The scientific article is devoted to the study of land (land plot) as an object of civil rights. The article indicates that the relevance of writing an article is due to the land reform in Ukraine. Delimitation of the legal concept of "land" and "land plot" is carried out. The article analyzes the rules of law on a land plot as an object of property rights. An integrated theoretical approach to the legal regime of land and a land plot as an object of civil rights is considered. The features of a land plot as an object of civil rights have been determined. The importance of protecting the lands of Ukraine by the state has been substantiated. It was found out how the legal regime of a land plot differs from the legal regime of other real estate or other things. Land and land plot are identified with the boon as an object of civil rights. The view of the land plot is illuminated as an intangible and material boon. A critique of the scientific definition of land as an object of land relations is given. It is determined that there is a need for a compromise between private interests, the interests of the land market and environmental interests, which can simultaneously contribute to the protection of the civil law regime of land and the protection regime of a natural object. A distinction is made between the legal regime of construction real estate and the legal regime of land as real estate. It also indicates the difference between a land plot as an object of property rights and other objects of property rights. The conclusion is made about the need for comprehensive legal regulation of land relations, about the limited legal regime of the land plot. Some shortcomings of land legislation were identified, and proposals were made for its improvement. Further, these objects are examined as an intangible boon and a material boon, and both objects are defined. The purpose of the article is, on the basis of the analysis of the current procedural legislation, to highlight the issue of bringing a civil action in criminal proceedings and its trial with the provision of proposals for amendments to the Criminal Procedure Code of Ukraine in this area. According to Part 5 of Article 128 of the Code of Criminal Procedure of Ukraine, a civil claim in criminal proceedings is considered by the court according to the rules established by this Code. If the procedural relations arising in connection with a civil suit are not regulated by this Code, the norms of the Civil Procedure Code of Ukraine shall apply to them, provided that they do not contradict the principles of criminal proceedings. However, today a number of legal provisions regarding the judicial review of a civil claim in criminal proceedings are not regulated by the Criminal Procedure Code of Ukraine. Conversely, the new provisions of the Code of Civil Procedure of Ukraine, regulating the procedure for resolving civil disputes, may be contradictory or incomprehensible given the existing Criminal Procedure Code of Ukraine. As a result of such legal gaps, difficulties may arise in exercising their representative powers in criminal proceedings. Відбувається глибока криза державної влади. Така ситуація приво-дить до соціальних конфліктів. Вони небезпечні для держави, оскільки протікають у формі демонстрацій, страйків,громадянських війн. Результат таких конфліктів непередбачуваний, але загроза розвалу держави присутня завжди.Основною причиною таких конфліктів є відсутність в управлінні суспільством із боку держави законності.Сама законність повинна формуватися на принципах верховенства права. Саме такі конфліктні ситуації галь-мують як розвиток громадянського суспільства, так і формування правової держави. Правова держава можливатільки за реального забезпечення верховенства права, верховенства закону, тому у статті аналізується сутністьтаких категорій, як «правова культура», «правосвідомість», «верховенство права», «законність».Існування верховенства права в системі правового регулювання держави можливе тільки за наявності в суспіль-стві правової культури, правової свідомості. Автор статті обґрунтовує, що саме правова культура є основою фор-мування громадянського суспільства. Тільки рівень правової культури суспільства забезпечує верховенство праваі законності. Сама законність можлива за умови забезпечення державою обов'язкової юридичної відповідальностівсіх членів суспільства під час порушення норм права.Автор доходить висновку, що існування реального механізму правового регулювання, який забезпечує закон-ність, можливе. The author also considers the featuresof society at the present stage of development of the statehood of Ukraine. Constitution of Ukraine states in the first articlethat the state is legal. This presupposes the existence of binding democratic institutions in society. This presupposesthe existence of binding democratic institutions in society. Democratic institutions in real support are possible onlyif there is a civil society. At the present stage in Ukraine, civil society is only being formed. There is a deep crisisof state power. This situation leads to social conflicts. They are dangerous for the state, as they take place in the formof demonstrations, strikes and civil wars. The result of such conflicts is unpredictable, but the threat of the collapse of thestate is always present. The main reason for such conflicts is the lack of legality in the management of society by the state.The rule of law itself must be based on the rule of law. It is precisely such conflict situations that hinder boththe development of civil society and the formation of a state governed by the rule of law. The rule of law is possible onlywith the real provision of the rule of law, the rule of law. Therefore, the article analyzes the essence of such categoriesas "legal culture", "legal consciousness", "rule of law", "legality".The existence of the rule of law in the system of legal regulation of the state is possible only if there is a legal cultureand legal consciousness in society. The author of the article substantiates that it is the legal culture that is the basisfor the formation of civil society. Only the level of legal culture of society ensures the rule of law and legality. Legalityitself is possible if the state ensures the mandatory legal responsibility of all members of society in case of violationof the norms of law.The author comes to the conclusion that the existence of a real mechanism of legal regulation, which ensureslegality, is possible. This can only be done if there are two systems: 1) a system of guarantees for rights and 2) a systemof ensuring legal liability in the absence of a system of duties.
