학위논문 (석사)-- 서울대학교 대학원 : 행정학과(정책학전공), 2012. 2. 금현섭. ; 본 연구는 국회 법안 심사 소위원회를 분석대상으로 삼아, 국회의 법안 심의가 어떠한 행태를 기반으로 이루어지는지 살펴보았다. 최근의 국회 의사결정에 관한 연구가 대부분 상임위원회 위주였기에 실질적인 법안심의 과정을 살펴보기 힘들다는 한계를 극복하기 위해 500쪽 가량의 소위원회 회의록을 Atlas.ti 프로그램을 이용한 분석을 통해 의원들의 행태를 파악하였다. 법률안 통과에 있어 비교적 큰 차이를 보이고 있는 보건복지위원회와 산업자원위원회를 분석대상으로 삼았는데, 분석결과 두 위원회의 행태적 차이는 예상과는 다르게 크지 않았다. 두 위원회 모두 전문성 범주가 압도적으로 많았으며, 대표성, 타협성, 당파성의 행태로 의사결정의 특징이 나타나 전반적인 차이는 존재하지 않았지만 보건복지위원회는 전문성과 당파성이 상대적으로 높았으며, 산업자원위원회는 대표성과 타협성이 상대적으로 높은 것으로 나타났다. 이러한 분석은 의회의 위원회 의사결정이 정당의 이익을 대변하기 위한 것이라는 정당이익이론과 의원 본인의 정치적 자산을 취득하기 위한 것이라는 이익분배이론과는 조금 다른 결과로 상임위원회라는 회의체가 본회의에 대한 정보제공을 목적으로 이루어지기 때문에 의원들의 의사결정 행태의 바탕이 전문성이라는 정보가설이론이 본 연구에서는 크게 지지되었다. 그리고 이와 같은 행태가 법률안의 의사결정에는 어떠한 영향을 미치는지 실증분석을 통해 살펴본 결과 당파성과 대표성은 법률안의 의결에 부정적인(-) 영향을 미쳤으며, 전문성은 긍정적인(+) 영향을 미치는 것으로 나타났다. 하위범주별로 로짓분석을 수행했을 때, 통계적으로 유의미한 결과가 나온 것은 정부의 정책에 대한 비판과 반대가 높을 때 의사결정이 이루어지지 않는다는 것이다. 의원들은 강한 비판과 반대를 통해 정부를 압박하지만 정부측에서 이를 수용하지 않을 경우, 의안의 의결은 대부분 이루어지지 않았다. 이는 법안 심의에 있어서도 정부의 영향력은 사실상 막강하다는 것을 보여주는 것으로 의원들이 심의하고 결정하는 회의체라 할지라도 실제 집행을 담당하는 정부의 동의 없이는 의안의 통과는 어려웠다. 또한 위원회별로 각 행태요인의 특성이 있는지 상호작용 효과에 관한 분석을 실시하였으나 통계적으로 유의미한 차이는 도출되지 않았다. 결국 의원들의 행태적 특성이 상임위원회가 다루는 정책의 내용에 따라 크게 달라지지 않았다는 것이다. 하지만, 의안 심의에 있어 산업자원위원회보다 보건복지위원회가 훨씬 더 활발한 회의를 진행하고 있었으며, 한 의안에 대한 심의기간과 질의 빈도가 훨씬 높은 것은 확인하였고, 한 의안에 대한 심의기간이 길기 때문에 상대적으로 다루는 의안수가 적을 수밖에 없는 것도 확인할 수 있었다. 결론적으로 17대 국회 법안심의 의사결정이 소위원회 중심으로 이루어지는 것을 확인할 수 있었으며, 일반적인 법안심의에 있어서는 당파성보다 전문성이 훨씬 많이 나타나고 있으며 행정부의 영향이 실제적으로는 크게 미치고 있는 것으로 나타났다. ; This study has investigated the behavioral basis for the congressional deliberation of bills, targeting the congressional subcommittee for the deliberation of bills. In order to overcome the limit in investigating the process of practical deliberation of bills because most recent studies on the congressional decision-making was based on the National Assembly Standing Committee, about 500-page minute of the subcommittee was analyzed using Atlas.ti program and then the behaviors of the members of the National Assembly were investigated. The Health and Welfare Committee and the Industry Advisory Committee were targeted because of comparatively large difference in the passage of the bills between them. As a result of the analysis, the behavioral difference between them were not so different from the expectation. Both committees had overwhelmingly large amount of professional categories, and the attributes of their decision-making appeared as the behaviors of representativeness, compromise, and partiality. Thus, there was no difference in general, but the professionalism and the partiality of the Health and Welfare Committee, and the representativeness and the comprise of the Industry Advisory Committee appeared relatively high. This analysis was slight different from the theory of party's interest, 'the decision-making by the committee represents the party's interest', and the theory of interest distribution, 'the decision-making by the committee is for the member to acquire their own political asset'. Because, the board aims to provide the information for the full-dress session, the theory of information hypothesis, 'the behaviors of the congressmen are based on the professionalism' was greatly supported in this study. And then, as a result of an empirical analysis for investigating how these behaviors influenced the decision-making on the bills, the partiality and the representativeness had a negative effect and the professionalism had a positive effect on the vote for the bills. The statistically significant result was produced when a logit analysis by subcategory was conducted. This implies that the decision is difficult to be made when the criticism and the opposition to the government is strong. When observing the minute of subcommittees, the administrators from the government are likely participated in the subcommittee as attendees not as doers, but they, in general, are more influential than the members. The members of the national assembly oppressed the government through powerful criticism and opposition. However, if the government did not accommodate these criticism and opposition, in most cases, the vote for the bills were not materialized. This implies that the government has an enormous effect on the deliberation of bills. In fact, the passage of the bills was difficult without an agreement by the government in charge of practical implementation, even though the members deliberate and decide in the board. In addition, an analysis of the effect of interaction was conducted to find out whether there were some attributes of each behavioral factors, but no statistically significant difference has been derived. Resultingly, the behavioral attributes of the member did not significantly vary in accordance with the contents of the policies being dealt by the standing committees. However, it was identified that in respect of the deliberation of bills, than the Industry Advisory Committee, the Health and Welfare Committee were proceeding meetings more actively, the deliberation period was longer and the quality of the deliberation were hight and the number of the bills dealt with was comparatively smaller, due to it's long period for the deliberation of bills. In conclusion, it was identified that the decision-making on the bills at the 17th National Assembly was centered on the subcommittees, and in respect of the deliberation of general bills, the professionalism appeared more often than the partiality, and the administration was significantly influential to that. ; Master

