Revelations concerning the number and conditions of detention of political prisoners in labor camps of the former Soviet Union; based on archival material.
The thesis deals with the jurisdiction of homosexual delicts as well as with the punishment inflicted upon homosexual convicts in the prisons of the Third Reich. Judicial measures taken against homosexuals aimed at preventing such predisposed men from practising their homosexuality. There was no plan to "re-educate" homosexuals - solely the severity of measures was intended to bring about a change in behaviour. Although it has been argued that convicts in concentration camps were particularly discriminated against when they were homosexuals, this cannot be proved for the prisons. It is true that convicts who were imprisoned as homosexuals held a special position within prisons too; nevertheless, this status showed fewer characteristics of a vertical than of a horizontal structure. On the whole, national-socialist politics towards homosexuals resulted from the general assessment of homosexuality. It did not aim at exterminating all homosexuals, but at an increase in population and the maintenance of moral standards.

"Wir dürfen uns gegenseitig nicht egal sein!" - Unter diesem Leitsatz entstand diese Diplomarbeit über die historische und gesellschaftspolitische Entwicklung des Strafvollzuges. Mit Blick auf den geschichtlichen Hintergrund wird unter Einbeziehung von Reformen des Strafvollzugsgesetzes die Entstehung der Freiheitsstrafe, wie sie heute besteht, dargetan. Der vorherrschende Strafzweck ist nicht mehr die Vergeltung der Strafe, sondern vielmehr der Schutz der Gemeinschaft und die erfolgreiche Resozialisierung und Wiedereingliederung des Verurteilten in die Gesellschaft. Auch die Rechtsstellung der Inhaftierten hat sich wesentlich verbessert. Erkannt wurde vor allem die Eigenart jedes Häftlings und dessen Tat. Der Freiheitsentzug wird daher zunehmend individualisiert und differenziert. Von der Unterdrückung durch Justizvollzugsbeamten in der Vergangenheit wird nunmehr der vorwiegend respektvolle und vertrauenswürdige Umgang mit Insassen erläutert. Abschließend wird im Rahmen dieser Arbeit intensiv der Frage nachgegangen, was das Gesetz für den Freiheitsentzug vorschreibt und wie die Praxis dem nachkommt. ; "We should not feel indifferent about each other" is the inspirational quote which led to the focus of my diploma thesis about the historical and sociopolitical development of the penitentiary. In order to better understand the penal system as it currently exists, an overview of the historical development is provided. This overview shows how the main purpose of imprisonment has changed over the years. Retaliation is no longer the main goal of penitentiaries but the ensurance of a safe community and the convicts successful reintegration into society. The convicts legal status has also considerably changed over time, to the extent that there is an increasingly differentiated approach to every individual's case and their alleged convictions. Furthermore, research suggests that inmates are generally no longer oppressed by prison guards but are handled in a more respectful and trusted way. Bisher mangelt es an kontrollierten Untersuchungen zum Effekt des offenen Vollzugs auf die Legalbewährung, da vorherige Studien unterschiedliche Gruppen von Inhaftierten miteinander verglichen. Um diesem Selektionseffekt entgegenzuwirken, wurden in der vorliegenden Studie mittels Matching-Verfahren vergleichbare Gruppen von Gefangenen gebildet. Mit Hilfe von Bundeszentralregisterdaten konnten die Rückfallquote, -geschwindigkeit und -schwere untersucht sowie individuelle Risiko- und Schutzfaktoren der Gefangenen kontrolliert werden. Die Ergebnisse zeigen, dass die Unterbringung im offenen Vollzug über die Positivauswahl von Gefangenen hinaus einen eigenständigen Effekt hat und das Risiko einer erneuten Inhaftierung signifikant reduziert.

