Este artículo pretende evidenciar como las reducciones tributarias que se otorgan a los inversionistas y empresarios en el país de Puerto Rico en vez de generar beneficios que contribuyan con el crecimiento y desarrollo del país, apoyo a los sectores económicos vulnerables e incipientes y a la generación de nuevas oportunidades empresariales y sociales ha desencadenado una problemática que se ha extendido al área fiscal del país, teniendo como resultado un panorama desalentador reflejado en una crisis que pudo ser evitada. ; This paper expects to show how the impositive taxes reduction that have been given to Puerto Rico's businessman and investors has not contributed with the economic growth, also expects to explain how this policy has not supported the economic vulnerable sectors and has not generated new work's business opportunities for people who really need it and for the progress of the society. In the last years people like foreign investors have been taken this social benefit for creating enterprises and for earning money, in the beginning of the policy's promotion was a really good strategy for the country but later the money who all the companies constantly was being produced started to disappear and the country suffered an important fiscal crisis. A fact thaht could be avoided an now is a critical problem for the government and for the country's budget.
Background In 2007, a non contributory pension program was launched in rural areas of Mexico. The program consisted in a non conditional cash transfer of US$40 monthly to all older adults (OA) aged 70 over. We evaluate the effect of the program on mental well being of its beneficiaries. Methods Findings Quantitative qualitative methods were used. For the quantitative component, we used the selection criteria established by the program (age locality size) to form the Intervention (OA aged 70–74 residing in rural localities, <2500 inhabitants) Control groups (OA aged 70–74, in localities with 2501–2700 inhabitants). Baseline data collection was conducted in 2007 where 5,465 OA were interviewed. The follow up survey was conducted in 2008, it was possible to interview 5,270 OA, with a response rate of 96%. A difference in difference linear probability model with individual fixed effect was used to estimate the impact of the program on mental well being indicators. In 2009 a qualitative component was designed to explore possible causal pathways of such effect. Results After a year of exposure, the program had a significant effect on reduction of depressive symptoms (β = −0.06, CI95% −0.12; −0.01) an increase in empowerment indicators: OA participated in important household decisions (β = 0.09, CI95% 0.03;0.15); OA participated in household decisions pertaining to expenses (β = 0.11, CI95% 0.05;0.18). Qualitative analysis found a strong trend showing a reduction of sadness, feeling of increasing empowerment. Conclusions These results suggest that a non conditional transfer in older ages have an impact beyond the economic sphere, impacting even the mental well being. This effect could be explained because the pension produces feelings of safety welfare. It is recommendable that governments should invest efforts towards universalizing the non contributory pension programs in order to ensure a basic income for the elderly.
In this article, we will provide a general overview of the origins, developments and most recent trends in pension matters in Latin America, based on a study of the main moments in the evolution of social security systems, particularly pension systems in the Region, within the framework of a relational and contextual analysis of the development of their economic and political process during the second half of the twentieth century, in the light of the deployment of the developmentalist model inspired by ECLAC, of its crisis and subsequent failure, as well as the emergence and implementation of the Neoliberal project, from which a series of structural reforms were projected and carried out, which we will study in the framework of the Neoliberal financialization process imposed on the Region in this area, to conclude with some reflections on non-contributory pensions in Latin America since the last wave of reforms and their impact on pension coverage in the Region. ; En el presente artículo, haremos un recuento general de los orígenes, desarrollos y las más recientes tendencias en materia pensional en América Latina, a partir del estudio de los principales momentos de la evolución de los sistemas de seguridad social, particularmente de los sistemas pensionales en la Región, en el marco de un análisis relacional y contextual entorno al desenvolvimiento de su proceso económico y político durante la segunda mitad del Siglo XX, a la luz del despliegue del modelo desarrollista de inspiración Cepalina, de su crisis y posterior fracaso, así como del surgimiento e implementación del proyecto Neoliberal, desde el cual se proyectaron y realizaron una serie de reformas estructurales que estudiaremos en el marco del proceso de financiarización Neoliberal impuesto en la Región en este ámbito, para finalizar realizando algunas reflexiones sobre las pensiones no contributivas en América Latina desde la última oleada de reformas y su impacto en la cobertura pensional de la Región.
