학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 권형기. ; 본 연구는 발전국가 이후 한국 자본주의 제도 변화 과정에서 나타난 국가 성격 전환에 관한 연구이다. 구체적인 사례로 하도급 제도를 대상으로 세계화 과정에서 국가 성격의 변화를 경험적으로 밝히고 이의 이론적 성격을 규명하고자 한다. 발전국가의 변천에 관한 기존의 연구는 주로 시장국가 혹은 최소주의적 규제국가라는 단일한 국가 모델로 수렴할 것인가라는 테제를 중심으로 접근해 왔다. 세계화론자들은 자본의 이동이 자유로워지고 자본을 유치하기 위한 경쟁이 치열해지면서 발전국가가 변화하는 세계경제에 부적합하기 때문에 단일한 규제국가 모델로 수렴할 것이라 예측한다. 반면, 신제도주의자들은 각 국가마다 착종된 제도와 문화가 다르기 때문에 "발전국가 이후" 규제국가로의 전환은 발전국가의 개입주의적 성격이 유지되는 경로의존적 제도 변화를 겪게 된다고 주장한다. 발전 경로가 다양할 수 있다는 점에서 제도주의의 입장에 동의하지만 한국의 국가성격 전환에 대한 기존 연구는 발전국가의 유산에만 천착하여 새롭게 재편되는 국가의 역할에 주목하지 못하고 있다. 본 연구에서는 개입주의의 유산을 통해 발전국가의 연속성을 찾는 기존 연구의 문제제기를 벗어나, 시장자유화라는 세계화의 일반적 추세에 따라 한국의 국가 성격 역시 규제국가로의 수렴 과정에 있다는 명제 하에서 한국의 규제국가가 갖는 다양성의 동학을 살피고자 했다. 한국의 발전 모델이 규제국가로 전환된 것은 사실이나 신자유주의적 국가가 상정하는 최소주의적 국가로 변화한 것은 아니다. 오히려 시장질서의 유지를 위한 협치적 개입주의라는 독특한 규제국가 모델을 형성하고 있다. 본 연구는 기존의 국가전환론이 지나치게 정태적인 분석 방법을 사용하여 비교균형론에 머무르는 한계를 지적하고 협치적 규제국가로의 전환을 이해하기 위해 행위자 중심의 이념, 사고, 담론의 정치적 과정을 분석하였다. 한국의 산업화 시기 형성된 발전연합은 공정거래법과 하도급법과 같은 경쟁법의 제도화를 억제했다. 80년대 신자유주의 관료의 등장과 정치엘리트의 정책 기조 전환이 맞물리면서 현재의 하도급 제도의 기원이 형성될 수 있었다. 이후 하도급법의 확대 및 강화를 통해 신자유주의적 규제국가가 아닌 질서 자유주의를 기반으로 하는 규제국가 모델로 재편되는 모습을 보여주었다. 이렇듯 한국의 규제국가가 '최소주의적'인 국가는 아니었지만 불충분한 제도화로 인해 자본의 양극화 문제를 충분히 해소하는 데에는 부족했다. 규제국가의 한계를 인식한 정부는 규제보다 사회적 규범을 통한 문제 해결을 선호했기 때문에 하도급법 강화에 저항적이었다. 이로 인해 중소기업의 불만을 조직하여 대변하는 정치세력의 연동제 도입 노력은 실패로 돌아가고 대신 점진적 개혁이 이뤄졌다. 자본의 패권에 대한 인식과 규제 국가의 능력에 대한 의심에도 불구하고 정부는 탈규제와 시장 방임으로 나아가지는 않았다. 오히려 사회적 규범을 형성하기 위한 사회적 조정을 시도하는 적극적 협치주의를 추구했다. 동반성장위원회는 공정거래위원회와 달리 사회적 합의 기구라는 제도적 조건과 적극적인 정치적 의지로 인해 이익공유제, 업종 적합성 등 중소기업의 불만을 반영한 다양한 대안들을 제시하여 대기업 측을 압박할 수 있었다. 전경련은 집단행동을 통해 이익공유제에 대한 항의를 전달했지만 법제화에 대한 두려움으로 동반위에서의 이탈보다는 강력하게 반대해 온 납품단가 연동제를 수용했다. 결론적으로 한국의 국가 성격은 발전주의 시기 이후 규제국가로의 수렴을 겪었다고 볼 수 있지만 이는 신자유주의 이념에 의한 것이 아니라 질서자유주의에 입각한 규제국가로의 전환이었다. 그러나 규제국가의 딜레마로 인해 강성규제국가보다는 협치적 규제국가라는 타협적 제도화가 이뤄지고 있다. 연성 규범 형성을 위한 협치적 개입주의는 사회적 조정을 통한 제도 변화의 급진성을 가져올 수 있는 새로운 가능성을 보여주지만 강제력의 부재라는 한계 역시 내포하고 있다. ; This study examines how the form of the Korean developmental state has changed in the process of economic liberalization. More specifically, the study analyzes the transformation of the Korean state empirically and theoretically investigating the changes in the subcontracting institutions under the globalization. The main question of the previous research on the tranformation of the developmental state is whether the state develops into one national model, 'minimalist state'. Capital mobility and the competition for capital make the interventionist states insufficiently competitive. Neoliberals predict the convergence of the national diversity under globalization. Institutionalists, on the other hand, insist that although the interventionist state has developed into a regulatory state, the direction of transformation is determined by path dependence. However, the literature on the transformation of the Korean state has paid little attention to the newly constructed role of the state. Unlike the previous literature, this research examines the dynamic process of the transformation of the Korean regulatory state. It is true that although the Korean state has changed from developmental model to regulatory state, it is distinct from minimalist model based on neo-liberal ideology. Rather, a new regulatory model has been formed. State intervention occurs not as a form of transformed developmental intervention, but as a form of governance. In order to understand this transformation, this study analyzes the political process based on the discursive institutionalism. The growth coalition blocked the introduction of the competition law in the era of industrialization. The newly empowered neoliberal bureaucrats and the turn of the policy stance under the new junta regime made it possible to enact the competition law. Since 1980s, the subcontracting law has been gradually reinforced. After enacting the law, the Korean state has developed into the regulatory state based on the ordo-liberalism, not on the neoliberalism. However, it is insufficient for the change to close the widening gap between big businesses and small businesses. The government prefers constructing the governance to strengthening the law in order to resolve the problem. Facing the government's resist, political parties' efforts to rapidly change the law failed. Although the government concerned about the capital mobility, it did not seek de-regulation and laissez-faire policy. Rather, the government tried to form a social norm using the governance. Unlike Fair Trade Commission, the Commission on Shared Growth for largecorporations and Small and medium Enterprises exerted pressure on the big business by proposing alternative plans including profit sharing and lists for SMB business items. Although the Federation of Korean Industries took collective action against the profit sharing plan to adjust the cost of subcontracting to the changes in raw material prices, it had to accept the plan which the FKI had strongly opposed. In conclusion, the Korean state developed into the regulatory state after the "developmental state". However, it does not mean that the role of the state becomes minimal as the neo-liberalsts argue. Nor does it that the state create a new role dependent on the developmental legacy. Using a new-formed governance, the Korean state tried to change the subcontracting institutions. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 김동욱. ; 이 논문은 한국과 이집트의 지역사회개발정책을 국가주도성이라는 공통적 측면에 주목하고, 이러한 국가주도적인 지역사회개발정책의 형성 및 발전과정에 따른 경로의존성을 분석하는데 주요한 관심을 둔다. 이를 위해 역사적 사건, 초기경로의 생성 경로의존적 닫힘, 그리고 새로운 경로의 열림으로 구체화 했다. 이러한 과정 하에 역사적, 제도적, 행위자적 요인으로 재분류함으로써 제도 변화의 경로 의존적 요인과 촉진 요인을 보다 면밀히 파악하고자 했다. 이는 기존의 제도적 맥락, 즉 제도 내외의 환경의 영향으로 설명하고자 하는 역사적 신제도주의에 기반하였다고 볼 수 있다. 