The internationalization of IP Law, initiated at the end of the 19th century, has taken since the end of the 20th century a brand new twist with its inclusion in the field of multilateral trade disciplines. The signing of the TRIPS agreement marks the emergence of a global IP governance. Indeed, the ambition displayed by the WTO is to supervise the margin of maneuver of its Members in implementing their policies. Although Communitization of IP law started much later, it now has a considerable scope: national protection regimes have been conciliated with the cardinal principles of the Treaty, some important harmonization directives have been enacted, and various European titles of protection have even been created. Our study is designed to show how Communitization, beyond its traditional role of source of law, officiates as a necessary and efficient vector for structuring the European position towards the Globalization of IP Law. In its ascendant side first -- from Local to Global, the Communitization vector plays a role of merging the objectives to be promoted on the international scene. The issue at stake is to shape an IP global framework that corresponds to the system of interests and values of the EU, in accordance with the far-reaching objectives assigned by the Treaty. This merging process is, however, not automatic. In spite of several amendments to the Treaty and of the progress of internal harmonization, various institutional constraints thwart the emergence of a fully integrated external European policy in the field of IP. But it is precisely in light of these constraints that the scope of the achievements of the EU, which in now recognized as a central actor in the global IP governance, must be appreciated. In its down side then -- from Global to Local, the Communitization vector is accompanied by a rise of the European Court of Justice in arbitrating complex normative interactions between national, EU and International IP Laws. A systematic analysis of the resolution by the ECJ of these normative interactions reveals its determination to safeguard the autonomy of the EU legal order, by arranging for significant discretion in implementing international commitments. This margin of appreciation is used to defend an original European model under construction, taking advantage of the flexibilities of the global normative framework ; Cette étude se propose de dépasser l'analyse statique des différentes sources supranationales du droit de la propriété intellectuelle pour s'intéresser spécifiquement aux interactions entre les processus de communautarisation et de mondialisation en la matière. Ce parti-pris méthodologique procède de la conviction que le sens de la communautarisation de la propriété intellectuelle ne peut être pleinement saisi qu'en y intégrant sa dimension externe, au travers d'une analyse systématique des relations qu'elle entretient avec la mondialisation de cette branche du droit. Par-delà son rôle traditionnel de source du droit, la communautarisation s'érige en effet en vecteur entre les ordres juridiques nationaux et un ordre international multipolaire, en modifiant fondamentalement les données de la dialectique du global au local. L'ambition de cet ouvrage est précisément de mettre en lumière combien la communautarisation - malgré son apparente fragmentation - officie comme un indispensable vecteur de structuration de la position européenne vis-à-vis de la mondialisation du droit de la propriété intellectuelle.Dans son versant ascendant tout d'abord, du local au global, la communautarisation se pose en vecteur de mutualisation des objectifs à promouvoir sur la scène internationale. L'enjeu n'est autre que de façonner une gouvernance mondiale qui corresponde aux intérêts et valeurs de l'UE, conformément aux buts ambitieux assignés par le Traité. En dépit d'un cadre institutionnel complexe et hétérogène qui fragilise parfois dangereusement sa cohésion, l'Union s'impose peu à peu comme un acteur incontournable dans la mondialisation du droit de la propriété intellectuelle, parvenant à exporter efficacement les standards européens de protection, tout en s'ouvrant progressivement aux revendications légitimes des pays en développement. Dans son versant descendant ensuite, du global au local, la communautarisation s'accompagne d'une montée en puissance de la Cour de justice dans l'arbitrage des interactions normatives entre le droit de l'Union et le droit international de la propriété intellectuelle. Dans le cadre de cette mission, le juge de Luxembourg s'attache à préserver l'autonomie de l'ordre juridique de l'Union, en ménageant une marge d'appréciation significative dans la mise en œuvre des obligations découlant de la mondialisation du droit de la propriété intellectuelle. Cette thèse pose la question de la territorialisation de l'action publique avec pour champ d'application la culture. Il s'agitde déterminer dans quelle mesure le management stratégique du portefeuille territorial d'évènements culturels participeau management de la proximité territoriale et, par extension, à l'attractivité durable du territoire.Il s'agit dans un premier temps de rappeler les enjeux territoriaux d'un management de la proximité. L'un des conceptscentraux mobilisés ici est le management territorial stratégique, entendu comme le nouveau paradigme de l'actionpublique locale. L'approche