Zavzetost zaposlenih v civilnodružbenih organizacijah na Hrvaškem ; Employee Engagement in Civil Society Organizations in Croatia
Razvoj človeških virov je bistvenega pomena pri doseganju uspeha za katero koli vrsto organizacije: profitne, javne ali civilne. Stanje civilne družbe je odvisno od okolja, tj. habitata, v katerem deluje. Cilj magistrske naloge je raziskati zavzetost zaposlenih v civilni družbi na Hrvaškem. V vsaki državi je sektor civilne družbe različen in se sooča s posebnimi izzivi. Sektor civilne družbe na Hrvaškem je še vedno v zgodnjih fazah razvoja in je pogosto povezan s podhranjenostjo s človeškimi viri. Mnoge civilnodružbene organizacije na Hrvaškem v celoti temeljijo na prostovoljnem delu. V nalogi smo se osredotočili na hrvaške civilno-družbene organizacije, ki imajo zaposlene. Teza je bila izbrana na podlagi vse več literature, ki se ukvarja z zavzetostjo zaposlenih v kontekstu razvoja civilne družbe. Izbran raziskovalni pristop je kombinacija kvantitativne (anketa) in kvalitativne (delno strukturiran intervju) metode. Intervjuji so bili uporabljeni kot dopolnitev k opravljenim anketam. Ključne ugotovitve kažejo, da so ne glede na finančno nestabilnost in nagnjenost k izgorelosti zaposleni v civilnodružbenih organizacijah na Hrvaškem relativno visoko zavzeti. ; The development of human resources is paramount in achieving success for any type of an organization: profit, public or the civil one. The state of the civil society is dependent on the surrounding context i.e. habitat in which it is operating. This paper aims to zoom into EE in the civil society in Croatia. The civil society sector is different in every country and it is facing unique challenges. In Croatia, the civil society is in its early phase of development, and is characterized by being under-capacitated, especially regarding its human resources. Many CSOs (in Croatia) are completely based on voluntary work. In this paper we have focused on Croatian CSOs that have employees. The thesis has been chosen based on the growing amount of literature on the topic of EE in context to the developing civil society. The research methods that have been used are a combination of the qualitative (the survey) and the quantitative (the semi-structured interviews) method. The interviews have been used as an addition to the surveys rendered. The main findings indicate that the employees in the civil society in Croatia, in spite of the financial instability and the burnout connected to their working environment, demonstrate relatively high engagement.

Vloga Uradniškega sveta pri imenovanju najvišjih javnih uslužbencev v Sloveniji ; The role of the Officials Council in appointing the high-ranking civil servants in Slovenia
Uradniški svet je samostojen in neodvisen organ, ki je bil ustanovljen z namenom depolitizacije državne uprave. Člani Uradniškega sveta določijo standarde in normative ter merila za izbiro kandidatov, ki se prijavijo za položaj najvišjih javnih uslužbencev. Kadar slišimo pojem politizacije se nam takoj ustvari nekakšna slika kako politika skozi politično kadrovanje poskuša vplivati na delovanje državne uprave in tako uveljaviti svoje interese in cilje. Politizacija ni nov pojav in tudi ne redek, z njo se srečujemo vsak dan in na vseh nivojih upravljanja (lokalnem, nacionalnem in nadnacionalnem). Avtor zaključnega dela raziskuje spolitiziranost Uradniškega sveta, cilj naloge pa je kako in na kakšen način se odraža spolitiziranost Uradniškega sveta in kako le ta vpliva na imenovanje najvišjih javnih uslužbencev v Sloveniji. Na podlagi vprašalnika, intervjujev ter analize dela je avtor prišel do ugotovitev, da lahko zasledimo obrise spolitiziranosti Uradniškega sveta. Bolj kot spolitiziranost Uradniškega sveta pa se kaže kako in na kakšen način poskuša politika imenovati najvišje javne uslužbence. ; Officials Council is body outside the government and was established to depoliticize administration in Slovenia. Members of Officials Council set standards, norms and criteria for the selection of candidates for the position of senior civil servants. When we hear the notion politicization, we immediately think how politics try to influence and enforce their interest threw a form of political recruitment in administration. Politicization is not a new phenomenom and it is not uncommon. We can find politicization at every level of governance (local, national and even transnational). The author researches the politicization of the Officials Council. In particular, he is interested in how and in what way the politicization of the Officials Council is reflected and how it affects the appointment of the highest civil servants in Slovenia. Through in-depth interviews, questionnaire and analysis of the work of Officials Council the author found out that we can see politicization of the Officials Council, but more than that we can see how politics try to affect on appointing the high-ranking civil servants.

