Korean economic development has proceeded at the rapid rate of in the past two decades with neglect to some areas of human development, especially in the case of mental illness. But the government has belatedly recognized the importance and urgency of welfare and health programmes to cope with increasing problems. Mental health problems are more serious among the economically underprivileged than others. Because of large portion of mental patients from the economically underprivileged segment are at the without proper treatment or care. Thus it is imperative to develop easily assessible, cost-effective alternatives that would offer effective mental health care as well as useful social rehabilitation programmes. The government enacted the National Mental Health Law in December 1995. This project will assist to clarify the appropriate roles of the most effective care system. 20 nurse practitioners began a study on voluntary basis to assess the patients and their family with assessment tool which developed by research members. After that managed the 46 patients and their families through telephone or home-visiting, day care center programmes(such as social skill training, group therapy, movement therapy, art therapy) and counselling, refering hospital and family support group. The goals of research is to strengthen the capacity of psychiatric mental health nurse practitioners to undertake home and community-based mental health care services through various training programmes and expected outcome is this programme will be developed continuously and implemented to another community mental health center. Lastly, the cost-effective study of community-based mental health care will have been undertaken with realistic data provided by the pilot programme policy recommendations prepared for the Ministry of Health and Welfare. ; open

Between 1995 and 2011, Peruvian GDP grew by 4.9% each year, driven by exports and private investment's increase. However, it only grew by 3.3% in 2015 and by 4% in 2016 due to a reduction in the international price of metals that the country exports. In this scenario, the government elected in 2011 faced the challenge of replacing private investment with public investment as a growth engine. However, this decision revealed two structural problems of the Peruvian economy: 1) the limited spending capacity of central and regional governments; and 2) the difficulty of increasing tax collection due to a very significant informal sector in the country. However, trade liberalization, stability in domestic prices and reforms in public management are strengths of the Peruvian economy, which would enable it to return in the next few years to growth rates of around 4% or more.

본 논문은 대외정책 분야에서 드러나는 미국 대통령제의 운용원칙인 권력분립을 미국식 민주주의의 사각지대로 접근하는 시각을 제시하여 선행연구와 차별성을 추구한다. 구체적으로 헌법이 천명하는 권력분립 원칙에도 불구하고 오히려 그 권력분립의 기제인 상호간 독자적 선거제에 의해 미국의 유권자 전체가 선출한 대통령은 각 지역구에서 선출된 입법부 구성원이 내세우는 집합적 통치 위임과 확연하게 구별되는 유일한 공공리더십(public leadership)을 정책결정과정에서 독점할 수 있다는 점을 주시하고자 한다. 결국 미국 대통령제의 과제는 미국식 민주주의의 주요 통치원칙인 권력분립을 중시하는 동시에 성공적 통치를 위해 권한공유의 묘(妙)를 찾는 부단한 노력을 경주해야만 가능하다는데 있다. 특히 국내정책 분야보다 대외정책 분야에서 이 난제의 해법을 모색하는데 있어서 법제도적 및 정치적 장애물이 가로막혀 있다. 게다가 선거결과와 무관하게 통치 위임을 생성하는 정치의 사법화가 입헌 대통령제의 근간을 흔들 수 있는 위험성을 목격했다. 이에 본 논문은 대외정책 분야의 미국 대통령제에 대한 평가를 권력분립의 양면성, 즉 권력분립은 권력공유를 전제로 한다는 패러독스에 중점을 두고 대통령의 우위에 대한 주장을 가능하게 하는 헌법적 및 정치적 근거를 대조하면서 미국식 민주주의의 사각지대를 재조명하고자 한다. ; In this paper, I argue that the principle of separation of power in foreign policy under presidentialism invites a blind spot in American democracy. Although the Constitution specifies separation of power both in the conduct of domestic and foreign affairs, independent elections of President and legislators differentiate the kind of collective mandates on Capitol Hill from the unitary mandate bestowed upon President, thus prompting him to proclaim public leadership. The key to a successful governing, then, lies in the art of pursuing "separated institutions sharing powers" persistently. However, the realm of foreign affairs poses a more challenging task, both constitutionally and politically, than its counterpart in domestic policy. Furthermore, we came to witness a modern presidency whose relentless claim on mandate, or what is dubbed as judicialization of politics, was found irrelevant to the electoral outcome itself, thus creating a peril in constitutional presidency. 학위논문 (석사)-- 서울대학교 대학원 : 환경계획학과, 2012. 2. 전상인. ; 경주지역의 고도보존법 개정과정 사례는 사회구조의 변화에 따른 문제점과 갈등의 원인을 공공부문과 시민들이 함께 인식하고, 다양한 이해관계자들이 참여와 협력을 통한 상호작용으로 합의를 도출한 협력적 계획사례로 평가할 수 있다. 따라서 경주사례를 협력적 계획의 구성요소를 통해 분석해 보는 과정은, 지방 환경에서 협력적 계획이론의 적합성과 현실에서의 적용에 있어 발생하는 문제들을 어떻게 개선하여 보완해야 하는지에 대하여 시사점을 제공한다. 협력적 계획이론에 대한 탐구를 바탕으로, 협력적 계획의 네 가지 구성요소들인 '제도적 맥락', '상호작용의 장', '사회적 학습', '참여 및 합의형성'을 도출하였고, 그중 제도적 맥락을 중심으로 분석을 진행하였다. 경주지역 고도보존법 개정과정에는 공공부문과 시민부문을 중심으로 하는 다양한 이해관계자들이 네트워크를 형성하고 있으며, 공유된 이해에 따라 네트워크는 변화하는 양상을 나타냈다. 개정과정의 이해관계자들은 공청회와 주민설명회를 중심으로 하는 상호작용의 장에서 유통되는 정보를 바탕으로 사회적 학습을 하고 있었으며, 이를 바탕으로 계획과정에 참여하여 개정안의 도출이라는 합의를 형성하였다. 분석의 결과를 종합하면, 경주의 사례는 협력적 계획의 외형은 갖추어져 있다고 평가할 수 있지만, 실제 과정에 있어서는 공공부문의 제한적인 정보공개 범위와 접근성의 문제, 참여자의 대표성과 권력의 비차별성이 부족, 상호작용의 장에서 공동학습이 이루어지기보다 소통의 방향이 일방적이라는 문제점을 가지고 있었다. 제도적 맥락으로 종합하면, 경주지역에 있어 위 문제들은 이해관계자들 간 신뢰저하의 원인으로 작용하였다. 경주지역의 이해관계자들은 정책의 목표달성을 위해 표면적으로 협력하고 있지만 서로를 신뢰하지 않았다. 지방환경에서 발생하는 공공부문과 시민들 간의 신뢰의 문제는 지속적인 합의형성의 학습에서 그 해답을 구할 수 있기에, 정책적 제언을 통해 제도적 보완과 사유재산권 제한에 대한 해법을 모색하고자 하였다. ; Gyeongju-city's preservation law revision process is evaluated as collaborative planning practices. On this case, first the public sector and citizens recognize social problem and conflicts, then various stakeholders are produced agreement with participation and interaction. Therefore, this analysis of cooperative Gyeongju case through the components of the collaborative planning theory provides implications for suitability of collaborative planning theory. It also provides the application of local environment and how to improve and supplement in real life problems. To precede the analysis, first I studied on collaborative planning theory and then derived four components of the collaborative planning theory that 'institutional context', 'field of interaction', 'social learning', 'participation and consensus-building'. Among these components, analysis was performed mainly on the institutional context. Various stakeholders to form a network and a shared understanding of the network showed a changing pattern in this revision process. Stakeholders are conducting social learning, based on the information that delivered by public-hearings and presentations around field of interaction. Based on this information, they involved in the planning process and derived the agreement. In sum, this case evaluated as collaborative planning case superficially. But there are some problems in process that information, participation and mutual understanding. Problem that listed above acts as the cause of deterioration of trust between stakeholders. On the surface, to achieve the goals of the policy is working, but stakeholders are did not trust each other. Through policy proposal, I tried to seek a solution on deterioration of trust problem. Continuous learning on public consensus is encouraging a social capital, such as trust. Study institutional complements on regional commission and find solution in private property limitation problem, are able to derive consensus making. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 권형기. ; 본 연구는 발전국가 이후 한국 자본주의 제도 변화 과정에서 나타난 국가 성격 전환에 관한 연구이다. 구체적인 사례로 하도급 제도를 대상으로 세계화 과정에서 국가 성격의 변화를 경험적으로 밝히고 이의 이론적 성격을 규명하고자 한다. 발전국가의 변천에 관한 기존의 연구는 주로 시장국가 혹은 최소주의적 규제국가라는 단일한 국가 모델로 수렴할 것인가라는 테제를 중심으로 접근해 왔다. 세계화론자들은 자본의 이동이 자유로워지고 자본을 유치하기 위한 경쟁이 치열해지면서 발전국가가 변화하는 세계경제에 부적합하기 때문에 단일한 규제국가 모델로 수렴할 것이라 예측한다. 반면, 신제도주의자들은 각 국가마다 착종된 제도와 문화가 다르기 때문에 "발전국가 이후" 규제국가로의 전환은 발전국가의 개입주의적 성격이 유지되는 경로의존적 제도 변화를 겪게 된다고 주장한다. 발전 경로가 다양할 수 있다는 점에서 제도주의의 입장에 동의하지만 한국의 국가성격 전환에 대한 기존 연구는 발전국가의 유산에만 천착하여 새롭게 재편되는 국가의 역할에 주목하지 못하고 있다. 본 연구에서는 개입주의의 유산을 통해 발전국가의 연속성을 찾는 기존 연구의 문제제기를 벗어나, 시장자유화라는 세계화의 일반적 추세에 따라 한국의 국가 성격 역시 규제국가로의 수렴 과정에 있다는 명제 하에서 한국의 규제국가가 갖는 다양성의 동학을 살피고자 했다. 한국의 발전 모델이 규제국가로 전환된 것은 사실이나 신자유주의적 국가가 상정하는 최소주의적 국가로 변화한 것은 아니다. 오히려 시장질서의 유지를 위한 협치적 개입주의라는 독특한 규제국가 모델을 형성하고 있다. 본 연구는 기존의 국가전환론이 지나치게 정태적인 분석 방법을 사용하여 비교균형론에 머무르는 한계를 지적하고 협치적 규제국가로의 전환을 이해하기 위해 행위자 중심의 이념, 사고, 담론의 정치적 과정을 분석하였다. 한국의 산업화 시기 형성된 발전연합은 공정거래법과 하도급법과 같은 경쟁법의 제도화를 억제했다. 80년대 신자유주의 관료의 등장과 정치엘리트의 정책 기조 전환이 맞물리면서 현재의 하도급 제도의 기원이 형성될 수 있었다. 이후 하도급법의 확대 및 강화를 통해 신자유주의적 규제국가가 아닌 질서 자유주의를 기반으로 하는 규제국가 모델로 재편되는 모습을 보여주었다. 이렇듯 한국의 규제국가가 '최소주의적'인 국가는 아니었지만 불충분한 제도화로 인해 자본의 양극화 문제를 충분히 해소하는 데에는 부족했다. 규제국가의 한계를 인식한 정부는 규제보다 사회적 규범을 통한 문제 해결을 선호했기 때문에 하도급법 강화에 저항적이었다. 이로 인해 중소기업의 불만을 조직하여 대변하는 정치세력의 연동제 도입 노력은 실패로 돌아가고 대신 점진적 개혁이 이뤄졌다. 자본의 패권에 대한 인식과 규제 국가의 능력에 대한 의심에도 불구하고 정부는 탈규제와 시장 방임으로 나아가지는 않았다. 오히려 사회적 규범을 형성하기 위한 사회적 조정을 시도하는 적극적 협치주의를 추구했다. 동반성장위원회는 공정거래위원회와 달리 사회적 합의 기구라는 제도적 조건과 적극적인 정치적 의지로 인해 이익공유제, 업종 적합성 등 중소기업의 불만을 반영한 다양한 대안들을 제시하여 대기업 측을 압박할 수 있었다. 전경련은 집단행동을 통해 이익공유제에 대한 항의를 전달했지만 법제화에 대한 두려움으로 동반위에서의 이탈보다는 강력하게 반대해 온 납품단가 연동제를 수용했다. 결론적으로 한국의 국가 성격은 발전주의 시기 이후 규제국가로의 수렴을 겪었다고 볼 수 있지만 이는 신자유주의 이념에 의한 것이 아니라 질서자유주의에 입각한 규제국가로의 전환이었다. 그러나 규제국가의 딜레마로 인해 강성규제국가보다는 협치적 규제국가라는 타협적 제도화가 이뤄지고 있다. 연성 규범 형성을 위한 협치적 개입주의는 사회적 조정을 통한 제도 변화의 급진성을 가져올 수 있는 새로운 가능성을 보여주지만 강제력의 부재라는 한계 역시 내포하고 있다. ; This study examines how the form of the Korean developmental state has changed in the process of economic liberalization. More specifically, the study analyzes the transformation of the Korean state empirically and theoretically investigating the changes in the subcontracting institutions under the globalization. The main question of the previous research on the tranformation of the developmental state is whether the state develops into one national model, 'minimalist state'. Capital mobility and the competition for capital make the interventionist states insufficiently competitive. Neoliberals predict the convergence of the national diversity under globalization. Institutionalists, on the other hand, insist that although the interventionist state has developed into a regulatory state, the direction of transformation is determined by path dependence. However, the literature on the transformation of the Korean state has paid little attention to the newly constructed role of the state. Unlike the previous literature, this research examines the dynamic process of the transformation of the Korean regulatory state. It is true that although the Korean state has changed from developmental model to regulatory state, it is distinct from minimalist model based on neo-liberal ideology. Rather, a new regulatory model has been formed. State intervention occurs not as a form of transformed developmental intervention, but as a form of governance. In order to understand this transformation, this study analyzes the political process based on the discursive institutionalism. The growth coalition blocked the introduction of the competition law in the era of industrialization. The newly empowered neoliberal bureaucrats and the turn of the policy stance under the new junta regime made it possible to enact the competition law. Since 1980s, the subcontracting law has been gradually reinforced. After enacting the law, the Korean state has developed into the regulatory state based on the ordo-liberalism, not on the neoliberalism. However, it is insufficient for the change to close the widening gap between big businesses and small businesses. The government prefers constructing the governance to strengthening the law in order to resolve the problem. Facing the government's resist, political parties' efforts to rapidly change the law failed. Although the government concerned about the capital mobility, it did not seek de-regulation and laissez-faire policy. Rather, the government tried to form a social norm using the governance. Unlike Fair Trade Commission, the Commission on Shared Growth for largecorporations and Small and medium Enterprises exerted pressure on the big business by proposing alternative plans including profit sharing and lists for SMB business items. Although the Federation of Korean Industries took collective action against the profit sharing plan to adjust the cost of subcontracting to the changes in raw material prices, it had to accept the plan which the FKI had strongly opposed. In conclusion, the Korean state developed into the regulatory state after the "developmental state". However, it does not mean that the role of the state becomes minimal as the neo-liberalsts argue. Nor does it that the state create a new role dependent on the developmental legacy. Using a new-formed governance, the Korean state tried to change the subcontracting institutions. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 철학과(서양철학전공), 2012. 2. 정호근. ; The objective of this thesis is to elucidate the concept of the general will and to make Rousseau's point clear by refuting criticisms which determine the general will as totalitarianism. To this end, I would like to reconstruct the concept of the general will by focusing on Rousseau's paradoxical expression of 'forcing to be free'. Because I think that it is possible to get a correct understanding of the general will through paying attention to this phrase. There are two kinds of 'forcing to be free' in the theory of Rousseau's General will. One is found in the notorious passage arguing that whoever refuses to obey the general will must be forced to be free in the Book 1 chapter 7 of On Social Contract. The other is implicit one in the passage discussing the conditions of the general will in the Book 2 chapter 3 and Book 2 chapter 7(part 4 chapter 8). I would like to examine these problems respectively and try to show that Rousseau's ultimate point consists in not 'forcing' but 'freedom'. Conclusively, the authentic difficulty of interpreting of Rousseau's logic is that nevertheless 'forcing to be free' is necessary to the production of the general will, he permit the possibility of failure of this process in practice. Rousseau's theory of the popular sovereignty argues that the foundation of legitimacy of the state does not consist in the divine or natural foundation but in the autonomous will of the people. Despite this theoretical postulate, the people appear to not only rational and social unity, but also always potentially the multitude as disordered gathering of individuals who are vulnerable to a capricious passion. On the one hand, the people's general will should make a society legitimate, particular deliberation of the people may be contingent and could make an erroneous decision on the other. As a result, Rousseau introduces the legislator or the civil religion which is external to a people in order to transform a multitude into unified people. However, because of the very reason that people are still and always multitude, they consequently could not obey this foreign authority so the problem regarding difficulty of self-ruling of the people remains unsolved. At a glance, Rousseau's theory of popular sovereignty seems to optimistic assertion that the people should and could govern itself. But Rousseau's pessimistic claim that the ideal people cannot be naturally given, but must be constructed by constant effort should not be overlooked as well. Finally, the introduction of the legislator or the civil religion is not contradictory to the principle of popular sovereignty because the success or failure of this heteronomous agency is uncertain and the popular sovereignty keeps still its autonomy. The problems are described as follows: the general will aiming at common good could fell to mere will of all by acquiring of a particular will possessed by some individuals. In the same way, the people who should be unitary and organic are degenerated into a blind multitude and the citizen who must be active and rational in the collective deliberation into a passive, passionate subject. The principle of the popular sovereignty claiming that good law makes a good people but the origin of the good law must be also the people, and the fact that primitive people does not have any capacity to legislate such good law is the source of the circular logic Rousseau engages. It also suggests that the self-ruling of the people is not easily attainable project by the introduction of the legislator or the civil religion because after the initial social contract, passionate, irrational and apolitical properties of the human being who had had those attributes in the state of nature cannot be completely eradicated. So the state of the society in Rousseau is more vulnerable than the traditional reading in that there is always the danger of reemergence of the state of nature. The fact that the sovereignty belongs to the people but the people do not have such capacity to exert the sovereignty is the central ambiguity derived from the theory of popular sovereignty in Rousseau. Rousseau's democracy as self-ruling of the people, therefore, remains always incomplete, contestable and unfinished democracy. This paradox of Rousseau is deduced from the consistent, thorough accomplishment of the principle of the freedom. In other words, Rousseau's premises arguing that the legitimacy of the politics does not have any transcendent and ultimate ground and its source is a unique source of will of the people as free being even permit the freedom to refuse their freedom. That is to say, individual citizens must be forced to be free but also can have the (natural) freedom not to be forced to have (civil and moral) freedom. In short, as though effective denaturalization is necessarily required to make man into citizen, it remains a process without a priori guarantee. Thus, the binary oppositions which support Rousseau's whole system, such as oppositions between the society and nature, the people and multitude and the general will and the will of all always have the possibility of confusion in practice. That danger renders the general will only transient or temporary in the conflictual process of politics. The fundamental problem of politics suggested by Rousseau is that the passage from the state of nature to the state of society is necessary, but is also very difficult and could not be achieved entirely. In conclusion, all these considerations show that Rousseau's political philosophy does not defense the alleged totalitarianism but is the philosophy of 'freedom' in the strict and consistent sense of the word. ; 본 논문의 목적은 을 중심으로 루소의 일반의지 개념의 정체를 해명하고, 이를 전체주의로 규정하는 비판들로부터 루소의 논지를 명료하게 하는 것이다. 이를 위해 나는 '자유롭도록 강제'된다는 루소의 역설적인 표현을 중심으로 일반의지 개념을 재구성하고자 하며, 이 점에 주목할 때 비로소 일반의지 개념에 대한 정확한 이해가 가능하다고 본다. 루소의 일반의지 이론에서는 크게 두 가지의 '자유롭도록 강제됨'이 나타난다. 하나는 일반의지를 거부하는 자들이 자유롭도록 강제되어야한다고 주장하는 1부 7장의 주장이며 다른 하나는 2부 3장 및 2부 7장(4부 8장)에서 일반의지의 성립 조건을 논의하는 대목에서 드러난다. 나는 이들을 각각 살펴보고 루소의 궁극적인 강조점은 강제가 아니라 자유에 있음을 보여주고자 한다. 결론적으로, 루소의 논리를 따를 때 나타나는 진정한 난점은 자유롭도록 강제하는 과정이 일반의지의 산출을 위해 필수적임에도 불구하고, 실천적으로는 이것이 실패할 수 있는 여지를 허용하는 데에 있다. 루소의 인민주권론은 국가 정당성의 토대가 신적인 것이나 자연적인 근거에 있다는 견해를 부정하고 인민의 자율적인 의지가 정치적 권위의 원천이라고 주장한다. 그런데 인민은 항상 이성적이고 사회적인 질서정연한 통일체인 것이 아니라 또한 잠재적으로 정념에 좌우되기 쉬운 개인들의 무질서한 모임으로서 다중으로 현상하기도 한다. 즉 한편으로 인민의 일반의지는 사회를 정당한 것으로 만드는 조건이지만, 다른 한편으로 인민들의 개별 심의는 우연적이며 오류를 범할 수 있는 것이다. 따라서 루소는 다중을 인민으로 만들기 위해서 입법자와 시민종교와 같은 인민 외부의 권위를 도입한다. 그러나 인민은 그들이 다중이라는 바로 그 이유로 이러한 외부적 권위에 복종하지 않을 수도 있기 때문에, 인민이 스스로를 통치하는 것에 관한 난점은 해결되지 않는다. 일견 루소의 인민주권론은 인민이 인민 자신을 통치해야 한다는 낙관적 주장으로 보이지만, 인민은 그 자체로 주어지거나 발견될 수 없으며 다만 이상적 인민으로 구성되어야 한다는 루소의 비관적 주장 역시 간과되어서는 안 된다. 결국 입법자나 시민종교의 도입은 인민주권의 원리와 상충되는 것이 아닌데, 이러한 타율적 장치의 성공 여부는 불확실하여 인민주권은 여전히 그 자율성을 지니기 때문이다. 문제는 공동이익을 지향해야 할 일반의지가 각 개인이 갖는 특수의지의 득세에 의해 한갓 전체의지로 전락할 위험, 통일적이고 유기적이어야 할 인민이 무지몽매하고 개별적인 다중으로 전락할 위험, 집단적인 심의에 있어 능동적이고 합리적이어야 할 시민이 수동적이고 정념에만 사로잡힌 신민으로 전락할 위험에 있다. 좋은 법이 좋은 인민을 만들지만 좋은 법의 출처는 또한 인민이어야 한다는 인민주권의 원리, 그리고 최초의 인민은 그러한 입법을 할 수 있는 역량을 가지지 못하는 다중이라는 상황이 루소가 사로잡힌 순환 논리의 원천이다. 그런데 사회계약 이후에도 인간이 자연 상태에서 갖던 감성적, 비합리적, 비정치적 속성은 완전히 해소되지 않으며, 이는 입법자나 시민종교 같은 장치를 통해서도 인민의 자기통치가 온전히는 달성될 수 없는 난제임을 보여준다. 이처럼 루소의 사회 상태는 항상 부분적으로나마 자연 상태가 돌발할 수도 있는 위험을 갖는다는 점에서 취약한 것이다. 주권은 인민에 속하지만 인민은 스스로를 직접 통치할 수 있는 역량을 결여한다는 것이 루소의 인민주권론이 보여주는 애매성이다. 그러므로 인민의 자기통치로서 루소의 민주주의는 항상 불완전하여 계속해서 갱신되고 수정되어야 하는 미완의 민주주의로 남는다. 루소에서 이러한 역설은 자유의 원리를 일관되게 관철시키게 됨에서 귀결된다. 즉 정치의 정당성에는 어떠한 선험적이고 궁극적인 토대도 없다는 것, 인민은 자유로운 존재로서 그들의 의지만이 정치적 정당성의 유일한 원천이라는 루소의 전제는 그들이 스스로의 자유를 거부할 자유마저도 허용한다. 다시 말해 각 개인은 일반의지의 실현을 위해서 자유롭도록 강제되어야 하지만, 이들은 '자유롭도록'(즉 시민적 자유와 도덕적 자유) 강제되지 않을 수 있는 자유(즉 자연적 자유)를 가질 수도 있다. 요컨대 인간을 시민으로 만들기 위해서는 효과적인 탈자연화가 요구되지만, 이는 보증없는 과정이다. 따라서 루소의 체계를 떠받치는 이항대립, 즉 사회와 자연, 인민과 다중, 일반의지와 전체의지는 항상 실천적으로는 혼동될 위험을 가지며 이러한 위험은 일반의지가 정치의 갈등적인 과정 속에서 단지 일시적으로만 가능한 것으로 만든다. 루소가 보여주는 정치의 근본 문제는 자연 상태로부터 사회 상태로의 이행이 필수적이지만, 동시에 이것이 매우 어렵고 온전히 달성될 수 없다는 것이다. 결론적으로 이러한 탐구는 루소의 철학이 전체주의를 대변하는 것이 아니라 여전히 '자유'의 철학이며, 그것도 매우 일관적인 의미에서 그러함을 보여준다. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과(행정학전공), 2012. 2. 정광호. ; 국문 초록 본 연구에서는 고구려연구재단과 동북아역사재단의 설립과정을 역사적 사회 환경적 관점, Allison의 정부정치 모형적 관점, 그리고 Kingdon의 정책흐름 모형적 관점에서 비교 분석하여 두 기관의 설립, 두 기관의 제도적 성취 및 역할 범위의 차이를 가져온 요인이 무엇인가를 밝혀보고자 하였다. 일반적으로 조직설립을 다루는 이론으로서 역사적 사회 환경적 관점에서는 조직 환경론, 특히 구조적 상황이론과 조직생태이론이 유용한 분석도구로 활용되어져 왔다. 이러한 이론들은 조직설립이 그것을 둘러싼 맥락 또는 상황에 의존한다는 결정주의적 입장을 취하고 있기 때문에 특정 상황적 요인의 존재 또는 발생으로 조직이 설립되었다는 것을 설명하는 데는 유용한 관점인 것으로 인식되어져 왔다. 하지만, 본 연구에서는 조직 환경론적 관점만으로는 왜 특정 공공조직은 특정 상황 또는 맥락의 존재에도 불구하고 설립 또는 사멸되지 않으며, 왜 유사한 공공조직간 제도적 성취의 차이가 발생하는 가를 설명하는 데는 한계가 있다고 보고 조직설립과 관련된 조직 환경론적 관점의 한계를 적시함과 동시에 준 정부조직 설립과정의 특수성을 감안하여 정부정치모형과 정책흐름 모형을 추가로 적용함으로써 고구려연구재단 및 동북아역사재단 설립과정에 대한 비교분석을 시도하였다. 먼저, 역사적 사회 환경적 관점에서는 구조적 상황이론과 조직 생태이론을 적용하여 두 기관의 설립을 가져온 역사적 배경이 무엇이며, 동북아역사재단 설립과 더불어 이에 흡수 통합된 고구려연구재단의 사멸 요인이 무엇인지를 밝혀보고자 하였다. 동 연구 결과에 의하면, 고구려연구재단의 사멸은 낮은 신뢰성 및 예측가능성, 신생조직의 불리, 작은 조직 규모 및 예산, 핵심적 조직 변화의 시도 및 동북아역사재단의 설립에 기인한 것으로 나타났다. 두 번째로, Allison의 정부정치 모형을 통하여 두 기관 설립을 둘러싸고 벌어진 참여자들의 흥정과 타협을 분석하여 이들의 입장·선호·인식·기대이익 등의 차이가 두 기관의 설립 및 제도적 성취에 어떠한 영향을 주었는가를 설명하였다. 그 결과 두 기관의 설립 및 제도적 성취의 차이 발생은 핵심참여자로서의 대통령과 행정기관의 인식 및 선호의 차이에 의해 크게 영향을 받은 것으로 나타났다. 다시 말해, 고구려연구재단 설립과 관련된 대통령 및 행정기관의 인식 및 입장은 한·중 양국의 외교관계 등을 의식해서 상당히 유화적이었던 반면, 일본의 역사교과서 왜곡 및 독도 영유권 도발로 시작된 동북아역사재단 설립과 관련하여서는 대통령과 행정기관의 인식이 매우 단호하였던 것으로 밝혀졌다. 세 번째로, Kingdon의 정책 흐름 모형을 적용하여, 두 기관 설립을 둘러싼 문제 및 정책의 흐름의 차이가 어떠하였는지를 비교 분석하였다. 먼저, 문제 흐름의 측면에서 고구려 역사 왜곡 문제에 대한 정책 당국자 또는 학계의 인식은 약했으며, 정책의 흐름도 시민단체 주도로 이루어져 일관성 및 강도가 약했다는 것을 확인하였다. 