N-ground' or 'multi-ground' ('Superground & Underground') concept applied to Seoul, call us to a new qualitative development that responds to the possibility to superimpose a new dense floor in the old infrastructures. A new ReCitying Topos on, inside, in, where and through which to develop new/old programs, uses and activities of life and relationship. The singularity of Seoul is the capacity for the city to combine and manage all the new global urban paradigmatic challenges. Seoul new qualitative development responds does not intend to "continue" or "recreate" the traditional city. Nor impose or positionate, transforming it, built machines or objects but superimpose a new dense floor (container and articulator at the same time) in the old obsolete infrastructures, that becomes a new Re-Citying. 학위논문(석사)--서울대학교 대학원 :인문대학 국사학과,2019. 8. 정용욱. ; This paper analyzes the organization and activities of the UNKRA(United Nations Korean Reconstruction Agency), which was established and operated under the UN General Assembly in the 1950s for Korean rehabilitation and reconstruction. Through this, this research tries to understand the problem of economic reconstruction in Korea after the Korean War. When UNKRA was founded, the United Nations forces anticipated military success and an early cessation of hostalities. However, Chinese intervention in Korea might prolong hostilites and hamper rehabilitation and recovery indefinitely. In the early years, UNKRA could not fully implement the reconstruction program until the military situation had settled down. Instead, it operated under military supervision. During the war, UNKRA mainly seconded its experts to the UNCACK(United Nations Civil Assistance Command in Korea). After September 1952, CINCUNC, UNKRA and the Government of the Republic of Korea agreed to start as much basic rehabilitation and reconsruction program as the military situation would allow. Nevertheless, the general situation had made it necessary to accord the first priority to the importation of consumer goods. Furthermore, UNKRA proceeded to develop comprehensive plans and programs in the support of the UN specialized agencies and the Nathan Associates. The Nathan Associates developed the Five-Year Plan for the reconstruction of Korea, which meant Korea could achieve economic independence in five years. It suggested that the major portion of investment would go into sectors of physical production and distribution where the direct, measurable impacts on national output would be heaviest and quickest. However, despite of the desirability of a large social investment programs in Korea after the Korean War, they did not emphasize upon social investment because of limited resources for reconstruction. After Armistice in July 1953, UNKRA actually launched the reconstruction program. However, UNKRA could not take over responsibility for all relief and rehabilitation activities because the United States developed a defense support program for South Korea after the war. That is, UNKRA was assigned a certain segment to operate and the rehabilitation of the war was coordinated through the OEC(Office of the Economic Coordinator). Nevertheless, UNKRA was independent from the defense support program of the United States and could emphasize on non-military areas of the economy. UNKRA's largest over-all investment allocation was made in the idustrial field. UNKRA undertook the reconstruction of the major industrial plants and the construction of new manufacturing facilities in the important sectors of manufacturing industries. In spite of many problems in operation and shortages of funds, it provided the capital and engineering for industrial expansion in Korea. ; 본고는 1950년대 한국의 전후 재건과 부흥을 위해 유엔 총회 산하에 설립되어 활동했던 유엔한국재건단(UNKRA: United Nations Korean Reconstruction Agency)의 조직과 활동을 고찰하였다. 재건단 원조는 1950년대 대한원조의 주축이었던 미국의 대한원조와는 독립된 방식으로 운영되었다. 그러므로 본고는 재건단의 설립과 위상변화 과정, 재건구상과 활동의 실제를 살펴보고 그 의미를 밝히고자 하였다. 유엔한국재건단은 한국전쟁에서 유엔군이 승리하여 조속히 전투가 종료되고 통일이 이루어질 것이라는 전망 속에서 설립된 기구였다. 재건단은 전투 종료 이후 통일된 한반도에서 긴급 구호와 기초시설의 재건, 생산성 확대에 이르기까지 대한원조 전반을 총괄하는 기구로서 수립되었다. 그러나 1950년 12월 1일 수립 이후 전쟁이 장기화되면서 독자적인 활동영역을 확보하지 못하였고, 유엔군사령부가 경제원조를 포함하여 한국에서의 전반적인 권한을 보유하는 가운데 재건단은 주로 유엔사의 활동을 보조하는 위치에 머물렀다. 그리하여 전시에 재건단은 본격적인 사업에 돌입하지 못하는 대신, 유엔사 산하에서 구호와 단기복구를 담당하는 기관인 유엔한국민사처(UNCACK)에 민간인력을 파견하는 것으로 주요 활동을 대체하였다. 1952년 중반 이후 전선이 안정되고 한국 경제의 위기가 심화되면서 유엔사, 한국정부, 재건단 사이에 본격적인 재건사업이 시작되어야 한다는 합의에 이르렀지만, 극심한 인플레이션으로 인해 재건단의 활동은 일부 소비재를 수입하는 것에 그쳤다. 이와 더불어 전시 재건단은 전쟁 종료 후 본격적인 재건사업에 돌입하는 단계를 준비하며 각종 조사를 실시했다. 