par les dynamiques de proximité est ensuite proposée comme grille de lecture du territoire,l'activation des potentiels de proximité permettant un renforcement de l'attractivité territoriale (Chapitre 1).Reste que l'action culturelle peut prendre des formes variées. Or, nous avons pu constater un déplacement de lapolitique culturelle française, anciennement fondée sur le développement d'équipements relais pour mailler le territoireet favoriser la démocratisation culturelle, et aujourd'hui soumise à un phénomène de « festivalisation ». Si l'évènementapparaît comme une forme moderne d'action culturelle, l'essoufflement constaté sur certains territoires et la mise enconcurrence accrue des « destinations évènementielles », invitent à replacer l'analyse de l'évènement culturel dans uneapproche stratégique fonctionnelle et dynamique du portefeuille territorial d'évènements culturels. Il s'agit alors des'interroger sur les différentes fonctions attribuées aux évènements et ce au regard d'une logique stratégique territoriale(Chapitre 2).Parmi les nombreux échelons territoriaux existants dans le système français, nous avons choisi d'analyser la stratégieculturelle au niveau d'un Etablissement Public de Coopération Intercommunale (EPCI) : la Communauté du Pays d'Aix(CPA). Ainsi, la méthodologie qualitative engagée (entretiens semi-directifs avec analyse de contenu) s'appuie-t-elle surune étude de cas unique (le portefeuille territorial d'évènements culturels de la CPA) enchâssée (les sous-unités d'analyseétant les évènements culturels eux-mêmes) (Chapitre 3). La sélection de trois évènements implantés sur le territoire de laCPA – « Par les Villages », la saison culturelle « Picasso-Aix 2009 », le Festival d'Aix-en-Provence – permet d'interrogerempiriquement la pertinence d'une approche fonctionnelle et dynamique du portefeuille territorial.Les résultats s'articulent autour de trois propositions (Chapitres 4-6) : (1) l'action culturelle locale est génératrice d'unevaleur ajoutée territoriale multi-dimensionnelle et favorise ainsi l'attractivité durable du territoire ; (2) la gestion duportefeuille territorial d'évènements culturels se fonde sur une approche fonctionnelle dont la grille de lecture analytiqueest la proximité territoriale ; (3) le management stratégique du portefeuille territorial d'évènements culturels implique lagestion d'un contenu à la fois « matériel » (des projets culturels) et « humain » (des porteurs de projets culturels). ; This work is a theoretical and methodological analysis of the public action territorialisation in the cultural field. We wantto determine to which extent the strategic management of a territorial events portfolio takes part in the reinforcement ofterritorial proximity, and, by extension, in the sustainable attractiveness of this territory.First, we recall the territorial issues of a strategic management thought in the way of territorial proximity. One of thecentral concepts mobilized in this reflection is the territorial strategic management. It is understood as the new paradigmof the local public action. The "dynamics of proximity" approach is then proposed as an analytic framework of the localgovernance system. The activation of the potentials of proximity make a strengthening of territorial attractiveness possible(Chapter 1).Moreover, the cultural action can take many forms. However, we have seen a shift in French cultural policy. Formerlybased on the development of equipment used to cover the territory and promote the democratization of culture, it isnow subject to a phenomenon of "festivalization". If the event is seen as a modern form of cultural action, the possiblerunning out of steam as the development of a real competition on the "event destinations" marketplace invite us to placethe analysis of the cultural event in a functional and dynamic approach of the territorial events portfolio. The aim is thusto consider the various functions assigned to the different events under a territorial strategic logic (Chapter 2).Among the numerous territorial levels existing in the French system, we chose to analyze the cultural strategy at the levelof a community council: the greater one of Aix-en-Provence. Thus, the qualitative methodology used (semi-structuredinterviews with content analysis) is based on a single and embedded case study: the cultural events portfolio of thecommunity council mentioned previously with the analysis of sub-units which are the cultural events themselves. Theselection of three events located on the territory allows us to empirically examine the relevance of a functional anddynamic approach of the territorial portfolio. These events are "Par les Villages", a local event; the cultural season of"Picasso-Aix 2009", a hallmark event; and the "Festival d'Aix-en-Provence", the major institutionalized hallmark eventinternationally known (Chapter 3).The results are based on three proposals (Chapters 4-6). (1) Local cultural action generates a "territorial added value" andsupports multi-dimensional and long-term attractiveness of the territory. (2) The strategic management of the culturalevents portfolio is based on a functional approach whose analytical reading grid is the territorial proximity. (3) Thestrategic management of this portfolio involves managing content in both "material" (cultural projects) and "human"(holders of cultural projects).