반면, 일본의 역사 교과서 왜곡 및 독도 영유권 도발로 촉발된 동북아역사재단 설립을 둘러싼 문제의 흐름은 강하고 일관성이 있었으며, 정책 흐름 역시 대통령과 행정기관의 주도하에 하향식으로 이루어져 일관되고 강하게 진행되었다. 이러한 두 가지 흐름상의 차이가 두 조직간 제도적 성취의 차이를 가져온 또 다른 설명 요인이었다고 할 수 있다. 본 연구의 결과, 발견된 시사점은 다음과 같다. 먼저, 역사적 사회 환경적 관점만으로는 공공조직 설립과정을 명확히 이해하는 데는 한계가 있다는 것을 확인하였다. 다시 말해, 역사적 사회 환경적 관점은 조직의 구조나 기능을 결정하는 요인으로 특정 환경 혹은 맥락을 강조해왔지만, 동 관점만으로는 왜 특정 환경의 존재에도 불구하고 왜 특정시점에는 조직 설립 또는 사멸이 이루어지지 않다가 다른 시점에 와서야 이루어지는가에 대해서는 명쾌한 해답을 제공하지 못하는 한계가 있다는 것이다. 두 번째, 준 정부조직은 민간조직과는 달리 법적·행정적·제도적 제약 조건하에서 설립되는 경우가 많기 때문에 준 정부 조직의 설립과정을 보다 명확히 이해하기 위해서는 보다 다양한 관점 즉, 정부 정치적 관점 및 정책 흐름적 관점 등을 통한 기존 이론의 보완 또는 대체가 필요하다는 것이다. 특히 우리사회가 다원화된 사회로 진행되어감에 따라 공공조직 설립과정을 이해하기 위해서는 참여자의 정치적 흥정과 타협을 다루는 정부정치적 관점에 대한 고려가 필요할 것으로 본다. 주요어: 역사적 사회 환경적 관점, 구조적 상황이론, 조직 생태이론, Allison의 정부정치 모형, Kingdon의 정책흐름 모형, 준 정부조직 ; ABSTRACT A Comparative Analysis of the Establishment Processes of Two Quasi-Governmental Organizations: The Cases of the Koguryo Research Foundation and the Northeast Asian History Foundation Si Yung Jung Department of Public Administration Graduate School of Public Administration Seoul National University The purpose of this study is to analyze through a comparative approach the establishment processes of the Koguryo Research Foundation and the Northeast Asian History Foundation from the perspectives of historical-social environment, Graham Allison's Governmental Politics Model, and John W. Kingdon's Policy Streams Model in order to clarify the establishment processes of these two organizations and to identify which factors determined their institutional achievements. Generally, both contingency theory and organizational ecology theory have been widely used as tools for analysis of organizational establishment. These theories have strengths for explaining the contingencies and contexts which determine the establishment of organizations. However, these theories have weaknesses in explaining the reasons why an organization fails to be established in the presence of a certain contingency or why there are differences of institutional achievements between certain similar organizations. To further the understanding of organizational establishment and the incidence of differences of institutional achievement between the two organizations, this study adopted the Governmental Politics Model and the Policy Streams Model. In the perspective of the historical-social environment, both contingency theory and organizational ecology theory were adopted as tools for analysis. Contingency theory assumes that the structure or management style of an organization depends on the environment which surrounds the organization. In the perspective of contingency theory, the creation of the Koguryo Research Foundation was initiated by the Chinese distortion of Koguryo history, while the Northeast Asian History Foundation was created by the Japanese distortion of history and sovereignty provocation over Dokdo. The perspective of organizational ecology theory was adopted to explain the reasons why the Koguryo Research Foundation was closed and then merged into the Northeast Asian History Foundation after two and one-half years of activity. Through this perspective, this study found that the closure of the Koguryo Research Foundation resulted from such factors as lower reliability and accountability, the liability of newness, the small size of its organization and budget, the attempt of essential organizational change, and the creation of a new organization, the Northeast Asian History Foundation. In the perspective of the Governmental Politics Model, this study examined how the political resultants, the Koguryo Research Foundation and the Northeast Asian History Foundation, were drawn through bargaining and negotiation by the players involved in the game. This study revealed that the differences in the institutional achievements between the two quasi-governmental organizations resulted from the differences of the players' perceptions, preferences, and stands on the issue. In terms of perception, the perception of key players such as the president of the Republic of Korea and his administration on the issue of the Chinese distortion of Koguryo history was pacificatory, while the perception of the president and the administration on the issue of the Japanese distortion of history and the issue of Dokdo was quite determined. Through this lens, this study also found that the players perceived the issue not only on the basis of national interests, but also on the basis of their organizational interests and personal concerns. Finally, through the viewpoint of the Policy Streams Model, this study examined how the streams of problems and policy alternatives proceeded along the processes of the founding of the two quasi-governmental organizations. According to the analysis, the streams of problems surrounding the founding of the Koguryo Research Foundation were weaker than the streams of problems concerning the Northeast Asian History Foundation. In the perspective of policy streams, those concerning the founding of the Northeast Asian History Foundation were consistent and strong due to the determined stand of the president on the issue, while the policy streams regarding the Koguryo Research Foundation were incremental, inconsistent, and mutated due to the lack of presidential support and the passive attitude of the administration toward the issue. The first implication of the study is that a variety of aspects of organizational establishment should be reviewed to understand the process of organizational founding more clearly. Though organizational environment theories have assumed that environment or context determines the structure or function of the organization, the theories can not clearly explain why the birth or closure of an organization occurred in a specific time in spite of the presence of previous contingencies. The second implication is that policy makers or researchers should consider such factors as politics, administration, and the legality of the issues regarding the establishment of a quasi-governmental organization, because quasi-governmental organizations are governed by legal, administrative, and other institutional constraints unlike private organizations. The third implication is that, as Korea society is growing more pluralistic, the relevance of the Governmental Politics Model is likely to become higher in explaining the establishment processes of quasi-governmental institutions in the Republic of Korea. 학위논문(석사)--서울대학교 대학원 :행정대학원 행정학과(정책학전공),2019. 8. 금현섭. ; 여성의 경제활동 참여와 맞벌이 가구가 증가하면서 육아기 자녀를 둔 부모는 근로권과 부모권의 양립이라는 과제를 안고 있다. 정부는 두 권리의 양립사이에서 발생하는 문제를 해결하고 궁극적으로 여성의 경력단절, 저출산 등의 사회적 문제를 극복하고자 다양한 일ㆍ가정양립제도를 시행하고 있다. 공직사회에서도 여성공무원과 맞벌이 공무원이 증가하면서 일하며 자녀를 양육할 수 있는 환경 조성의 필요성이 커지고 있다. 이에 정부는 그동안 시행해 온 출산휴가, 육아휴직, 유연근무제 등의 일ㆍ가정양립제도 외에 근로시간을 단축할 수 있는 육아시간제를 새로 시행하게 되었다. 육아시간제는 만 5세 이하 자녀를 둔 공무원이 최대 24개월 동안 급여의 삭감 없이 하루 최대 2시간 이내에서 단축근무를 할 수 있는 제도로, 시행된 지 채 1년이 되지 않았기에 제도 정착까지는 일정한 시간과 노력이 필요하다. 따라서 본 연구에서는 육아시간제 사용에 영향을 미치는 요인을 분석하고, 이를 바탕으로 육아시간제의 원활한 사용을 위한 정책적 대안을 제시하였다. 육아시간제 사용에 미치는 영향요인을 분석하기 위해 중앙부처 공무원을 대상으로 설문조사를 실시하였고, 수집된 자료는 STATA를 통해 분석하였다. 또한 설문을 보완하고 개인의 사례 및 제도 사용경험과 현장의 상황을 풍부히 이해하고자 인터뷰도 실시하였다. 분석결과, 업무적 요인인 업무의 상호의존성과 즉흥성은 육아시간제 사용경험에 유의한 영향을 미치지 않는 것으로 나타났다. 조직적 요인의 경우 과업지향적 문화와 비우호적 분위기의 세부지표 중 조직 내 제도 사용자가 드묾만 육아시간제 사용에 유의한 영향을 미치고, 비우호적 분위기의 세부지표 중 상사ㆍ동료의 눈치, 인사상 불이익, 동료에의 미안함은 유의하지 않았다. 제도적 요인의 경우 제도의 규정과 절차의 정비 지표 중 초과근무의 불인정만 유의한 영향을 미쳤고, 재량규정과 산정방식의 불합리함은 유의하지 않았다. 한편 질적연구에서는 각각의 요인들 모두 육아시간제 사용을 결정하는데 영향을 미치는 것으로 나타났다. 종합해보면 제도 대상자들이 육아시간제 사용에 있어 업무적, 조직적, 제도적 요인의 영향을 모두 인식하고 있으나, 제도의 사용을 결정함에 있어서는 조직적ㆍ제도적 측면의 장애를 제일 심각하게 받아들이고 있음을 알 수 있었다. 본 연구결과를 바탕으로 육아시간제 사용을 활성화하기 위한 몇 가지 방안을 제시하였다. 첫째, 육아시간제에 대한 안내와 조직 내 가정친화적 분위기를 조성해야 하고, 둘째, 육아시간제 사용자 확대를 위해 강제적 제도 사용을 위한 인사평가 등의 제도를 개선해야 하며, 셋째, 단축된 근무시간에 맞는 업무량이 주어져야 하고, 마지막으로 현실과 어긋나는 제도 규정을 개선해야 한다. 이를 통해 육아시간제가 잘 정착하여 많은 육아기 공무원의 부모권과 근로권이 조화롭게 보장받기를 바란다. ; With the participation of women in economic activities and the rise of double-income households, child-rearing parents are facing the task of the compatibility of working rights and parental rights. The government has implemented a variety of work-family compatibility systems to solve problems arising between the two rights and ultimately to overcome social problems such as female career discontinuation and low birth rates. In officialdom, the need to create an environment, where female and dual-income civil servants can work and foster children, has grown. In response, the government has introduced a new childcare time system that can shorten working hours in addition to work-family compatibility systems of maternity leave, paternity leave and flexible work system that has been implemented so far. The childcare time system is a system that has been in place for less than a year, and it requires a certain amount of time and effort to settle the system. Therefore, this paper aims to analyze the factors affecting the use of childcare time system and based on this analyze the paper also aims to propose an alternative policy for the smooth use of childcare time system. In order to analyze the factors that have influence on the usage behavior of the childcare system, the central government employees are surveyed and the collected data are analyzed through STATA. Interviews are also conducted to supply the survey and to provide a good understanding of the interviewee`s case and experience. The analysis shows that task`s interdependence and spontaneity, which are work-related factors, do not significantly affect the experience of using childcare time. In the case of organizational factors, among indicators of task-oriented culture and unfriendly atmosphere, unusual institutional users in the organization has significant influence on the use of childcare time system, and among the indicators of unfriendly mood, the look of supervisors and coworkers, personnel disadvantage, and their sorriness to coworkers are not significant. In the case of institutional factors, only the disapproval of overtime has a significant effect on the maintenance indicators of the system's regulation and procedures, and discretionary regulation and the absurdity of calculation methods was is not significant. Qualitative studies have shown that each factor has an effect on determining the behavior of childcare time system use. Overall, people are aware of the effects of work-related factors or organizational and institutional factors in the use of childcare time system, but they take organizational and institutional obstacles the most seriously in determining the use of the system. Based on the results of this study, several measures have been proposed to promote the use of childcare time system. Firstly, guidance on the childcare time system and the family-friendly atmosphere within the organization should be fostered. Secondly, the system should be improved to expand the use of the childcare system by connecting and evaluating the usage, Thirdly, the workload should be given according to the shortened working hours and finally, the system regulations that go against reality should be improved. Background Low-quality services of emergency medical institutions, unclear function of institution classification, and overcrowding of emergency departments (ED) of regional emergency medical centers (regional centers) have been major problems in the Korean emergency medical services system (EMSS). In 2015, the Middle East Respiratory Syndrome (MERS) outbreak spread from patients waiting for hospitalization in the overcrowded ED. The MERS outbreak was an event that revealed the vulnerability of EMSS and opened the policy window to solve the problem of EMSS in Korea. Several policies for EMSS improvement were implemented after the 2015 MERS outbreak focusing the improvement of emergency medical services (EMS) delivery system and ED infection control. This study investigates the policy processes for improving emergency EMSS and infection control program after the MERS outbreak. The purpose of this study was to examine the policy processes regarding EMSS from the view of policy actors and draw lessons for improving the EMSS in Korea. 