The article deals with the issue of the operation of Civil Service Tribunal of the European Union from the moment the decision was made in 2004 to establish it until the termination of its operation in 2016. The Public Service Tribunal had been the only specialized court created by this time. It was found that the Nice Treaty of 2001 provided for a flexible solution to the problem: the Council of the European Union had the right to establish new judicial bodies of special jurisdiction as the third (lower) part of the EU judicial system. The author analyzes the reasons for the introduction of a special judicial body - Civil Service Tribunal. The Protocol No. 3 on the Statute of the European Union Court, which regulates the functioning of the specialized tribunal, has been researched. The article also examines the jurisdiction of the Civil Service Tribunal, internal structure, structure. It has been established that the European Union Public Service Tribunal exercised the authority of the first instance to resolve disputes between the Union and its employees in matters concerning labor relations, the social protection system, and had the right to consider disputes between all EU bodies and institutions, for example, between Europol and European Investment Bank. The analysis of the implementation of reform in the European Union judicial system, the main directions of the reform, the approaches that are used in this regard, are revealed, stated that the reform was aimed at ensuring the effective functioning of the European Union Court, optimizing the implementation of its tasks. It was found that the reform envisaged a gradual increase in the number of judges of the General Court and the merger of the Tribunal for Public Service with the General Court. It was investigated that the Tribunal for Public Service was disbanded as a result of apparent disproportionality between the financial costs of its maintenance and the positive outcome of its activities.
In the article, the author explored ways to ensure the fulfillment of obligations in the historical aspect. The author came to the conclusion that the institution for ensuring the fulfillment of obligations owes its origin to the law of Ancient Rome, where a harmonious system of such methods was created. The first mention of securing compliance can be found in the Justinian Code of 529. The types of obligations that can be secured by a deposit are determined. The ratio of the deposit and advance is established. The legal consequences of the violation and the termination of the obligation secured by the deposit are analyzed. Attention is drawn to the presence of gaps in civil legislation regarding the regulation of deposits and ways to fill them by introducing appropriate changes to the Civil Code of Ukraine are suggested.Keywords: provision of fulfillment of obligations, deposit, functions, legal nature ; У статті автором було досліджено способи забезпечення виконання зобов'язань в історичному аспекті. Автор прийшов до висновку, що інститут забезпечення виконання зобов'язань завдячує своїм походженням праву Стародавнього Риму, де було створено струнку систему таких способів. Перші згадки про забезпечення виконання зобов'язань можна віднайти ще в Уложеннях Юстиніана 529 р. Визначаються види зобов'язань, що можуть бути забезпечені завдатком. Установлюється співвідношення завдатку та авансу. Аналізуються правові наслідки порушення та припинення зобов'язання, забезпеченого завдатком. Звертається увага на наявність прогалин у цивільному законодавстві щодо регулювання завдатку та пропонуються шляхи їх заповнення шляхом внесення відповідних змін до Цивільного кодексу України.Ключові слова: забезпечення виконання зобов'язань, завдаток, функції, правова природа.