In this thesis we analyze the performance of communication networks using game theoretic approaches. The thesis is in two parts. The first part studies the performance of Ad hoc, cellular and transportation networks taking into consideration spatial effects. The second part studies economic issues in the communication networks related to the `net neutrality' regulations. Here we study price competition and revenue sharing mechanisms between the network service providers.In the first part, we use Medium Access Control (MAC) game and Jamming game models to study the performance of a Mobile Ad hoc NETwork (MANET), and routing games to study the performance of a transportation network. In the cellular networks, we study the effect of reducing the spatial density of base stations on the amount of radiation to human body (green networking). Geometric aspects play an important role in the performance of wireless networks. For example, node locations affect the amount of interference. In MANETs, the mobility results in users experiencing different amount of interference from their neighbors, and also due to decentralized nature of the network the users can be selfish in sharing the resources. To model the geometrical properties of the network and selfish behavior of the users we used stochastic geometry and game theory. Our work developed a pricing mechanism and showed that with an `appropriate' price all the users can be made to get a fair share of the resources resulting in global optimal network performance. We also considered an adversarial setting where some of the nodes aim to degrade the performance of the network by jamming other nodes' transmissions.In the second part of the thesis, we study economics aspects in communication networks. Representatives of several Internet access providers (ISPs) have expressed their wish to see a substantial change in the Internet pricing policies. In particular, they would like to see content providers (CPs) pay for use of the network, given the large amount of resources they use. This would be in clear violation of the ``net neutrality'' principle that had characterized the development of the wireline Internet. The thesis explored possibility of a regulator facilitating monetary interactions between the ISPs and CPs in a nonneutral regime. Using tools from game theory and mechanism design we developed two bargaining mechanisms to decide payments between the ISPs and CPs. We showed that if the players bargain before they set the access prices for end users, it results in a favorable equilibrium where every player benefits. We also considered the case where some of CPs make exclusive contracts with the ISPs to get preferential treatment and studied its impact on both the service providers and the end users.As the Internet commerce grows, regulation of the monetary interaction between various service providers is unavoidable. Our work provides important policy guidelines on how the Internet should be regulated such that the end users' interests are protected ; Dans cette thèse, nous analysons les performances des réseaux de communication à l'aide d'approches issues de la théorie des jeux. Cette thèse se présente en deux parties. La première partie étudie la performance des réseaux ad-hoc, cellulaires et de transport en tenant compte d'effets spatiaux. La deuxième partie adresse des problématiques économiques dans les réseaux de communications, liées à la réglementation de la «neutralité du réseau». Ici, nous étudions la concurrence des prix ainsi que des mécanismes de partage des revenus entre fournisseurs de services réseau.Dans la première partie, nous utilisons des modèles de jeu d'accès canal (MAC) et jeu de brouillage pour étudier les performances d'un réseau mobile ad hoc (MANET), et de jeux de routage afin d'étudier les performances d'un réseau de transport. Dans les réseaux cellulaires, nous étudions l'effet de la réduction de la densité spatiale des stations de base sur la quantité de rayonnement au corps humain (réseau vert).Les considérations géométriques jouent un rôle important dans les performances des réseaux sans fils. Par exemple, la position des nœuds affecte le niveau des interférences. Dans les MANETS, la mobilité des nœuds conduit à une observation différente du niveau d'interférences provenant de leurs voisins, et aussi due à la nature décentralisée du réseau, les utilisateurs peuvent adopter un comportement égoïste dans le partage des ressources. Afin de modéliser les propriétés géométriques du réseau ainsi que le comportement égoïste des utilisateurs, nous utilisons la géométrie stochastique et la théorie des jeux. Notre travail a développé un mécanisme de tarification et a montré qu'en définissant un prix approprié, tous les utilisateurs pouvaient être amenés à recevoir une part équitable des ressources conduisant à un optimal global des performances du réseau. Nous considérons aussi une configuration antagoniste où certain nœuds tendent à dégrader les performances du réseau en brouillant les communications des autres nœuds du réseau. Dans la deuxième partie de la thèse, nous étudions des aspects économiques dans les réseaux communication. Les représentants de plusieurs fournisseurs d'accès Internet (ISP) ont exprimé leur souhait de voir un changement important dans les politiques de tarification de l'Internet. En particulier, ils aimeraient voir les fournisseurs de contenu (CP) payer pour l'utilisation du réseau, compte tenu de la grande quantité de ressources qu'ils utilisent. Ce qui serait une violation flagrante du «principe de neutralité des réseaux» qui a caractérisé le développement de l'Internet filaire. La thèse a étudiée la possibilité de l'introduction d'un régulateur facilitant les interactions monétaires entre les ISP et les CP dans un régime non neutre. En utilisant des outils issus de la théorie des jeux et de la conception de mécanismes, nous avons développé deux mécanismes de négociation décidant des paiements entre les ISPs et CPs. Nous montrons que si les joueurs négocient avant de fixer les prix d'accès des utilisateurs finaux, ceci conduit à un équilibre favorable où tous les joueurs ressortent gagnant. Nous considérons également le cas où certains CPs établissent des contrats d'exclusivités avec les ISP afin d'obtenir des traitements préférentiels et en étudions l'impact sur les fournisseurs d'accès et les utilisateurs finaux. Avec la croissance du commerce de l'internet, la régulation des interactions monétaires entre différents fournisseurs de services est inévitable. Notre travail fournit des lignes directrices importantes sur la façon dont l'Internet doit être réglementé de telle sorte que les intérêts des utilisateurs finaux sont protégés

We analyse the impact and determinants of an overall carbon tax in an imperfectly integrated economy composed of countries of different sizes. With the help of a trade and localisation model, we first show that the concentration of firms in the country with a market size advantage increases total CO2 emissions. The introduction of a global carbon tax then leads to relocation of firms from the large country to the small country, so that even if set at a single rate, a carbon tax would not be neutral from the point of view of economic geography. Finally, by leading to a reduction in global CO2 emissions, these relocations improve the environmental effectiveness of the carbon tax. ; Nous analysons l'impact et les déterminants d'une taxe carbone globale dans une économie imparfaitement intégrée composée de pays de différente taille. A l'aide d'un modèle de commerce et de localisation, nous montrons tout d'abord que la concentration de firmes dans le pays disposant d'un avantage de taille de marché accroît les émissions totales de CO2. L'intro- duction d'une taxe carbone globale conduit alors à des délocalisations de fi…rmes du grand pays vers le petit pays de sorte que même …fixée à un taux unique, une …fiscalité carbone ne serait pas neutre du point de vue de la géographie économique. Enfin, parce qu'elles conduisent à une réduction des émissions mondiales de CO2, ces relocalisations améliorent l'efficacité environnementale de la taxe carbone.