2. Methods A mixed method was utilized to identify and explain the complex subject of the policy processes of Korean EMSS during and after the MERS outbreak in 2015. As a quantitative study, changes in EMSS after MERS were investigated according to the WHO's model of a national health system infrastructure. Literature review and data analysis of Korean Health Insurance Service (NHIS) database were conducted. In Korea, the NHIS covers all citizens. A quantitative analysis was performed on 16,965,755 cases using ED during 2014-2016. In-depth interviews were conducted on 30 experts, who were involved in the emergency medical policy process, including clinicians, policy experts, and hospital management experts. The total interview time was 55 hours and 4 minutes. Changes in EMSS and the policy process after the MERS outbreak were evaluated from the view of policy actors. In this study, quantitative data was interpreted qualitatively, and independent qualitative evaluation was conducted, as well. Therefore, this research is a mixed-methods study focusing on qualitative research. SAS version 9.4 was used for the quantitative analysis and NVivo 12.0 was used for the qualitative analysis. 3. Results The quantitative analysis results showed that in the area of EMS delivery system, the human resource of ED and number of regional centers have been increased and facility, equipment, and manpower standards have been revised in order to expand emergency medical resources. As a result, the number of medical personnel and emergency intensive care units in regional centers increased and profitability of ED improved as well. The number of monthly ED visits temporarily decreased during the MERS outbreak but then recovered afterward. As ED overcrowding indicators were emphasized in the evaluation of EMS institutions, monthly mean ED length of stay of regional centers was decreased. However, despite the emphasis on providing critical care, transfer rate of severe emergency patients was not decreased. In the policy processes of EMS, experts evaluated that EMS delivery system was set up as a pseudo-agenda and exploration and comparison of policy alternatives were not sufficiently carried out. As a result, the physicians did not comply with the policy implementation and policy goals were not achieved. In the area of ED infection control program, the human resources for infection control and the number of isolation unit of ED were increased. Budgets for emerging infectious disease management were increased and profitability of infection control was also improved. The EMS Act was revised to respond to emerging infectious diseases and indicators related to infection control were strengthened in evaluation of EMS institutions. In the qualitative research, experts said that since the ED infection control program was such an intuitive and obvious problem, it was easy to become a policy-agenda. Despite the resistance of small hospitals, ED infection control program was implemented by powerful policy measures such as the revision of the Law. As a result, policy goals of expanding the infection control resources and improving the infection management environment were able to be achieved. From results of observing EMS policy process, the following characteristics of policy actors were found. First, there was difference of opinions within the physician subgroup as well as between government and medical professionals. ED staff, other department staff, and hospital executives, who have different views on policy alternatives could have all served as veto points in the policy process. Second, while the EMSS expert organization, which was an unofficial participant in the emergency medical policy process, could have played both roles of cause group and sectional group in the policy process, their sectional position has been emphasized, thereby weakening their insider status during policy process. Third, policy actors understood the publicness of EMS differently in terms of its ownership and function. The ED staff insisted that government support is needed because emergency medical care is based on public interest, however, some staffs were unwilling to provide less profitable cares, leading to conflict. Main characteristics of the emergency medical policy process that made it difficult to successfully implement are as follows: First, there was lack of consideration regarding variation of EMSS in Korea, such as distribution of medical resources among different regions, incentives to hospitals, and understanding of functional variations in ED. Second, the problem of the EMS delivery system was a problem of the low quality of emergency medical care. Third, the lack of professionalism in some physicians has lowered the capacity of emergency medical care, as well as trust between patient and doctor, therefore made the problem more difficult to solve. 4. Discussion Based on the analysis of the policy processes of the EMSS after the MERS outbreak in Korea, following lessons are suggested. First, setting the goals of EMS from the perspectives of citizen is warranted. The final performance goal should focus on improving health status of citizen and satisfaction with emergency medical care. Second, to close the gaps among policy actors in understanding policy content and policy process, actors should work together to explore the root causes of the problems and establish a policy agenda together. Third, a policy alternative should be causal in solving the problems in EMSS considering variation of EMS. Fourth, compliance with policies could be secured by internal persuasion among policy actors with proper incentives and reasonable punishment, especially EMSS expert organization. Fifth, policy outcomes should be evaluated based on both policy output and side effects together to identify policy impact. Sixth, policy governance regarding EMSS should be established and the roles of EMSS expert organization should be strengthened as the cause group rather than sectional group. This study examined the emergency medical policy processes from the view of policy actors through the 2015 MERS outbreak in Korea. Specifically, this study empirically analyzes how the quantitative and qualitative levels of the resident participation system influenced the democratic performance of local governments. The involvement of residents in the policy process of local government is an essential element for decentralization and actual operation of local autonomy, which is the complementary means of representative democracy. Resident participation plays a role in improving the practical problem-solving ability by preventing local government policies from violating reality. It is also known that civic involvement in the policy process plays a positive role in improving the responsiveness and effectiveness of administration. Therefore, local governments consider various measures to promote participation of residents. There are many ways to promote participation. Among them, the institutional introduction and continuous operation of the means of involvement of the residents has a positive effect on the invigoration of the involvement of the residents, as it provides the basis for the participation of the residents and broadens the scope of participation. In addition, the resident participation system can serve as a mechanism for maintaining and supporting appropriate resident participation in the policy process. Therefore, institutionalization of participation in local government is meaningful, and this study deals with civic involvement system based on such discussion. If so, is it good to have a lot of participation systems in the policy process at the basic level of local government? In reviewing previous studies, the introduction of a new resident participation system has the effect of activating resident participation or enhancing government performance. Therefore, it emphasizes the necessity of introduction to local governments that have not yet introduced the participatory system, and suggests methods for successful operation of the participant system. Previous studies have shown that the effects after the introduction of the new resident participation system or the qualitative nature of the participation system have a positive effect on the activation of resident participation and government performance. Point out that this will be a helpful option in terms of promoting participation or improving government performance. Yet another preliminary study suggests that the essential reason for local governments to introduce participatory participation systems may not be the expansion of participatory participation or the improvement of government performance. In other words, it is a formal means to show that local government officials are at work, or as a means of demonstrating that they are not falling behind in competition with other local governments. In such cases, the introduction of the resident participation system may have a negative impact on the welfare or government performance. Why is it important to measure government performance at the level of local government, and why do we consider the resident participation system as a major influencer of local government performance in this study? In general, government performance means making policy decisions that respond to citizens' policy needs and implementing them efficiently. Participation through the participatory system as a formal channel of participation not only guarantees the continuity of policy process participation, but can also reflect democratic, transparent, and responsive policies and public services because it can reflect diverse interests and communication. Therefore, the resident participation system is a channel and a means to guarantee continuous and stable resident participation. Most of the existing studies evaluate that participatory participation system acts as a catalyst for local autonomy and is justified in terms of improving government performance. Nevertheless, some studies question the effectiveness of the resident participation system, including the fact that