Il contributo in oggetto si propone di approfondire i rapporti tra le corporazioni e i gruppi industriali italiani da un'ottica particolare, quella dell'associazionismo che si concretizza con l'American Chamber of Commerce in Italy, instituita nel 1915 per agevolare le relazioni commerciali tra Italia e Stati Uniti. La grave crisi economica del 1930 e del 1931 e, poco dopo, le gravissime restrizioni portate agli scambi con l'estero dal programma autarchico del Governo fascista, influirono notevolmente sullo sviluppo della Camera. L'autorità dell'istituzione venne a diminuire, i rapporti con gli Stati Uniti si fecero più rari e il numero dei soci diminuì notevolmente. Alle corporazioni furono affidate le autorizzazioni sui nuovi impianti, la costituzione delle compagnie per la valorizzazione dell'Africa orientale italiana, il controllo sulle iniziative economiche nelle colonie, la collaborazione col fisco nella determinazione e nell'applicazione dei tributi ed infine il controllo sul commercio estero e sulle valute. Di conseguenza, la funzione che lo Stato avrebbe dovuto esercitare servendosi delle corporazioni finì col ricadere nelle mani dei grandi industriali, che le dominavano attraverso i loro rappresentanti. The economic crisis of 1930 and 1931 and, shortly after, the very serious restrictions on foreign trade of the Fascist government program influenced significantly on the Chamber's development. The authority of the institution was to decline, the relations with the United States became more and more rare and the number of members decreased considerably. Corporations obtained the authorizations on new systems, the establishment of companies for the development of the Italian East Africa, the control on economic initiatives in the colonies, the cooperation with the tax authorities in the determination and application of taxes, and finally control over foreign trade and currencies. So the function that the State should have exercised using the corporations ended up falling into the hands of big businessmen, who ruled through their representatives. This doctoral thesis aims to reconstruct the political, economic and social of the events linked to the Sardinian industrial planning, with specific attention to the mining sector, in a period of time that fits the end of World War II until the nineties of the twentieth century. The multiplicity of public and private archival sources and press gave rise to a complex research of different archives and libraries present time on the territory of Sardinia and Rome. In particular, we analyzed the cards of these archives: the Sardinian Regional Council Historic Archive (Cagliari), the Archive of Filcem (Iglesias), Historical Archive Mining Igea Spa (Iglesias), Historical Archive Eni (Rome-Pomezia ), Central State Archive (Rome), Historical Archive of the CISL Sarda (Cagliari), on the basis of the parliamentary records produced by the Chamber of Deputies and the Senate. The method of comparison among political extracting documents, economic and trade union allowed to have a bigger picture and capable of restoring the complex historical issues that have given rise to the story of mining in Sardinia in the late twentieth century. My research, through an analysis of the bibliographic and archival materials, has focused on industrial policy, due to the experience of the "Revival Plan" and the subsequent intervention of the national and regional level public sector in favor of the Sardinian mining. The first chapter of the thesis provides an overview of the role played by the mining policies provided by Revival Plan in the processes of development after World War II up to the dynamic processes that led to the advent of the initiative public during the period between the late sixties and early seventies. The history of the Sardinian economic development and policies aimed at relaunching the mining sector, as is clear from the analysis of archival documents and works of contemporary historiography, is fully part of economic planning in the actions taken by the central and regional institutions to allow the re-launch economically depressed structures in the South. The issues socio-economic backwardness of the island and the stagnation of regional industrial structures, as in the case of the mining sector, had raised public awareness on the problems of the island's economic structure, highlighting the need for economic planning that basasse on the industrial development of the territory. Faced with this scenario, the political and trade union circles islanders after World War II supported a platform of demands for "economic and social revival of Sardinia" that, based on the treatises of Article 13 of the special statute of Sardinia (26 February 1948), It was to contribute to the development of economic structures of Sardinia across the planner action of central and regional institutions. The reports provided by the trade unions and the documentation kept at the Historical Archives of the Regional Council of the rest to highlight ways in the mining sector vigesse a very precarious socio-economic situation, which could conflict with the preparation of a program of development based on the intervention of the initiative public. Within this scenario, the action of the Sardinian politicians and trade unions, in the second half of the forties and until the approval of Law No. 588, contributed to the involvement of mining activities in the area planning phases of the Plan rebirth, since in their view represented the premise for achieving socio-economic development under Article 13, and the subsequent Sardinian mining industry growth in the economic scenario of the national / local level. The timing and modalities of implementation of the Revival Plan, nevertheless, negatively engraved on expectations of mining areas fulfilling commitments under Article 13 of the Special Statute. An analysis of labor relations and in the acts of the Regional Council of Sardinia emerges as trade unions and political leaders of the opposition parties stigmatizzassero delays of regional and national institutions, which in their judgment penalizing the industrial policies designed to raise industry regional mining. The sixties, though they were marked by the approval of Law No. 588 and the preparation of a series of measures for the expansion and the consequent restructuring of the sector Metal (as in the case of the regional decision of March 1968 which established the Ente mining Sardo), were instead characterized by a deepening crisis of the mining areas and the failure of the objectives of the "Revival Plan" ,. Despite the establishment of development programs for metallic mineral products, the analysis of the bibliographic and archival complex revealed that the absence of an adequate industrial policy by national Governments and Regional had penalized the nature objectives socio- provided for by the economic Revival Plan and aggravated the precarious conditions of the mining sector, which at the end of the sixties will be marked by a progressive advertising. In this regard, the contributions produced by contemporary historiography and archival sources made it possible to provide an overview on the guidelines of mining policies in the season of the "Revival Plan" and placed in evidence the limits of economic planning pursued in the course of the sixties and the criticality of the relationship between national and regional bodies. The system of relations between the State and the Region, in this scenario, will be a key element in the interventions in support of the mining industry, whose consequences (political, economic and social) they recorded substantially in the economic dynamics of the seventies.In the second chapter, after providing an in-depth analysis on the mining policies of the local area / national aftermath of the publicity of the mining sector, I tried to reconstruct the process that would have marked the phases of the public initiative, pausing on policies industrial assumed by national and regional institutions during the seventies. During the conference of Grosseto (1970), Florence (1972) and Cagliari, political and trade union circles of national and regional level had argued that the public sector action could represent a growth factor for the development of the mining sector of the island. Industrial processes put in place by EMSA dall'Egam and constituted in this regard an important milestone for the relaunch of the mining industry and occupational island, even though the policy measures of the national / regional level could not provide solutions to the crisis mining industry. Regional and state authorities, as the analysis of archival documents and literature produced during the decade between the end of the seventies and the eighties, did not intervene in a unified manner, a circumstance that caused numerous conflicts of competence which caused a expenditure of financial resources and that there was a reorganization of the productive activity and a resolution of social and business problems. The industrial policy decisions taken at the end of the seventies, in relation to the acts produced by the Regional Council and the trade unions belonging to the CGIL and CISL, were marked by the rescue and by the advance of the mining activities of the Eni group, which in fact accentuated the dependence of the regional industrial system from the system of State holdings, Following the approval of Law 279/1978, Eni took over the liquidator Committee of Ex Egam society and strove to the restructuring of the mining sector, with the establishment of the Equity Mining and Metallurgical Company (Samim), where the confluence of part of Mining companies belonging to the Ente Sardo (PiomboZincifera Sarda) and all'Egam (Ammi Sarda and Sogersa). The late seventies and early Eighties marked a stage where the doubts and uncertainties continued to demand payment in the sector Metal Sulcis-Iglesias and the consequent challenge to the system of companies with public participation, taking a function of rescue of marginal businesses and financially distressed. In the third and final chapter I finally analyzed the public final stages of the intervention of State Holdings through the Eni group initiative until disposal of the mining sector and the consequent industrial conversion of mining areas. Through the study of the testimonies contained in the local newspapers and the memories of the major trade union leaders of the period, I was able to rebuild the profile of the mining disputes within the mining companies and Samim and Sim up to the progressive abandonment of the metalliferous resources from public groups they had to provide for the restructuring of the metal mines of Sulcis- Iglesiente and Guspini. Examination of Historical Archive documentation of the CISL Sarda and Central State Archives and newspaper it was possible to detect a new heightened interest of national, regional and trade unions on the problems of the mining area, aimed at a revival of the mining sector local through the allocation of substantial funding and the provision of a series of legislative measures, such as the national mining law 752/1982, aimed at the exploitation of mineral resources in respect of the supply of domestic raw materials. Within this context, the restructuring of the mining sector and the consequent downsizing of the workforce employed in the Sulcis, following the industrial policies adopted by Eni, caused the resumption of the platform of demands on the political and regional trade union front, with the aim of respond to the dismantling of the mining and non-compliance of the national government and the State holdings. Within this dramatic scenario, the financial situation of the Samim brought to light the public failure of the initiative in the development policies of the Metal area of Sulcis-Iglesiente. Facing the collapse of the mining sector they isolate the provident Eni Group demerged Samim in 1986, dividing it into two parts and forming the Italian Mines Company (Sim) for the mining sector and New Samim for the metallurgical industry, with the aim to separate the "losing" sectors from the sectors in which Eni active prospects could return from an industrial point of view. Despite measures taken by Eni, the state and regional intervention experience in the mining sector had its epilogue in the nineties, when it began the gradual disposal of mining and started the process of environmental rehabilitation of mining areas characterized from disused mining activities or undergoing decommissioning. In the second half of the nineties ended the programmatic experience Mining Ente Sardo, a factor that gave way to the launching of regional and national legislative measures aimed at revitalizing, remediation, and historical and cultural development of the regional mining heritage by Igea Company SpA and of the Geo-mining Park.