The thesis focuses on the industrialization of housing in France (1885-1970), from the lightweight and removable construction to the heavy construction and architecture. The purpose of this thesis is placed at the interface of four major topics: the existence of industrialization before the World War II, the technical policy of the Ministry of Reconstruction and Urbanism (MRU), projects after the Second World War that applied the methods of industrialization imposed by the State, and the principles of the Charter of Athens. The study period extends from 1885, the first witness of European industrialization of the building, to 1970ties of questioning of this type of construction. The industrialization of the building has very old roots; it grows primarily in the military, for the needs of the colonial conquest, campaigns, wars, which inflamed the Europe. The beach cabin or the shack resort, the canvas tent, canopy of market, are as much constructive figures which are proliferating at the end of the nineteenth century. Especially, the colonial expeditions conducted drums requiring speed, security, capacity: the shack is the industrial solution. Industrialization continues to be not light anymore but heavy. It is the main route for the State because it decreases the cost price of the construction, reduces the interventions and improves the comfort of the housing. From 1945, the French State newly invests in the most stricken, encourages innovation based on the employment of materials and techniques in establishing the technical approval of the "new materials and non-traditional methods of construction". In the first part of this research, i have tried to show that there is an industrialization of the building before the Second World War. Industrialization occupied "brutally" lightweight construction in the 1890s. The shack removable and transportable, military becomes the object of competitions, confrontations, of interest of warriors in Western Europe. Dozens of models are prefabricated and really mounted in the fields of battles or in anticipation of territorial conquest. In a second time i have chosen to continue the story in the heavy construction in the after war, specifically the construction of the housing. Therefore i chose to study two outstanding projects of the period just after the Second World War. First is the project of Noisy-le-Sec, through which the state tried to test the processes and new materials to use fewer the raw materials and energy, to simplify the implementation, to raise awareness of these innovations to advance technology and contribute to the improvement of the habitat (interior comfort and equipment). To do this, it imported new processes and imposed changes in pace and scale. Second is the project of Grandes Terres: The site of the project of Grandes Terres could be considered as the first masterpiece of heavy housing prefabrication. In addition the project of Grandes Terres affirms a new way of thinking about the city and its report to the habitat, it is one of the successful applications of the Charter of Athens, bible of the urbanism of Lods, and a reference for the urban development's decades 60 and 70. Finally, to develop this academic research I have taken the party "chronologically":1885-1940 "the lightweight construction and demountable", 1940-1970, "the heavy prefabrication and Unremovable", 1945-1953 "the city of experience of Noisy-le-sec", 1952-1956, "the completed model which is the most successful of major operations, the project of Grandes Terres". ; La thèse porte sur l'industrialisation du logement en France (1885-1970), de la construction légère et démontable à la construction lourde et architecturale. L'objet de cette thèse se place à l'interface de quatre grands sujets : l'existence de l'industrialisation avant la seconde guerre mondiale, la politique technique du ministère de la Reconstruction et de l'Urbanisme (MRU), les projets réalisés après la seconde guerre mondiale dont on applique les méthodes d'industrialisation imposées par l'Etat, et les principes de la charte d'Athènes. La période d'étude s'étend de 1885, premier témoin européen de l'industrialisation du bâtiment, à 1970 année de remise en cause de ce type de construction. l'industrialisation du bâtiment a des racines très anciennes, elle croît d'abord parmi les militaires, pour les besoins de la conquête coloniale, des campagnes, des guerres qui enflamment l'Europe. La cabane de plage ou la baraque de villégiature, la tente de toile, l'auvent de marché, sont autant de figures constructives qui prolifèrent en fin du XIXe siècle. Surtout, les expéditions coloniales menées tambours battants exigent rapidité, sécurité, capacité : la baraque est la solution industrielle. L'industrialisation se poursuit, non plus légère mais lourde. Elle est pour l'Etat la principale voie car elle diminue le prix de revient de la construction, réduit les interventions et améliore le confort des logements. A partir de 1945, l'Etat français nouveau investit dans la partie la plus sinistrée, encourage les innovations basées sur l'emploi de matériaux et de techniques en instituant l'agrément technique des « matériaux nouveaux et des procédés non traditionnels de construction ». Dans la première partie de cette recherche, nous avons essayé de montrer qu'il y a bien une industrialisation du bâtiment avant la seconde guerre mondiale. L'industrialisation occupe « brutalement » la construction légère dans les années 1890. La baraque démontable et transportable, militaire, ambulante devient l'objet de compétitions, de confrontations, d'intérêts guerriers en Europe de l'ouest. Des dizaines de modèles sont préfabriqués et montés en arrière des champs de batailles ou en prévision des conquêtes territoriales. Dans un second temps nous avons choisi de continuer l'histoire de la construction lourde dans l'après guerre, spécifiquement la construction du logement. Par conséquent nous avons choisi d'étudier deux projets remarquables de la période juste après la seconde guerre mondiale. 