재건단의 의뢰에 의해 유엔 전문기구들은 농·수산업, 교육, 보건 등 분야별 조사를 담당하였고, 네이산 협회는 이를 포괄하는 전반적인 재건계획을 제출하였다. 재건단의 의뢰로 작성된 네이산 보고서는 한국에서 5년 간의 재건계획을 수행하여 전전과 비슷한 생활수준을 회복하고, 국제수지의 균형을 맞출 수 있을 것으로 전망하였다. 이를 위해 생산영역에 집중적으로 투자하면서, 농산물, 수산물, 광물 등 자연자원을 개발하여 수출을 증진한다는 계획을 제시하였다. 전후 한국사회에서 주택, 보건, 복지 등의 분야에 대한 필요가 절실했지만, 사회서비스나 복지 분야는 직접적인 생산력 증대를 불러오는 분야가 아니라는 점에서 재건계획 상 상대적으로 후순위에 배치되었다. 1953년 7월 휴전협정 체결 이후 재건단은 본격적으로 재건사업에 착수하였다. 그러나 이때에도 재건단은 한국 재건사업에서 전반적인 권한을 보유하지 못했는데, 미국의 전후 구상에 따라 방위지원을 주축으로 하는 미국의 대한원조가 중심이 되고 유엔 원조기구의 위상이 상대적으로 축소되었기 때문이다. 결국 재건단은 미국 원조기관과의 협의에 따라 한정된 영역에서만 사업을 진행할 수 있었다. 그럼에도 재건단은 독자적인 조직을 유지하며 담당 부문에서 자체 사업을 진행하였고, 원조의 내용에서도 미국 원조와는 다른 특성을 보였다. 즉 미국 원조가 주로 소비재 판매대금을 통해 막대한 국방비를 충당하고 경제를 안정화하는 데 초점을 맞추었던 것과 달리, 재건단은 장기적으로 한국경제의 생산력을 증진시키는 것이 필요하다고 보고 시설투자와 기술원조가 결합된 형태의 원조를 주로 진행하였다. 재건단 원조에서 전시기에 걸쳐 가장 많은 비중을 차지한 것은 공업 부문이었다. 재건단의 공업 부문 원조는 소비재에서 생산재까지 여러 분야에 걸쳐 진행되었고, 노후화된 기존 시설을 대체하고 전쟁으로 파괴된 시설을 복구하는 것 이상으로 신규투자를 통해 새롭게 공장을 건설하기도 했다. 특히 재건단은 중소규모 기업에 자금과 기술, 시설을 제공하는 한편, 면방직 공업이나 시멘트 공업, 판유리 공업과 같은 몇몇 분야를 전략적으로 성장시켜 국내 생산을 증가시키고 수입을 대체하고자 했다. 이와 같은 재건단의 원조는 운영상의 여러 문제점을 노정하였으나, 한국의 초기 전후 복구 과정에 상당 부분 기여했다. ; 머리말 1 一. 전시 유엔한국재건단의 설립과 재건구상 7 1. 재건단의 설립과 유엔군사령부와의 관계 정립 7 2. 전후 재건구상 18 二. 전후 유엔한국재건단의 조직과 활동 25 1. 휴전 이후 재건단의 대외적 위상 변화 25 2. 재건단 내부의 조직운영과 예산 구성 34 3. 재건단의 활동 분석―공업 부문을 중심으로 47 맺음말 59 참고문헌 62 Abstract 67 ; Master

Meanwhile, Korea's ODA has been diversified by various implementing agencies. There have been many previous researches on effective implementation system to improve the effectiveness of ODA projects. In 2010, through the establishment of the Act on International Development Cooperation, the function of organizing and coordinating policies in ODA of the International Development Cooperation Committee has been strengthened. However, little case-based research has been done on what adjustments are actually made in the committee. The purpose of this study is to analyze the policy coordination cases of the International Development Cooperation Committee and to examine the factors influencing policy coordination in international development cooperation. The target of the analysis is the case of the integration of the overseas volunteer dispatch project into the WFK(World Friends Korea), which started in 2009 and has been in progress until 2019. In 2008, the Lee Myung-bak government set up a national policy task to dispatch 20,000 volunteer overseas. In this regard, discussions have begun on the need to integrate the overseas volunteer dispatch projects being promoted by all ministries into WFK program, which is being promoted by the Ministry of Foreign Affairs, and primary integration by the leadership of the President in 2009 ~ 2010 was achieved. In the meantime, since 2016, the International Cooperation Committee has been discussing the integration of volunteer dispatch projects that have not been integrated yet. As a result, the Ministry of Foreign Affairs has promoted discussions on integrated promotion. The related projects were programs of the Ministry of Health and Welfare, Ministry of Culture, Sports and Tourism, Ministry of Patriots and Veterans Affairs, Korea Meteorological Administration, Fair Trade Commission, Ministry of Education. The research methodology first outlines the theories and researches on the influencing factors of policy coordination and selected the factors that might influence the policy coordination of international development cooperation. Based on the selected factors, the analysis framework was established and hypotheses were established. The analysis was conducted based on the analysis framework and the hypothesis was verified for the eight projects of six ministries in the case. In this study, the concept of policy coordination was focused on the integrated promotion aspect of inter-ministerial policies for enhancing synergy rather than solving policy conflicts among ministries considering the characteristics of international development cooperation issues. According to the theoretical discussion, the policy coordination is based on the hierarchical system, the network system, and the market system, and the International Development Cooperation Committee is considered as a coordinating mechanism for interactions among various participants in network system. In the previous researches on the factors influencing the general policy adjustment, it was pointed out that attributes of the issue and participant, leadership are important in policy coordination. On