The paper aims to characterize and evaluate the immigration policy of the European Union in the context of the challenges posed by regular and irregular migration processes on a global and regional scale. The EU policy is in line with the United Nations (UN) initiatives aimed at international cooperation in solving migration problems. The provisions of the treaties share powers in EU immigration policy between its institutions and member states. The harmonization of activities in this area is carried out through the implementation of directives adopted at various times and related to limited areas of immigration policy, hence its fragmented nature. The 2015 migration crisis posed new challenges to the EU's immigration policy and revealed conflicts of interest between individual member states. Nevertheless, the EU is taking steps to build a comprehensive approach to migration, asylum, integration, and border management (The New Pact on Migration and Asylum). The Lisbon Treaty gives the European Union (EU) institutions new external competences, including foreign direct investment (FDI) in the common trade policy. Using these competences the European Commission formulated a proposal for a regulation establishing the screening framework for FDI, which entered into force in April 2019. The aim of this paper is to discuss the issue of FDI screening as an element of policies towards FDI applied by developed countries, to assess the justifications for its introduction, as well as the potential consequences of the screening framework for inflowing FDI into the EU. A need to protect the EU's strategic economic interests in relations with third countries was the reason for the introduction of the new tool at the EU level. The new system of screening FDI inflows into the EU is not centralized. The right to screen remains the sole responsibility of the Member States. The co-ordination mechanism at the level of the EU which has been constructed seems to give guarantees that common interests will be protected. The economic and political consequences of the EU's screening framework for FDI should be foreseen. Apart from administrative and compliance costs, as well as uncertainty and delays related to investment decision processes, two categories of potential consequences seem to be important. These are the expected reduced access to capital by some Member States, especially the 'new' ones, and the worsening of relations with external partners, especially China. ; Traktat Lizboński nadał instytucjom Unii Europejskiej (UE) nowe kompetencje w stosunkach zewnętrznych, włączając bezpośrednie inwestycje zagraniczne (BIZ) do wspólnej polityki handlowej. Wykorzystując te kompetencje Komisja Europejska sformułowała propozycję regulacji ustanawiającej ramy dla screeningu BIZ, która weszła w życie w kwietniu 2019 r. Celem niniejszego artykułu jest dyskusja nad kwestią screeningu jako elementu polityki wobec inwestorów zagranicznych, prowadzonej przez kraje rozwinięte, ocena uzasadnienia wprowadzenia screeningu oraz jego potencjalnych konsekwencji dla napływu BIZ do UE. Przyczyną wprowadzenia nowego instrumentu na poziomie UE była potrzeba ochrony strategicznych ekonomicznych interesów UE w stosunkach z krajami trzecimi. Nowy system screeningu BIZ napływających do UE nie jest scentralizowany. Prawo do screeningu pozostaje w wyłącznej kompetencji krajów członkowskich. Jednak mechanizm koordynacji na szczeblu UE wydaje się dawać gwarancję, że wspólne interesy będą chronione. Należy spodziewać się, że nowa regulacja przyniesie ekonomiczne i polityczne konsekwencje. The aim of this paper is to discuss new trends that have occurred in the policies of the EU and China towards foreign direct investment (FDI), to examine some implications of the EU‑China Comprehensive Agreement on Investment (CAI) – which is currently being negotiated – for their bilateral relations, and to assess the role which China's "One Belt One Road' (OBOR) initiative might play in its relations with the new EU Member States. The EU established freedom of capital movement with third countries; however, the introduction of the common investment policy has encountered some obstacles. These are related to investor protection and ISDS issues. In turn, China is carrying out an independent state policy towards foreign investment with limited liberalization of FDI flows. The negotiated EU‑China CAI is expected to create conditions conducive to bilateral foreign investment flows, and it might bring positive effects for their economies in the future. However, the progress made thus far in the negotiations is still limited. The relations between China and the new EU Member states (CEE countries) are characterized by common interests in the field of FDI flows. The new EU countries are interested in attracting Chinese FDI and seem not to show the fears that have arisen in the old EU countries. ; Celem artykułu jest analiza nowych tendencji w polityce Unii Europejskiej (UE) i Chin wobec bezpośrednich inwestycji zagranicznych (BIZ), dyskusja nad niektórymi implikacjami Wszechstronnej Umowy o Inwestycjach, negocjowanej między UE i Chinami, dla ich wzajemnych stosunków oraz ocena roli chińskiej inicjatywy "One Belt One Road' (OBOR) w odniesieniu do nowych krajów członkowskich UE. Unia Europejska ustanowiła swobodny przepływ kapitału w stosunkach z krajami trzecimi, jednak wprowadzenie wspólnej polityki wobec inwestycji zagranicznych napotyka na przeszkody, które są związane z kwestiami ochrony inwestorów i rozstrzygania sporów między inwestorami a państwem (ISDS). Chiny prowadzą natomiast niezależną politykę wobec inwestycji zagranicznych, z pewnymi posunięciami liberalizacyjnymi wobec BIZ. The Transatlantic Trade and Investment Partnership (TTIP) is a controversial subject, but at the same time it is perceived to be the most comprehensive international agreement on free trade and investment protection. Among the topics that evoke criticism on the part of different social groups is the investor-state dispute-settlement (ISDS), as well as its legal consequences for the EU Member states. A less discussed issue is the potential implications of the agreement on the state of economic co-operation between the European Union and the USA in the field of investment flows, with special reference to foreign direct investment (FDI). The aim of this paper is to present the discussion related to the ISDS and examine some of the economic, political and legal implications of TTIP provisions for FDI flows between the EU and the USA. The proposals of the European Commission to change the investment protection system might be treated as an attempt to make the system of arbitrage more transparent and convincing to societies, and safer for states. The effects of the TTIP agreement for FDI between both partners might be dependent on the scale of trade creation and diversion effects, and the mirror effects of investment creation and diversion under a free trade area.

