The article is devoted to the analysis of the concept, philosophy, principles and basic forms of Community Policing as a model of interaction of the National Police of Ukraine with the population. A historical digression of the formation of the Community Policing strategy was made and it was proved that it was based on the implementation of the so-called "9 principles of modern police" by Robert Peel, modified and tested in the law enforcement agencies of democratic countries. It is proposed to define Community Policing in the sense of a community-based approach to policing, which recognizes that effective policing depends on community assistance and support, and which is based on innovative collaboration between the police and the community to jointly identify and address issues, facing the community. It has been proved that the Community Policing, as a model of interaction between the police and the population, has its own philosophy and certain organizational principles. It is proposed to understand the concept of Community Policing, philosophy as certain semantic postulates, as well as an organizational strategy for their implementation in the field of police and community cooperation to overcome problems related to crime, public order and security, to improve the quality of life. The philosophical and semantic principles of the Community Policing concept are revealed. The purpose of realization of the Community Policing model is substantiated and defined and the expected results of its introduction in Ukraine are formulated. It is proposed to define the concept of "forms of policing within Community Policing" in the sense of homogeneous in nature and legal nature of groups of actions that have external expression, and through which the protection of citizens, public order, public safety, crime prevention, police services in the process of partnership between the police and the population. The most promising forms of interaction between the police and the population within the Community Policing model operating in Ukraine are analyzed. It is proved that the conditions for the effectiveness of communication between the police and the public within the Community Collecting model are the implementation of the latter in accordance with established principles and on a certain range of issues. The content of these principles is revealed and the range of relevant issues of the communication process is outlined. ; Статтю присвячено аналізу поняття, філософії, принципів та основних форм здійснення Community Policing як моделі взаємодії Національної поліції України з населенням. Здійснено історичний екскурс формування стратегії Community Policing та доведено, що в її основу було покладено реалізацію так званих 9 принципів роботи сучасної поліції Роберта Піля, модифікованих і апробо- ваних у діяльності правоохоронних структур демократичних країн світу. Запропоновано визначення поняття Community Policing у розумінні орієнтованого на громаду підходу в роботі поліції, який визнає, що ефективна поліційна діяльність залежить від допомоги й підтримки з боку громади і який ґрунтується на організованій інно- ваційними методами співпраці поліції і громади щодо спільного виявлення й розв'язання проблем, які стоять перед громадою. Доведено, що Community Policing, як модель взаємодії між поліцією і населенням, має власну філософію та певні організаційні засади. Запропоновано під поняттям філософії Community Policing розуміти певні смислові постулати, а також організаційну стратегію щодо їх втілення у сфері взаємодії поліції і громади задля подолання проблем, пов'язаних із злочинністю, порушенням громадського порядку та безпекою, з метою поліпшення якості життя громади. Розкрито філософсько-смислові засади концепції Community Policing. Обґрунтовано й визначено мету реалізації моделі Community Policing та сформульовано очікувані результати її запровадження в Україні. Запропоновано визначення поняття «форми реалізації поліційної діяльності в межах Community Policing» у розумінні однорідних за своїм характером та правовою природою груп дій, що мають зовнішнє вираження, і за допомогою яких забезпечуються охорона прав громадян, громадський порядок, громадська безпека, здійснюється протидія правопорушенням, надаються поліційні послуги у процесі партнерської взаємодії між поліцією і населенням. Проаналізовано найбільш перспективні форми взаємодії поліції і населення в межах моделі Community Policing, що діє в Україні. Доведено, що умовами ефективності комунікації між поліцією і населенням в межах моделі Community Policing є здійснення її відповідно до установлених принципів і з визначеного кола питань. Розкрито зміст зазначених принципів та окреслено коло відповідних питань процесу комунікації.

The article analyzes the activities of local self-government bodies at the level of united territorial communities through the analysis of programs of integrated community development planning, their stages and problems that arise in their development. Approaches to researching the content of community development potential are identified. The main problems that hinder capacity development, have been identified: low level of organizational capacity of local self-government bodies, lack of organizational strategy and organizational processes, low level of interest and awareness of the processes of local self-government reform and lack of certainty in the land legislation.

