Vloga Uradniškega sveta pri imenovanju najvišjih javnih uslužbencev v Sloveniji ; The role of the Officials Council in appointing the high-ranking civil servants in Slovenia
Uradniški svet je samostojen in neodvisen organ, ki je bil ustanovljen z namenom depolitizacije državne uprave. Člani Uradniškega sveta določijo standarde in normative ter merila za izbiro kandidatov, ki se prijavijo za položaj najvišjih javnih uslužbencev. Kadar slišimo pojem politizacije se nam takoj ustvari nekakšna slika kako politika skozi politično kadrovanje poskuša vplivati na delovanje državne uprave in tako uveljaviti svoje interese in cilje. Politizacija ni nov pojav in tudi ne redek, z njo se srečujemo vsak dan in na vseh nivojih upravljanja (lokalnem, nacionalnem in nadnacionalnem). Avtor zaključnega dela raziskuje spolitiziranost Uradniškega sveta, cilj naloge pa je kako in na kakšen način se odraža spolitiziranost Uradniškega sveta in kako le ta vpliva na imenovanje najvišjih javnih uslužbencev v Sloveniji. Na podlagi vprašalnika, intervjujev ter analize dela je avtor prišel do ugotovitev, da lahko zasledimo obrise spolitiziranosti Uradniškega sveta. Bolj kot spolitiziranost Uradniškega sveta pa se kaže kako in na kakšen način poskuša politika imenovati najvišje javne uslužbence. ; Officials Council is body outside the government and was established to depoliticize administration in Slovenia. Members of Officials Council set standards, norms and criteria for the selection of candidates for the position of senior civil servants. When we hear the notion politicization, we immediately think how politics try to influence and enforce their interest threw a form of political recruitment in administration. Politicization is not a new phenomenom and it is not uncommon. We can find politicization at every level of governance (local, national and even transnational). The author researches the politicization of the Officials Council. In particular, he is interested in how and in what way the politicization of the Officials Council is reflected and how it affects the appointment of the highest civil servants in Slovenia. Through in-depth interviews, questionnaire and analysis of the work of Officials Council the author found out that we can see politicization of the Officials Council, but more than that we can see how politics try to affect on appointing the high-ranking civil servants.

Prispevek v luči slovenskega predsedovanja Svetu EU v prvi polovici leta 2008 predstavi institucijo Svet EU in organizacijske, posredniške, politične in nacionalne vloge, ki jih uresničuje predsedujoča država. Obravnavan je slovenski gozdno-politični okvir, ki vpliva na usmeritev za posamezno vlogo inpredstavljena teza, da sta za Slovenijo najpomembnejši organizacijska in nacionalna vloga. V okviru nacionalne vloge je pomembno pridobiti nove ideje za vsebino gozdne politike in znanja o procesu njenega oblikovanja na domači ravni in ravni Unije. ; In the light of the Slovenian presidency of the EU Council in the first half of the year 2008, the contribution presents the Council of the European Union (the EU Council) as an institution and the organizational, mediatory, political and national roles performed by the presiding state. The framework of the Slovenian forest policy is discussed, which influences the policy regarding each individual role, and the thesis presented by which the most important roles for Slovenia are the organizational and national role. Within the national role it is important to acquire new ideas regarding forest policyas well as the skills and knowledge regarding the drafting of forest policy on the level of the state and the EU.