the policy reflection rate through the resident participation system remains low at the local government's policy process and the effectiveness of the resident participation system is low. In addition, some previous studies have cited the inability to accurately measure the effect of citizen participation through resident participation system. In other words, it was difficult to determine whether the resident participation system directly influenced the government performance improvement or whether the resident participation system affected the society and the government performance improved as a result. However, it is clear that the purpose of the resident participation system is to enhance the democratic outcomes of local governments and ultimately improve the quality of life of residents. This fact is more evident when examining the Basic Ordinances on Participation of Residents, which are established by Ordinance by some local governments, which states that the purpose of the citizen participation is to promote administrative transparency and responsiveness. In other words, the purpose of the resident participation system is to improve the democratic performance of local governments. If so, it would be necessary to take a step further from the existing studies and use variables that can measure how transparent, democratic and responsive the administration has been due to the operation of the actual participatory system. Based on the above discussion, this study measured the quantitative level of the resident participation system introduced from 2005 to 2017 when the actual operation of the resident participation system was confirmed for 226 local governments in 2019. Next, the quality of the participation system was measured by categorizing the individual participation system based on the scope and intensity of participation. Type III systems are the ones with the highest intensity of delegation with the participation of the general population among the total residents participation system. Finally, the democratic achievements of local governments were divided into transparency, responsiveness and effectiveness of each basic local government. Transparency of local governments was measured by the Comprehensive Integrity Index, and responsiveness was measured by the total number of complaints handled per government official, and by the share of grievances and other complaints. Effectiveness was measured by the ratio of social welfare budget to the total budget and the quality of life index of residents. As a method of analysis, fixed effect panel analysis was used. The summary of the analysis is as follows. First, the increase in the quantitative level of the resident participation system for the local government at the basic level has a significant negative effect on the transparency of administration, while the increase in the share of the Type III resident participation system has a positive effect on the transparency of the administration. It was also confirmed that the transparency of administration did not decrease as the total number of operation of the resident participation system increased, but that the slope converged to zero when the quantitative level of the participation system reached a certain level. On the other hand, in the local governments at the County level, it was found that when the resident participation system fell short of the average number of operations, it had a negative effect on the transparency of the administration, while exceeding the average number of operations had a positively significant effect on the transparency of the administration. Second, the increase in the quantitative level of the resident participation system has a negative effect on administrative responsiveness, and the increase in the quality level has no statistically significant effect. However, the quantitatively appropriate level of the resident participation system, which improves administrative responsiveness, was confirmed in the case of the District level of local government. Although the total number of operation of the participatory system reached a certain level, it had a negative effect on administrative responsiveness, but beyond that level, it was found to have a positive and significant effect on responsiveness. Third, the increase in the quantitative level of the resident participation system has a positive effect on the effectiveness of administration. As the total number of operation of the resident participation system increased, both the proportion of social welfare budget and the quality of life of the residents increased. However, the statistical significance of the quantitative and qualitatively appropriate levels of the resident participation system to enhance the effectiveness of administration could not be confirmed. Based on this, the implications of this study are as follows. As discussed above, most existing studies analyze the effect of each participatory system implemented by local governments or their impact on the performance of specific sectors of local governments, or the effects of implementing participatory systems on individual municipalities. In addition, existing researches are only on comparative studies between local governments operating specific participatory systems and on the possibility of revitalization of participatory systems. In other words, there is a limitation in that not only the collective effects of various participation systems used in local government policy processes but also the effects of accumulated participation systems over time are not considered. In order to overcome these limitations, this study approached the resident participation system at the collective level and focused on the direct effect of the institutional factor on the government performance. Theoretical implications of this study are as follows. First, this study expanded the spatial and temporal scope of analysis to overcome the limitations of the analytical objects of previous studies. Second, the participation system was analyzed from various angles. Various types of typology of resident participation system suggested in the previous study were summarized, and it was confirmed that the effect on government performance also appeared differently according to the kind of participatory system. Third, this study attempted to measure government performance on a democratic level. Since the ultimate goal of the resident participation system is to realize local autonomy and to promote democracy, this paper analyzes the transparency, responsiveness, and effectiveness of administration focusing on the democratic dimension of government performance. Fourth, this study tried to make the analysis accurate by conducting fixed effect panel analysis that can control individual specificity such as endogenous local government's effect and time effect which was not controllable in the cross-sectional analysis used in the existing research. In terms of policy, the implications of this study are as follows. First, this study considered the quantitative and qualitative level of the resident participation system as a major influencing factor of government performance. Increasing the quantitative and qualitative levels of the resident participation system had a significant influence on the democratic performance of local governments. In particular, it was found that in order for the resident participation system to have its original effect, it must be an institution with an interactive attribute including a means for communicating with the government and delegating authority to the residents. Second, this study diagnosed the quantitative and qualitative levels of the local participation system, which is currently operated by local governments, and suggested the basis for the selection and concentration of future participation system. Third, although the administrative implications of the research on the performance of local governments are considerable, empirical research is insufficient. This seems to be because the performance of local governments is not only objectively measurable, but also limited in obtaining usable variables. Therefore, this study limited government performance to democratic performance, and analyzed total democratic performance of local government using various variables that can be measured. The limitations of this study are as follows. First, since the quantitative and qualitative levels of the resident participation system were measured at the collective level, the individual characteristics of each resident participation system could not be reflected in depth in measuring the quality level. Next, due to the limitations of the data available to local governments at the basic level, this study could only reflect the use of subjective indicators to measure democratic government performance such as 'quality of life of residents' in Seoul Metropolitan Government. In this regard, the results and methods of this study are based, and it will be necessary to approach in various ways how and in what circumstances the participation system has a significant effect on 지방정부에는 도입의 필요성을 강조하고, 시행 중인 지방정부에는 참여제도의 실질적 운영을 위한 방법을 제시한다. 그러므로 새로운 주민참여제도를 도입한 이후의 효과 또는 참여제도의 속성이 주민참여의 활성화 혹은 정부성과에 긍정적으로 유의미한 영향을 주었다는 기존의 연구결과들은 지방정부가 앞으로 더 많은 주민참여제도를 도입하는 것이 주민참여의 활성화나 정부성과 제고 측면에서도 도움이 되는 선택이 될 것을 말해준다. 하지만 또 다른 선행연구에 의하면, 지방정부가 주민참여제도를 도입하는 이유가 주민참여의 확대나 정부성과의 제고에 있다는 것은 부차적인 문제일 뿐이라고 주장한다. 그뿐만 아니라 지방정부의 관료가 일하고 있다는 것을 보여주기 위한 형식적 방법, 다른 지방정부와의 경쟁에서 뒤처지지 않고 있다는 것을 증명하는 하나의 수단으로 주민참여제도를 도입, 운영하기도 한다는 것이다. 이럴 때 주민참여제도의 도입은 오히려 주민 복리 또는 정부성과에 부정적 영향을 미칠 수 있다. 한편, 지방정부 수준에서 정부성과를 측정하는 것은 왜 중요하며, 본 연구에서 지방정부 성과의 주요 영향요인으로 주민참여제도를 고려하는 이유는 무엇인가? 일반적으로 정부성과는 시민의 정책적 요구에 반응하는 정책 결정을 하고, 이를 효율적으로 집행하는 것을 의미한다. 참여의 공식적 통로인 주민참여제도를 통한 주민참여는 정책과정 참여의 지속성을 보장할 뿐 아니라 다양한 이해관계와 의사소통을 반영할 수 있으므로 민주적이고 투명하며, 대응성 높은 정책과 공공서비스를 산출할 수 있도록 유도하는 역할을 할 수 있다. 다시 말해 주민참여를 지속적이고 안정적으로 보장할 수 있는 통로이자 수단이 바로 주민참여제도인 것이다. 대부분의 기존연구들은 주민참여제도가 지방자치의 촉매제 역할을 하며, 정부성과 제고 측면에서도 정당성이 높다고 평가한다. 그런데도 일부 연구들은 실제 지방정부의 정책과정에서 주민참여제도를 통한 정책반영비율은 낮은 수준에 머물러 있고, 주민의 참여제도에 대한 효능감도 떨어지는 등 주민참여제도의 효과성에 의문을 제기한다. 또한, 주민참여제도를 통한 주민참여의 효과를 정확히 측정할 수 없기도 하거니와 주민참여제도가 정부성과 제고에 직접적 영향을 미친 것인지, 주민참여제도를 통해 주민참여가 활성화됨으로써 사회에 영향을 미치고 결과적으로 정부성과가 향상된 것인지 판단하는 데 어려움이 있었다. 그러나 확실한 점은 주민참여제도의 목적이 지방정부의 민주적 성과를 제고하여 최종적으로는 주민의 삶의 질 향상에 있다는 사실이다. 이러한 사실은 일부 지방정부가 조례로 제정한 「주민참여에 관한 기본조례」를 살펴보면 더욱 확실히 나타나는데, 주민참여가 행정의 투명성과 대응성을 증진하고자 하는 목적이 있음을 명시하고 있다. 즉, 주민참여제도의 목적은 지방정부의 민주성 성과의 향상인 것이다. 그렇다면 기존연구에서 확인한 바와 같이 주민참여제도가 가지는 효과의 측정을 재정이나 예산자료를 활용하여 양적으로 측정한 연구에서 한 걸음 더 나아가 실제 주민참여제도 운영으로 인해 얼마나 행정이 투명하고 민주적이며 대응적으로 변화했는지를 측정할 수 있는 변수를 활용해야 할 필요가 있을 것이다. 이상의 논의를 바탕으로 본 연구는 2019년 기준 226개 기초단위의 지방정부를 대상으로 주민참여제도의 실제 운영이 확인되는 2005년부터 2017년까지 도입된 주민참여제도의 양적 수준을 측정하였다. 더불어 개별 주민참여제도를 참여의 범위와 강도를 기준으로 유형화하여 시행 중인 전체 주민참여제도 중 일반적 주민이 참여하면서, 권한위임의 강도가 가장 큰 참여제도들(제 Ⅲ형 제도)이 전체 시행 중인 주민참여제도에서 차지하는 비중을 주민참여의 질적 수준으로 측정하였다. 다음으로 지방정부의 민주적 성과를 각 기초 지방정부의 투명성, 대응성, 효과성으로 구분하고 종합청렴도지수, 공무원 1인당 전체 민원처리 건수, 고충 민원과 기타민원의 합이 전체 민원에서 차지하는 비중, 전체 예산대비 사회복지예산의 비중, 주민의 삶의 질 지수로 측정하였다. 분석방법은 고정효과 패널 분석을 활용하였다. 분석결과를 요약하면 다음과 같다. 