This paper analyses and makes a critical balance of the Chilean constitutional reform project, sent by the President of the Republic to the Senate. The objective of the constitutional reform project is to elaborate a democratic New Constitution, in contrast to the current constitution that is a product of an institutional rupture. To do that there was a participatory process of citizenship that culminates with the "Citizens Bases for a New Constitution", also, an Indigenoues Constituent Process was made. ; El presente artículo analiza y realiza un balance crítico del proyecto de reforma constitucional chileno enviado al Senado por la Presidenta de la Republica. El proyecto de reforma constitucional tiene por objetivo elaborar una Nueva Constitución de manera democrática, en contraste con nuestra actual Constitución que fue producto de una ruptura institucional. Para ello hubo un proceso participativo de la ciudadanía que culminó con "las Bases Ciudadanas para una Nueva Constitución", a su vez, se realizó un Proceso Constituyente Indígena.

Prolegomena In the context of the "Constitutional Reform" of 2005 promulgated by Law No. 20,050, we are summoned to expose again about the instruments or institutes of cognition, inspection and parliamentary political control of the Chamber of Deputies, whose purpose is to strengthen the improperly called "supervisory power of said corporation, especially the interpellations and their infra-constitutional normative development by the Regulations of the Chamber of Deputies. This monographic approach is pertinent, since the national doctrine fully addresses the configuration of our National Congress and its functions , but the monographic study of the aforementioned "control power" is absent. ; 1. Prolegómenos En el contexto de la "Reforma Constitucional" de 2005 promulgada mediante Ley N° 20.050 se nos convoca a exponer nuevamente acerca de los instrumentos o institutos de cognición, inspección y control político parlamentario de la Cámara de Diputados, que tienen por finalidad fortalecer la impropiamente denominada "potestad fiscalizadora de dicha corporación, en especial las interpelaciones y su desarrollo normativo infraconstitucional por el Reglamento de la Cámara de Diputados. Este abordaje monográfico es pertinente, ya que la doctrina nacional aborda de modo completo la configuración de nuestro Congreso Nacional y sus funciones, pero está ausente el estudio monográfico de la mencionada "potestad fiscalizadora"

The institutionalization of the Citizen Defender (Ombudsman) encounters a series of practical difficulties; namely: a certain "ombudsmanship" (Rivero) that afflicts certain supporters of the institution, and the criticism of the institution's critics who, giving an account of the sufficiency of controls over the administration, allude to the cultural, political and historical uprooting of the Ombudsman and therefore a certain snobbery towards an "exotic" institution, something like "importing elephants to pull sleds in polar lands". ; La institucionalización del Defensor del Ciudadano (Ombudsman) tropieza con una serie de dificultades prácticas; a saber: una cierta "ombudsmanía" (Rivero) que aqueja a ciertos partidarios de la institución, y el reproche de los críticos de la institución que dando cuenta de la suficiencia de controles sobre la administración aluden al desarraigo cultural, político e histórico del Ombudsman y por tanto cierto esnobismo ante una institución "exótica", algo así como "importar elefantes para tirar trineos en tierra polares".

El Parlamento moderno constituido con posterioridad a la revolución francesa o a la gloriosa revolución inglesa asume como funciones tradicionales: función legislativa, función financiera, función fiscalizadora y funciones jurisdiccionales-políticas.

