In this article the present-day territorial organization of correctional institutions of the Federal Penitentiary Service of Russian Federation and the history of its formation from the 19th century are considered. The major emphasis in the historical consideration is placed on the economic premises for the territorial location of these facilities: industrial and civil construction, mining development, and other tasks of infrastructural development of Russia's territory. In the analysis of the current state of affairs the diversity of correctional institutions (pretrial-detention facilities (PTDFs), prisons, correctional colonies of different regimes, fostering and educational facilities), their distribution by size class and type of settlements, with the differences between Russia's central and peripheral areas taken into account, and the relationship between the territorial distribution of the population in Russia and territorial distribution of the network of correctional institutions are considered. Particular attention is given to correctional institutions that are located in scarcely populated territories (less than five people per 1 km2) with low transport accessibility, as well as their general economic influence and the influence on local labor markets. The industrial specialization of correctional institutions and its dependence on the location of these facilities in urban and rural areas is analyzed.

The study of the legislative regulation of the use of life imprisonment, carried out by the author of the article, allows us to draw the following conclusions. A comparative analysis of the criminal legislation of Great Britain, Germany, Switzerland and the USA has shown that in countries there is an almost unified approach to the list of categories of crimes for which life imprisonment is imposed. The results of the study on the sex and age of convicts showed that this type of punishment is not assigned to women only in Russia, and the age from which the application of life for life in the legislation of the countries under consideration is different. In the opinion of some researchers, life imprisonment is appointed in order to restore social justice, correct the convicts and prevent the commission of the crime, both convicted and other persons. Certainly, a person who committed a particularly serious crime must serve his life in places of deprivation of liberty, not to intimidate others and not to repay or restore social justice, but to render harmless and exclude his further danger to society. Studying the psychological characteristics of convicts of this category, we can conclude that the complexity of working with them is related to the characteristics of their personality, attitude to committed crimes, as well as the specifics of the execution of punishment. This is what makes it necessary to develop quality psychological support and the positive result can be influenced by education and religion, which allow surviving in harsh conditions, to maintain adequate behaviour and prevent the recurrence of the crime.

The article is devoted to organizational and legal problems of educational colonies in Ukraine. It is noted that educational colonies occupy a special place among other penitentiary institutions provided by the CEC of Ukraine and special institutions for children, defined by the Law of Ukraine "On bodies and services for children and special institutions for children." However, the Law of Ukraine "On Bodies and Services for Children and Special Institutions for Children" only formally outlines the place of educational colonies in the system of special institutions for children. The main tasks of penitentiary institutions are proper execution of sentences, correction and re-socialization of convicts, general and special prevention, prevention of torture and inhuman or degrading treatment of convicts. The main tasks of the legislation, compared to the Correctional Labor Code of Ukraine in 1970, have not changed, only the achievement of resocialization and prevention of torture and inhuman or degrading treatment of convicts was first defined by the legislator as the purpose of criminal law. It is emphasized that in the current conditions, when places of imprisonment are financed from the budget, to keep thousands of convicts, feed them three times a day, provide them with at least heat, light, supervision and protection is very expensive not only for the young state, which is Ukraine, but and for any country, even with a developed market economy. Proposals to establish an independent body to investigate complaints of violence against children in correctional facilities, as well as to establish cooperation between correctional facilities with the children's service and the center of social services for youth and to require the appointment of individual social workers responsible for working with colonies. The article discusses the features of the activities of educational and correctional institutions for minors who have committed offenses. The authors reveal the peculiarities of the education of this category of persons in the colonies-shelters of the Russian Empire of the late 19th - early 20th centuries and at the present time. Past experience is considered by the example Storozynski transitional shelter Smolensk province through the analysis of historical materials found in the State archive of the Smolensk region (ASR). It is worth pointing out that education included various types of influence on juvenile offenders, which led to the correction of the latter.