이 논문을 통해서 지역사회개발정책을 둘러싼 국가 계획은 역사적, 제도적 그리고 행위자적 요인으로 인해 일정기간 지속성을 이끌어가는 요인으로 작용했으며, 한편으로는 역사적 요인에 의하여 단절적인 변화를 경험하기도 했다. 한국의 새마을운동이 적어도 정부가 의도한 바대로 지역사회의 변화를 이끌어내기 위한 의미있는 성과를 가져왔음에 비해, 이집트의 슈르끄 운동을 포함한 일련의 지역사회개혁정책이 지역민의 참여와 자원을 효과적으로 이끌어내지 못한 점을 경로의존성 분석을 통하여 도출해내었다고 볼 수 있다. 이러한 분석결과는 다음과 같이 양국의 지역사회개발정책의 유사성과 상이성으로 나뉜다. 먼저, 유사성으로는 한국과 이집트는 개발도상국으로서의 국가주도 지역사회개발정책을 실시한 경험을 가지고 있다는데 있다. 기본적으로 농경에 바탕을 둔 사회이며, 19세기 외세에 의한 근대화 및 권위주의정권에 의하여 지역사회개발정책이 상당부분 영향을 받았다는 점이 유사하다. 이외에도 개발도상국으로서 공업화 등에 대한 우선적 관심으로 상대적으로 지역사회개발정책과 관련된 자원을 투입하는데 한계가 있었지만, 대통령의 일반적인 관심사가 되었다는 점에서 유사하다. 다음, 상이성으로는 한국의 경우, 새마을운동은 앞선 시기의 여러 사회적, 제도적 및 행위자 요인과 함께 지역사회의 인적 물적 자원을 효과적으로 동원하는 내무부 주도의 제도적요인과 박정희 대통령의 정책에 대한 관심과 거버넌스를 촉진하는 행위자적 맥락 요인이 함께 작용하여 이러한 국가주도적 경로의존성을 지속시켜나갔다. 이러한 국가의 개입은 민간의 참여와 자원을 효과적으로 동원하는 방식으로 나아갔다. 한편, 1980년대 새마을운동은 박정희 정부의 종식과 연이은 전두환 정부의 민간주도 정책으로 인해 기존 국가주도적 경로를 이탈하게 된다. 한국과 달리 이집트의 국가주도 지역사회개발정책의 경로는 국가가 이러한 변화를 주도하는 측면에서는 여전히 경로의존성을 유지하고 있었다. 이는 1980년대 무바라크 정부에서는 슈르끄 사업을 실시함으로써 민간주도로 이행하기 위한 노력을 진행했으나, 현재까지 강한 국가주도적 경로를 유지하고 있다. 국가의 의도를 실현시킬 수 있는 효과적인 집행기관과 지역사회의 참여와 자원을 이끌어낼 수 있는 기제가 마련되어 있지 않는데 원인이 있다. 또한, 실제 지역사회개발정책을 통한 정책효과에 대한 무바라크 대통령의 관심의 부재와 지역사회개발에 참여하는 대지주 및 기업가의 부패문제는 지역사회 참여자의 관심을 이끌어 내지 못함으로써 국가가 대부분의 지역사회개발과 관련된 문제를 독자적으로 해결해나가야 하는 악순환에 처해 있는 것이다. 그러나 2012년 현재 이집트는 쟈스민 혁명으로 일컬어지는 민주화운동에 의하여 새로운 정부 수립을 앞두고 있다. 이렇게 새로이 수립된 정부가 그간 권위주의 정부에 의하여 추진된 농촌 등 지역사회개발정책에 대한 개선책에 대한 기대감이 크다. 새로운 정부의 수립 이후 과거 이집트정부가 추진한 강한 국가주도 지역사회개발정책의 실효성을 강화하는 방향으로 나아갈지 혹은 새로이 민간주도 정책으로 전환하는 주요 결절점으로서 작용할지가 주목된다. 이와는 별개로 정권교체 이후에도 당분간 국가가 주도하여 지역사회개발정책을 수립해나갈 가능성이 크므로 이러한 작업을 위해 이집트 정부는 한국 새마을 운동의 성공요인이었던 내무부 주도, 민간의 자발적 참여와 자원동원을 이끄는 방식을 추진한다면, 지역사회개발의 성공을 앞당길 수 있을 것으로 전망된다. ; Focusing on similarity of the state-led character between both countries, this study aims to analyze its formation and developmental process of Korea and Egypt's rural development policy in terms of a path dependency. For this purpose, this study fall into the four sub-parts, which is historic events, creation of initial path, closeness of path and openness of new path. Under this circumstance, as being reclassified in the basis of historic, institutional, and stakeholder factor, it was able to look into more specifically how the path was proceeded. This based on historical institutionalism to be explained by its environmental circumstances both inside and outside institutions. This study shows the national plan on both country's policies of rural development contributed to keep consistency within a certain periods, but they often experienced several sudden shocks which might be disconnect their paths. The Saemaeul Undong in Korea at least have brought significant outcomes for changes in its rural societies. In comparison, The Egypt's case was not successful at that much because they failed to efficiently attract its rural people's support and securing their resources for their national rural development plans. These result outcomes came from analysis from the perspective of path-dependency and it can be more specifically classified into the two categories, which is similarity and difference of both nation's rural development policies. First of all, Korea and Egypt have a similar experience for conducting their own state-led rural development plans as a developing countries. Besides, when they started to develop rural area, the state mainly relied on agriculture and the rural development plan influenced from the authoritative regimes or the power of a foreign countries. In addition, both countries was more focused to invest their limited resources into the industries, rather than rural development. Next, In Korea, with its prior several social, institutional and stake holder's factors, Saemaeul Undong kept its state-led developmental path as successfully mobilizing its human and material resources with help of deep concern of president Park Chung-hee as stakeholder factor and his ministry of interior as institution factor. Especially, this engagement by the central government was gave more initiatives to private sectors when they obtaining their participation and resources. Meanwhile, in 1980s, the Saemaeul Undong derailed its path due to the facts such as the assassination of president Park Chung-hee or the privatization policy of president Chun Doo-hwan. Different from the Korea case, Egypt's state-led rural development has kept on sustaining previous path until now. There are several attempts such as president Mubarak's Shrouck plan toward private-led rural development. However, it does not seem to be enough for detouring its current state-led development tendency for a new change. This is responsible for lack of effective implementation agency and mechanism which is able to get cooperation from rural society. It hinders them in carrying out their plan not only by president Mubark's lack of actual concerns on rural reforms, but also by business man or large farm owner's corruption problems. Therefore the Egyptian government was caught in a vicious circle in which the central government should exclusively take on whole responsibility for rural development issue. However, as of 2012, Egyptians are facing a new government by liberalization movements which called 'jasmine revolution'. They hope that a reform packages of the new government would be differentiated from that of the previous. it might be a prime concerns whether they are maintaining its state-led path or changing their course toward a more private-led one. Whatever the case it would be, their strong involvement by the central government is more likely to be kept for a while. In these circumstance, if the Egyptian government adopt those successful factors of the Saemaeul Undong, their success for rural development would be advanced by substantial length of time. Bearing in mind the distinctive features of prepetition claims