The discussion about the establishment of regions has been going on in Slovenia for some years. In addition, the regional legislation package has been in the parliamentary procedure for quite some time, too. The purpose of this paper is neither to analyze the proposed legislation nor to provide a detailed list of all the solutions the legislation can bring in. The real purpose of this paper is to analyze various existing regional divisions in the fields of the state administration, general public services & civil society. Some of these regional divisions are supposed to be adapted (according to the regional tasks presented in the legislative proposal) to the proposed dividing the country into fourteen regions. It interests us how the regionalization, taken into consideration by various institutions of the state administration, broader public sector & civil social organizations, complies with the proposals made in attempts to introduce a broader level of local self-government. Besides, we would also like to ascertain whether in already existing regional divisions in Slovenia there might be the predominant solution that could be the basis for the future dividing Slovenia into regions. The special legal nature of the concession contract (as one of the legal transactions) which represents a legal framework where the public & private interests meet (two parties cooperate for mutual benefit) is characterized by intertwining of general rules of obligation law & special legal institutes that originate from the sphere of public law. The legal nature of the contractual relationships that arise between administrative & private entities requires special regulation of individual institutes that should reflect the public interest as an important guiding principle for concluding these contracts, & a special legal position of a public law entity as a holder of this public interest. Despite adoption of the new Public-Private Partnership Act in the legislative regulation of the concession contract that still remains variously regulated in previously adopted special provisions of sectoral laws, there are still some deficiencies & dilemmas that are more or less effectively dealt with in the contractual practice. For the legal positions that are classically civil at first sight, the legislator or court practice have laid down special modified rules of civil law in most developed countries. In the course of time, these rules became part of public law/administrative law. Thus, the French legal order has best developed the rules of the public contractual law & the legal institute of the administrative contract that the Slovenian administrative theoreticians try more & more to introduce also into our legal order. ASSOCIATIONAL PLURALISM – IS IT POSSIBLE TO BUILD ON THIS CONCEPTUAL HERITAGE?

Abstract. The article reflects on a key category introduced by Adolf Bibič
in his 1990 theoretical work Civil Society and Political Pluralism; namely,
association pluralism. Bibič introduced this concept into Slovenian political thought to grasp the diverse social and political developments of the 1980s and to open up a new view of political pluralism that moves beyond party pluralism. The author therefore asks whether the notion of associational pluralism still holds sufficient explanatory potential and is worth preserving and developing further, or whether it can be used to deal with a new social and political reality, i.e., political pluralism, which is also strongly marked by multifaceted environmental issues.

Profession of mediator as the professional provider of the mediation process ; Poklic mediatorja kot strokovnega nosilca postopka mediacije
The civil mediation programme, which is a court-connected programme, established as a form of alternative dispute resolution, is increasingly gaining ground as a field with its own theoretical and practical knowledge, principles and basic rules. Mediation has already set up its own body of knowledge, based on studies, classification of cases and the analyses of the results. In this article, we examine whether in the context of the development of mediation in Slovenia we might already talk about the profession of the mediator, defined as a provider of the mediation process. We examine the court-connected civil mediation and mediators who mediate at the court-connected civil mediation, and define them theoretically. By interviewing the mediation experts and mediators we examine their opinions about mediators and the court mediation. We examine the legal basis for the court-connected mediation programmes in Slovenia as well as in the European Union. Proceeding from our findings we conclude that the legal regulation of the court mediation in Slovenia is well established, and that the mediators of the court-connected civil mediation programmes can be accepted as the professional providers of the mediation process. ; Sodišču pridružena mediacija se kot alternativna metoda reševanja sporov vse bolj uveljavlja kot področje dela z lastnim teoretičnim in praktičnim znanjem, lastnimi načeli in osnovnimi pravili. Mediacija je vzpostavila lastno znanje, ki temelji na študijah, razvrstitvi primerov in analizi rezultatov. V prispevku bomo preverili, ali lahko glede na razvoj mediacije v Sloveniji govorimo o poklicu mediatorja in ga opredelimo kot strokovnega nosilca postopka mediacije. Najprej bomo sodišču pridruženo mediacijo in mediatorje, ki mediirajo v sodišču pridruženi mediaciji, teoretsko opredeliti ter s pomočjo intervjujev s strokovnjaki za mediacijo in mediatorji v nadaljevanju preverili, kakšno je njihovo mnenje o mediatorjih in sodišču pridruženi mediaciji. Proučili bomo tudi pravno podlago sodišču pridružene mediacije tako v Sloveniji kot Evropski uniji. Glede na ugotovitve bomo sklenili, da je pravna ureditev sodišču pridružene mediacije v Sloveniji dobra in da lahko o mediatorjih sodišču pridružene mediacije govorimo kot o strokovnih nosilcih mediacijskega postopka.
