Ketentuan Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas yang mewajibkan Perseroan Terbatas khususnya yang bergerak dalam bidang Sumber Daya Alam untuk menyalurkan Tanggung Jawab Sosial dan Lingkungan atau secara luas dikenal sebagai Corporate Social Responsibility, merupakan sebuah hal baru yang menimbulkan perdebatan. Pada satu sisi Perusahaan sebagai entitas bisnis bertujuan untuk menghasilkan laba yang sebesar-besarnya, namun pada sisi lain sebagai entitas yang ada di tengah-tengah masyarakat Perusahaan pun harus memperhatikan kondisi sekelilingnya. Perkembangan ajaran mengenai tata kelola perusahaan yang baik atau good corporate governance yang salah satu prinsip pokoknya adalah tanggung jawab, kemudian memberikan pengaruh mengenai tujuan perusahaan itu sendiri. Pola perusahaan yang mengejar sebesar-besarnya keuntungan perlahan bergeser menjadi perusahaan yang bertanggung jawab terhadap usahanya dalam mengejar profit. Ditinjau dari perspektif Politik Hukum, aturan mengenai kewajiban Perusahaan menyalurkan Tanggung Jawab Sosial dan Lingkungan merupakan sebuah upaya pembuat aturan untuk mewujudkan cita-cita hukumnya atau dalam teori hukum pembangunan dimaknai sebagai sebuah social engineering untuk mewujudkan perusahaan yang baik.

Indigenous peoples' participation in public policy and planning is ascribed in numerous international and national legal instruments as essential to the realisation of their self-determination. This study examines how the Akwé: Kon guidelines (AK) can promote effective indigenous peoples participation in environmental management, especially during environmental impact assessment (EIA). Special focus is drawn on the Finnish context, home of the Sámi indigenous people. The study applies an effectiveness review package by Lee and Colley (1999), supplemented by interview and questionnaire surveys, to analyse how effective the AK have been. It was found that although they were useful in promoting further interaction of the Sámi with authorities, the AK did not address their most fundamental political and legal grievances. This leaves room for EIA policy and practice, in Finland and all other jurisdictions with indigenous peoples, to consider how they can more effectively harness the potentialities in AK.

ABSTRACT By the end of 2016, Banyumas local government decided to shut down Tempat Pembuangan Akhir Gunung Tugel. The purpose of this paper is to show the failure of Banyumas local government to deal with the social change they made and to show legal and sociological excess caused by that failure. From a methodological standpoint, this paper operates both normative and socio-legal approaches. The results are, first, Banyumas local government unable to deal with the social change they made. Second, Banyumas local government needs a new Peraturan Daerah to substitute the prior Peraturan Daerah to improve garbage management. RESUMEN A finales de 2016, el gobierno local de Banyumas decidió cerrar Tempat Pembuangan Akhir Gunung Tugel. El propósito de este artículo es mostrar el fracaso del gobierno local de Banyumas para hacer frente al cambio social que hicieron y mostrar el exceso legal y sociológico causado por ese fracaso. Desde el punto de vista metodológico, este trabajo opera con un enfoque tanto normativo como socio-legal. El resultado es, primero, que el gobierno local de Banyumas no puede hacer frente al cambio social que hicieron. En segundo lugar, el gobierno local necesita un nuevo Peraturan Daerah para sustituir al Peraturan Daerah anterior para mejorar la gestión de basura.

