In 1915, a few months after the outbreak of the 1st World War, Sigmund Freud writes the essay "Zeitgemäßes über Krieg und Tod", in which he reflects about the reason why war is still possible in a cultural advanced society like the Western one, and about the relation of modernity with the problem of "evil", violence and death. This article takes its cue from this essay in order to analyse Erich Maria Remarque's novel "Im Westen nichts Neues" (1928-29) from an innovative point of view. Remarque himself argues in many interviews and articles that his book should neither be considered a historical report about the 1st World War nor merely an antiwar-novel about the dramatic experience of a lost generation, but rather a true psychological novel. As a matter of fact, "Im Westen nichts Neues" tells about the "human all too human" mechanisms of violence and power through an understated representation of the trauma of a generation which was thrown into a sort of "state of exception", a state situated simultaneously outside and inside civil society. The essay aims to illustrate how Freud and Remarque take a very similar perspective in their works about the Great War when considering the complex relation between culture and war, civilisation and violence, psychology and power in Western modern society.
The unceasing change that science and technology have imposed on civil society brings into question fundamental issues such as birth, health, death, together with the 'legal instruments' designed for the self-determination. Not only the individual is affected by this tumultuous process but also the family institution, as the main place where the self exercises its personality. In this third volume of Verso un diritto europeo per la bioetica ("Towards a European bioethics law") the focus of the contributions by various authors (jurists, doctors, bioethicists) is centred on topics such as: responsible parenthood and artificial insemination, anticipatory profiles taken on by health and related protection needs, articulation of family models and redefinition of the parenting project. All of this is declined in the logic of Biolaw, which is an autonomous discipline but also an investigation and a working method for those who intend to approach the so-called biotechnological cases.
The subject of this essay is social and political liberty, and the nature of the limits that the State and society can be exercised above individuals. With regard to liberty, Dahrendorf carries out two essential operations. First of all, liberty is placed against equality. Then, within a unitary vision of this concept, he shows its fundamental elements, and distinguishes two totally interconnected aspects: the «problematic» concept of liberty and the «assertoric» concept of liberty. According to this hermeneutical hypothesis, i.e. assertoric liberty as a mode of human existence by specific realities behaviour, Dahrendorf defines a form of thinking that is totally separated from the historiography of political liberalism. Furthermore, the principle of social justice is always present in Dahrendorf 's political thought. In this sense, social inclusion is a moral duty, its rational justification is based on a criterion of justice. The process of inclusion of the greatest number of individuals in the sphere of the social contract means adherence to the norms of social coexistence and a condition for the survival of civil society.

La tesi oggetto di discussione è che lo sviluppo di forme di Economia sociale e solidale nella regione EU-MENA sia indispensabile a: comporre il conflitto di rappresentanza tra istituzioni pubbliche e società civile; innalzare i livelli di benessere delle persone più colpite dagli effetti negativi del cambiamento climatico; gestire gli impatti negativi ed imprevisti della globalizzazione. La tesi proposta ha una natura transcalare, dunque se ne illustrano le implicazioni geopolitiche con riferimento alla posizione dell'Italia, al posizionamento europeo a livello internazionale e all'evoluzione dello scenario globale prospettata dall'Agenda 2030 delle Nazioni Unite. ; This paper illustrates how the empowerment of the Social and Solidarity Economy in the EU-MENA region might be of the utmost importance to: narrow, when existing, the political gap among public institutions and the civil society; raise the wellbeing of those most affected by the negative impacts of climate change; manage the negative and unpredictable impacts of globalization. This hypothesis has a multilevel nature, and the main geopolitical implications are discussed with respect to the Italian position within the Euro-Mediterranean region, the EU external policy and the evolution of the global scenario fostered by the UN 2030 Agenda.