the other hand, previous researches in the field of international development cooperation have been studied mainly in terms of improvement of the institutional aspects, and prior studies on the factors influencing the adjustment are rare. Based on the previous research and theoretical discussions of network view on policy coordination, three factors were identified as factors influencing the policy coordination of international development cooperation. Those are the degree of internalization of the unique policy viewpoint of the network participants, disposition tendency of the participants on the policy, and the leadership level of the President and the Ministry of Foreign Affairs. For each factor, detailed sub-indicators were set up. First, we considered the existence of dedicated implementation agencies, the use of specific policy resources, and the presence of interest groups as criteria for the degree of internalization of the unique policy view. In case of domain dispute tendency, the absolute amount and proportion of budget and the key policy areas. Third, in the case of leadership, the level of leadership of the president and the policy coordination institute (Ministry of Foreign Affairs) was considered. Eight projects from the six ministries had different degrees for each of the three factors, which affected the results of the strategies and adjustments chosen by the individual ministries in the policy coordination network. First, the Ministry of Health and Welfare carries out its own voluntary work by a non-profit corporation called the Korean Oriental Medical Service Group, but its degree of internalization of the policy perspective is not so high due to the small grant amount and the existence of multiple sponsors in the corps. In addition, and the number of stakeholders in Korea was not so high. However, the MHW restructured its business due to the President 's overseas trip, and the MHW stopped the business. The project is now integrated into the WFK platform. In the case of the Ministry of Culture, Sports and Tourism, there is a high level of internalization of the policy perspective. The program is implemented by the traditional performing arts promotion foundation, which is a nonprofit foundation under MCST. In addition, it utilizes related majored students and its Korean Culture Center abroad. Moreover, the program is closely related to the main policy areas of MCST such as the operation of overseas Korea Cultural Center. As a conclusion, MCST decided to leave the network and converted the program into non-ODA domain to continue the program. In the Ministry of Patriots and Veterans Affairs, there were two projects: the medical service project of the 6.25 participating countries and the medical service project in Vietnam. First, the medical service project of 6.25 participating countries, which had relatively low importance in MPVA, and which did not have any interest groups, was abandoned. However, the Vietnamese medical service project, which has a dedicated agency and strong interest group, and was chosen to be remained by being moved into non-ODA domain. The Korea Meteorological Administration utilizes unique policy resources and the KMA also adopted the non-ODA method to continue the project. In the case of the Fair Trade Commission, the proram is about dispatching FTC's internal employees overseas. Therefore, both the degree of internalization of the viewpoint and the tendency to dispute the domain were high. However, the Ministry of Foreign Affairs did not promote the integration of the FTC project, and it seems that mutual recognition is made that the project is not subject to integration between the two ministries. In the case of the Ministry of Education, there is a high degree of internalization of the policy perspective due to the fact that the responsible administration agency is in operation, utilizes its own policy resources, and there is a strong teacher interest group. In addition, the amount of the program's budget is very large, and the tendency to dispute the policy region is also high. The Ministry of Foreign Affairs has shown a strong commitment to coordinate with the MOE's program since 2019, but the MOE is keep refusing it. We analyzed the cases of 8 projects of these 6 departments through analysis framework. The different factors that existed on each department triggered different strategies within the network for each department, and we observed that the result of the policy adjustment was