The article analyzes the institutional system of European Civil Procedure, supranational EU legislation of Civil Process, which is the basis of two recent pan-European procedures in civil and commercial matters,аnd procedures that facilitate efficient consideration and resolution of civil and commercial cross-border matters, including the service of judicial and extrajudicial documents, regulation of evidence, recognition and enforcement of judgments etc. ; В статье анализируется институциональная система European Civil Procedure, наднационального законодательства Европейского Союза в сфере гражданского процесса, основой которой явлются две современные общеевропейские процедуры по рассмотрению и решению отдельных категорий гражданских и коммерческих дел. Проанализированы положения, регулирующие вопросы передачи судебных и внесудебных документов, представление доказательств, обеспечение требований, признание и исполнение судебных решений, правовую помощь в трансграничных делах и тому подобное. ; У статті аналізується інституційна система European Civil Procedure, наднаціонального законодавства Європейського Союзу у сфері цивільного процесу, основою якої є дві сучасні загальноєвропейські процедури з розгляду й вирішення окремих категорій цивільних і комерційних справ. Проаналізовано положення, що регулюють питання передачі судових і позасудових документів, подання доказів, забезпечення вимог, визнання й виконання судових рішень, правову допомогу в транскордонних справах тощо.
The scientific article defines the legal nature and content of civil procedural legal personality of minors and juveniles involved in the case, as a prerequisite for acquiring their civil procedural status. It is determined that the obligatory precondition for the emergence of civil procedural status of a minor is a civil procedural legal personality as a set of civil procedural legal capacity and civil procedural capacity. It is substantiated that all minors and juveniles have general civil procedural legal capacity and can acquire without any restrictions in civil proceedings the relevant procedural status of a party, third party, applicant, interested person. As for special civil procedural legal capacity (ability to have civil procedural rights and obligations of bodies and persons authorized by law to protect the rights, freedoms and interests of others; representatives of parties, third parties, bodies and persons authorized by law to protect rights) , freedoms and interests of other persons, applicants and other interested persons, other participants in civil proceedings), such legal capacity of minors and juveniles in civil proceedings can not acquire, because it occurs only if the conditions specified in the law. It is proved that the civil procedural capacity of minors and juveniles, according to the amount of abilities that form it, is divided into: full civil procedural capacity, which is the ability to personally exercise all civil procedural rights and perform all civil procedural duties in court, and which is granted only to minors in the presence of the conditions specified in the law, and incomplete civil procedural capacity, which is the ability to personally exercise civil procedural rights under Part 1 of Art. 45 CРC of Ukraine, and which is given to all minors and juveniles as participants in civil cases.
The paper examines the legal nature and the regulatory grounds for two judicial conciliation procedures in civil proceedings, namely the amicable agreement and the procedure for dispute settlement with the participation of a judge. Attention is drawn to the urgent need to study judicial conciliation procedures in civil proceedings of Ukraine. Their functional efficiency in the current conditions is assessed, some problematic aspects of the legislative regulation of these institutions are identified and proposals are made to eliminate shortcomings and possible reformatting of these procedures, which would probably contribute to the effective and rapid resolution of civil disputes. It has been repeatedly emphasized that the development and use of conciliation procedures is a matter of the future for the entire justice system of Ukraine. The article determines the need to create a sufficient theoretical basis for the search for new or transformation of existing ways of regulating civil disputes, so that they solve the existing problems of the judicial system of Ukraine and contribute to the formation of "ideal justice". A thorough analysis of the norms of the Civil Procedure Code of Ukraine governing the application of the amicable agreement and the dispute settlement procedure with the participation of a judge is carried out; a number of remarks and proposals to the current civil procedural legislation of Ukraine are expressed. Possible ways of reformatting the legally defined mechanisms for resolving the dispute, which would partially or completely solve the tasks assigned by the legislator to judicial conciliation procedures, are proposed. Conclusions are formulated on the positive and negative phenomena caused by the reform of civil procedural legislation in terms of the conciliation procedures studied. In this article the norms of Books 1–3 of the Civil Code of Ukraine are examined in order to determine civil sanctions and their system. The au- thor stipulates that in the Civil Code of Ukraine there is no definition for the specific term "sanction" and its types, except for Article 354, which states only one type of the sanction, that is, confiscation. These gaps lead to the problems in determining the grounds for the application of certain measures of coercive nature and impede the effective protection of subjective civil law rights which are violated.