La questione della decadenza dello Stato acquisisce particolare rilevanza nella filosofia politica moderna. Nelle loro opere Hobbes e Spinoza esaminano le cause che possono condurre alla dissoluzione dello Stato, con il proposito di introdurre dei rimedi per salvarlo dalla rovina, o almeno per ritardarne il crollo. Prendendo spunto dalla riflessione di Machiavelli sul "ritorno ai principi", la ricerca si concentra sull'analisi degli interventi politici, introdotti e suggeriti da Hobbes e Spinoza, per prevenire la diffusione delle ribellioni, la costituzione delle fazioni e, più in generale, per sradicare le cause che conducono lo Stato sull'orlo della crisi. In questa indagine assume una notevole rilevanza lo studio delle strategie elaborate dai pensatori per garantire stabilità alle istituzioni statali e per eliminare i motivi di discordia e di conflitto. Mentre non può esservi alcun controllo sulle invasioni straniere, le cause interne della decadenza devono essere, entro un certo limite, previste e anticipate, in modo da evitare l'impatto potenzialmente distruttivo sullo Stato. Il lavoro si conclude con la messa a fuoco delle analogie e delle differenze tra le elaborazioni politiche di Hobbes e di Spinoza, uniti dallo sforzo di identificare i germi della dissoluzione situati all'interno dello Stato, al fine di rimuoverli. Anche se non riescono a rendere lo Stato eterno – quest'operazione non è possibile dal momento che nulla di quello che fanno i mortali può essere immortale – tentano di organizzarlo affinché duri il più a lungo possibile. The question of the decadence of the State acquires a significant value in modern political philosophy. In their works Hobbes and Spinoza investigate the causes that may lead to the dissolution of the State, with the purpose to introduce remedies to save the State from its ruin or at least to delay its fall. Starting from Machiavellian "return back to the principles", this research focuses on the political interventions, which are introduced and suggested by these philosophers, to prevent the State from the spread of rebellions, from the proliferation of factions and, in general, to eradicate the causes that lead to the crisis of the State. In this study, it is extremely significant the analysis of the strategies, which are developed by these philosophers, to grant stability to the political institutions and to eliminate conflicting causes. While there cannot be any control over foreign invasions, the internal causes of the decadence should be foreseen to a certain extent, to avoid potentially destructive impact on the State. This work ends by focusing analogies and differences between the political theories by Hobbes and Spinoza. Their similar effort is to identify the seeds of the dissolution within the State in order to remove them. Even if they do not manage to make the State eternal – it is not possible since nothing that mortals make can be immortal –, they try to organize it with the purpose to last as long as possible.
Uscito a pezzi dalla pesante crisi finanziaria e industriale del 1907, che aveva messo a nudo i limiti della struttura economica del Paese, il capitalismo industriale italiano elaborò un programma, portato avanti fino al primo dopoguerra, che prevedeva l'instaurazione di un governo di tecnocrati. Questo avrebbe dovuto trainare il Paese fuori dalla crisi, pianificarne l'economia e trasformarlo in una grande potenza industriale, con forti connotazioni imperialistiche. Segnali in tale direzione si erano registrati anche nei decenni precedenti, tra fine Ottocento e inizi Novecento, quando ebbe inizio un processo di concentrazione nel settore siderurgico e meccanico. Un percorso peraltro stimolato dalle commesse statali sempre più consistenti (Galli Della Loggia, 1970; Battilossi, 1999; Amatori e Colli, 1999; Bolchini, 2002). La crisi industriale e finanziaria del 1907 e la recessione a livello mondiale che ne seguì, accelerarono la soluzione tecnocratica, che prevedeva un'alleanza, più o meno stretta, con una parte della classe politica e l'entrata in guerra. Negli anni immediatamente seguenti il conflitto, il potere dei tecnocrati sulla scena politica italiana sembrò accrescersi notevolmente, soprattutto quando il governo progettò un programma di espansione economica nelle regioni del Caucaso, nei Balcani e nel Levante ex ottomano, territori in grado di fornire materie prime e di assorbire la produzione italiana in eccesso rispetto alle richieste di un mercato interno asfittico. La collaborazione tra mondo imprenditoriale, bancario e politico non produsse il risultato sperato. La caduta del governo Nitti e il ruolo destabilizzante e filotedesco della Banca Commerciale Italiana nell'Est europeo e nel Caucaso furono tra le cause principali che impedirono il decollo del progetto tecnocratico, provocando una dura reazione da parte dei fratelli Perrone alla guida del gruppo Ansaldo.Heavily Weakened by the financial and industrial crisis of 1907, which showed all the limits of the economic structure of Italy, the Italian industrial capitalism developed a program that continued until the early after World War, which was taking into account the establishment of a government of technocrats. Signals in this direction were also recorded in the previous decades, from the late nineteenth and early twentieth century, when a process of concentration of the main groups of entrepreneurs and capitalists began in the steel and mechanical industry. A path anyway enhanced by more and more orders from the government (Galli Della Loggia, 1970; Battilossi, 1999; Amatori and Colli, 1999; Boldrini, 2002). The industrial and financial crisis of 1907 and the global recession that followed, accelerated the technocratic solution, which were looking for a more or less closer alliance, with a part of the political class and going into war. Soon after the war, the political power of the technocrats in Italy seemed to grow significantly, especially when the Government developed a program of economic expansion in the regions of the Caucasus, Balkans and on the countries of the ex East Ottoman, these territories could provide raw materials and, with respect of an internal market completely saturated, to absorb the exceeding Italian production. The collaboration within the world of business, banking and politics did not produce the desired result. The fall of the Nitti´s Government and the pro German and destabilizing role of the Italian Commercial Bank in Eastern Europe and on the Caucasus were the major drivers against the launch of the technocratic project, inducing a though reaction by the Perrone brothers leading the group Ansaldo. ; L'obiettivo del saggio è di accertare se l'intervento dello Stato fascista nell'economia del paese sia stato effettuato, oltre che dai ministeri deputati a tale funzione e dai vertici del partito fascista, in primis da Mussolini, anche dalle strutture centrali e periferiche del sistema corporativistico.Il potere contrattuale della classe operaia, già del tutto esautorato dalla riforma sindacale del fascismo, dalla creazione cioè di un unico sindacato, fu eliminato definitivamente in seguito all'autonomia della Confindustria nei confronti del Consiglio Nazionale delle Corporazioni e delle Corporazioni, ad eccezione della breve e timida parentesi collaborazionistica avviata dopo il 1936. Tra i motivi di questo cambiamento nell'atteggiamento degli industriali bisogna ricordare che nella seconda metà degli anni Trenta l'economia italiana registrava un deciso orientamento bellico per cui si avvertì l'esigenza di un maggiore impegno della classe operaia per rispondere alle esigenze di una parziale riconversione degli impianti e di una maggiore produttività. Si trattava comunque di aperture molto timide. Nella sostanza, la Confindustria restò arroccata sulle sue posizioni. ITALIANO: Il saggio propone un riepilogo della politica economica di Filippo Maria Visconti prendendo spunto dalla posizione dei mercanti presso il duca e nella società lombarda, per suggerire come i mercanti non solo si adoperassero al servizio del principe ma si avvalessero anche del suo sostegno. L'oggetto principale della fittissima serie degli accordi intercittadini, provvedimenti e decreti emanati da Filippo Maria fu il commercio, riconosciuto quale motore dell'economia dello stato. Il ruolo capitale attribuito ai traffici spiega la riorganizzazione dell'Universitas mercatorum quale organismo giusdicente nelle questioni commerciali, che restituì alla Mercanzia una parte delle competenze che le erano state proprie sino alla prima metà del Trecento. Un secondo ambito di intervento riguarda le manifatture. Nei primi decenni del XV secolo il lanificio lombardo fu in netta espansione, a differenza della produzione dei fustagni che, almeno per quanto riguarda Milano, mostra segni di crisi. Il decreto del 1420 per il lanificio e quelli del 1425 e del 1444 per i fustagni, come l'iniziativa di promuovere il setificio, segnalano la volontà del duca di supervisionare le manifatture dell'intero stato e l'intenzione di rendere autosufficiente la produzione per il mercato interno. Un'iniziativa di riforma monetaria, nel 1436, per aumentare le entrate fiscali, venne però intrapresa quando Milano era divenuta un centro di molto maggiore potenza economica, con un'attiva circolazione di moneta aurea, la valuta dell'alta finanza e del commercio internazionale, mentre il fallimento della riforma va spiegato con il fatto che la società lombarda nelle sue componenti artigiane e agrarie era stata pesantemente penalizzata dalla svalutazione della moneta d'argento. / ENGLISH: The contribution presents a summary of the economic policy of Filippo Maria Visconti, starting from the position of merchants in Lombard society, which not only served the duke's interests but also took advantage of his support. The main object of several treatises, measures and decrees issued by Filippo Maria was trade, recognized as the engine of the State economy. The fundamental role attributed to trade explains the reorganization of the Universitas mercatorum, which returned to the merchant guild part of the authority held until the first half of the 14th century. A second area of intervention relates to industry. In the first decades of the 15th century the Lombard wool industry was in full growth, unlike the cotton cloth production that, at least as far as Milan, shows signs of crisis. Filippo Maria, with a decree about wool in 1420 and two decrees in 1425 and 1444 for cotton cloth, as well as promoting silk manufacture, intended to control manufacturing of the entire State to make textile production self-sufficient for the domestic market. An initiative of monetary reform was undertaken in 1436, when Milan was a city of great economic power, with a golden coin circulation, the currency of high finance and international trade, while its failure must be explained by the fact that Lombard society in its artisan and agricultural components had been heavily penalized by the devaluation of silver coin.
