ABSTRACT Access to justice is the concrete means of asserting everyone's right to respect for provisions protecting the environment. Does the European Union have vocation to guarantee effective judicial protection? This article presents a difference in treatment by Union law of access to national judges and access to his own court. Indeed, if access to national judges in litigation environmental rights, is widely promoted by Union law the access to Court of Justice is, on the contrary, rigorously framed in the law of the Union and in despite proposals and demands, no substantial development can be in the area of the environment.

This research attempts to shed light on the role of the international Court of Justice (ICJ) and the significance of its adjudicatory and advisory functions. The theme of this research will initially project a brief introduction of the topic in question, keeping in view the historical and contemporary perspectives of the ICJ. This research also focuses on the organizational structure of the United Nations, keeping in view the position and role of the ICJ within the organization. With practical examples of case laws, the ambit of judicial review in the context of judicial and advisory function of ICJ will also be taken into account. The article examines international experience in the field of judicial protection of land rights and settlement of land disputes. The author analyzes the legal structure of a series of countries of the world and the practice of the specialized judicial agencies. The positive experience of the work of land courts, achieved by different States, is summarized. The analysis of the jurisdiction of land and environmental courts of Australia, Scotland, Sweden, the USA, the Dominican Republic is conducted. On the basis of the conducted research the author gives reasons for a set of proposals concerning the organization of work of the specialized land courts in the Russian Federation.

Currently in the legislative, judicial, doctrinal,scientific and academic environment is frequently addressed the important question of evidence, so the finality of this research project is a break in the schemes that exist in this area, based on the concept of guardianship right to effective judicial proof, thus beginning a study concerning Supreme Court as the United States and the European Court of Human Rights to focus on the "OstravaCase", which proved a serious difficulty indirect discrimination probation using statistics evidence. In addition, background review of the Model Code of collective processes for Latin America and the Colombian law 472 of 1998 that provide statistics used for evidentiary purposes, allowing identify the statistical evidence as ideal for the protection of vulnerable populations and condition of discrimination in the absence of evidence substantiating the need for security and protection of their situation. Defending the thesis and descriptive statistics as evidence in serious difficulty collective facts and therefore evidence as to propose to his own substantial regulatory proceedings before international and national courts. Then a catalog of evidence subject only to traditional evidence contrasts with the evolution of law in the "modern world". ; Actualmente en el ámbito legislativo, jurisprudencial, doctrinal, científico y académico, se aborda con frecuencia la importancia del tema probatorio, así que el objetivo de este proyecto de investigación es un rompimiento a los esquemas que existen en esta materia, fundamentado en el concepto de tutela judicial efectiva y el derecho a la prueba, iniciando de esta forma un estudio con referentes como la Corte Suprema de Estados Unidos de América y el Tribunal Europeo de Derechos Humanos, enfocándose en el "Caso Ostrava", donde se probó una discriminación indirecta de seria dificultad probatoria, usando evidencias estadísticas. Además se revisan antecedentes del Código Modelo de Procesos Colectivos para Iberoamérica y de la ley Colombiana 472 de 1998, que contemplan usar estadísticas con fines probatorios, lo que permitirá identificarla como evidencia adecuada para la protección de poblaciones vulnerables y en condición de discriminación, ante la carencia de medios probatorios que avalen la necesidad de garantía y tutela de su situación. Defendiendo así la tesis de la estadística descriptiva como medio de prueba en hechos colectivos con seria dificultad probatoria y por tanto llegar a proponer su regulación sustancial propia para procesos ante tribunales internacionales y nacionales. Luego, un catálogo probatorio sujeto solo a medios de prueba tradicionales contrasta con la evolución del Derecho en el "mundo moderno"