A critical analysis of existing classifications of civil sanctions is carried out, and an author's classification of the General Part of the Civil Code's sanctions is proposed, depending on the types of legal relationships governed by it. For the purposes of such classification, the author considers the subjective composition of the legal relationship, the focus on the restoration of the subjective civil law right, which is violated, or on the compensation of the harm caused, and the consequences of civil sanctions application.
A thorough analysis of the norms of Books 1-4 of the Civil Code is carried out in order to identify the norms containing civil sanctions. Thus, in the first three chapters of the Civil Code there is a lack of the norms containing civil sanctions. At the same time, Chapter 4 of the Civil Code is distinguished by the variety of civil sanctions that are proposed to be considered as civil sanctions that limit or impede the personal civil status of an individual in the circumstances specified in Articles 36, 37, 39, 41, 43, 46, 47, 481. Other provisions of the same chapter contain sanctions that restore the civil status of an individual, which causes him or her to have positive legal effects (Articles 38, 42) related to the restoration of the civil capacity of an individual whose civil capacity has been is limited or recognized as incompetent.
On the basis of the conducted research of the norms of the Civil Code, it is concluded that the diversity of civil legal sanctions in different chapters of the Civil Code, which have different directions and consequences of their application, despite the absence of their direct name "sanctions".

Громадянське суспільство формується та функціонує за вимогами дотримання рівня відповідності встановленим нормам і стандартам включення в суспільні відносини. І саме на цій основі відбувається ідентифікація та об'єднання учасників цих відносин.У даній статті автором аналізується поняття громадянської солідарності як поведінкової стратегії громадянського діалогу, яка є засобом реалізації інтересів громадян та способом їх волевиявлення, шляхом осмисленого вибору суспільного об'єднання та ідентифікації себе з ним. Громадянський діалог багато в чому залежить від громадянської солідарності, від розвитку рівня культури діалогової взаємодії суспільства і держави та, звичайно, від законодавчоправового закріплення процедур двосторонньої інтеракції влади і громадянського суспільства. The building instrument of it is civil solidarity as the main condition of society for the consolidation and unification. Civil society is formed and operated by the requirement of compliance with applicable standards and inclusion in social relations. And on this basis happens the identification and association of these relations.In this article the author examines the concept of social solidarity as a behavioral strategy of civil dialogue, which is the means of realizing the interests of citizens and their way of expression through meaningful selecting of social associations and identifying themselves with it. Civil dialogue is largely dependent on the social solidarity, on the culture development of dialogue interaction between society and the state, and of course, of the law and legal procedures consolidation of bilateral interaction authorities and civil society. On the one hand, the demand for interactive communication in society is determined by the degree of civil solidarity development of the population, on the other hand, this solidarity awakening only in the full and equal civil society dialogue with the government, which, by the way, today we lack for the establishment of a vibrant civil society in contemporary Ukraine.The problem of social solidarity in the «postSoviet» Ukraine is generated by the need to replace entrenched consciousness of the citizens «Soviet» concepts and values in modern Ukrainian identity factors and integration.
The article examines the adversarial principle, its legislative consolidation. This paper analyses the concept of the adversarial principle as the primary principle of the civil procedure. The case law of the European Court of Human Rights on the adversarial principle is examined. The article analyzes the opinion of such scientists as Komarov, Stefan and Mamnitsky. The article highlights elements of the adversarial principle. There are: 1) right of the parties to participate in the process; 2) the right to justify claims and objections; 3) the right to petition; 4) the right and obligation to adduce evidence; 5) the right to submit new and additional materials in the court of appeal, cassation, etc. Ability in litigation requires that the prosecution, defense, civil claimant and defendant have the same opportunity to convince the court of their correctness. The parties and other parties involved in the case have equal rights to adduce evidence, to investigate and to prove their conviction. The court has a leading role in the trial it facilitates the full, comprehensive clarification of the circumstances of the case and adjudicates on the basis of internal conviction, guided by law. This principle is undoubtedly a historically conditioned legal phenomenon, since, at a particular stage of society's development, depending on national peculiarities and legal traditions. This paper analyses the legislative consolidation of the principle of competition in the Constitution of Ukraine and the Civil Procedure Code of Ukraine. Moreover, the article explores the practice of the European Court of Human Rights. Such as Garcia Ruiz v. Spain case, Montovanelli v. France case, Salov v. Ukraine case and the case of Lazarenko and Others v. Ukraine.

