The aim of this article is to study how judicial power vested in Superior Tribunal de Justiça (STJ) and Supremo Tribunal Federal (STF) works in controversies between different branches in the Brazilian system of checks and balances. The 1988 Brazilian Constitution, in its article 105, I, "g", provides that STJ has original jurisdiction to appreciate controversies between administrative and judicial branches. This specific constitutional provision has been present in Brazilian constitutional system since the Monarchy regime period (19th century), inspired from the peculiar French constitutional system which has established a Tribunal des conflits, and since then has been repeated without further consideration among the successive constitutional documents. This historical analysis of the subject allowed the study hazards to propose a renewal of the dominant concept of controversies between diferente branches in Brazilian government and, also, revisiting the concept or meaning of what must be considered different branches or powers of government. The proposed renewed concepts were tested through case analysis of Brazilian's constitutional jurisprudence, including one recently case that have emerged as a result of the Covid-19 pandemic. Finally, it proposes a re-reading of the theme in the light of the 1988 Constitution, examining the reconstruction of the Brazilian Organic Procedural Law, aiming, at last, to systematize the matter in a future Brazilian Constitutional Process Code.Received: April 1st 2021/Approved: October 28th, 2021 ; O objetivo do presente artigo é estudar a tutela judicial, como questão principal, de atribuições constitucionais conformadoras do sistema brasileiro de freios e contrapesos.