La trattazione cerca di delineare i confini teorici ed applicativi dell'istituto dell'interpretazione autentica, nella chiara consapevolezza che dietro tale tematica si celi il più complesso problema di una corretta delimitazione tra attività di legis-latio e attività di legis-executio. Il fenomeno delle leggi interpretative costituisce infatti nodo nevralgico e punto di intersezione di tre ambiti materiali distinti, ossia la teoria dell'interpretazione, la teoria delle fonti del diritto e la dottrina di matrice liberale della separazione dei poteri. All'interno del nostro ordinamento, nell'epoca più recente, si è assistito ad un aumento esponenziale di interventi legislativi interpretativi che, allo stato attuale, sono utilizzati per lo più come strumenti di legislazione ordinaria. Sotto questo profilo, il sempre più frequente ricorso alla fonte interpretativa può essere inquadrato nel più complesso fenomeno della "crisi della legge" i cui tradizionali requisiti di generalità, astrattezza ed irretroattività sono stati progressivamente abbandonati dal legislatore parallelamente con l'affermarsi dello Stato costituzionale. L'abuso dello strumento interpretativo da parte del legislatore, gravemente lesivo delle posizioni giuridiche soggettive, non è stato finora efficacemente contrastato all'interno dell'ordinamento nonostante l'elaborazione da parte della Corte costituzionale di una serie di limiti e requisiti di legittimità dell'esegesi legislativa. In tale prospettiva, diventano quindi di rilevanza fondamentale la ricerca e l'esame di strategie e rimedi, giurisdizionali ed istituzionali, tali da arginare l'"onnipotenza" del legislatore interprete. A seguito dell'analisi svolta, è maturata la consapevolezza delle potenzialità insite nella valorizzazione della giurisprudenza della Corte Edu, maggiormente incline a sanzionare l'abuso delle leggi interpretative. ; The treatment delineates the theoretical and applicative boundaries of the institute of authentic interpretation, in the clear awareness that this issue lurks behind the most complex problem of a proper delimitation between the activities of legis-latio and legis-executio. The phenomenon of the interpretative laws constitutes in fact a nerve centre and a point of intersection of three distinct areas of law, that are the theory of interpretation, the theory of sources of law and the liberal doctrine of the separation of powers. Within our system, in the most recent period, there has been an exponential increase of interpretative legislative interventions that, in the actual state, are used mainly as instruments of ordinary legislation. Under this aspect, the more and more frequent appeal to the interpretative source can be framed in the more complex phenomenon of the "crisis of the law" whose traditional requirements of generality, abstractness and non-retroactivity have been gradually abandoned by the legislator in parallel with the establishment of the constitutional State. The abuse of the interpretative tool by the lawmaker, seriously injurious of the subjective juridical positions, has not yet been effectively thwarted in spite of the elaboration from the constitutional Court of a series of limits and requirements of legitimacy of the legislative exegesis. In this perspective, the research and examination of strategies and jurisdictional and institutional remedies, such as to embank the "omnipotence" of the lawmaker interpreter, become extremely relevant. As a result of the analysis, the investigation has reached the awareness of the potentialities inherent in the development of the jurisprudence of the Court Edu more inclined to punish the abuse of interpretative laws.
La tesi analizza il fenomeno del microcredito in Europa, approfondendo le cause che hanno reso necessaria l'introduzione di questo strumento finanziario anche in economie profondamente diverse da quella in cui ha avuto origine ed esamina le trasformazioni che lo strumento ha subito durante il suo processo di adattamento ai paesi evoluti. Lo studio esamina il microcredito in Francia, Inghilterra, Spagna e Germania, soffermandosi ad analizzare, in ognuno dei suddetti Stati, la disciplina giuridica adottata (qualora esistente), le istituzioni micro finanziarie esistenti, le caratteristiche del settore e le fonti di finanziamento. L'obiettivo dell'analisi è pertanto quello di comprendere come nei Paesi europei convivano contemporaneamente modelli di microcredito profondamente diversi, a seconda del contesto economico, politico e sociale nel quale trovano applicazione. La tesi si concentra ad analizzare il microcredito in Italia, valutando il rapporto esistente tra questo strumento finanziario ed il problema dell'esclusione sociale, dell'immigrazione e dell'usura. Lo studio approfondisce, inoltre, la disciplina giuridica del microcredito adottata in Italia dopo le recenti modifiche introdotte dal D.lgs n. 169/2012. Il lavoro si sofferma ad analizzare, altresì, se e quali interventi, a livello internazionale ed europeo, sono stati programmati per dare al microcredito una cornice legislativa unitaria e per promuoverne lo sviluppo. L'attività di ricerca infine è volta a valutare, sulla base delle esperienze descritte dalla letteratura del settore, gli effetti prodotti dal microcredito, nonché ad approfondire alcune problematiche comuni ai programmi adottati negli Stati europei, quali la sostenibilità delle istituzioni di microcredito, la dipendenza dai sussidi e l'applicazione di tassi di interesse elevati. La tesi si conclude con l'analisi del rapporto esistente tra microcredito e crisi finanziaria, in un periodo storico in cui le politiche per l'occupazione ed il sostegno alla piccola impresa sono fondamentali per stimolare la ripresa economica. ; The thesis analyses the phenomenon of microcredit in Europe going deeply into the causes which have made the introduction of this financial instrument necessary even in completely different economies than those in which it originated and examining the transformation that the instrument has undergone during the process of its adaptation to the progressive countries. The study examines microcredit in France, England, Spain and Germany, pausing to analyse, in each state, the juridical discipline adopted, if existing, the present institutions of micro credit, the nature of the sector and the source of funds. The objective of the analysis is to understand how European countries,according to the economic, political and social context,live completely different models of microcredit at the same time. The thesis concerntrates on analyzing the microcredit in Italy, taking into account the existing relations between this financial instrument and the problems of social exclusion, of immigration and of usury. The study also examines the juridical practice of microcredit used in Italy after recent changes introduced by D.lgs n. 169/2012. The work pauses to analyse if and which interventions, at International and European levels, have been programmed to give microcredit a unitary legislative framework and to promote its development. The research is aimed towards the valuation of the effects produced by microcredit on the basis of experiences described in the literature of the subject, as well as examining some common problems in the programs used in the European States; the sustainability of the microcredit institutions, the dependence of subsidies and the application of high interest taxes. The thesis concludes with the analysis of the existing relations between microcredit and the financial crisis, in a historical period in which politics for occupation and the support of small businesses are fundamental to stimulate economic growth.
