La Convention de 1951 contient d'autres dispositions importantes relatives à l'expulsion de réfugiés, même dans un pays tiers où ils ne risquent pas d'être victimes de persécutions. Dans le cas des réfugiés se trouvant régulièrement sur leur territoire, l'expulsion ne peut être décidée que pour des raisons de sécurité nationale ou d'ordre public.

The 1951 Convention contains other important provisions relating to expulsion, even to a third country, not to a country where the person would be subject to persecution. In the case of refugees lawfully staying in the territory, expulsion shall only be resorted to for reasons of public order or national security.

Dans la Charte des Nations Unies, l'expression «encourager le respect des droits de l'homme et les libertés fondamentales», qui revient fréquemment, est suivie des mots: «pour tous, sans distinction de race, de sexe, de langue ou de religion,…». A l'échelon de l'Etat, on distingue généralement entre ressortissants, d'une part, et, d'autre part, les étrangers, cette dernière catégorie englobant un sous-groupe, celui des réfugiés, dont le statut est particulièrement précaire en droit international coutumier. Car, en droit international traditionnel, le concept de nationalité est considéré comme le lien entre l'individu et le droit international. Dans les dernières éditions de son ouvrage, qui fait autorité en la matière, Oppenheim qualifie la nationalité de «lien principal».

Wherever the United Nations Charter refers to promoting and encouraging respect for human rights and for fundamental freedoms, it refers to human rights and fundamental freedoms for all without distinction as to race, sex, language or religion. Within a State one distinguishes normally between nationals and aliens. But among the aliens there is a particular group—the refugees—whose position in traditional customary international law is especially precarious. This is due to the fact that in classic international law nationality is considered as the link between the individual and international law. In later editions of Oppenheim's leading textbook on International Law it is called the principal link.

De même que la Déclaration Universelle des droits de l'homme proclame l'importance fondamentale des droits de tous les hommes, de même la Convention Européenne des droits de l'homme vise à assurer à toute personne relevant de la juridiction des Hautes Parties Contractantes les droits et libertés qu'elle contient. Cet objectif consistant à assurer l'application générale de la protection de la Convention, est poursuivi dans les Protocoles à la Convention, qui ajoutent de nouveaux droits à ceux qui y sont déjà incorporés.
