Vprašanje kolektivnih pravnih sredstev v Evropski uniji je v zadnjih letih zaradi pobud evropskih institucij pridobilo veliko pozornosti. V praksi se ja namreč pokazalo, da je intervencija Evropske unije na tem področju potrebna, saj se instituti kolektivne tožbe v državah članicah zelo razlikujejo. Razlikujejo se po vrsti kolektivne tožbe, ki je na voljo, aktivni legitimaciji, uporabi sistema vključitve ali izključitve, financiranja tožbe itd. Heterogenost na tem področju je problematična, saj niso vsi državljani držav članic Evropske unije deležni enake pravne zaščite v primerih množičnih oškodovanj. Različne ureditve držav članic pa imajo tudi negativni vpliv na enotni notranji trg. V nalogi sem analizirala izbrane postopke s kolektivnimi tožbami v državah članicah Evropske unije in osvetlila razlike med njimi. Ugotovila sem, da je ukrepanje organov Evropske unije potrebno, da se zagotovi ustrezno urejene in uravnotežene mehanizme, ki prispevajo k učinkoviti zaščiti in izvrševanju pravic v primerih množičnih oškodovanj. ; The issue of collective redress procedures in the European Union has received a great deal of attention in recent years due to initiatives by the European Union institutions. In practice, however, it has become clear that the European Union intervention in this area is necessary, as institutes of collective redress vary greatly from one-Member State to another. They differ in type of collective action available, legal standing, use of an opt-in or an opt-out system, financing of the action, and so on. Heterogeneity in this area is problematic, as not all citizens of the Member States of the European Union enjoy equal legal protection in cases of mass harm. Moreover, different Member States arrangements also have a negative impact on the single internal market. In this thesis, I have analysed selected collective redress procedures in the Member States of the European Union and highlighted the differences between them. I have identified the need for actions by the European Union institutions to ensure that mechanisms are properly regulated and balanced to contribute to the effective protection and enforcement of rights in cases of mass harm.
This article addresses the deficiency in the area of human rights scholarship in International Relations (IR) by examining the theoretical advancements in IR theory that have led to the emergence of non-state collective actors as a pertinent research topic. It provides a review of the trajectory of the constructivist theoretical approach, which has brought major advancements in how international non-state actors are conceptualised in the human rights IR literature. This considers the limitations and implications of side-lining collective non-state actors within IR theory, arguing that expanding the theoretical understanding of how different collective actors are constituted and attributed with agency can enrich IR human rights scholarship. The article also proposes a potential way forward with respect to non-state collective actors in human rights in IR by identifying a research programme based on practiceoriented approaches to help broaden the ability of scholars to foster interdisciplinary conversations. Expanding along these lines would bridge the existing boundaries within scholarly and disciplinary contexts. Izgorevanje fosilnih energentov negativno vpliva na naš planet in v veliki meri pripomore k negativnim spremembam našega okolja. Z namenom preprečitve teh sprememb se od devetdesetih let prejšnjega stoletja v svetu, tudi v političnem opredeljevanju, vse bolj krepi zavedanje, da je treba ukrepati in s tem namenom svetovne politike vse več pozornosti posvečajo uvajanju programov, s katerimi bi te spremembe preprečili oziroma jih vsaj omilili. Evropska unija ima pri aktivnostih varovanja okolja vodilno vlogo v svetu. Predvsem pa znotraj unije skrbi za uresničevanje zastavljenih ciljev varstva okolja in državam članicam nalaga obveze za izpolnjevanje skupnih ciljev in dopušča ukrepe, ki naj bi zagotovili izpolnitev zadanih ciljev. S tem namenom dopušča tudi izjeme od načelne prepovedi dodeljevanja državnih pomoči. Le te so dopustne le, če so skladne s pravili, ki opredeljujejo njihovo dodelitev, katera so v izključni pristojnosti Evropske komisije, in uresničujejo cilje skupnega interesa, kar skrb za varstvo okolja zagotovo je. Tako je, dodeljena skladno z enimi od takšnih pravil, to je s smernicami o državni pomoči za varstvo okolja in (energijo) , izjemoma dopustna tudi državna pomoč proizvajalcem, ki proizvajajo električno energijo iz obnovljivih virov, če je predhodno tudi potrjena s strani Evropske komisije. Takšna državna pomoč, je bila leta 2009 z Energetskim zakonom uveljavljena tudi v Republiki Sloveniji, kot podpora za električno energijo, proizvedeno iz obnovljivih virov v okviru podporne sheme. Uveljavitev podporne sheme je bila smiselna in predvsem potrebna z namenom spodbuditi potencialne investitorje k investicijam, ki bodo prispevale k razvoju oziroma povečanju deleža električne