Traditionally, the quality of law is associated with observing certain principles of law making, the so-called principles of good legislation. Such a way of thinking, however, seems to be an over-simplification. Thus, the author indicates that the high-quality of legislation and the principles of good legislation are not the same. Law passed on the basis of good legislation procedures does not automatically result in the high-quality law, in particular, if one makes an assumption that the quality of law depends, above all, on legal certainty being ensured. The reflections presented here express an opinion on the immediate connection between the quality of law and the theory of law. In this perspective, thoughts on the quality of law resulted in an opinion how firmly the process of improvement in law quality is associated with the development of the theory of law. As regards the studies on the quality of law as a measure of legal certainty, three issues are pointed out in the material: 1. the quality of law from the point of view of its formation in reference to certain general social phenomena, 2. the quality of law relating to a person, 3. the quality of law in judicial activities.

Certainly, it is essential, for the shaping of public order in a state, to establish the standards of good administration and axiological basis for the legal system of administrative law, both in the formal-legal and systemic aspect and the substantive-law domain. The basic role is played by legal designatations, such as: properly understood the principle of separation of powers, the principle of the rule of law, human dignity as an axiological basis and the categorical imperative in the sphere of understanding what good administration is, the meaning of the notion of the common good, proper distribution of prime factors of the relationship the common good – human dignity. Legal security and certainty of law, the elimination of inflation of law and the relativization of fundamental values of systemic significance form are also an important element underlying good administration. It is not possible to shape the system of good administration without a properly formed public service and without continuously building its ethos. The analysis of the foundations of good administration and its durability cannot boil down only to the procedural and legal aspects. Therefore, apart from pointing to the need to constantly address the issues of the principles and standards set out in Poland in the Code of Administrative Procedure and in the Code of Good Administrative Behaviour adopted on 6 September 2001 by the European Parliament, I have decided to present this issue in another paper, while focusing herein on the fundamental axiological values symbolizing good administration. An important place in this area is taken by the problem of the individual's right to good administration, which is a consequence of recognising that the State has an obligation and responsibility to shape the optimal model of good administration and governance within the country. ; Nie ulega wątpliwości, że dla kształtowania ładu publicznego w państwie kluczowe jest ukształtowanie standardów dobrej administracji i aksjologicznych podstaw porządku prawnego, tworzącego system prawa administracyjnego zarówno w płaszczyźnie formalnoprawnej i ustrojowej, jak i materialnoprawnej. Podstawową rolę odgrywa kilka desygnatów prawnych, takich jak: odpowiednio rozumiana zasada podziału władz, zasada praworządności, godność człowieka jako aksjologiczna podstawa i imperatyw kategoryczny w sferze pojmowania dobrej administracji, znaczenie pojęcia dobra wspólnego, właściwe rozpisanie na czynniki pierwsze relacji dobro wspólne – godność człowieka. Istotnymi elementami wzmacniającymi podstawy dobrej administracji są także bezpieczeństwo prawne i pewność prawa oraz eliminowanie zjawiska inflacji prawa i relatywizacji fundamentalnych wartości mających znaczenie systemowe. Kształtowanie systemu dobrej administracji nie jest możliwe bez odpowiednio ukształtowanej służby publicznej oraz stałego budowania jej etosu. Analiza podstaw dobrej administracji i jej trwałości nie może być sprowadzona tylko do aspektów proceduralnych i formalnoprawnych. Dlatego – poza zasygnalizowaniem potrzeby ciągłego zajmowania się problematyką zasad i standardów określonych w Polsce w Kodeksie postępowania administracyjnego oraz przyjętym w dniu 6 września 2001 r. przez Parlament Europejski Kodeksie Dobrej Administracji – problematykę tę postanowiłem przedstawić w innym artykule, kładąc nacisk w niniejszym opracowaniu na fundamentalne wartości aksjologiczne symbolizujące dobrą administrację. Ważne miejsce zajmuje w tym zakresie doniosły problem prawa jednostki do dobrej administracji, co jest swoistą konsekwencją uznania, że na państwie ciąży obowiązek i odpowiedzialność związana z ukształtowaniem optymalnego modelu dobrej administracji i ładu publicznego w państwie.

Publikacja recenzowana / Peer-reviewed publication ; The main purpose of this article is to bring the reader into an atmosphere of intensity created by the political disputes about the need of immigration reform in the United States. It is unquestionable that problems of the immigrants, who for decades were crossing illegally American borders, contribute to internal political turbulences in this country. This article proceeds on the assumption, that the immigration related problems created a social "melting pot" which became one of the most serious challenges for the American policymakers. The confrontation of the President with Congress was inevitable. On the one hand, Obama's administration started to regulate the status of illegal immigrants by executive orders; on the other hand, the Congress was determined to bloc these actions as illegal attempts of the President violating the prerogatives of the legislative body. The confl ict resulted in the stalemates which seriously undermined the effectiveness of the American system of checks and balances. The lack of legal certainty, a necessary component of the reliability of the democratic governments, triggered the dispute over the values of the interpretational fl exibility of the Constitution of the United States.