Il campo d'interesse della ricerca è stato l'attuale processo di ricentralizzazione del Social Housing nelle periferie urbane in una parte del contesto internazionale, che sembra stia portando le città a ricrearsi e ripensarsi grazie alla presa di coscienza delle differenze esistenti, rispetto al passato, nei nuovi processi di trasformazione nei quali la città è intesa sia come spazio costruito ma anche sociale. In virtù di quest'ultimi due aspetti complementari della città, oggi, il ruolo della periferia contemporanea sembra essere diversamente interpretato, così come gli interventi di riqualificazione di tipo assistenziale - migliorativo tenderebbero a trasformarne i suoi caratteri alla ricerca del "modello di città". L'interesse alla tematica è inoltre scaturito dalla constatazione che alla base della crisi dei modelli d'intervento pubblico starebbero sia l'insostenibilità economica ma soprattutto l'errata lettura dei bisogni delle famiglie nella loro specificità e diversità e che in tal senso l'eventuale partecipazione della cittadinanza costituirebbe effettivamente una proposta valida, anche per risolvere la crescente domanda abitativa che si pone a livello mondiale. L'obiettivo della ricerca è stato quello d'analizzare, nel contesto internazionale del Social Housing, le caratteristiche di partecipazione e sussidiarietà che connotano particolarmente gli interventi di riqualificazione destinati a famiglie economicamente carenti, nello specifico analizzando i metodi e gli strumenti atti alla comunicazione partecipativa del progetto in aree urbane periferiche italiane e brasiliane. Nella prima e seconda fase della ricerca è stato svolto, rispettivamente, un lavoro di analisi bibliografica sul tema dell'emergenza casa e sulle nuove politiche abitative di sviluppo urbano ed uno specifico sulla tematica della riqualificazione partecipata del Social Housing in aree della periferia urbana, infine nella terza fase sono stati analizzati i casi di studio prescelti dando rilievo all'analisi delle caratteristiche e requisiti prestazionali delle tecniche partecipative di rappresentazione - comunicazione, più idonee ad influenzare positivamente il suddetto processo. ; The research covers the current process of re-centralization of Social Housing in the suburbs in a part of the international context, which seems to be leading the cities to rethink and reshape themselves thanks to the awareness of the existing differences, as compared to the past, in the new processes of transformation in which the city is considered both as made up buildings and as a social space. As a conseguence of these two complementary aspects of the city, today, the role of contemporary suburbs seems to be interpreted differently, likewise the welfare rehabilitation tend to transform their characters in search of the "model city". Moreover the interest in this topic is the result of the realization that at the basis of the crisis of public models of intervention lies economic unsustainability and above all the misunderstanding of the needs of families in their specificity and diversity. In this sense the participation of citizens would actually be a valid proposal, even to solve the growing housing demand that is arising in the world. The aim of the research is to analyze, on the international level of Social Housing, the characteristics of participation and subsidiarity that characterize the redevelopment works aimed at less well-off families, in particular by analyzing the methods and means suitable to participatory communication in the project in Italian and Brazilian suburb areas. The first and second steps of the research were, respectively, a work of literature review on home emergency and new housing policies of urban development and a specific on the issue of participatory rehabilitation of Social Housing in suburb areas. Then the third step analyzes case studies selected by highlighting the analysis of the characteristics and performance requirements of participatory techniques of representation - communication, best suited to positively influence this process.
The shift from the continent of emigration to the continent of immigration marks the change of an era for Europe. Since 1945, tens of millions of immigrants have reached Western Europe, at first from other European regions, then from every corner of the world. Thus, a remarkable social transformation took place: the (ultimate) birth of multi-national, multi-racial, multi-cultural, multi-religious societies. For a long time, governments and companies demanded that immigrants be only temporary, so as to have a mass of precarious, barely integrated, vulnerable workers. Such demand, strongly restated over the past few years, was fiercely opposed by immigrant populations, who responded with a wider social rooting. The same applies to the similar demand by the powers that be to impose on immigrants differential exploitation and any sort of discrimination, opposed by a long chain of struggles and upheaval. Over the course of decades, set on the background of the unsolved great crisis of 2008, this conflict has escalated, until the "question of immigration" has turned into a military question, to be fixed with the intervention of the navy and border police. This paper states that the stakes are now too high: either we go back to a model of society and state based on brutal "racial" and class oppression, or we go towards a society finally freed from any kind of oppression. ; Il passaggio dal continente di emigrazione al continente di immigrazione è stato un enorme cambiamento per l'Europa. Dal 1945, decine di milioni di immigrati sono arrivati in Europa occidentale, prima di altre regioni europee, dopo dei quattro angoli del mondo. Così si è verificata un'enorme trasformazione sociale: la nascita (definitiva) di società multinazionali, multirazziali, multiculturali, multireligiose. Per molto tempo i governi e le aziende hanno voluto che gli immigrati fossero solo temporanei, per avere una massa di lavoratori precari, poco integrati e vulnerabili. Questa rivendicazione, tornata con forza negli ultimi anni, ha incontrato l'orgogliosa resistenza delle popolazioni immigrate, che hanno creato un sempre maggiore radicamento sociale. Lo stesso vale per l'analoga rivendicazione dei poteri istituiti di sottoporre le popolazioni e i lavoratori migranti a uno sfruttamento differenziato e ad ogni tipo di discriminazione, che sono state affrontate con lotte e ribellioni. Per decenni, nel fondo minaccioso della grande crisi irrisolta del 2008, questo conflitto si è aggravato fino a trasformare la "questione immigrazione" in una questione militare, che deve essere risolta con le marine militari e la polizia di frontiera. Questo articolo spiega che c'è tanta cosa in gioco: o torniamo a un modello di società e stato basato sulla più brutale oppressione "razziale" e di classe, oppure passiamo a una società definitivamente liberata da queste e altre forme di oppressione ; A passagem de continente de emigração a continente de imigração foi para Europa uma mudança enorme. Desde 1945, chegaram è Europa ocidental dezenas de milhões de imigrantes, antes de outras regiões europeias, depois dos quatro cantos do mundo. Assim se verificou uma transformação social enorme: o nascimento (definitivo) desociedades multinacionais, multirraciais, multiculturais, multirreligiosas. Durante um longo período, os governos e as empresas pretenderam que os imigrantes só fossem temporâneos, para poder dispor de uma massa de trabalhadores precários, pouco integrados, vulneráveis. Esta pretensão, que tem voltado com força nos últimos anos, encontrou a orgulhosa resistência das populações imigrantes, que criaram um enraizamento social cada vez maior. O mesmo vale para a pretensão similar dos poderes estabelecidos de submeter as populações e os/as trabalhadores/trabalhadoras migrantes a uma exploração diferencial e a todo tipo de discriminações, que foram encaradas com lutas e rebeliões. Durante décadas, no fundo ameaçador da grande crise não resolvida de 2008, esse conflito piorou até transformar a "questão imigração" numa questão militar, que deve ser solucionada com as marinhas militares e as polícias de fronteiras. Este artigo explica que há muita coisa em jogo: ou voltamos a um modelo de sociedade e estado baseado na mais brutal opressão "racial" e de classe, ou vamos para frente para uma sociedade definitivamente liberada dessas e outras formas de opressão.
It is now widely agreed that the current "crisis" of the body area is not only economic but also environmental. This issue combined with that of the green economy could provide an opportunity to intervene in the non-municipal territorial systems, once vital to the local economy, and now left to themselves in favor of the urban areas, places more cost effective. Starting from the directions of the Programme for the United Nations Environment Programme (UNEP) could be defined development policies in order to improve the competitiveness and attractiveness of rural territorial systems through the exploitation of local resources present on these territories, with the aim to promote the sustainable development of the various activities in order to create an integrated network. The research shows the different dynamics of the creation of a network of Eco-Villages, with the aim of the new functions existing urban housing stock and improving, thus, the quality of life of mountain villages. This model can effectively represent one of the possible solutions to the depopulation in preserving and protecting the natural environment through the promotion of the green economy, based on the use of sustainable production systems, in compliance with environmental requirements, in the activation of renewable energy systems and tourist attraction in the historical and cultural heritage of the mountain. In fact, these resources if managed in the right way, through careful planning, could be the driving force for a model of sustainable development and at the same time could initiate a redevelopment and enhancement of the rural villages, which often host an architectural heritage of great value, improving so the quality of life of the citizens who live there. So it is necessary, for rural contexts, introduce instruments, innovative ways and means of intervention capable of revitalizing the mountain areas. This paper represents an advance study on the issues that have affected the construction of a network of ecovillages investigating issues related to the local economy, landscape and, more generally, environmental sustainability. ; È ormai opinione largamente condivisa che l'attuale "crisi" dell'organismo territoriale non sia soltanto economica ma anche ambientale. Quest'ultima tematica unita a quella della green economy potrebbero rappresentare l'occasione di intervenire sui sistemi territoriali non urbani, un tempo vitali per l'economia locale, ed oggi abbandonati a se stessi a favore delle aree urbanizzate, luoghi economicamente più vantaggiosi. Partendo dalle indicazioni del Programma per l'Ambiente delle Nazioni Unite (UNEP) si potrebbero definire politiche di sviluppo al fine di migliorare la competitività e l'attrattività dei sistemi territoriali rurali attraverso la valorizzazione delle risorse endogene presenti su tali territori, con l'obiettivo di favorire lo sviluppo ecosostenibile delle diverse attività al fine di creare una rete integrata. La ricerca svolta presenta le diverse dinamiche legate alla creazione di una rete di Eco-Villaggi, con lo scopo di rifunzionalizzare il patrimonio edilizio e urbanistico esistente, migliorando, così, la qualità della vita dei centri montani. Questo modello può rappresentare concretamente una delle possibili soluzioni allo spopolamento, nel conservare e tutelare lo spazio naturale attraverso la promozione della green economy, basata sull'utilizzo di sistemi di produzione sostenibili, nel rispetto dei requisiti ambientali, nell'attivazione di sistemi energetici rinnovabili e nel richiamo turistico del patrimonio storico-culturale della montagna. Infatti queste risorse se gestite nel modo corretto, attraverso una attenta pianificazione territoriale, potrebbero rappresentare il volano per un modello di sviluppo sostenibile e allo stesso tempo potrebbero avviare una riqualificazione e valorizzazione dei borghi rurali, che spesso ospitano un patrimonio architettonico di notevole pregio. Risulta necessario, per i contesti rurali, porre in atto strumenti, modalità e forme innovative d'intervento capaci di rivitalizzare le aree montane. Il presente contributo rappresenta un avanzamento di studio sui temi che hanno interessato la costruzione di una rete di ecovillaggi approfondendo problematiche relative all'economia locale, al paesaggio e, più in generale, alla sostenibilità ambientale.
