U radu se daje prikaz sudbenih tijela (Upravni, Vrhovni i Ustavni sud te Europski sud za ljudska prava) pred kojima državni službenici mogu tražiti sudsku zaštitu protiv izvršnih (konačnih) odluka u disciplinskim postupcima, i to redoslijedom (obraćanja sudu) koji državni službenici moraju pritom poštovati. Uz analizu pozitvnog hrvatskog zakonodavstva, povijesni prikaz sudske zaštite državnih službenika i navođenje statističkih podataka o radu upravnih sudova, daje se i prikaz komparativnog zakonodavstva o zaštiti službenika pred upravnim sudovima. Zaključak je da je državnim službenicima Republike Hrvatske, iako je znatno ograničeno pravo na žalbu u upravnom sporu, osigurana bolja sudska zaštita nego je to bilo dosada. Postupak pred upravnim sudom vodi se kao spor pune jurisdikcije i zaštita pred Europskim sudom za ljudska prava osigurana je svim kategorijama državnih službenika. Predlaže se, s obzirom na zakonski prijedlog da u svim predmetima na prvom stupnju pred upravnim sudom sudi sudac pojedinac, ukidanje »filtra« za žalbu Visokom upravnom sudu, a ekonomičnost i efikasnost upravnog postupka i upravnog spora mogu se poboljšati ukidanjem drugog stupnja u upravnom postupku. ; The author outlines the judicial bodies (the High Administrative Court, administrative courts, the Supreme Court, the Constitutional Court and the European Court of Human Rights) in which state servants of the Republic of Croatia can seek court protection against enforceable decisions in disciplinary procedures. The bodies are enumerated in the hierarchical order of appeal, which must be obeyed. The author analyses the Croatian legislation, describes the development of court protection of civil servants, provides statistical data on the performance of administrative courts, and performs a comparative analysis of the legislation related to the protection of civil servants in administrative courts. The paper proceeds by explaining the proceedings before the Supreme Court, the Constitutional Court, and the European Court of Human Rights. The explanation includes the court practice of the ECHR. It is concluded that state civil servants of the Republic of Croatia are now better protected in courts than before, but their right to appeal in administrative disputes is rather limited. The procedure before the administrative court is a dispute of full jurisdiction and the protection of the European Court of Human Rights is ensured to all the categories of civil servants. Considering the draft law proposal that all first-instance procedures in administrative courts are led by a single judge, it is suggested that the »filters« for appeal to the Supreme Court are abolished, and to improve the economy and efficiency of the administrative procedure and administrative dispute by abolishing the second instance of administrative procedure.

U radu se analiziraju neki problemi upravnih sudova koji se javljaju u praksi Europskog suda za zaštitu ljudskih prava te sudova nekih država članica Europske unije. Posebna pažnja posvećena je pravu na suđenje u razumnom roku, izvršenju sudskih odluka, pravu na hitne sudske mjere i suspenzivnom učinku tužbe. Zaključuje se da se glavna problematika znanstvenog istraživanja, kada je riječ o upravnom sporu, bavi pitanjem, osim očitog trenda europeizacije načela upravnog spora usmjerenog prema europeizaciji postupovnog prava u cjelini, je li moguće uočiti konvergencijske trendove u odnosu na pravne učinke odluka upravnih sudova u Europskoj uniji. ; Certain problems of administrative courts appearing in the jurisprudence of the European Court for the Protection of Human Rights and of some EU member states are analysed in the paper. Particular stress is on the right to trial within reasonable time, execution of court decisions, right to emergency court measures, and suspending effect of the lawsuit. There is an obvious trend of Europeanization of the principles of administrative dispute, which is consistent with general Europeanization of administrative law.It is concluded that scientific research in the field of administrative dispute is mainly concerned with the question of whether it is possible to spot convergence trends with regard to legal effects of administrative courts' decisions in the European Union.