Mniej dyskutowaną kwestią są natomiast potencjalne implikacje porozumienia dla ekonomicznej współpracy między Unią Europejską a USA w dziedzinie przepływów inwestycji, a szczególności bezpośrednich inwestycji zagranicznych (BIZ). Celem artykułu jest przedstawienie dyskusji dotyczącej ISDS i zbadanie wybranych ekonomicznych, politycznych i prawnych implikacji postanowień TTIP dla przepływów BIZ między partnerami. Propozycja Komisji Europejskiej, aby zmienić procedury ochrony inwestycji i rozstrzygania sporów, może być traktowana jako próba stworzenia bardziej transparentnego systemu, akceptowalnego dla różnych grup społecznych i bezpieczniejszego dla państw członkowskich. Efekty porozumienia dla BIZ między UE a USA mogą zależeć od efektów kreacji i przesunięcia handlu oraz "lustrzanych" efektów w sferze inwestycji.

The aim of the paper is to determine the current state of the integration processes in the global economy and prognosticate on the foreseeable changes in this phenomenon in the upcoming. Will they be divergence from or continuity with the past trends in the global economy in this field? The article examines three regional integration groupings, i.e. the European Union, ASEAN Economic Community, and NAFTA. The analysis makes it possible to conclude that all of these groupings/organizations are encountering some problems. In the case of the EU, these are mainly: the two - speed integration process as far as a monetary union is concerned; serious negative consequences of the global financial crisis for the socio-economic cohesion of the EU-28; as well as a worsening position in the world trade in goods and services and in the total global gross capital inflows. The problems of the ASEAN Economic Community seem to be connected with some discrepancies between the political will in favour of deepening integration among member states and the real economic difficulties involved in attaining higher stages of integration among a group of countries extremely differentiated in their economic development. NAFTA's problems also lie in the asymmetrical development between member states, as well as in the lessening importance of the integration within the organization for the member states, which results from the putting into effect numerous other FTAs. The growing openness of all the analyzed integration groupings, being in line with the globalization process, seems to be a future characteristic of integration processes in the global economy.

Czy będzie to odejście od dotychczasowych trendów, czy też ich kontynuacja? Przedmiotem analizy są trzy ugrupowania integracyjne, tj. Unia Europejska (UE), Wspólnota Gospodarcza ASEAN oraz NAFTA. Przeprowadzona analiza pozwala wnioskować, iż wszystkie te ugrupowania napotykają na problemy. W przypadku UE są to: integracja o dwóch prędkościach w odniesieniu do unii monetarnej, poważne negatywne konsekwencje globalnego kryzysu finansowego dla spójności społeczno-gospodarczej UE-28, jak również pogorszenie pozycji w światowym handlu dobrami i usługami oraz światowym napływie kapitału. Problemy ugrupowania ASEAN wydają się wiązać z rozbieżnością między polityczną wolą pogłębiania integracji pomiędzy krajami członkowskimi a realnymi ekonomicznymi możliwościami osiągania wyższych etapów integracji przez grupę krajów poważnie różniących się poziomem ekonomicznego rozwoju. Problemy NAFTA sprowadzają się także do asymetrii w rozwoju między krajami członkowskimi i zmniejszającym się znaczeniu integracji w ramach tego ugrupowania dla jego członków. Powodem jest wchodzenie w życie licznych innych stref wolnego handlu, których członkami są kraje NAFTA. Postępujące otwieranie się ugrupowań integracyjnych, zgodne z procesami globalizacji, wydaje się cechą charakterystyczną współczesnych procesów integracyjnych w gospodarce światowej.