Una vicenda poco nota, relativa ad una stagione di battaglie sindacali è quella di cui si resero protagoniste le raccoglitrici di fiori di gelsomino della Calabria jonica. Il loro lavoro rappresentò, tra gli anni Cinquanta e gli anni Settanta del '900, un elemento importante nella storia economica e sociale del territorio calabrese, favorendo la creazione di un'interessante rete di collegamento tra le numerose imprese agricole di piccole e medie dimensioni operanti nel territorio ed alcuni tra i più noti marchi dell'industriaprofumiera francese.L'acquisita consapevolezza del profilo "internazionale" e, dunque, dell'importanza del proprio lavoro nella promozione industriale e sociale del territorio, fu all'origine di una stagione di rivendicazioni, che sancirono un netto miglioramento delle condizioni lavorativeed una maggiore considerazione sociale per queste donne trovatesi improvvisamente, anche per effetto della disoccupazione maschile e dell'emigrazione, a ricoprire il ruolo di capo-famiglia; altresì posero all'attenzione del Parlamento la necessità di darericonoscimento normativo alle istanze delle lavoratrici. Nella lotta sindacale condotta da queste pioniere dei diritti delle lavoratrici si intrecciarono, ad un certo punto, interessi che rischiarono di snaturane il significato, ma esse seppero tenere testa alle strumentalizzazioni che provenivano da varie parti, battendosi solo per i loro diritti.La crisi del settore, determinata da un eccesso di produzione rispetto alla domanda e dalla concorrenza di alcuni paesi esteri (Egitto, Israele, Spagna, Algeria, Tunisia), che poterono giovarsi anche dei minori costi della manodopera, provocò un crollo verticale dellevendite di gelsomino, conducendo nel giro di pochi anni alla totale sparizione della coltura dalle coste calabresi.Il legislatore intervenne tardivamente per disciplinare molti di quei diritti che le raccoglitrici di gelsomino erano riuscite a conquistare, ottenendo una contrattazione collettiva provinciale che rispettava e richiamava il diritto consuetudinario. L'intervento dello Stato fu tardivo perché alla fine degli anni Settanta quasi più nessuno in Calabria coltivava il gelsomino e le mutate condizioni del mercato internazionale dirottarono le commesse dell'industria francese verso Paesi più competitivi. Tuttavia, il ruolo pionieristico di queste donne, il cui lavoro tracciava di per sé un'identità di genere, segnò sicuramente un passo decisivo verso il cambiamento sociale e l'emancipazione femminile, che sembra doveroso ricordare. ; A little-known story relating to a season of trade union struggles is the one in which the jasmine flower pickers of Ionian Calabria were the protagonists. Their work represented, between the fifties and the seventies of the twentieth century, an important element in the economic and social history of the Calabrian territory, favoring the creation of an interesting network of connection between the numerous small and medium-sized agricultural companies operating in the territory and some of the best-known brands of the French perfume industry.The acquired awareness of the "international" profile and, therefore, of the importance of one's work in the industrial and social promotion of the territory, was at the origin of a season of claims, which sanctioned a clear improvement in working conditions and greater social consideration for these women who suddenly found themselves, also as a result of male unemployment and emigration, to fill the role of head of the family; they also brought to the attention of Parliament the need to give regulatory recognition to the requests of female workers.In the trade union struggle conducted by these pioneers of the rights of female workers, at a certain point, interests intertwined that risked distorting the meaning, but they were able to cope with the exploitation that came from various sides, fighting only for their rights.The crisis in the sector, determined by an excess of production compared to the demand and by competition from some foreign countries (Egypt, Israel, Spain, Algeria, Tunisia), which could also benefit from lower labor costs, caused a vertical collapse in sales of jasmine, leading within a few years to the total disappearance of the crop from the Calabrian coasts.The legislator intervened belatedly to regulate many of those rights that the female jasmine pickers had managed to conquer, obtaining a provincial collective bargaining that respected and recalled customary law. State intervention was late because at the end of the seventies almost no one in Calabria was growing jasmine and the changed conditions of the international market diverted orders from French industry to more competitive countries. However, the pioneering role of these women, whose work in itself traced a gender identity, certainly marked a decisive step towards social change and women's emancipation, which it seems necessary to remember.
Le celebrazioni per i 150 anni dell'Unità d'Italia offrono anche l'occasione per interrogarsi sulla storia e lo sviluppo di questo Paese, in particolare in riferimento alla cultura del mare e al sistema dei trasporti via acqua. In un paese peninsulare come l'Italia, con i suoi 7.500 chilometri di fronte d'acqua, la presenza dei porti è sempre stata elemento determinante per la crescita economica e per la sua affermazione sui mercati internazionali. Ma, dalla seconda metà del Novecento, le città e i loro porti sono andati progressivamente separandosi, determinando situazioni di forti contrasti e di continue tensioni. Solo più recentemente – a seguito della legge n. 84 del 1994 – nuove forme di 'dialogo' hanno consentito, in talune occasioni, di riavviare politiche di concertazione sui piani di sviluppo delle aree portuali e sul miglioramento della situazione delle zone urbane prossime ai porti. Per tutti questi motivi, l'occasione del 150esimo anniversario dell'Unità d'Italia può rappresentare un momento significativo per riprendere la riflessione sul ruolo dei porti italiani nella storia del nostro paese, ed, eventualmente, sul potenziale rafforzamento che essi possono subire, alla luce dei dati positivi ed incoraggianti dell'intero cluster marittimo in questi ultimi anni, almeno fino alla crisi congiunturale del 2008.Al tempo stesso, si può analizzare la complessa relazione porto-città, in un'ottica di mutuo riconoscimento delle rispettive esigenze e della volontà di sviluppare le proprie attività in un quadro di concreto ed efficace spirito di collaborazione, che richiede sia una maggiore conoscenza reciproca, così come una più efficace definizione degli obiettivi per il raggiungimento di una qualità urbana sostenibile e duratura.La progressiva globalizzazione dell'economia e la liberalizzazione del mercato hanno determinato una generale crescita degli scambi commerciali a livello mondiale e in particolare il bacino del Mediterraneo è diventato un centro di flussi di traffico Est-Ovest e Nord-Sud. L'Italia, posta al centro del bacino del Mediterraneo, è tornata ad essere oggi il crocevia delle più importanti direttrici di collegamento mondiale di merci e passeggeri, vivendo una stagione di intensa crescita nei traffici marittimi. Ad eccezione per quei porti caratterizzati da una forte presenza del segmento crocieristico che ha registrato livelli di crescita interessanti, la crisi congiunturale e globale del 2008 ha avuto effetti molto pesanti anche in questo settore (traffico merci su mezzi pesanti e traffico container). Si pagano alcune lacune storiche della portualità del Mediterraneo, e di quella adriatica in particolare, quali la mancanza di collegamenti terrestri via ferrovia da e per i porti, anche se le Autorità Portuali stanno cercando di colmare il ritardo sia dal punto di vista infrastrutturale che di sostenibilità ambientale, attraverso politiche di condivisione e convivenza tra il porto e il territorio circostante e in una rinnovata e diffusa 'cultura del mare' e del ruolo attivo e 'creativo' dei porti. Solo attraverso un approccio culturale e una reciproca educazione potrà emergere una nuova percezione del porto in città e della città nel porto. In realtà, esistono già segnali incoraggianti di una recente appropriazione – o ri-appropriazione – del porto in chiave positiva e di un recupero della cultura del mare in alcune città portuali italiane. Attraverso un processo lento e complesso, articolato in eventi diversi, sta maturando un nuovo 'sentire' nei confronti dei porti, visti in chiave di risorsa e di parte integrante di una città, purché essi rispettino alcune regole necessarie per una vita urbana sostenibile. ; The celebrations for the 150th anniversary of the Unification of Italy also offer the opportunity to question the history and development of this country, particularly in reference to the maritime culture and the system of water transport. In a peninsular country like Italy, with its 7,500 km of waterfront, the presence of ports has always been crucial to economic growth and its success in international markets. But the second half of the twentieth century, cities and their ports have been gradually separated, resulting in situation of conflict and ongoing tensions. Only recently – following the Law 84, 1994 - new forms of 'dialogue' have allowed, on certain occasions, to restart political consultation on the development plans of the port areas and on improving the situation of urban areas close to ports. For all these reasons, the occasion of the 150th anniversary of the Unification of Italy can be a significant moment to resume the debate on the role of Italian ports in the history of our country, and possibly increase the potential that they may have, according to the positive and encouraging data of the entire maritime cluster in recent years, at least until the economic crisis of 2008. At the same time, the complex relationship port-city can be analyzed, with a view to mutual recognition of their needs and to the development of their activities in a framework of practical and effective, cooperative spirit, which requires both a greater mutual understanding as well as a more effective targeting to achieve a lasting and sustainable urban quality. The gradual economic globalization and market liberalization have led to