Sommario: Il principio del contraddittorio è cardine portante della struttura del processo. Sia l'ordinamento italiano, sia quello canonico si basano essenzialmente sul principio del contraddittorio e sul diritto di difesa, ponendo al centro la persona. L'ordinamento statale italiano e quello canonico non sono però immediatamente assimilabili, soprattutto per ciò che concerne i motivi che ne ispirano l'azione. Pur avendo in questa prospettiva elementi che contribuiscono alla divergenza tra i due ordinamenti ognuno dei due si ritrova di fronte alla necessità di dettagliare, in termini di diritto positivo, principi specifici, ma probabilmente sono molti di più i valori comuni, che rivendicano la loro normatività sia nei confronti della società civile sia di quella ecclesiale, anzi postulano una loro sana cooperazione. ; Abstract: The adversial principle is the pillar of a legal process. Indeed, both the Italian and canonical legislation hinge on the adversial principle and the right of defense, with the 'person' being centerstage. Albeit the two legislations diverge in several respects, the points in common seem to prevail, especially when considering their roles vis-à-vis the civil society and the canonical order, respectively, and the need to promote a healthy/peaceful cooperation between the two.
By enabling greater freedom of expression to the soviet civil society, Gorbachev's perestrojka caused the re-emergence of radical nationalist movements among soviet nationalities. In Ukraine these radical movements, though born in a typically post soviet social and cultural environment, drew inspiration from movements and thinkers deeply influenced by European fascism and the right wing radicalism of the first half of the twentieth century. Radical right wing nationalism in post soviet Ukraine, a minority opposed to both pro-Russian and national-democratic currents of Ukrainian mainstream political life, played no role in national independence and in the events of the first two decades of independence, including the "Orange Revolution" of 2004. The bloody events of Euromajdan and the following war in Ukraine's Donbass between pro-Ukrainians and pro-Russian separatists created an opportunity for these radical movements to play a greater political and paramilitary role and to take advantage of the renewed patriotic spirit.
There are growing signs of the emergence of a new Chinese civil society which stems from a heightened consciousness of the Chinese people to their rights and displays a greater willingness to face challenges in order to defend such rights by means of litigation. Evidence of such a shift can be detected in the intensification of what has been defined, in Chinese, as gongyi susong (literally: public intrest litigation). Although this kind of litigation constitutes a rather recent development in China, recourse to such a device has seen an exponential growth in recent years and has become one of the fundamental topics of debate and investigation in fields which extend well beyond scholarship and case law. The Chinese definition itself discloses an indebtment to American conceptions of public interest litigation, and a growing number of NGOs, law firms, lawyers (and, at times, individuals) file such cases almost on a daily basis, reminding government authorities of their duties and obligations under the law. This has, in some instances, led to outright confrontation with the regime in the name of public interest. What is meant, concretely, in China, by "public interest litigation"? What tools can Chinese citizens and their lawyers use to defend the public interest? Moreover, what is the public interest which "gongyi susong" claims seek to safeguard? The present thesis addresses and provides some insight on the foregoing questions, through the lens of a series of interviews carried out by the author in 2009 with Chinese lawyers based in Beijing.
[Guide to Psychosocial Intervention for unaccompanied foreign minors]. The phenomenon of the so-called 'unaccompanied foreign minors' has become an urgent problem which does not allow any further delay or any partial and ineffective responses. It cannot only be faced as the emotional reaction to emergency situations, but it requires civil society to ensure the basic rights of the weakest and most vulnerable individuals. Our country is reluctant to give systematic responses capable of providing effective protection. There is also need of an adequate legislative tool more in keeping with the European one. It is essential to understand the various needs and to ensure that the numerous needs be met with expertise and professionalism, taking into account the psychological situation of the children and youngsters who arrive full of hope and who, at the same time, experienced maltreatment, abuse, threats and who were (sometimes impotent) witnesses of their travel mates' deaths. In this sense, the Guide to Psychosocial Interventions is a valuable tool for many workers.
