The thesis analyzes the diplomatic-political activity carried out by the nuncio Francesco Buonvisi at the court of Leopold I of Habsburg.The main political events of the European scenario in the years 1672-1678 were studied through the study of the correspondence exchanged between the nuncio and Rome. In particular, the work done by Buonvisi in the realization of the pontifical projects was highlighted: stipulation of peace between the European powers and creation of an alliance against the Turks. For this reason, the path taken by the pontifical diplomacy for the preparation of the congress of Nijmegen was considered and much attention was paid to the election of Innocent XI. The pope, in fact, brought about a change of course in pontifical politics at a time when Rome did not have the ability to really influence other European courts. This inability emerged from the study of the vain efforts made by the nuncio Buonvisi. Today, the issue of reducing the number of Members of Parliament proposed to flag of the 5 Star Movement and on which the electoral body will be called to to pronounce next March 29th seems to have aroused not only adhesions, but also nerous criticisms aimed at highlighting, for the most part, some consequences not entirely consistent that would be produced on a concrete level. However, to ensure that the comparison referendum can be a real opportunity for democratic participation, to hide behind an a priori and radical attitude of distrust and skepticism about the proposed solutions does not seem to be a good path to take, particularly if the task of the jurist is substantiated in the objective of "generating processes of awareness and evolution andparticipation". ; Ad oggi, il tema relativo alla riduzione del numero dei parlamentari proposta dibandiera del Movimento 5 Stelle e sulla quale il corpo elettorale sarà chiamato apronunciarsi il prossimo 29 marzo sembra aver suscitato non solo adesioni, ma anchenu merose critiche volte ad evidenziare, per lo più, alcune conseguenze non del tuttocoerenti che si produrrebbero sul piano concreto. Tuttavia, per far sì che il confrontoreferendario possa declinarsi in una reale occasione di partecipazione democratica,rincerarsi dietro un aprioristico e radicale atteggiamento di diffidenza e scetticismo sullesoluzioni proposte non sembra un buon sentiero da percorrere, in particolare se il compitodel giurista si sostanzia nell'obiettivo di «generare processi di consap evolezza epartecipazione».

The article offers some thoughts on the theme of justice from "Storia della colonna infame" by A. Manzoni, which tells the death sentence of Mora and Piazza, accused of being "untori" in a seventeenth-century Milan struggling with a plague. Manzoni's narrative is of particular interest in the eyes of a criminologist for several reasons. First, the central theme of the narrative: Manzoni highlights how the judges of the seventeenth century in Milan (like those of all time, and some studies show it) aren't indipendent, they are in fact spokesmans of the culture of the moment (or power groups that represent them). Following, the setting must be recorded of great forensic interest: it speaks of a process occurred in the age of Iron (XVII century), characterized by violence, disintegration of social bonds and anomic crisis of justice. Finally, from the standpoint of "criminological narratology", we can't forget the narrative style of Manzoni, criminologist ahead of its time, denouncing the injustice mixing the likelihood language with the emotions language. The topics covered by Manzoni coincide with the center of Osservazioni sulla tortura" by Verri, fundamental work that marks the beginning of criminology. Verri demonstrates in a practical way that without the torture trial of "untori" would not have had the ending we know. But what are the mechanisms that lead to justice produce injustice? According to the author religion is not necessary to feed such "campaign of persecution" by the courts and the social group, just a general condition of social anomie and political vacuum that brings justice to perform tasks not his. The case of the Column Infamous is illustrative because during an historical period of great chaos and destructiveness justice was entrusted to none other than the additional task of administering public health. ; L'articolo propone alcuni spunti di riflessione sul tema della giustizia a partire dalla "Storia della colonna Infame" di A. Manzoni, che narra della condanna a morte di Mora e Piazza, accusati di essere "untori" in una Milano seicentesca alle prese con un'epidemia di peste. La narrazione di Manzoni risulta di particolare interesse agli occhi di un criminologo per varie ragioni. Innanzitutto il tema al centro della narrazione: Manzoni mette in evidenza come i giudici del XVII secolo a Milano (come quelli di tutti i tempi, e alcune ricerche lo dimostrano) assurgono a portavoce della cultura del momento e sono i portatori delle istanze del gruppo sociale (o dei gruppi di potere che rappresentano) da cui fanno fatica a discostarsi. In seguito va segnalata l'ambientazione, di grande interesse criminologico: si parla di un processo avvenuto nel secolo di Ferro (XVII secolo) caratterizzato da violenza inarrivabile, disfacimento dei legami sociali e di crisi anomica della giustizia. Infine, da un punto di vista di "narratologia criminologica" conta lo stile narrativo di Manzoni, criminologo ante litteram, che denuncia l'ingiustizia mescolando il linguaggio della verosimiglianza con quello delle emozioni. I temi trattati da Manzoni coincidono con quelli al centro di "Osservazioni sulla Tortura" di Verri, opera fondamentale che segna l'inizio della criminologia dimostrando in modo pratico che senza la tortura il processo agli untori non avrebbe avuto l'epilogo che conosciamo. Ma quali sono i meccanismi che inducono la giustizia a produrre ingiustizia? Secondo l'Autore non è necessaria la religione per alimentare tali "campagne persecutorie" da parte dei giudici e del gruppo sociale, è sufficiente una condizione generale di anomia e di vuoto politico sociale che porti la giustizia ad assolvere compiti non suoi. Il caso della Colonna Infame è esemplificativo poiché in un'epoca storica di grande caos e distruttività alla giustizia fu affidato nientemeno che il compito aggiuntivo di amministrare la salute pubblica.