a general increase in trade globally and in particular the Mediterranean has become a centre of traffic flows East-West and North-South. Italy, located in the middle of the Mediterranean basin, is now once again become the crossroads of the most important lines of goods and passengers connected world, experiencing a period of intense growth in maritime trade. Except for those ports with a strong presence of the cruise segment, which recorded growth rates of interest, the global economic crisis of 2008 has had very heavy in this sector (freight traffic to trucks and containers). This is also due to some historical gaps of the Mediterranean ports, such as the lack of rail connections to and from the ports, although Port Authorities are trying to bridge the gap both in terms of infrastructural interventions and environmental sustainability, through policies of sharing and coexistence between the port and the surrounding area and through a renewed and widespread 'culture of the sea'. Since only through a cultural approach and mutual education will emerge a new perception of the port in the city and the city in the port. Le celebrazioni per i 150 anni dell'Unità d'Italia offrono anche l'occasione per interrogarsi sulla storia e lo sviluppo di questo Paese, in particolare in riferimento alla cultura del mare e al sistema dei trasporti via acqua. In un paese peninsulare come l'Italia, con i suoi 7.500 chilometri di fronte d'acqua, la presenza dei porti è sempre stata elemento determinante per la crescita economica e per la sua affermazione sui mercati internazionali. Ma, dalla seconda metà del Novecento, le città e i loro porti sono andati progressivamente separandosi, determinando situazioni di forti contrasti e di continue tensioni. Solo più recentemente – a seguito della legge n. 84 del 1994 – nuove forme di 'dialogo' hanno consentito, in talune occasioni, di riavviare politiche di concertazione sui piani di sviluppo delle aree portuali e sul miglioramento della situazione delle zone urbane prossime ai porti. Per tutti questi motivi, l'occasione del 150esimo anniversario dell'Unità d'Italia può rappresentare un momento significativo per riprendere la riflessione sul ruolo dei porti italiani nella storia del nostro paese, ed, eventualmente, sul potenziale rafforzamento che essi possono subire, alla luce dei dati positivi ed incoraggianti dell'intero cluster marittimo in questi ultimi anni, almeno fino alla crisi congiunturale del 2008.Al tempo stesso, si può analizzare la complessa relazione porto-città, in un'ottica di mutuo riconoscimento delle rispettive esigenze e della volontà di sviluppare le proprie attività in un quadro di concreto ed efficace spirito di collaborazione, che richiede sia una maggiore conoscenza reciproca, così come una più efficace definizione degli obiettivi per il raggiungimento di una qualità urbana sostenibile e duratura.La progressiva globalizzazione dell'economia e la liberalizzazione del mercato hanno determinato una generale crescita degli scambi commerciali a livello mondiale e in particolare il bacino del Mediterraneo è diventato un centro di flussi di traffico Est-Ovest e Nord-Sud. L'Italia, posta al centro del bacino del Mediterraneo, è tornata ad essere oggi il crocevia delle più importanti direttrici di collegamento mondiale di merci e passeggeri, vivendo una stagione di intensa crescita nei traffici marittimi. Ad eccezione per quei porti caratterizzati da una forte presenza del segmento crocieristico che ha registrato livelli di crescita interessanti, la crisi congiunturale e globale del 2008 ha avuto effetti molto pesanti anche in questo settore (traffico merci su mezzi pesanti e traffico container). Si pagano alcune lacune storiche della portualità del Mediterraneo, e di quella adriatica in particolare, quali la mancanza di collegamenti terrestri via ferrovia da e per i porti, anche se le Autorità Portuali stanno cercando di colmare il ritardo sia dal punto di vista infrastrutturale che di sostenibilità ambientale, attraverso politiche di condivisione e convivenza tra il porto e il territorio circostante e in una rinnovata e diffusa 'cultura del mare' e del ruolo attivo e 'creativo' dei porti. Solo attraverso un approccio culturale e una reciproca educazione potrà emergere una nuova percezione del porto in città e della città nel porto. In realtà, esistono già segnali incoraggianti di una recente appropriazione – o ri-appropriazione – del porto in chiave positiva e di un recupero della cultura del mare in alcune città portuali italiane. Attraverso un processo lento e complesso, articolato in eventi diversi, sta maturando un nuovo 'sentire' nei confronti dei porti, visti in chiave di risorsa e di parte integrante di una città, purché essi rispettino alcune regole necessarie per una vita urbana sostenibile. ; The celebrations for the 150th anniversary of the Unification of Italy also offer the opportunity to question the history and development of this country, particularly in reference to the maritime culture and the system of water transport. In a peninsular country like Italy, with its 7,500 km of waterfront, the presence of ports has always been crucial to economic growth and its success in international markets. But the second half of the twentieth century, cities and their ports have been gradually separated, resulting in situation of conflict and ongoing tensions. Only recently – following the Law 84, 1994 - new forms of 'dialogue' have allowed, on certain occasions, to restart political consultation on the development plans of the port areas and on improving the situation of urban areas close to ports. For all these reasons, the occasion of the 150th anniversary of the Unification of Italy can be a significant moment to resume the debate on the role of Italian ports in the history of our country, and possibly increase the potential that they may have, according to the positive and encouraging data of the entire maritime cluster in recent years, at least until the economic crisis of 2008. At the same time, the complex relationship port-city can be analyzed, with a view to mutual recognition of their needs and to the development of their activities in a framework of practical and effective, cooperative spirit, which requires both a greater mutual understanding as well as a more effective targeting to achieve a lasting and sustainable urban quality. The gradual economic globalization and market liberalization have led to a general increase in trade globally and in particular the Mediterranean has become a centre of traffic flows East-West and North-South. Italy, located in the middle of the Mediterranean basin, is now once again become the crossroads of the most important lines of goods and passengers connected world, experiencing a period of intense growth in maritime trade. Except for those ports with a strong presence of the cruise segment, which recorded growth rates of interest, the global economic crisis of 2008 has had very heavy in this sector (freight traffic to trucks and containers). This is also due to some historical gaps of the Mediterranean ports, such as the lack of rail connections to and from the ports, although Port Authorities are trying to bridge the gap both in terms of infrastructural interventions and environmental sustainability, through policies of sharing and coexistence between the port and the surrounding area and through a renewed and widespread 'culture of the sea'. Since only through a cultural approach and mutual education will emerge a new perception of the port in the city and the city in the port. The present dissertation work consists of 3 chapters. The first one focuses on the analysis of the role of collective bargaining within Community Law. The purpose is to assess whether it is suitable today to speak about an enhancement of "collective autonomy" within Community Law. If the new provisions of the Treaty of Lisbon, acknowledging the autonomy of social partners, allow to compare the European systems which featuring the principle of "collective autonomy", their implementation will deny this conclusion. The weakness of collective bargaining has lead the single European systems to face the current economic crisis by adopting national reforms pursuing the objective of "flexicurity" spurred and supported by European Institutions. An alignment between different European systems of industrial relations has been observed as for the shared trend towards a decentralization of corporate contracts at company level, this particularly in the French and Italian systems. The second chapter, after a short description of the French system of relations professionnelles, will further focus on the analysis of the instruments employed by French Legislator to promote collective bargaining at company level. The lois Auroux breached the traditional system of relations professionnelles leading to a true earthquake first in 2004 and then in 2008. The point is the different way of conceiving the traditional hierarchy system of the sources with a change in the criteria ruling it, that are now identified in the principle of "subsidiarity". The unsatisfactory implementation of the reform lead the French legislator to a new intervention in 2008. The 2008 Law reached the point of making the convention de branche suppletive and abolished the hierarchic principle making the accord d'entreprise the new cornerstone of the system. The law also completely reshaped the Trade Union Law. The reform amended the legitimacy review of collective agreements but also amended the representativeness required for trade unions completely abolishing the principle of assumption of representativeness. The 2008 Law engendering an actual promotion of the settlement of the accords d'entreprise, particularly in matter of employment. The final chapter, after a brief overview of the developments of Italian system of collective bargaining, will focus on the analysis of the instruments employed by the social partners in order to promote company agreements. The most relevant instrument has been identified in the "exit clauses" that, already used in the legal praxis, were first officially acknowledged only by the 2009 reform. The Framework-agreement of 22 January 2009 introduced the