CONSTITUTIONAL COMPLAINT IN UKRAINE: CERTAIN ISSUES OF EFFICIENCY AS A MEANS OF PROTECTION OF FUNDAMENTAL RIGHTS ; КОНСТИТУЦІЙНА СКАРГА В УКРАЇНІ: ОКРЕМІ ПИТАННЯ ЕФЕКТИВНОСТІ ЯК ЗАСОБУ ЗАХИСТУ ОСНОВНИХ ПРАВ
The article analyzes the effectiveness of the institution of constitutional complaint in Ukraine in the context of reviewing court decisions in exceptional circumstances, compensation for damage caused by unconstitutional acts, retroactive effect of decisions of the Constitutional Court of Ukraine, ensuring balance with res judicata. It turns out that the effectiveness of the constitutional complaint in Ukraine as a means of protecting the rights of the individual is determined by its legal consequences, which should occur based on the provisions of procedural law (this is the right to resume consideration in the form of review of exceptional circumstances). However, unfortunately, the current mechanism is not well thought out, and the practice of its application is extremely confusing and contradictory. The necessity of fixing an adequate model of action of decisions of the Constitutional Court of Ukraine in time, execution of court decisions and their review under exceptional circumstances at the legislative level is substantiated. It is concluded that there should be restrictions on the review of final court decisions, especially by persons. Perhaps this should be just a certain individual reward for the person who filed a constitutional complaint. Moreover, such a reward (or "award") is in good agreement with the model of regulatory complaint and with its help it will be possible to maintain a balance of legal certainty and material justice. This also requires some differentiation in the review of exceptional circumstances depending on the specifics of the proceedings. It is proposed to distinguish between the approaches to be applied in civil and commercial proceedings, as well as in the application of the Code of Administrative Procedure. ; У статті аналізується ефективність реалізації інституту конституційної скарги в Україні в контексті перегляду судових рішень за виключними обставинами, відшкодування шкоди, завданої неконституційними актами, зворотної сили рішень Конституційного Суду України, забезпечення балансу із принципом res judicata. Доводиться, що ефективність конституційної скарги в Україні як засобу захисту прав особи визначається її юридичними наслідками, які мають наставати виходячи з положень процесуального законодавства (мова йде про право на поновлення розгляду у вигляді перегляду рішення за виключними обставинами). Проте, на жаль, чинний механізм є недостатньо продуманим, а практика його застосування вкрай заплутаною і суперечливою. Обґрунтовується необхідність закріплення адекватної моделі дії рішень Конституційного Суду України в часі, виконання судових рішень і їх перегляду за виключними обставинами на законодавчому рівні. Робиться висновок про те, що мають існувати обмежувачі щодо перегляду остаточних судових рішень, передусім, за колом осіб. Можливо, це має бути певною індивідуальною винагородою особі, яка звернулася із конституційною скаргою. Тим більше, що така винагорода (або ж «премія») непогано узгоджується із моделлю нормативної скарги і за її допомогою вдасться дотриматися балансу правової визначеності і матеріальної справедливості. При цьому потрібна також певна диференціація щодо перегляду за виключними обставинами залежно від специфіки процесуальних проваджень. Пропонується розмежовувати підходи, що мають застосовуватися у цивільному і господарському процесі, а також в рамках застосування Кодексу адміністративного судочинства.