and postpetition claims where the former are generally classified as insolvency claims subject to restrictions as per insolvency procedures while the latter as administration claims granted the rights to be paid irrespective of insolvency procedures, one may well assert that the actual amount of realized payment will consequently be different by a significant margin. Thus, it does matter to classify straddle claims before and after the order for relief. In South Korea, the part-fulfillment test(일부구비설) is widely accepted as a common view. In pursuant to the part-fulfillment test, once a particular debt in question is affirmatively established as insolvency claims, other claims that do not fall into the category of insolvency claims but nevertheless fulfill the requirement of administration claims are deemed administration claims. Even if the claims are unliquidated, contingent, unmatured, disputed, they can be classified as insolvency claims when the significant part of the claims are fulfilled prepetition. It seemingly is due to the reception of the Japanese insolvency acts which has eventually resulted in South Korean insolvency frameworks adopting the relevant Japanese legal theories and precedents that developed on the basis of the part-fulfillment test. But the word 'the significant part of the claims' is too vague to establish a clear and consistent criterion. Among the cases of the Supreme Court of South Korea, some cases contradict each other. In Japan, a scholar following the part-fulfillment test even admits that the test has its defects as some cases of the Supreme Court of Japan are inconsistent. The 'theory of deduction(控除説)' in Japan, based on the study of history of theories about classifying claims, criticizes the present common view in Japan, the part-fulfillment test, and suggests that the claims subject to insolvency risks be insolvency claims and the claims free from insolvency risks be administration claims. It may sound like a tautology, but it pinpoints that the present part-fulfillment test is far from realizing the essence of treatment and disposition of claims, using the word 'the significant part of the claims'. However, the theory of deduction also leaves much to be desired to set a clear and consistent criterion. In the United States, timing problems of claims in insolvency have been an important research theme, making use of a substantial balancing test. Thus, the arguments in the United States serve as a good reference. The theories of the United States do not apparently dichotomize, but virtually distinguish contractual claims from non-contractual claims. When it comes to contractual claims, the claimants voluntarily enter the contracts considering insolvency risks, so it is easy to determine whether the claimants bear the insolvency risks in accordance with their intention. In contrast, as of non-contractual claims, the claimants often get the claims involuntarily. It is hard to determine, based only on the claimants' intention, whether they should be burdened with insolvency risks. Therefore, dichotomy is desirable. In case of contractual claims, almost all federal courts of appeals and scholars adopt the performance test in the United States. As of non-contractual claims, there are the accrued state law test, the conduct test, the relationship test, and the fair contemplation test in the United States. Most of federal courts of appeals follow the relationship test, while most of scholars support either the conduct test or the fair contemplation test. For contractual claims, including the ones based on executory contracts, we can accept the performance test as it is. The part contributed to a debtor prepetition by a claimant abandoning exceptio non adimpleti contractus is subject to the insolvency risks and should be treated as insolvency claims. The part induced to do business with a debtor postpetition is beneficial for the estate and thus should be treated as administration claims. For efficiency, prepetition claims should be cut off from post-insolvency as sunk costs, while postpetition claims should receive priority to induce entities to enter new business with a debtor so as to foster reorganization. In case of non-contractual claims, it is hard to tell whether the claims are supposed to bear insolvency risks or not. It is a matter of policy. Unless it is the case where Debtor Rehabilitation and Bankruptcy Act in South Korea excludes explicitly the non-contractual claims from insolvency claims, prepetition claims should be classified as insolvency claims and postpetition claims administration claims. While the meaning of 'claims' for insolvency is defined in a unique sense under the United States Bankruptcy Code so as to put a great weight on that specific point of time, Debtor Rehabilitation and Bankruptcy Act in South Korea yet omits to define the meaning of 'claims' for insolvency, making it unnecessary to be obsessed with as to when a claim arises. For insolvency in South Korea, I hereby propose the relationship test that does not stick to the point when a claim arises. Rather, I suggest a more flexible solution that allows bifurcation of claims. If the part of the claim occurring before the order for relief creates a relationship, such as contact, exposure, impact, or privity, between the claimant and the debtor, then the part of the claim is insolvency claim. At the same time, the purposes of the acts on which the claim is based, the entity benefitted by the expense, and so forth, should be considered. Prepetition claims should be cut off to encourage a fresh start of the debtor, but that does not mean that the debtor is free to commit torts or gain unjust enrichments. Though it is quite theoretical, postpetition claims that the claimant gains involuntarily because the debtor fails to block a relationship between them should be treated as administration claims so that the estate shoulders the expense. As a result, insolvency can proceed with efficiency and equity. The representatives and the social insurance programs for future claimants can satisfy due process concerns. 