Alternative means of dispute resolution are sought a long time as an access to justice more humane. Without the imposition of an intervening power, the parties have gain more autonomy in their decisions. The extension project of the Federal University of Paraíba "Citizenship in Extension: Access to Justice and Conflict Mediation", linked to the Reference Center for Human Rights (CRDH) aims to address the theme "Access to Justice", using one of the extrajudicial dispute resolution methods, namely: Mediation. The Mandacaru and Jardim Veneza's Reference Center for Citizenship in João Pessoa/PB, were the spaces chosen in the first year of the project, where residents discussed their problems in these localities, in order to build possible plans of action. The following year, the Guardian Council has become the chosen space, working directly with the Mediation. Building a sense of unity among residents of a community is one of the goals of this project with respect to collective issues. And mediation, with respect to individual issues. With the prospect of working together, this project follows its activity, achieving its main goals: empowering individuals and fostering active citizenship.
ABSTRACT Objective: to describe the ethical resolution process/clinicians using a fictional case study. Method: it is a case study, with a current bibliographic references and base legislation on the subject. Results: stages analyzed 1) Resolution on the values: list of ethical problems, moral problem to be analyzed, and identification of conflicting values; 2) Resolution on the duties: identification of extreme courses of action, identification of intermediate courses of action (possible alternatives) and identification of the optimal course of action; and 3) Consistency tests: where the aspects of temporality were analyzed, advertising, legality. Conclusion: the resolution is a fundamental procedure of ethics, occurring every time the values, individual or collective are in conflict. It is necessary to decide to make the decisions that are concrete considering the act of context and its predictable consequences. Descriptors: Bioethics; Decision-making; Ebolavirus. La tesi sostiene che, mentre molte teorie di pianificazione si sono concentrate sulle differenze, il multiculturalismo e risoluzione dei conflitti sociali, non c'è ancora sufficiente approfondimento su come queste differenze possano restare profondamente irrisolte e come questa debolezza possa essere fortemente legata a razionalità contrastanti e a una sorta di "slittamento dei livelli di senso" o "equivoci" cognitivi tra i soggetti coinvolti (Bourdieu e Wacquant, 1992). Soprattutto in termini di conflitti urbani espliciti, generati non da opposti interessi economici o differenti volontà politiche, ma semplicemente da differenti background culturali e comportamentali, il livello cognitivo di com-prensione tra le persone coinvolte ha un ruolo fondamentale in termini di consapevolezza e di effi-cacia delle scelte. Dunque il legame tra pianificazione, governance, contesti istituzionali e partecipazione delle comu-nità è, prima di tutto, una questione di reciproca, profonda e vera comprensione, piuttosto che la continua ricerca di nuovi strumenti e politiche. Partendo dalla convinzione che i conflitti siano una fonte incredibile di soluzioni creative e inaspet-tate all'interno dei contesti urbani, dei sistemi di pianificazione e di condivisione di valori, questo lavoro si propone di sondare come la Mobilitazione Cognitiva (Dalton, 1984), per la cura e la prote-zione di un bene comune, può essere in grado di guidare una comunità nella lotta per i propri diritti, permettendo l'acquisizione di conoscenze politiche e abilità specifiche per il raggiungimento di decisioni condivise collettivamente, la costruzione di nuove forme di azione politica dal basso, nuove processi di educazione (Dolci, 1974) e ampliamento culturale contro il prevaricare di Egemonie politiche e sociali (Gramsci, 2007). Utilizzando metodi quantitativi e qualitativi, l'autore presenta due esperienze di pratiche insorgenti provenienti dall' Europa meridionale: (1) un tradizionale Caso-Studio nell' area marina protetta dell' Arrábida, in Portogallo, per illustrare come la mobilitazione cognitiva, volta alla genuina e profonda comprensione delle istanze portate avanti dalla collettività, può realizzare forme di partecipazione che, guardando ai problemi in termini di risorse, permettono alla comunità di collaborare democra-ticamente cercando soluzioni nuove e condivise in grado di modificare profondamente un piano isti-tuzionale il quale, a causa di una profonda contrapposizione tra poteri gioco e valori espressi, ha ge-nerato forme di conflitto dichiarato, ma anche latente; (2) un caso di Participatory Action Research nella valle del fiume Simeto, in Italia, dove le comunità locali, attraverso una forte mobilitazione collettiva, sono state in grado di difendere e curare il fiume Simeto, il più grande in termini di bacino idrogeologico in un territorio caratterizzato da scarsità idrica come la Sicilia, minacciato dalla scelta istituzionale di collocare un inceneritore proprio in un area fortemente incentrata sull'agricoltura, per il suo sostentamento economico, e profondamente legata al paesaggio circostante, in termini di riconoscimento e senso di appartenenza. Questo lavoro può avere importanti implicazioni sia per la teoria, che per la pratica di pianificazione. La scelta di un approccio multi-disciplinare, inoltre, aiuta nella comprensione di come sia possibile trasformare l'antagonismo in spirito competitivo tra soggetti, diversi per natura e per cultura, concentrandosi principalmente sul rispetto e l'apprendimento reciproco, sulla costruzione di processi veramente inclusivi e sulla scelta di soluzioni davvero condivise. ; The thesis argues that while many planning theories have focused the sight on the social differences, multiculturalism and conflicts resolution, there is not yet sufficient acknowledgement on how these differences