The field of social security has been subject to numerous regressive reforms since the beginning of the management of the Alliance for Change. The planned reforms of June 2016 and December 2017 adopted in the National Congress (Law 27260 entitled 'National Historical Repairment Programme for pensioners and pensioners' and Law 27.426, which modi? included the calculation of the initial existence and updates), involve regressive changes in social security with the scope of coverage, income replacement and recognition of entitlements. At the same time, but through administrative measures, thousands of non-contributory pensions were derecognised. In this article we present the evolution of non-contributory pensions in recent years and characterised the administrative measures of suspension and cancellation of pensions as violations of social security, health and adequate living standards rights, in particular for persons with disabilities. ; El campo de la seguridad social ha sido objeto de numerosas reformas regresivas desde el comienzo de la gestión de la Alianza Cambiemos. Las reformas previsionales de junio de 2016 y diciembre de 2017 aprobadas en el Congreso Nacional (la Ley 27260 denominada "Programa nacional de reparación histórica para jubilados y pensionados" y la Ley 27.426 que modi?ficó el cálculo del haber inicial y las actualizaciones) con? guran transformaciones regresivas en la seguridad social con alcances signi? cativos en la cobertura,sustitución de ingresos y en el reconocimiento de derechos. Al mismo tiempo, pero a través de medidas administrativas, se dieron de baja miles de pensiones no contributivas. En este artículo presentamos la evolución de las pensiones no contributivas en los años recientes y caracterizamos las medidas administrativas de suspensión y cancelación de pensiones como violaciones a los derechos a la seguridad social, a la salud y a gozar de un nivel de vida adecuado, en particular para las personas con discapacidad.
ilustraciones, fotografías, gráficas, tablas ; Introducción Este estudio tiene como objetivo estimar la tasa de mortalidad postoperatoria a los 30 días y los costos totales del episodio médico, así como determinar los factores pronósticos asociados a estos desenlaces en pacientes adultos que se han sometido a una artroplastia de hombro en el sistema contributivo de salud de Colombia. Método Cohorte retrospectiva de datos administrativos de pacientes adultos inscritos en el sistema contributivo de salud de Colombia que se sometieron a artroplastia de hombro entre los años 2012 y 2017. Los desenlaces evaluados fueron tasa de mortalidad, ingreso a UCI y requerimiento de trasfusión durante los primeros 30 días, tasa de mortalidad, fracturas, infección y revisiones a 1 año y el costo total del episodio médico incurrido por el tercer pagador durante los 90 días posteriores al procedimiento. También se generaron modelos de regresión lineal multinivel para determinar los factores pronósticos asociados con los resultados presentados. Resultados El estudio incluyó a 2.471 pacientes, el grupo de edad entre 65 y 79 años representa el 55% de la totalidad, siendo más frecuente en el sexo femenino. las tasas complicaciones dentro de los primeros 30 días por cada 100 procedimientos fue de 0.36 para mortalidad, 2.14 para ingreso a UCI y 0.57 para requerimiento transfusional. las tasas complicaciones a un año por cada 100 procedimientos fue de 2.67 para mortalidad, 0.97 para revisiones e infecciones peri protésicas y 0.89 para fracturas peri protésicas. Se encontró que a mayor edad e índice de comorbilidad de Charlson (ICC) se incrementa la tasa de mortalidad; menor edad y el sexo masculino están asociados con mayor tasa de revisión al año. Se encontró que el costo total promedio del episodio médico fue de USD$2031.12. El modelo multivariado encontró tendencias crecientes en el costo a medida que aumenta el ICC. Conclusiones Se trata de un estudio poblacional que incluye la cohorte estudiada para mortalidad en reemplazo de hombro más extensa a las publicadas hasta el momento. El comportamiento en cuanto mortalidad es mayor en Colombia, se reportan menores costos desde el punto de vista del sistema de salud. La edad y el ICC son factores asociados con mortalidad. (Texto tomado de la fuente). ; Introduction This study aims to estimate the postoperative mortality rate at 30 days and the total costs of the medical episode, as well as to determine the prognostic factors associated with these outcomes in adult patients who have undergone shoulder arthroplasty in the Colombia's contributory system of health. Method Retrospective cohort of administrative data of adult patients enrolled in the Colombia's contributory health system who underwent shoulder arthroplasty between 2012 and 2017. The outcomes evaluated were mortality, ICU admission, and transfusion requirement rate during the first 30 days, mortality, fractures, infection, and revisions rate at 1 year and the total cost of the medical event incurred by the third payer during the 90 days after the procedure. Multilevel linear regression models were also generated to determine