첫째, 기초단위의 지방정부 전체를 대상으로 주민참여제도의 양적 수준의 증가는 평균적으로 행정의 투명성에 부정적으로 유의미한 영향을 미치지만, 제 Ⅲ형 주민참여제도 비중의 증가는 행정의 투명성에 긍정적으로 유의미한 영향을 미쳤다. 또한, 주민참여제도의 총 운영 건수가 증가할수록 행정의 투명성이 지속해서 감소하는 것이 아니라, 참여제도의 양적 수준이 일정 수준에 이르면 그 기울기가 0에 수렴함을 확인하였다. 한편, 군 단위의 지방정부에서는 주민참여제도가 평균 운영 건수에 미치지 못할 때는 행정의 투명성에 부정적 영향을 미치지만, 평균 운영 건수를 넘어서면 오히려 행정의 투명성에 긍정적으로 유의미한 영향을 미치는 것으로 확인되었다. 둘째, 주민참여제도의 양적 수준의 증가는 행정의 대응성에 부정적으로 유의미한 영향을 미치는 것으로 나타났으며, 질적 수준의 증가는 통계적으로 유의미한 영향력을 가지지 못하는 것으로 확인되었다. 그러나 구 단위 지방정부의 경우 행정의 대응성을 제고하는 주민참여제도의 양적 적정 수준이 확인되었다. 참여제도 총 운영 건수가 일정 수준에 이르기까지는 행정의 대응성에 부정적 영향을 미치는 것으로 나타났지만, 그 수준을 넘어서면 대응성에 긍정적으로 유의미한 영향을 미치는 것으로 확인되었다. 셋째, 주민참여제도의 양적 수준의 증가는 행정의 효과성에 긍정적으로 유의미한 영향을 미치는 것으로 나타났다. 주민참여제도의 총 운영 건수가 증가할수록 전체 대비 사회복지예산의 비중과 주민의 삶의 질 모두 증가하는 것을 확인하였다. 그러나 행정의 효과성을 제고하는 주민참여제도의 양적 및 질적 적정 수준의 통계적 유의미성은 확인할 수 없었다. 이를 바탕으로 본 연구의 함의를 제시하면 다음과 같다. 앞서 논의한 바와 같이 대부분의 기존연구들은 지방정부에서 시행하는 각각의 주민참여제도가 가지는 효과 또는 지방정부의 특정 부문의 성과에 미치는 영향력을 분석하거나, 개별 지방자치단체를 사례로 참여제도 시행의 효과 분석, 특정 참여제도를 운영 중인 지방정부 간 비교연구, 참여제도의 활성화 가능성에 관한 연구에 머무르고 있다. 다시 말해, 지방정부 정책과정에서 활용되는 다양한 주민참여제도의 집합적 효과뿐 아니라 시간이 흐름에 따라 누적된 참여제도가 미치는 효과 또한 고려하지 못했다는 한계가 있다. 본 연구는 이러한 한계를 극복하고자 집합적 수준에서 주민참여제도에 접근하였고, 주민참여제도라는 제도적 요인이 정부성과에 가지는 직접적 효과에 주목하였다. 구체적으로 본 연구의 함의를 이론적 측면에서 살펴보면 다음과 같다. 첫째, 본 연구는 선행연구가 가진 분석대상의 한계를 극복하기 위해 분석의 공간적, 시간적 범위를 확장하였다. 둘째, 주민참여제도를 다양한 각도에서 분석하였다. 먼저, 선행연구에서 제시한 주민참여제도의 다양한 유형화 방식을 종합적으로 정리하였으며, 어떤 속성을 가진 참여제도인지에 따라서 정부성과에 미치는 효과 또한 차별적으로 나타난다는 것을 확인할 수 있었다. 셋째, 정부성과를 민주적 차원에서 측정해보고자 하였다. 주민참여제도가 가지는 궁극적 목적이 바로 지방자치의 실현과 민주주의의 제고에 있으므로 정부성과의 민주적 차원에 초점을 두어 행정의 투명성, 대응성, 효과성을 분석하였다. 넷째, 본 연구는 기존연구에서 활용한 횡단면 분석에서 통제 불가능했던 개별 지방정부 고유의 효과 및 시간 효과와 같은 개별특이성을 모두 통제 가능한 고정효과 패널 분석을 시행함으로써 분석의 정확성을 꾀하고자 노력하였다. 다음으로 정책적 측면에서 본 연구의 함의는 다음과 같다. 첫째, 본 연구는 정부성과의 주요 영향요인으로서 주민참여제도의 양적, 질적 수준을 고려하였다. 주민참여제도의 양적, 질적 수준의 증가는 지방정부의 민주적 성과에 유의미한 영향력을 미치는 것을 확인할 수 있었다. 특히 주민참여제도를 설계할 때 제도가 본래의 효과를 가지기 위해서는 정부와 주민이 상호작용할 수 있고, 주민에게 권한을 위임할 수 있는 수단이 포함된 교호적 성격을 가진 제도여야 한다는 것을 알 수 있었다. 둘째, 기초 지방정부 수준에서 개별 주민참여제도가 가지는 속성이 민주적 정부성과에 영향을 줄 수 있음을 확인한 바와 같이 지방정부가 현재 시행 중인 주민참여제도 전반의 양적 및 질적 수준을 진단하여 향후 주민참여제도의 선택과 집중에 도움이 될 수 있는 근거를 제시하였다. 셋째, 지방정부 성과에 관한 연구가 가지는 행정학적 함의는 상당한데도 실증연구는 부족한 실정이다. 이것은 지방정부의 성과가 객관적으로 측정하기 어려울 뿐 아니라 활용할 수 있는 변수를 획득함에서도 한계가 있기 때문으로 보인다. 그래서 본 연구는 정부성과를 민주적 성과로 한정하였고, 이를 측정할 수 있는 다양한 변수를 활용하여 지방정부의 민주적 성과를 총체적으로 분석하였다. 한편, 본 연구의 한계는 다음과 같다. 먼저, 주민참여제도의 양적 및 질적 수준을 집합적 수준에서 측정하였기 때문에 질적 수준의 측정에 있어 각각의 주민참여제도가 가지는 개별적 속성을 심층적으로 반영하지 못했다. 다음으로 본 연구는 기초단위의 지방정부에서 활용 가능한 데이터의 한계로 인해 '주민의 삶의 질'과 같은 민주적 정부성과를 측정하는 주관적 지표 활용을 서울특별시 자치구를 대상으로밖에 반영하지 못했다. 이러한 부분에서는 본 연구의 학위논문(석사)--서울대학교 대학원 :인문대학 국사학과,2019. 8. 정용욱. ; This paper analyzes the organization and activities of the UNKRA(United Nations Korean Reconstruction Agency), which was established and operated under the UN General Assembly in the 1950s for Korean rehabilitation and reconstruction. Through this, this research tries to understand the problem of economic reconstruction in Korea after the Korean War. When UNKRA was founded, the United Nations forces anticipated military success and an early cessation of hostalities. However, Chinese intervention in Korea might prolong hostilites and hamper rehabilitation and recovery indefinitely. In the early years, UNKRA could not fully implement the reconstruction program until the military situation had settled down. Instead, it operated under military supervision. During the war, UNKRA mainly seconded its experts to the UNCACK(United Nations Civil Assistance Command in Korea). After September 1952, CINCUNC, UNKRA and the Government of the Republic of Korea agreed to start as much basic rehabilitation and reconsruction program as the military situation would allow. Nevertheless, the general situation had made it necessary to accord the first priority to the importation of consumer goods. Furthermore, UNKRA proceeded to develop comprehensive plans and programs in the support of the UN specialized agencies and the Nathan Associates. The Nathan Associates developed the Five-Year Plan for the reconstruction of Korea, which meant Korea could achieve economic independence in five years. It suggested that the major portion of investment would go into sectors of physical production and distribution where the direct, measurable impacts on national output would be heaviest and quickest. However, despite of the desirability of a large social investment programs in Korea after the Korean War, they did not emphasize upon social investment because of limited resources for reconstruction. After Armistice in July 1953, UNKRA actually launched the reconstruction program. However, UNKRA could not take over responsibility for all relief and rehabilitation activities because the United States developed a defense support program for South Korea after the war. That is, UNKRA was assigned a certain segment to operate and the rehabilitation of the war was coordinated through the OEC(Office of the Economic Coordinator). Nevertheless, UNKRA was independent from the defense support program of the United States and could emphasize on non-military areas of the economy. UNKRA's largest over-all investment allocation was made in the idustrial field. UNKRA undertook the reconstruction of the major industrial plants and the construction of new manufacturing facilities in the important sectors of manufacturing industries. In spite of many problems in operation and shortages of funds, it provided the capital and engineering for industrial expansion in Korea. ; 본고는 1950년대 한국의 전후 재건과 부흥을 위해 유엔 총회 산하에 설립되어 활동했던 유엔한국재건단(UNKRA: United Nations Korean Reconstruction Agency)의 조직과 활동을 고찰하였다. 재건단 원조는 1950년대 대한원조의 주축이었던 미국의 대한원조와는 독립된 방식으로 운영되었다. 그러므로 본고는 재건단의 설립과 위상변화 과정, 재건구상과 활동의 실제를 살펴보고 그 의미를 밝히고자 하였다. 유엔한국재건단은 한국전쟁에서 유엔군이 승리하여 조속히 전투가 종료되고 통일이 이루어질 것이라는 전망 속에서 설립된 기구였다. 재건단은 전투 종료 이후 통일된 한반도에서 긴급 구호와 기초시설의 재건, 생산성 확대에 이르기까지 대한원조 전반을 총괄하는 기구로서 수립되었다. 그러나 1950년 12월 1일 수립 이후 전쟁이 장기화되면서 독자적인 활동영역을 확보하지 못하였고, 유엔군사령부가 경제원조를 포함하여 한국에서의 전반적인 권한을 보유하는 가운데 재건단은 주로 유엔사의 활동을 보조하는 위치에 머물렀다. 그리하여 전시에 재건단은 본격적인 사업에 돌입하지 못하는 대신, 유엔사 산하에서 구호와 단기복구를 담당하는 기관인 유엔한국민사처(UNCACK)에 민간인력을 파견하는 것으로 주요 활동을 대체하였다. 1952년 중반 이후 전선이 안정되고 한국 경제의 위기가 심화되면서 유엔사, 한국정부, 재건단 사이에 본격적인 재건사업이 시작되어야 한다는 합의에 이르렀지만, 극심한 인플레이션으로 인해 재건단의 활동은 일부 소비재를 수입하는 것에 그쳤다. 이와 더불어 전시 재건단은 전쟁 종료 후 본격적인 재건사업에 돌입하는 단계를 준비하며 각종 조사를 실시했다. 재건단의 의뢰에 의해 유엔 전문기구들은 농·수산업, 교육, 보건 등 분야별 조사를 담당하였고, 네이산 협회는 이를 포괄하는 전반적인 재건계획을 제출하였다. 재건단의 의뢰로 작성된 네이산 보고서는 한국에서 5년 간의 재건계획을 수행하여 전전과 비슷한 생활수준을 회복하고, 국제수지의 균형을 맞출 수 있을 것으로 전망하였다. 이를 위해 생산영역에 집중적으로 투자하면서, 농산물, 수산물, 광물 등 자연자원을 개발하여 수출을 증진한다는 계획을 제시하였다. 전후 한국사회에서 주택, 보건, 복지 등의 분야에 대한 필요가 절실했지만, 사회서비스나 복지 분야는 직접적인 생산력 증대를 불러오는 분야가 아니라는 점에서 재건계획 상 상대적으로 후순위에 배치되었다. 1953년 7월 휴전협정 체결 이후 재건단은 본격적으로 재건사업에 착수하였다. 그러나 이때에도 재건단은 한국 재건사업에서 전반적인 권한을 보유하지 못했는데, 미국의 전후 구상에 따라 방위지원을 주축으로 하는 미국의 대한원조가 중심이 되고 유엔 원조기구의 위상이 상대적으로 축소되었기 때문이다. 결국 재건단은 미국 원조기관과의 협의에 따라 한정된 영역에서만 사업을 진행할 수 있었다. 그럼에도 재건단은 독자적인 조직을 유지하며 담당 부문에서 자체 사업을 진행하였고, 원조의 내용에서도 미국 원조와는 다른 특성을 보였다. 즉 미국 원조가 주로 소비재 판매대금을 통해 막대한 국방비를 충당하고 경제를 안정화하는 데 초점을 맞추었던 것과 달리, 재건단은 장기적으로 한국경제의 생산력을 증진시키는 것이 필요하다고 보고 시설투자와 기술원조가 결합된 형태의 원조를 주로 진행하였다. 재건단 원조에서 전시기에 걸쳐 가장 많은 비중을 차지한 것은 공업 부문이었다. 재건단의 공업 부문 원조는 소비재에서 생산재까지 여러 분야에 걸쳐 진행되었고, 노후화된 기존 시설을 대체하고 전쟁으로 파괴된 시설을 복구하는 것 이상으로 신규투자를 통해 새롭게 공장을 건설하기도 했다. 특히 재건단은 중소규모 기업에 자금과 기술, 시설을 제공하는 한편, 면방직 공업이나 시멘트 공업, 판유리 공업과 같은 몇몇 분야를 전략적으로 성장시켜 국내 생산을 증가시키고 수입을 대체하고자 했다. 이와 같은 재건단의 원조는 운영상의 여러 문제점을 노정하였으나, 한국의 초기 전후 복구 과정에 상당 부분 기여했다. ; 머리말 1 一. 전시 유엔한국재건단의 설립과 재건구상 7 1. 재건단의 설립과 유엔군사령부와의 관계 정립 7 2. 전후 재건구상 18 二. 전후 유엔한국재건단의 조직과 활동 25 1. 휴전 이후 재건단의 대외적 위상 변화 25 2. 재건단 내부의 조직운영과 예산 구성 34 3. 재건단의 활동 분석―공업 부문을 중심으로 47 맺음말 59 참고문헌 62 Abstract 67 ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 김동욱. ; 이 논문은 한국과 이집트의 지역사회개발정책을 국가주도성이라는 공통적 측면에 주목하고, 이러한 국가주도적인 지역사회개발정책의 형성 및 발전과정에 따른 경로의존성을 분석하는데 주요한 관심을 둔다. 이를 위해 역사적 사건, 초기경로의 생성 경로의존적 닫힘, 그리고 새로운 경로의 열림으로 구체화 했다. 이러한 과정 하에 역사적, 제도적, 행위자적 요인으로 재분류함으로써 제도 변화의 경로 의존적 요인과 촉진 요인을 보다 면밀히 파악하고자 했다. 이는 기존의 제도적 맥락, 즉 제도 내외의 환경의 영향으로 설명하고자 하는 역사적 신제도주의에 기반하였다고 볼 수 있다. 이 논문을 통해서 지역사회개발정책을 둘러싼 국가 계획은 역사적, 제도적 그리고 행위자적 요인으로 인해 일정기간 지속성을 이끌어가는 요인으로 작용했으며, 한편으로는 역사적 요인에 의하여 단절적인 변화를 경험하기도 했다. 한국의 새마을운동이 적어도 정부가 의도한 바대로 지역사회의 변화를 이끌어내기 위한 의미있는 성과를 가져왔음에 비해, 이집트의 슈르끄 운동을 포함한 일련의 지역사회개혁정책이 지역민의 참여와 자원을 효과적으로 이끌어내지 못한 점을 경로의존성 분석을 통하여 도출해내었다고 볼 수 있다. 이러한 분석결과는 다음과 같이 양국의 지역사회개발정책의 유사성과 상이성으로 나뉜다. 먼저, 유사성으로는 한국과 이집트는 개발도상국으로서의 국가주도 지역사회개발정책을 실시한 경험을 가지고 있다는데 있다. 기본적으로 농경에 바탕을 둔 사회이며, 19세기 외세에 의한 근대화 및 권위주의정권에 의하여 지역사회개발정책이 상당부분 영향을 받았다는 점이 유사하다. 이외에도 개발도상국으로서 공업화 등에 대한 우선적 관심으로 상대적으로 지역사회개발정책과 관련된 자원을 투입하는데 한계가 있었지만, 대통령의 일반적인 관심사가 되었다는 점에서 유사하다. 다음, 상이성으로는 한국의 경우, 새마을운동은 앞선 시기의 여러 사회적, 제도적 및 행위자 요인과 함께 지역사회의 인적 물적 자원을 효과적으로 동원하는 내무부 주도의 제도적요인과 박정희 대통령의 정책에 대한 관심과 거버넌스를 촉진하는 행위자적 맥락 요인이 함께 작용하여 이러한 국가주도적 경로의존성을 지속시켜나갔다. 이러한 국가의 개입은 민간의 참여와 자원을 효과적으로 동원하는 방식으로 나아갔다. 한편, 1980년대 새마을운동은 박정희 정부의 종식과 연이은 전두환 정부의 민간주도 정책으로 인해 기존 국가주도적 경로를 이탈하게 된다. 한국과 달리 이집트의 국가주도 지역사회개발정책의 경로는 국가가 이러한 변화를 주도하는 측면에서는 여전히 경로의존성을 유지하고 있었다. 이는 1980년대 무바라크 정부에서는 슈르끄 사업을 실시함으로써 민간주도로 이행하기 위한 노력을 진행했으나, 현재까지 강한 국가주도적 경로를 유지하고 있다. 국가의 의도를 실현시킬 수 있는 효과적인 집행기관과 지역사회의 참여와 자원을 이끌어낼 수 있는 기제가 마련되어 있지 않는데 원인이 있다. 또한, 실제 지역사회개발정책을 통한 정책효과에 대한 무바라크 대통령의 관심의 부재와 지역사회개발에 참여하는 대지주 및 기업가의 부패문제는 지역사회 참여자의 관심을 이끌어 내지 못함으로써 국가가 대부분의 지역사회개발과 관련된 문제를 독자적으로 해결해나가야 하는 악순환에 처해 있는 것이다. 그러나 2012년 현재 이집트는 쟈스민 혁명으로 일컬어지는 민주화운동에 의하여 새로운 정부 수립을 앞두고 있다. 이렇게 새로이 수립된 정부가 그간 권위주의 정부에 의하여 추진된 농촌 등 지역사회개발정책에 대한 개선책에 대한 기대감이 크다. 새로운 정부의 수립 이후 과거 이집트정부가 추진한 강한 국가주도 지역사회개발정책의 실효성을 강화하는 방향으로 나아갈지 혹은 새로이 민간주도 정책으로 전환하는 주요 결절점으로서 작용할지가 주목된다. 이와는 별개로 정권교체 이후에도 당분간 국가가 주도하여 지역사회개발정책을 수립해나갈 가능성이 크므로 이러한 작업을 위해 이집트 정부는 한국 새마을 운동의 성공요인이었던 내무부 주도, 민간의 자발적 참여와 자원동원을 이끄는 방식을 추진한다면, 지역사회개발의 성공을 앞당길 수 있을 것으로 전망된다. ; Focusing on similarity of the state-led character between both countries, this study aims to analyze its formation and developmental process of Korea and Egypt's rural development policy in terms of a path dependency. For this purpose, this study fall into the four sub-parts, which is historic events, creation of initial path, closeness of path and openness of new path. Under this circumstance, as being reclassified in the basis of historic, institutional, and stakeholder factor, it was able to look into more specifically how the path was proceeded. This based on historical institutionalism to be explained by its environmental circumstances both inside and outside institutions. This study shows the national plan on both country's policies of rural development contributed to keep consistency within a certain periods, but they often experienced several sudden shocks which might be disconnect their paths. The Saemaeul Undong in Korea at least have brought significant outcomes for changes in its rural societies. In comparison, The Egypt's case was not successful at that much because they failed to efficiently attract its rural people's support and securing their resources for their national rural development plans. These result outcomes came from analysis from the perspective of path-dependency and it can be more specifically classified into the two categories, which is similarity and difference of both nation's rural development policies. First of all, Korea and Egypt have a similar experience