can be deeply unsolved and how this weakness could be strongly linked with conflicting rationalities and with a 'cognitive slipping' planes of meaning (Bourdieu & Wacquant, 1992). Especially in terms of inexplicit urban conflicts, generated by not opposite economic interests or political will, but by simply and natural differences of the cultural and behavioral baggage, the cognitive level of understanding between people involved plays a fundamental role in terms of awareness and choices efficacy. So this works wants underlines that the link between planning, governance, institutional adjustments and community engagement is, first of all, a matter of mutual deep and real understanding, rather than new form of tools and policies. Starting from the persuasion that conflicts are an incredible source of unexpected creative solution for urban contexts, planning systems and sharing values, this paper aims to probe how a 'cognitive mobilization' (Dalton, 1984) of a community, for the care and the protection of a common good, can be able to "fight for a right" in terms of acquiring political resource and skills to reach own decisions, and constructing new form of genuine power through education (Dolci, 1974) and culture against a 'dominant discourse' (Gramsci, 2007). Using quantitative and qualitative methods, the author presents two field experiences of insurgent practices in the southern Europe: (1) a traditional Case-Study of a Marine Protected Area in Arrábida, Portugal, to illustrate how a community mobilization, that aims to understand really every form of instance and claim, can realize forms of participation that, first of all, sight problems in term of resources, and then allowed people to work democratically together building new and shared solutions able to modify deeply an institutional plan that, due to a displacement between powers and values, generated forms of conflicts between stakeholders, especially in terms of economic and decision making point of view; (2) a case of Participatory Action Research in the Simeto river valley, Italy, where local communities through a strong mobilization were able to defend and took care the river, the biggest in terms of basin in a scarcity water territory, threatened by the institutional choice to collocated an incinerator in a valley strongly based on agriculture, for its economic sustenance, and deeply linked with the landscape, for its recognition and sense of belonging to . This understanding, it is suggested, has important implications for both planning theory and practice. Choosing a multi-disciplinary approach, this work attempts to explore if and how it is possible to transform the antagonism between enemies in competitive spirit among subjects, different for nature and culture, focusing on respect and mutual learning and on the building up of processes really inclusive and choices really shared
The article analyzes the past, present, & future potential role of the EU in the ongoing ethnic division in Kosovo, with a focus on what the EU can do diplomatically toward furthering a final political resolution, particularly one that will be acceptable to Serbs & ethnic Albanians alike. The discussion begins with a summary of the EU's diplomatic efforts throughout the Balkan wars of the 1990s. Other specific topics surveyed include the current political posture of Serbia with regards to the question of Kosovo, the posture of the majority Albanians in Kosovo, & the posture of the minority Serbs in Kosovo. The article concludes that, given the fact that Portugal now occupies the rotating presidency of the EU, Portugal is now in a unique diplomatic position to help bridge the gaps between the various players in the dispute regarding Kosovo. As Áreas de Preservação Permanente (APPs) desempenham um papel fundamental na manutenção dos principais fatores que regulam os processos hidrológicos e de conservação biológica. Na Amazônia, as APPs vêm sendo ocupadas com atividades econômicas de alto impacto ambiental que levam à supressão de vegetação, desrespeitando o regime legal desse tipo de área protegida. Este artigo analisa os conflitos de uso da terra dentro das áreas destinadas à preservação e propõe uma delimitação dessas áreas de acordo com o Código Florestal Brasileiro de 2012, no municipio de Moju, um dos mais importantes polos de produção de biodiesel do estado do Pará. A pesquisa utilizou imagem multiespectral de alta resolução do satélite RapidEye de 2010 para uma classificação supervisionada que determinou oito classes de cobertura e uso da terra, com especial atenção para a floresta, o cultivo agrícola e cultivo de óleo de palma (Elaeis guineensis). As terras alteradas do município perfazem 30,29% do total, sendo que 17,07% estão ocupadas pela pecuária. Somente 5,2% do território de Moju é legalmente definido como APP. Destas áreas, 29,3% se encontram em uso conflituoso, onde predomina a pastagem, presente em 15,6% das APPs do município. O cultivo de palma corresponde a apenas 0,63% da área da APP e a 2,17% do município. A aplicação das novas regras de recomposição de APPs pelo novo Código Florestal Brasileiro irá resultar em perda de 60,69% de área recuperada em APPs neste município. ; Areas of Permanent Preservation (APPs) play a crucial role in maintaining some of the most important factors regulating hydrological processes and biological conservation. In Amazonia, APPs are being used in economic activities with high environmental impact in violation of legislation concerning this category of protected land. This leads in turn to the suppression of vegetation. This paper analyzed land use conflicts within APPs and outlined these areas in the municipality of Moju according to the Brazilian Forest Code of 2012. Moju is one of the main biodiesel production centers in the State of Pará. The study used high resolution multispectral imagery acquired in 2010 by the RapidEye satellite and supervised classification algorithm to determine eight classes of land cover and use, with special attention