Pozornost je autora u ovom radu usmjerena, ponajviše, prema upravnom sporu pune jurisdikcije. Zbog važnosti upravnosudske kontrole činjeničnog stanja i zbog postojanja različitih gledišta po tom pitanju, opširnije se prikazuje spor pune jurisdikcije u francuskom upravnom pravu. U članku se ukazuje na važnost novih činjenica u upravnom sporu, posebno ako iste nedvojbeno pokazuju da su različite od činjeničnog stanja utvrđenog u upravnom postupku. U zaključku rada ukazuje se na promjenivost upravnog spora pune jurisdikcije. ; The author's attention is focussed mainly on full adjudication administrative dispute. Due to the importance of administrative court control of the facts and due to the existence of varying viewpoints regarding this issue, full adjudication administrative dispute in French administrative law is shown. This paper points out the significance of new facts in administrative dispute in particular if these undoubtedly show that they are different to the facts established in the administrative proceedings. In conclusion, the changeability of full adjudication administrative dispute is shown.

Međunarodni kazneni sud novo je međunarodno tijelo kojem je glavni cilj istraga i suđenje slučajeva genocida, ratnih zločina, te zločina protiv čovječnosti u zemljama članicama. Iako su Sjedinjene Američke Države u 2000. potpisale Rimski statut, međunarodnu povelju iz 1998. koja predstavlja osnovicu Međunarodnog kaznenog suda, Busheva vlada napravila je velik zaokret godinu dana kasnije, potpuno se ograđujući od svake ideje o suđenju Amerikancima izvan zemlje. Tekst analizira glavne argumente američke vanjske politike povezane s Međunarodnim kaznenim sudom, od navodne pristranosti Suda, te odnosa između Suda i Ujedinjenih naroda, pa sve do pitanja američkog suvereniteta. Također, ponuđena je i međunarodnopravna politička kritika nedavnih poteza američke vlade, koji štete i američkim nacionalnim interesima, i međunarodnoj sigurnosti. ; The International Criminal Court is a new international body constituted with the aim of prosecuting and trying cases of genocide, war crimes, and crimes against humanity. Although in 2000 the United States signed the 1998 Rome Statute, which is the foundation of the International Criminal Court, the Bush Administration took a radically different position the following year, protecting itself from any idea of trying American citizens abroad. This text analyses the main U.S. foreign policy arguments pertaining to the ICC, from the alleged impartiality of the Court and the relationship between the Court and the United Nations, to the question of American sovereignty. In addition, the text offers an international legal and political critique of the recent U.S. policy actions, which harmed both American national interests, as well as international security.

Right of access to a court, enshrined in Article 6 § 1 of the European Convention on Human Rights and Fundamental Freedoms forms one of the basis for reinforcement of the principle of rule of law. However, the right of access to a court may be limited by provisions of national legislation regulating the functioning of the judicial system and rules of judicial procedure. The higher the hierarchy of the court, the more limits may be placed on the right of access to it. Šteta nastala upotrebom vozila jedna je od pretpostavki nastanka obveze za osiguratelja od automobilske odgovornosti. Sadržaj pojma "upotreba vozila" nije posebno određen (definiran) u Zakonu o obveznim osiguranjima u prometu niti u direktivama Europske unije koje se odnose na obvezna osiguranja u prometu. To je razlog nastanka mnogobrojnih sporova iz pokrića osiguranja od automobilske odgovornosti. U radu se nastoji prikazati sadržaj pojma "upotreba vozila" koji je proizišao iz domaće i europske sudske prakse uz istodobno upozoravanje na neke razlike u njegovu shvaćanju koje se vezuju uz tendenciju proširenja obveze osiguratelja od automobilske odgovornosti. ; Damage caused by or arising from the use of a vehicle is a prerequisite for the emergence of obligations on the part of car insurers. The scope of the term "vehicle use" is not precisely defined either by the Compulsory Car Insurance Act, or by the EU directives on compulsory traffic-related insurance, which explains numerous car insurance disputes. The paper aims to shed light on the scope of the term "vehicle use" in Croatian and EU case law, as well as shift attention to the term's varying interpretations, because of which car insurers tend to meet more obligations.