Is it possible to provide a "philosophical reduction" of extensively proliferating interpretations of the phenomenon of identity in humanities? Could the concept of ethno-cultural form of life serve as the end socio-anthropological correlate of its philosophical understanding through the notions of life-world, culture, a person of culture? Interpreting E. Ericson's, A. Sen's, K.A. Appiah's, A. Maalouf's, N. Sharansky's and some other ideas the article responds in a positive way to the raised questions. At the same time it critisizes a trend of applying cosmopolitan view on the globalization process (A. Sen, J. Habermas) to analysis of the "end grounds" of the identity. The author refers to deliberated hermeneutical study of the "communitas" (Lat.) done by R. Esposito to join his conclusion on "no-thingness" of the "essence" or "communality" of community as identity of a collective subject. Using generalizations of B. Anderson as to "emagined nations" the author develops the view on identity as a way of being in terms of being-possibility, as well as through M. Heidegger's concept of ontological difference. Methodologically, such an approach can help to criticize various forms of reificationistic approaches in political judgments and in everyday life, i.e., under discriminating interpretations of identity through indication of the "negative features of national character", biased reduction of communities and individuals to their bio-anthropological characteristics, etc. ; ***

Certain aspects of the local self­government functions realization support in Ukraine and some other countries have been considered. Analysis of the notion "issue of the local character" has been made taking into account its doctrine interpretation in both native and foreign scientific literature. Foreign experience regarding determination of the local self­government functions and objectives in the countries having Anglo­Saxon and continental types of the local government systems has been studied. Certain suggestions have been made to improve Ukrainian practice as for the community's right for local self­government realization. The suggestions made concern division of the local character issues into the local issues themselves and the issues delegated. Besides, the local issues themselves include obligatory issues (key functions performed by the local self­government itself) and additional (optional) functions which are performed by the local self­government regarding the community financial situation under the contracts with private companies and attracting other communities' financial assets. ; Розглянуто окремі аспекти забезпечення реалізації функцій місцевого самоврядування в Україні та в інших країнах. Problem setting. The success of United Territorial Communities development depends on stimulating their financial capacity. Effective use of local resources, availability of business entities, developed infrastructure is capable of ensuring the successful development of the territorial community. By forming their financial capability, territorial communities become management entities and are given real opportunities to carry out their powers.Highlighting previously unsettled parts of the general problem. The current stage of development of local self-government is characterized by a full understanding of the need for change, provided that the development of territorial communities and the study of their financial capacity. Thus, it is important to pre-calculate its financial capacity, which will assess the benefits and risks of such an association, determine the need to find additional funds and organize expenditures. At the same time, the approaches to the analysis of communities' financial capacity have not been fully explored. Paper main body. The carried out analysis of data of the performance of local government budgets of United Territorial Communities has shown a significant increase in several regions. At the same time, the analysis showed that the rate of growth of own incomes per inhabitant in different regions differs more than twice. This indicates the necessity to find additional opportunities to increase the revenues into the local budgets by attracting businesses to their territories. Successful business development, creation of comfortable working conditions for businesses helps to increase the financial resources, which the community would receive. Important documents that help attract investors are the existence of a strategic plan and a master plan for the development of the territory. The development of the territory planning scheme contains important information for potential investors, as it substantiates the needs of the territorial community and arranges the public, civil and private interests. Another important aspect of meeting the financial needs of the territorial community is the formation of the optimal structure of the expenditure part of the budget. It is vital to carry out a constant analysis of budget expenditures, transparency and publicizing the results of the analysis, which will prevent cases of their irrational spending.Conclusions of the research and prospects for further studies. Thus, when forming a new OTG, it is important to pre-calculate its financial capacity, which will assess the benefits and risks of such an association, determine the need to find additional funds and organize expenditures. This analysis also provides an opportunity to analyze and compare the results of their financial activities with the results of other communities, both in their region and in neighboring one. It will also provide an opportunity to see the strengths and weaknesses of the community, focus efforts on strengthening