different. In addition, the original hypothesis was verified. First, the greater the discrepancy in the viewpoint of the policy, the more unfavorable the policy coordination. Second, the larger the ministry's domain dispute tendency, the more disadvantageous the policy coordination. Third, the greater the leadership of the president and the policy coordination institute, the more favorable the policy coordination. Although this study was intended to detail the processes and achievements of policy coordination in the international development cooperation of Korea through actual cases, it was difficult to access the every minutes of the network participants' meetings, and inference was used to deduce the behavior of individual participants (ministries) through the review of official document. Therefore, it was only a rough explanation. However, the purpose of this study is to suggest that the main variables that actually affect the results of policy coordination in the International Development Cooperation Committee in Korea, the understanding of the process of policy coordination through committee among participants from a network perspective, and the microstatement of the behavior of the representatives of individual ministries in the course of the policy coordination. In the future, we look forward to expanding the scope of the research, including another example of policy coordination through the International Development Cooperation Committee, so that the results of the study can be generalized. ; 우리나라의 공적개발원조(ODA) 예산은 2010년 OECD 가입 이후로 지속적으로 확대되어 왔다. 한편 우리나라의 ODA는 다양한 시행기관에서 분산적으로 추진하고 있는 상황으로, ODA 사업의 효과성 제고를 위하여 그간 효과적 추진체계에 대한 선행연구가 다수 이뤄져 왔다. 이와 궤를 같이하여 2010년에는 국제개발협력기본법의 제정을 통해 국제개발협력위원회에 ODA의 총괄적 추진을 위한 정책의 총괄 및 조정 기능이 강화되었다. 그러나 본 위원회에서 실제로 어떤 조정이 이루어지는지에 대한 사례 기반의 연구는 거의 이루어지지 않은 상황이다. 본 연구의 목적은 국제개발협력위원회의 정책 조정 사례를 분석하여 국제개발협력에서 정책 조정에 영향을 미치는 요인이 무엇인지 알아보는 것이다. 분석 대상은 2009년에 시작되어 2019년 현재까지 진행되고 있는 이다. 2008년 이명박 정부에서는 글로벌리더 10만 양성을 국정과제로 정하고 해외 봉사단 2만명 육성 사업을 추진하였다. 이와 관련하여 전 부처에서 개별 추진 중인 해외 봉사단 파견 사업의 KOICA의 WFK로의 통합에 대한 논의가 시작되었고, 2009~2010년 경 대통령 리더십에 의한 1차적 통합이 이루어졌다. 한편 2016년 경 부터는 아직 통합되지 않은 봉사단 파견 사업들에 대하여 국제개발협력위원회에서 2차적 통합 논의가 시작된 바, 외교부가 주관부처로서 통합 추진 논의를 추진하였으며 통합 대상이 되었던 사업 들은 총 6개의 부처(보건복지부, 문화체육관광부, 국가보훈처, 기상청, 공정거래위원회, 교육부)의 8개 사업이었다. 연구의 진행 방식은 먼저 정책 조정의 영향 요인에 대한 이론과 연구를 개관하고, 국제개발협력의 정책 조정에서 주요한 영향을 미치리라 생각되는 요인들을 선별하였다. 선별된 요인을 바탕으로 분석 틀을 설정하고 가설을 수립하였으며 사례에 존재하는 6개의 부처의 8개 사업에 대하여 분석틀에 기반하여 분석을 수행하였고 가설을 검증하였다. 이를 위해 2014년부터 2020년까지의 국제개발협력위원회 조정 과정에서 생산된 문건인 무상원조 관계기관 협의회 및 국제개발협력위원회 의결 종합시행계획 등을 분석하였다. 본 연구에서는 정책 조정의 개념에 대하여 국제개발협력 이슈의 특성을 고려하여 부처 간 정책 갈등 해결 측면 보다는 시너지 제고를 위한 부처 간 정책의 통합적 추진 측면을 중시하였다. 이론적 논의에 따르면 정책 조정은 위계에 의한 방식, 네트워크에 의한 방식, 시장에 의한 방식 등이 존재하는 바, 국제개발협력위원회제도는 다양한 참여자 간 협의체를 통한 상호 작용의 조정 기제로 보아 네트워크적 관점에서 분석하고자 하였다. 한편 일반적인 정책 조정 영향 요인에 대한 선행연구에서는 이슈 및 참여자의 속성, 조정 환경, 조정 주체 요인 등이 주요 영향 요인으로 지적되어 왔다. 한편 국제개발협력 분야의 선행연구는 주로 제도적 측면의 개선점에 주안을 두고 그간 연구되어온 바, 조정 영향 요인에 대한 선행 연구가 드물었다. 결국 분석모형틀로서 이론적 논의의 네트워크 관점의 정책 조정 영향 요인과, 일반 정책 조정 선행 연구에서 논의된 영향 요인을 종합하여 국제개발협력의 정책 조정 영향 요인으로서 세 가지를 도출하였다. 이는 네트워크 참여자의 고유한 정책 관점 내재화의 정도, 참여자의 정책에 대한 영역권 다툼 성향, 대통령 및 주관부처(외교부)의 리더십의 수준 이다. 각 요인에 대하여는 세부 하부 지표를 설정하였는바, 먼저 고유한 정책 관점 내재화의 정도의 판단 기준으로 전담 사업 수행기관의 존부, 고유 정책 자원의 활용 여부, 이익집단의 존부를 고려하였다. 영역권 다툼 성향의 경우 예산의 절대 액수 및 비중, 사업 관련 기성사실의 발생 정도를 고려하였다. 셋째로 리더십의 경우 대통령 및 정책 조정 촉발 기관(외교부)의 리더십의 수준을 고려하였다. 통합 대상이 되었던 6개 부처 8개의 사업들은 이 세 요인에 대하여 각각 다른 정도를 가지고 있었으며 이는 개별 부처가 정책 조정 네트워크에서 택한 전략 및 조정의 결과에 영향을 미쳤다. 먼저 보건복지부의 사업은 대한한방해외의료봉사단이라는 비영리사단법인이 전담 수행하며 고유 자원을 활용하나 소규모의 보조금 교부 액수 및 봉사단에 복수 후원처의 존재 등으로 정책 관점 내재화 정도는 그리 높지 않다고 보인다. 또한 사업 수행이 오래되었으나 국내 이해관계자의 수는 많지 않아 영역권 다툼 성향도 높지 않다고 볼 것이다. 그러나 결정적으로 대통령의 해외 순방에 따른 보건복지부의 자체 사업 구조조정이 조정 결과에 영향을 미쳤다고 보이며, 보건복지부는 2018년부터 사업을 중단하였고 해당 사업은 현재 WFK 플랫폼에 통합된 상태이다. 문화체육관광부의 경우 전통공연예술진흥재단 등 소관 비영리재단법인이 사업을 전담하고 전통문화 전공 학생 및 재외 한국문화원을 활용하는 등 고유 정책 자원을 활용하며 이익집단도 존재하는 등 정책 관점 내재화 정도가 높다. 또한 예산은 소규모이나 한국문화원 등 연관 정책이 문화체육관광부의 중점 정책 영역에 해당한다. 이에 외교부가 해당 사업에 대한 강경한 검토 의견을 제시하였을 때, 문화체육관광부는 WFK와 통합하거나 사업을 중단하는 대신, 사업을 비ODA사업으로 전환하여 국제개발협력 조정네트워크에서 이탈한 후 지속 추진하는 전략을 택하였다. 국가보훈처에서는 6.25참전국 의료봉사 사업 및 베트남 의료봉사 사업의 두 사업을 논의하였다. 국가보훈처에서는 상대적으로 중요도가 낮고 전담 수행기관과의 밀착도가 낮으며 이익단체가 없었던 6.25 참전국 의료봉사 사업은 수행을 포기하였다. 그러나 국가보훈처는 베트남 의료봉사 사업의 경우 상이군경회라는 고유 정책 자원을 전담 기관으로 활용하는 점, 강력한 이익단체가 존재하는 점, 한-베 민간협력은 부처 차원의 주요 정책 영역에 해당하는 점 등으로 인해 사업을 포기하지 않고 비ODA방식으로 전환하여 지속 추진하는 방식을 택하였다. 기상청의 사업도 한국기상산업기술원이 전담하며 고유한 정책 자원을 활용하는 형태이나 이익단체가 특별히 없고 예산 비중이 낮았다. 한편 기상청도 본 사업을 비ODA방식으로 전환하여 지속 추진하는 방식을 택하였다. 