Vloga in izzivi Varnostnega sveta OZN pri uveljavljanju odgovornosti zaščititi ; The Role and Challenges of the UN Security Council in the enforcement of the Responsibility to Protect
Pri izpolnjevanju svoje primarne naloge ohranjanja mednarodnega miru in varnosti, ki mu jo nalaga Ustanovna listina Organizacije združenih narodov, Varnostni svet Združenih narodov deluje predvsem v okviru II. in III. stebra odgovornosti zaščititi. Nabor ukrepov, ki jih pri tem uporablja, je kljub temu, da je Varnostni svet edini organ, ki lahko zakonito po VII. poglavju Ustanovne listine odobri izjemo od splošne prepovedi uporabe sile, bistveno širši od gole uporabe sile, ki je bila brez privolitve države doslej odobrena le enkrat, leta 2011 v Libiji. Hipoteza naloge je, da potencial, ki ga odgovornost zaščititi ponuja pri reševanju kompleksnih kriznih situacij, ki lahko vodijo k množičnim grozodejstvom, ni docela izkoriščen zaradi nepopolnega uveljavljanja, ki je predvsem posledica blokade Varnostnega sveta zaradi uporabe veta stalnih članic. Izziv so tudi različne razlage njegovih resolucij, ki so že večkrat privedle do očitkov, da izvajalci resolucij slednje izrabljajo z namenom menjave režima v posameznih državah. Zaradi hudih posledic neaktivnosti z vetom blokiranega Varnostnega sveta, kar se kaže zlasti v primeru Sirije, so se kot alternativne možnosti delovanja mednarodne skupnosti v situacijah, kjer je uporabljiva odgovornost zaščititi, pojavile delovanje preko Generalne skupščine Združenih narodov na podlagi resolucije ˝Združeni za mir˝, regionalnih organizacij (denimo po vzoru Afriške unije) ter intervencija ad hoc koalicij. Ker nobena od navedenih možnosti ne ponuja primerne alternative odločitvi Varnostnega sveta, sta se v okviru odgovornosti neuporabe veta oblikovali dve pobudi za reformo odločanja v Varnostnem svetu, ki predlagata vzdržanje stalnih članic od uporabe veta v primerih štirih grozodejstev, vendar je njuna uspešnost vprašljiva, saj zaenkrat nobena od njiju nima podpore vseh petih stalnih članic. ; Authorized by the Charter of the United Nations, the United Nation Security Council fulfills its primary task of maintaining international peace and security by acting primarily within Pillars II and III of the Responsibility to Protect. Despite the fact, that the Security Council is the only body entitled to legally authorize an exception to the general prohibition of the use of force, this is only one of many measures it can adopt. In fact, the use of force against the will of a state has only been carried out once, in 2011 in Libya. The hypothesis of the present thesis is that the potential that the Responsibility to Protect offers in addressing crisis situations that could lead to mass atrocities is not fully utilized due to a blockage imposed by a veto from a permanent member state. The rising reproaches that those carrying out the resolutions exceed their mandates by changing the regimes in some states also represent a great challenge. This is caused by different interpretations of the language of the resolutions. Due to major consequences of the Security Council's inactiveness, as seen primarily in Syria, some suggestions of alternative actions that could be taken by the international community include acting through the United Nations General Assembly and its ˝Uniting for Peace˝ resolution, regional organizations (following the example of the African Union) and intervention by ad hoc coalitions. Since none of the mentioned possibilities represent a suitable alternative to a decision of the Security Council, two petitions in light of the Responsibility not to Veto have arisen. They suggest the permanent members abstain from the use of veto in the cases of four mass atrocities. Their success, however, is questionable, since neither has so far obtained the support from all five permanent members.

Vloga zunanjih akterjev pri reševanju izraelsko-palestinskega konflikta: primer Sveta za sodelovanje v zalivu ; The role of external actors in managing the Israeli-Palestinian conflict: the case of the Gulf Cooperation Council
Zunanji akterji igrajo poglavitno vlogo pri upravljanju in reševanju konfliktov, saj s svojimi kapacitetami lahko prispevajo k reševanju vzroka konflikta in k delnemu spreminjanju ter izpolnjevanju ciljev sprtih strani. Med najbolj trdovratne konflikte uvrščamo verske in druge identitetne konflikte, saj identiteta vpliva na prepričanje posameznika in skupine o svoji vlogi oz. položaju v konfliktu. Prednost pri zaznavanju in reševanju tovrstnih konfliktov pa imajo zaradi svojega poznavanja območja in akterjev predvsem regionalne organizacije, med njimi tudi države članice Sveta za sodelovanje v zalivu (Gulf Cooperation Council – GCC), ki so dejavne pri upravljanju in reševanju izraelsko-palestinskega konflikta. Magistrska naloga preučuje vpliv verskega dejavnika na vlogo arabskih zalivskih držav pri reševanju konflikta od ustanovitve Izraela leta 1948 do katarske diplomatske krize leta 2017 ter posledice razmaha šiitsko-sunitskega razkola na njihovo vlogo. Kot kažejo ugotovitve, so arabske zalivske države v obdobju od leta 1948 do leta 2011 vztrajno poskušale rešiti konflikt v prid palestinskega prebivalstva, z razmahom šiitsko-sunitskega razkola med arabsko pomladjo pa je