This book contains the proceedings of the conference held on 11 and 12 October 2004 in the Aula Magna of the University of Florence, in collaboration with the Fondazione Spadolini. The aim of the conference was to delineate the profiles of a series of emblematic figures, representative of the presence and activities of illustrious teachers from the University of Florence in local and national institutions and in civil society. The proceedings are conceived to act as permanent evidence of the close links between the University and the Institutions and of the major impact of the work of so many lecturers from the University of Florence in the recent history of Italian institutions. - Il volume raccoglie gli atti del convegno tenutosi nei giorni 11 e 12 ottobre 2004 presso l'Aula Magna dell'Università degli Studi di Firenze in collaborazione con la Fondazione Spadolini. Il convegno ha inteso delineare il profilo di una serie di figure emblematiche e rappresentative della presenza e dell'attività di illustri docenti dell'Università degli Studi di Firenze nelle istituzioni locali e nazionali e nella società civile. La riflessione pedagogica è stata da una parte accusata di silenzio e di mancanza di approfondimento rispetto alle responsabilità educative coinvolte nello sviluppo dei fenomeni mafiosi; d'altra parte ci confrontiamo con la diffusa domanda di comprensione di tali realtà e del ruolo della società civile e con un aumento di interesse, da parte delle Istituzioni, verso percorsi educativi. Questa ricerca intende contribuire al dibattito pedagogico sulle possibili progettualità educative per costruire una risposta civile alla problematica delle mafie. Per fare ciò, si accostano diverse griglie interpretative (storiche, sociologiche, giuridiche) e si confrontano percorsi di differenti criminalità organizzate (mafia, camorra, 'ndrangheta a livello nazionale e internazionale in primis, ma anche Yakuza, Cosa nostra americana e Triadi) con l'obiettivo di formarsi un angolo visuale più ampio e nello stesso tempo profondo della problematica mafiosa nella società globalizzata. Da questo confronto emerge l'importanza di comprendere, accanto alla pervasività delle mafie, la permeabilità dei contesti e le convergenze con gli stili esistenziali inautentici del nostro tempo, improntati al consumo, all'utilitarismo, al disimpegno, all'antropocentrismo. Ripercorrendo l'evoluzione delle iniziative che sono state svolte sul piano politico-istituzionale e su quello civile, constatiamo soprattutto a partire dagli anni '80 l'emergere del discorso educativo. Per comprendere i possibili obiettivi educativi, si analizzano infine diversi progetti, narrati attraverso la documentazione, le interviste e i questionari rivolti ai protagonisti, e confrontati con le riflessioni pedagogiche in merito alla cittadinanza e alla legalità. L'ascolto dei familiari delle vittime, le esperienze dei campi della legalità "tra nord e sud", di rigenerazione sociale e cura degli spazi e dei beni pubblici e dell'abitare la città, consentono di aprire l'orizzonte all'utopia di una civiltà dell'empatia, a patto di non sottrarsi all'investimento educativo nello sviluppare la capacità di ascolto della realtà e delle ragioni dell'altro, di coltivare l'arte della resistenza nel segno dell'empatia. ; Pedagogy has been blamed of silence and superficiality on the relationship between mafias and education; however, nowadays we are facing a spreading of interest among civil society and institution around educational projects. This research aims to contribute to the pedagogical debate around possible directions to support the civil society response to the problems of mafias. First of all, it deepens different theoretical framework (sociological, criminological, historical, law) and compares the different evolution of mafias (Cosa nostra, camorra, 'ndrangheta in the italian and international context, but also yakuza, triads, and italo-american mafia). The aim is to keep a wide and deep perspective of the problem of mafias in the globalized era. From this analysis emerges the importance of comprehension not only of the pervasiveness of the phenomenon but also the permeability of the contexts and the convergence with inauthentic lifestyles which are connected with consumption, utilitarianism, anthropocentrism and disengagement. Considering this, the research address to understand the evolution of political-institutional and civil initiatives. The importance of education has increased since the '80s, when the law enforcement agents have started to be murdered. To comprehend possible educational goals, the research analyzes different projects, which are narrated through the documentation, interviews and surveys of actors involved and it confronts them with the pedagogical reflections on citizenship and legality. Listening to the relatives of victims, working on the land confiscated to mafiosi and turned into social land trust or social projects, restoring and taking care of public spaces and goods, trying new way of social living: these practices allow us to open the horizon to the utopy of the civilization of empathy if we engage in the development of the ability to comprehend reality and the reasons of the other and to nurture the art of resistence, in the sign of empathy.