스위스를 가리켜 다양성(diversity) 그 자체라고 정의하는 이유는 다양한 통치조직 뿐 아니라 다양한 언어와 종교, 그리고 문화를 수용하고 심지어 현재에는 전체 인구의 20%가 외국인으로 구성된 "의지에 의한 국가 (willensnation 또는 nation by will)"이기 때문이다. 이러한 독특한 의지는 스위스 헌법에 명확하게 명시되어 있다. 그렇다면 스위스 사회상에 내포된 문화적 다양성이 스위스 헌법 조문에 명기되어 있기 때문에 스위스의 다문화주의가 그에 상응하는 정치적 영향력을 가지는가? 아니면 헌법 조문에 명기되어 있음에도 불구하고 소수 집단을 규정하지 않는다는 한계를 연방 법제도와 정당제를 통해 실질적으로 극복하려는 정치적 의지가 있기 때문에 결과적으로 다문화주의의 정치적 영향력이 생성되는가? 본 논문은 이러한 논제에 답하기 위해 헌법 조문에서 명시된 또는 명시되지 않은 다양성을 연방국가 간 비교하면서 문화적 다양성을 설명하는 이론적 틀을 이해한 후 스위스가 원론적으로 문화적 다양성을 수용하면서도 다문화사회의 소수 집단 구성원들을 명확하게 규정하지 않는 현실적 괴리를 법제도와 정당제를 통해 보완하고 있음을 분석하여 스위스 다문화주의의 도면을 그려내고자 한다. ; The modern Switzerland appears well integrated such that Swiss polity is often dubbed as the embodiment of diversity. Switzerland is indeed the "willensnation" or the "nation by will" precisely because it embraces the peculiar multiplicities of government machineries, languages, creeds, and cultures. Even foreigners make up about 20 percent of Swiss population. This unique will is expressed in the Federal Constitution of the Swiss Confederation. Then, is cultural diversity politically valid in accordance with its constitutional specification? Or, is multiculturalism turned into a central pillar of nationhood because Switzerland manages to surmount the limits of the constitutional silence on the conception of the minority with the legal-institutional federalism and party system? 학위논문 (박사) -- 서울대학교 대학원 : 법학전문대학원 법학과, 2020. 8. 전종익. ; 우리나라의 제9차 개정헌법인 현행 헌법으로의 개정이 이루어진 지 만 32년이 지난 지금, 당시 헌법개정을 둘러싼 논의가 어떠한 과정을 통해 이루어지고 그것이 어떻게 지금 우리에게 적용되고 있는 헌법규정들을 낳았는지를 구체적으로 확인하는 일은, 그 해석을 위한 자료를 제공할 수 있을 뿐 아니라 그 양상에 대한 평가를 통해 현행 헌법 그 자체에 대한 평가를 보충할 수 있을 것으로 기대된다. 그리하여 이 연구는 최근까지 나온 사료들을 가급적 망라하여 개별 헌법규정들의 개정논의 과정을 재구성하고 그 부문별 양상을 고찰함으로써 개정의 의미내용에 대한 평가를 시도한다. 새로운 헌법에 대한 필요는 유신헌법에 이어 국민의 의사와 국가권력의 성립·유지가 괴리되어 있었던 1980년 헌정체제의 성격으로부터 제기되었다. 그러나 기존 헌법상의 절차에 따른 개헌은 종전 집권세력과의 공존을 수반하는 것이었기 때문에, 헌법문제의 해결을 위한 대안으로 처음부터 대통령직선제 개헌이라는 방편에 대한 사회적 합의가 이루어지지는 못하였다. 직선제를 향한 요구와 그에 대한 수용으로 그에 대해 여야뿐만 아니라 범사회적인 합의가 이루어지는 것은, 전두환 정권과 그에 대한 저항세력 모두 기본적인 정치체제에 대한 여타의 대안을 각자 제시하고 그 모두를 서로 받아들일 수 없음이 분명해진 뒤에 비로소 가능했다. 여야 정당들과 기타의 사회주체들 모두 개헌시안을 마련함에 있어서 시민사회의 요구를 광범위하게 반영하는 구체적인 구상을 제시하지 못하였고, 그보다는 종전의 구상들을 답습하거나 임시방편적으로 수용하는 경향을 보였다는 점을 확인한다. 이는 양대 정당의 경우 정권의 획득이나 유지가 보다 중요했기 때문이라고 볼 수도 있다. 하지만 보다 근본적인 관점에서 이는 강력한 물리력을 배경으로 정부가 국민의 자유의사에 따른 개헌을 가로막는 한 아무리 구체적으로 개헌구상을 입안하더라도 그것이 현실화할 전망이 없기 떄문이기도 하였다. 연구의 후반부를 이루는 각 헌법 부문별 논의 과정은 1987년 초반부터 야당뿐 아니라 저항세력 전반에까지 수렴된 대통령직선제 개헌이라는 대안이 정부와의 극한대립 끝에 6. 29 선언을 통한 수용으로써 합의로 넘어간 당시의 상황을 반영한다. 헌법의 기본성격, 그리고 헌법을 통해 보호해야 할 영역을 획정하는 것으로서 정치제도 못지않은 중요성을 지니는 전문과 기본권에 대하여는 양대 정당의 의견이 서로 과정과 내용의 면에서 모두 대체로 대등한 수준에서 반영되었다. 특히 전문에 관한 양대 정당의 논의는 양자의 어느 쪽도 정치적 우위를 점하지 못하고 중립적인 타협을 이룬 새 헌법의 성격을 잘 보여준다. 한편 정치제도에 관하여는 국회해산권의 폐지나 국회의 일부 권한에 관하여 치열한 논쟁이 벌어지기도 하였지만, 결국 국회의 국정감사권과 헌법소원제도가 헌법상 규정된 등의 몇몇 성과를 논외로 하면 전반적인 수준에서 국회나 정부의 지위에 대한 변혁이 이루어졌다고 보기는 어려운 것으로 평가된다. 이와 같은 개헌논의의 결과에 대하여는 기성의 양대 정당이 정권획득을 둘러싼 경쟁질서에만 관심을 가졌기 때문에 급속하고 불충분한 타협만이 이루어졌다는 평가도 가능할 것이나 다른 한편 현행 헌법은 이로써 이후의 정권교체에 불구하고 안정성을 확보할 수 있었다. 이는 국민의 선택에 따라 정치적 책임을 지는 집권세력이 국민의 기본권으로부터 통제되는 헌법으로서의 규범력이 강화된 만큼, 종전의 헌정체제들과 달리 현행의 체제에서는 국민의 책임성 또한 강화되었음을 간과해서는 안 될 것이다. ; 32 years have passed since the 9th revision to the current Constitution in 1987. The author deems the time ripe enough to say that now we give a careful look into how this Constitution was deliberated in what process, and how it led to the provisions that apply to our lives today. Hopefully it can provide new grounds for interpretation thereof, as well as tools to supplement previous evaluations on the Constitution at large, with retrospect to the general trends of the discussion. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. The pattern of constitutional provisions largely attests to this. The preamble, initially a symbolic battlefield of political powers, was diluted to signify more neutral values. Discussion on fundamental rights was, with a few exceptions where major political interests were involved, a relatively smooth interchange of mutual suggestions, which led to an accommodation at least to the most urgent needs raised in the Chun regime. As for political institutions, the most urgent questions were tacitly solved as the plans of both parties accorded to each other. Thus relatively residual needs were answered in the course of negotiation, which led to a few institutional progress including parliamentary power to inspect the government and the newly devised jurisdiction for constitutional complaint. But aside from those, neither legislative or administrative power can be said to have been subject to thorough change. Some might, with good reason, conclude from the results of the negotiation that the existing major parties were concerned only for their upcoming struggle for power and thus made haste for an insufficient outcome. But on the other side, this course of revision led the Constitution to become stable in spite of periodic interchange of power between the political factions. This enabled people to compare the performances between the factions under largely static insitutional settings, and then choose between them to hold the worse one politically responsible. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. The pattern of constitutional provisions largely attests to this. The preamble, initially a symbolic battlefield of political powers, was diluted to signify more neutral values. Discussion on fundamental rights was, with a few exceptions where major political interests were involved, a relatively smooth interchange of mutual suggestions, which led to an accommodation at least to the most urgent needs raised in the Chun regime. As for political institutions, the most urgent questions were tacitly solved as the plans of both parties accorded to each other. Thus relatively residual needs were answered in the course of negotiation, which led to a few institutional progress including parliamentary power to inspect the government and the newly devised jurisdiction for constitutional complaint. But aside from those, neither legislative or administrative power can be said to have been subject to thorough change. Some might, with good reason, conclude from the results of the negotiation that the existing major parties were concerned only for their upcoming struggle for power and thus made haste for an insufficient outcome. But on the other side, this course of revision led the Constitution to become stable in spite of periodic interchange of power between the political factions. This enabled people to compare the performances between the factions under largely static insitutional settings, and then choose between them to hold the worse one politically responsible. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과(행정학전공), 2012. 2. 정광호. ; 사회가 민주화되고 가치가 분화됨에 따라 각종 국책사업을 둘러싼 공공갈등이 심화되고 있다. 단순한 이익갈등뿐만 아니라 가치갈등 또는 복합갈등이 빈번하게 발생하고 있으며, 갈등범위도 전국적으로 확대되고 있다. 본 연구는 국책사업 중에서 '세종시 수정안'을 사례로 선정하여 정책결정 과정을 둘러싼 갈등에 대해 분석하고자 하였다. 특히 세종시 수정안 정책결정을 둘러싼 갈등의 배경과 성격은 무엇이고, 그 갈등을 관리 또는 해결하기 위해 정부에서 선택한 의사결정 방안이 적정하였는지 등을 참여적 의사결정 하의 갈등관리시스템의 틀로 분석하였다. 이를 통해 향후 세종시 수정안 추진과 유사한 대형국책사업 추진에 있어서의 성공적인 갈등관리를 위한 시사점을 도출할 수 있을 것으로 기대하였다. 제1장에서는 연구의 목적과 필요성, 연구의 대상과 범위에 대해서 설명하고 연구에서 사용한 사례연구방법과 자료수집방법에 대해 밝혔다. 제2장에서는 공공갈등의 개념과 유형 등 이론적 논의를 한 후, 참여적 의사결정이론을 소개하였다. 이러한 이론적 배경과 선행연구 등을 바탕으로 연구의 분석틀을 설정하였다. 제3장에서는 세종시 수정안 갈등의 발생배경과 갈등의 성격, 갈등의 쟁점과 이해관계자 분석, 갈등시기별 전개과정 등을 살펴보았다. 제4장에서는 연구의 분석틀에 따라 참여적 의사결정 요인과 정치 환경 요인에 따라 세종시 수정안 사례를 분석하였다. 주요 분석결과를 요약하면 다음과 같다. 우선 참여적 의사결정 요인에 따른 분석결과, 세종시 수정안 사례는 전반적으로 참여적 의사결정 방법에 의한 갈등관리가 미흡하였다고 평가할 수 있다. 첫째, '여론수렴 및 정보제공'이 미흡한 것으로 나타났다. 초기부터 여론수렴 및 정보제공 보다는 정부주도의 일방향적인 의사결정 추진 및 설득에 치중함으로써 갈등관리에 부정적인 영향을 미쳤다고 볼 수 있다. 둘째, '참여적 의사결정 활용' 측면 또한 미흡한 것으로 나타났다. 관련분야의 학식과 경험이 풍부한 전문가들을 민간위원으로 포함시켜 '세종시 민관합동위원회'를 구성ㆍ운영하였으나, 인적구성에서 찬성의견과 반대의견에 대한 균형을 이루지 못하여 활동결과에 대한 신뢰도를 저하시키는 원인이 되었다. 셋째, '협력규칙의 적용 여부'를 살펴보면, 우선 참여규칙, 분해규칙 적용 측면에서 미흡하였다. 그리고 자원확대규칙 측면에서는 원안보다 큰 경제적 보상이라는 인센티브를 제공하였으나, 이해관계자들에게 정치적 신뢰를 얻지 못함으로써 큰 효과를 발휘하지 못하였다. 마지막으로 '결과의 공개 및 정책에의 반영 여부' 측면에서 볼 때, '세종시 발전방안'을 언론 브리핑 형태로 발표함으로써 결정결과의 공개 자체는 투명하게 이루어졌다고 할 수 있으나, 수정안 마련 과정이나 발표 이후 국민의견수렴 절차를 거치는 과정은 미흡했다고 볼 수 있다. 정치환경 요인에 따른 분석결과는 다음과 같다. 우선, 여당내 대통령의 리더십이 수정안 찬성집단과 반대집단으로 분절된 결과, 정책의제 설정 및 정책결정과정의 추진력이 약화되었다. 둘째, 야당이 타협의 의사 없이 세종시 수정 추진에 무조건 반대하는 방식으로 진행되어 갈등이 증폭되었다. 셋째, 핵심 어젠다 제기의 정치적 타이밍과 관련, 5년 단임제의 특성을 고려할 때 집권 2년이 다 되어 갈 무렵 세종시 수정이라는 어젠다가 공식 제기됨으로써 유리한 타이밍을 놓쳤다고 볼 수 있다. 이와 같이 불리한 환경적 요인들은 참여적 의사결정에 의한 갈등관리에 부정적인 제약요인으로 작용하였다고 볼 수 있다. 제5장에서는 이와 같은 연구결과를 요약하고, 다음과 같은 시사점을 도출하였다. 첫째, 갈등과 갈등 당사자의 특성, 갈등이슈 유형 등에 따라서 갈등관리방식의 선택 또한 달라져야 한다는 것이다. 특히, 극단적인 대립과 갈등이 예상되고 그 파급효과가 매우 큰 세종시 수정안과 같은 사례일수록, 사전에 갈등영향분석 등을 통해 갈등의 요인을 사전예측ㆍ분석하여 관리대책을 마련하고, 정책의제설정 및 정책결정과정에서 참여적 의사결정 수단의 적극적인 활용이 필요하다고 볼 수 있다. 둘째, 정책대상집단과 이해관계자에 대한 사회적 인식(social construction of target populations)에 따라 갈등관리의 구체적인 수단 또한 달라져야 한다는 점을 알 수 있다. 따라서 향후 유사한 갈등사례에 있어서 정부의 갈등관리 전략 마련시 대상집단에 대한 사회적 인식에 대한 관심을 바탕으로 유ㆍ무형의 인센티브를 적절히 활용하는 것이 필요하다고 할 수 있다. 셋째, 참여적 의사결정기법 활용을 위한 구체적인 법적ㆍ제도적 장치 마련이다. 세종시 수정안 사례에서 전반적으로 참여적 의사결정방법의 구체적인 수단 활용이 미흡했던 것은 이러한 방안을 준비하고 실행할 수 있는 제도적 뒷받침이 부족했던 점에서도 그 원인을 찾을 수 있다. ; As society is democratized and the value is divided, public conflict surrounding the various national projects is growing. Value conflicts or compound conflicts, as well as simple interest conflicts occur frequently, and conflict is expanding nationwide scope. This study selected the case of amendment of Sejong city among various national projects as a case study, and tried to analyze conflict over the decision-making process of the case. Especially, this analyzed over the background and characteristic of conflict on the amendment of Sejong city, and appropriateness of the system of conflict management selected by the government in order to manage or solve the conflict through the frame of conflict management system under participative decision-making. This promotion is similar to the amendment during the next three