energije, proizvedene iz obnovljivih virov, v skupni bruto končni rabi električne energije. Evropska unija je Republiko slovenijo z Direktivo 2009/28/ES Evropskega parlamenta in sveta o spodbujanju uporabe energije iz obnovljivih virov namreč obvezala do leta 2020 doseči 25 odstotni delež energije iz obnovljivih virov v skupni bruto končni rabi energije. Proizvajalci, ki so zgradili oziroma namestili proizvodne naprave za proizvodnjo električne energije iz obnovljivih virov so tako lahko v okviru podporne sheme pridobili podpore, namenjene za pokritje razlike med stroški proizvodnje, vključno z normalnim donosom na vložena sredstva, in prihodki od prodaje te proizvedene električne energije na trgu. Ker so bile vrednosti podpor določene administrativno, na podlagi vrednosti primerljivih investicij pred uveljavitvijo podporne sheme, in v obdobju med leti 2010 in 2012 niso bile usklajene z razmerami enakih investicij posameznih tehnologij na trgu (katerih cene so se bolj ali manj prepolovile), so v mnogih primerih proizvajalcem dodeljene podpore, za katere se izkazuje, da niso sorazmerne in presegajo dopusten obseg državne pomoči opredeljen tako v smernicah o državni pomoči za varstvo okolja in (energijo), kot tudi v nacionalni zakonodaji. V takšnih primerih bi država načeloma morala poseči v že dodeljene državne pomoči, ki se bodo proizvajalcem izplačevale za vso proizvedeno električno energijo v obdobju 15 let od namestitve proizvodne naprave, in jih, skladno z zakonodajnimi določbami, korigirati tako, da bodo služile svojemu namenu, to je pokritju razlike med stroški proizvodnje, vključno z normalnim donosom na vložena sredstva in prihodki od prodaje te energije na trgu. ; The combustion of fossil fuels has a negative impact on the environment and has become a major contributor to negative changes in our environment. To prevent these changes, the awareness that action must be taken has been present from the 1990s onward, including political actions. Global governance, therefore, pays more attention to the introduction of the programmes that prevent or at least mitigate these changes. The European Union has a leading role in the combat against climate changes. The Member States are responsible for meeting common objectives to protect the environment and to implement the measures for the fulfilment of these objectives. In this view, exceptions to the general prohibition on state aid are allowed. These exceptions are allowed only if they are in compliance with the rules that determine their allocation and falling within the exclusive jurisdiction of the European Commission, as well as if they meet the common targets related to environmental protection. In lines with one of these rules, Guidelines on State aid for environmental protection and energy, a state aid for the production of electricity from renewable sources is permitted. This state aid must be previously approved by the European Commission. By implementing the Energy Act in 2009, Slovenia has established such state aid as a support for the production of electricity from renewable energy sources within the frame of the support scheme. The introduction of the support scheme was a sensible and above all the necessary solution to encourage investors for investments that will contribute to the development and to increasing the share of renewable electricity in the gross final electricity consumption. By the Directive 2009/28/EC of the European Parliament and of the Council on the promotion of the use of energy from renewable sources Slovenia become committed to achieve a 25 percent share of energy produced from renewable sources by 2020 in the gross final energy consumption. Producers who built or installed the facilities for the production of electricity from the renewable sources received the support within the support scheme ; the support was intended to cover the difference between the production costs, including a normal return on assets, and the revenues from the sale of electricity in the market. These supports were determined administratively on the basis of comparable investments before the support scheme was implemented ; in the period between 2010 and 2012 were not in compliance with the requirements for comparable investments in the market (prices of these investments were more or less halved). Due to that, many producers were granted the supports, which are not proportional and exceed the admissible amount of state aid determined by the Guidelines on State aid for environmental protection and energy, and national legislation. In such cases, the state should intervene in already granted supports, which are to be paid to producers for the produced electricity over the period of 15 years from the installation of the production facility. In accordance with the legislation, supports should be amend in a way to serve their purpose, that is to cover the difference between the production costs, including a normal return on assets, and the revenues from the sale of electricity in the market.