The article draws attention to the fact that in accordance with international documents in the detention of prisoners and the provision of places for sleep it is necessary to treat them with respect for human dignity, with the possibility of seclusion in a separate room. Meanwhile, the criminal-executive legislation of Ukraine, the practice of punishment in the form of imprisonment, the spatial structure of correctional colonies do not provide such an opportunity. Since its introduction in 1920, imprisonment only involves collective retention of the convicts first in the barracks, now in the dormitories, that is the material embodiment of the idea of correction of the convicts «in the collective and through the collective.» It is not about any personal space of the convicted person, since placement in dormitories, where the living space is provided in 4 m2, excludes the possibility of solitude neither in the daytime nor at night. Under such conditions, the result of living of prisoners in dormitories due to the large crowding of people in a confined space is a manifestation of anxious-depressive, negative-depressive and negative-hysterical reactions among them. Accommodation in such dormitories causes irreparable harm to the individual, contributing to the development of psychological fatigue, alienation, tension, irritation, anxiety and depression, that leads to neuro-psychological overload, conflicts and breakdowns. Prolonged being of convicts in an aggressive environment of their own without any possibility of seclusion with inevitability leads to psychosomatic changes, that become irreversible after 5–6 years of imprisonment. Thus, the placement of convicts in dormitories acquires signs of cruel, inhuman and degrading treatment. The purpose of the article is to develop proposals aimed at eliminating the shortcomings of imprisonment with serving it in correctional colonies, in order to replace the deprivation of liberty, that involves the residence of prisoners in dormitories, with imprisonment. that provides private space in a separate room for each prisoner. This material allows to submit the following proposals: it is necessary to abandon such a type of punishment as imprisonment introduced in 1920 by the Provisional Instruction of the People's Commissariat of Justice; instead of imprisonment, there should be punishment in the form of imprisonment only for violent crimes against a person; taking into account the negative impact on the health of a person of a prolonged isolation, the maximum term of imprisonment may not be more than five years; the possibility of imprisonment for minors should be ruled out; there is a need to abandon the «ideal zone» and introduce a new for Ukraine architectural model of a prison where there would be no placement of convicts in dormitories, and each prisoner would be provided with a living room of a hotel type that complies with the European prison rules, with sanitary compliance of the hygienic requirements to the living space and the cubic area at least at the level of the nineteenth century, which was in solitary cells of the royal prisons, that is, an area of at least 10 m2 and, accordingly, a cubature not less than 28 м3. ; В этой статье обращается внимание на тот факт, что согласно международным документам при размещении заключенных, предоставлении места для сна, надо относиться к ним с уважением человеческого достоинства с обеспечением возможности уединения в отдельном помещении. Между тем уголовноисполнительное законодательство Украины, практика исполнения наказания в виде лишения свободы, пространственная структура исправительных колоний не предоставляют такую возможность. С момента своего введения в 1920 году лишение свободы предполагает только коллективное содержание осужденных сначала в бараках, теперь в общежитиях, которые являются материальным воплощением идеи исправления осужденных «в коллективе и через коллектив». Ни о каком личном пространстве осужденного речь не идет, поскольку проживание в общежитиях, где жизненное пространство предоставляется в 4 м2, исключает возможность уединения как днем, так и ночью. При таких условиях, результатом проживания осужденных в общежитиях из‑за большой скученности людей в ограниченном пространстве имеет место проявление среди них тревожно-депрессивных, отрицательно-депрессивных и нервно-истерических реакций. Проживание в таких общежитиях причиняет невосполнимый ущерб личности, способствуя развиию психологической усталости, отчуждению, напряжению, раздраженности, тревожности и угнетенности, что приводит к нервно-психическим перегрузкам, конфликтам и срывам. Длительное нахождение осужденных в агрессивной среде