iranska grožnja zasenčila reševanje izraelsko-palestinskega konflikta. Zunanji akterji, predvsem regionalne organizacije, so torej občutljive na mednarodno in regionalno dogajanje ter morebitne spremembe dinamike konflikta. Slednje posledično vpliva na vlogo zunanjih akterjev pri reševanju konfliktov, ki se v luči sprememb strukturnega okolja iz pozitivne lahko prelevi v negativno. ; External actors play a key role in conflict management and resolution, as they can contribute to resolving the cause of the conflict and partially changing or meeting the goals of the conflicting parties. Among the most persistent conflicts are religious and other identity conflicts, since identity influences the belief of an individual and a group about their role in the conflict. Due to their knowledge of the region and actors, the advantage in detecting and resolving such conflicts lies particularly with regional organizations, including the Gulf Cooperation Council (GCC) member states, which are actively engaged in the management and resolution of the Israeli-Palestinian conflict. The master's thesis examines the influence of the religious factor on the role of the Arab Gulf states in resolving the Israeli-Palestinian conflict since the founding of Israel in 1948 up until the Qatar diplomatic crisis in 2017, and the consequences of the intensification of the Shiite-Sunni divide on their role. In the period between 1948 and 201 the Arab Gulf states persistently sought to resolve the conflict in favor of the Palestinian population ; however, with the intensification of the Shiite-Sunni divide during the Arab Spring, the Iranian threat overshadowed the resolution of the Israeli-Palestinian conflict. External actors, especially regional organizations, are therefore sensitive to international and regional developments, as well as possible changes in the dynamics of the conflict. The latter consequently influences the role of external actors in managing and resolving conflicts, which can change from positive to negative, in the light of changes to the structural environment.

Strukturna naddoločitev izobraževalnih reform in delovanje ; Structural over-determination of education reforms and agency
Članek poskuša konceptualizirati odnos med individualnim (stro-kovnim) in strukturnim v obdobju razmeroma korenitih sprememb v družbi. Izzivalna in razkrivajoča dialektika takih odnosov je analizirana s kombinacijo avtoetnografskih razmislekov, ob naslonitvi na arhivske dokumente, ki prikazujejo spremembe v delovanju strokovnega sveta v državi, ki je doživela tri temeljne miroljubne prehode in se tudi spopadla z njimi: prehod iz samoupravnega socialističnega gospodarstva v tržno gospodarstvo, prehod iz enopartijskega socialističnega sistema v repre-zentativno liberalno demokracijo in prehod iz republike, ki je bila del zvezne države, v neodvisno državo. Strokovni svet Socialistične republi-ke Slovenije (takrat še del Socialistične republike Jugoslavije), pozneje preimenovan v Strokovni svet Republike Slovenije (takrat že liberalna demokracija s tržnim gospodarstvom in z neodvisno državo), lahko slu-ži kot primer produktivnega prepletanja individualnega (strokovnega) in strukturnega pri oblikovanju in izvajanju preobrazbe izobraževalnega sistema. Kontekstualizirani prikaz in ocena premikov, ki so skupaj pri-pomogli k nastanku neodvisne države in njenega oblikovanja izobraže-valnega sistema, opisuje zapletenost in pomen refleksivnega upravljanja v času tranzicije, ki sama po sebi v ospredje postavlja vrsto pomembnih vprašanj ter vabi in podpira spremembe v izobraževalnem sistemu. Ta-kšne priložnosti država in njeni edukatorji ne bi smeli zamuditi. ; This article attempts to conceptualise the relationship between the indi-vidual (professional) and the structural in a period of relatively radical changes in society. The challenging and revealing dialectic of such rela-tions is analysed through the combination of auto-ethnographic reflec-tions and archival documents showing the changes in the functioning of a council of experts in a country that experienced and coped with three fundamentally peaceful transitions: the transition from a self-managed socialist economy to a market economy, the transition from a one-party socialist system to a representative liberal democracy, and from a re-public that was part of a federal state to an independent state. The Ex-pert Council of the Socialist Republic of Slovenia (then still part of the Socialist Republic of Yugoslavia), later renamed the Expert Council of the Republic of Slovenia (at that time a liberal democracy with a mar-ket economy and an independent state), can serve as an example of the productive intertwining of individual (expert) and the structural in the formulation and the implementation of the functional transformation of the educational system. The contextualised account and assessment of the shifts that together helped bring about the independent state and its education system formation outlines the complexity and importance of reflexive governance in the times of transition, which, in itself, brings to the fore a number of relevant issues and invites and supports change in the educational system. Such an opportunity should not be missed by the country and its educators.

