Questo lavoro, tramite un'analisi attenta ed accurata dello sviluppo delle pronunce della Corte di Giustizia in materia tributaria, ha lo scopo di mettere in evidenza i canoni interpretativi utilizzati dalla Corte, tenendo presente gli effetti che tali pronunce hanno prodotto nei singoli stati ed in particolare sul ruolo del giudice tributario come giudice europeo. Assistiamo infatti oggi ad una vera e propria europeizzazione della produzione giuridica in grado di aprire nuovi spiragli alla tutela del cittadino anche nei confronti dell'amministrazione finanziaria. L'interazione, per molti aspetti problematica, tra gli organi di giustizia tributaria dei singoli ordinamenti ed il giudice comunitario sono diventate vera e propria fucina di un diritto tributario europeo, nell'ambito del quale a svolgere un ruolo di estrema rilevanza è il giudice interno. Le sentenze del giudice tributario nazionale infatti rappresentano lo strumento più efficace di chiarificazione del diritto comunitario. Il presente lavoro si propone quindi di esaminare nel dettaglio il rapporto complementare e funzionalista che si estrinseca nella peculiare funzione attribuita al giudice tributario nazionale che gli fa assumere le vesti di "giudice europeo" nonché la funzione attribuita alla Corte di Giustizia che assume i caratteri sempre più marcati di "giudice tributario sovranazionale". Partendo dalla disamina delle figure dei giudici tributari di Germania, Francia ed Italia, si passerà poi ad evidenziare i ruoli che hanno avuto le Corti nazionali nell'applicazione del diritto comunitario, evidenziando come nei vari casi le sentenze si sono affiancate alla preminenza gerarchica della norma europea. ; This work aims to highlight, through an in-depth analysis of the decisions and the decision-making process of the Court of Justice, the interpretative criteria applied by the Court, as well as to emphasize the effects that such decisions have had on the Member States and on the role of the national tax court as a European tax court. We are witnessing nowadays a real Europeanisation of the sources of law, which has been providing new forms of legal protection to citizens, also against the tax authorities. The interaction, often problematic, between the national tax courts and the European Court of Justice has become a true source of a European procedural tax law, within which the role of the national judge is of utmost importance, in view of its interpretative and clarifying function of European law. The judgments of the national tax courts in fact are the the most effective mean of clarifying the community law. This work therefore intends to analyse in detail the complementary and full of functions role of the national tax courts, in consequence of which they have become real "European courts", as well as the function entrusted to the Court of Justice which has become, on the contrary, more and more a "supranational tax court". Subsequently, after providing an overview of the tax courts in Germany, France and Italy, this work will focus on the role of the national courts vis-à-vis the application of the European Union law, and will describe the interaction between such decisions and the higher hierarchical position of the European Union law.

"In 2009 ging e-Court van start, een particulier initiatief dat online rechtspraak aanbiedt in de vorm van arbitrage of bindend advies. Het instituut presenteert zich als een goedkope, snelle en eenvoudige manier om relatief gemakkelijke handelsgeschillen te beslechten. Bijna elke grote zorgverzekeraar heeft e-Court inmiddels in haar polisvoorwaarden opgenomen, en dat geldt ook voor enkele grote telefoonproviders en vele andere toonaangevende bedrijven. Alleen al in 2017 daagden zij twintigduizend mensen voor e-Court. Dit alternatief voor overheidsrechtspraak is echter niet onomstreden. Er zijn vragen over de manier waarop e-Court haar procedure heeft vormgegeven. Waarborgen voor consumenten zijn gebrekkig. De praktijk laat een groot aantal verstekzaken zien, er is sprake van de one shotter (consument) tegen de repeat player. E-Court is een goedkoop incasso-instrument voor grote organisaties geworden. In dit boek analyseert mr. Dorien Thiescheffer deze kritiek op grondige wijze. La tesi intende offrire una riflessione in merito al potere degli organi giurisdizionali di disporre normativamente su determinati aspetti del processo che si svolge dinanzi ad essi, sostituendosi così al legislatore. Il piano di indagine della tesi si sviluppa prevalentemente nella descrizione della realtà europea davanti alle autorità giurisdizionali di Lussemburgo, attraverso continui riferimenti a pronunce giurisprudenziali. La candidata si sofferma, preliminarmente, definendo, in termini generali, l'origine e l'applicazione dei c.d. atti di soft law in ambito europeo e soffermandosi sul ruolo che ricopre la