공정거래위원회의 경우 부처가 직접 내부 직원을 파견하는 사업으로 고유 관점 내재화 정도와 영역권 다툼 성향이 모두 높았다. 그러나 외교부는 공정거래위원회 사업에 대해 통합을 추진하지 않은 바, 양 부처 간에 본 사업은 통합이 가능한 유형의 사업이 아님에 대한 상호간의 인지가 이뤄진 것으로 보인다. 교육부의 경우 소속 책임운영기관이 사업을 실시 중이며, 고유 정책 자원을 활용하고 있고 강력한 교원 이익단체가 존재하여 정책 관점 내재화 정도가 크다. 또한 사업의 액수가 매우 크고 부처의 중점 정책 영역에 해당하는 등 영역권 다툼 성향도 크다. 외교부는 2019년 시행계획부터 교육부 사업에 대하여 강력한 조정 의지를 보이고 있으나 교육부는 네트워크에 참여하여 협의를 통해 이를 지속적으로 반대하는 모습을 보이고 있다. 이러한 6개 부처 8개 사업의 사례를 분석모형틀을 통해 분석하였다. 영향 요인에 대하여 부처 별로 상이한 여건은 개별 부처가 네트워크 내에서 다른 전략을 취하도록 촉발하였고 이에 따라 정책 조정의 결과가 다르게 나타나는 것을 관찰하였다. 또한 당초 설정한 가설을 검증하였다. 첫째, 정책의 관점 단절의 차이가 클수록 정책 조정(통합)에 불리하였다. 둘째, 소관 부처의 영역 다툼 성향이 클수록 정책 조정(통합)에 불리하였다. 셋째, 주관부처 및 대통령의 리더십이 클수록 정책 조정(통합)에 유리하였다. 본 연구는 우리나라의 국제개발협력에서 정책 조정의 과정 및 성과를 실제 사례를 통해 세밀하게 기술하고자 하였으나, 실질적으로 네트워크 참여자들의 세부적인 회의록에는 접근하기 어려워, 단계 별로 조정에 대한 검토 결과를 통해 개별 참여자(부처들)의 행태를 추론하는 방법을 사용하여 대략적인 설명에 그친 한계점이 있다. 그러나 우리나라의 국제개발협력에서 실제로 국제개발협력위원회라는 정책조정의 수단, 즉 네트워크적 관점에서 참여자들 간의 회의체 운영을 통한 정책 조정의 과정을 파악한 점, 이 과정에서 개별 부처의 사업 담당자들이 보이는 행태들을 미시적으로 기술하였고, 우리나라의 정책 조정에서 실질적으로 정책 조정 결과에 영향을 미치는 주요 변인이 무엇인지 원형을 제시하였다는 점에서 연구의 의의가 있다. 향후에는 국제개발협력위원회를 통한 정책 조정의 또 다른 사례 등 연구 대상을 확장하여 연구 결과가 일반화 될 수 있기를 기대하여 본다. ; 제 1 장 서 론 1 제 1 절 연구의 배경과 목적 1 제 2 절 연구의 범위 4 제 3 절 연구의 방법 7 제 2 장 이론적 논의 및 연구 설계 9 제 1 절 정책 조정의 개념 9 1. 정책 조정의 개념 및 유형 9 2. 정책 조정의 수단 11 제 2 절 국제 개발 협력 이론 18 1. 국제개발협력 추진체계 18 2. Objectives: The purpose of this study is to figure out the current state of patient safety research in Korea and to evaluate whether the research fund support project for patient safety research is proceeding in priority order. Methods: Through the literature search, a list of research projects in the field of patient safety in Korea were collected as of January 6, 2017. Four researchers independently evaluated the subject using the priority list of patient safety research derived from the previous study. Results: As of January 2017, a total of 21 research projects were conducted in the Korea Health Industry Development Institute and 42 research studies were conducted in the National Science & Technology Information. The results of the priority evaluation showed that there were no researches that ranked first and second priority. Many of the research topics were �쁀dverse drug events/drug errors,�� �쁇ealth information technology/information systems,�� and �쁋ess relevance.�� Conclusion: Patient safety research projects are not only diverse but also quantitative in Korea. Support for research topics that need to be prioritized is needed, such as developing safety indicators and measuring patient safelty levels, improving communication, and improving patient safety incident reporting systems. ; open

Readmission which reflects capacity to manage patients and general level of medical services has been known for one of the causes of medical expenditure due to inefficient service. Compared to disease-specific readmission, hospital wide readmission (HWR) is relatively easy to understand, and has merit to get over limitation of collateral medical services assessment; therefore, a growing interest in development and usage of readmission indicator as quality of care indicator focusing on all-disease is detected. In this study, we investigate current state of risk standardized readmission rate indicator used in the United States, the United Kingdom, and Canada, and examine the considerations when using readmission rate as quality indicator in Korea. Differences in risk-adjustment methods were showed among countries. The United States do not control race not to hide socio-demographic factors on readmission. Canada shows differentiation compared to other countries about reflecting community factors. All three-countries utilize readmission rate as monitoring quality of care rather than incentives or penalty due to the fact that readmission rate could not represent the whole quality of hospital and has a limitation at controlling socio-economic factors. Therefore, for usage readmission rate as quality indicator in Korea, preparing readmission classification standard for Korean medical environment and additional methods for acquiring information by using discharge summary is need. Moreover, continued discussion with clinical specialists is needed for obtain clinical reliability and validity. ; open