The historical trends and the state of modern legal regulation of property rights have been identified. The characteristics and features of the servitude as an object of civil rights have been investigated. The methods of ac-quiring and terminating a servitude, its scope and legal regime, the peculiarity of public easements are consid-ered. A servitud, as a kind of property rights that are the subject of rights to another's property, is a special catego-ry of property rights and a specific object of civil rights in view of the peculiarities related to its turnover. Servitude law not only gives the owner the opportunity to effective-ly use his property, but also provides for the satisfaction of the interests, including non-property, of others (for example, to exercise the right of vehicular and pedestrian traffic through another's plot of land even to place tem-porary structures). The right of a landowner to restrict-ed use of other land is necessary and satisfies the needs (or deficiencies) of the land at expense of other, usually neighboring plots. The person who has received servitude in due course has the following competences, which con-stitute the content of the servitude law.In the absence of consent to establish a servitude, the person concerned must prove in court that it is impossible to make normal economic use of the land in the absence of a servitude. When acquiring a servitude, a person should avoid abusing their rights. If there is no basis for the ac-quisition of rights, the attempt to acquire them by any means results in nullity of legal effects.There are always two parties in the servitude rela-tions: the landowner and the person (or several persons) who acquires a limited property right in the form of a servitude. Since any servitude is always a restriction on the right of others, it is thus the least burdensome for the owner of the thing. On the other hand, it should be noted that the restriction of property rights makes it necessary for the owner to refrain from certain actions that may vio-late the rights of another person. If a person has acquired a limited right, they cannot have legal relationship with the owner of the property. There is a type of limited right that is, legislative prohibition that narrow the content of subjective property law with a view to protecting and implementing the rights of others and that determine the relationships character. ; Виявлено історичні тенденції та стан сучасного правового регулювання речових прав на чуже майно. З'ясовано характерні ознаки й особливості сервітуту як об'єкта цивільних прав. Розглянуто способи набуття та припинення сервітуту, його обсяг і правовий режим, особливість публічних сервітутів. Набуваючи серві-тут особа має уникати зловживання своїми правами. За відсутності підстав набуття речових прав, спроба на-бути їх у будь-який спосіб зумовлює нікчемність пра-вових наслідків.У сервітутних відносинах завжди виступають дві сторони: власник земельної ділянки та особа (чи кіль-ка осіб), яка набуває обмежене речове право на чужу земельну ділянку у вигляді сервітуту. In this article essence of concept «disciplinary responsibility» is found out and the decision of definition is offered «disciplinary responsibility of civil servant». The fastened is marked in Law of Ukraine «On Civil Service» exhaustive list of breaches of discipline of civil servants, which is foundation for bringing in to disciplinary responsibility. It is marked about absence of concept «breach of discipline» in a current legislation. Suggestions are considered in relation to acceptance of the unique normatively act. ; У даній статті з'ясовано сутність поняття «дисциплінарна відповідальність» та запропоновано визначення дефініції «дисциплінарна відповідальність державного службовця». Зазначено закріплений в Законі України «Про державну службу» вичерпний перелік дисциплінарних проступків державних службовців, який є підставою для притягнення державного службовця до дисциплінарної відповідальності. Наголошено про відсутність поняття «дисциплінарна відповідальність державного службовця » в чинному законодавстві. Розглянуто пропозиції щодо прийняття єдиного нормативно акту.
Following the 2017 reform the civil litigation has been significantly changed. The action proceedings, inter alia, have been divided into general and simplified procedures. Therefore, the role of the court in determining the procedure for of the case consideration is decisive, since the law does not impose the obligation to apply to the court in a specific procedure but stipulates respective court power and criteria for its implementation.
Thus, the case may be heard in the general proceedings or in a simplified procedure, which provides for the possibility of a court hearing or without such a hearing, in accordance with the grounds and criteria laid down in Article 11, Parts 4 and 6 of the Article 274, Parts 1 and 2 of the Article 277, as well as Part 6 of Article 279 of the Civil Procedural Code of Ukraine, the common only approaches of which have not yet been achieved in practice. Therefore, the object of attention of the author is the problems of differentiation and determination by courts of specific grounds for consideration of civil cases according to the general or simplified procedure of action proceedings, as well as the appointment of a court session,
based on the analysis of first instances courts decisions, adopted during 2018-2019 and available for the research on the website of the Unified State Registry of Judgments.