After explaining the difference between the notions of self-government & local autonomy, the applicability of both to the description of the political-administrative status of the Slovene city of Ljubljana in the 19th-century Austrian Empire is examined. The Austrian March Constitution of 1849, its abolishment by the emperor Franz Joseph in 1851, the municipalities law of 1849 & 1862, & December Constitution of 1867 are some of the legal acts examined in the outline of the chronology of the self-government & autonomy of Ljubljana as a provincial capital in the Austrian Empire. The powers & prerogatives contained in the city's municipal statues are discussed, considering the relationship & power sharing between the state & municipalities in the Austrian Empire & the Austria-Hungary dual monarchy. The study of the Ljubljana archive sources concludes that prior to 1895, the city's municipal council powers to issue normative legislation were limited, & an increased norm-giving activity resulted only from the need to rebuild the city after the 1895 earthquake. The council's municipal autonomy was largely responsible for regulating all reconstruction activities, including the organization & modernization of transport, electrification, & other infrastructure. Pojmovanje varnosti in upravljanje konfliktov: primer ukrajinskega konflikta ; Concept of security and conflict management: the case of the Ukrainian conflict
Spremembe v mednarodni skupnosti po koncu hladne vojne so mednarodne institucije, ki delujejo na področju zagotavljanja miru in varnosti, postavile pred nove izzive, ki so izpostavili pomanjkljivost obstoječh norm, mehanizmov in konceptualnega aparata za naslavljanje novih varnostnih groženj. Mednarodne institucije se težko spopadajo z modernimi varnostnimi grožnjami, med katere spadajo tudi etnični konflikti, hkrati pa je proces prepoznavanja varnostnih groženj kompleksen. Magistrska naloga skozi študijo primera delovanja Varnostnega sveta in Organizacije za varnost in sodelovanje v Evropi v ukrajinskem konfliktu preučuje, kako pojmovanje varnosti mednarodnih institucij vpliva na upravljanje (etničnih) konfliktov. Naloga pokaže, da sodobno pojmovanje varnosti presega dojemanje države kot edinega relevatnega referenčnega objekta varnosti in da je varnost intersubjektivna kategorija, ki odpira vprašanje glede procesa prepoznavanja (novih) varnostnih groženj. Posledično pojmovanje varnosti vpliva na diskurz in delovanje akterjev. Na primeru Varnostnega sveta tako vidimo, da se države članice zavedajo pomena vzpostavljene prakse delovanja, ki izhaja iz pojmovanja varnosti dotične institucije, ter njenega vpliva na odločanje v Varnostnem svetu. OVSE pa kljub prepoznavanju kršitev določenih prvin varnosti v praksi te kršitve težko naslavlja. Naloga pokaže tudi, kako specializirano znanje posameznih institucij vpliva na diskurz držav v teh institucijah ter da pojmovanje varnosti v posameznih institucijah ni statično, temveč rezultat nenehnih (re)interpretacij. ; Changes in the international community after the end of the Cold War have led international institutions working in the field of peace and security to face new challenges that have highlighted the disadvantage of existing norms, mechanisms and conceptual apparatus for addressing new security threats. International institutions are struggling to deal with modern security threats, including ethnic conflicts, while the process of identifying security threats is complex. The master's thesis examines how the concept of security of international institutions influences the management of (ethnic) conflicts through a study of the functioning of the Security Council and the Organization for Security and Co-operation in Europe in the Ukrainian conflict. Thesis demonstrates that modern concept surpasses the perception of the state as the only relevant referent object of security and that security is an intersubjective category that raises the issue of the process of identifying (new) security threats. As a consequence the concept of security affects the discourse and the functioning of the actors. In the case of the Security Council, we can see that Member States are aware of the importance of the established practice, which stems from the concept of security of the institution, and its impact on decision-making in the Security Council. Despite the recognition of violations of certain elements of security in practice, the OSCE has difficulty addressing this violation. The thesis also shows how the specialized knowledge of individual institutions influences the discourse of states in these institutions, and that the concept of security in individual institutions is not static, but the result of continuous (re)interpretations.

