The article is dedicated to the interaction of civil law and civil legislature as systems. The author tries to prove that there are several aspects of interaction of law and legislature: not only as the interaction of form and content but also as independent law phenomena. The author concludes that both civil law and civil legislature are polymeric systems. ; Статья посвящена вопросам взаимодействия гражданского права и гражданского законодательства как систем. Автор предпринимает попытку доказать, что существует несколько аспектов соотношения права и законодательства: не только как содержания и формы, но и как самостоятельных правовых явлений. At the present stage of development of the Russian Federation, after the collapse of the Soviet Union, the ideological bonds of the people disappeared. In these conditions, the "well-wishers" of various stripes are persistently trying to fi ll the resulting vacuum. The people themselves and their leadership are also in search of a national idea that can unite all Russians into a single nation. One of the options for a possible new national idea, according to some scientists, is the so-called "civil religion". Is it suitable for the Russian society?

Civil-military relations in Lithuania have serious deficiencies, which have appeared because of the simulation of a recommended Western model of civilian control. After regaining Independence, Lithuania had the difficult task of creating its armed forces and system of national defence following the Western model. At the same time we had to implement two political programs: to create functio-ning armed forces and a institutional-legal system of democratic civil-military control. However, this control is not only proper laws and functioning institutions. Equally, an important role must be given to intellectual reflection, which enables the posing of questions such as: what is war; how is the character of war changing; how does this affect Lithuanian defence policies and the perception of threats? Raising such questions inside the armed forces and in wider political and civil society is an essential condition for having effective and flexible civilian control over the military.

Осуществление гражданских прав в контексте новелл гражданского законодательства ; Implementation of Civil Rights in the Context of Civil Law Novels
Рассматриваются особенности осуществления гражданских прав с учетом новелл гражданского законодательства. Авторы анализируют новеллы гражданского законодательства о порядке осуществления субъективных прав участниками гражданского оборота, в частности нормы, регламентирующие принципы и пределы осуществления гражданских прав, а также нормы, устанавливающие последствия нарушения предписанных законом правил поведения. В контексте изменения гражданского законодательства заметно усиление принципа добросовестности участников гражданского оборота на всех стадиях развития гражданского отношения, в том числе при заключении и исполнении договорного обязательства. В качестве общего последствия недобросовестного поведения стороны правоотношения выступает возможность для другой стороны требовать возмещения причиненных убытков, в качестве специального - отказ в защите права. Кроме того, важное значение приобретает принцип непротиворечивого поведения (estoppel) и сотрудничества участников в процессе осуществления своих прав и исполнения обязанностей. Рассмотренные принципы осуществления гражданских прав являются существенными гарантиями реализации субъективных гражданских прав и нуждаются в дальнейшем развитии и внедрении в специальные нормы ГК РФ.DOI 10.14258/izvasu(2017)3-18 ; The article examines the specifics of the implementation of civil rights, taking into account the novels of civil legislation. The authors analyze the novels of civil legislation on the procedure for exercising of subjective rights by the participants of civil turnover, in particular, the norms regulating the principles and limits of the exercise of civil rights, as well as the norms establishing the consequences of violation of the rules of conduct prescribed by law. In the context of the change in civil law, strengthening is obvious of the principle of conscientiousness of participants in civil turnover at all stages of the development of civil relations that include concluding and executing of contractual obligation. As a general consequence of the dishonest conduct of a party to a legal relationship, it is possible for the other party to demand compensation for the losses, while a special consequence implies the refusal to protect the right. In addition, the special emphasis is made on the principle of consistent behavior (estopel) and cooperation of participants in the process of exercising their rights and performing of their duties. The considered principles of the exercise of civil rights are essential guarantees for the implementation of subjective civil rights and need further development and implementation in special norms of the Civil Code of the Russian Federation.DOI 10.14258/izvasu(2017)3-18

The article is devoted to the issues of procuring of systematiccivil legislation under conditions of its substantial renovation. Theseissues are studied by author in consideration of legal innovationsin the areas of transactions invalidity, legal entities institute, andgeneral thesis on obligations. On the basis of carried out analysis,it is concluded that the novels in these areas do not fully meet theneeds of systematicity of civil legislation. ; Статья посвящена вопросам обеспечения системности гражданского законодательства в условиях его значительного обновления. Указанные вопросы исследуются автором с учетомлегальных нововведений в сферах недействительности сделок, института юридических лиц, общих положений об обязательствах. На базе проведенного анализа делается выводо том, что новеллы в названных областях не в полной мереотвечают потребностям системности гражданского законодательства.
