Responsibility, Restoration and Fault suggests how we could measure responsible behaviour. What criteria do our actions have to abide by to protect individuals and society? This is particularly relevant in a period where modern technology has not only multiplied the risks and degree of damage, but also created long causal chains that often make it difficult to see a connection between action and damage, and when the damaging effects on individuals or society only emerge decades later. The author argues that a person's behaviour is responsible if the following criteria are fulfilled simultaneously: (i) the person, whose behaviour could cause damage, would be able to restore the victim, (ii) the person, whose behaviour causes actual damage, restores the victim (both criteria of restoration) and (iii) the person is not at fault when determining and executing an act (criteria of fault). Am Anfang und am Ende des Lebens stehen zahlreiche Fragen, die in den Grenzbereichen zwischen Recht, Philosophie und Theologie zu kontroversen Diskussionen führen. Nicht nur diese Disziplinen, sondern auch die (medizinische) Praxis sieht sich hier regelmäßig mit Problemen konfrontiert. Einen Überblick über den aktuellen Forschungsstand bieten die Referate der Tagung 'Ethik und Recht in der Bioethik' an der Universität Luzern: Sie beleuchten Themen von der Präimplantationsdiagnostik über die Reproduktionsmedizin und die Forschung am Menschen bis hin zum Hirntod und zur Organtransplantation, zu Sterbehilfe und Patientenverfügungen. DieAufsätze erschließen dabei den aktuellen Forschungsstand, hinterfragen bestehende Annahmen und entwickeln neue Ansätze.De nos jours, l'on se pose de nombreuses questions en corrélation avec le début et la fin de la vie humaine. Ces questions fondamentales situent (souvent) le débat théorique aux frontières de plusieurs disciplines dont le droit, la philosophie et la théologie. Mais aussi la pratique notamment médicale est directement concernée. Le colloque « Ethique et droit dans la bioéthique » qui s'est déroulé à l'Université de Lucerne donne un aperçu actuel de la recherché: Les orateurs ont abordés des thèmes tels que le diagnostique génétique préimplantatoire en lien avec la médecine de reproduction, la recherche sur l'homme dans sa période de fin de vie, ainsi que la mort cérébrale et l'euthanasie, la transplantation d'organes ou encore les directives anticipées. Les contributions reprennent non seulement les conclusions de l'état actuel de la recherche mais posent aussi un ?il critique sur les développements et perspectives à venir.