себе подобных без возможности уединения с неизбежностью приводит к психосоматическим изменениям, которые через 5–6 лет лишения свободы приобретают необратимый характер. Таким образом, размещение осужденных в общежитиях приобретает признаки жестокого и унижающего достоинство обращения. Целью статьи является разработка предложений, направленных на преодоление недостатков лишения свободы с отбыванием его в исправительных колониях для того, чтобы на смену лишению свободы, предусматривающему проживание осужденных в общежитиях, пришло тюремное заключение, предоставляющее личное пространство в отдельной комнате каждому заключенному. Изложенный материал позволяет дать следующие предложения: необходимо отказаться от введенного еще в 1920 г. Временной инструкцией Наркомъюста такого вида наказания, как лишение свободы; вместо лишения свободы должно быть наказание в виде тюремного заключения лишь за насильственные преступления против личности; с учетом отрицательного влияния на здоровье человека длительной изоляции максимальный срок заключения не может быть более пяти лет; необходимо исключить возможность применения тюремного заключения к несовершеннолетним; возникла необходимость отказаться от «идеальной зоны» и внедрить новую для Украины архитектурную модель тюрьмы, где не будет размещения осужденных в общежитиях, а каждый заключенный будет обеспечен для проживания отдельной комнатой гостиничного типа, что будет соответствовать Европейским тюремным правилам, с соблюдением санитарно-гигиенических требований к жилой площади и кубатуре помещений хотя бы на уровне ХІХ столетия, какой был в одиночных кельях царских тюрем, то есть площадью не менее 10 м2 и соответственно кубатурой не менее 28 м3. ; У статті звертається увага на те, що за міжнародними документами при розміщенні ув'язнених, надання місць для сну, необхідно ставитися до них з повагою людської гідності із забезпеченням можливості усамітнення в окремому приміщенні. Між тим кримінально-виконавче законодавство України, практика виконання покарання у виді позбавлення волі, просторова структура виправних колоній не надають такої можливості. З моменту свого запровадження у 1920 році позбавлення волі передбачає лише колективне утримання засуджених спочатку у бараках, тепер у гуртожитках, що є матеріальним втіленням ідеї виправлення засуджених «в колективі і через колектив». Ні про який особистий простір засудженого не йдеться, оскільки розміщення у гуртожитках, де житлова площа надається у 4 м2, виключає можливість усамітнення як удень, так і вночі. За таких умов результатом проживання засуджених у гуртожитках через велику скупченість людей в обмеженому просторі є прояв серед них тривожно-депресивних, негативно-депресивних і негативно-істеричних реакцій. Проживання в таких гуртожитках завдає непоправної шкоди особистості, сприяючи розвитку психологічної втоми, відчудження, напруження, роздратування, тривожності і пригніченості, що призводить до нервово-психічних перевантажень, конфліктів і зривів. Тривале перебування засуджених в агресивному середовищі собі подібних без можливості усамітнення з неминучістю призводить до психосоматичних змін, які через 5–6 років позбавлення волі набувають незворотного характеру. Таким чином, розміщення засуджених у гуртожитках набуває ознак жорстокого, нелюдського і такого, що принижує гідність поводження. Метою статті є розробка пропозицій, спрямованих на усунення недоліків позбавлення волі з відбуванням його у виправних колоніях, для того, щоб на зміну позбавленню волі, що передбачає проживання засуджених у гуртожитках, прийшло тюремне ув'язнення, яке надає особистий простір в окремій кімнаті для кожного ув'язненого. Викладений матеріал дозволяє надати такі пропозиції: необхідно відмовитися від запровадженого ще у 1920 р. Тимчасовою інструкцією Нарком'юсту такого виду покарання, як позбавлення волі; замість позбавлення волі має бути покарання у виді тюремного ув'язнення лише за насильницькі злочини проти особи; з урахуванням негативного впливу на здоров'я особи, тривалої ізоляції максимальний строк ув'язнення не може бути більше п'яти років; необхідно виключити можливість застосування тюремного ув'язнення до неповнолітніх; настала потреба відмовитись від «ідеальної зони» і запровадити нову для України архітектурну модель в'язниці, де не буде розміщення засуджених у гуртожитках, а кожний ув'язнений буде забезпечений для проживання окремою кімнатою готельного типу, що відповідатиме Європейським тюремним правилам, з дотриманням санітарно-гігієнічних вимог до житлової площі і кубатури приміщеннях хоча б на рівні ХІХ ст., який був в одиночних келіях царських тюрем, тобто площею не менше 10 м2 і відповідно кубатурою не менше 28 м3.