The realization of expert court reports by anthropologists has begun to be relatively frequent in Latin America in the context of trials related to native peoples and other areas of conflict such as femicides. However, there is a scarce bibliography on the implications that these expert reports have for the discipline itself and, especially, on the ethical dilemmas, the political repercussions and the epistemological adjustments that this practice proposes. This text analyzes these aspects using the process of creatingthe first anthropological expert report on the victims of Francoism, made in Spain in 2012, in which the author of this article participated. ; El artículo reflexiona sobre la elaboración de un peritaje antropológico realizado conjuntamente por cinco antropólogos en relación con un procedimiento seguido en el Tribunal Europeo de Derechos Humanos contra el España sobre el posible desasistimiento de las víctimas del franquismo. El artículo aquí presentado reflexiona sobre las condiciones en que dicho peritaje se realizó, así como cuáles fueron los principales condicionantes tanto teóricos como metodológicos para llevarlo a efecto [ES] La realización de peritajes jurídicos por parte de antropólogos ha comenzado a ser relativamente frecuente en América Latina en el contexto de juicios relacionados con los pueblos originarios y otros ámbitos de conflicto como los feminicidios. For some decades, the actions of the Teaching Career QualifyingCourt (TCCD) have been the object of accusations for the inadequate applicationof discretion within the process of awarding teaching positions and school managers in the public sector. Therefore, this article takes up an exploratory investigation on the performance of this ministerial entity in the period 2014-2018. Themethodological design implemented was intensive (qualitative); that is, throughan inferential analysis, applied mainly to official documents, an attempt has beenmade to determine the factors that have influenced the proceedings of this courtAmong the findings can be mentioned gaps in the legislation and the inappropriate use of discretion by the TCCD in the process of assigning places. This work focuses on a compared analysis of the South Afri- can decision related to the "peace and reconciliation act" of this country's Parliament, and the Colombian decision regarding the amendment of the constitution called "The juridical framework for the peace." Turning to the structure, it is developed in three major topics: 1. It provides a brief of the historical context, political background and an overview of the two decisions.2. It gives a structural analysis of the powers that each Court has and the nature of the constitutional mechanism through which both Courts decided the constitutionality of the said norms 3. It presents a critical analysis on the similarities and differences between the two systems and judgments. It presents some con- clusions.

Summary The legitimacy of the Inter-American Court of Human Rights has been called into question both by doctrine and by some states under its jurisdiction. As part of the wider debate on the legitimacy of courts and international law, responses are sought to these criticisms from this legal system, in so far as the Court is a party to it, and to the foundations of the legal binding nature of international law, taking into account both the best philosophical proposals and the reality of current international law. It is concluded that the work of the IDH Court is a feature of contemporary international human rights law which not only enjoys legitimacy in itself, but is a source of legitimacy for international law as a whole. ; Resumen La legitimidad de la Corte Interamericana de Derechos Humanos ha sido cuestionada tanto por la doctrina como por algunos Estados sometidos a su jurisdicción. Dentro del debate más amplio sobre la legitimidad de los tribunales y el Derecho internacional, se buscan respuestas a dichas críticas desde este ordenamiento jurídico, en la medida en que la Corte es un tribunal parte del mismo, y en los fundamentos de la obligatoriedad jurídica del Derecho internacional, atendiendo tanto a las mejores propuestas filosóficas como a la realidad del Derecho internacional actual. Se concluye que la labor de la Corte IDH es característica del Derecho internacional contemporáneo de los derechos humanos que no solo goza de legitimidad en sí mismo, sino que es fuente de legitimidad del Derecho internacional en su conjunto.