The article analyzes the norms of the Civil Procedural Code of Ukraine in the wording of 2017 of procedural representation. The genesis of this institute in the Civil Process of Ukraine, starting with the Civil Code of the USSR of 1963, is briefly reviewed. The provisions of procedural representation in different types of proceedings are compared, in particular with economic and administrative ones. On the basis of this it is noted that there was a unification of the rules of representation, which is positive in terms of the practice of applying these provisions of the law. Also the author indicates the terminology and definitions used in this institute as applied in literature and legislation; analyzes the provisions of the Code regarding the types of procedural representation and accordingly indicates that the legislation introduced, along the traditional types of representation (legal and voluntary), another type of representation – self-representation. The article focuses on the possibility of applying procedural representation in different types of proceedings – the ordering proceedings, litigation (claim) and separate proceedings, and certain categories of cases. It is noted that at present, the legislator does not foresee any restrictions of the application of the institution of representation in any categories of cases, as it was in the CPC of Ukraine of 2004. Concerning the same types of proceedings, it is concluded that the institution of representation is applicable to cases of ordered and claim (general and simplified) proceedings. The article analyzes the approaches to psychological understanding of concepts "responsibility" and "citizenship", substantiates the content and structure of the civil responsibility in unity, determinism and complementarity of cognitive, emotional-motivational, behavioral-volitional, moral-spiritual components. The aforementioned structural components reflect the functional-dynamic expression of phenomenology of civil responsibility of personality. At the same time, cognitive, activates the flow of intellectual-search activity, the second describes the readiness to act in specific situations and promotes awareness of the actual public needs, the third ensures the functioning of specific practical activity, system of attitudes to perform the duties, the fourth produces self-awareness of oneself as a human who is guided, make decisions to realization and is ready to distribute public values against the background of own inner freedom not only as the subject of these values but also as a person and individuality of separate worldview models of behavior and activity. Also determined that the important features of expression of civil responsibility as an integral trait-property of personality are such as active life position, conscious attitude to perform somebody's civil duty, independence and persistence, self-analysis, self-control, self-organization, honesty, readiness to be responsible for own acts etc. High civil responsibility appears as an active, full of meaning and sense of life which is subject directs to the constant improvement himself as a citizen of the country, reveals social self-realization through erudition, social orientation and public position. Besides singled out preconditions that influence the formation of civil responsibility of personality(civil society, civil society consciousness and self-awareness). Overall proved that there is a direct dependence between the forms and organizations of civil society and the level of people's responsibility for what is happening in the country. The deeper expression of citizenship has the people, the more effective civil responsibility of each. Civil consciousness is formed in civil society, represents by itself inherent to human way of relating to objective reality and at the same time is a form of reflection of the reality with help of objectivated in the word socially produced knowledge, regulates the activity of the human and enables to predict the result of its action as a conscious goal. Civil self-consciousness of the personality is focused around the processes of awareness of itself as the carrier of civil values and attitudes to itself as to the subject of these values. The process of self-awareness mainly is carried out on a personal level of implementation civil tasks and social actions and also during interacting with others, as a result there is a conscious attitude of the person to own needs and abilities, appetences and motives of behavior, worrying and thoughts, actions and deeds. Вищезазначені структурні компоненти відображають функціонально-динамічний вияв феноменології громадянської відповідальності особистості. Водночас перший – когнітивний – активізує перебіг інтелектуально-пошукової активності, другий характеризує готовність діяти у конкретній ситуації та сприяє усвідомленню актуальних громадянських потреб, третій забезпечує функціонування конкретної практичної активності, системи ставлень до виконання обов'язків, четвертий продукує самоусвідомлення себе як людини, котра керується, приймає до зреалізування та готова розповсюджувати громадянські цінності на фоні власної внутрішньої свободи не лише як суб'єкт цих вартостей, а й як особистість та індивідуальність окремих світоглядних моделей поведінки і діяльності. Також визначено, що важливими ознаками вияву громадянської відповідальності як інтегральної риси-властивості особистості є такі, як активна життєва позиція, усвідомлене ставлення до виконання свого громадянського обов'язку, самостійність й наполегливість, самоаналіз, самоконтроль, самоорганізація, чесність, готовність відповідати за власні вчинки тощо. Висока громадянська відповідальність постає у вигляді активного, наповненого смислом і сенсом, життя, яке суб'єкт спрямовує на постійне вдосконалення