학위논문 (석사)-- 서울대학교 대학원 : 사회학과, 2012. 2. 장덕진. ; 경제적 세계화와 국내 정치가 조세정책에 미치는 영향 연구 : 1981년 - 2008년 OECD 18개국을 대상으로 서울대학교 대학원 사회학과 박 기 웅 본 논문은 한 사회의 균열을 반영하는 국내 정치가 경제적 세계화의 흐름 속에서 자율적인 정책 형성 능력을 유지하는지 밝히고자 한다. 세계화의 논리는 국가공동체 및 민주주의의 논리와 갈등을 일으키고, 이러한 갈등은 국내의 다양한 경제·사회정책 영역의 투쟁으로 드러난다. 특히 국가의 물질적 기반과 직결되는 조세정책은 경제적 세계화의 영향력을 받는 동시에 국가의 재분배 정책 의지를 반영한다는 점에서 중요한 지표이다. 본 연구는 경제적 세계화와 국내 정치의 경쟁적 관계에 대한 실마리를 찾고자 조세정책의 주요 세목인 법인세를 연구 대상으로 삼았다. 지난 30년 간 사회과학계는 신자유주의적 세계화의 효과에 대해 수렴 가설과 다양성 가설로 대표되는 논쟁을 지속해왔다. 먼저 수렴 가설은 자본을 유치하기 위한 조세경쟁이 정부의 조세정책 능력을 구조적으로 제약하고 국내 정책 결정에 대한 주권을 약화시켜, 각 국의 정책을 하향 수렴(race to the bottom)시킨다고 주장한다. 반면 다양성 가설은 국내적 요인(정당정치, 노조 등)에 의해 세계화의 영향력이 매개되어 개별 국가가 세계화의 파괴적인 영향력을 막아낼 수 있다고 본다. 뿐만 아니라 다양성 가설은 국가 별, 레짐(regime) 별로 세계화 양상이 유의한 차이를 보인다는 점에 주목한다. 두 입장의 이론적인 대립과 비교할 때, 그간의 경험 연구들은 대부분 다양성 가설 혹은 정치 중심(Politics Matter)의 주장들을 뒷받침해왔다. 본 논문은 기존의 경험 연구가 지닌 한계를 극복하고 레짐 별 차이를 확인하기 위해, 1981년부터 2008년까지 선진 산업국가의 법인세 정책 변화를 패널교정표준오차(Panel-Corrected Standard Error) 회귀모델로 분석하였다. 분석 결과 첫째, 법정법인세율은 경제적 세계화 변수(금융자유화, 무역의존도)와 강한 부(-)의 관계를 보였다. 이 결과는 경제적 세계화가 진행될수록 조세경쟁이 심화되고 법정법인세율이 낮아진다는 점에서 수렴 가설을 지지하는 근거가 된다. 하지만 여전히 정당과 노조를 비롯한 국내 정치적 변수도 부분적으로 영향을 미치고 있다는 점에서 국내 정치의 영향력이 무의미해졌다고 해석하기는 어렵다. 둘째, 개인소득세 최고세율과 법정 법인세율의 차이를 나타내는 세율 격차는 경제적 세계화 변수와 정(+)의 관계를 보였다. 즉 경제적 세계화가 진행될수록 세율 격차는 점점 더 커지고, 그에 따라 세입 증대 억제와 소득세의 누진성 약화와 같은 조세경쟁의 간접적 효과가 나타나는 것이다. 국내 정치 요소 중 정당 정치 변수의 영향력은 사라졌지만 노조의 영향력은 여전히 유효하였다. 셋째, Esping-Anderson이 제시한 복지국가 레짐 분류가 세계화에 대한 대응에서 어떤 차이점과 공통점을 보이는지 확인하기 위해 법정법인세율에 대한 레짐 별 분석을 시도하였다. 그 결과 경제적 세계화 변수는 레짐과 무관하게 부(-)의 관계를 나타내면서 효율성(수렴) 가설을 강하게 뒷받침하고, 국내 정치 변수는 부분적으로만 다양성 가설을 지지한다는 사실을 확인했다. 세부적으로 경제적 세계화 변수는 사민주의 레짐의 법인세 정책에 가장 강한 영향력을 나타냈고, 정당 정치 변수는 자유주의 레짐에서, 노조 변수는 보수주의 레짐에서 유의하게 나타났다. 본 연구의 결과를 종합하면, OECD 국가들의 법인세 정책에는 조세경쟁으로 인한 '강한 수렴'과 국내 정치의 매개를 통한 '약한 다양성' 경향이 드러난다고 할 수 있다. 즉, 자본의 영향력 증대와 정치의 퇴각으로 인한 정책 자율성의 축소는 세계 경쟁의 틀에 구속되어 있는 선진 산업 국가에서 보편적으로 관찰되는 현상인 것이다. 또한 연구 결과는 신자유주의적 세계화가 진행된 이래 정치사회학적 의미의 민주주의 기반이 흔들리고 있으며 동시에 민주주의의 왜소화가 빠르게 진행되고 있음을 암시한다. 이는 선진 복지국가만의 문제가 아니라, 전 세계적인 신자유주의적 재편 과정의 일부이며 또한 '미국의 길'을 걷고 있는 한국의 문제이기도 하다. 따라서 향후 한국에서 전개될 복지국가 논쟁은 국내 정치를 제약하는 경제적 세계화의 영향력에 대해 심화된 고민을 필요로 한다. ; Effects of Economic Globalization and Domestic Politics on Tax Policy - Focused on 18 OECD Countries, 1981-2008 - Park, Kiwoong Department of Sociology Graduate School Seoul National University The purpose of this study is to find out whether domestic politics, which reflect social cleavage, still preserves its autonomy which enables policy making in the era of economic globalization. The logic of globalization confronts with the logic of nation community and democracy, and this conflict comes out as a struggle within various domestic economic/social policy areas. Especially, tax policy, directly connected with the country's material base, is important because it not only is influenced by economic globalization but also reflects the state's redistribution policy will. Main target of this research is the corporate tax, major item of tax policy, to inquire about the competitive relationship between economic globalization and domestic politics. There has been an acute debate about the effect of neoliberal globalization between convergence hypothesis and diversity hypothesis. First, convergence hypothesis insists that tax competition to attract capital structurally constrains the state's tax policy capacity and weakens its sovereignty in internal policy decision. As a result, each country's policy enters the race to the bottom. Diversity hypothesis, however, maintains that an individual nation can protect itself from globalization's destructive influence by domestic factors (party politics, institution, etc.). Also, this stance focuses on the differentiated effect of globalization by country and regime. Based on such debate, most previous empirical researches have backed up the diversity hypothesis or the 'Politics Matter' argument. This paper has analyzed the corporate tax change of the advanced industrial states between 1981 and 2008 by OLS-PCSE(Panel-Corrected Standard Error) model to overcome the limits of previous empirical researches and to verify the characteristics by regime. The analysis result is as follow. First, statutory corporate tax rate shows a strong negative relation with economic globalization variables (financial liberalization, trade openness). This result supports convergence hypothesis by showing off that the tax competition deepens and statutory corporate tax rate decreases as economic globalization proceeds. But it cannot be interpreted that the influence of domestic politics has become meaningless since internal politics variables, such as party and labor union, still keeps their influence. Second, tax rate difference between the highest individual income tax rate and statutory corporate tax rate is positively related with economic globalization variable. It means that the tax rate difference becomes larger and the indirect effect of the tax competition, for example, control on tax revenue increase and weakened income tax's progressivity, as the economic globalization progresses. Though the influence of party politics variable among internal politics factors has faded away, labor union's influence is still effective. Third, statutory corporate tax rate analysis, according to regime, is performed to verify how Esping-Anderson's welfare state regime classification applies to response to globalization. As a result, regardless of