The frigate GERMANIA set sail from Hamburg for Brazil in 1824. During the voyage, eight men were accused of mutiny and sentenced to death. Some of the passengers on the ship, which was under the command of Captain Hans Voss, were inmates of a prison in Hamburg whose voyage to Rio de Janeiro was the equivalent of a remission - only on condition, however, that they never return to the Hamburg region again. Apart from these prisoners there were emigrants on the ship, attracted by the promotional activities of the Brazilian agent Major Georg Anton Schäffer, who in 1822 had been commissioned by the Brazilian royal household to recruit people to come and settle in the country. Settlement of the country - which became independent that same year - was important to the Brazilian king Dom Pedro, son of the Portuguese king Juan VI, for several different reasons. One of his objectives was to have the immigrants chop down sections of jungle to create plantations, as well as to serve as soldiers in order to protect the royal family and fight in border conflicts. Major Georg Anton Schäffer, whose recruitment methods were notorious, had to move from Hamburg to Altona and then on to Bremen, because people feared an influx of vagabonds and paupers. German emigration to Brazil, largely caused by famines of the previous years, reached its high point of 30 percent in 1825. Those who decided to emigrate to Brazil were of differing origin: they included not only farmers, businessmen and tradesmen but also paupers and convicts. The negotiation transcript written on board the ship and other documents helping to reconstruct what took place on board the GERMANIA throw light on the events leading up to the execution of the eight accused mutineers, five of whom had boarded the vessel as convicts from Hamburg. The attempts to prevent them from arriving in Brazil began in Glückstadt, where the ship was supposed to be set on fire to this end. On the high seas, following an attempt to rebel against senior crew members, the death sentences were imposed and members of the ship's crew carried them out. The contents of the official negotiation transcript are doubtful, however, since the accused were forced to confess under torture and the main reason for the transcript was to make the plaintiffs' behaviour more officially acceptable. A letter received from a passenger who was also on board the GERMANIA, in which the brutality of the negotiators becomes clear, serves as a basis for a change of opinion with regard to the negotiation transcript.

Die in Deutschland im Jahr 2011 gesetzlich eingeführte elektronische Aufenthaltsüberwachung (EAÜ) bietet die technische Voraussetzung zur Überwachung entlassener Straftäter*innen mit negativer Legalprognose. Dies betrifft insbesondere Sexualstraftäter*innen und betont den Ausnahmecharakter der EAÜ als ultima ratio in Deutschland. Das Bundesland Hessen als Pionier der elektronischen Überwachung in Deutschland setzte in der Vergangenheit institutionelle Maßstäbe für die bundesweite Implementation. Bei der praktischen Umsetzung sind Akteur*innen verschiedener Behörden beteiligt, die bei sog. Fallkonferenzen über den EAÜ-Einsatz entscheiden. Die Fallkonferenzen wurden erst mit der Einführung der EAÜ ins strafrechtliche SanktionssystemDeutschland initialisiert. Sie sind ein innovatives, bisher wenig erforschtes Instrument einer ressortübergreifenden Verwaltungskoordination. Im vorliegenden Beitrag werden auf Basis von Interviews mit Expert*innen einer exklusiv besetzten Stichprobe sowie mit Hilfe des akteurzentrierten Institutionalismus die Bedeutung der Fallkonferenzen für die erfolgreiche Koordination der EAÜ exploriert.

Der Hauptfokus des Buches sind die im Titel genannten Räume in Bezug auf das System der Atlantic slavery. Ich verstehe unter Atlantic slavery bzw. Atlantic slaveries sowohl die Sklaverei-Regimes an Land in Afrika und in Amerika, inclusive Inseln, wie auch Versklavung und Transport zu Land und zu Wasser sowie den Sklavenhandel auf dem Atlantik. Die drei territorialen Hauptelemente, vulgo Kontinente und Ozean, bilden das System Afrika-Atlantik-Amerikas (AAA). Europa spielte auch eine Rolle. Das Wesentliche war aber die Süd-Süd-Komponente, die vor allem unter iberischer Kontrolle stand (ca. 7 Millionen Versklavte aus Afrika von insgesamt rund 11 Millionen in die Amerikas Verschleppter). Das ist das strukturell-anthropologische Hauptproblem; das qualitative, aber auch chronologisch-historische, Hauptproblem ist die Bedeutung von AAA für die Geschichte der Moderne und des Kapitalismus.The book series of the Bonn Center for Dependency and Slavery Studies publishes monographs and edited volumes that examine different phenomena of slavery and other forms of strong asymmetrical dependencies in societies. The series follows the BCDSS's research agenda in going beyond the dichotomy of slavery versus freedom by proposing a new key concept, strong asymmetrical dependency, which covers all forms of bondage across time and space. This includes debt bondage, convict labor, tributary labor, servitude, serfdom, and domestic work, as well as forms of wage labor and various types of patronage. Works published in this series will also investigate periods, regions and contexts in world history that have not been directly affected by Western colonization, such as the ancient Near East, pre-modern and modern societies in Asia, Africa, and the pre-colonial Americas.Language Policy Dependency and Slavery StudiesWith its mission to explore phenomena of asymmetrical dependency, the Bonn Center for Dependency and Slavery Studies (BCDSS) and its book series Dependency and Slavery Studies work against forms of gatekeeping which may put obstacles in the way of scholarly work in English felt to be non-standard. The Center and its book series understand language to be intimately connected to power structures and strive to foster an awareness of epistemic dependencies resulting from linguistic dependencies. Given that language is multiply situated and constantly evolving, the editors of Dependency and Slavery Studies do not insist on conformity to the traditional binary standard Englishes (British and American). Authors are thus encouraged to write in their national or regional variety of English