1947년 일본헌법과 더불어 제정된 지방자치법은 중앙정부로부터 독자적 직접선거를 통한 입법부와 행정부 선출을 명시하며 일본의 중앙-지방관계를 규정한다. 특히 1980년대 이후 분권화는 세계화와 맞물려 잠시나마 좌우 이념의 간극에도 불구하고 드물게 의견의 합치를 이룬 정책 목표다. 본 논문은 자치체의 행정체계 정비를 포함해 자치체의 효율적 운영, 주민의 의견 반영 및 공정한 국정운용을 제고하려는 일본의 로컬 거버넌스가 궁극적으로 행정개혁, 시민참여, 그리고 균형발전을 동시에 두 가지 이상 성취하기 어려운 삼중고(trilemma)에 봉착한다는 설명 틀을 2003년 지방자치법 개정 전후 일본의 중앙-지방 관계 변화에 적용하고자 한다. 이에 따라 2절에서 일본 중앙-지방 관계의 발전사를 검토하고, 3절에서 로컬 거버넌스의 기존연구들을 정리한 후, 4절에서 2000년 지방분권일괄법이 실행되고 2003년 지방자치법 개정으로 이어진 과정에서 지방분권 개혁이 어떻게 전개되었는지 로컬 거버넌스의 삼중고(trilemma) 관점에서 보완하여 설명한다. 그리고 1990년대 이후에 지방자치법이 명시한 법적 권리를 넘어 헌법에 명시되어 있으나 실제로는 적극적으로 활용하지 않았던 시민의 직접적 정치참여에 대한 관심이 고조되는 배경을 검토하며 일본의 로컬 거버넌스에 대한 전망을 제시하고자 한다. ; Enacted along with the Japanese Constitution in 1947, the Local Autonomy Law established the directly elected head of executive and legislature at the local level, independent of the central government. Especially since the 1980s, an outcry for decentralization in a global age managed to put together a consensus across liberal and conservative wings, albeit its brevity. While striving for a thorough reorganization in local administration, an efficient management of local government and a participatory democracy at the local level, however, local governance encounters a trilemma of local reform, civic engagement, and balanced development. I purport to reconstruct the Japanese intergovernmental relations before and after the 2003 revision of the Local Autonomy Law in the context of a trilemma in local governance. In so doing, I lay out previous theoretical works on local governance and trace a unique path of intergovernmental relations in Japan, followed by an overview of local reforms and reorganizations since the Omnibus Law of Decentralization was launched in 2000. 학위논문 (석사)-- 서울대학교 대학원 : 정책학과, 2012. 2. 박정훈. ; 오늘날과 같은 지식정보화 사회에서의 전자정부 구현은 정부경쟁력, 더 나아가 국가경쟁력을 제고할 수 있는 핵심수단으로 여겨지기에 세계 각국과 국제기구에서는 전자정부를 도입하고 발전시키기 위해 재정적, 정책적으로 많은 노력을 기울이고 있다. 그러나 전자정부를 발전시키려는 이러한 노력들에도 불구하고 정부의 효과성, 민주성, 투명성 등 정부경쟁력의 개선은 전자정부 도입 시 기대했던 바에 크게 미치지 못하고 있는 것이 현실이다. 본 연구는 이러한 문제의식에서 출발하여 각 국의 정부경쟁력을 한층 강화시켜 줄 것이라 생각했던 전자정부가 과연 실제 그 효과를 나타내고 있는지에 대한 문제를 제기하고 전자정부가 정부경쟁력에 어떻게 영향을 미치고 있는 실증 분석하고자 하였다. 이를 통해 전자정부 도입 시 본래 달성하고자 하는 바들이 얼마나 잘 달성하고 있는지, 또 서로 다른 부문들로 구성된 전자정부 요소들은 정부경쟁력에 각기 어떠한 영향을 미치고 있는지 살펴보고 향후 전자정부의 연구, 정부정책과 관련한 몇 가지 시사점을 도출하고자 하였다. 본 연구는 151개 국가들을 대상으로 실시하였으며 종속변수로는 UN에서 발표하는 'Global E-government Readiness Report'의 전자정부 준비지수(Global E-government Readiness), 독립변수로는 국제투명성위원회의 부패인식지수(CPI), World Bank의 정부효과성지수(GE), Freedom House의 정치적 권리(PR), 시민의 자유(CL)지수를 시차를 고려하여 다중회귀분석을 실시하였다. 분석결과 각 국의 웹과 정보통신인프라의 발전은 정부운영의 효과성과 시민의 정치적 권리와 자유를 증진시키고 정부부문의 부패를 감소시켜 정부경쟁력 강화에 유의미한 영향을 미치고 있는 것으로 나타났다. 이러한 웹과 정보통신인프라의 효과적인 정부운영 및 부패감소 효과는 OECD국에 비하여 비OECD 국에서 상대적으로 더 큰 것으로 나타났다. 반면 정부의 시민참여 노력정도를 반영하는 온라인참여(E-Participation)변수는 기대와 달리 시민의 정치적 권리와 자유를 증진시키는데 기여하고 있지 못하는 것으로 나타났다. 본 연구는 전자정부 운영 및 연구에 있어서 몇 가지 함의를 시사한다. 첫째 전자정부가 정부경쟁력 강화라는 본래 목표를 달성하기 위해서는 무엇보다 정보통신인프라의 확충과 웹사이트의 발전이 동시에 이루어져야 할 것이다. 둘째, 각 국이 처한 경제, 사회 등 여러 부문의 발전수준과 전자정부 각 요소들을 각 국에 도입했을 때 그 영향들을 고려한 전략적 접근이 전자정부를 성공적으로 이끄는데 하나의 중요한 요소로 작용할 것이라는 점이다. 셋째, 현 시점의 전자정부 뿐만 아니라 이전의 전자정부 수준역시 정부경쟁력에 지속적인 영향을 미치고 있는 것으로 나타났다. 이는 전자정부사업에 대한 성과가 나타나는 시간이 길기 때문에 시차를 고려한 전자정부 사업계획 및 성과평가가 이루어져야 함을 보이는 것이다. 마지막으로 정부의 온라인 국민 참여노력(E-Participation)이 실제 민주주의강화에 이어질 수 있도록 정부의 보다 강한 책임성과 대응성, 법‧제도의 구축이 이루어져야할 것이라는 점이다. ; In the information society, All countries of the world and international organizations have tried to develop E-government, considering it as core means to improve government competitiveness. However, It is true that the results of it fall short of our expectations regardless of our effort in E-government. The results of the analysis are as follows: With awareness of issues above, this study tried to solve research questions: Has E-government which plays a role in improving government competitiveness accomplished its aims? and which components of it have effect on the government competitiveness? In addition, this study aimed to offer proposals related to policies and studies of E-government. In research method, multi-regression analysis was used based on the data : Global E-government Readiness Index reported by UN, Corruption Perceptions Index issued by TI, Government Effectiveness Index reported by World Bank, Political Right and Civil Liberty issued by Freedom House with 151 countries in the world. As a result of analysis, It is verified that Development of Web and Telecommunication Infrastructure have influence on improving Government effectiveness and democracy in society. And Their influence is stronger in OECD countries than non-OECD. On the other hand It is revealed that an effort of government to encourage political participation of nation doesn't contribute to improving level