The curator of the estate may be established by a common court not only from office but also at the request of an administrative court. The rules determining the award of remuneration for actions taken before an administrative court in such a case come from procedural and material law provisions. However, they do not provide in an exhaustive way all the cases of granting remuneration to the curator of the estate in respect of the performed function. As a result, there is a need to solve such problems involving rules that are not explicitly expressed in the applicable regulations. This leaves the possibility to propose solutions for this kind of situation in practice. Due to the demand for consistency of the legal system, it is necessary to attempt to identify the entities responsible for covering receivables on the basis of the applicable regulations. Depending on the actions taken by the curator of the estate, this may be a court of inheritance or a governmental or local government administration body. Due to the postulate of legal certainty, it is necessary to postulate taking into account the legal opinions functioning in the literature in order to introduce regulations that will be considered exhaustive, from the point of view of entities applying the law. ; Kurator spadku może zostać ustanowiony przez sąd powszechny nie tylko z urzędu, lecz także na wniosek sądu administracyjnego. Reguły określające przyznanie wynagrodzenia za czynności podejmowane przed sądem administracyjnym w takim przypadku pozostają zawarte w przepisach prawa procesowego oraz prawa materialnego prywatnego. Nie przewidują one jednak w sposób wyczerpujący wszystkich przypadków przyznania wynagrodzenia kuratorowi spadku z tytułu sprawowanej funkcji. W efekcie pojawia się potrzeba rozwiązania takich problemów za pośrednictwem reguł, które nie zostały wprost wyrażone w obowiązujących przepisach. Stwarza to zatem możliwość zaproponowania rozwiązań tego rodzaju sytuacji w praktyce. Z uwagi na postulat zachowania spójności systemu prawa należy podejmować próby określenia podmiotów odpowiedzialnych za pokrycie omawianych należności na podstawie obowiązujących regulacji. W zależności od czynności podejmowanych przez kuratora spadku może to być sąd spadku bądź organ administracji publicznej lub samorządowej. Z uwagi na postulat pewności prawa należy postulować uwzględnienie funkcjonujących w literaturze poglądów prawnych w celu wprowadzenia regulacji, które będą uznawane za wyczerpujące z punktu widzenia podmiotów stosujących prawo.

Discussed amendment of Civil Procedure Code has entered into force on 3 May 2012 and it is still very speculative. Polish Civil Procedure Code is an act of 17 November 1965 which regulates actions in civil cases. It has been changed many times up till now. The amendment from 3 May 2012 implements big change in enforcement proceedings. It is obvious that enforcement proceedings may be undertaken only by the legally entitled bodies. This kind of proceedings are essential for creditors. Execution must be short and effective to provide creditors protect them rights. In order to improve the service of civil courts many responsibilities are now imposed on court referendary. In addition, to improve the quality of the enforcement proceedings it was necessary to implement rise of fines. The Polish legislator implemented new institution astreinte which may force debtors to obey the executive law. The amendment introduces also new definition of executory entitlement, shorter terms for some of actions and many other changes in Polish civil procedure. Now, there is huge possibility that debtors would obey the law more successfully. Even if the amendment dated 16 September 2011 seems positive there are opinions that there were too many changes in Polish Civil Procedure Code yet. The doctrine postulate implementing new civil procedure code in order to guarantee legal certainty and stability. ; Na przestrzeni lat polski Kodeks postępowania cywilnego był poddawany licznym zmianom, którym zawdzięcza swój obecny kształt. Jedną z ważniejszych nowelizacji była ta, która weszła w życie z dniem 3 maja 2012 r. Jej źródłem była ustawa z dnia 16 września 2011 r. o zmianie ustawy – Kodeks postępowania cywilnego oraz niektórych innych ustaw. Wśród głównych założeń nowelizacji wymieniono: likwidację odrębnego postępowania gospodarczego, rozszerzenie dyskrecjonalnej władzy sędziego, udzielenie dodatkowych kompetencji referendarzom sądowym oraz wprowadzenie zmian w zakresie postępowania zabezpieczającego i egzekucyjnego. Niniejsze opracowanie koncentruje się głównie na zmianach dotyczących postępowania egzekucyjnego, które miały doprowadzić do usprawnienia i przyspieszenia postępowania egzekucyjnego. Szeroko omówiono również zwiększenie zakresu kompetencji referendarzy sądowych oraz zmiany w zakresie środków przymusu, z naciskiem na wprowadzenie nieznanego do tej pory środka w postaci tzw. astreinte oraz innych. W konkluzji autorka starała się dokonać oceny zmian wprowadzonych nowelizacją.