possibility of reaching "specific modifying agreements" occurring quite a wide number of conditions and cases, whereas the Interconfederal Agreement of 15 April 2009 introduced stricter criteria and limited its stipulation only to the regional local level. The "Fiat" case, first reached company agreements completely regardless of the new rules, made it urgent the need for a change of the trade union representation. On the matter, the Interconfederal Agreement of 28 June 2011 introduced the criteria of calculation of trade union representativeness on which the general effectiveness of company agreements is depending and which basically lead to the adoption of the majority principle. These criteria were re-asserted under art. 8 of law nr. 148/2011, which simply refers to a generic majority principle thus stretching the results of the agreement far beyond its original expectations. The art. 8 acknowledge the "specific modifying agreements" at the company and regional local levels (now called "proximity bargaining") in such a great number of cases to cover the whole regulation of working relationships. Derogation is now legitimated even in respect to the law, by a "blank power of attorney" to the decentralised level. ; La thèse est articulée en trois chapitres. Dans le premier est analysé l'encadrement juridique de la négociation collective par le droit communautaire. L'approche suivie a pour objectif de vérifier l'utilisation par le droit communautaire de la notion d'« autonomie collective ». Si les nouveaux dispositifs du Traité de Lisbonne, reconnaissant l'autonomie des partenaires sociaux, permettent de rapprocher les systèmes européens qui connaissent telle notion, leur mise en œuvre renie une telle conclusion. La faiblesse de la négociation collective européenne a conduit les législateurs nationaux, derrière la poussée des institutions européennes, à faire face à la crise économique par l'adoption de réformes visant à atteindre l'objectif de « flexicurité ». Dans ce contexte, on peut ainsi souligner la convergence des systèmes européens de relations professionnelles sur une décentralisation vers l'entreprise, tendance clairement observée dans la comparaison franco-italienne. Le deuxième chapitre est consacré à l'évolution du système français de relations professionnelles : après sa brève reconstruction, sont analysés les instruments élaborés par le législateur afin d'encourager la négociation d'entreprise par l'introduction d'accords dérogatoires. A partir des lois Auroux, une brèche dans le traditionnel système de relations professionnelles a été ouverte, suivie par des élargissements en 2004 et 2008. Il s'agit d'une nouvelle logique de fond du système, fondée sur la possibilité d'introduire des dérogations aux conventions collectives de différents niveaux, ainsi qu'à la loi. Il s'agit de faire place au critère de subsidiarité au lieu du principe traditionnel de hiérarchie. La mise en œuvre insatisfaisante de la réforme de 2004 a poussé le législateur à intervenir à nouveau en 2008 : il supprime le critère de hiérarchie qui est remplacé par le principe de « supplétivité ». La réforme a fait de l'accord d'entreprise le nouveau centre de gravité du système, en réalisant un vrai bouleversement. La loi de 2008 a créé également une véritable refondation du droit syndical, en intervenant sur les règles de légitimité des conventions collectives ainsi que sur les critères de représentativité des syndicats, en supprimant la présomption irréfragable de représentativité. La réforme a enfin effectivement encouragé la conclusion d'accords d'entreprise, notamment en matière d'emploi. Le dernier chapitre est consacré à la négociation collective en Italie. Il retrace l'évolution du système de relations professionnelles, historiquement centralisé, et la difficile émergence de la négociation d'entreprise, en analysant les instruments élaborés par les partenaires sociaux afin d'encourager la diffusion de la négociation d'entreprise. L'instrument le plus significatif a été celui des «clauses de sortie » qui, bien que déjà pratiquées, ont été formellement reconnues par la réforme de 2009. Alors que l'accord-cadre du 22 janvier 2009 autorise des « accords spécifiques modifiant » dans des conditions assez larges, l'accord interprofessionnel du 15 avril 2009 reproduit des critères plus stricts et limite eux au niveau territorial. Le cas Fiat, qui s'est posé en dehors des nouvelles règles, a rendu nécessaire une intervention en matière de représentativité syndicale. Ce qu'a été fait par l'accord interprofessionnel du 28 juin 2011 qui fixe les critères pour mesurer la représentativité syndicale, en accueillant un principe majoritaire auquel est liée l'efficacité générale des conventions collectives. Tels critères sont confirmés par l'art. 8 de la loi n° 148/2011, qui mentionne le principe majoritaire l'étendant bien au-delà des cas prévus par l'accord interprofessionnel. L'article 8 légitime les accords modifiants au niveau de l'entreprise et du territoire (« négociation de proximité ») dans cas si larges qu'ils couvrent l'entière règlementation des rapports de travail, dérogeant aussi bien aux conventions qu'à la loi par une sorte de « délégation en blanc ».
Il lavoro prende in considerazione i principali avvenimenti che hanno influenzato l'evoluzione economica finanziaria del nostro Paese nella crisi del cambio 1992,ho voluto concentrare l'attenzione sugli avvenimenti a partire dal 1979 e analizzando l'intervento delle autorità monetarie. Allora non esisteva l'Euro, esisteva il Sistema Monetario Europeo con una sorta di valuta di riferimento, l'ECU, a cui le varie valute nazionali aderenti al sistema dovevano stare agganciate, entro una percentuale di scostamento non superiore al 2,25% per alcune e al 6% per altre, fra cui la lira. La Germania vantava di un'economia più solida di altri, con un sistema produttivo di avanguardia e con una moneta forte che faceva da riferimento per tutte le economie. L'Italia aveva un' economia che si doveva adattare continuamente alle conseguenze di una gestione del paese sconsiderata, miope e orientata al breve termine, frutto di una incompetenza della classe politica. Nel marzo 1979, l'Italia aveva aderito al Sistema Monetario Europeo, una decisione orientata, insieme con la politica estera, al rafforzamento dei vincoli comunitari nell'intento di dar luogo alla creazione di un'Europa Unita; consapevoli che questa sarebbe stata una scelta più di carattere politico che economica. L'adesione allo Sme avvenne in un clima di divergenza, Paolo Baffi allora governatore della Banca d'Italia, faceva infatti presente che una valuta debole come la lira, avrebbe trovato difficoltà ad abbandonare il regime delle svalutazioni facile. diversi economisti, oltre a Baffi,al di là di dove sedessero, se in Parlamento come Luigi Spaventa o alla direzione della Banca d'Italia o ancora all'interno del governo come Rinaldo Ossola, sostenevano la loro contrarietà all'ingresso nel Sistema Monetario Europeo, esponendo motivazioni tra loro eterogenee. Tutti si attendevano che il vincolo esterno dei cambi stabili costringesse il paese a seguire una politica di rigorosa stabilità monetaria. L'Italia aveva ottenuto il privilegio di una banda di oscillazione del 6%, contro il 2,5% degli altri paesi, ma tutti intendevano che l'adesione all'accordo di cambio avrebbe imposto una politica di rientro all'inflazione. Contro le aspettative generali, l'inflazione proseguì invece più violenta di prima. Il tasso di cambio, assunse con l'avanzare del progetto unitario una significatività crescente, aggiungendo alla sua funzione di strumento di orientamento, quella di fattore di credibilità. Le autorità monetarie italiane non accettarono mai una svalutazione esterna della lira pari a quella interna. Fra il 1980 e il 1987, i riallineamenti di parità nell'ambito dello Sme si susseguirono numerosi e coinvolsero numerose valute. Ogni riallineamento segnò una svalutazione della lira rispetto al marco. Dopo il 1987, i riallineamenti vennero sospesi e il corso della lira subì un solo ritocco al ribasso, in occasione del rientro della banda stretta. La politica di fatto seguita fu dunque quella di una graduale rivalutazione della lira, in termini reali, rispetto al marco. All'inizio degli anni novanta venne firmato il trattato di Maastricht, il contenuto degli accordi si inseriva in un contesto politico- sociale interno altamente critico, nel quale le energie politiche a lungo represse dalla guerra fredda si erano liberate, grazie al crollo del Muro di Berlino, spingendo quindi gli equilibri del sistema politico e economico con una rottura che si verificò del tutto nel 1992. Se il processo d'integrazione europeo era stato spesso rappresentato dalla classe politica come una sorta di panacea alle tare italiane, a Maastricht, si celebrò l'innocenza dell'europeismo italiano che vide stravolgere e crollare la visione retorica con la quale aveva guardato alla costruzione europea a partire degli anni '70. Per la storia dell'integrazione europea, il trattato di Maastricht rappresenta una pietra miliare, anche se con l'entrata in vigore ha creato ancora più instabilità, in quanto caratterizzato da uno scarso realismo degli obiettivi di convergenza delle variabili macroeconomiche, da mancanza flessibilità e insieme da asimmetrie dei comportamenti possibili delle banche centrali. La scena economica internazionale era segnata da: tendenze divergenti dei tassi di interesse, al ribasso negli Stati Uniti per rilanciare l'economia, al rialzo in Germania per gli effetti dell'unificazione tedesca, con conseguenti indebolimenti del dollaro, rafforzamento del marco, tensione nello Sme; le incertezze circa il completamento della unificazione monetaria in Europa, quale è stata sancita nel trattato di Maastricht. Questi sviluppi esterni coglievano l'economia italiana in una fase di attività produttiva debole, inflazione in lenta discesa, squilibri irrisolti nella finanza pubblica. Tra gli accadimenti che sono susseguiti, sono da richiamare i seguenti: l'esito negativo del referendum danese sul trattato di Maastricht del 2 giugno, infatti il referendum di Copenaghen si conclude al fotofinish (50,7%) di no contro il (49,3%) di si; mancata riduzione dei tassi di interesse