This contribution identifies the main sources of approximation of penal laws between the Member States of the European Union and underlines the serious limits affecting it. It then focuses on the different functions that the approximation of penal laws plays in the establishment of an area of freedom, security and justice, suggesting that these functions are currently undervalued and that this underplaying undermines the ability to achieve this general and fundamental objective the Treaty of Amsterdam has conferred upon the Union.

The introduction of the Euro carries the risk of counterfeit. Protection of the Euro within the EU cannot be achieved through existing international instruments or internal systems implemented by member states. More than any other matter, this illustrates the insufficient cooperation about penal matters among member states. How can member states accept the progressive abandonment of their specific national currency in favor of the Euro, but remain steadfast in regard to their penal powers? This paradox is more important than the disparity of judicial systems from the material & procedural point of view, namely the multiplicity of the authorities of pursuit, & the difficulties to efficiently fight against the counterfeit of the Euro, which includes considerable risks to the single monetary policy. "This book examines the varied competences of the European Union (EU) in relation to its capacity to externalize its policy preferences. Specifically, it explores the continued resilience within the EU's policy toolbox of supranational modes of governance beyond the State. The book first situates European experiences of supranationality in relations to the wide variety of regional and global modes of governance it comes into contact with when seeking to deal with an increasingly complex and fragmented international environment. Over the course of its subsequent sections, the book analyses the resilience, flexibility and adaptability of the EU's supranational practices across a significant cross-section of policy fields, for example, Area Freedom of Justice, Justice and Security; Socio-economic Governance; or Trade Policies. Overall, these chapters unpack the impact of the EU's internal institutional complexity on the EU's external capacity to export its preferences in an increasingly fragmented international environment. This in turn, sees the book also question whether the EU has the institutional tools to guarantee and implement consistency between its internal and external policies.