The article analyzes scientific views on the definition of the concept of forced feeding of convicts as well as the problems of legislative regulation of forced feeding of convicts. The issue of forced feeding of prisoners has become widespread in recent years. The key task of the state is to ensure the rights of individuals in conditions of detention, which would not infringe on its human dignity and do not predetermine suffering in view of the conditions of detention. There are the most violations of human rights in the correctional colonies, the largest number of mass acts of disobedience are held there too. We observe that in recent years such protests are more and more frequent. It should be emphasized that the coercive feeding procedure should not violate the standards defined by the European Court of Human Rights practice. However, when enforcing feeding on convicts, state authorities must comply with the criteria set by the ECHR in their decisions. In addition, it is necessary to reform and work with the personnel of penitentiary institutions. One of the priority tasks to be solved by the modern system of penitentiaries is an individual approach to each convict, taking into account the nature of the character, forecasting possible behavioral variants, which will enable to construct an ideal strategy for quick correction of the convicted person.

В статті розглянуті питання, що пов'язані з протидією розслідуванню злочинів, яка здійснюється організованими злочинними угрупуваннями у виправних колоніях України. Автори визначили протидію організованих злочинних формувань у виправних колоніях як комплекс різноманітних заходів легального та конспіративного характеру, що вчиняються об'єднаними у злочинні співтовариства засудженими, які відбувають покарання, для створення перешкод у розслідуванні злочинів, вчинених у цих установах виконання покарань та в цілому для негативного впливу на стан оперативної обстановки і управління процесами виконання і відбування покарання. За результатами дослідження були запропоновані науково обґрунтовані заходи щодо запобігання і нейтралізації цього суспільно небезпечного явища. In the article the questions concerning counteraction to investigation of crimes which are committed by organized criminal associations in correctional penal colonies of Ukraine have been considered and also science-based measures for preventing and neutralizing this socially dangerous phenomenon have been offered. Counteraction of organized criminal formations in correctional penal colonies should be understood as the complex of various actions of legal and secret character made by united criminal societies of convicts, serving time for this crime, for creation of hindrances in investigation of the crimes committed in these establishments of execution of punishments, and in general for negative influence on a condition of an operational situation and management of processes of execution and serving of this punishment. Counteraction tactic, which is applied by organized criminal groups in correctional penal colonies, is based on such actions, as: a) actions on the organization of criminal activity in these colonies; b) measures aimed to collect the relevant information for planning of crimes; c) the measures providing disguising of criminal activity in correctional penal colonies; d) the actions directed to creation of effective systems of contacts in structures of administration of correctional penal colonies; e) the actions directed to occupation of the real power over convicts in correctional penal colonies; e) power impact on the number of convicts who respect law and order in imprisonment places; e) criminal intelligence activity that is the main weapon in counteraction to investigation of the crimes committed in correctional penal colonies.