to forest, agricultural cultivation and oil palm (Elaeis guineensis) cultivation. Altered lands in the municipality amount to 30.29% of the total, of which 17.08% is used by livestock. APPs with original vegetation cover (forest and campinarana) constitute 68% of the municipality area. The loss of 28.29% of the vegetative cover in local APPs is due mainly to agriculture and animal husbandry. Oil palm cultivation comprises only 0.63% of the APP and 2.17% of the municipality areas. Mercosur: the dilemma between the customs union and a free trade area. In 2001, the government of Argentina - facing a major economic crisis - took a rather controversial decision and reduced the tariff rates of all capital goods to zero. This became a main source of conflict with Brazil, the only country of Mercosur that produces such goods. This paper discusses two possible scenarios for the resolution of this issue. In the first one, the countries would opt for the maintenance of the customs union. The authors present some suggestions for the rebuilding of the Common External Tariff (CET), by which the countries would take a middle course acceptable to all. The other possible outcome would be a step back in the direction of a free trade area, with no CET at all. (Rev Econ Polit/GIGA)
Nas últimas décadas assistimos a um avanço dos estudos feministas, que têm trazido importantes contributos para garantir a integração e igualdade de género nas várias áreas, revelando ser uma corrente inovadora por completar e dinamizar a análise, estudo e compreensão da questão de género em especial relativamente à paz e aos conflitos. Até há pouco tempo, os assuntos relacionados com as Mulheres e a Paz não eram temas prioritários e nem eram motivos de discussão da política internacional permitindo que durante anos fossem cometidas atrocidades contra as mulheres, sem que a Comunidade Internacional desse por isso. Atualmente, as mulheres começaram a assumir um papel mais influente nos processos de reconstrução da paz. Esta evolução tem vindo a ser acompanhada por várias iniciativas e contributos a nível internacional, mediante a elaboração de importantes documentos e promoção de fóruns de debate e sensibilização da sociedade global, como é o caso da Resolução 1325 publicada pelo Conselho de Segurança das Nações Unidas, em 2000. Todos estes processos têm vindo a revelar a importância da promoção da igualdade de género em todas as fases dos processos de (re)construção da paz e da promoção da segurança, incluindo em países como a Guiné-Bissau; ABSTRACT: "The role of women in the peacekeeping processes. The case of Guinea-Bissau" In the last few decades we have witnessed a breakthrough of feminist studies, which have brought relevant contributions to ensure integration (of women to the politics discussion) and gender equality in various areas, what revealed to be an innovative and dynamic chain to improve the analysis, study and comprehension of the gender matters particularly peace vs. conflict subjects (issues). Until this and for many years, issues related to Women and Peace were not a priority and weren't grounds for discussion of international politics which allowed that all the atrocities committed against women remain covered to the eyes and judgement of the International community. From the last few years to now on we can observe how women start to play a more influential and active role in what concern to the development of peacemaking (and peacekeeping) processes. Such evolution has been motivated by different worldwide initiatives and contributions, followed by the development of important documents, promotion of discussions and the awareness of global society forums, such as the 1325 resolution, published by the Security Council of the United Nations in 2000. All these actions (processes) revealed the importance of promoting gender equality in all phases of the (re)construction of peace and the improvement of women rights and safety, including in countries such as Guinea-Bissau.
In order to deal with the institutionalization process of initial and continuing education politics of Basic and Higher Education teachers, starting from the management and curricular politics in the degree programs, the article sociologically problematizes the conflicts and curricular episodes of the historical and contextual trajectory that configures the period of 1996 to 2018 in Brazil, through the analysis of reference educational documents that materialize curriculum expressions. In the sequence, it debates propositions, tensions and resistances perceived in the constitution process of the state politic of teacher formation in Paraná, taking as a curricular-historical clipping Resolution CNE / CP nº 02/2015, make interface by the collective alternatives of pedagogical management presented by Progrades ( Permanent Forum of IEES / PR Graduation Pro-rectors). As one of the results of the postdoctoral probation, this qualitative research, both bibliographical and documentary, starts from the reflections of curriculum as a contest field, based on the Pierre Bourdieu contributions. ; Para hacer referencia al proceso de institucionalización de la política de formación inicial y continuada de profesores de la Educación Básica y Superior, a partir de la gestión y de las políticas curriculares en las carreras de profesorado, el artículo problematiza sociológicamente las tensiones y los marcos curriculares de la trayectoria histórico-contextual que configura el período de 1996 a 2018 en Brasil, permeando por el análisis de documentos educacionales de referencia que materializan expresiones de currículo. A continuación, debate proposiciones, tensiones y resistencias percibidas en el proceso de constitución de la política estadual/provincial de formación docente en Paraná, tomando como recorte histórico-curricular la "Resolução CNE/CP nº 02/2015", interfacetada por las alternativas colectivas de gestión pedagógica presentadas por el Progrades (Fórum Permanente dos Pró-reitores de Graduação das IEES/PR).