In recent years, the foreign investment regime has been subject to an increasing volume of criticism from the public. The significant sums of money at stake and the potential impact of the awards on State's regulatory powers have placed the Investor-State Dispute Settlement (isds) under the spotlight. In response to this, the European Union has proposed a far-reaching reform which introduces an Investment Court System (ics). This model constitutes an innovative dispute settlement mechanism intended to address most of the core issues of the isds by combining elements of the traditional isds with judicial features. Overall, this paper aims at analysing whether the EU's new approach constitutes an effective improvement to the traditional isds and the future of the international investment regime. To achieve this, the study begins with an overview of the current isds; followed by a synopsis of the main criticisms to the traditional isds; proceeded by a review of the core features of the EU's proposed ics and its inclusion in the new generation of iias in negotiation by the EU; and finally, provides a commentary of the main criticisms and obstacles that the introduction of the ics is likely to encounter. ; En los últimos años, el régimen de inversión extranjera ha sido objeto de un creciente número de críticas del público. Las sumas significativas de dinero en juego y el posible impacto de los laudos en los poderes regulatorios del Estado han puesto al actual Sistema de Resolución de Controversias entre Inversores y el Estado bajo la lupa. En respuesta a ello, la Unión Europea ha propuesto una reforma de gran alcance mediante la introducción de un Sistema de Corte de Inversiones (sci). El nuevo sistema constituye un mecanismo innovador de resolución de controversias internacionales destinado a remediar los problemas centrales que acarrea el sistema actual, mediante la combinación de elementos tradicionales del arbitraje con rasgos judiciales. En este contexto, el presente escrito pretende analizar si el nuevo enfoque de la Unión Europea constituye una mejora efectiva del actual mecanismo de resolución de controversias de inversiones y del futuro del régimen de inversión internacional. Para dicho propósito, el artículo comienza con una descripción general del actual Sistema de Resolución de Controversias entre Inversores y el Estado; seguido de una sinopsis de sus principales críticas; continúa con un resumen de las principales características del Sistema de Corte de Inversiones, así como de su inclusión en la nueva generación de acuerdos internacionales de inversión en negociación por la Unión Europea; y, finalmente, hace una referencia a las principales críticas y posibles obstáculos que afrontará la introducción del nuevo Sistema de Corte de Inversiones.

[ES] El libro editado por Andrea Castagnola y Saúl López Noriega, Judicial Politics in Mexico: The Supreme Court and the Transition to Democracy, constituye un trabajo innovador cuya principal virtud es analizar, de una manera convincente y sugerente, el papel que la Suprema Corte de Justicia jugó en las vicisitudes del largo y complejo proceso de democratización en México. No parece un elogio inmerecido afirmar que, hasta la publicación de este volumen, no existía investigación escrita que hubiese abordado, de un modo tan sistemático en términos teóricos y tan informado empíricamente, el estudio de la máxima institución del poder judicial en aquel país y que, al mismo tiempo, analizase los vínculos del comportamiento de la Suprema Corte de Justicia con los progresos y las regresiones de la democracia mexicana.

This paper submits to critical analysis both the argument used to justify the traditional approach to the study of the Supreme Court ́s production and its retort. Next, the paper presents the texts that conform "The Genaro Carrió Court". It concludes that, while each text is independent, they share a common argumentative line centered on the historical moment in which the court has to act as well as the concern to lay the foundations of a culture of argument for a democratic society. ; El trabajo somete a análisis crítico tanto el argumento desplegado para justificar el enfoque tradicionalmente aplicado al estudio de la producción de la Corte Suprema, como su réplica. Presenta, a continuación, los textos que conforman La Corte Genaro Carrió. Concluye que, si bien cada texto es independiente, se enlazan entre sí a partir de una línea argumentativa común centrada en el momento histórico en el que le toca actuar al tribunal y la preocupación por sentar las bases de una cultura del argumento para una sociedad democrática.

En América Latina los procesos políticos por el reconocimiento de los derechos sexuales y reproductivos han generado una serie de disputas entre sectores antagónicos. Por un lado, los movimientos feministas y LGBTTI pugnan por la inclusión y ampliación de estos derechos en las políticas públicas. Frente a ellos, se viene consolidando un activismo de oposición cada vez más complejo que trasciende a los actores religiosos que históricamente han defendido una moral sexual conservadora. Desde la sociedad civil, se han conformado una serie de ONG que privilegian la judicialización y el uso de un lenguaje de derechos humanos como estrategias de impacto político y social. Este trabajo identifica y analiza la configuración y evolución de las ONG católicas "Pro-Vida" de cohorte católico en Argentina en su accionar frente a las Cortes ; In Latin America, a political process for the recognition of sexual and reproductive rights has generated a series of disputes between opposing sectors. On one hand, feminist and LGBTTI movements struggle for the inclusion and broadening of these rights in public policies. On the other hand, a more complex opposition activism is consolidating, that transcends the religious actors that have historically defended conservative sexual morals. From civil society, a series of Catholic NGOs have been formed that privilege legal strategies and the use of human rights language as strategies for political and social impact.