in Germania; voci di svalutazione della lira; rialzo dei tassi ufficiali in Germania. Nel corso dell'anno 1992 si assiste a una piena recessione, infatti con il debito pubblico al 105,5 del Pil, con un fabbisogno attorno al 10,4 del Pil, con il passivo della bilancia dei pagamenti di parte corrente in crescita, la crisi era alle porte. Il 6 giugno la Banca d'Italia aumenta il tasso sulle anticipazioni a scadenza fissa di mezzo punto percentuale, irrigidendo così la politica monetaria, Moody's mise sotto controllo l'Italia per la sua incapacità nella riduzione del debito pubblico. Il 29 giugno il cambio contro il marco arrivò a 756,54 a fronte di una sostanziale stabilità nei confronti della sterlina e della peseta, Amato per effettuare un risanamento economico annunciò il 5 luglio la manovra da 30000 miliardi di lire, e con quella successiva di 100000 miliardi dà inizio al risanamento finanziario del Paese. Le vicende relative alle turbolenze che hanno sconvolto le parità valutarie dei paesi aderenti allo Sme hanno avuto inizio con la svalutazione del 7% della lira, la quale appariva quasi un riallineamento da manuale. Il 21 settembre, la Banca d'Italia, annunciò che le autorità monetarie si sarebbero astenute all'effettuare la quotazione ufficiale della lira. Questo fu un colpo durissimo per l'Italia che fino a quella data, aveva fatto del cambio della lira l'architrave della sua politica economica e finanziaria, sostenendo pesanti oneri in termini di riserve valutarie, infatti tra il giugno e il settembre vennero impiegate 53000 miliardi di riserve; colpo durissimo anche per la Comunità, colpita al cuore proprio nello strumento fondamentale, lo SME, investito nel ruolo di preparare e garantire le condizioni di stabilità, generalizzata e consolidata, che avrebbero dovuto, poi consentire quel salto di qualità dell'Europa, con il decollo della Unione Economica e monetaria, la moneta unica e il sistema delle banche centrali europee. Successivamente le tensioni speculative investono la lira , la sterlina e la peseta: momento in cui Italia e Gran Bretagna annunciano di uscire dagli Accordi europei di cambio. Subito dopo la svalutazione del 1992, si aprì un periodo di svalutazione generale della lira rispetto alle altre monete, periodo che si protrasse all'incirca fino al marzo 1993. Tra il 1992 e 1993 vennero firmati due accordi triangolari il protocollo Amato 31 luglio 1992 che abolì il sistema di scala mobile, completato da Ciampi nel luglio 1993, con la quale si fissarono gli obiettivi comuni di politica di reddito. Dopo di allora la lira rimase agganciata al dollaro. Il legame fra lira e dollaro potrebbe essere frutto dell'agire spontaneo dei mercati, ma potrebbe anche essere scaturito dalla decisione delle autorità monetarie italiane di ritornare alla vecchia linea di cambio differenziato, già seguita negli anni prima del 1979, fino all'ingresso dello Sme. Il problema essenziale delle autorità di governo era quello di evitare che la svalutazione esterna della lira si traducesse in inflazione importata, l'aver agganciato la lira al dollaro può essere inteso come una misura ragionevolmente coerente con l'obiettivo della stabilità monetaria. Di certo che la svalutazione della lira non ha contribuito alla soluzione del problema economico italiano, ha rischiato di aggravarlo producendo perdita di credibilità per il Paese. La crisi del sistema monetario europeo ha favorito una ripresa dei dibattiti teorici sui modelli di crisi valutarie, che si distinguono tra prima e seconda generazione, quelli di prima collegano l'emergere della crisi all'incompatibilità tra politiche macroeconomiche e stabilità del cambio; quelli di seconda, il cui sviluppo è stato stimolato dagli stessi fatti del 1992, nella quale l'emergere di una crisi appare come una scelta endogena, effettuata dalle autorità in base alle proprie preferenze e all'interazione con gli agenti economici privati. Analizzando i modelli si può concludere che mentre la rappresentazione di un regime di cambio fisso per mezzo di un livello puntuale del cambio non rappresenta un limite interpretativo rilevante, le ipotesi relative al processo di espansione del credito e all'esistenza di un livello di soglia delle riserve, nei modelli di Krugman, non sembrano dar conto adeguatamente della realtà dei fenomeni economici. I modelli di prima generazione danno una spiegazione "fondamentalista" delle crisi nel senso che fanno risalire la crisi allo sfasamento dei fondamentali macroeconomici dell'economia, in particolare l'esistenza di politiche fiscali espansive e prolungati deficit di bilancio incompatibili con un impegno di cambio fisso. I modelli di seconda generazione sottolineano il comportamento ottimizzante del policy-maker che non subisce più la crisi, ma decide di avviarla perché tale scelta minimizza i costi, nel senso che i costi in termini di reputazione a cui il governo va incontro uscendo dall'impegno sono comunque minori dei costi di rimanere in termini di incremento dei tassi di interesse e riduzione delle riserve valutarie. I modelli di terza generazione pongono enfasi sulla presenza di squilibri di natura finanziaria con la conseguenza che delle crisi valutarie non sono più viste come fenomeni a sé stanti ma come parte di una crisi sistemica in cui le crisi valutarie e bancarie si autoalimentano. Le ipotesi di perfetta previsione, d'altra parte, implicano che la razionalità degli agenti sia tale da non permette il realizzarsi di peso problem, i quali invece vengono osservati nella realtà. At that time there was no euro, there was the European Monetary System with a kind of reference currency, the ECU, to which the various national currencies participating in the system had to be hooked, within a variance rate of no more than 2.25% for some and 6% for others, including the lira. Germany boasted of an economy stronger than others, with a state-of-the-art production system and a strong currency that was the benchmark for all economies. Italy had an economy that had to adapt continuously to the consequences of a reckless, short-sighted and short-term management of the country, the result of an incompetence of the political class. In March 1979, Italy had joined the European Monetary System, a decision aimed, together with foreign policy, at strengthening EU ties in order to create a united Europe; aware that this would be a more political than an economic choice. The policy followed was therefore that of a gradual revaluation of the lira, in real terms, with respect to the mark. At the beginning of the 1990s the Maastricht Treaty was signed, the content of the agreements was part of a highly critical internal political-social context, in which political energies long repressed by the Cold War had been freed, thanks to the collapse of the Berlin Wall, thus pushing the balance of the political and economic system with a break that occurred entirely in 1992. If the process of European integration had often been portrayed by the political class as a kind of panacea to the Italian tare, in Maastricht, the innocence of Italian Europeanism was celebrated, which saw the rhetorical vision with which it had looked to the construction of Europe since the 1970s, overturned and collapsed. For the history of European integration, the Maastricht Treaty represents a milestone, although with the entry into force it has created even more instability, as it is characterized by a lack of realism in the convergence objectives of macroeconomic variables, lack of flexibility and at the same time as asymmetries of the possible behaviour of central banks. The international economic scene was marked by: divergent trends in interest rates, downwards in the United States to boost the economy, up in Germany due to the effects of unification Germany, resulting in a weakening of the dollar, a strengthening of the mark, tension in the SME; The uncertainty about the completion of monetary unification in Europe, as enshrined in the Maastricht Treaty, is. These external developments caught the Italian economy in a period of weak production activity, slow-falling inflation, unresolved imbalances in public finances. Among the events that have followed, the following are to be recalled: the negative outcome of the Danish referendum on the Maastricht Treaty of 2 June, in fact the Copenhagen referendum ends at photofinish (50.7%) no versus (49.3%) yes; failure to reduce interest rates in Germany; rumours of the valuation of the lira; official interest rates in Germany. Subsequently, speculative tensions hit the lira, sterling and peseta, when Italy and Great Britain announced they were leaving the European Exchange Agreements. Immediately after the devaluation of 1992, a period of general devaluation of the lira against the other currencies opened up, which lasted approximately until March 1993. Between 1992 and 1993, two triangular agreements were signed, the Amato protocol on 31 July 1992, which abolished the escalator system, which was completed by Ciampi in July 1993, which set common income policy objectives. After that, the lira remained pegged to the dollar. The link between the lira and the dollar may be the result of the spontaneous action of the markets, but it could also have stemmed from the decision of the Italian monetary authorities to return to the old differentiated exchange line, which was already followed in the years before 1979, until the entry of the Sme. The second-generation models emphasize the optimising behaviour of the policy-maker who is no longer suffering from the crisis, but decides to start it because this choice minimizes costs, in the sense that the reputation costs that the government faces by exiting the commitment are still lower than the costs of staying in terms of raising interest rates and reducing currency reserves. Third-generation models place emphasis on financial imbalances, with the consequence that currency crises are no longer seen as stand-alone phenomena but as part of a systemic crisis in which currency and banking crises feed themselves. The hypotheses of perfect prediction, on the other hand, imply that the rationality of the agents is such that it does not allow the realization of weight problem, which instead are observed in reality.