regime, economic globalization variable shows negative relationship. This result strongly supports effective convergence hypothesis, and confirms that the internal politics variable support the diversity hypothesis in part only. Specifically, economic globalization variable presents the strongest influence on social democratic regime's tax policy, while party politics variable is significant in liberal regime. Labor union variable is significant in conservative regime. Putting together the result of this study, OECD countries' corporate tax policy reveals a 'strong convergence' due to tax competition and a 'weak diversity' carried by domestic politics. That is, reduction of domestic policy's autonomy due to augmented influence of capital and retreat of politics is a universal phenomenon in advanced industrial states which are confined in the framework of global competition. It can be referred that the base of democracy - in the way of political sociology - is waving and trivialization of democracy is proceeding. This is not only the problem of the advanced welfare state, but also a phase of global neoliberal reorganization and Korea, which is on the way of 'The Road to USA.' 학위논문 (석사)-- 서울대학교 대학원 : 법학과, 2012. 2. 권영준. ; 담보제도는 여신금융거래와 밀접한 관계를 가지고 있어서 담보제도의 안정적인 작동은 여신금융거래의 활성화에 기여할 수 있다. 그런데 최근 들어 새롭고 복잡한 금융기법이 등장하고 있는데도 불구하고 대표적으로 이용되고 있는 담보물권의 일종인 저당권은 여신금융거래를 둘러싼 사회적 요구를 충분히 수용하지 못하고 있다. 특히 대규모의 자금이 투입되는 건설사업 등 각종 부동산개발사업을 추진하는 과정에서 이용되고 있는 프로젝트 파이낸싱(Project Financing, 이른바 PF 대출)이라는 금융기법은 막대한 대출금 규모에 비례하는 보다 안전한 담보가 필요하게 되었고, 이와 관련하여 부동산담보신탁은 새로운 담보방법으로 주목받기 시작하였다. 원래 신탁은 영국에서 발달한 제도이고, 현행 우리나라의 부동산담보제도는 대륙법계에서 발전된 제도이기 때문에 신탁을 통한 담보방법의 폭넓은 활용은 용이하지 않았다. 우리나라에서 신탁을 통한 담보방법인 부동산담보신탁의 활용이 관심받기 시작한 것은 불과 20년도 채 되지 않았다. 물론 부동산담보신탁이 완벽한 담보적 기능을 가지고 있는 것은 아니지만, 현행 법체계에서 담보력을 유지하기 위한 강력한 수단이라고 평가받고 있다. 그 이유 중의 하나는 신탁의 도산격리 효과 때문이다. 이것은 위탁자나 수탁자의 파산절차 또는 회생절차에 구속되지 않고 신탁부동산을 독립적으로 취급할 수 있으므로, 채권자인 수익자는 위탁자나 수탁자의 채권자로부터의 간섭 없이 신탁부동산에 대한 권리를 행사할 수 있음을 의미한다. 이러한 도산격리 효과는 신탁제도의 고유한 효과이므로, 부동산담보신탁에서도 동일하게 인정된다. 특히 위탁자에 대한 회생절차가 개시된 경우 수익자로 지정된 채권자는 경우에 따라 위탁자에 대해 가지는 회생채권은 실권될 수 있어도 수탁자에 대해 가지는 수익권은 실권되지 않는다. 이러한 점은 부동산담보신탁을 활성화시키는 강력한 유인이라고 볼 수 있다. 한편 그동안 우리나라에서는 부동산담보신탁에 대하여 신탁의 형식을 빌린 담보제도로 구성하려는 견해가 많았으나. 엄밀히 말하면 부동산담보신탁은 담보제도로 볼 수 없다. 부동산담보신탁에 대하여 형식은 '신탁'이지만 실질은'담보'라는 주장은 물권적 기능을 하는 권리들을 물권법정주의라는 틀에 맞추어 설명하다 보니 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 일종의 비전형담보권으로 보려고 했던 것이다. 그러나 담보신탁을 통하여 얻게 되는 채권자의 담보취득 효과는 경제적인 측면에서 그러한 것이지 법률적인 측면에서 그러한 것이 아니다. 따라서 부동산담보신탁은 어디까지나 신탁제도의 일종이라고 보아야 하고, 신탁제도 자체의 고유한 법리에 기초한 해석으로써도 부동산담보신탁제도를 충분히 설명할 수 있다고 보아야 한다. 미국에서는 부동산을 담보로 금융을 얻는 방법으로 대륙법계의 저당권이 아니라 'Mortgage'나 'Deed of Trust'를 이용하여 왔다. 이러한 'Mortgage'나 'Deed of Trust'는 담보를 위하여 부동산에 대한 소유권을 이전한다는 점에서는 동일하지만, 전자는 채권자에게 부동산에 대한 소유권을 이전하는 반면에 후자는 수탁자에게 그것을 이전하고 채권자는 수익자로 된다는 점에서 차이가 있다. 캘리포니아 州의 경우 1930년 이후부터'Deed of Trust'와 'Mortgage'를 동일하게 취급하여 'Deed of Trust'의 본질을 매각권이 부여된 'Mortgage'로 보았다. 그러나 이와 같이 'Deed of Trust'와 'Mortgage'에 대한 동일한 취급이 우리나라에서도 수용 가능한 것인지는 재고의 여지가 있다. 왜냐 하면 미국의 도산절차에서는 담보권자의 권리가 감축되지 않으므로 'Deed of Trust'를 매각권이 부여된 'Mortgage'로 취급하더라도 별 문제가 없으나, 우리나라의 경우는 채무자 회생 및 파산에 관한 법률의 회생절차에서 회생담보권자로 취급되면 권리감축의 대상이 되므로 부동산담보신탁을 담보제도로 보게 되면 중대한 문제가 발생할 수 있기 때문이다. 즉 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 비전형담보권으로 보게 될 경우 논리적으로 회생담보권이 되어 수익자 보호에 취약해질 수 있다는 것이다. 최근 우리나라에서는 신탁법의 전면 개정(2011. 7. 25. 법률 제10924호)으로 담보신탁의 법적 근거가 마련되고, 어떤 측면에서는 기존의 담보제도가 가진 한계를 극복-예컨대 수익증권의 발행이 가능하게 됨으로써 수익권의 유통성이 확보됨-할 수 있게 되었다. 이러한 점들은 앞으로 부동산담보신탁의 활용을 높이는 계기가 될 것이다. 한편으로는 담보신탁의 대상이 단순히 부동산에만 한정된 것이 아니기 때문에 동산, 유가증권, 금전채권 등의 신탁재산을 포괄하는 담보신탁의 활용 가능성에 대한 관심과 연구가 증대되어 궁극적으로 안정적이고 편리한 담보신탁의 활용을 통하여 여신금융거래의 활성화에 기여할 수 있도록 하여야 한다. ; The stable working of the security system can make a significant contribution to revitalizing the loan financial transaction because both of them are intimately associated with each other. Although new and complicated financial methods recently appear, a typically-used hypothec does not accept social needs surrounding the loan financial transaction. Especially the financing method which is called Project Financing needs a safer security in the process of promoting all sorts of the Real Estate Development Business prodigious funds are invested in. In this situation the real estate security trust began to make a mark as a new type of security method. A wide use of Trust as a security method was not easy because it is originated from the United Kingdom and the real estate security system in Korea has been developed from the Continental law line. It is less than 20 years that the real estate security trust has been noted as a new type of security method. Although the real estate security trust does not have perfect functioning of security, it is appreciated as a powerful means for keeping the value of security. One of the reasons is due to bankruptcy remoteness effect in Trust. This means that a creditor as the beneficiary can exercise his or her right about the trusted real estate being free from intervention of truster or trustee. As this bankruptcy remoteness effect is a peculiar one of the trust system, it is equally admitted in the real estate security trust. If a rehabilitation procedure is started, a creditor as the beneficiary can lose his or her rehabilitation credit about truster but can not lose the beneficiary right about trustee. This aspect is a contributory cause in reinvigorating the real estate security trust. Some people tended to regard the real estate security trust as the security system so far in Korea. In other words those who make an assertion that it is 'the trust' in form and 'the security system' in essence think of the beneficiary right as a kind of non-typical security right. But strictly speaking, it is not the security system. Because the security acquisition