El Profesor Yoon realiza un estudio descriptivo de la influencia que ha tenido la historia del pueblo coreano y su cultura en la conformación del sistema jurídico de ese país. Concluye afirmando que ninguna ley podrá funcionar en un contexto histórico distinto si no es adaptada a esa propia realidad y propugna una actitud aperturista que promueva la fusión de culturas y facilite la modernización de las sociedades. ; Professor Yoon thoroughly describes the influence of Korean history and culture on the formation of this country s legal system. His ideas are also useful to perceive the pecularities of other East Asian legal systems, in countries which share similar historical backgrounds, namely the influence of Confucianism, the Japanese invasion and the ideas imposed on them by the USA after the Second World War. The author asserts that "law is not a fixed entity but a phase in the dynamic development of legal practice in the context of other human activities". This Essay examines constitutionalism, or the legal expression of democracy. Explanations of Korea's underdeveloped sense of constitutionalism which are rooted in the culture of Confucianism do not provide an adequate explanation of the post-1948 Korean experience. A better model is provided by contrasting the uses of law by prior authoritarian regimes with current political developments including the rising role of entrepreneurial interests in Korean politics.

Though the North Korean nuclear issue has resurfaced- subsequently restraining inter-Korean cooperation-this impasse has not fettered the South Korean government in such a way that it cannot maneuver to improve the ROK-DPRK relationship. Seoul must take small steps to solve individual problems in the North-South relationship, and methodically prepare for systematic advances in inter-Korean relations once the nuclear impasse is settled. Furthermore, Seoul must focus on both quantitative and qualitative improvements in the inter-Korean relationship, look more at economic cooperation that emphasizes mid- to long-term development of North Korea, and concentrate on developing a blueprint for the North's recovery that acknowledges greater involvement from regional actors.