the prognostic factors associated with the results presented. Results 2,471 patients were included, the age group between 65 and 79 years represents 55% of these, being more frequent in the female sex. Complication rates within the first 30 days per 100 procedures were 0.36 for mortality, 2.14 for ICU admission, and 0.57 for transfusion requirements. Complication rates at one year per 100 procedures were 2.67 for mortality, 0.97 for revisions and periprosthetic infections, and 0.89 for periprosthetic fractures. It was found that the higher the age and the Charlson comorbidity index (CCI), the mortality rate increases; Younger age and male gender are associated with a higher revision rate per year. The average total cost of the medical episode was found to be USD$2031.12. The multivariate model found increasing trends in cost as the ICC increases. Conclusions This is a population-based study that includes the largest cohort studied for mortality in shoulder replacement to those published to date in Colombia and developing countries. The behavior in terms of mortality is higher in Colombia, lower costs are reported from the point of view of the health system. El artículo describe y analiza los aspectos organizacionales, presupuestarios y programáticos desde la creación del Ministerio de Desarrollo Social de la Nación (MDS) a fines de 1999 hasta la conformación del nuevo Ministerio de Salud y Desarrollo Social en septiembre de 2018. Su propósito es reunir evidencia para la comprensión de su aporte al gobierno de la pobreza bajo distintas administraciones y diferentes escenarios económicos pero con la continuidad de un importante contingente de trabajadores con débiles inscripciones al mercado formal de trabajo y, en consecuencia, excluidos de la protección social contributiva. En particular, se analizan las diferentes políticas de transferencias no contributivas de ingresos desarrolladas por el MDS mostrando su limitado alcance y la baja generosidad de los montos suministrados. En consecuencia, el análisis ilustra el modo estatal de gestión de las poblaciones excluidas de la protección social contributiva. ; The article describes and analyzes the organizational, budgetary and programmatic aspects of the National Ministry of Social Development (MDS) from its creation (1999) until the formation of the new Ministry of Health and Social Development (2018). The purpose of this text is to gather evidence for the understanding of the MDS contribution to the government of poverty under different administrations and economic scenarios but with the continuity of an important contingent of workers with weak registrations to the formal labor market and, consequently, excluded from contributory social protection. In Argentina, the years following the 2001-2002 economic crisis had been characterized by the growing importance of State intervention on welfare production. This paper looks into the inclusion policies implemented by the Argentine government in the area of social protection for people aged 65 and older. Traditionally, Argentine pension system had been contributory and had operated on a 'pay as you go' basis. Economic crises of earlier decades, and 90s regressive reforms, caused a decline in coverage and real income transfers. Consequently, in the early 2000s, a significant share of the older people was excluded from any pension system. In order to address this situation, the government developed a set of measures that favored inclusion extending the coverage of the pension system and improving the purchasing power of benefits. However, these were only temporal solutions since they have not solved the structural problems of the social protection system. In particular, the persistence of a dual labor market prevents the proper functioning of contributory institutions in the Argentine welfare State. ; En el caso de Argentina, los años posteriores a la crisis económica de 2001-2002 han estado marcados por el protagonismo creciente del Estado en la producción de bienestar. El objeto de este artículo es indagar sobre las políticas de inclusión implementadas por el gobierno argentino en el área de la protección social de las personas mayores de 65 años. El régimen previsional argentino ha sido tradicionalmente de tipo contributivo y de reparto. Las crisis económicas de las décadas anteriores y las reformas regresivas de los años 90 produjeron una notable reducción de la cobertura y de las prestaciones, en términos reales. En consecuencia, en los primeros años 2000, una cuota significativa de los adultos mayores estaba excluida del sistema de protección social. Para hacer frente a esta situación, el gobierno desarrolló un conjunto de medidas de inclusión que favorecieron la ampliación de la cobertura del sistema previsional y una mejora del poder adquisitivo de las prestaciones. Sin embargo, se trató de soluciones transitorias que no han resuelto los problemas estructurales del sistema de protección social. En particular, la persistencia de un mercado laboral dual impide el correcto funcionamiento de las instituciones contributivas del Estado de bienestar argentino.