kinds of large national projects in promoting the success of the implications for conflict management was expected to be drawn. Through this study, it is expected to reach to an implication for the successful conflict management on the similar case of the amendment of Sejong city. Chapter 1 explains the purpose, necessity, range and target of the research, and it defines a method of case study as well as the method of collecting data that are used for the case study. Chapter 2 explains the theory of participative decision making after introducing a theoretical review such as concept and kinds of public conflict, and establishes a framework of the study by referencing previous studies. Chapter 3 reviews the background and nature of conflict on the amendment of Sejong city, conflict issues and stakeholders, and development process of conflict. Chapter 4 analyzes the case by the factors of participative decision making and the political-environmental factors through the framework. The summary of main analysis is as follows: First of all, the case of amendment of Sejong city can be evaluated that the conflict management through participative decision making is insufficient, as a result of analysis by the factors of participative decision making. First, the 'collection of public opinion and provision of information' was insufficient. From the beginning, the government focused on a one-way decision-making and persuasion rather than collection of public opinion and provision of information, and it negatively influenced on conflict management. Second, the 'use of participative decision-making' was also insufficient. Even though various experts participated in the Sejong city committee, the composition was biased. Therefore it was one of the main cause of declining the reliability of the results. Third, 'participating rule' and 'factoring rule' were not sufficiently utilized. In terms of 'resource expanding rule', the government suggested more incentive of amendment plan than one of original plan, but it was not effective because of distrust of the government. Finally, in terms of announcement of the result and feedback of policy', amendment of Sejong city was openly publicized through giving a briefing. However the process of collecting extensive opinions was insufficient. The result of analysis by means of political-environment factor is as follows: First, the leadership of President was divided into supporting groups and opposition groups. Therefore the momentum of agenda-setting and policy-making was weakened. Second, the opposition party opposed to the amendment of Sejoing city without any condition. Third, the political timing of agenda-setting was not timely. The government missed the advantageous timing because the agenda was proposed during second year of a 5-year term of presidency. These adverse environmental factors negatively effected on conflict management of participative decision making. Chapter 5 summarizes the results of these studies, and the following implications were drawn. First, the method of conflict management should be selected according to the nature of conflict and the conflict parties, conflict type of issue. In particular, when the extreme conflict is anticipated and the result of the policy is wide, the government should pre-establish measures of conflict management through conflict effect analysis, and participative decision making should be actively utilized. Second, the specific means of conflict management should be selected by social construction of target populations. Third, the government should prepare the specific legal and institutional means for the use of participative decision making. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 박찬욱. ; 본 연구는 1970년대 이후 미국의 통상정책 결정과정에서 주된 절차적 기제로 작용해온 신속처리절차(Fast-track procedures)가 2002년 무역법을 통해 무역증진권한(Trade Promotion Authority; TPA)으로 재입법되는 과정의 동학을 의회-행정부 관계를 중심으로 설명하는 것을 목적으로 한다. 신속처리절차는 대통령이 비관세장벽 관련 내용이 포함된 무역협정을 체결하고 이행법안을 의회에 제출하면 양원은 수정안 제출 없이 가부만을 결정해서 90일내에 처리해야 한다는 규정으로 1974년 무역법에서 처음 도입된 이래 30년 간 미국의 무역정책결정과정에서 중요한 위치를 차지해왔다. 하지만 자유무역정책에 대한 양당의 합의가 약해지면서 1994년 만료되었고, 2002년 8월 6일 부시 대통령이 법안에 서명을 하면서 8년 만에 통상정책결정과정에 다시 등장했다. 그렇다면 어떠한 맥락에서 클린턴 행정부 시기에는 부결되었던 연장 법안이 부시 행정부 때는 성공할 수 있었을까? 기존의 연구들은 1997년과 2001년 표결 분석을 통해 의원 차원에서 이익집단ㆍ유권자들과의 관계, 정당 차원에서 단점정부를 그 요인으로 지적한다. 하지만 입법과정에서 의회의 행태는 의원 개인, 정당 두 차원 외에도 행정부와의 관계에서 입법부로서의 의회를 강화하고자 하는 유인의 영향을 받는데 본 논문은 마지막 차원에 주목한 설명을 제시하고자 한다. 즉 의회는 국내외 경제적 상황, 유권자와 이익집단에 대한 고려, 행정부 등 다양한 요구에 대응하는 과정에서 입법부로서의 지위 강화를 위해 행정부와의 관계에서 개입을 증대하는 동시에 실패했을 경우에 부담해야 하는 비난, 지지기반의 이탈과 같은 손실을 최소화하는 방향으로 정책을 입안하려고 했고, 그 결과로 2002년에 무역증진권한이 다시 입법되었다는 것을 보이고자 한다. 입법 과정을 보면 초기에는 기존 연구 결과에서 나타나듯 의원 개인의 차원에서는 재선을 위해 유권자와 이익집단을 고려했고 정당 차원에서는 다수당이 되려는 선거 정치에 대한 고려와 이익집단과의 관계에서 통과와 저지의 공을 주장하려는 의도에서 정당 간 대립이 나타나기도 했다. 하지만 입법과정이 본격화되고 상원에서 안데스 산맥 국가들에 대한 무역특혜협정, 무역조정지원과 포괄법안의 형태로 입법되는 것으로 논의되면서 양당의 지도부는 의회가 미국의 전반적인 무역정책의 수립에 어떻게 개입해야 하는가에 대한 고민을 시작했다. 의회는 무역개방이 필요하다는 방향성에는 전반적으로 동의하고 있었고 WTO Doha Round가 임박해오고 있는 상황에서 행정부에 권한을 위임하지 않았다가 미국의 무역과 경제 상황이 악화된다면 그에 대한 책임을 온전히 부담해야 하기 때문에 무역증진권한의 입법을 통해 책임을 공유할 필요가 있었다. 