As a result, the problematic issues that have arisen in the jurisprudence, in particular, regarding the decisive role of the court in choosing the civil case procedure have been identified and the relevant solutions have been proposed. The role of the court is to determine whether there are grounds for a simplified procedure, whether there are no grounds for a mandatory general procedure for this case consideration, as well as an assessment of the merits and motivation of the plaintiff's and defendant's motions for choosing the procedure for this case consideration, in particular, as it is defined in Article 11 of the Civil Procedural Code of Ukraine. Currently the directions for the development of modern civil procedural law such as optimization, facilitation, forwarding proceedings promoting the increase of the civil procedure efficiency factor are of peculiar importance. Their results are occurrence and functionality of simplified proceedings system designed to facilitate significantly hearing some categories of cases, promotion of their consideration within reasonable time and reduce legal expenses so far as it is possible. The category "simplified proceedings" in the native science of the procedural law is underexamined. A good deal of scientists-processualists were limited to studying summary (in the context of optimization) as a way to improve the civil procedural form, summary proceedings and procedures functioning in terms of the mentioned proceedings, consideration of case in absentia as well as their modification. Among the Ukrainian scientist who studied some aspects of the simplified proceedings are: E. A. Belyanevych, V. I. Bobrik, S. V. Vasilyev, M. V. Verbitska, S. I. Zapara, A. A. Zgama, V. V. Komarov, D. D. Luspenuk, U. V. Navrotska, V. V. Protsenko, T. V. Stepanova, E. A. Talukin, S. Y. Fursa, M. Y. Shtefan others. The problems of the simplified proceedings were studied by the foreign scientists as well, such as: N. Andrews, Y. Y. Grubanon, N. A. Gromoshina, E. P. Kochanenko, J. Kohler, D. I. Krumskiy, E. M. Muradjan, I. V. Reshetnikova, U. Seidel, N. V. Sivak, M. Z. Shvarts, V. V. Yarkov and others. The paper objective is to develop theoretically supported, practically reasonable notion of simplified proceedings in the civil process, and also basing on the notion of simplified proceedings, international experience of the legislative regulation of simplified proceedings, native and foreign doctrine, to distinguish essential features of simplified proceedings in the civil process and to describe them. In the paper we generated the notion of simplified proceedings that shall mean a specific, additional form of consideration and solution of civil cases that is based on the voluntary approach to its use, characterized by the reduced set of procedural rules and ends with rendering a peculiar judicial decision. Moreover, the most common features of summary proceedings are highlighted. Simplified proceedings as a specific form of consideration of dispute regarding civil law and as a special way to optimize legal proceedings is provided with a set of peculiar features that distinguish them among the other proceedings. Therewith, the analyzed features shall be defined as basic, in other words, such features peculiar to the certain kind of proceedings during its development and direct application to the civil procedural law. ; У статті досліджується окремий аспект проблеми спрощеного провадження в цивільному процесі. The article is devoted to the concept of emancipation of a minor in civil proceedings, providing on the basis of the analysis of scientific views and taking into account the current legislation theoretical and legal characteristics of the emancipation of a minor in civil proceedings. The problem of granting full civil capacity to minors (emancipation) is considered. The problem related to the procedure and grounds for granting full civil capacity to minors in civil proceedings is highlighted. The problems that arise when granting full civil capacity in court are analysed. Judicial practice of granting full civil capacity to a minor registered by the person's father or mother is considered. To achieve these results, a scientific description of the status of minors and the definition of emancipation, investigated the grounds and procedure for granting full civil capacity to minors and analysed the case law on granting full civil capacity to a minor who is registered as a child or parent. The conclusion is characterized that the rights of the child as a separate category of human rights have acquired and are gaining legal consolidation, based on the need for special treatment, taking into account the physiological and psychological characteristics of the needs of the child. The rights of the child, as well as human rights, should be spoken of in terms of power-to-person relations. If a child has a right, the state is obliged to guarantee it. For example, as defined in Article 55 of the Constitution of Ukraine – the rights and freedoms of man and citizen are protected by the court, respectively, the state guarantees everyone access to court, including minors. The state creates a judicial system and develops rules governing its functioning, which are constantly on the move and improving. These rules provide, inter alia, for the proper emancipation of minors by civil proceedings – the problem is urgent and insufficiently covered. New approaches to the analysis of the state of solving this problem in civil proceedings are contained in our study. ; Статтю присвячено поняттю емансипації