effect in the real estate security trust is right in a economical aspect and is not so in a legal aspect. So the real estate security trust is a kind of trust system and we can understand it with an explanation based on the peculiar principle of trust system. They have used 'Mortgage' or 'Deed of Trust' as a method for financing with a real estate in the United States. This 'Mortgage' or 'Deed of Trust' is similar in transferring the ownership about a real estate for a security, the former transfers it to a creditor but the latter does so to trustee. In California 'Deed of Trust' and 'Mortgage' are treated equally as the essence of 'Deed of Trust' is a kind of 'Mortgage' that has the right of disposal by sale since 1930. However we must reconsider whether this treatment in California can be accepted in Korea. Although 'Deed of Trust' in California is similar to the security trust in Korea, they are not identical. It is natural that 'Deed of Trust' is treated as a kind of 'Mortgage' which has the right of disposal by sale because the security right is not reduced in the law related to rehabilitation or bankruptcy procedure of the United States. However the law in Korea is different from that in the United States. If we regard the real estate security trust as the security system in Korea, the serious problem comes into existence because the rehabilitation security right is reduced according to the insolvency law of Korea. In other words if they think of the beneficiary right as a kind of non-typical security right, it is logically the rehabilitation security right. In result we can not protect the beneficiary. The Trust Law of Korea was fully revised in 25th July, 2011. It has not only brought about the legal basis of the security trust but also made a kind of the institutional device which can get over a boundary of the past security system-issuing a beneficiary certificate and securing a circulation of the beneficiary right. These points will enhance the use of the real estate security trust. Additionally as the object of the security trust is not limited only to a real estate, we must study the chance of using the security trust which include movable properties, securities, bonds to be paid in money and so on. This leads to making good use of the security trust which is stable and convenient, and so will eventually revitalize the loan financial transaction. ; Master

학위논문 (박사) -- 서울대학교 대학원 : 사범대학 사회교육과(역사전공), 2020. 8. 유용태. ; 본 연구는 청이 불평등조약과 서양 국제법 서적을 통해 주외공관 제도를 수용하는 과정을 분석한 다음, 이것이 주한공관 설립과 한청 근대외교로 이어지는 모습을 고찰하였다. 이 과정에서 전통외교와 근대외교 각각에서 유래한 합리성과 제국성이 작용하는 양상에 유의하였다. 요컨대, 외교학의 용어와 개념은 물론 주외공관의 운영 원리에 착목하여 청의 주한공관을 체계적으로 밝힌 개척적인 연구라 할 수 있다. 청은 아편전쟁으로 체결한 불평등조약에 따라 주외공관 제도를 수용하였다. 이후 열강이 속속 설립한 주청공관은 자국인을 보호하고 외교 협상을 효과적으로 전개하는 한편, 영사재판권·포함외교 등을 통해 자국의 이익을 확보하였다. 한편 이 시기 청에 번역 소개된 󰡔만국공법󰡕 등의 서양 국제법 서적 또한 주외공관의 역할, 권리, 의무 등을 총체적으로 설명하는 한편, 非서구에 대한 영사재판권과 포함외교를 정당화하였다. 이를 통해 청에서는 합리성과 제국성으로 대표되는 주외공관 인식이 형성되었다. 본고가 불평등조약과 서양 국제법 서적에서 公使·領事 등의 번역어가 정착되는 과정을 분석한 결과는 청의 주외공관 인식이 심화되는 과정을 잘 보여준다. 이러한 상황에서 대외 위기가 고조되자, 청 정부 내에서는 상주사절 파견론이 대두하였다. 그 결과, 청은 영국을 시작으로 해외 각국에 공사관을 개설하고, 싱가포르 등 청국인이 많이 거주하는 지역에는 영사관을 설립하기 시작하였다. 청의 주외공관은 현지에서 교섭 사무, 자국민 보호, 정보 수집 등 다양한 업무를 수행하였다. 이는 청이 불평등조약에 따라 설립된 열강의 주청공관을 관찰하고, 서양 국제법 서적을 번역 이해한 결과였다. 이러한 흐름 속에서 1883년 청은 첫 번째 주한공관으로서 주조선상무서를 설립하였다. 그런데 주조선상무서는 분명 근대외교의 산물이었으나 청과 조선은 아직 전통외교를 적용하고 있었다. 따라서 주조선상무서는 전통외교와 근대외교가 착종된 과도적 형태의 주한공관이라 할 수 있다. 이것은 청이 진수당의 직함을 총판상무위원이라 하면서도 사실상 총영사의 지위를 부여한 데서도 잘 나타난다. 진수당은 주로 청 상인의 경제적 이익을 확보하는 방향으로 제국성을 표출하였고, 이를 합리성으로 분식하기 위해 전통외교와 근대외교를 선택적으로 활용하였다. 이 시기 한성·인천·부산·원산에 설립된 주조선상무서는 판리조선상무장정을 토대로 운영되면서 진수당의 활동을 뒷받침하였다. 1885년 청은 진수당을 경질하고 그 후임으로 원세개를 임명하였다. 이때 원세개에게는 총리교섭통상사의라는 직함과 총영사 겸 4등공사라는 지위가 부여되었다. 본고는 원세개가 지닌 4등공사의 지위에 주목하여, 이것을 원세개가 상국의 대표로서 조선의 외교를 주지한 법적 근거였음을 밝혔다. 그러나 원세개는 외교뿐 아니라 내정에까지 개입하였고, 이 과정에서 전통외교와 근대외교를 선택적으로 구사하여 제국성을 더욱 강렬히 표출하였는데, 이는 원세개의 독단적인 판단이 아니라 어디까지나 청 정부의 암묵적 동의에 따른 것이었다. 이 시기 원세개가 임기를 마친 후에도 두 차례나 더 유임되었고, 주조선상무서의 규모가 대폭 확장되고 용산상무서가 신설된 것은 원세개의 활동을 뒷받침하는 토대로 작용하였다. 그러던 중 청일전쟁이 일어나며 주조선상무서는 폐쇄되었다. 그러나 청은 1896년 총상동·총영사 당소의를 파견하여 주조선영사서를 개설하였다. 이때 당소의가 비공식 사절을 자처하였던 만큼, 주조선영사서 또한 비공식 기구에 머물렀다. 청이 자국민을 보호하면서도 조선의 수교 요구는 거부하기 위해 일종의 편법을 사용했던 것이다. 청은 마지못해 수교를 결정한 다음에도 4등공사 또는 흠차대신을 파견하려고 하는 등, 여전히 대한제국에 전통외교를 적용하려는 태도를 보였다. 1899년 한청수교가 이루어진 후, 청은 두 번째 주한공관인 주한공사관·영사관을 개설하였다. 이는 결국 청이 대한제국에 근대외교를 전면 적용하게 되었음을 의미하는 것이다. 주한공사 서수붕, 허태신, 증광전은 서양 국제법과 한청통상조약에 근거하여 교섭 사무를 처리해 나갔고, 이 무렵 신설된 外務部가 주외공관 제도의 개편에 나서면서 주한공사관·영사관의 합리성은 한층 보강되었다. 이 시기 청이 제국성을 표출하기 어려워진 상황과 달리 대한제국에서는 열강을 모방한 제국성이 생겨나기 시작하였다. 제1·2차 한일협약 이후에는 청의 주한공사관이 철수하고 주한영사관이 그 공백을 채웠다. 이 시기 한국총영사 마정량은 주한공사에 버금가는 권한을 지녔고, 주한영사관의 규모는 더욱 확장되었다. 본고는 이 시기 청 정부가 주외공관 제도를 개편하면서, 주한영사관의 관제가 개편되고 관원에 대한 대우가 개선된 것에 주목하였다. 이는 대한제국이 국권을 상실해 가는 상황에서도 청의 주한공관이 지닌 합리성이 증진되었음을 의미한다. 그러나 한국총영사 마정량은 각종 현안을 교섭하는 과정에서 합리성을 내세웠지만, 대한제국을 매개로 일본이 표출하는 제국성에 대응하는 과제를 안게 되었다. 그리고 한일병합으로 대한제국이 주권을 상실한 후에도 주한영사관은 주조선영사관으로 명칭을 바꾸어 존속하였으나, 한청관계가 일청관계로 대체되었기에 그 위상은 점차 낮아졌다. 본 연구에서 청말 주한공관을 한청관계의 맥락 위에 놓고 전통외교와 근대외교의 착종 과정에 주목한 것은 선행 연구의 보완과 연구 지평의 확대라는 측면에서 다음과 같은 의미를 지니고 있다. 첫째, 중국외교사의 측면에서, 청의 주한공관은 중앙 정부와 개인 차원의 외교 행위를 상호 관련성 속에서 이해할 수 있도록 하는 발판이 된다. 특히 청의 근대외교는 합리성을 갖추고 있었던 것은 물론 속국에 대해서는 명백히 제국성을 띠었던 만큼, 청의 근대외교가 지닌 후진성이나 反침략성을 강조해 온 선행 연구의 관점은 재고될 필요가 있다. 둘째, 한중관계사의 측면에서, 청의 조선 정책은 전통외교와 근대외교 양쪽 모두에서 유래한 합리성과 제국성이 길항하는 과정에서 그 양상을 달리하였음을 규명하였다. 