Рассмотрено уточнение оснований и условий предоставления осужденным права передвижения без конвоя, согласно действующему российскому законодательству. Перевод на бесконвойное передвижение формально связан с положительной характеристикой осужденных, однако ею прямо не обусловлен. Передвижение осужденных без конвоя или сопровождения, связанное, прежде всего, с отсутствием вооруженной охраны, самостоятельным нахождением вне исправительного учреждения, содержит достаточно высокий уровень благ, что невозможно ни в одних условиях отбывания лишения свободы, даже самых мягких. В этой связи оно фактически представляет собой одну из таких форм исполнения лишения свободы, когда на первый план выступает возможность достаточно эффективной подготовки осужденных к жизни после освобождения из исправительного учреждения на основе объективной оценки степени действительной их исправленности и способности к ресоциализации. Наиболее широкие возможности предоставления осужденным права передвижения без конвоя имеют колонии общего режима для осужденных мужского пола. ; The paper is devoted to clarifying the grounds and conditions of granting the convict the right to move without convoy according to the Russian legislation. Permission to move without convoy is formally connected with the positive character evidence of the convicted, but does not determine it directly. Moving without convoy or escort primarily implies the lack of armed guards, independent stay outside prison, which is a fairly high level of benefits impossible in any other conditions of serving a sentence, even the mildest. In this regard, it actually is one of the forms of imprisonment, which provides an opportunity of quite effective training of the convicted for life their release from a correctional institution on the basis of an objective assessment of the real extent of their correction and ability to re-socialization. General regime penal colonies for male convicts have more potential of granting the right to move without convoy. These are men convicted for crimes committed by negligence, men who committed intentional crimes of little and average gravity with no previous imprisonment, and men sentenced to imprisonment for serious crimes with no previous imprisonment. Unlike male penal colonies of general regime the situation with the possibility of granting the right to move without convoy in female penal colonies of general regime is similar to the male strict regime colony, because they contain persons who committed especially grave crimes, and dangerous recidivists. Prisoners left in detention facilities or jails to perform household duties were carefully examined (during the selection process and in the course of their activities), and almost all of them can later be granted the right to move without convoy. Thus, therapeutic prisons and colonies of strict and general regime, as well as educational colonies and groups of household service at detention centers, prisons and colonies of special regime have a rather large number of convicts (from 30 to 70 %, and for the household service group almost 100 %) potentially able to move without convoy. The grounds for granting this right, in our opinion, are a job outside the correction facility which is connected with movement without convoy or escort, and a positive character evidence of the convict; the condition is that the convicted lacks the features of the category of persons who are not allowed to move without convoy or escort outside the correction facility. This approach stems from the fact that certain legal bases should encourage the change of the legal status of the convict (which the right to move without convoy actually is), however, there must be conditions to follow in order to have such changes. The conditions may be assigned for convicts and for correctional facilities, and their execution may be compulsory for both. So, when moving without convoy, the grounds of having a job outside the correction facility require correctional institutions to give such convicts a job However, Part 1 of Art. 96 of the Correctional Code of the Russian Federation this condition is virtually non-existent, as moving without convoy is applicable in case «if t is necessary by the nature of work. Still, giving jobs to convicts seems to be an important task correctional institutions face.

В статье описываются состояние и организация воспитательной работы с заключенными в исправительно-трудовых учреждениях СССР в годы Великой Отечественной войны. Исходя из понятия воспитательной работы как систематического исправительного воздействия на заключенных, приоритет отдавался культурно - воспитательной составляющей, которая включала в себя проведение политической работы среди заключенных, организацию трудового соревнования, активное участие в вопросах организации их быта, разъяснение правил режима, развитие самодеятельности, культурный отдых и др. Однако состояние культурно-воспитательной работы в отдельных исправительно-трудовых лагерях (ИТЛ) и колониях было неудовлетворительным, а в некоторых ИТЛ она вообще не проводилась. Причиной тому являлось общее плохое физическое состояние заключенных вследствие некачественного питания, болезней, высокой смертности, а также недостаточного внимания подбору кадров сотрудников, осуществлявших культурно-воспитательную работу в местах лишения свободы. Приведены примеры участия заключенных в обеспечении фронта финансовыми и материальными