In 1994, binge eating disorder (BED) was introduced as a disorder requiring further study in the American Psychiatric Association's Diagnostic and Statistical Manual of Mental Disorders, fourth edition ( DSM-IV). It is now listed as a distinct eating disorder in the DSM-5, along with bulimia nervosa and anorexia nervosa. This article summarizes the information currently available on BED, so social workers will be knowledgeable as they work with clients with obesity, BED, and other eating disorders. Diagnostic criteria for BED are reviewed, as well as changes in the criteria since the diagnosis was first introduced. Prevalence estimates, available assessment instruments, and comorbidity are discussed. An overview of the systematic reviews and meta-analyses that have examined the treatment of clients meeting the criteria for BED is presented, and, finally, questions and issues that have been suggested for future research are offered.
Bali Governor Regulation No. 97 of 2018 concerning Limitation of Disposal of Disposable Plastic Waste has an impact that makes the Bali Local Government a dilemma. This is quite reasonable considering that on one hand the Local Government of Bali should preserve the environment, so the human right to a healthy environment can be achieved. But on the other side, with the issuance of Bali Governor Regulation No. 97 of 2018 concerning Limitation of Disposable Plastic Waste Disposal has an impact on the reduced income earned by plastic bag manufacturers. This study aims to understand the objectives to be achieved with the issuance of Bali Governor Regulation No. 97 of 2018 concerning Limitation of Disposable Plastic Waste Disposal and to know the environmental costs as a solution to the pollution of disposable plastic waste. This research is a normative study using a statutory approach. In this study, the authors found that the basis for consideration of the Bali Governor's Regulation Number 97 of 2018 concerning Limitation of Disposable Plastic Waste Disposal is a manifestation of the provisions of Article 12 paragraph (3) and Article 13 paragraph (2) of the Bali Provincial Regulation Number 5 of 2011 concerning Management Rubbish. The policy was then concretized in the provisions of Article 2 of the Bali Governor Regulation No. 97 of 2018 concerning Restrictions on the Arising of Plastic Waste. The aim is to preserve the environment. Environmental costs can be applied as an alternative in handling disposable plastic waste. Through internalization of the environmental costs of plastic bag businesses, businesses can still sell plastic bags, however, the price of plastic bags is increased from the original price. The profits are not taken entirely by businesses, but go to the local treasury to be used by the Provincial Government of Bali for handling disposable plastic waste for environmental maintenance purposes. Peraturan Gubernur Bali Nomor 97 Tahun 2018 tentang Pembatasan Timbulan Sampah Plastik Sekali Pakai membawa dampak yang membuat Pemerintah Daerah Bali menjadi dilema. Hal ini cukup beralasan mengingat di satu sisi Pemerintah Daerah Bali memiliki kewajiban untuk menjaga kelestarian lingkungan, sehingga hak asasi terhadap lingkungan yang sehat dapat tercapai. Namun disisi lain, dengan dikeluarkannya Peraturan Gubernur Bali Nomor 97 Tahun 2018 tentang Pembatasan Timbulan Sampah Plastik Sekali Pakai membawa dampak terhadap berkurangnya pendapatan yang diperoleh oleh produsen kantong plastik. Penelitian ini bertujuan untuk memahami tujuan yang hendak dicapai dengan dikeluarkannya Peraturan Gubernur Bali Nomor 97 Tahun 2018 tentang Pembatasan Timbulan Sampah Plastik Sekali Pakai serta mengetahui biaya lingkungan sebagai solusi terhadap pencemaran sampah plastik sekali pakai. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan. Dalam penelitian ini, penulis menemukan bahwa dasar pertimbangan Peraturan Gubernur Bali Nomor 97 Tahun 2018 tentang Pembatasan Timbulan Sampah Plastik Sekali Pakai merupakan pengejawantahan dari ketentuan Pasal 12 ayat (3) dan Pasal 13 ayat (2) Peraturan Daerah Provinsi Bali Nomor 5 tahun 2011 tentang Pengelolaan Sampah. Kebijakan tersebut kemudian dikonkretkan dalam ketentuan Pasal 2 Peraturan Gubernur Bali Nomor 97 Tahun 2018 tentang Pembatasan Timbulan Sampah Plastik. Tujuannya adalah menjaga kelestarian lingkungan. Biaya lingkungan dapat diterapkan sebagai alternatif dalam penanganan sampah plastik sekali pakai. Melalui internalisasi biaya lingkungan pelaku usaha kantong plastik tetap dapat menjual kantong plastik namun, harga kantong plastik dinaikkan dari harga semula. Keuntungannya tidak diambil seluruhnya oleh pelaku usaha, namun masuk ke kas daerah yang akan digunakan oleh Pemerintah Daerah Provinsi Bali untuk penanganan sampah plastik sekali pakai untuk tujuan pemeliharaan lingkungan.