for conducting their own state-led rural development plans as a developing countries. Besides, when they started to develop rural area, the state mainly relied on agriculture and the rural development plan influenced from the authoritative regimes or the power of a foreign countries. In addition, both countries was more focused to invest their limited resources into the industries, rather than rural development. Next, In Korea, with its prior several social, institutional and stake holder's factors, Saemaeul Undong kept its state-led developmental path as successfully mobilizing its human and material resources with help of deep concern of president Park Chung-hee as stakeholder factor and his ministry of interior as institution factor. Especially, this engagement by the central government was gave more initiatives to private sectors when they obtaining their participation and resources. Meanwhile, in 1980s, the Saemaeul Undong derailed its path due to the facts such as the assassination of president Park Chung-hee or the privatization policy of president Chun Doo-hwan. Different from the Korea case, Egypt's state-led rural development has kept on sustaining previous path until now. There are several attempts such as president Mubarak's Shrouck plan toward private-led rural development. However, it does not seem to be enough for detouring its current state-led development tendency for a new change. This is responsible for lack of effective implementation agency and mechanism which is able to get cooperation from rural society. It hinders them in carrying out their plan not only by president Mubark's lack of actual concerns on rural reforms, but also by business man or large farm owner's corruption problems. Therefore the Egyptian government was caught in a vicious circle in which the central government should exclusively take on whole responsibility for rural development issue. However, as of 2012, Egyptians are facing a new government by liberalization movements which called 'jasmine revolution'. They hope that a reform packages of the new government would be differentiated from that of the previous. it might be a prime concerns whether they are maintaining its state-led path or changing their course toward a more private-led one. Whatever the case it would be, their strong involvement by the central government is more likely to be kept for a while. In these circumstance, if the Egyptian government adopt those successful factors of the Saemaeul Undong, their success for rural development would be advanced by substantial length of time. 학위논문 (석사) -- 서울대학교 대학원 : 사범대학 사회교육과(일반사회전공), 2020. 8. 이미나. ; 본 연구는 청소년의 정치효능감과 디지털 리터러시 수준이 정치 참여에 미치는 영향을 알아보고, 디지털 리터러시 수준이 정치효능감과 정치 참여 활동 사이의 관계에 조절변인으로 작용하는지를 살펴보고자 한다. 궁극적으로 디지털 미디어의 활용에 적극적인 청소년의 정치 참여 방안을 찾는데 기여하는 것을 목적으로 한다. 위와 같은 문제인식을 바탕으로 본 연구는 다음과 같은 연구 문제를 제기하였다. 1. 정치효능감이 높은 청소년일수록 정치 참여에 적극적인가? 1) 내적 정치효능감이 높은 청소년일수록 정치 참여 행위에 적극적인가? 2) 외적 정치효능감이 높은 청소년일수록 정치 참여 행위에 적극적인가? 3) 내적 정치효능감이 높은 청소년일수록 정치 참여 의지가 클 것인가? 4) 외적 정치효능감이 높은 청소년일수록 정치 참여 의지가 클 것인가? 2. 디지털 리터러시 수준이 높을수록 정치 참여에 적극적인가? 1) 디지털 리터러시 수준이 높은 청소년일수록 정치 참여 행위에 적극 적인가? 2) 디지털 리터러시 수준이 높은 청소년일수록 정치 참여 의지가 클 것인가? 3. 디지털 리터러시 수준이 높을수록 정치효능감이 청소년의 정치 참 여에 미치는 영향이 클 것인가? 1) 디지털 리터러시 수준이 높을수록 정치효능감이 청소년의 정 치 참여 행위에 미치는 영향이 클 것인가? 2) 디지털 리터러시 수준이 높을수록 정치효능감이 청소년의 정 치 참여 의지에 미치는 영향이 클 것인가? 첫 번째 질문은 정치효능감이 청소년의 정치 참여에 미치는 영향을 측정하기 위해 설정하였다. 두 번째 질문은 디지털 리터러시 수준이 정치 참여에 미치는 효과를 측정하기 위해 설정하였다. 마지막 세 번째 질문은 디지털 리터러시 수준과 정치효능감이 청소년의 정치 참여에 미치는 상호작용 효과를 측정하기 위해 설정하였다. 본 연구를 통해 다음과 같은 결과를 알 수 있었다. 첫째, 정치효능감이 청소년의 정치참여에 미치는 영향을 검증한 결과, 내적 정치효능감이 청소년의 정치참여에 유의미한 영향을 미치고 있었다. 상세하게 살펴보면, 내적 정치효능감이 정치 참여 행위와 정치 참여 의지에 유의미한 영향을 미치는 것으로 나타났다. 반면에 외적 정치효능감은 정치 참여 행위와 정적인 영향 관계를 보이지만, 그 값이 유의미 하지는 않았다. 외적 정치 효능감은 청소년의 정치 참여 의지에는 유의미한 영향을 주는 것으로 나타났다. 정치효능감과 정치 참여 전체를 대상으로 한 회귀 분석에서는 정치 효능감이 정치 참여에 유의한 것으로 나타났다. 둘째, 디지털 리터러시는 정치 참여 행위와 정치 참여 의지에 유의미한 영향을 끼치는 것으로 나타났다. 디지털 리터러시가 정치 참여에 유의한 영향을 끼친다는 결론은 디지털 세대인 청소년들에게 커다란 의미를 가진다. 청소년들은 디지털 미디어를 통해서 정치에 관한 정보를 접하고, 정치에 참여한다. 따라서 디지털 리터러시 함양을 위한 정치 교육 자료를 개발하고 활용할 필요성을 말해 준다고 볼 수 있다. 특히 연구대상이 된 청소년들에게 디지털 리터러시를 정보 활용 능력, 비판적 사고 능력, 의사 소통 능력, 규범 준수 능력의 하위 요인으로 구분하여 질문하였기에 이와 같은 하위 요인에 포함된 리터러시 능력을 키워주는 일이 중요하다고 하겠다. . 셋째, 정치효능감과 디지털 리터러시 수준의 상호작용 효과를 살펴본 결과, 그 영향력이 크지 않아 모든 가설이 기각되어 정치 효능감과 디지털 리터러시가 정치 참여에 유의미한 상호 작용 효과를 가지지는 않는 것으로 나타났다. 이러한 연구 결과를 바탕으로 청소년의 정치 참여 활성화를 위한 몇가지 교육적 제안을 하고자 한다. 첫째, 청소년들은 정부의 반응에 따라 정치 행위에 참여하기보다는 본인이 정치에 영향을 끼칠 수 있다는 믿음에 따라 정치 행위에 참여하는 것으로 보인다. 따라서 청소년의 내적 정치효능감을 키울 수 있는 정치 교육 자료를 계발할 필요성이 있다. 둘째, 본 연구에서는 디지털 리터러시 수준이 청소년의 정치 참여 행위와 정치 참여 의지에 모두 긍정적인 영향을 끼치는 것으로 나타났다. 이는 디지털 미디어를 적극 활용한 정치 교육에 대해서 많은 자료를 개발하고 활용할 필요성을 말해 준다고 볼 수 있다. 셋째, 청소년의 정치 참여를 위한 교육적 지원 방안 또한 필요하다. 청소년 중에서도 고등학생은 성인이 되기까지 1∼3년 남은 준 성인에 해당한다고 할 수 있다. 실제 만 18세 이상의 고등학생은 참정권까지 보장받았다. 그러나 청소년을 대상으로 하는 정치 교육은 학교 교육 외에는 선거연수원에서 실시하는 '민주주의 선거교실'이 유일하다. 그리고 고등학교 통합 사회에는 정치 참여와 관련한 단원이 없고, 정치와 법은 선택 과목으로 10% 미만의 학생만 수업을 듣는다. 따라서 고등학생들의 정치 참여를 위한 첫 번째 방안으로 고등학교 통합사회 안에 정치 참여와 관련한 단원을 포함시켜야 한다. 주요어 : 청소년, 정치효능감, 디지털리터러시, 정치참여 학 번 : 2017-29900 ; Abstract The Effect of Political Efficacy and Digital Literacy on Adolescents Political Participation Inhae, Song Department of Social Suties Education The Graduate School Seoul National University In the revised social studies curriculum of 2015, democratic citizens are those who develop democratic values based on knowledge and participate with a sense of responsibility. Therefore, it can be said that raising students who are actively participating is a core element of social studies. In recent years, in terms of the political climate of our society, adolescents who participated in the election of the National Assembly directly appeared after the election age was reduced to 18, and the number of adolescents participating in candlelight vigils and Internet petitions is increasing. According to previous studies, it can be seen that political efficacy is a major factor influencing adolescents's political participation. Political efficacy is a direct motivation for individuals to participate in politics. It is said that individuals with high political efficacy have a strong willingness to participate in politics and actively participate in political activities such as voting. Adolescents needs literacy to become a meaningful activity and exercise of rights. In particular, digital literacy is indispensable in times of increasing political participation through digital media such as these days. Digital literacy refers to the level of critical thinking required by all users to properly evaluate the value of information found on the Internet, and the ability to understand and use various types of information found from various sources and to newly combine it for their purposes ( Gilster, 1997). The purpose of this study is to examine the effect of adolescents' political efficacy and digital literacy level on political participation, and to examine whether digital literacy level acts as a moderating variable in the relationship between political efficacy and political participation. The purpose of this study is to contribute to finding ways to actively participate in politics of adolescents in the use of digital media. Based on the above problem recognition, this study raised the following research problems. 1. Are adolescentss with higher political efficacy active in political participation? 1) Are adolescentss with higher internal political efficacy active in political participation? 2) Are adolescentss with higher external political efficacy active in political participation? 3) Is the willingness to participate in politics greater as the adolescents with higher internal political efficacy? 4) Is the willingness to participate in politics greater for adolescents with higher external political efficacy? 2. The following results were found through this study. First, as a result of examining the effect of political efficacy on adolescents's political participation, it was found that internal political efficacy had a significant effect on political participation behavior and willingness to participate. On the other hand, it was found that external political efficacy had no significant effect on political participation, but only on the will of political participation. Political efficacy was found to be significant in political participation in the regression analysis of political efficacy and political participation. Second, digital literacy was found to have a significant effect on political participation and willingness to participate. 학위논문 (석사)-- 서울대학교 대학원 : 교육학과(교육학전공), 2012. 2. 박현정. ; 이 연구의 목적은 공군에 복무하는 병사들이 지각하는 사회적 지지, 자기효능감, 자아탄력성이 군 생활 적응에 어떠한 영향을 미치는지 살펴보고, 변인들 간의 구조적 관계 및 상대적인 영향력의 크기를 확인하는 것이다. 그리고 이 때 개인의 정의적 특성인 자기효능감, 자아탄력성이 사회적 지지와 군 생활 적응의 관계에서 매개변인으로 작용하는지 확인하는 것이다. 한 개인이 타인과의 의미 있는 상호작용의 결과로부터 얻을 수 있는 긍정적 자원인 사회적 지지는 스트레스에 대한 예방과 적응에 도움을 줄 수 있는 효과적인 완충제 역할을 함으로써 좌절을 극복하고 문제해결의 도전을 받아들이는 능력을 강화한다(Sarson, 1991; Sarson et al., 1983). 그러므로 병사들이 군대 환경의 맥락에서 지각하는 사회적 지지는 이들의 군 생활 적응에 유의미한 영향을 미치는 주요한 변인이 될 수 있다. Bandura(1995)는 긍정적 자기효능감은 어려운 과제나 장애에 직면했을 때 자신을 동기화하고 좌절과 고통을 극복하게 함으로써 장애로부터의 성공적인 회복과 치료에 중요한 영향을 미친다고 주장하였는데, 이는 부여된 임무를 수행하는 병사들의 과업 수행과 직무 만족도에 긍정적 영향을 미쳐 군 생활 적응을 매개하는 변인으로 작용할 수 있음을 나타낸다. 또한 환경의 역경과 스트레스 상황에서 융통성 있는 행동과 문제해결 전략을 동원하여 심리적 적응을 중재하는 변인으로 밝혀진 자아탄력성은 개인에게 낯선 삶의 경험과 수행을 요구하는 군대 환경의 맥락에서 병사들의 적응을 예측하고 매개하는 변인으로 작용할 수 있다. 이 연구에서는 이러한 이론과 선행연구 결과를 근거로 다음과 같은 연구문제를 설정하고 이를 검증하고자 하였다. 연구문제 1. 공군 병사들이 지각하는 사회적 지지가 자기효능감, 자아탄력성, 군 생활 적응에 영향을 미치는가? 연구문제 1-1. 공군 병사들이 지각하는 사회적 지지가 군 생활 적응에 직접적 영향을 미치는가? 연구문제 1-2. 자기효능감은 군 생활 적응에 직접적 영향을 미치는가? 연구문제 1-3. 자아탄력성은 군 생활 적응에 직접적 영향을 미치는가? 연구문제 2. 공군 병사들이 지각하는 사회적 지지는 자기효능감과 자아탄력성을 매개로 군 생활 적응에 영향을 미치는가? 연구문제 2-1. 공군 병사들이 지각하는 사회적 지지는 자기효능감을 매개로 군 생활 적응에 영향을 미치는가? 연구문제 2-2. 공군 병사들이 지각하는 사회적 지지는 자아탄력성을 매개로 군 생활 적응에 영향을 미치는가? 연구문제 2-3. 공군 병사들이 지각하는 사회적 지지는 자기효능감, 자아탄력성을 매개로 군 생활 적응에 영향을 미치는가? 연구문제 3. 공군 병사들의 자기효능감은 자아탄력성을 매개로 군 생활 적응에 영향을 미치는가? 위의 연구문제를 확인하기 위하여 공군에 근무하는 병사 520명을 대상으로 예비 및 본 조사 설문을 실시하였고, 연구모형에서 설정한 잠재변인의 구조적 관계를 확인하기 위해 구조방정식을 이용하여 모형을 분석하고 자기효능감, 자아탄력성의 매개효과를 검증하였다. 본 연구의 주요 결과를 요약하면 다음과 같다. 첫째, 선행연구 결과와 이론에 근거하여 설정한 사회적 지지, 자기효능감, 자아탄력성, 군 생활 적응의 구조적 관계에 대한 구조모형이 군대 환경의 맥락에서도 잘 지지되는 것으로 확인되었다. 모형 평가는 적합도 평가 지수의 기준이 확립된 TLI, CFI, RMSEA를 통해 평가하였고, 적합도 지수가 수용 가능한 것으로 확인되었다. 따라서 이 연구에서 설정한 연구모형은 비교적 연구 자료를 적절하게 잘 설명하는 것으로 볼 수 있다. 둘째, 병사들이 지각하는 사회적 지지와 개인의 정의적 특성인 자기효능감, 자아탄력성은 군 생활 적응에 모두 직접적인 효과를 나타내는 것으로 확인되었다. 직접효과 크기는 자기효능감이 가장 큰 효과크기를 나타냈고, 이어서 사회적 지지, 자아탄력성 순으로 나타났다. 셋째, 사회적 지지는 자기효능감, 자아탄력성 각각을 매개로 군 생활 적응에 간접적인 영향을 미치고 또한 자기효능감과 자아탄력성 두 개의 매개변인을 통해 군 생활 적응에 간접적인 영향을 미치는 것으로 확인되었다. 간접효과의 크기는 자기효능감을 매개로 하는 효과가 가장 크게 나타났고, 이어 자기효능감과 자아탄력성을 매개로 하는 효과, 자아탄력성을 매개로 하는 효과 순으로 나타났다. 특히 자기효능감은 군 생활 적응에 미치는 직접효과 및 간접효과에 있어 가장 큰 주요 변인으로 확인되었다. 이 연구 결과를 통해 사회적 지지, 자기효능감, 자아탄력성, 군 생활 적응 간의 인과관계를 확인함으로써 병사들의 군 생활 적응을 예측하고 중재할 수 있는 유의미한 변인을 확인할 수 있었다. 