이 경우 직접적인 권한 행사 주체는 행정부이기 때문에 실패했을 때는 행정부에 책임을 전가할 수 있는데다 권한의 위임범위와 재량권을 더욱 축소하고 적극적으로 개입해 무역 정책을 수립할 수 있기 때문에 의회의 입장에서는 결과에 대한 직접적인 책임을 회피할 수 있다. 동시에 절차의 적용 요건을 강화하고 감독기구를 늘리고 등의 조치를 통해 협상과정에 의회가 능동적으로 개입할 수 있는 통로를 확대하고, 행정부가 의회의 의사와 반하는 협상을 할 여지를 줄이기 위해 재량의 범위를 제한했다. 하지만 2002년 무역법에서 의회의 무역정책수립에 대한 적극적인 개입 의지가 가장 강하게 드러난 부분은 주도적으로 무역개방으로 인해 피해를 입은 부문에 대한 보상정책을 수립했다는 점이다. 무역조정지원에서 규정한 정책들은 분배정책적인 특성으로 인해 수혜자들에게 공을 주장하기는 쉽지만 비난을 받거나 실패할 확률은 낮기 때문에 의회의 입장에서는 헌법상 수임기관으로서 무역정책을 적극적으로 수립하는 의무를 다하고 있다고 주장하기에 효과적인 조치였다. 의회는 이처럼 무역조정지원 법안을 통해 적극적으로 개입해 직접 무역정책을 수립하고 무역협정체결과정에서 개입을 증대하는 동시에 권한을 위임하지 않았을 경우 WTO Doha Round에서 미국의 협상지위 약화로 미국의 무역과 경제 상황이 악화될 수 있다는 우려 때문에 개입의 정도를 자제하고 행정부에 직접적인 무역협정체결권한을 위임하는 내용의 무역증진권한을 입법한 것이다. ; The purpose of this study is to analyze the dynamics of legislating the Trade Act of 2002 which granted Trade Promotion Authority, previously called fast-track negotiating authority, to the President of the United States focusing on the relations between the executive and Congress. Fast-track procedures were set forth in the Trade Act of 1974, stipulating that once the president formally submits a bill implementing a trade agreement concerning non-tariff barriers, both houses must vote on the bill without any amendments or filibusters. Being continuously in effect for 30 years, they have acted as a principal procedural mechanism for enacting trade agreements since 1970's. As the bipartisan consensus on free trade was eroded by the emergence of social issues like labor and environment in trade talks, however, they expired in 1994 due to failure to reach an agreement on how these issues should be handled. In 2002, a long and enthusiastic debate in both houses finally ended and the procedures were restored after a 8-year hiatus during the Bush presidency. If that is the case, in what circumstances was it possible for president Bush to regain the authority that president Clinton failed to win? The existing studies which conducted a comparative analysis on the roll-call voting that took place in 1997 and 2001 pointed out that representatives' consideration of constituents including pressure from interest groups and divided government had a noticeable effect in the different consequences. But besides these two, the respective members and party, a motive to reinforce the legislative branch as an institution has a impact on the behavior of Congress. This study aims to propose an explanation focusing on the third dimension from a view of interbranch politics. Then, responding to both domestic and international economic condition, demand from interest groups and constituents, and request from the executive branch, Congress approved the measure as a consequence of reflecting the intention to improve its status by increasing engagement with the process of decision making in the executive branch and minimize the loss such as the blame from the public or decrease in support accompanying failure of certain policy at the same time. In the early stage of legislation congressmen's consideration of constituents for winning reelection and partisan rivalry prevailed as other studies predicted. But as the actual legislative process progressed, the situation changed. With the Senate Democrats insisting on enactment of the omnibus trade bill incorporating TPA and two other bills, Andean Trade Preference Act and Trade Adjustment Assistance, concern over how Congress should engage with the establishment of generic trade policy spread throughout the party leaders. Congress agreed with the executive branch on the need of trade expansion and delegating the power to negotiate trade agreements for imminent WTO Doha Round because it would make them share the responsibility for possible deterioration in economy and trade in the future. The fact that the direct agent of exerting the authority was the executive branch had Congress make up its leeway as it could shift all the blame onto the other branch. Furthermore, when the economy got worse Congress could curtail the limit of the delegation and discretionary power given to the executive and establish trade policy firsthand. Delegating the authority, Congress expanded the means to actively involve in negotiating process by reinforcing its role of oversight, downsizing the discretionary power to prevent the executive from concluding the agreement despite congressional opposition, and tightening up the conditions to meet for the application of the fast-track procedures. But the most impressive part of the Trade Act of 2002 is TAA which reflected Congress's intension to play a leading role in making compensation policy for the people who got injured by trade. In conclusion, a broad agreement that TPA should be extended spread over Congress as it would consolidate the firm standing of the United States in trade talks including the upcoming WTO Doha Round. Moreover, Congress did not want to take full responsibilities or blame for the potential deteriorating economy. But at the same time Congress wanted to increase its engagement with trade policy making with the authority originally given to it by Constitution and its grown capabilities. The effort to restore the fast-track negotiating authority; TPA during the Bush presidency was feasible as it was linked to TAA bill, a measure taken by Congress to expand its involvement in trade policy making, and some steps to increase its engagement with the process of negotiation were taken. In other words, the Trade Act of 2002 was legislated as a result of Congress' struggle to balance between two motives, desire to avoid blame and increase its engagement with policy making. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 외교학과, 2012. 2. 신욱희. ; 본 연구는 구조적 환경과 행위자의 선택, 그리고 구조와 선택을 매개한 정책결정자의 인식의 상호작용을 통해 1960년대 중반 북한 자주외교노선의 결정요인을 분석하고자 한다. 정권수립 이후 북한은 동아시아에 형성된 냉전 구조 속에서 사회주의 대국이었던 소련과 중국에게 편승함으로써 상대적으로 "밖"의 문제보다 "안"의 문제에 집중할 수 있었다. 김일성은 경쟁세력을 차례로 숙청하며 권력을 집중화할 수 있었고, 단일지도체제를 구축할 수 있었다. 하지만 김일성은 1956년 소련공산당 제20차 대회 이후 전개된 흐루시초프의 신노선에 소극적으로 대응하였고, 이에 정권의 중심에서 밀려나 있던 소련파와 연안파의 불만을 촉진시켰다. 김일성에 대한 개인숭배 심화와 당 지도부의 경제, 인사 정책에 불만을 가졌던 경쟁 세력은 외부의 힘을 이용하여 당의 노선 변화를 도모하고자 하였고, 이러한 계획은 1956년 8월 전원회의를 통해 현실화되었다. 하지만 사전에 계획을 인지하고 있었던 김일성의 방해로 인해 연안파와 소련파의 계획은 실패하였고, 주도자들은 종파주의자로 낙인 찍혀 대규모 숙청의 대상이 되었다. 하지만 김일성의 과도한 권력집중을 일탈로 우려한 소련과 중국은 미코얀과 펑더화이를 파견하여 북한의 내정에 간섭하였다. 이로써 김일성의 반(反)대국주의 의식은 심화되었고, 이후 중소분쟁이 본격적으로 시작하면서 국내정치에서 외부의 힘을 제거하고 단일지도체제를 구축하였다. 1960년대가 시작되면서 중국과 소련의 갈등은 이념적 차원을 넘어 정책적 차원으로 확대되었으며 북한은 국내외의 문제에 사로잡힌 양국의 관심에서 벗어나 본격적으로 대외관계를 주도할 수 있었다. 이전까지 북한의 대외관계는 소련과 중국의 압도적인 영향력 아래 있었지만 상호방위조약을 통해 양국과 대등한 관계를 형성함은 물론 제3세계 국가들과의 대외관계를 적극적으로 확대하면서 자주외교노선의 기틀을 마련하였다. 소련공산당 20차 대회와 중소분쟁으로 이어지는 사회주의 진영의 구조적 환경의 변화 속에서 김일성을 비롯한 당 지도부는 역사적으로 형성된 반(反)대국주의 인식으로 인해 어느 한 국가에 대한 일방적인 편승을 배제한 채 1960년대 중반 대외적으로 자주외교노선을 공식화할 수 있었다. ; The purpose of this paper is to analyse North Korea's foreign policy, called the self-reliance foreign policy, which was implemented in the mid-1960s. Among the various factors that can influence foreign policy, this paper concentrates on the interaction of structure, decision maker's intention, and perception or values according to Carlsnaes' dynamic model of analysing foreign policy change. After nation building, there have been two critical structural diversions in the Communist bloc—the Twentieth Party Congress of the CPUS in February 1956 and the Sino-Soviet conflict that began in the late 1950s. In each event, Kim Il-sung attempted to increase DPRK's policy-making autonomy and exclude the political leverage of two brotherhood countries, Soviet and China, in the domestic politics. Kim's strong anti-great power chauvinism was strengthened from his past experiences, and it was reinforced by two countries' intervention in 1956. These two primary elements had influenced Kim Il-sung's foreign policy decision making during his reign. In the late 1950s, Kim and his partisans concluded the intra-party conflict with two rival groups, the Soviet Korean and Yan'an groups. These events completely monopolized power in domestic politics. As the dispute between China and Soviet aggravated in the 1960s, North Korea could secure its policy-making autonomy from these two countries. It had become more equal that North Korea extended its diplomatic relations to the Third World nations in this period. On the basis of the consecutive policies, North Korea could implement the self-reliance foreign policy in around 1965. ; Master

1947년 일본헌법과 더불어 제정된 지방자치법은 중앙정부로부터 독자적 직접선거를 통한 입법부와 행정부 선출을 명시하며 일본의 중앙-지방관계를 규정한다. 특히 1980년대 이후 분권화는 세계화와 맞물려 잠시나마 좌우 이념의 간극에도 불구하고 드물게 의견의 합치를 이룬 정책 목표다. 본 논문은 자치체의 행정체계 정비를 포함해 자치체의 효율적 운영, 주민의 의견 반영 및 공정한 국정운용을 제고하려는 일본의 로컬 거버넌스가 궁극적으로 행정개혁, 시민참여, 그리고 균형발전을 동시에 두 가지 이상 성취하기 어려운 삼중고(trilemma)에 봉착한다는 설명 틀을 2003년 지방자치법 개정 전후 일본의 중앙-지방 관계 변화에 적용하고자 한다. 이에 따라 2절에서 일본 중앙-지방 관계의 발전사를 검토하고, 3절에서 로컬 거버넌스의 기존연구들을 정리한 후, 4절에서 2000년 지방분권일괄법이 실행되고 2003년 지방자치법 개정으로 이어진 과정에서 지방분권 개혁이 어떻게 전개되었는지 로컬 거버넌스의 삼중고(trilemma) 관점에서 보완하여 설명한다. 그리고 1990년대 이후에 지방자치법이 명시한 법적 권리를 넘어 헌법에 명시되어 있으나 실제로는 적극적으로 활용하지 않았던 시민의 직접적 정치참여에 대한 관심이 고조되는 배경을 검토하며 일본의 로컬 거버넌스에 대한 전망을 제시하고자 한다. ; Enacted along with the Japanese Constitution in 1947, the Local Autonomy Law established the directly elected head of executive and legislature at the local level, independent of the central government. Especially since the 1980s, an outcry for decentralization in a global age managed to put together a consensus across liberal and conservative wings, albeit its brevity. While striving for a thorough reorganization in local administration, an efficient management of local government and a participatory democracy at the local level, however, local governance encounters a trilemma of local reform, civic engagement, and balanced development. I purport to reconstruct the Japanese intergovernmental relations before and after the 2003 revision of the Local Autonomy Law in the context of a trilemma in local governance. In so doing, I lay out previous theoretical works on local governance and trace a unique path of intergovernmental relations in Japan, followed by an overview of local reforms and reorganizations since the Omnibus Law of Decentralization was launched in 2000. 본 논문은 대외정책 분야에서 드러나는 미국 대통령제의 운용원칙인 권력분립을 미국식 민주주의의 사각지대로 접근하는 시각을 제시하여 선행연구와 차별성을 추구한다. 구체적으로 헌법이 천명하는 권력분립 원칙에도 불구하고 오히려 그 권력분립의 기제인 상호간 독자적 선거제에 의해 미국의 유권자 전체가 선출한 대통령은 각 지역구에서 선출된 입법부 구성원이 내세우는 집합적 통치 위임과 확연하게 구별되는 유일한 공공리더십(public leadership)을 정책결정과정에서 독점할 수 있다는 점을 주시하고자 한다. 