of democracy. The lessons from this study are as follows. First, it is important to expand telecommunication infrastructure for more citizen to get information which is a little bit developing infrastructure highly and improve web site for citizen to get high quality information. Secondly, it is necessary to approach strategically considering a level of economy and society and influence of e-government predicted before planning policies about e-government in order to make e-government business successful. thirdly, It is revealed that not only a level of current e-government but also a level of past e-government have influence on current government competitiveness. It means that time lag has to be considered planning e-government business and evaluating performance of it. Last but not least, More responsibility and responsiveness of government and laws and institutions related to e-government are needed in order that an effort of e-participation each government carries out is connected to reinforcing democracy. ; Master

학위논문(박사)--서울대학교 대학원 :인문대학 국사학과,2020. 2. 정용욱. ; This thesis examines aspects of savings mobilization that the Korean government pursued to mobilize internal investments in the 1960s and 1970s, focusing on household savings. Chapter 1 analyzes savings mobilization attempts made after the implementation of the First Five-Year Economic Development Plan immediately following the May 16 military coup. To this end, we first look at the domestic capital mobilization of the 1st Five-year Economic Development Plan and the various institutional and social practices promoted for mobilizing household savings. Representatively, it describes saving enlightenment activities and the national saving movement promoted by the government. In addition, it deals with the establishment of a National Savings union established primarily for wage workers. Chapter 2 deals with political and social discussions within Korean society that were developed in the process of determining the rate realization measures implemented in September 1965. It also describes the process of institutional reform, including the establishment of local banks, which was established to strengthen mobilization of savings while witnessing an increase in financial savings after the implementation of this measure. In addition, this study analyzes aspects of the living rationalization movement such as 'the second economic movement' that was developed along with the reform of the system. The effects of such activities and the recognition of household savings are analyzed based on the savings market survey conducted by the Bank of Korea since 1967. Chapter 3 deals with the aspects of saving mobilization during the period of heavy chemical industrialization in the early 1970s. The government has promoted the heavy and chemical industrialization policy since 1973 and made a plan to raise funds for domestic capital. To this end, the financial system was reorganized and a national investment fund was established. And attempted to mobilize household savings by introducing the National Welfare Pension, but failed. This chapter examines this process and describes the attempts and limitations of building a mobilization system. Chapter 4 analyzes the savings mobilization strategy developed after the global economic recession caused by the oil shock. During this period, the oil shock shocked the domestic economy, which in turn increased demand for income security. The Korean government used financial institutions as a means of ensuring the lives of its people. Representatives include workers' asset-building savings and life insurance. These systems were introduced and fostered as a means to mobilize the domestic capital necessary for the promotion of the Fourth Five-Year Plan. In addition, this chapter examines households 'responses to workers' asset-building savings and life insurance. Based on the above, the effects of forced saving, saving enlightenment, and economic incentives used by the Korean government for saving mobilization can be summarized as follows. First, forced saving did not have much effect. In the case of the national savings union, although it has the characteristics of forced savings, it was far short of its target. In addition, the National Welfare Pension, which was created as a means of domestic capital mobilization immediately after the declaration of industrialization, attempted to be introduced using welfare discourse, but its implementation was delayed