이러한 결과는 병사들의 효과적인 군 생활 적응 중재방안을 수립하는 데 있어 여러 변인들 간의 구조적 관계 및 효과에 대한 보다 체계적이고 통합적인 관점으로 접근할 필요가 있음을 시사 하였다. ; The primary purpose of this study was to investigate what effects the social support, self-efficacy, and ego-resilience perceived by airmen in the military service have on the adjustment to military life, and to identify comparative effect size as well as structural relationship among variables. The study also aimed to explore whether self-efficacy and ego-resilience which are affective characteristics operated as mediating variables. The social support, as a positive resource, obtained by an individual through meaningful interactions with other people plays an effective buffering role in preventing stress and helping adjustment to an environment, Thus it reinforces the ability to overcome frustration and embrace any challenges for solving problems (Sarson, 1991; Sarson et al., 1983). Furthermore, the social support perceived by airmen in the military context can serve as a principal variable that has a significant effect on their adjustment to military life. Bandura (1995) asserted that when people face obstacles and demanding assignments, positive self-efficacy plays a crucial role in enabling people to motivate themselves and to overcome frustration and pain. This implies that the self-efficacy can have a positive effect on task performance and job satisfaction by airmen, and act as a mediating variable of the adjustment to military life. Ego-resilience, a variable that is assumed to arbitrate psychological adjustment by enabling people to employ flexible behaviors and problem solving strategies, faced with circumstantial adversities and stressful situations, can be a factor that predicts and mediates the adjustment of airmen to the military context in which the airmen are forced to face an unfamiliar environment and deal with unaccustomed work. The present study, based on these theories, presents the following research questions. 1. Does the social support perceived by airmen have an effect on self-efficacy, ego-resilience, and the adjustment to military life? 1-1. Does the social support perceived by airmen have an direct effect on the adjustment to military life? 1-2. Does the self-efficacy have an direct effect on the adjustment to military life? 1-3. Does the social support perceived by airmen have an effect on the adjustment to military life through the mediation of ego-resilience? 2-3. Does the social support perceived by airmen have an effect on the adjustment to military life through the mediation of self-efficacy, ego-resilience? 3. Does the self-efficacy have an effect on the adjustment to military life through the mediation of ego-resilience? In order to investigate the questions above, both preliminary and main questionnaires were conducted on 520 airmen served in ROK Air Force. The validation of the tool was made through the process of both exploratory factor and confirmatory factor analyses on the scale of the adjustment to military life. The model was also analysed by using structural equation model to identify the structural relations among latent variables established in the research model, with the verification of the mediating effect of self-efficacy and ego-resilience. The key findings of the research are summarized as follows: First, it was confirmed that structural model on the structural relationship between the three variables, social support, self-efficacy and ego-resilience and the adjustment to military life, which were based on previous studies and theories, was well supported in the military context. Model test was conducted through TLI, CFI, RMSEA, in which the criteria of model test fit were established, and it turned out that model fit could be acceptable. Thus, it may be seen that research data could be explained relatively appropriately by the research model established in this thesis. Second, it turned out that both the social support and self-efficacy as well as ego-resilience affected the adjustment to military life directly. With regard to the effect size of the variables, they were arranged in the order of self-efficacy, social support, and ego-resilience. Third, the social support had indirect effects on the adjustment to military life through the mediation of self-efficacy and ego-resilience respectively. In addition, the social support affected the adjustment to military life indirectly through the mediation of both self-efficacy and ego-resilience. The effect size was arranged in the order of the mediation of self-efficacy, the mediation of both self-efficacy and ego-resilience, and the mediation of ego-resilience. In particular, self-efficacy turned out to be the primary variable that affected the adjustment to military life both directly and indirectly. The result of the study showed the structural relationship between the three variables, social support, self-efficacy and ego-resilience and the adjustment to military life, those variables turned out to be the ones that can predict and mediate the adjustment to military life. This implies that in establishing effective intervention methods on the adjustment to military life, a systematic and unified approach, based on the structural relationship among various variables and their effectiveness, should be made. ; Master

Bearing in mind the distinctive features of prepetition claims and postpetition claims where the former are generally classified as insolvency claims subject to restrictions as per insolvency procedures while the latter as administration claims granted the rights to be paid irrespective of insolvency procedures, one may well assert that the actual amount of realized payment will consequently be different by a significant margin. Thus, it does matter to classify straddle claims before and after the order for relief. In South Korea, the part-fulfillment test(일부구비설) is widely accepted as a common view. In pursuant to the part-fulfillment test, once a particular debt in question is affirmatively established as insolvency claims, other claims that do not fall into the category of insolvency claims but nevertheless fulfill the requirement of administration claims are deemed administration claims. Even if the claims are unliquidated, contingent, unmatured, disputed, they can be classified as insolvency claims when the significant part of the claims are fulfilled prepetition. It seemingly is due to the reception of the Japanese insolvency acts which has eventually resulted in South Korean insolvency frameworks adopting the relevant Japanese legal theories and precedents that developed on the basis of the part-fulfillment test. But the word 'the significant part of the claims' is too vague to establish a clear and consistent criterion. Among the cases of the Supreme Court of South Korea, some cases contradict each other. In Japan, a scholar following the part-fulfillment test even admits that the test has its defects as some cases of the Supreme Court of Japan are inconsistent. The 'theory of deduction(控除説)' in Japan, based on the study of history of theories about classifying claims, criticizes the present common view in Japan, the part-fulfillment test, and suggests that the claims subject to insolvency risks be insolvency claims and the claims free from insolvency risks be administration claims. It may sound like a tautology, but it pinpoints that the present part-fulfillment test is far from realizing the essence of treatment and disposition of claims, using the word 'the significant part of the claims'. However, the theory of deduction also leaves much to be desired to set a clear and consistent criterion. In the United States, timing problems of claims in insolvency have been an important research theme, making use of a substantial balancing test. Thus, the arguments in the United States serve as a good reference. The theories of the United States do not apparently dichotomize, but virtually distinguish contractual claims from non-contractual claims. When it comes to contractual claims, the claimants voluntarily enter the contracts considering insolvency risks, so it is easy to determine whether the claimants bear the insolvency risks in accordance with their intention. In contrast, as of non-contractual claims, the claimants often get the claims involuntarily. It is hard to determine, based only on the claimants' intention, whether they should be burdened with insolvency risks. Therefore, dichotomy is desirable. In case of contractual claims, almost all federal courts of appeals and scholars adopt the performance test in the United States. As of non-contractual claims, there are the accrued state law test, the conduct test, the relationship test, and the fair contemplation test in the United States. Most of federal courts of appeals follow the relationship test, while most of scholars support either the conduct test or the fair contemplation test. For contractual claims, including the ones based on executory contracts, we can accept the performance test as it is. The part contributed to a debtor prepetition by a claimant abandoning exceptio non adimpleti contractus is subject to the insolvency risks and should be treated as insolvency claims. The part induced to do business with a debtor postpetition is beneficial for the estate and thus should be treated as administration claims. For efficiency, prepetition claims should be cut off from post-insolvency as sunk costs, while postpetition claims should receive priority to induce entities to enter new business with a debtor so as to foster reorganization. In case of non-contractual claims, it is hard to tell whether the claims are supposed to bear insolvency risks or not. It is a matter of policy. Unless it is the case where Debtor Rehabilitation and Bankruptcy Act in South Korea excludes explicitly the non-contractual claims from insolvency claims, prepetition claims should be classified as insolvency claims and postpetition claims administration claims. While the meaning of 'claims' for insolvency is defined in a unique sense under the United States Bankruptcy Code so as to put a great weight on that specific point of time, Debtor Rehabilitation and Bankruptcy Act in South Korea yet omits to define the meaning of 'claims' for insolvency, making it unnecessary to be obsessed with as to when a claim arises. For insolvency in South Korea, I hereby propose the relationship test that does not stick to the point when a claim arises. Rather, I suggest a more flexible solution that allows bifurcation of claims. If the part of the claim occurring before the order for relief creates a relationship, such as contact, exposure, impact, or privity, between the claimant and the debtor, then the part of the claim is insolvency claim. At the same time, the purposes of the acts on which the claim is based, the entity benefitted by the expense, and so forth, should be considered. Prepetition claims should be cut off to encourage a fresh start of the debtor, but that does not mean that the debtor is free to commit torts or gain unjust enrichments. Though it is quite theoretical, postpetition claims that the claimant gains involuntarily because the debtor fails to block a relationship between them should be treated as administration claims so that the estate shoulders the expense. As a result, insolvency can proceed with efficiency and equity. The representatives and the social insurance programs for future claimants can satisfy due process concerns.