따라서 청의 조선 정책을 전통적인 속방 체제의 강화 또는 근대적 제국주의 어느 한쪽으로 이해하는 것보다는 양측 모두가 착종한 양상에 주목하는 것이 적절하다. ; This study examined the way in which Qing dynasty had introduced the diplomatic office system through unequal treaties and the Western international law books, and figured out relevance between Qing's diplomatic offices in Korea and Sino-Korean modern diplomacy. In particular, this article paid attention to the manifestation that rationality and empireness of the diplomatic offices appeared and the aspect that the traditional diplomacy and modern diplomacy competed. In premodern times, traditional diplomacy based on tributes and installation was widely practiced in East Asia. But traditional diplomacy shook and modern diplomacy spread after the Opium War. In particular, the diplomatic offices of Western powers were symbol of modern diplomacy. Qing's understanding of the diplomatic office deepened through unequal treaties and Western international law books. The unequal treaty that Qing dynasty signed with the Western powers included clauses related to the diplomatic offices. The Western international law books introduced by Qing also included contents related to the diplomatic offices. In short course, the idea of dispatching resident envoys emerged in the Qing government. In this situation, Qing started to set up legations and consulates abroad. The diplomatic offices of Qing dynasty carried out various tasks, including negotiation affairs, protection of citizens, and gathering information. These diplomatic offices were based on the reference of the Western powers' diplomatic offices and Western international law books, therefore they contained both rationality and empireness of modern diplomacy. Paradoxically, rationality and empireness were fully expressed in the East Asian country. Qing's diplomatic offices in Korea can be explained in terms of rationality and empireness, and the change of Qing's diplomatic offices in Korea can be divided into the following two periods. The first phase is the founding period of the Qing's diplomatic offices in Korea. In this period, Qing aimed at making the Chosun her vassal state through the Commercial Affair Office. The General Commissioner of Trade Chen Shu-Tang established several Commercial Affair Office. In fact, the Commissioner of Trade was equal to the consul, and the Commercial Affair Office was equal to the consulate. But Qing avoid the term 'consul', 'consulate' to emphasize the vassal status of Chosun. Yuan Shi-Kai as a successor to Chen Shu-Tang corresponded to diplomatic minister. In this period, Qing and Chosun experimented the modern diplomacy through the diplomatic offices, but the traditional diplomacy was still valid. Qing made a use of modern diplomacy and traditional diplomacy arbitrarily. The second phase is the completing period of the Qing's diplomatic offices in Korea. In 1896, Qing established the consulate in Korea to protect the Chinese and avoid Chosun's call for diplomatic ties. After deciding to establish diplomatic ties, Qing planned to dispatch the fourth minister, and soon changed it to the minister plenipotentiary. This phenomenon symbolically shows the shift from traditional diplomacy to modern diplomacy. In 1899, Qing established a legation and consulates after concluding Sino-Korean treaty of commerce. The ministers of Korea treated the negotiation with Korea on the basis of the Western International law and Sino-Korean treaty of commerce. At that time, Qing established the Department of Foreign Affairs to reform diplomatic institutions. As a result the rationality of modern diplomacy increased, but the empireness of modern diplomacy was difficult to appear. In 1906, Qing decided to withdraw legation of Korea by request of Japan, and the consulate then dealt with task of the legation. Accordingly, consul general of Korea Ma Ting-Liang came close to minister of Korea, and the consulate grew in size. At that time, Qing government reformed the diplomatic office institutions, so consulates of Korea were reformed and diplomat treatment improved. After Japan-Korea Treaty of 1910, Sino-Korean relations ended, but the consulate of Korea still maintained changing its name to consulate of Chosun. In short, the consulate of Korea had developed in a way that enhances the rationality of modern diplomacy, but had to defend against Japanese empireness. This study has the following meanings in terms of supplementation of prior research and expansion of research horizon. First, this article revealed that Qing's empireness before Sino-Japanese War had come from both traditional diplomacy and modern diplomacy. Therefore preceding researches which have judged Qing's Chosun policy traditional or modern need to be reconsidered. Second, this article discovered the rationality from modern diplomacy in proceeding of Sino-Korean relations. Several preceding researches didn't stress on the development of Sino-Korean relations. 학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 박찬욱. ; 본 연구는 1970년대 이후 미국의 통상정책 결정과정에서 주된 절차적 기제로 작용해온 신속처리절차(Fast-track procedures)가 2002년 무역법을 통해 무역증진권한(Trade Promotion Authority; TPA)으로 재입법되는 과정의 동학을 의회-행정부 관계를 중심으로 설명하는 것을 목적으로 한다. 신속처리절차는 대통령이 비관세장벽 관련 내용이 포함된 무역협정을 체결하고 이행법안을 의회에 제출하면 양원은 수정안 제출 없이 가부만을 결정해서 90일내에 처리해야 한다는 규정으로 1974년 무역법에서 처음 도입된 이래 30년 간 미국의 무역정책결정과정에서 중요한 위치를 차지해왔다. 하지만 자유무역정책에 대한 양당의 합의가 약해지면서 1994년 만료되었고, 2002년 8월 6일 부시 대통령이 법안에 서명을 하면서 8년 만에 통상정책결정과정에 다시 등장했다. 그렇다면 어떠한 맥락에서 클린턴 행정부 시기에는 부결되었던 연장 법안이 부시 행정부 때는 성공할 수 있었을까? 기존의 연구들은 1997년과 2001년 표결 분석을 통해 의원 차원에서 이익집단ㆍ유권자들과의 관계, 정당 차원에서 단점정부를 그 요인으로 지적한다. 하지만 입법과정에서 의회의 행태는 의원 개인, 정당 두 차원 외에도 행정부와의 관계에서 입법부로서의 의회를 강화하고자 하는 유인의 영향을 받는데 본 논문은 마지막 차원에 주목한 설명을 제시하고자 한다. 즉 의회는 국내외 경제적 상황, 유권자와 이익집단에 대한 고려, 행정부 등 다양한 요구에 대응하는 과정에서 입법부로서의 지위 강화를 위해 행정부와의 관계에서 개입을 증대하는 동시에 실패했을 경우에 부담해야 하는 비난, 지지기반의 이탈과 같은 손실을 최소화하는 방향으로 정책을 입안하려고 했고, 그 결과로 2002년에 무역증진권한이 다시 입법되었다는 것을 보이고자 한다. 입법 과정을 보면 초기에는 기존 연구 결과에서 나타나듯 의원 개인의 차원에서는 재선을 위해 유권자와 이익집단을 고려했고 정당 차원에서는 다수당이 되려는 선거 정치에 대한 고려와 이익집단과의 관계에서 통과와 저지의 공을 주장하려는 의도에서 정당 간 대립이 나타나기도 했다. 하지만 입법과정이 본격화되고 상원에서 안데스 산맥 국가들에 대한 무역특혜협정, 무역조정지원과 포괄법안의 형태로 입법되는 것으로 논의되면서 양당의 지도부는 의회가 미국의 전반적인 무역정책의 수립에 어떻게 개입해야 하는가에 대한 고민을 시작했다. 