1- Le projet de la cité expérimentale de Noisy-le-Sec : au travers de ce projet l'Etat a essayé de tester les procédés et matériaux nouveaux permettant d'utiliser moins de matières premières et d'énergie, de simplifier la mise en œuvre, de faire connaître ces nouveautés pour faire de la technique une technologie et contribuer à l'amélioration de l'habitat (confort intérieur, équipement). Pour ce faire, il importe des procédés et impose des changements de rythme et d'échelle. 2- le projet des Grands Terres : Le chantier des Grands Terres doit être considéré comme le premier chef d'œuvre de préfabrication lourde de logements. Ce projet affirme aussi une nouvelle façon de penser la ville et son rapport à l'habitat, il est une des applications réussies de la Charte d'Athènes, bible de l'urbanisme de Lods, et une référence pour les évolutions urbaines des décennies 60 et 70. Enfin, pour élaborer cette recherche académique j'ai pris le parti "chronologique" " : 1885-1940 "la construction légère et démontable", 1940-1970, "la préfabrication lourde et indémontable", 1945-1953 " la cité d'expérience de Noisy-le-Sec", 1952-1956, "le modèle achevé le plus réussi des grands opérations, le projet des Grandes Terres".

In this thesis, we consider how underground or alternative cultural activities, which we call off, could work for urban development much as mainstream cultures, or in, do. We propose that underground cultural activities are an important part of the cultural landscape of a city and, in this way, could be considered an important actor of urban development. As many authors have shown, culture is nowadays a key element of urban development. First, in the major urban redevelopment projects of the last two decades, there was often a cultural facility flagship, a museum or convention center for example. It is especially true in the case of waterfront or industrial wasteland redevelopments. Second, the artists are often pioneers in the gentrification process. The presence of artists has become meaningful for a neighborhood and has increased the real estate value of a place. Third, cultural and artistic activities are very important factors in building a positive image of a city. It markets the city as an innovative and creative place, two fundamental qualities essential to success in the global inter-city competition. Indeed, it is argued that a strong and dynamic cultural framework provides many leisure opportunities for inhabitants and tourists. Cultural activities are therefore increasingly becoming a marketing strategy to attract firms and people to visit or to settle down in a particular city; and cultural tourism is an engine for urban tourism. And finally, many predict that cultural activities are going to be one of the most important economical activities in the city, both by creating direct value and employment and by developing the tourist industry. But, most of these authors considered mainstream cultures. Our purpose is to demonstrate how underground cultures could also work with these topics. By underground or alternative culture, we mean all kinds of cultural activities that are not subsidized and that have no commercial value. But, because they are a part of the 'art world' and should not be considered as separate from the mainstream cultural world, we prefer to use another semantic scheme in our thesis. We are using the concept of 'in culture / off culture'(which is used to explain what is happening in the major art festivals). The in is organized and planned, while the off is spontaneous and opportunist; the off is free of commercial, academic or trend constraints, so it is a creative and innovative space; the in draws from the off new ideas and new talents; the off needs the in to build its legitimacy; and, little by little, the off becomes the real festival: the place to show and to be, the real engine of the festival which attracts more people and more artists until a new off of the off appears. In much the same way, in our study we consider underground cultures as "off culture", and mainstream culture as "in culture". Our research is focused on the artistic squats as an example and a syncretism of off culture. Indeed, they can be considered both as the space of the off culture and as the off spaces of culture. This is one of the original features of this research: using artistic squats as a comprehensive key to analyze and understand urban changes. For this reason, we needed to develop an original methodology. We propose to implement three different kinds of methodological research, each focusing on one of the topics already detailed and all based on artistic squats issues. These works will focus on the Parisian case, but also on other European and global metropolis, such as San Francisco, New York, Toronto, Berlin, London,. by our personal experiences or by bibliographic review. Concerning economical issues, we will most likely not implement empirical research, but it undoubtedly would be of some interest to do a bibliographically based comparison with the theory of innovation and creativity. On the other hand, a literature review has been done on the changes in cultural practices and