In 'The Fairness Dilemma' in Sharing the Nile Waters', Zeray Yihdego enquires into the fairness dilemma in connection with the construction of the Grand Ethiopian Renaissance Dam (GERD) in light of relevant colonial-era Nile treaties, post-1990 Nile framework instruments, and international watercourses law. The GERD is now a 'fait accompli', but fairness considerations will continue to be vital issues during its construction, filling, and operation. This monograph argues that the GERD is a symbol of a fair share of the Nile waters by Ethiopia, the realization of which depends on, 'inter alia', an appropriate economic return, and prevention of significant impacts. Yihdego articulates the lessons that can be applied to public international law and suggests a process to address the issue of unfair agreements, arguing that, although the principle of fairness's application can be complex, the notions of procedural fairness and distributive justice can define and delineate the principle with reference to a specific treaty regime.--Page 4 of cover

Implementing International Watercourses Law through the WEF Nexus and SDGs: An Integrated Approach Illustrated in the Zambezi River Basin offers an innovative approach to the governance of shared watercourses and the implementation of international water law through the Law, Nexus and Goals (LNG) approach. By looking at policy frameworks such as the WEF nexus and global development agendas such as the SDGs, the monograph provides a method of integration for holistic water governance. In order to demonstrate this approach, a case study of the Zambezi River Basin is used, through which the monograph not only exemplifies the approach taken, but also provides a detailed account of the legal and policy frameworks within the basin. Readership: Of particular interest to international water law professionals, policy makers, academics and students. Also, potentially of interest to those interested in international environmental or natural resources law more generally.

The project takes a multi- and interdisciplinary approach to the formation of a decision analytical framework (DAF) for participatory and integrated planning, to allow the evaluation of decisions based on social, economic and environmental needs, therefore reflective of sustainable development. Somalia has been without government since 1991. A transitional government was established in 2004 under the presidency of Abdullahi Yusuf, with the backing of the United Nations, the African Union (AU), the Arab League and the Inter-governmental Agency for Development (IGAD). The Government sat in Baidoa in southern Somalia from June 2005 until December 2006. In June 2006 the Union of Islamic Courts (UIC) took control of much of southern and central Somalia, including the capital, Mogadishu, but not Puntland and Somaliland. They declared and tried to establish an Islamic State. Somalis were told to comply with stringent Islamic rules or face harsh punishment. In the meantime, efforts to achieve national reconciliation were ongoing under the auspices of IGAD, though without much success. It was reported that on 20 July 2006 Ethiopian troops crossed into Somalia. Ethiopia only admitted to having military trainers to help the Somali Government (estimated to be 400 military personnel). On 21 July, the UIC declared a 'holy war' against Ethiopia. In September 2006 the Somali interim President survived an assassination attempt in Baidoa. On 25 October 2006 Ethiopia said that it was 'technically at war' with the Islamic Courts. After few days the UIC claimed to have ambushed and killed Ethiopian troops near the Ethiopian border.1

This first volume of EtYIL focuses on issues concerning the developing world in general and (the Horn of) Africa - and Ethiopia - specifically. It argues that rebalancing the international law narrative to reflect Africa's legitimate interests is an urgent priority, and can only succeed through the fair representation of African countries in the creation and interpretation of international law. The book begins by reflecting on the ICJ's West African Cases and provides a unique perspective on decolonisation as a source of jus cogens and obligations erga omnes. This is followed by a comprehensive analysis of the reception of international law in the Ethiopian legal system, and of the potential implications of Ethiopia joining the WTO. The book then delves into such topical issues as the relationship between competition for natural resources and international investment law, the UN Global Goals and the fledgling international climate change regime, with particular emphasis on the Paris Climate Agreement and their implications for developing countries. Further issues include the Declaration of Principles on the Grand Ethiopian Renaissance Dam signed by Ethiopia, Sudan and Egypt in light of Nile colonial treaties and contemporary international watercourses law, as well as selected legal implications of the armed conflict in South Sudan. Gathering high-quality scholarship from diverse researchers, and examining a constellation of critical international law issues affecting developing countries, especially African countries, the book offers a unique resource.
