Die Untersuchung widmet sich einem der umstrittensten und in dieser Komplexität wenig behandelten Felder des modernen Migrationsrechts. Die Autorin begreift Familienzusammenführung als ein europäisches Migrationsphänomen, das einer rechts- und länderübergreifenden sowie interdisziplinären Perspektive bedarf. Die Darstellung besitzt mit ihrer Zusammenführung von Völkerrecht, Europarecht und deutschem Verfassungsrecht mit Elementen der Politikwissenschaft Seltenheitswert. Im Zentrum stehen die aktuellen Entwicklungen in der EU. Die Entwicklung der Familienzusammenführungsrichtlinie wird vor dem Hintergrund völkerrechtlicher Verpflichtungen und nationaler Veränderungen kritisch untersucht. Dabei werden die Verhandlungspositionen zur Richtlinie vor dem Hintergrund des französischen, niederländischen und deutschen Nachzugsrechts analysiert. Des Weiteren erforscht die Autorin die Auswirkung dieses Europäisierungsprozesses für Unionsbürger einerseits sowie für Drittstaatsangehörige andererseits einschließlich der Gruppe der Asylberechtigten und Flüchtlinge und hinterfragt das Zuwanderungsgesetz 2007 auf Einhaltung der gemeinschaftsrechtlichen und internationalen Verpflichtungen

Die Verfasserin zeigt, dass die EU-Staaten sehr zurückhaltend in Bezug auf die Aufgabe von Kompetenzen sind, wenn es um die Einwanderung von Bürgern aus Drittstaaten geht. Die neue EU-Richtlinie zur Familienzusammenführung wird die Regelung der Familienzusammenführung nur in begrenztem Maße harmonisieren. In der Form, in der sie im September 2003 verabschiedet wurde, ist die Richtlinie nicht geeignet, ihr angebliches Ziel, die Förderung der Integration, zu erreichen. Hierfür sind die unterschiedlichen familiären Normen in Europa nur teilweise verantwortlich. Eine wichtigere Rolle spielt der Wunsch einzelner EU-Staaten, an ihren eigenen, restriktiven Einwanderungsbestimmungen festzuhalten. (ICEÜbers)

Background As effective antibiotics are becoming a scarce resource, governmental regulation is needed to promote responsible use. Implementation of antibiotic stewardship and practice guidelines in health care facilities seems to be crucial to this effort. Empirical studies suggest, however, that guidelines have limited influence on health professionals' behavior and practice. Barriers and facilitators to guideline implementability are much studied, but little attention has been given to health professionals' perceptions of normative acceptability of guidelines as a condition for compliance. The aim of the present study was first, to examine if and how aspects potentially promoting acceptability and compliance among clinical target users were addressed during development of Norwegian national guidelines for antibiotic use in hospitals and second, to identify procedural characteristics of the development process that were perceived by target users to yield legitimate guidelines. Methods Qualitative deductive thematic analysis was used. A theoretical framework inspired by the AGREE II Instrument and the Accountability for reasonableness framework assisted data gathering and interpretation. Archival data was collected and used to detail the guideline development process. Semi-structured, in-depth interviews with eight clinicians with extensive knowledge of the guidelines were carried out. Results Guideline development was characterized by i) broad agreement about scope and purpose, ii) broad involvement of stakeholders in the development process, iii) use of systematic methods to search for and apply evidence, iv) easily identifiable and specific recommendations, v) provision of tools on how to put recommendations into practice, and vi) editorial independence. Several procedural characteristics were perceived by the interviewees as promoting guideline legitimacy; i) diverse perspectives systematically involved in the process, ii) accessibility and transparency of the rationales for decision making, iii) opportunities for appeals and reconsiderations, and iv) regulative authority. Conclusions This study provides insights as to how guidelines that are intended to promote responsible use of antibiotics in hospitals can be carefully developed to facilitate perceptions of relevance, transparency, and authority by health professionals.

The purpose of this paper is to discuss the new scientific search service Google Scholar (GS). It aims to discuss this search engine, which is intended exclusively for searching scholarly documents, and then empirically test its most important functionality. The focus is on an exploratory study which investigates the coverage of scientific serials in GS. The study is based on queries against different journal lists: international scientific journals from Thomson Scientific (SCI, SSCI, AH), open access journals from
the DOAJ list and journals from the German social sciences literature database SOLIS as well as the analysis of result data from GS. All data gathering took place in August 2006. The study shows deficiencies in the coverage and up-to-dateness of the GS index. Furthermore, the study points out which web servers are the most important data providers for this search service and which information sources are highly represented. The paper can show that there is a relatively large gap in Google Scholar's coverage of German literature as well as weaknesses in the accessibility of Open Access content. Major commercial academic publishers are currently the main data providers. (author's abstract)