taste and on sociology of art and artists. So, how could planners integrate these off spaces in urban projects? We study three urban projects, based on interviews and officials materials analyzes. We are considering a case where planners finally decided to integrate a off space in the urban redevelopment project (Les Frigos in the ZAC Paris-Rive Gauche). The second case (La Chapelle-Stalingrad regeneration project) shows how off culture are used as a tool for planning, by cleaning and securing a decaying area. Off artists become planners' pathfinder. They are symbolic shifter from decay to glamour. Then, the real planning project could start. Moreover, this example puts into relief the role of inhabitants organizations in the cultural-led regeneration planning. Indeed, it seems that culture is the unique acceptable feature for urban projects. What does this culture-oriented claim mean? For whose sake are cultural amenities created? The third project is the Newtown cultural precinct that has been created in Johannesburg (South Africa). In this quite unique urban, social, economic and political context, can culture play a similar role? What are the objectives of such an undertaking? Does this project correspond to the lifestyles and behaviours of the inhabitants? As it is shown with the Parisian example, this kind of urban planning practices are more related to a settlement policy than to a cultural one. - Are off spaces places of gentrification? Following many authors, we are interested in the aesthetic and consumerist explanations of gentrification processes. We propose that off cultures play a role in the gentrification process, and expect that they work by giving a trendy image to a neighborhood, as a creative and bohemian place. So, off cultures could be a meaningful pathfinder of gentrification. To prove our purpose, we implement a methodology based on real estate agents interview. We consider real estate agents as good informers about the evolution of real estate markets and neighborhood social changes. They could help us to understand neighborhood and market changes, to explore the potential for gentrification, and to clarify the role of artists and then of off artists and places in gentrification. To do so, we interview several agents in different neighborhoods, all of them located near artistic squats. At the same time, we realize a statistic analysis of real estate market trends. Nevertheless, the results of the researches are mixed. Local real estate agents use artists as a communication tool. They argue that artists and even off artists create a pleasant atmosphere in the neighbourhood, that could attract other populations. But, real estate statistics do not provide convincing results. The only certainty we can propose is that in general, property prices are not influenced by artistic squats. - Is the off an element of the 'tourist gaze'? We argue that off cultural spaces could be tourist places by corresponding to the 'tourist gaze' expectations. Therefore, we do not analyze the tourist (and then economic) impact of off places, but show that off places are important tourist attractions. To do so, we analyze how tourist guidebooks present a city. Indeed, guidebooks writers give meaning to a place by choosing specific places or things to see, and then by interpreting them for the tourists and sometimes by judging them. In this way, tourist guidebooks could be considered as meaningful pathfinder. Based on a comparison between Paris and Berlin, the analysis of several guidebooks shows main differences between the two cities' tourist image. In the Paris case, artistic squats and other off scenes are almost never described in guidebooks. Off is not a part of the city's experience. On the other hand, according to guidebooks, a tourist in Berlin should not avoid visiting one of the many off places. Off is definitely a local attraction. Moreover, off is the Berlin's taste. As we have showed, our PhD is quite ambitious. But it must be considered not as an exhaustive exercise but as an understanding of contemporary urban society proposal. This study help us to understand how off cultures are a part of the city imaginary, and so, how they give meaning to the city. In this thesis, we consider how underground or alternative cultural activities, which we call off, could work for urban development much as mainstream cultures, or in, do. We propose that underground cultural activities are an important part of the cultural landscape of a city and, in this way, could be considered an important actor of urban development. As many authors have shown, culture is nowadays a key element of urban development. First, in the major urban redevelopment projects of the last two decades, there was often a cultural facility flagship, a museum or convention center for example. It is especially true in the case of waterfront or industrial wasteland redevelopments. Second, the artists are often pioneers in the gentrification process. The presence of artists has become meaningful for a neighborhood and has increased the real estate value of a place. Third, cultural and artistic activities are very important factors in building a positive image of a city. It markets the city as an innovative and creative place, two fundamental qualities essential to success in the global inter-city competition. Indeed, it is argued that a strong and dynamic cultural framework provides many leisure opportunities for inhabitants and tourists. Cultural activities are therefore increasingly becoming a marketing strategy to attract firms and people to visit or to settle