Economic Constitution is an "old-new" category of Constitutional Law, old in European dogmatics and new in our "constitutional dogmatics"; since the wrong category of "Economic Public Order" is frequently used, disciplinary taken from Economic Law. The Economic Constitution (EC) is an old category used by Beckerath in 1933 in a tribute to W. Sombart, in the context of the Weimat Economic Constitution, which reflects a "liberal-socialist" ideology, that is, a set of rules fundamental laws that enshrine values and principles that must govern the economic activity of the State and private companies (formal sense); fundamental legal norms that account for a closed or open constitutional ideology linked to the dominant economic system (material sense). The foregoing means building the category of Economic Constitution on the denial of the "ideological neutrality" of the State Constitution, and therefore the search in German dogmatics for categories of "security" or guarantees against progressive or revolutionary ideologies as occurs with the categories of "institutional guarantee" and "institute guarantees". The Spanish legal scholar Manuel García Pelayo, after fully living the 20th century, died in Caracas, Venezuela in 1991, a country that received him during a long exile, after a journey that began in Argentina and continued in Puerto Rico, an exile that It begins at the beginning of the 50s, since he did not accept the internal exile that being in the defeated Republican side in which he served as an Army officer and having belonged to the category of prisoner of war offered him. García Pelayo was solidly and eruditely trained in Vienna and Berlin, early professing university teaching in Spain before the Civil War, getting to know first hand the great iuspublicists of the time and the great debates of the Weimar era, and also knowing the crisis of the new republics of the first postwar period and the rise of European fascism, and the second great war and its consequences. ; El iuspublicista español Manuel García Pelayo, después de vivir plenamente el siglo XX, falleció en Caracas, Venezuela en 1991, país que lo recibió durante un largo exilio, después de un periplo que se inicia en Argentina y sigue en Puerto Rico, exilio que se inicia a principios de la década del 50, ya que éste no aceptó el exilio interior que le deparaba estar en el derrotado bando Republicano en que sirvió como oficial del Ejército y haber pertenecido a la categoría de prisionero de guerra. Opening fire in the constitutional-constituent debate by exposing the "bases" of a new Constitution for Chile and the new political-constitutional ideas, presents as a challenge to propose the strong ideas of a center-left constitutional discourse forged for a long time, from the remote criticism formulated in 1980 by the Constitutional Studies Group to the 1980 Constitution and the great fraud that gave birth to it, and that at the same time as a constitutional discourse it must be contemporary and ideologically open to modern ideas, connecting all of this with our reality historical-political. In this sense there are no models or transitions or institutional arrangements to copy. ; Abrir fuego en el debate constitucional-constituyente exponiendo las "bases" de una nueva Constitución para Chile y las nuevas ideas político-constitucionales, presenta como desafío plantear las ideas fuerza de un discurso constitucional de centro-izquierda fraguado durante largo tiempo, desde la remota crítica formulada en 1980 por el Grupo de Estudios Constitucionales a la Constitución de 1980 y el gran fraude que la vio nacer, y que al mismo tiempo en cuanto discurso constitucional debe ser contemporáneo e ideológicamente abierto a las ideas modernas, conectando todo ello con nuestra realidad histórico-política. En este sentido no hay modelos ni transiciones ni de arreglos institucionales a copiar.

The article analyzes judicial activism, based on a pretext that is to comment on Lambert's work, which will exercise a powerful influence in France in terms of judicial review of the law, and which allows some "lessons from a classic" to be drawn; in the contemporary perspective, in light of the old dogma of the "separation of powers" and the fundamental decisions about the rule of law and democracy. ; El artículo analiza el activismo judicial, a partir de un pretexto que es comentar la obra de Lambert, que ejercerá en Francia una poderosa influencia en materia de revisión judicial de la ley, y que permite extraer algunas "lecciones de un clásico";, situadas en la perspectiva contemporánea, a la luz del viejo dogma de la "separación de poderes" y de las decisiones fundamentales acerca del Estado de Derecho y la democracia.

This paper deals with the debate opened in Chile on the need or not to convene a constituent Assembly to elaborate the draft of a new Constitution. The author argues that the discussion should not revolve around the constituent Assembly, which is the means or process; but in the end pursued with regard to the problem and discussion: a new Constitution, result of the democratic constituent power and their normative contents open to the modern constitutionalism (liberal, democratic, and social). ; En este trabajo se aborda el debate abierto en Chile sobre la necesidad o no de convocar una Asamblea constituyente para elaborar una nueva Constitución.