결국 미국 대통령제의 과제는 미국식 민주주의의 주요 통치원칙인 권력분립을 중시하는 동시에 성공적 통치를 위해 권한공유의 묘(妙)를 찾는 부단한 노력을 경주해야만 가능하다는데 있다. 특히 국내정책 분야보다 대외정책 분야에서 이 난제의 해법을 모색하는데 있어서 법제도적 및 정치적 장애물이 가로막혀 있다. 게다가 선거결과와 무관하게 통치 위임을 생성하는 정치의 사법화가 입헌 대통령제의 근간을 흔들 수 있는 위험성을 목격했다. 이에 본 논문은 대외정책 분야의 미국 대통령제에 대한 평가를 권력분립의 양면성, 즉 권력분립은 권력공유를 전제로 한다는 패러독스에 중점을 두고 대통령의 우위에 대한 주장을 가능하게 하는 헌법적 및 정치적 근거를 대조하면서 미국식 민주주의의 사각지대를 재조명하고자 한다. ; In this paper, I argue that the principle of separation of power in foreign policy under presidentialism invites a blind spot in American democracy. Although the Constitution specifies separation of power both in the conduct of domestic and foreign affairs, independent elections of President and legislators differentiate the kind of collective mandates on Capitol Hill from the unitary mandate bestowed upon President, thus prompting him to proclaim public leadership. The key to a successful governing, then, lies in the art of pursuing "separated institutions sharing powers" persistently. However, the realm of foreign affairs poses a more challenging task, both constitutionally and politically, than its counterpart in domestic policy. Furthermore, we came to witness a modern presidency whose relentless claim on mandate, or what is dubbed as judicialization of politics, was found irrelevant to the electoral outcome itself, thus creating a peril in constitutional presidency. 학위논문 (석사)-- 서울대학교 대학원 : 정책학과, 2012. 2. 권혁주. ; 본 연구는 정책변동(policy change)사례 연구이다. 정책변동은 정책형성(의제설정과 의사결정)을 포함한다는 시각에서 논의를 진행하였다. 정책변동의 성공과 실패의 원인을 찾기 위해 '신행정수도이전정책'의 두 차례 정책변동과정을 분석하였다. 의제설정과정은 Kingdon의 정책흐름모형(policy stream model)을 적용하였고, 의사결정과정은 입법과정을 고려한 거부점(veto point)과 거부권행사자(veto player) 개념을 적용하여 분석하였다. '행정수도이전정책'은 1971년에 최초로 제기되었으나 구체화의 기회를 잡지 못하였다. 시간이 흘러 '행정수도이전정책'은 노무현 정부의 등장과 함께 정책의제가 되고 결정되어 추진되었다. 그런데「신행정수도의건설을위한특별조치법」이 헌법재판소로부터 위헌판결을 받게 되어, '행정중심복합도시건설정책'이 후속정책으로 채택되어 집행되었다. 한편, 이명박 정부는 '교육과학경제도시건설정책'으로 정책변동을 추진하지만 실패하게 되었다. 본 연구는 '신행정수도이전정책'이 좌초된 이후 노무현 정부가 실시한 '행정중심복합도시건설정책'으로의 제1차 정책변동과정과 그 성공을 다루었다. 그리고 이명박 정부의 '교육과학경제도시건설정책'으로의 제2차 정책변동과정과 그 실패에 대하여 분석하였다. 이론적 분석틀은 다음과 같이 구성하였다. 먼저 정책변동을 위한 의제설정과정은 Kingdon의 정책흐름모형에 따라 분석하였다. 정책의 3가지 흐름(정치의 흐름, 정책대안의 흐름, 정책문제의 흐름)을 정리한 후, 각 흐름들이 어떻게 결합되어 정책의 창을 열게 되고, 정책의 창 내에서 자신의 의사를 관철시키고자 하는 참여자의 활동을 해당 정책의 찬성과 반대집단으로 구분하여 살펴보았다. 다음으로 정책변동을 위한 의사결정과정은 국회에서의 입법과정을 중심으로 제도적 맥락에 따라 거부점과 거부권행사자를 구별하여 살펴보았으며, 사후적 거부점으로서 헌법재판소를 포함하였다. ; This is a case study on the policy change. This study have a perspective on policy change that includes policy formation (agenda setting and decision making). In order to find the cause of success and failure of policy change, this research analyzed two cases of the policy change of The New Administrative Capital Relocation Policy. Agenda-setting processes were analyzed on the basis of Kingdon' policy stream model, and decision-making processes were analyzed by applying the concept of the veto point considering the legislative process and veto players. The Administrative Capital Relocation Policy was first raised in 1971, but the policy did not take a chance to be materialized. Over time, the policy was determined by the policy agenda and driven with the advent of the Rho Moo-Hyun Administration. However, The Constitutional Court ruled that The New Administrative Capital Relocation Law is unconstitutional, so Multi-functional Administrative City Construction Policy was adopted as a subsequent policy and implemented. On the other hand, Lee Myoung-Bak Administration was attempts to policy change from the Multi-functional Administrative City Construction Policy to the Education and Science Centered, Economic City Construction Policy but Lee administration was failed to change the Multi-functional Administrative City Construction Policy. This study analyzed the first policy change process to the Multi-functional Administrative City Construction Policy and the success since the failure of the New Administrative Capital Relocation Policy. And then, this study analyzed the second policy change process of the Education and Science Centered, Economic City Construction Policy and the failure. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 환경계획학과, 2012. 2. 전상인. ; 경주지역의 고도보존법 개정과정 사례는 사회구조의 변화에 따른 문제점과 갈등의 원인을 공공부문과 시민들이 함께 인식하고, 다양한 이해관계자들이 참여와 협력을 통한 상호작용으로 합의를 도출한 협력적 계획사례로 평가할 수 있다. 따라서 경주사례를 협력적 계획의 구성요소를 통해 분석해 보는 과정은, 지방 환경에서 협력적 계획이론의 적합성과 현실에서의 적용에 있어 발생하는 문제들을 어떻게 개선하여 보완해야 하는지에 대하여 시사점을 제공한다. 협력적 계획이론에 대한 탐구를 바탕으로, 협력적 계획의 네 가지 구성요소들인 '제도적 맥락', '상호작용의 장', '사회적 학습', '참여 및 합의형성'을 도출하였고, 그중 제도적 맥락을 중심으로 분석을 진행하였다. 경주지역 고도보존법 개정과정에는 공공부문과 시민부문을 중심으로 하는 다양한 이해관계자들이 네트워크를 형성하고 있으며, 공유된 이해에 따라 네트워크는 변화하는 양상을 나타냈다. 개정과정의 이해관계자들은 공청회와 주민설명회를 중심으로 하는 상호작용의 장에서 유통되는 정보를 바탕으로 사회적 학습을 하고 있었으며, 이를 바탕으로 계획과정에 참여하여 개정안의 도출이라는 합의를 형성하였다. 분석의 결과를 종합하면, 경주의 사례는 협력적 계획의 외형은 갖추어져 있다고 평가할 수 있지만, 실제 과정에 있어서는 공공부문의 제한적인 정보공개 범위와 접근성의 문제, 참여자의 대표성과 권력의 비차별성이 부족, 상호작용의 장에서 공동학습이 이루어지기보다 소통의 방향이 일방적이라는 문제점을 가지고 있었다. 제도적 맥락으로 종합하면, 경주지역에 있어 위 문제들은 이해관계자들 간 신뢰저하의 원인으로 작용하였다. 경주지역의 이해관계자들은 정책의 목표달성을 위해 표면적으로 협력하고 있지만 서로를 신뢰하지 않았다. 