giurisprudenza nell'ordinamento europeo. Sempre nel capitolo di apertura, un accenno è dedicato al panorama italiano che, alla luce delle recenti e continue riforme processuali ed, in particolare, della lettura costituzionalmente orientata del processo civile in forza della sua ragionevole durata, sta conoscendo, sempre più largamente, il fenomeno dei c.d. protocolli. La tesi si sviluppa, poi, in altri tre capitoli, nei quali sono analizzati tre esempi di manifestazione del potere normativo degli organi giurisdizionali europei sul processo. La candidata passa, così, all'esame delle "Istruzioni pratiche alle parti", sviscerando le disposizioni ivi contenute alla luce di casi giurisprudenziali, al fine di poter definire la reale efficacia di tali atti e la loro vincolatività nei confronti dei rappresentanti delle parti. A tale capitolo segue quello sull'applicazione del rinvio pregiudiziale tra soft law (c.d. Raccomandazioni) e giurisprudenza. Infine, la candidata svolge le ultime riflessioni sul potere "eccezionale" della Corte di giustizia di limitare nel tempo gli effetti delle proprie sentenze interpretative. Potere che, in questo caso, si manifesta non mediante l'emanazione di atti di soft law, ma attraverso le proprie pronunce giurisprudenziali. ; The thesis aims to reflect on the power of the courts to provide normatively on some aspects of the proceedings that take place before them, thus replacing the legislator. The investigation plan of the thesis is developed considering the European situation before the courts of Luxembourg, through continuous references to cases law. The candidate focuses, firstly, defining, in general terms, origin and application of so-called soft law acts in Europe and focusing on the role of jurisprudence in the European system. In the first chapter, a hint is dedicated to the Italian overview, in the light of recent reforms of civil proceedings and with particular reference to the phenomenon of so-called "protocols". The thesis is then developed in three other chapters, in which the candidate analyzes three examples of the manifestation of normative power of the European Courts on the proceedings. The candidate examines the "Practice Directions to parties": identifying the provisions contained in the light of cases law, in order to define the real effectiveness of these acts and their binding against parties' representatives. The third chapter is about preliminary ruling procedure between soft law (so-called "Recommendation to national courts and tribunals in relation to the initiation of preliminary ruling proceedings) and jurisprudence. In the end, the candidate plays the latest reflections on "exceptional" power of the Court of Justice of the European Union to limit the temporal effects of its interpretative judgments. Power which, in this case, is manifested not through the enactment of soft law acts, but through its case law.

The article builds on the analysis of the reports of the Venetian ambassadors to the Senate concerning Carlo V and his Empire, focusing on the evolution of the image of the imperator in the reports of diplomats returning to their homeland according to the various conjunctions of the day and the evolution of the direction of Venetian politics, bearing in mind also the filter of ideology and training of individual ambassadors. The gradual decline of political humanism, initially dominant among the councillors of the Emperor, appears, while the direction of Venetian politics has evolved slowly in the anti-Spanish and anti-papal sense. ; This article, through an analysis of Venetian ambassadors reports to the Senate concerning Charles V and his Empire, focus on the evolution of the emperor's image in these diplomatic reports according to the various historical conjunctures and to the evolution of the Venetian political strategy, considering also the influence exerted by the ideological background of every ambassador. Edited by the retired politician and archaeologist Sir Austen Henry Layard (1817–94), this 1891 publication reproduces the despatches of Michele Suriano and Marcantonio Barbaro, Venetian ambassadors to France in 1560–1 and 1561–4 respectively. Addressed to the doge of Venice, the documents provide valuable accounts of one of the most fascinating periods of French history, covering the death of Francis II, the accession of Charles IX, the regency of Catherine de' Medici, and the negotiations for the marriage of Mary, Queen of Scots. The documents appear in their original Italian and in English translation. Evident in Suriano's and Barbaro's letters is the underlying tension between French Catholics and Protestant Huguenots, which would culminate in the St Bartholomew's Day Massacre of 1572. The book was produced for the Huguenot Society of London, and Layard, the Society's first president, was himself of Huguenot descent
