International guidelines for managing investigation and collection of evidence of war crimes

The article is devoted to the peculiarities of the international regulations of the organization of the investigation and collection of evidence of military crimes. The objective is to analyze the effective minimization of the impact of destructive factors on the investigation of military crimes, so it is necessary to create a special governmental institution to cooperate with the International Criminal Court with the appointment of national coordinators in relation to amendments to the Code of Criminal Procedure of Ukraine, which provides for the possibility of investigation. The methodological basis of the research was the methods and techniques of scientific knowledge, specifically the main method of research was the dialectical method. It is concluded that the concept of investigation of military crimes committed in armed conflict and criminal prosecution of perpetrators can be defined as of important scientific and practical significance, a holistic interdisciplinary comprehensive theoretical system of activities under special conditions, which generally combines theoretical provisions on specific patterns in the field of legal support, organization of investigation and collection of evidence of military crimes. : search, arrest and transfer of officials involved in military crimes and implementation of international proceedings against the accused.

The purpose of this paper is to serve as a helpful tool for students, jurists, lawyers, judges and others, in the profesional and scientific aspect. In ruling a contested procedure in a professional manner, the court has to find the truth, so that the contested procedure is most efficient until reaching the final verdict. In my research, I intend to enrich the science with my knowledge in the field of contested procedure.In this study I have used analytical, comparative, synthesis, generalization and other methods.Those reading this paper will understand how evidence is the most important part in a fair trial, since failure to prove claims very often leads towards an incorrect situation; they will understand how difficult and painful would be forfeiting rights for the litigating party, which would lead to serious changes, such as losing property, losing a job, compensation of personal income, compensation for damage caused.The paper in itself contains deposited evidence, which maintain the level of estimation from the court in order to make a judgment in a contested procedure with a court verdict.In this paper I present the subject of: "Means of evidence and evidence collection in contested procedure", where I have tried to research the theory but also the practice in contested proceedings, addressing the positive aspects, the deficiencies and novelties. In the legal provisions of the Law on Contested Procedure of theRepublicofKosovo, no. 03/L-006, of 30 June 2008, and Law no. 04/L-118, of 13 September 2012, on amendments to the Law on Contested Procedure, evidentiary means and evidence collection are included in chapter XXII.

Nous étudions un modèle à deux périodes où la décision de la seconde période se fonde sur le choix ex ante d'un test. Les individus doivent classer des paires formées d'une « option » et d'un « essai », où une « option » consiste en un sous-ensemble fini d'alternatives qui représente les choix possibles de la seconde période, et où un « essai » est un sous-ensemble fini de tests délivrant des informations sur les alternatives. Plusieurs axiomes sont introduits qui permettent une représentation numérique au moyen d'une fonction de credence (crédibilité) décrite de la façon suivante. La fonction de credence attribue des nombres aux paires alternative-test. Le nombre de credence rattaché à chaque paire peut être interprété comme le degré de validation que le test apporte à la plausibilité de l'alternative. À chaque essai, chaque alternative est évaluée par la somme des nombres de credence obtenus lors de tous les tests de l'essai. Chaque paire option-essai est alors classée selon la somme maximale des nombres de credence obtenus pour l'option relativement à l'essai.