неповнолітньої особи в цивільному судочинстві, наданню на підставі аналізу наукових поглядів та з урахуванням чинного законодавства теоретико-правової характеристики емансипації неповнолітньої особи в цивільному судочинстві. Розглянуто проблему надання повної цивільної дієздатності неповнолітнім особам (емансипації). Висвітлено проблему, пов'язану з порядком та підставами надання повної цивільної дієздатності неповнолітнім особам у цивільному судочинстві. Проаналізовано проблеми, які виникають під час надання повної цивільної дієздатності в судовому порядку. Розглянуто судову практику надання повної цивільної дієздатності неповнолітній особі, яка записана батьком або матір'ю особи. Для досягнення таких результатів здійснено наукову характеристику статусу неповнолітніх та визначення поняття «емансипація», досліджено підстави та порядок нaдaвання повної цивільної дієздaтності неповнолітнім особам та зроблено аналіз судової практики щодо надання повної цивільної дієздатності неповнолітні особі, яка записана батьком або матір'ю дитини. Охарактеризовано висновок про те, що права дитини як окрема категорія прав людини набули й набувають юридичного закріплення, базуючись на необхідності особливого ставлення, з урахуванням фізіологічних і психологічних особливостей, потреб дитини. Про права дитини, як і про права людини, слід говорити з погляду відносин «влада – особа». Якщо дитина має право, то держава зобов'язана гарантувати їй це право. Наприклад, як визначено у ст. 55 Конституції України, права і свободи людини і громадянина захищаються судом, відповідно держава гарантує кожному доступ до суду, у тому числі неповнолітнім особам. Держава створює судову систему і розробляє правила, що регулюють її функціонування, що постійно перебувають у русі та вдосконалюються. Зазначеними правилами передбачено здійснення належної емансипації неповнолітніх засобами цивільного судочинства – проблема нагальна та недостатньо висвітлена. Нові підходи до аналізу стану вирішення цієї проблеми в цивільному судочинстві містяться в нашому дослідженні.
The article is devoted to the analysis of the legal provision of insignificant civil jurisdiction cases. The meaning of insignificant civil jurisdiction cases are analyzed. Consideration and proposed methods for solving problems of insignificant civil jurisdiction cases. Possible prospects for further development in this direction. The Verkhovna Rada of Ukraine adopted the Law of Ukraine "On Amendments to the Commercial Procedural Code of Ukraine, the Civil Procedural Code of Ukraine and other norms of the Ukrainian legislation". By this law, the legislator introduced the concept of minor cases, which are considered in the simplified procedure. According to the Civil Procedural Code, the legislator noted that minor cases are: 1. Cases in which the value of the claim does not exceed one hundred living wages for the able-bodied. 2. Cases of minor complexity, declared by the court insignificant. The difference between the general and the simplified procedure is that the court examines the case in the form of a simplified lawsuit without notifying the parties of the materials available in the case. Also, consideration of the case in the order of the simplified lawsuit takes place without a preparatory meeting and not later than 30 days from the opening date of the proceedings. We believe that these changes are not complete and there are many defects that we encountered in studying the subject. The first problem is the very term of minor cases, it does not exist in civil procedural law. In view of this, we propose the introduction of the term Civil cases of no significant complexity, that is, the insignificant case is a civil matter, in which the controversial legal relationship nature, subject matter of evidence and the composition of the participants, etc., do not require the conduct of preparatory proceedings and / or court sessions for the complete and complete establishment of circumstances. Also there are also no nominal non-property cases assigned. Non-proprietary claims - claims that do not include claim fees. Therefore, one more problem arises from this. However, in our opinion, non-property disputes can`t be considered as insignificant, since the Constitution of Ukraine states that the person, his life and health, honor and dignity, inviolability and security are recognized in Ukraine as the highest social value. In addition, the legislator did not foresee the appeal of minor cases in the cassation court. Therefore, there is a need to further resolve this gap in civil law due to the violation of legal human rights to a fair trial. ; Статья посвящена анализу законодательного положения о малозначимости дел гражданской юрисдикции. Проанализировано значение малозначимости дел гражданской юрисдикции для судопроизводства Украины. Рассмотрены методы решения проблематики малозначительности дел гражданской юрисдикции, в частности, ограничения в кассационном обжаловании решений по малозначимым делам, и является ли это нарушением Конституции Украины. Определены возможные перспективы дальнейшего развития в данном направлении. ; Стаття присвячена аналізу законодавчого положення щодо малозначності справ цивільної юрисдикції. Проаналізоване значення малозначності справ цивільної юрисдикції для судочинства України. Розглянуті методи щодо вирішення проблематики малозначності справ цивільної юрисдикції, зокрема, обмеження у касаційному оскарженні рішень щодо малозначних справ, та чи є це порушенням Конституції України. Зазначені можливі перспективи подальшого розвитку у даному напряму.