financial capacity and the rational use of funds to provide quality public services to community residents. The financial and budgetary component determines the degree of decentralization of its powers and influences the socio-economic development of a particular territory. Decentralization of budgetary resources enhances the overall responsibility for increasing the revenues into the local budget for the benefit of the local territorial community. Therefore, the formation of the financial capacity of territorial communities is an important task of our time and the search for opportunities to intensify this process is an important question of future research. ; Розглянуто питання фінансового стимулювання розвитку об'єднаних територіальних громад (далі – ОТГ) в умовах продовження реформи децентралізації. In the article, it is analysed some memorandums of the community law of Ukraine – the Regulations on public administration of the city of Odessa, which was the current law-making collection of the city government in Odessa until 1872. It is reviewed some socio-economic and political appearance causes of the current memorandum and the method of its adaptation by Emperor Alexander II 30. IV. 1863. It is established that the main law-making collections of the Regulation on public governmental authorities in Odesa in 1863 were: Charter on Rights and Benefits for the Towns of the Russian Empire 21 IV.1785; Charter on public administration of St. Petersburg 13 ІІ. 1846; the ninth volume of the Code of Laws of the Russian Empire, 1857; Regulations on public administration of the city of Moscow 20 III. 1862; Charter on alterations and additions of some authorizations on public administration in St. Petersburg 20 III. 1862, etc. Structurally, the Regulations on public administration of the city of Odessa in 1863 consist of an introduction and the main part of the eighty-two paragraphs, which are combined into four chapters: Chapter I. "On the composition, subjects, and images of the Odessa public administration"; Chapter II. "On the order of calling the elections and members of General Duma and vacancy filling in the city public administration"; Chapter III. "On the order of elections and gatherings for them"; Chapter IV "On the rights and benefits of public city service". According to the Regulations on public administration of the city of Odessa in 1863, it is included mainly the standards on urban law of that time and established a new arrangement of city self-government in the city of Odessa. According to the Regulations on public administration of the city of Odessa in 1863, governmental authorities were divided into general ones, for the whole city community which included: The General City Duma; Mayor; Regulatory City Duma and personal, for certain categories of citizens or estates, namely: Assembly of elected officials; Estate officers; merchant and bourgeois councils together with their institutions and ranks.Certain establishments of the Regulations on public administration of the City of Odessa in 1863 established specific powers of general and personal bodies of city self-government. Of particular importance were the provisions of the Regulations on public administration of the City of Odessa in 1863, which defined a new preparation of holding meetings for city elections. ; У статті зроблено аналіз пам'ятки муніципального права України – Положення про громадське управління міста Одеси 1863 року, яке було чинним законодавчим збірником міського самоврядування в м. The content of such concepts as "a territorial community", "a united territorial community", "a capable territorial community" is analyzed. The correlation between the content of the concept of a territorial community in the legislation of Ukraine and in the European Charter of Local Self-Government is investigated. Different approaches to identifying characteristic features of a territorial community are shown.Problem setting. Sushinsky and many others.Highlighting previously unsettled parts of the general problem. The contribution of the researchers mentioned above is significant, but a special attention should be paid to the need for the further research in this field. The purpose of the study is to determine the content and approaches to understanding of the concept of a territorial community, its main features and legal personality, to analyze the essence and characteristics of capable territorial communities.Paper main body. The foundations for decentralization in Ukraine were laid on April 01, 2014, when the Concept of reforming of local self-government and territorial organization of power in Ukraine was approved by the order № 333-r of the Cabinet of Ministers of Ukraine and the Plan of Actions on its implementation was confirmed on June 18, 2014 by the order № 591-r of the Cabinet of Ministers.The investigation of the concept of a territorial community, its legal status, functions, features, is necessary to understand the decentralization and ways of forming of capable territorial communities. The Constitution of Ukraine and the Law of Ukraine "On Local Self-Government in Ukraine" define a territorial community as the primary subject of local self-government in Ukraine, but the definition itself is ambiguous.The analysis of the definition of the primary subject of local government in the European Charter of Local Self-Government reveals some translation related differences. Based on the comparison of the English and French-language translations of the European Charter of Local Self-Government, it is possible to say that the term "local authorities" is understood as "local (territorial) communities (collectives)".Based on the definitions in the legislation