Platform work is often characterised by economic insecurity, dehumanising control procedures, isolation, deepening racial, economic and gender inequalities, and other socio-economic problems. There are lively debates underway concerned with how to regulate or limit the negative effects of platform capitalism. This article reviews two of the most common calls for action – regulation and platform co-operatives. We argue that there is also an unexplored, complementary option, which uses the network effects of platforms to provide greater benefits for platform workers. To understand this alternative, we introduce the American Employee Stock Ownership Plan (ESOP) mechanism for employee buyouts, redefine the model according to the main cooperative values, and apply it to the platform economy. We conclude that there is a third option is available to governments and municipalities, namely to require an Employee Stock Ownership Plan (ESOP) in the local subsidiary of the platform company. Abstract. We examined the changing sense of control over one's life during epidemics. Using original survey data during the first lockdown in May 2020 our case study focuses on Ljubljana's multi-apartment buildings (MAB) which, due to the physical proximity of the residents and the common spaces/facilities represent a distinct case with its particular threats (infection spread) and potential resources (neighbourly support) for coping with epidemic-related problems. We found a dramatic drop in perceived control over one's life, from 75% of respondents in usual times to 35% during the pandemic. Accounting for a range of epidemic-associated occurrences in the building and among the residents our regression analysis shows their significant impact on residents' sense of control that highly exceeding those of the quality of life and of basic socio-demographic characteristics. While our case study demonstrates that the specific setting of an MAB can provide a valuable layer of human action in times of crisis, further research is needed to permit generalisations. Although municipalities are foundational units of local self-government, they experience some very basic problems since the re-establishment in the middle of 1990s; those problems are closely connected with inadequate exercise of subsidiarity and connection principles from in 1996 ratified European charter of local self-government. Slovenia has larger number of undersized municipalities that report problems with normative overload and their administrative incapacity. According to the findings of empirical study presented in the paper, the latter is often the case in municipalities smaller than 5000 inhabitants. The authors are also analysing inadequately defined scope of municipal jurisdiction; Slovenian municipalities are currently responsible for local affairs that affect only municipal inhabitants, and that narrow scope of jurisdiction is in many cases causing problems in managing the municipality, especially in cases of smaller municipalities.

Dementia is often the ultimate argument for the need of institutions. However, dementia is not a "disease" that would need an institutional care, and institutions are not an environment of decisive advantage, and the placement in an institution is not the result of a "deterioration" of the state – it is a consequence of the discontinuity of the system, the lack of intensive services in the community, the "drama of institutionalisation" accompanied by reification of human beings and encouraged by the quest for profit. Quite the contrary, institutions can be described as a "machine of oblivion", a foundation of alienation, passivation and intensification of the very difficulties that are usually attributed to the disease process. On the basis of this critique, the author sketches specific elements of deinstitutionalisation in the case of dementia and proposes a heuristic theorem for the research and action in this field. The transition to the community means transforming the modelling of dementia, providing a safe space, adequate intensity of support, a conjunction of informal care and professional interventions, enabling alternative subjectivity and new solidarity. Research and action in the field of dementia should stem from the life-world of so labelled people, and transversely address the variety of plateaus of action. It should focus on the equally transversal phenomena of supplanting the loss of subjectivity and territorial insertion, while also addressing the more fundamental issues of the bifurcation of contemplative and action identity.