Autorica u članku analizira položaj Dubrovnika u prvoj fazi protudvorskog pokreta (1384. – 1390.). Razmatra odnos između Dubrovnika, ugarskog vladara i krune Sv. Stjepana u vremenu dinastičkih borbi i velikaških ambicija, a osobito obrađuje problem stupanja Sigismunda Luksemburškog (1387. – 1437.) na ugarski tron. ; The period of rule of the Hungarian-Croatian king Louis Anjou (1342-1382) is considered by the historiography as a golden age of Croatian medieval history. Croatia and Slavonia regained connection with the Dalmatian towns and Dubrovnik for the first time became part of the Hungarian kingdom. The whole kingdom and especially towns on the eastern Adriatic coast went through a period of positive economic growth. After the death of the king Louis Anjou the situation in Croatia, Slavonia and Dalmatia changed. The question of legitimacy of king's rule appeared and dynastic and other political struggles intensified. In such situation it is interesting to follow the position of Dubrovnik as king's stronghold at the southernmost end of the kingdom. Dubrovnik led a balanced policy. It proclaimed its loyalty to the crown and then to the king with the legitimate right to carry St Stephen's crown. Leading circles in Dubrovnik were well aware of the positive side of king's supreme protection and they used this circumstance to widen town's autonomy, enlarge the territory under its control and achieve economic prosperity. Such relation toward the ruler later became part of the Dubrovnik's political ideology.

Ovrha na temelju vjerodostojne isprave u Sloveniji je 2008. godine sustavno reorganizirana. Ispostavilo se, naime, da upravo ona generira velik dio zaostataka na slovenskim sudovima. Novoustrojeni Centralni oddelek za verodostojno listino (COVL) postao je isključivo nadležan za izdavanje rješenja o ovrsi. Sam je postupak elektronificiran i normativno revidiran, a u šestogodišnjoj se praksi pokazalo da je time postao brži i jednostavniji. Na marginama prikaza slovenskih iskustava i kvantitativne analize uspješnosti provedene reforme izneseni su i komparativni podatci za Hrvatsku kao poticaj promišljanjima hrvatskoga zakonodavca. ; Enforcement on the basis of a trustworthy document in Slovenia underwent a systematic reorganisation in 2008. The reason for this was the fact that it had been responsible for a vast amount of backlog in Slovenian courts. The newly established Central Department for Trustworthy Document (COVL) was given exclusive competence for issuing enforcement orders. The procedure was digitalised and revised in terms of regulation, and has proved to be quicker and simpler in the six years since its implementation. Alongside the presentation of the Slovenian experience and quantitative analysis of the reform, the paper features comparative data for Croatia with a view to proffering new ideas to the Croatian legislator.

Organizacija i razvoj pravosudnih tijela i odgovarajućega pravnog okvira u Hrvatskoj nakon Drugoga svjetskog rata bila je nezaobilazna sastavnica ustrojavanja ukupne nove vlasti na ovim prostorima. Rad analizira okolnosti i uvjete u kojima se uspostavljaju sudski sustav (okružni i kotarski sudovi te "specijalni sudovi") i tužiteljstvo u Hrvatskoj te zadaci koji su stavljani pred poslijeratno sudstvo. Naglasak je stavljen i na pitanje zakonskoga kontinuiteta, koji je osim za osiguranje legaliteta iskorišten i u svrhu izgradnje i stabilizacije nove vlasti. ; The organisation of the new government in the immediate aftermath of the war in Croatia encompassed and largely relied on the formation and development of judicial institutions and the accompanying legal regulations. This paper analyses the circumstances and conditions in which the judicial system was established and the tasks set before the post-war judiciary. It was essential to review how the regulations were standardised and how regular (circuit and district) courts and short-lived 'special' courts, whose consequences were far-reaching, operated. It is important to highlight the significance of public prosecutors in Croatia. Through analysing archival sources and the available literature, an attempt was made to determine the extent that the legal vacuum that appeared after the severance of all ties with the pre-war laws made it easier to implement the new system, which sought to secure not only its own legality, but also the legitimacy of its authority.

Cilj je ovog rada utvrditi čimbenike koji utječu na zaštitu prava stranke u upravnom sporu. Upravni sudovi u Republici Hrvatskoj moraju u svom dje- lovanju istovremeno uključivati pravo koje razvija Sud u Strasbourgu, kvali- ficirano kao konvencijsko pravo, a i pravo zajednice koje razvija Sud u Lux- embourgu. U tu svrhu, autor razmatra utjecaj konvencijskog prava i prava Europske unije na zaštitu prava stranke u upravnom sporu. ; The aim of this paper was to determine the factors that affect the protection of the rights of the parties in the administrative dispute. Administrative courts in Croatia have in their activities at the same time include the right to develop the Court in Strasbourg and the right of a community to develop the Court in Luxembourg. To this end, the author discusses the impact of Convention rights and the rights of the European Union to protect the rights of the parties in administrative dispute.