and the scientific literature, the following understanding of a territorial community can be formulated. A territorial community is an aggregate of citizens of Ukraine who live together within a certain territory, have a legal status defined by law, identify themselves with it and have common interests.The Law of Ukraine "On Local Self-Government in Ukraine" defines the ability as a state guaranteed right and the real capability of a territorial community to resolve issues of local importance within the framework of the Constitution and Laws of Ukraine independently or under the responsibility of local self-governmental bodies and officials.A capable territorial community should have the following characteristics: a defined territory; developed social infrastructure; required staff potential; material and financial resources sufficient to solve local issues for the benefit of residents of a community.The majority of the territorial communities of Ukraine under modern conditions, having the authority to resolve issues of local importance, cannot fulfill them properly due to lack of material and financial resources, poor quality or lack of infrastructure (buildings, structures, roads, etc.) and lack of qualified staff.Conclusions of the research and prospects for further studies. The Constitution of Ukraine and the Law of Ukraine "On Local Self-Government in Ukraine" define a territorial community as the primary subject of local self-government. Based on one variant of the translation of the term "local authorities", the analysis of the text of the European Charter of Local Self-Government and the procedure for its adoption, it can be stated that the European Charter of Local Self-Government also defines a territorial community as the primary subject.Based on the definition of a territorial community in the Ukrainian legislation, different approaches to its understanding, it is possible to define the concept of a territorial community as an aggregate of citizens of Ukraine who live together within a certain territory, have a legal status defined by law, identify themselves with it and have common interests.The ability is defined as the state guaranteed right and the real capability of a territorial community to solve the issues of local importance within the Constitution and Laws of Ukraine independently or under the responsibility of local self-government bodies and officials.A capable territorial community must have a defined territory, a developed social infrastructure, the necessary human resources and the material and financial resources sufficient to solve issues of local importance for the benefit of residents of the community. The practice of exercising the powers of the united territorial communities indicates the inability to carry out the tasks assigned to them. The further research needs the connection of the capability of local communities with the prospects of accelerating of their integration and the impact of external and internal factors on this process. ; Проаналізовано зміст понять "територіальна громада", "об'єднана територіальна громада", "спроможна територіальна громада". Based on one variant of the translation of the term "local authorities", the analysis of the text of the European Charter of Local Self-Government and the procedure for its adoption, it can be stated that the European Charter of Local Self-Government also defines a territorial community as the primary subject.Based on the definition of a territorial community in the Ukrainian legislation, different approaches to its understanding, it is possible to define the concept of a territorial community as an aggregate of citizens of Ukraine who live together within a certain territory, have a legal status defined by law, identify themselves with it and have common interests.The ability is defined as the state guaranteed right and the real capability of a territorial community to solve the issues of local importance within the Constitution and Laws of Ukraine independently or under the responsibility of local self-government bodies and officials.A capable territorial community must have a defined territory, a developed social infrastructure, the necessary human resources and the material and financial resources sufficient to solve issues of local importance for the benefit of residents of the community. The practice of exercising the powers of the united territorial communities indicates the inability to carry out the tasks assigned to them. The further research needs the connection of the capability of local communities with the prospects of accelerating of their integration and the impact of external and internal factors on this process. ; Проаналізовано зміст понять "територіальна громада", "об'єднана територіальна громада", "спроможна територіальна громада". The essence phenomena of local self-government and territorial community are considered. The article discloses main problems of the concept potential of "territorial community" in a modern society. Problem setting. In today's conditions of democratization of social relations, the role of local communities as the main entity of socio-economic development of a separate territory is growing. At the same time, progress in the realization of these tasks is possible only under the condition of financial resources sufficiency, efficiency and their proper use. Therefore, the issue of managing financial resources at the local level is becoming more and more relevant.Recent research and publication analysis. The problem of managing financial resources of the territorial community has been studied by the following scientists: K. Blishchuk, I. Kozak, Ye. Matviishyn, O. Niema, M. Semenko, I. Storonianska, etc.Highlighting