의회는 무역개방이 필요하다는 방향성에는 전반적으로 동의하고 있었고 WTO Doha Round가 임박해오고 있는 상황에서 행정부에 권한을 위임하지 않았다가 미국의 무역과 경제 상황이 악화된다면 그에 대한 책임을 온전히 부담해야 하기 때문에 무역증진권한의 입법을 통해 책임을 공유할 필요가 있었다. 이 경우 직접적인 권한 행사 주체는 행정부이기 때문에 실패했을 때는 행정부에 책임을 전가할 수 있는데다 권한의 위임범위와 재량권을 더욱 축소하고 적극적으로 개입해 무역 정책을 수립할 수 있기 때문에 의회의 입장에서는 결과에 대한 직접적인 책임을 회피할 수 있다. 동시에 절차의 적용 요건을 강화하고 감독기구를 늘리고 등의 조치를 통해 협상과정에 의회가 능동적으로 개입할 수 있는 통로를 확대하고, 행정부가 의회의 의사와 반하는 협상을 할 여지를 줄이기 위해 재량의 범위를 제한했다. 하지만 2002년 무역법에서 의회의 무역정책수립에 대한 적극적인 개입 의지가 가장 강하게 드러난 부분은 주도적으로 무역개방으로 인해 피해를 입은 부문에 대한 보상정책을 수립했다는 점이다. 무역조정지원에서 규정한 정책들은 분배정책적인 특성으로 인해 수혜자들에게 공을 주장하기는 쉽지만 비난을 받거나 실패할 확률은 낮기 때문에 의회의 입장에서는 헌법상 수임기관으로서 무역정책을 적극적으로 수립하는 의무를 다하고 있다고 주장하기에 효과적인 조치였다. 의회는 이처럼 무역조정지원 법안을 통해 적극적으로 개입해 직접 무역정책을 수립하고 무역협정체결과정에서 개입을 증대하는 동시에 권한을 위임하지 않았을 경우 WTO Doha Round에서 미국의 협상지위 약화로 미국의 무역과 경제 상황이 악화될 수 있다는 우려 때문에 개입의 정도를 자제하고 행정부에 직접적인 무역협정체결권한을 위임하는 내용의 무역증진권한을 입법한 것이다. ; The purpose of this study is to analyze the dynamics of legislating the Trade Act of 2002 which granted Trade Promotion Authority, previously called fast-track negotiating authority, to the President of the United States focusing on the relations between the executive and Congress. Fast-track procedures were set forth in the Trade Act of 1974, stipulating that once the president formally submits a bill implementing a trade agreement concerning non-tariff barriers, both houses must vote on the bill without any amendments or filibusters. Being continuously in effect for 30 years, they have acted as a principal procedural mechanism for enacting trade agreements since 1970's. As the bipartisan consensus on free trade was eroded by the emergence of social issues like labor and environment in trade talks, however, they expired in 1994 due to failure to reach an agreement on how these issues should be handled. In 2002, a long and enthusiastic debate in both houses finally ended and the procedures were restored after a 8-year hiatus during the Bush presidency. If that is the case, in what circumstances was it possible for president Bush to regain the authority that president Clinton failed to win? The existing studies which conducted a comparative analysis on the roll-call voting that took place in 1997 and 2001 pointed out that representatives' consideration of constituents including pressure from interest groups and divided government had a noticeable effect in the different consequences. But besides these two, the respective members and party, a motive to reinforce the legislative branch as an institution has a impact on the behavior of Congress. This study aims to propose an explanation focusing on the third dimension from a view of interbranch politics. Then, responding to both domestic and international economic condition, demand from interest groups and constituents, and request from the executive branch, Congress approved the measure as a consequence of reflecting the intention to improve its status by increasing engagement with the process of decision making in the executive branch and minimize the loss such as the blame from the public or decrease in support accompanying failure of certain policy at the same time. In the early stage of legislation congressmen's consideration of constituents for winning reelection and partisan rivalry prevailed as other studies predicted. But as the actual legislative process progressed, the situation changed. With the Senate Democrats insisting on enactment of the omnibus trade bill incorporating TPA and two other bills, Andean Trade Preference Act and Trade Adjustment Assistance, concern over how Congress should engage with the establishment of generic trade policy spread throughout the party leaders. Congress agreed with the executive branch on the need of trade expansion and delegating the power to negotiate trade agreements for imminent WTO Doha Round because it would make them share the responsibility for possible deterioration in economy and trade in the future. The fact that the direct agent of exerting the authority was the executive branch had Congress make up its leeway as it could shift all the blame onto the other branch. Furthermore, when the economy got worse Congress could curtail the limit of the delegation and discretionary power given to the executive and establish trade policy firsthand. Delegating the authority, Congress expanded the means to actively involve in negotiating process by reinforcing its role of oversight, downsizing the discretionary power to prevent the executive from concluding the agreement despite congressional opposition, and tightening up the conditions to meet for the application of the fast-track procedures. But the most impressive part of the Trade Act of 2002 is TAA which reflected Congress's intension to play a leading role in making compensation policy for the people who got injured by trade. In conclusion, a broad agreement that TPA should be extended spread over Congress as it would consolidate the firm standing of the United States in trade talks including the upcoming WTO Doha Round. Moreover, Congress did not want to take full responsibilities or blame for the potential deteriorating economy. But at the same time Congress wanted to increase its engagement with trade policy making with the authority originally given to it by Constitution and its grown capabilities. The effort to restore the fast-track negotiating authority; TPA during the Bush presidency was feasible as it was linked to TAA bill, a measure taken by Congress to expand its involvement in trade policy making, and some steps to increase its engagement with the process of negotiation were taken. In other words, the Trade Act of 2002 was legislated as a result of Congress' struggle to balance between two motives, desire to avoid blame and increase its engagement with policy making. ; Master