себе як громадянина країни, виявляє соціальну самореалізацію через освіченість, суспільну спрямованість та громадянську позицію. Крім того, виокремлено передумови, що впливають на формування громадянської відповідальності особистості (громадянське суспільство, громадянська свідомість і самосвідомість). Загалом доведено, що існує пряма залежність між формами та організованостями громадянського суспільства і ступенем відповідальності населення за те, що відбувається у державі. Чим глибший вияв громадянськості має народ, тим дієвіша громадянська відповідальність кожного. Громадянська свідомість формується у громадянському суспільстві, являє собою властивий людині спосіб ставлення до об'єктивної дійсності і водночас є формою відображення реальності за допомогою об'єктивованого у слові суспільно виробленого знання, регулює активність людини та дає змогу передбачити результат своєї дії як усвідомлену мету. Громадянська самосвідомість особистості фокусується навколо процесів усвідомлення себе як носія громадянських цінностей та ставлення до себе як до суб'єкта цих вартостей. Процес самоусвідомлення здійснюється переважно на особистісному рівні виконання громадянських завдань та соціальних дій, а також під час взаємодії з іншими, у результаті чого й виникає усвідомлене ставлення особи до власних потреб і здібностей, потягів і мотивів поведінки, переживань і думок, дій і вчинків. This article provides a general analysis of the Model European Rules of Civil Procedure established in 2020 (hereinafter – the Rules). It describes their structure, defines the purpose and goals, main principles. The author comes to the conclusions regarding the role and importance of these Rules for the further development of civil proceedings, both in the EU Member States and in other countries, in particular, in Ukraine. The important role of the unification of the terminology of civil procedure is identified. In particular, we are talking about such specific institutions of civil procedural law as the principle of cooperation between a judge and parties, the principle of settlement, case management and others, which are absent in Ukrainian national legislation, nevertheless, very important for the scholar research. Second, the scope and main principles of the Rules require rethinking of traditional approaches to regulating the relationship between a judge, parties and their representatives, as well as the role of a judge in proceedings, new approaches to the phasing of court proceedings and the differentiation of civil procedure, which should be helpful while further development of the civil procedural legislation in Ukraine. Introduction. Protecting the public during the deployment of emergencies of different levels of danger is one of the most important challenges facing the state in the context of sustainable development and national security. In view of this, the selected issues are an important aspect of public administration in the current conditions of development of Ukraine. Reformation transformations in this field require a balanced and rational approach to decision-making, while taking into account the social, economic, and political conditions specific to the country, as well as globalization processes taking place in the world. In a special period, a single state civil protection system implements a state policy on civil protection.Purpose and methods of research. The purpose of the study is to find out the nature and content of a single state civil protection system. The theoretical basis of the research is the scientific development of domestic and foreign scientists on public finance and social policy. The following methods of scientific knowledge were used in the research: induction and deduction, analysis and synthesis, comparison, generalization, associations, analogies and others. Results. Following the adoption of the Code and the approval of the Regulation on the Unified State Civil Protection System in Ukraine, a single state civil protection system was formed, which excludes duplication of one system by another, as regulated by the previous legislation, defined a number of basic tasks, components and modes of functioning. By developing a single state civil protection system as a major component of state civil protection policy, the potential for improving the governance system defined in the Unified State Civil Protection System Regulation grows. There are four modes of operation of a single state civil protection system: daily functioning; increased readiness; emergency; state of emergency. In each case, the system is assigned clear tasks to establish a secure state within the country. However, in practice, there are a number of problems, which testify to the inability to ensure the proper functioning of the unified state system of civil protection in terms of fulfilling its tasks. The most important are limited financing of modernization projects and maintenance of a working state of the centralized management system; physical deterioration of technical means and obsolescence of information processing and transmission technologies; uneven coverage of individual territories of the country, especially in rural and mountainous areas; inadequate regulation of a clear strategy for the development of a single state civil protection system. Prospects. To date, despite the adoption of the Code and the adoption of the Regulation on a single state civil protection system in Ukraine, it is still too early to speak about the final formation and full-scale functioning throughout our country. Against this background, further research into creating an effective system for managing emergencies, minimizing their consequences and finding major ways to improve emergency management systems in a single state civil protection system remains highly relevant.