La domanda intorno al compito che le società scientifiche si trovano ad assolvere sia nei confronti dei propri membri che della collettività ritorna periodicamente nel dibattito pubblico e merita attenzione. Sin dalla loro fondazione, alle società scientifiche si riconoscono il compito di difendere gli interessi professionali dei membri, favorire gli scambi di informazioni, competenze e ricerche, e offrire strumenti di formazione e aggiornamento costante ai propri membri. In particolare, l'oggetto di questo contributo è il ruolo che tali società possono ricoprire all'interfaccia tra mondo della ricerca, mondo professionale e livello decisionale e politico. A partire dalle progettualità di una società scientifica internazionale operante nell'ambito della comunicazione in sanità, si auspica l'individuazione di modalità attraverso le quali le società scientifiche possano emergere come protagoniste di cambiamento e innovazione. ; The issue about the role of scientific societies for their affiliates and civil society is recurrent and deserves attention. Ever since their foundation, scientific societies have been known to operate at the levels of advocacy, networking and lifelong learning. More specifically, this contribution focuses on the role such societies may play at the interface between the world of scientific research, the profession and policy making. Referring to the example set by an international scientific society operating in the domain of health communication, we advocate the identification of pathways through which scientific societies can become main promoters of innovation and change.
Marx continua ad essere un pensatore vivo, come dimostrano i numerosi studi degli ultimi anni. Marx va costantemente alla ricerca di quelle forze soggettive che possano fare la storia dal suo interno. E le individua in quelle potenze produttive che sono trasformate in soggetto storico all'interno della società civile moderna. Il capitale per Marx non è soltanto una gigantesca macchina che produce ricchezza. È prima di tutto un rapporto sociale. Accanto alle logiche della valorizzazione sono necessarie e si sviluppano delle tecniche di potere che producono la soggettività del lavoro. Governare la forza-lavoro significa istituire un rapporto di subalternità, disciplinare l'uso dei corpi, regolare la mobilità e l'accesso degli individui alla ricchezza. È per questo motivo che ho trovato utile riprendere alcuni tasselli della complessa produzione teorica foucaultiana al fine di pensare l'impensato in Marx. Il mio lavoro si colloca ai bordi di questa frontiera per spingersi oltre, indagando le strategie, i metodi e le tecniche tramite le quali per Marx la forza-lavoro è catturata in una rete di produzione/potere. Questa maglia di relazioni soggettive e dispositivi oggettivi costituisce quella che Marx chiama la società civile. La bürgerliche Gesellschaft, infatti, non è per Marx solo il luogo dello scambio, della compravendita della forza-lavoro, del sistema dei bisogni, ma anche spazio della cooperazione, della costituzione di corpi collettivi, dello sviluppo di forme organizzative e aspirazioni politiche. È così che il governo della forza-lavoro (in senso oggettivo) si tramuta in liberazione delle forze produttive tramite l'invenzione di nuove istituzioni (quel governo del lavoro vivo in senso soggettivo esemplificato dalla Comune di Parigi). ; Marx continues to be a lively thinker, as shown by numerous studies in recent years. Marx is constantly looking for those subjective forces that could act the story from the inside. And he identifies them in those productive powers that have become an historical subject within modern civil society. Capital for Marx is not only a gigantic machine that produces wealth. It is first and foremost a social relationship. In addition to the logic of enhancement, techniques of power are necessary and developed in order to produce the subjectivity of the work. Governing the workforce means to establish a subordinate relationship, to control the use of bodies, to adjust the mobility and access of individuals to wealth. It is for this reason that I found useful to take some pieces of the complex theoretical production of Foucault in order to think the unthinkable in Marx. My work is at the edge of this border to go further by investigating the strategies, methods and techniques through which workforce is captured in a production/power network. This web of subjective relations and objective devices constitutes what Marx calls the civil society. The bürgerliche Gesellschaft, in fact, for Marxi s not only the place of exchange and of the system of needs, but also field for cooperation, for the production of collective bodies, and development of organizational forms and political aspirations. That is how the government of the workforce (in the objective sense) turns into liberation of the productive forces through the invention of new institutions (that government of living labor in the subjective sense exemplified by the Paris Commune).