средствами. Несмотря на сложность обстановки в исправительно-трудовых лагерях и колониях в военные годы, воспитательная работа носила содержательный, планомерный, патриотический характер, являлась одним из эффективных средств исправления лиц, находящихся в местах лишения свободы. ; The article describes the status and organization of educational work with prisoners in corrective-labour establishments of the USSR in the great Patriotic war. Based on the concept of educational work as a systematic correction of prisoners, priority was given to the cultural and educational component, which included the holding of political prisoners, the organization of labor competition, and active participation in the organization of their life, explaining the rules of the regime, the development of talent, culture, etc. However, the status of cultural-educational work in separate correctional-labor camps (ITL) and the colonies were poor, and some ITL she was not conducted. The reason for this was the General poor physical condition of the prisoners due to poor nutrition, disease, high mortality and insufficient attention to recruitment of employees, carrying out cultural and educational work in places of deprivation of liberty. This article explores the connection between the Congregation of the Holy Spirit (Spiritans) and the Elsinore Bennu Think Tank for Restorative Justice (EBTT). The Spiritan's historic involvement in the liberation, healing and restoration of enslaved men, women, and children in French colonies, as well as the establishment of local churches in Africa, inspires the human spirit to equitable relationships between peoples. Shifting from that global perspective, we consider their local efforts in founding Duquesne University as an institution of higher education for the children of immigrant steelworkers. Moving to the present, we note the genesis of The Inside-Out Prison Exchange Program at Duquesne, the formation of the EBTT at the State Correctional Institution in Pittsburgh. EBTT members are committed to collaborative community efforts as a way for people damaged by circumstance and systems of oppression to remake themselves, recognizing that remade people are needed to restore a broken society.

AbstractTom L. Johnson made his mark on politics far from Capitol Hill, in the gritty world of turn‐of‐the‐century Cleveland, Ohio. Barely 30 years old and at the height of a successful career as an inventor, steel manufacturer, and street railway monopolist, Tom Loftin Johnson experienced a change of heart. After discovering the ideas of Henry George, Johnson became a lifelong advocate of the single tax, which he used to guide his new career in politics. In 1901, Cleveland voters elected Johnson to the first of his four terms as mayor of the industrial city of 400,000 people. During his eight‐year reign as chief executive, Cleveland took over essential services such as garbage collection, street cleaning, and lighting from private enterprise. Johnson helped humanize the city's correctional system by replacing the old workhouse with a network of farm colonies designed to rehabilitate wayward youths and adults convicted of petty crimes. Largely as a result of Johnson's efforts, Cleveland won constitutional home rule, a lower streetcar fare, the referendum, and higher taxes on the corporations that amassed giant fortunes through perpetual public franchise grants. For a short time, while he was still mayor, Cleveland owned and operated its own streetcar company, a rarity in early 20th‐century America. All of these accomplishments made Johnson something of a hero to progressive reformers. The muckraker Lincoln Steffens famously called Johnson "the best Mayor of the best‐governed city in the United States."

AbstractHow did the abolition of slavery influence the relations between urban centres and rural areas? How did "new" French citizens experience access to the urban environment? Based on the archives of the correctional courts, this article focuses on how race and citizenship determined the accessibility of French colonial urban spaces and institutions after 1848. The abolition of slavery in the French Antilles on 27 April 1848 led to a modification of the legal and judicial systems: the changing legal status of former slaves gave them new opportunities to move around the colonies, at least on paper. In theory, after 1848, everyone should have had freedom of social and spatial mobility and access to the urban centres and their institutions; what happened in practice, however, still needs to be researched. This article shows that the abolition exacerbated two dynamics already at play since the beginning of the nineteenth century: the control of the population and the attraction of the urban environment for the elite. The plantation system in the mid-nineteenth century was suffering both economically and politically: the newly acquired freedom and possible migration of former slaves to the towns (Saint-Pierre and Fort-de-France in Martinique, Pointe-à-Pitre and Basse-Terre in Guadeloupe) threatened to destabilize the system of private justice as well as the economic apparatus. To counteract these legal changes, vagrancy laws were implemented to restrict citizens' mobility while, at the same time, the white elite's discourse on urban spaces changed from them being seen as a hotbed for revolutionary ideas to representing a safe environment to which access needed to be restricted.