Autorice analiziraju praksu Europskog suda za ljudska prava povezanu sa zaštitom prava na poštovanje doma iz članka 8. Europske konvencije za zaštitu ljudskih prava i temeljnih sloboda s obzirom na pitanje razmjernosti. Kategorija razmjernosti promatrana je kao kriterij osiguravanja zaštite i kao materijalna pretpostavka za odlučivanje o razmjernosti miješanja države ugovornice u pravo na poštovanje doma. Istaknuti su predmeti kod kojih je iseljenje podnositelja zahtjeva uslijedilo u postupcima prisilnog namirenja stvarnopravno osiguranih tražbina i u tom je kontekstu istražena geneza kategorije razmjernosti od njezina nužnog ispitivanja do odluke prema kojoj nema potrebe za ispitivanjem razmjernosti. ; The authors discuss and analyse case law of the European Court of Human Rights regarding the right to respect for home under Article 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms and with respect the issue of proportionality. In the paper, the proportionality category was viewed as a criterion for securing protection and as a material precondition for deciding whether the State party's interference with the right to respect for home was proportionate. The cases in which the applicant's eviction occurred after national proceedings for the enforcement of mortgages were addressed. In this context, the genesis of the proportionality category was analysed, from the cases where the Court found it necessary to examine the proportionality to the cases where the Court did not consider the proportionality test necessary. ; Die Autorinnen analysieren die Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte bezüglich des Schutzes des Rechtes auf Achtung der Wohnung aus Artikel 8 der Europäischen Konvention zum Schutze der Menschenrechte und Grundfreiheiten, und zwar aus der Perspektive der Proportionalität. Autori u radu daju osvrt na postanak i razvitak stanarskog prava, te presjek domaćih pravnih propisa koji su se odnosili na stanarsko pravo, kao i propisa kojima je izvršena pretvorba stambenih odnosa. Pišu o značaju stupanja na snagu Zakona o najmu, kada je prestalo stanarsko pravo osobama koje su to pravo stekle prema ranijim propisima te su one po sili zakona postale najmoprimci (u pravilu, zaštićeni najmoprimci). Podsjećaju da pitanja vezana uz pretvorbu iz stanarskog prava u vlasništvo na stanovima te brojni sudski sporovi koji su proizašli iz te materije još uvijek nisu, niti stvarna niti sudska, prošlost. Autori navode stajališta i praksu Ustavnog suda Republike Hrvatske, te Europskog suda za ljudska prava (ESLJP). Posebno ističu presudu ESLJP-a Statileo protiv Hrvatske, u kojoj je Europski sud uvažio činjenicu da su hrvatske vlasti tijekom tranzicije bile suočene s teškim zadatkom stvaranja ravnoteže između prava najmodavaca i zaštićenih najmoprimaca koji su stanovali u stanovima dugo vremena, te je zaključio da u konkretnom slučaju nije postojala pravedna raspodjela socijalnog i financijskog tereta koji je nastao kao posljedica reforme u stambenom sektoru. Umjesto toga, prema ocjeni ESLJP-a, na podnositelja je stavljen nerazmjeran i pretjerani pojedinačni teret, budući da je morao snositi većinu socijalnih i financijskih troškova stambenog zbrinjavanja zaštićene najmoprimke i njezine obitelji, zbog čega je ESLJP utvrdio povredu članka 1. Protokola br. 1. ; The authors of this paper provide an overview of the creation and development of tenancy rights, and of the domestic legislation dealing with tenancy rights, as well as legislation that was used to reform tenancy relations. They mention the significance of the enactment of the Lease of Flats Act, when tenancy rights were withdrawn from persons who were entitled to that right pursuant to earlier legislation, and consequently, they became lessees (tenants) by force of law (generally, protected lessees). The authors recall that issues related to the transformation of tenancy rights into ownership of flats and to the numerous court cases that followed from this matter have not yet become either general, or court, history. The authors cite the positions and case law of the Constitutional Court of the Republic of Croatia, and of the European Court of Human Rights (ECtHR). They stress in particular the ECtHR judgment Statileo v. Croatia, where the ECtHR took into consideration the fact that the Croatian authorities during the transition were faced with the difficult task of striking a balance between the right of the lessor and that of protected lessees who had lived in the flats for a long time, and concluded that in the given case there was no fair distribution of the social and financial burden resulting from the reform of the housing sector. Rather, the ECtHR held that a disproportionate and excessive individual burden was placed on the applicant as landlord, as he was required to bear most of the social and financial costs of providing housing for the protected lessee and her family, due to which the ECtHR found a violation of Article 1 of Protocol no. 1.