Mednarodni kazenski pregon in človekove pravice tujih terorističnih borcev ; International prosecution and human rights of foreign terrorist fighters
POVZETEK MEDNARODNI KAZENSKI PREGON IN ČLOVEKOVE PRAVICE TUJIH TERORISTIČNIH BORCEV Avtor: Rok Petročnik Mentorica: izr. prof. dr. Vasilka Sancin V magistrski nalogi sem raziskoval nastanek fenomena tujega terorističnega borca, njihov mednarodni kazenski pregon in kršitve njihovih temeljnih človekovih pravic v domačih kazenskih pregonih. Varnostni svet OZN je leta 2014 na podlagi VII. poglavja Ustanovne listine OZN sprejel Resolucijo 2178, ki podaja opis tujega terorističnega borca, vendar ne loči med oboroženimi spopadi in terorizmom. Resolucija 2178 opisuje tujega terorističnega borca kot posameznika, ki potuje v tujino z namenom izvedbe ali sodelovanja v terorističnem napadu, medtem ko je tuji borec posameznik, ki odpotuje v tujino z namenom pridružitve oboroženim spopadom. V raziskavi sem prišel do sklepa, da trenutno ne obstaja mednarodni kazenski pregon tujih terorističnih borcev, saj pregon izvajajo države same pred nacionalnimi sodišči. Varnostni svet OZN je pregon tujih terorističnih borcev preložil na države članice OZN, in sicer z vzpostavitvijo različnih odborov za nadzor izvajanja sankcij Varnostnega Sveta, kot so Sankcijski odbor 1267 in Skupina za analitično podporo in nadzor sankcij. V primerih Nada, Ahmed in Abdelrazik so nacionalna sodišča zaradi kršitev temeljnih človekovih pravic s sodbami razveljavila državne upravne akte, ki so vpeljevali sprejete protiteroristične resolucije Varnostnega sveta. Podobno je naredilo sodišče EU v primeru Kadi, kjer je bila razveljavljena uredba, ki je vpeljala sankcije Varnostnega sveta. Sodbe nacionalnih in sodišč v EU so bile glavni dejavnik za spremembo mednarodnopravnega okvirja terorizma OZN in za posledično večji poudarek na spoštovanju temeljnih pravic, ki jih zagotavlja Evropska konvencija o človekovih pravicah. ; ABSTRACT INTERNATIONAL PROSECUTION AND HUMAN RIGHTS OF FOREIGN TERRORIST FIGHTERS Author: Rok Petročnik Mentor: Vasilka Sancin, PhD, Professor In master's thesis i explored the emergence of the foreign terrorist fighter phenomenona, international prosecution of foreign terrorist fighters, and the violation of the fundamental rights of foreign terrorist fighters in domestic prosecutions. UN Security Council in 2014 adopted Resolution 2178 under Chapter VII of the UN Charter. However, while the Resolution outlines the description of a foreign terrorist fighter, it fails to distinguish between armed conflicts and terrorism. Resolution 2178 defines foreign terrorist fighters as individuals who travel to a state other than their states of residence or nationality for the purpose of the perpetration, planning, or preparation of, or participation in, terrorist acts or the providing or receiving of terrorist training, including in connection with armed conflict, while foreign fighter is an individual who travels abroad with intention to join armed conflict. The research led to the conclusion that there is currently no international prosecution of foreign terrorist fighters because states carry it out before national courts. UN Security Council has placed the burden of prosecuting foreign terrorist fighters on UN Member States by establishing different committees monitoring the implementation of the Security Council sanctions, such as the 1267 Committee and the Analytical Support and Sanctions Monitoring Team. In the cases of Nada, Ahmed and Abdelrazik, national courts due to violations of fundamental rights, repealed national administrative acts that introduced the adopted UN Security Council counter terrorism resolutions. The Court of Justice of the EU made a similar decision in the case of Kadi by repealing the regulation introducing the UN Security Council sanctions. Judgements of national and EU courts were the main factor in changing the UN terrorism framework in terms of international law, thus shifting the focus on the respect of fundamental rights as guaranteed by the European Convention on Human Rights.

THE LEGAL STATUS OF ALIEN COMBATANTS IN THE UKRAINIAN ARMED FORCES WITHIN THE CONTEXT OF THE INTERNATIONAL JUDICIAL REALITY

The decision by the Council of Europe to ter minate the Russian Federation's membership of the Council of Europe on 16 March 2022 makes the issue of legal certainty for aliens actively participating in the war in Ukraine as part of the Ukrainian Armed Forces completely unpredictable. The academic literature and the case law of the European Court of Human Rights in the field of the legal status of alien combatants is limited, and the International Criminal Court has not complet ed any cases on this topic. This article addresses the prin ciple of case law and, above all, the principle of legality with regard to aliens and their active participation in the armed forces of Ukraine. This issue has become cen tral since the Russian Federation may or may not grant these persons the status of prisoner of war according to the Third Geneva Convention, relating to Protocol I, or may characterise them as criminal offenders or terro rists.