The Minimum Vital Income is a new non-contributory benefit of the social security system whose purpose in contribute to eradicate the situation of vulnerability generadted by both poverty and social exclusión. Aunque el derecho a la Seguridad Social aparece regulado en numerosos Tratados internacionales, ni el Convenio Europeo de Derechos Humanos ni sus Protocolos Adicionales la contemplan. Y, sin embargo, son numerosas las sentencias del Tribunal Europeo de Derechos Humanos que tienen por objeto la tutela del derecho a percibir prestaciones sociales contributivas, no contributivas y de naturaleza mixta. El elemento en común que tienen esas sentencias –que se analizan en el primer bloque– es que el Tribunal parte de la premisa de que el derecho a prestaciones sociales es un derecho de propiedad tutelable al amparo del artículo primero del Primer Protocolo Adicional al Convenio Europeo de Derechos Humanos. En base a dicho precepto España ya ha sido condenada en dos ocasiones en materia de pensiones de Seguridad Social. Esta jurisprudencia podría convertirse, además, en un límite a la potestad legislativa de los Estados que, como España, introdujeron importantes recortes en materia de pensiones en los años más duros de la última crisis económica y financiera mundial. En el segundo bloque se estudia el impacto de dicha jurisprudencia del Tribunal Europeo de Derechos Humanos en el Tribunal de Justicia de la Unión Europea, del que la cuestión prejudicial Florescu es, hoy por hoy, la única exponente. Por último se analiza la jurisprudencia de nuestro Tribunal Constitucional que viene manteniendo el criterio que en materia de prestaciones sociales no existe un derecho de propiedad, sino una expectativa de derecho no indemnizable ; Although the right to Social Security is regulated in numerous international Treaties, neither the European Convention on Human Rights nor its Additional Protocols contemplate it. Nevertheless, there are numerous judgments of the European Court of Human Rights that have for object the protection of the right to receive social contributory, non-contributory and of a mixed nature benefits. The common element in these judgments - which are analyzed in the first block - is that the Court starts from the premise that the right to social benefits is a property right that can be protected under the first article of the First Additional Protocol to the European Convention. of Human Rights. Based on this precept, Spain has already been sentenced twice in cases related to Social Security pensions. This dence could also become a limit to the legislative power of States that, like Spain, introduced important pension cuts in the harshest years of the last global economic and financial crisis. This article comments on the Conclusions 2017 of the European Committee of Social Rights (ECSR) pertaining to the Rights to social security (art. 12 of the European Social Charter - ESC) and to social and medical assistance (Art.13.1). Some governments having given effect to the Charter had to report on the application of these rights in 2016. This was the case for Spain. The laws, regulations and reforms during the reference period 2012-2015 only were taken into consideration. Reforms since then will be reported later. The Right to social security recalls the governments to their (optional) obligations in either (§1) maintaining "a system of social security" (in line with ILO Standard nr 102), (§2) maintaining it "at a satisfactory level at least equal to that necessary for the ratification of the European Code of Social Security" (assessed by the Committee of Ministers of the Council of Europe as proposed by the ILO), (§3) endeavouring "to raise progressively the system of social security to a higher level"; (4) in taking "steps (…) in order to ensure" the rights of nationals of other Parties to the ESC and moving to take advantage of social security completed under the legislation of each of the Parties. Non-contributory benefits are examined by the ECSR in the scope of article 13 which protects the right to social assistance to "any person who is without adequate resources and who is unable to secure such resources by his own efforts or from other sources". In the scope of each provision of the ESC he authors glance through first the repeated comments of the ECSR on the national reporting before then summarizing the main conclusions related to Spain. Spain has more to do or amend in order to apply the Charter comprehensively. The comments of the ECSR have establish now for years ground-lights for the states room of manoeuvre when managing the social security with due consideration for their budgetary constraints. --- Cet article commente les Conclusions 