지방환경에서 발생하는 공공부문과 시민들 간의 신뢰의 문제는 지속적인 합의형성의 학습에서 그 해답을 구할 수 있기에, 정책적 제언을 통해 제도적 보완과 사유재산권 제한에 대한 해법을 모색하고자 하였다. ; Gyeongju-city's preservation law revision process is evaluated as collaborative planning practices. On this case, first the public sector and citizens recognize social problem and conflicts, then various stakeholders are produced agreement with participation and interaction. Therefore, this analysis of cooperative Gyeongju case through the components of the collaborative planning theory provides implications for suitability of collaborative planning theory. It also provides the application of local environment and how to improve and supplement in real life problems. To precede the analysis, first I studied on collaborative planning theory and then derived four components of the collaborative planning theory that 'institutional context', 'field of interaction', 'social learning', 'participation and consensus-building'. Among these components, analysis was performed mainly on the institutional context. Various stakeholders to form a network and a shared understanding of the network showed a changing pattern in this revision process. Stakeholders are conducting social learning, based on the information that delivered by public-hearings and presentations around field of interaction. Based on this information, they involved in the planning process and derived the agreement. In sum, this case evaluated as collaborative planning case superficially. But there are some problems in process that information, participation and mutual understanding. Problem that listed above acts as the cause of deterioration of trust between stakeholders. On the surface, to achieve the goals of the policy is working, but stakeholders are did not trust each other. Through policy proposal, I tried to seek a solution on deterioration of trust problem. Continuous learning on public consensus is encouraging a social capital, such as trust. Study institutional complements on regional commission and find solution in private property limitation problem, are able to derive consensus making. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 김상헌. ; 중앙정부는 지방정부의 부족한 재원을 지방교부세, 국고보조금과 같은 지방재정조정제도를 통해 보전하고 있다. 우리나라의 경우 지방 재정조정제도의 하나인 지방교부세에 보통교부세와 특별교부세가 있 다. 특별교부세는 보통교부세의 경직적 산정에 따른 배분의 한계를 보완하여 각 지방재정력의 격차를 고려하여 보전한다는 방침으로 행 정안전부에서 운영하고 있다. 그러나 특별교부세는 배분의 기준과 결 정이 모호하고 불투명하여 그 결정이 정치적으로 이루어진다는 문제 점을 지적하는 연구가 있다. 선행연구로 이루어진 특별교부세 배분에 관한 실증분석에서는 배분의 결정에 영향을 미친다고 상정한 정치적 행위자를 국회 행정안전위원회 소속, 지역구 국회의원 수 등 의회의 영역으로만 한정하였다. 본 논문은 정치적 요인에 의회의 행위자뿐만 아니라 정부의 행위자 를 포함시켜 분석하였다. 본 논문은 전국 234개 시‧군‧구의 2003~2006년도 4개년도의 특별교부세 자료를 이용하여 특별교부세 배분의 결정에 영향을 미치는 요인들에 대해 정부 정무직 공직자를 포함하여 실증분석을 시도하였다. 그 결과 정부 정무직 공직자로 상 정한 변수가 배분의 결정에 영향을 미친다고 파악되었고, 정부 정무 직 공직자 중에서도 국무총리와 국무조정실‧차장이 다른 정무직 공직 자에 비해 더 큰 영향을 미친다고 파악되었다. 특별교부세 배분에 정무직 공직자가 자기 출생지에 더 많이 배분하 려 결정 과정에 영향을 미치는 것뿐만 아니라 정무직 공직자가 임기 후 선출직에 출마할 경우 특별교부세 배분의 결정에 더 큰 영향을 미 친다는 것을 보았다. 이로써 특별교부세 배분의 결정에 정부의 정무 직 공직자가 영향을 미친다는 것을 확인할 수 있었다. ; The national government makes up for any shortfall in finance of the local governments by the local finance coordination system, which includes local revenue sharings and national subsidies. The local revenue sharing, as a kind of the local finance coordination system, consists of an ordinary revenue sharing and a special revenue sharing. The latter is introduced to remedy the shortcomings of the former's allocation system caused by the rigidity of its calculation, and is currently operated by the Ministry of Public Administration and Security. There are some literature criticizing the problem that the SRS allocation is decided politically due to the fact that the principles for its allocation are equivocal and the decisions are arbitrary and not transparent. In previous studies analyzing the SRS allocation empirically, the scope of the political actors who are assumed to exert influences on the allocation decision is limited to the legislative area, such as the members of the National Assembly Public Administration and Security Committee and the number of lawmakers in each electoral district. This study presents a further analysis with a new political factor, the government actors, in addition to the existing legislative actors. Specifically, using the SRS data for the period of 2003 ~ 2006 for the entire 234 cities- counties-districts in the country, the present study attempts to analyze the factors, which affect SRS allocation decisions, including the new variable, the government's political masters. The results demonstrate that the new variable indeed affects the allocation decisions and that, among the political masters, prime ministers and directors generals and deputy directors in the Prime Ministers Office are shown to exert greater influences than others. Moreover, it is also shown that they exercise their power in the SRS allocation decision making process to provide more sharings to their places of birth, and in particular, their intervention is even greater when they decide to run for an elective office from their places of birth after the termination of their government offices. As such, this study verifies that the government's political masters exert influences on the SRS allocation decision. ; Master