down in a particular city; and cultural tourism is an engine for urban tourism. And finally, many predict that cultural activities are going to be one of the most important economical activities in the city, both by creating direct value and employment and by developing the tourist industry. But, most of these authors considered mainstream cultures. Our purpose is to demonstrate how underground cultures could also work with these topics. By underground or alternative culture, we mean all kinds of cultural activities that are not subsidized and that have no commercial value. But, because they are a part of the 'art world' and should not be considered as separate from the mainstream cultural world, we prefer to use another semantic scheme in our thesis. We are using the concept of 'in culture / off culture'(which is used to explain what is happening in the major art festivals). The in is organized and planned, while the off is spontaneous and opportunist; the off is free of commercial, academic or trend constraints, so it is a creative and innovative space; the in draws from the off new ideas and new talents; the off needs the in to build its legitimacy; and, little by little, the off becomes the real festival: the place to show and to be, the real engine of the festival which attracts more people and more artists until a new off of the off appears. In much the same way, in our study we consider underground cultures as "off culture", and mainstream culture as "in culture". Our research is focused on the artistic squats as an example and a syncretism of off culture. Indeed, they can be considered both as the space of the off culture and as the off spaces of culture. This is one of the original features of this research: using artistic squats as a comprehensive key to analyze and understand urban changes. For this reason, we needed to develop an original methodology. We propose to implement three different kinds of methodological research, each focusing on one of the topics already detailed and all based on artistic squats issues. These works will focus on the Parisian case, but also on other European and global metropolis, such as San Francisco, New York, Toronto, Berlin, London,. by our personal experiences or by bibliographic review. As it is shown with the Parisian example, this kind of urban planning practices are more related to a settlement policy than to a cultural one. - Are off spaces places of gentrification? Following many authors, we are interested in the aesthetic and consumerist explanations of gentrification processes. We propose that off cultures play a role in the gentrification process, and expect that they work by giving a trendy image to a neighborhood, as a creative and bohemian place. So, off cultures could be a meaningful pathfinder of gentrification. To prove our purpose, we implement a methodology based on real estate agents interview. We consider real estate agents as good informers about the evolution of real estate markets and neighborhood social changes. They could help us to understand neighborhood and market changes, to explore the potential for gentrification, and to clarify the role of artists and then of off artists and places in gentrification. To do so, we interview several agents in different neighborhoods, all of them located near artistic squats. At the same time, we realize a statistic analysis of real estate market trends. Nevertheless, the results of the researches are mixed. Local real estate agents use artists as a communication tool. They argue that artists and even off artists create a pleasant atmosphere in the neighbourhood, that could attract other populations. But, real estate statistics do not provide convincing results. The only certainty we can propose is that in general, property prices are not influenced by artistic squats. - Is the off an element of the 'tourist gaze'? We argue that off cultural spaces could be tourist places by corresponding to the 'tourist gaze' expectations. Therefore, we do not analyze the tourist (and then economic) impact of off places, but show that off places are important tourist attractions. To do so, we analyze how tourist guidebooks present a city. Indeed, guidebooks writers give meaning to a place by choosing specific places or things to see, and then by interpreting them for the tourists and sometimes by judging them. In this way, tourist guidebooks could be considered as meaningful pathfinder. Based on a comparison between Paris and Berlin, the analysis of several guidebooks shows main differences between the two cities' tourist image. In the Paris case, artistic squats and other off scenes are almost never described in guidebooks. Off is not a part of the city's experience. On the other hand, according to guidebooks, a tourist in Berlin should not avoid visiting one of the many off places. Off is definitely a local attraction. Moreover, off is the Berlin's taste. As we have showed, our PhD is quite ambitious. But it must be considered not as an exhaustive exercise but as an understanding of contemporary urban society proposal. This study help us to understand how off cultures are a part of the city imaginary, and so, how they give meaning to the city. But we also expect that our concept could be used by other scholars or planners for example to understand how urbanity occurs, how a place becomes trendy, or to put into relief relationships between in and off in other sphere. We expect to deliver some comprehensive keys for urban planners such as contemporary gazers. ; Dans cette thèse, nous montrons dans quelle mesure les pratiques culturelles