Development of information technologies, cryptocurrencies and technology of distributed networks has caused the appearance of smart con- tracts as new types of civil contract. They have been widely used in recent years in such areas as initial coins offering (ICO), financial sector, inter- national trade and public services. At the same time the legal status and legal regulation of smart contracts are uncertain. These uncertainties cause many legal risks of smart-contractsutilization. The purpose of this article is to find out the conception of smart contract as a form of civil contract, to research its legal status and legal regula- tion issues and to develop proposals for the improvement of legal regulation of smart contracts and cryptocurrencies in Ukraine. By its legal nature a smart contract is a digital form of a civil contract realized in programming code automatically executed in a distributed network. Like a civil contract, smart contract has such elements as parties, subject and essential terms of the contract. The legal force of a smart contract depends on whether it includes the fundamental features of a civil contact, such as evidence that parties have intention to create legal relations, understandabil- ity of contract conditions and possibility to perform the terms of the contract under duress. The main advantages of a smart contract are its ability to significantly accelerate and reduce costs of the transaction and guarantee the fulfillment of contract terms regardless of the contractual parties' and third parties' will. The main risks of a smart contract are uncertainty of legal status of a smart contract and cryptocurrencies as a means of payment, complexity of expressing the contact terms in a mathematical algorithm, risk of software bugs and hacking attack. To solve the problems of legal regulation of smart contracts in Ukraine it is necessary to change the legislation in order to settle the legal status of cryptocurrencies and recognize a smart contract as a form of a civil contract. It is necessary to identify parties of the smart contract, confirm their agreement on the terms of the smart contract by using digital electronic signature. A smart contract should be supplemented by text application containing the es- sential terms of the contract which will have legal force in trail. It is necessary to implement blockchain technology in the state registers and pro- vide legal ability to make adjustments in the registers automatically for the performance of smartcontracts.
The article analyzes the state control of civil aviation. A comparative analysis of various regulations in the field of civil aviation is conducted. It is concluded that there is a need to improve state control in the field of civil aviation. Civil aviation creates significant risks for businesses, the environment, society, and is at the same time an organic component of social and scientific and technological development. To date, the question of signs of state control of civil aviation in Ukraine has been almost unexplored. In addition, the issues of administrative and legal regulation of general aviation are unresolved. State control in the field of civil aviation is of great importance today. This is related to the rapid development of aviation, scientific and technological progress, European integration processes in Ukraine. The analysis of the domestic legislation leads to the conclusion that in Ukraine there is no single definition of general aviation, this raises a number of misunderstandings in the interpretation of activities performed by general aviation. According to Article 1 of the Air Code of Ukraine, general aviation is aviation not used for commercial air transportation and performance of aviation works. It is worth agreeing with the considerations of V. Zueva, V. Cherevatyuk that the current code does not form an idea of the subject of regulation of general aviation, therefore does not fix the possibility of carrying out any commercial activity, including conducting aviation works within the RAM, and allows for an ambiguous interpretation in the provisions of general aviation. In addition, the Code does not contain a direct prohibition on conducting commercial activities by general aviation. The article describes the essence of the concept of "civil culture" as a necessary condition for the civil society development. The modern scientific ideas treat the civil society as the totality of all citizens as well as of their free formations and associations connected with their social relations characterized by a high level of social consciousness and political culture, which are guaranteed and protected by the state, but are outside of it. The manifestation of the main signs of civil culture is a kind of an indicator of the civil society condition. Now, the increased attention to the civil culture is caused by the civil dialogue activation based on the principles of freedom and humanism. Our scientists regard the phenomenon of civil culture as a mixed culture type in which the different interests and aspirations of the members of society are rationally preconcerted, thus creating a basis for its development. The people's knowledge of their rights and duties, of the mechanism of the government, of the political systems, of the procedures of political and in particular of electoral process refer to the content of the civil culture. A survey of interviewed students of higher technical educational institutions affirms the urgent need for the formation of civil culture of future professionals. Because the moral perception of the mechanism of governmental power by the citizens and the development of the civil society in general depend on its level.