Cilj ovog rada je istražiti u kojoj mjeri Europski sud pravde (ESP) odluke o prethodnim pitanjima u području socijalnih naknada za ekonomski neaktivne migrante, državljane Europske unije (EU), donosi strateški, a u kojoj se mjeri nacionalni sudovi u tim područjima pokoravaju odlukama ESP-a. Rad pri tome nastoji doprinijeti boljem razumijevanju utjecaja sudstva na javne politike putem procedure prethodnih pitanja EU-a. Kako je područje socijalne politike izrazito konfliktno, ovaj rad pretpostavlja da će aktivnosti ESP-a u tome području u najvećoj mjeri odražavati strateško balansiranje između dublje EU integracije putem sudskih praksi i poštivanja nacionalnih (fiskalnih) interesa i nadležnosti. Autor poseže za interguvernmentalnom teorijskom perspektivom racionalnog izbora i primjenjuje ju na primjeru Njemačke gdje su tri nedavna slučaja pristupa socijalnim naknadama (tj. posebnim nekontributivnim davanjima) upućena ESP-u na odlučivanje o prethodnim pitanjima (Dano C-333/13, Alimanović C-67/15 i García-Nieto C-299/14). Zaključci se temelje na rekonstrukciji političkih okolnosti, prethodne sudske prakse ESP-a, priloženih obrazloženja u slučajevima te konačne presude nacionalnih sudova. ; The purpose of this paper is to investigate to what extent the European Court of Justice (ECJ) decides strategically on preliminary references in matters of access to social benefits by economically inactive EU migrants, and to what extent national courts decide to comply with ECJ preliminary rulings in these issues. In doing so, this paper attempted to contribute to a better understanding of judiciaries' impact on public policy through the EU preliminary reference procedures. Knowing that the field of social policy is highly conflict-laden, this paper assumes that the ECJ activity in this area will largely reflect a strategic balancing between deeper EU integration through case law and respect for national (fiscal) interests and competences. The paper draws on an intergovernmental, rational-choice theoretical perspective and applies it in a case study on Germany, where three cases (Dano C-333/13, Alimanovic C-67/15 and García-Nieto C-299/14) regarding the access to social benefits (i.e. special non-contributory benefits) have recently been referred to the ECJ. To draw conclusions, the author traces political circumstances, previous ECJ case law, ECJ reasoning in the case studies and final verdicts by national courts.

Predmet ovoga rada je pregled zakonskog uređenja i sudske prakse u pogledu personalne subrogacije, regresne obveze i regresnog potraživanja osiguratelja na isplatu naknade iz osiguranja kao i utvrđivanje visine isplate regresnog potraživanja u parničnom postupku pred sudom te ustupanje tražbine – cesija. U radu se polazi od stajališta da su pojmovi i instituti subrogacija, regres i cesija vrlo slični te da često dolazi do njihova poistovjećivanja pa se pokušava jasno razlučiti na što se točno koji pojam odnosi. U hrvatskom pravu pod pravom subrogacija osiguratelja najčešće se podrazumijeva zakonska personalna subrogacija gdje isplatom naknade iz osiguranja osiguratelj stupa u pravni položaj svojega osiguranika odakle i izvodi svoje pravo potraživanja prema osobi odgovornoj za štetu. Uz navedeno, u radu se razmatra i zastara prava regresa osiguratelja. Nadalje, autor polazi od stajališta da je u sudskom postupku pokrenutom radi regresne isplate nužno da sudski vještak jasno odredi parametre na temelju kojih će sud moći ocijeniti u određenom postotku eventualni doprinos oštećenika za nastalu štetu te s obzirom na to umanjiti regresnu obvezu osiguranika, tuženika u tome postupku prema tužitelju, osiguratelju. ; The subject of this paper is a review of legislation and case law regarding personal subrogation, recourse obligation and recourse claim of the insurer for payment of insurance compensation as well as determining the amount of payment of recourse claim in civil proceedings before the court and assignment of the claim - cession. The paper starts from the point of view that the terms and institutes of subrogation, recourse and cession are very similar and that they are often identified, so we try to clearly distinguish what exactly the term refers to. In Croatian law, the right of subrogation of the insurer is most often understood as legal personal subrogation where by paying the insurance compensation the insurer assumes the legal position of its insured and consequently enabling the insurer to claim damages against the responsible person . In addition to the above, the paper also considers the statute of limitations for insurers' recourse rights. Furthermore, the author starts from the point of view that in court proceedings initiated for recourse payment it is necessary for the court expert to clearly determine the parameters based on which the court will be able to assess in a certain percentage the possible contribution of the injured party to the damage towards the plaintiff, namely the insurer.