2017 du Comité européen des droits sociaux (CEDS) concernant les Droits à la sécurité sociale (Art.12 de la Charte sociale européenne – CSE) et à l'assistance sociale et médicale (Art.13.1). Certains gouvernements ayant ratifié la Charte devaient établir en 2016 un rapport sur l'application de ces droits. C'était le cas de l'Espagne. Seules les lois, réglementations et réformes intervenues pendant la période de référence 2012-2015 devaient être prises en considération. Les réformes entreprises depuis lors seront commentées plus tard. Le Droit à la sécurité sociale rappelle aux gouvernements leurs engagements optionnels (§1) « à maintenir un régime de sécurité sociale » (en conformité avec la convention n°102 de l'OIT), (§2) « à maintenir le régime de sécurité sociale à un niveau satisfaisant, au moins égal à celui nécessaire pour la ratification du Code européen de sécurité sociale » (évalué par le Comité des Ministres du Conseil de l'Europe sur la proposition de l'OIT), (§3) « à s'efforcer de porter progressivement le régime de sécurité sociale à un niveau plus haut », (4) « à prendre des mesures (….) pour assurer » les droits des ressortissants des autres Parties à la CSE qui se déplacent à bénéficier d'une sécurité sociale complétée par la législation de chacune des Parties. Les prestations non-contributives sont examinées par le CEDS dans le cadre du champ d'application de l'article 13 qui protège le droit à l'assistance sociale de « toute personne qui ne dispose pas de ressources suffisantes et qui n'est pas en mesure de se procurer celles-ci par ses propres moyens ou de les recevoir d'une autre source ». Les auteurs parcourent d'abord, en regard de chaque disposition de la Charte, les commentaires que le CEDS répète à l'appui de chaque rapport national et résument ensuite ses principales conclusions concernant l'Espagne. Il reste beaucoup à faire dans ce pays, ou à amender, en vue d'une conformité globale avec la Charte. El Convenio-Hispano Marroquí es el más antiguo de los 24 Convenios de Seguridad Social actualmente en vigor celebrados por España. Su ámbito de aplicación material se restringe al Régimen General y a los Regímenes Especiales españoles que expresamente se mencionan, no incluyéndose los Regímenes Especiales de Funcionarios. Sólo se aplica al nivel contributivo de Seguridad Social, excluyéndose las prestaciones por desempleo, las prestaciones por cese de actividad, y las de dependencia. Sin embargo, por aplicación del Acuerdo Euromediterráneo, que consagra la igualdad de trato en el ámbito de la Seguridad Social de los trabajadores marroquíes y sus familias, estos tienen derecho a las prestaciones españolas no contributivas de Seguridad Social españolas y a las de dependencia. Asimismo, el Reglamento (UE) 1231/2010 les permite totalizar y exportar las prestaciones de Seguridad Social contributivas y no contributivas dentro del territorio de la Unión Europea. ; The Moroccan Hispanic Social Security Agreement is the oldest of the 24 Social Security Agreements concluded by Spain currently in force. Its material scope is restricted to the General Regime and to the Spanish Special Regimes that are expressly mentioned, not including the Special Regimes of Public Officials. It only applies to the Social Security contributory level, excluding unemployment benefits, benefits for cessation of activity and long-term care benefits. However, by application of the EuroMediterranean Agreement, which enshrines equal treatment in the field of Social Security for Moroccan workers and their families, they are entitled to non-contributory benefits and long-term care benefits. This paper aims to analyze the set of Social Security regulations aimed at protecting the family. Regardless of whether it is direct or indirect protection, the different contributory and non-contributory benefits that have family objectives are indicated. The result is the confirmation of a transversal system of protection, tremendously heterogeneous and lacking in unity, which requires the action of the legislator to unify the different measures if families are to be truly protected by Social Security. ; Con este trabajo se analiza el conjunto normativo de Seguridad Social dirigido a la protección de la familia. Con independencia de si se trata de una protección directa o indirecta, se señalan las diferentes prestaciones contributivas y no contributivas que tienen objetivos de carácter familiar. El resultado es la constatación de un sistema transversal de protección, tremendamente heterogéneo y carente de unidad, que requiere la actuación del legislador para unificar las distintas medidas si se quiere que las familias puedan ser verdaderamente protegidas por la Seguridad Social.