Politična participacija je ključnega pomena za delovanje in razvoj koncepta demokracije, saj predstavlja orodje, prek katerega lahko državljani izvajajo pritiske na politično elito. To vlogo zavzema poleg konvencionalne tudi nekonvencionalna politična participacija. Osrednji poudarek bo namenjen protestni participaciji, ki se najpogosteje opredeljuje kot ena izmed kompleksnejših oblik kolektivne akcije, skozi katero državljani najvidneje izražajo svoja prepričanja, hkrati pa najbolj jasno odraža nezadovoljstvo državljanov. Osredotočili se bomo na protestno participacijo v obdobju ekonomske krize, ki je leta 2008 zajela države Evropske unije. V okviru empirične analize se tako osredotočamo na dejavnike, ki so v zastavljenem obdobju privedli do izbruha protestne participacije, pri čemer nas zanimajo predvsem različne kombinacije vzročnih poti, ki jih ti dejavniki tvorijo. Ključno raziskovalno vprašanje se nanaša na možne kombinacije pogojev, ki v obdobju ekonomske krize rezultirajo v prisotnosti ali odsotnosti protestov v državah EU. Te kombinacije tvorijo naslednji dejavniki: materialna deprivacija, brezposelnost, razvitost civilne družbe in razvitost demokracije. Empirična analiza temelji na kvalitativni primerjalni analizi (QCA) oziroma bolj specifično na crisp-set QCA. Slednjo se uporablja za obdelavo kompleksnejših binarnih podatkov, pri čemer je cilj poenostavitev teh podatkovnih struktur v preprost in logičen zapis. S pomočjo izbrane metode analize smo prišli do ugotovitve, da do zastavljenega izida ne vodi le en sam pogoj ali ena sama kombinacija pogojev, temveč nastane več raznolikih vzročnih poti, ki lahko rezultirajo tako v odsotnosti kot v prisotnosti izida (protestnih akcij). ; Political participation is crucial for the functioning and development of the concept of democracy, as it represents a communication tool through which citizens can exert pressure on the political elite. Besides the conventional form, unconventional political participation has this role, too. The main focus will be on protest participation, which is most often identified as one of the more complex forms of collective action, through which citizens most visibly express their beliefs ; at the same time it reflects dissatisfaction of citizens most transparently. The highlight will therefore be on protest participation in the period of economic crisis affecting the countries of the European Union since 2008. In the context of the empirical analysis we focus on factors that led to an outbreak of protest participation within the set period. We are particularly interested in the various combinations of causal paths formed by these factors. The key research question therefore refers to the possible combinations of conditions, resulting in the presence or in the absence of protests in EU countries in times of economic crisis. These combinations are formed by the following factors: material deprivation, unemployment, development of civil society and development of democracy. Empirical analysis is based on qualitative comparative analysis (QCA) or more specifically on the crisp-set QCA. The latter is used to process more complex binary data, the aim being to simplify these data structures into a simple and logical notation. By using the selected method of analysis, we came to the conclusion that not only one condition or a single combination of conditions leads to the set outcome. Rather there emerges a variety of causal paths, which can result in both the absence and in the presence of the outcome (protest actions).
Povzetek. Radikalizem in radikalna politična gibanja so logični in hkrati problematični odziv na družbene spremembe in probleme. Namen članka je prikazati težavno umeščenost radikalizma med povsem legitimne oblike reagiranja na družbeno stvarnost in potencialno ali celo dejansko grožnjo nacionalni varnosti v primeru nasilnega ekstremizma. Avtor preverja in potrjuje tezo, da je politični radikalizem oblika odzivanja na družbene probleme, ki v primeru uresničitve z največjo verjetnostjo pripelje do velikih družbenopolitičnih sprememb, vendar pa se sooča s tveganjem, da postane grožnja nacionalni varnosti v primeru izvajanja ekstremističnih nasilnih dejanj. Avtor ugotavlja, da je radikalizem rezultat kontinuuma med naraščajočo radikalnostjo ciljev in naraščajočo radikalnostjo implementacije ciljev.