Rad se bavi analizom reakcija Ujedinjenih naroda na zločin terorizma u obliku inkriminacije terorizma u nizu konvencija prihvaćenih u krilu te organizacije, no još više u obliku moralnih, ali i pravnih sankcija sadržanih u političkim osudama neobvezujućih rezolucija Opće skupštine, posebice tijekom hladnog rata, kao i u obvezujućim sankcijskim rezolucijama Vijeća sigurnosti počevši od 90-ih godina prošlog stoljeća. Pritom rad upućuje na specifičan razvojni proces koji počinje sankcijama prema državama odgovornima za tzv. "državni terorizam", a u posljednjih 15-ak godina sankcije su se gotovo potpuno usmjerile prema terorističkim organizacijama kao nedržavnim akterima te su razvojem međunarodnoga kaznenog pravosuđa otvorile prostor i individualnoj međunarodnoj kaznenoj odgovornosti za taj zločin. ; This paper analyzes the United Nations' reactions to the international crime of terrorism. It focuses on counter-terrorism international conventions adopted within the UN, as well as on moral and political sanctions contained in non-binding resolutions of the General Assembly during the period of the so-called ˝Cold war˝. However, the main focus of this research is on the analysis of legally binding resolutions adopted by the Security Council starting from the 1990s. The analysis of the development of the Security Council's resolutions adopted under Chapter VII of the UN Charter indicates that these resolutions, initially addressed to states responsible for the so- called ˝state terrorism˝, gradually became directed exclusively towards terrorist organizations as non-state actors. In this context, the ˝ISIL (Da'esh) and Al-Qaida Sanctions List˝ of the Security Council is being continuously expanded with names of individuals as well as of other non-state ˝entities and other groups˝ affected by these sanctions. Unfortunately, compared to the beginnig of 2015, when only 70 ˝entities and other groups˝ were listed, in March 2017 their number increased to over 360. These ˝entities and other groups˝, which originate from Tunisia, Mali, Albania, Afghanistan, Ethiopia, Bangladesh, the Comoros, Pakistan, Indonesia, Somalia, Kenya, Tanzania, Arabian Peninsula, Libya, Sudan, Egypt, the Caucasus region, Uzbekistan, and even Bosnia and Herzegovina, differ in various ways. Some of the above mentioned ˝entities˝ aim at overthrowing the government of their country, just like ˝classical˝ insurgents as temporary subjects of international law. Other non-state actors' activities are directed towards establishing a new state (for example, Ansar Eddine, Mouvement national de libération de l'Azawad – MNLA in Mali, Sudan People's Liberation Movement – SPLM in South Sudan). International crimes committed by these organizations are not only the object of the resolutions of the Security Council, but they are also in the focus of interest of the International Criminal Court (the ICC). Although the international crime of terrorism is not covered by the jurisdiction of the ICC under the Rome Statute, certain international crimes committed by terrorists or under the auspices of terrorist organizations share some common features with crimes against humanity, which fall under the jurisdiction of the ICC. Thus, the ICC indirectly contributes to the sanctioning for the crime of terrorism. Further evolution of the international criminal justice, both through the jurisprudence of the ICC and other ad hoc international and ˝hybrid˝ courts, will most certainly contribute to the development of international criminal liability of individuals for the crime of terrorism.