previously unsettled parts of the general problem. Despite a large number of theoretical studies in this area, the formation of an integrated approach to managing the financial resources of the territorial community is an urgent problem.Paper main body. To fulfil this task it is necessary to increase the financial capacity of administrative-territorial entities by transferring additional financial resources and additional sources of income to local self-government bodies. In addition, the important point is the ability to cooperate with representatives of economic entities of various forms of ownership, the use of funds of the population, loans, investments, participation in various projects and programs.Therefore, local management of financial resources involves the use of an integrated approach, a combination of resources coming from both state and non-state sources. There is a steady increase in own income of territorial communities due to the reform.In this context, a special task is to carry out a permanent analysis of revenue and expenditure of budget funds. Such an analysis enables local governments to analyze and compare the results of their financial activities with the results of other communities. This analysis also makes it possible to see the strengths and weaknesses of the community, to focus on the rational use of funds. Such approaches are becoming more relevant in the context of active unification of communities and gaining new authorities and new resources by them. Communities with well-developed entrepreneurship and with a large number of workplaces have high-income local budgets. Another possibility of implementing development programs is the use of a strategic planning tool that helps analyze all available community resources and assess the feasibility of implementing their own projects.According to the EBRD's support program, centers of advisory and business support are established in the regions. Such centers provide information on possible projects, programs, development tools.Conclusions of the research and prospects for further studies. Therefore, only the creation of an effective system for managing financial support for the development of territorial communities anable active influence on the socio-economic development of these territories. ; Висвітлено роль фінансового управління у формуванні місцевої політики розвитку територіальних громад. Reformatting and formation of new territorial communities in Ukraine actualizes the problems of their material and financial support. One of the components of the material and financial basis of local self-government in Ukraine is real estate. However, the questions remain as to which real estate objects we can consider as assets of the territorial community and which are its problem assets?In the course of the research, we analyzed the definition of the essence of the concept of "real estate" in the Ukrainian legal framework, considered approaches to the classification of real estate (from the standpoint of real estate taxation and from the standpoint of its management). In this paper, we outlined the defining characteristics of real estate from four points of view: from the standpoint of physical properties, from the legal, economic, and social approaches.We analyzed scientific and practical approaches to defining the essence of the concept of "enterprise assets" and identified the characteristic features of the asset. In the next step of the study, we extrapolated these features to properties located within the local community. On this basis, we outlined what real estate we can qualify as an asset of the local community.However, as it turned out, the territorial community also has a kind of quasi-assets, which are privately owned real estate. They correspond simultaneously to several features characteristic of real estate as an asset of the territorial community. In addition, a large number of real estate objects are problematic assets for the local community. Among them are real estate, the owners of which do not have title documents, real estate that is in disrepair, as well as real estate with a significant degree of depreciation, which require large expenditures from the local budget for their repair, etc. We classified them into two groups: those that belong to the territorial community on property rights, and those that are located within the territorial community, but do not belong to it (may become a quasi-assets for the community).We pointed out that intensifying the management of local governments in the direction of transforming problem assets into assets that benefit the community, as well as preventing their occurrence in the future would increase the role of real estate as one of the basic assets of the local community. ; Переформатування та формування нових територіальних громад в Україні актуалізує проблеми їх матеріального та фінансового забезпечення. Одним із складових елементів матеріально-фінансової основи місцевого самоврядування в Україні є нерухомість. Проте залишаються відкритими питання, які об'єкти нерухомості можна вважати активами територіальної громади, а які ні?У ході дослідження проведено аналіз визначення сутності поняття «нерухомість» в українській нормативно-правовій базі, розглянуто підходи до класифікації об'єктів нерухомості, окреслено їх визначальні характеристики.На основі наукових та практичних підходів до визначення суті дефініції «активи підприємства» виокремлено характерні ознаки активу і запропоновано трактування нерухомості як активу територіальної громади.Висвітлено проблеми, пов'язані з визначенням об'єктів нерухомості, розташованих в межах територіальної громади, як її активів.
