The advance of bioethics as a science has exceeded the ethical scenario to fully immerse oneself in other environments of knowledge, essentially in the sphere of the legal, as it is, the bio-legal and towards a new protagonist of an emerging science such as the biolaw. There are dilemmas or bioethical premises from which generate the great juridical questions, around the legal sciences, which must be adjusted to the social reality generated by the great biotechnological advances, in order to regulate the behavior generated by human behavior. The objective of the research is to analyze the role of bioethics in the development of biolaw or biolaw as a mediator of new biomedical dilemmas. The methodology used is a bibliographic documentary research which focuses on the positions of some authors such as Aparisi (2007) and Schaefer (2017), among others. A documentary review was made from a critical stance of the literary sources selected and used for the development of the research, this with the purpose of identifying the different conceptions that biotechnological advances have had on human behavior and its need to be regulated by law. It is concluded that the relationship between bioethics and law has been very useful, at the time of responding to the theme of the debate on the great bioethical dilemmas, which results in the emergence of a novel legal branch such as bio-legal or biolaw.
Los avances científicos en el campo de la genética y de la biología han obligado al legislador a adoptar soluciones jurídicas concretas, generalmente partiendo de determinados criterios éticos que, en ocasiones, entran en conflicto con la ética individual o libertad de conciencia. Pues bien, una de estas cuestiones es la llamada «gestación de sustitución». La gestación de sustitución ha suscitado un intenso debate en el ámbito social, ético y jurídico, que continúa vigente porque en la práctica seguimos encontrando casos de gestación de sustitución que generan conflictos de difícil solución y que revelan, sin duda, la complejidad de este fenómeno. ; The scientific advances in the field of Genetics and Biology have forced the legislator to adopt concrete legal solutions, generally starting off from certain ethical criteria that, sometimes, enter in conflict with the individual ethics or freedom of conscience. In this respect one of these questions is the so called gestation of substitution. The gestation of substitution has triggered an intense debate in the social, ethical and legal scope, which has reached the present date. In fact there is evidence of such cases of gestation of substitution that generates conflicts of difficult solution, and that they reveal undoubtly the complexity of this phenomenon.
RESUMEN. Introduce el presente número el artículo del profesor español Ángel Pelayo González-Torre, Bioética, bioderecho y biopolítica. Una aproximación desde España, en el cual nos expone la evolución no solo terminológica sino conceptual en la manera de entender la forma en que han de ser tratadas la salud y la vida de las personas. Este tránsito de la ética médica a la bioética, de esta al bioderecho y posteriormente a la biopolítica evidencia un proceso que comenzó en el momento en que la actividad sanitaria sale del control de los profesionales de la salud y se convierten en objeto interdisciplinar autónomo para ocupar luego el debate social y con él la necesidad de ejercer un control sobre las actividades sanitarias e investigadoras, etapa en la que va a ser el derecho el llamado a pronunciarse sobre lo que se puede o no hacer, quedando finalmente en los representantes políticos la potestad de legislar y establecer cómo resolver los ya urgentes y trascendentes dilemas bioéticos, institucionalizando, de paso, un nuevo modelo de relación médico-paciente basada en los derechos de este último. El anterior marco conceptual es referido a la situación de España, ocupándose de algunas de las normas más importantes vigentes en materia de bioética. ; ABSTRACT. El Bioderecho Brasileño en la postmodernidad surge a partir de intensos estudios relacionados con la Bioética y los Derechos Humanos, movimiento acentuado por el avance de las tecnologías que no sólo resultó en aspectos positivos. Fue en este contexto que se vio la necesidad de atender a principios éticos y jurídicos capaces de garantizar la dignidad de la persona humana, salvaguardando la vida, la integridad física y los derechos fundamentales de las personas. Así, el objetivo general de este trabajo se caracteriza por verificar las contribuciones de la bioética y de los derechos humanos a la formación del biodirecto en la posmodernidad. El presente estudio, caracterizado por una investigación cualitativa, bibliográfica y documental, obtuvo como resultado la comprobación de que el bioderecho, además de ser una derivación de la bioética, forma una tríada inseparable con los Derechos Humanos, concluyendo que son los principios orientadores de la experimentación científica.

For this reason, at present one of the challenges of the legislator in this matter is to know how to conjugate the rights derived from the practices of su rrogacy, among which are those of the woman in general, as well as those of the pregnant woman and the children born of the same, in which the jurisprudence begins to open a way of recognition. ; El Bioderecho es una disciplina que ha venido desarrollándose en las últimas décadas a remolque de los avances tecnológicos en materia médica. La normativa, aprobada en base a la jurisprudencia generada por la casuística, ha llegado a reconocer derechos de tercera generación, como la autonomía del paciente o la objeción de conciencia del médico, impensables hasta hace bien poco tiempo. One of the most important tasks of European Council was to engender responses to regulate different biomedical practices as they were arising and developing. Thus, the European Council regulated, for instance, the juridical status of blood products as well as organs and tissues for transplantation and grafting, respectively. However, it was not easy to establish a European policy to foster a law armonized with new demands and challenges of biomedical advances, without a general juridical framework that would allow us to move forward into a communitarian regulation. In this scenario, the European Community sought to identify and define specific norms to recognize certain founding principles of European Biolaw, which should be understood as a law for establishing limits for scientific and biotechnological practices, and defining a human identity. This paper examines thoses principles and their utility for regulation as well as their contribution to consolidate biolaw as a discipline in Europe. ; Una de las tareas más importantes del Consejo Europeo fue generar respuestas para regular diferentes prácticas biomédicas a medida que iban surgiendo y desarrollándose. Así, el Consejo Europeo reguló, por ejemplo, la situación jurídica de los hemoderivados, así como de los órganos y tejidos para trasplante e injerto, respectivamente. Sin embargo, no fue fácil establecer una política europea para impulsar una ley armonizada con las nuevas demandas y desafíos de los avances biomédicos, sin un marco jurídico general que nos permitiera avanzar hacia una regulación comunitaria . En este escenario, la Comunidad Europea buscó identificar y definir normas específicas para reconocer ciertos principios fundacionales del Bioderecho europeo, que debe entenderse como una ley para establecer límites a las prácticas científicas y biotecnológicas, y definir una identidad humana. Dans ce scénario, la Communauté européenne a cherché a identifier et a définir des normes spécifiques pour reconnaitre certains principes fondamentaux du Biodroit européen, qui devraient etre compris comme une loi visant a établir des limites aux pratiques scientifiques et biotechnologiques et a définir une identité humaine.