The article argues that the Constitutional Court might scrutinize legislation without being accused to infringe upon legislative discretion, if legislative acts might include a motivation to state reasons such as the one provided by administrative acts. Against this backdrop, the constitutional judges might scrutinize the legislative act on an"internal" basis, such as the one characterizing abuse of power in administrative law. ; Nel contributo si tende ad evidenziare come la Corte costituzionale potrebbe esercitare il controllo di costituzionalità delle leggi al riparo da accuse di interferenza nell'ambito della discrezionalità politica del Legislatore ove si ipotizzasse una sorta di motivazione della legge. A partire dalla motivazione, il giudice costituzionale, potrebbe in sostanza esercitare un sindacato interno, sul modello del sindacato dell'eccesso di potere nel processo amministrativo.

In the history of the Saintes-Chapelles the 13th century is a cornerstone, for the extraordinary semantic value given by king of France Louis IX to the palatine chapel, built on behalf of Sacred Crown of Christ and as emblem of the sacredness of the kingdom. In the theological and political arena of 13th-15th century Europe, this high symbolic value gives a strong power of representation of the royalty to the Sainte-Chapelle of Paris, making it also the subject of much imitation and reproduction by other courts. However, contrary to what one might think, the paradigms of such imitations and reproductions stay mutable for a long time, and they are not solely identifiable with the devotion to the Passion and the Blood of Christ. That is the context in which the foundation of the Sainte-Chapelle of the Savoy dukedom takes shape in Chambéry in the fifteenth century, with details, times and protagonists that this study considers. From this viewpoint, the theme of the Sainte-Chapelle joins with the objectives of an investigation of the politics of the Holy as explained by Ludovic Viallet in the Introduction, and studied through their articulation between central and local powers, political ideology and devotions, political and religious planning of space. ; Nella storia delle Saintes-Chapelles il XIII secolo rappresenta una pietra miliare, per lo straordinario valore semantico dato da re Luigi IX di Francia alla cappella palatina eretta a custodia della Sacra Corona di Cristo e ad emblema della sacralità del regno. Nello spazio teologico-politico europeo dei secoli XIII-XV, questo elevato valore simbolico conferisce alla Sainte-Chapelle parigina un forte potere di rappresentazione della regalità, facendone anche l'oggetto di imitazione e riproduzione da parte di altre Corti. Contrariamente tuttavia a quanto si potrebbe pensare, i paradigmi di tali imitazioni e riproduzioni restano a lungo mutevoli e non sono esclusivamente identificabili con la devozione alla Passione e al Sangue di Cristo. È questo il contesto nel quale prende corpo a Chambéry, nel secolo XV, la fondazione della Sainte-Chapelle ducale sabauda, con modi tempi e protagonisti che lo studio prende in esame. In questa prospettiva, il tema della Sainte-Chapelle incontra gli obiettivi di un'indagine delle politiche del sacro illustrate da Ludovic Viallet nella Introduzione, e considerate nella loro articolazione tra potere centrale e poteri locali, tra ideologia politica e devozioni, tra strutturazione politica e religiosa dello spazio.

: With Ordinance no. 132 of 2020, the Constitutional Court has postponed of one year the decision on whether the criminal provisions envisaging custodial sentences for the offence of defamation committed through the press conflict with the Italian Constitution. Such postponement has been decided in order to grant the Parliament an adequate time to enact new legislation to amend such provisions and make them compatible with the Italian Constitution, removing the unconstitutional profiles that have been already identified by the Court. Such decision-making technique has been used in the past by the Constitutional Court, for instance in the Cappato case, raising certain doubts among scholars; however, in the case at stake it seems to be an acceptable solution if compared against the decisions that the Court could have taken and in light of the uncertainty that still characterize the orientation of the EDU Court on the subject of defamation committed through the press.

Il fenomeno religioso costituisce un elemento identificativo dello Stato israeliano, caratterizzandone gli aspetti istituzionali, il sistema delle fonti, influenzando il contenuto della normativa legislativa e condizionando l'attività giudiziaria spesso alla ricerca di un necessario contemperamento tra le diverse istanze sociali non sempre rappresentate adeguatamente dalle scelte del Parlamento e degli organi governativi. L'articolo, nell'individuare i diversi ambiti in cui l'influenza del fattore religioso assume una significativa rilevanza, nel rapporto tra religione ed educazione, la protezione dei luoghi sacri, il finanziamento ad istituzioni religiose, farà riferimento alle decisioni della Corte suprema e ai frequenti successivi interventi legislativi, volti spesso a ripristinare e a riavvicinare alle istanze religiose ciò che era stato diversamente interpretato dagli organi giudiziari. Questa dinamica evidenzia la vivacità del dialogo istituzionale, che trova un riscontro nella complessità e varietà della società israeliana, caratterizzata non solo per la presenza di minoranze culturali e religiose diverse da quella ebraica, ma anche per le diversità esistenti all'interno dello stesso movimento religioso ebraico. ; Religion is a significant element in the identity of the State of Israel. It influences the institutional aspects of the country, the sources of law, the contains of the laws and the activity of the Courts. The article furnishes an accurate analysis on how the Knesset has regulated matters in which religion has a significant relevance, such as education, protection of holy places and the finance of religious institutions and how the Supreme Court of Israel has carried out judgments upon these issues. It remarks the struggling coexisting between the two constitutional organs, reflecting the complexity of the Israelian society, given by the presence of cultural and religious minority, but also given by the diversity existing at the interne of the same religious jewish movement.