alternatives, que nous appelons off, participent au développement des grandes métropoles, tout comme cela a été démontré avec la culture institutionnelle, que nous appelons in. Il est couramment admis que la culture est un élément qualifiant dans la concurrence inter-urbaine et est essentielle à la construction de l'image d'une métropole. En effet, la diversité et la qualité de l'offre culturelle et artistique sont des atouts pour attirer des entreprises de pointes dont les cadres sont friands et grands consommateurs de services culturels. D'autre part, l'événementiel culturel est un moteur du tourisme urbain, principalement axé autour du tourisme culturel. Enfin, la culture et l'industrie culturelle représentent aujourd'hui un secteur économique en pleine expansion, et jouent un rôle important dans le développement des grandes métropoles comme Paris, New York, Los Angeles et San Francisco. En terme de développement urbain, ces phénomènes peuvent se manifester de plusieurs manières : • Les lieux culturels sont programmés dans les projets urbains : dans de nombreux programmes de requalification de friches urbaines, de nouveaux équipements culturels et de loisirs ont été aménagés, devenant les portes-drapeaux de la regénération urbaine ; • les artistes sont souvent des pionniers de la gentrification. A la recherche de locaux spacieux, peu onéreux et centraux, ils s'installent dans des quartiers dévalorisés, industriels ou populaires ; et peu à peu, par leur présence, revalorisent symboliquement le quartier, où de nouvelles populations, attirées par la proximité des artistes, viennent s'installer, entraînant une hausse des prix de l'immobilier. Cela a souvent pour conséquence de chasser les populations les plus pauvres dont les artistes eux-mêmes, incapables de payer les nouveaux loyers ; • les espaces d'expression de la culture (musées, galeries, théâtres, patrimoine bâti.) sont les lieux visités par les touristes, devenant les symboles de la ville, reconnus internationalement. Ces observations portent sur ce que l'on peut considérer comme étant la culture institutionnelle, que nous appelons in. Pour notre part, nous proposons que les pratiques culturelles alternatives ou off participent elles-aussi et de manière similaire au développement urbain. Leur présence est révélatrice de la créativité et du dynamisme d'une métropole. Elle est porteuse d'une image positive pour la ville car c'est par la pluralité et la diversité des scènes et des pratiques artistiques que la culture devient un élément de la métropolisation. Nous parlons de culture in et de culture off par analogie aux grands festivals où se côtoient le in et le off. Le in y est programmé et le off opportuniste et spontané ; le in s'enrichit par l'existence du off où, par une plus grande liberté, peuvent se produire les innovations ; le off a besoin du in pour justifier son existence, trouver une légitimité. Et peu à peu, le off prend le dessus sur le in, attire plus de spectateurs, devient le moteur populaire du festival. Ainsi, dans cette thèse, nous postulons que la culture off joue un rôle dans le développement urbain par complémentarité avec la culture in. Pour cela, nous concentrons nos analyses autour des lieux culturels off (comme par exemple les squats d'artistes) pour montrer en quoi ils contribuent à l'attractivité d'un espace métropolitain. En effet, les lieux off sont l'inscription physique dans l'espace urbain de pratiques artistiques off. Ici, ils ne sont pas l'objet de l'étude, mais le fil conducteur, l'analyseur permettant une compréhension nouvelle des évolutions urbaines contemporaines. Dans cette optique, il s'agit de construire une méthodologie adaptée et novatrice en reprenant les trois grands marqueurs du développement urbain que nous avons présentés précédemment. Ainsi, trois axes et méthodes de recherche sont mis en œuvre : • La régénération urbaine. Comment les lieux culturels off sont-ils intégrés à des projets urbains ? Comment deviennent-ils des constituants d'un nouveau quartier ? Comment les aménageurs conçoivent-ils cette intégration ? Nous nous intéressons particulièrement aux discours produits par les différents acteurs impliqués pour justifier, expliquer et valoriser la présence de lieux off dans des projets d'aménagements (par exemple, l'intégration des Frigos dans la ZAC Paris-Rive gauche). • La gentrification. Dans quelle mesure des lieux off (comme les squats d'artistes) participent-ils à la revalorisation symbolique d'un quartier ? Pour cela, avons réalisé une analyse de données statistiques sur le marché immobilier parisien et des enquêtes auprès d'agents immobiliers afin de comprendre la perception, par des acteurs centraux du marché immobilier, de la présence d'artistes dans un quartier. • Le tourisme urbain. Les squats d'artistes et d'autres éléments de la culture off sont-ils des lieux touristiques ? Participent-ils à l'image touristique des villes ? Pour mettre en évidence cela, nous étudions la construction de l'image touristique des villes à travers une analyse sémiotique de différents guides touristiques. En effet, le guide touristique constitue en soi un corpus intéressant, quoique négligé, pour analyser l'image construite d'un lieu. Il ne reflète pas la réalité du lieu, mais construit et est construit par l'imaginaire porté par ce lieu. Au travers ces trois volets, cette recherche montre comment et dans quelle mesure un lieu off, peut participer au développement urbain. La coexistence des cultures in et off est essentielle à l'effervescence créative d'une métropole, à la fois révélatrice et symbole du dynamisme métropolitain.