indefinitely due to strong repulsion and oil shock. Next, the saving enlightenment of the government also did not have much effect on increasing savings. The government and savings organizations continued to disseminate discourses on rationalization through the preparation of households, but not many households keep a housekeeping book. According to a savings market survey conducted by the Bank of Korea, each household was told to increase or decrease its savings by increasing or decreasing its income. The most effective means of government's savings mobilization were through economic incentives. Regular deposits and installment savings have increased since interest rate realization measures, and the popularity of workers' asset-building savings in the late 1970s is a reflection of this. The main motives for savings identified by the savings market survey were real estate purchases, child education and marriage funds, and stabilization of retirement life, and workers' asset-building savings and life insurance were just the right tools for that need. As a result, the government's savings mobilization was able to achieve effective results when it met the needs and desires of households. The demand for saving mobilization for the people of the Park Chung Hee regime seemed very strong on the outside. But the reality is that the government is driven by household demands. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 이승종. ; 민선 5기 지방선거 이후 우리나라 지방자치는 새로운 양상으로 진행되고 있다. 지방자치의 정치화, 지방정치의 중앙화가 가속화되었으며 특히 무상급식이라는 정책이슈가 지방자치의 주류 현안으로 등장하게 되었다. 이 논문은 무상급식 이슈가 대표적인 양대 지방자치단체인 서울시와 경기도에서, 유사한 정책 환경에도 불구하고 전혀 다른 정책결과를 낳은 점에 주목하였다. 이를 위해 서울시와 경기도의 무상급식과 관련된 정책 환경의 공통점과 차이점을 알아보고 어떤 요소에 의해 상이한 정책결과가 나타났는지를 분석하고자 하였다. 급식정책 실시 결과라는 종속변수에 영향을 주는 독립변수로는 지방선거 결과, 지방의회 특성, 자치단체 재정규모, 마지막으로 단체장의 특성을 설정하였다. 연구 결과 두 지방자치단체는, 단체장의 정당배경 및 무상급식에 대한 소신, 지방의회의 정당간 분점정도, 의회규모, 의원 보수, 자치단체 재정규모 면에서 극히 유사하였으나 단체장 특성 가운데 정당배경 및 성장배경 보다는 갈등해결 전략에서 차이가 있음을 알 수 있었다. 그 결과 경기도에서는 김문수 지사가 명분을 지키면서도, 의회와 타협하여 상생의 길을 모색하였고 서울시에서는 오세훈 시장과 의회가 강경대응으로 일관하여 시장 사퇴라는 나쁜 선례를 남기고 말았다. 또한 당초 설정된 '단체장의 특성에 따라 급식정책은 영향을 받을 것이다' 라는 가설이 확인되었다. 정책적 함의로 첫째는 '지방선거의 지방화'를 위해 정치권이 노력해야한다는 점을 들 수 있다. 6.2 지방선거에서는, 행정학자들이 우리나라 지방정치의 문제점으로 거론해 온 지방정치의 중앙화 현상이 더욱 극심해진 결과를 보여주었다. 중앙당은 지방선거를 중앙선거의 대리전 또는 전초전으로 간주하는 태도를 버려야 할 것이다. 둘째는 정당들이 더욱 정책개발에 노력할 필요가 있다는 것이다. 민선 5기 선거는 무상급식 이슈가 전국을 휩쓴 선거로서, 여야 정당들은 지방차원의 정책 개발보다는 선거이슈 선점에 따른 공세 및 방어에 급급한 모습을 보여 주었다. 교육정책에는 무상급식 외에 절실한 문제들이 많이 있음에도 불구하고 마치 과거 민주화항쟁 당시의 대통령 직선제 요구를 방불케 하는 양자택일 양상으로 진행되었다. 또한 근거 없이 무상급식 요구를 포퓰리즘으로 매도한다거나, 선별적 급식지원 정책이 아이들에게 눈칫밥을 먹이는 것이라고 선동하는 것은 지방선거에서 우선 승리하고 보자는 식의 후진성을 보여주는 사례라고 할 수 있다. 정치권이 더욱 성숙해질 필요가 있다. 셋째 복지정책은 개별 지방자치단체의 재정상황 여건에 따라 추진할 필요가 있다. 연구결과 복지 선진국들도 국가별, 지역별로 다양한 급식 정책을 실시하고 있음을 알 수 있었다. 또한 지방자치단체와 의회는 일방적인 '힘'의 논리만 앞세우지 말고 서로 화합하여 선진 지방자치 문화 정착에 기여하여야 할 것이다. ; After the 5th local election by popular vote, Korea's local autonomy is taking on a new aspect. Party politics and centralization of local politics are accelerating. Especially free meals policy has become the mainstream issue of local autonomy. This paper paid attention to the fact that free meals issue brought about different outcome in two big typical local governments such as Seoul city and Gyeonggi province. For this research, first I tried to discern similarities and differences related to free meals policy environment and to analyze what factors brought about different outcome. I set up the local election result, financial ability of local government, and characteristic of local government head as independent variables which have influence on school meals policy. This reserch finds out that there was significant difference in characteristic of local government head, particularly conflict solving strategy rather than political backgrounds although there were many similarities in their parties, belief on free meals policy, inter-party domination structure, size of assembly, annual salary, local finance of the two local governments. In Gyeonggi province, Governor Kim negotiated with local assembly for peaceful coexistence, in Seoul city Mayor Oh and city assembly called for tighter controls. Finally Mayor Oh resigned because of the low turnout in inhabitant's poll on free meals policy. This is a bad precedent in local autonomy history. Also the hypothesis that free meals policy will be influenced according to the characteristic of local government head was confirmed. This study implies, first, all politicians should make a greater effort for localization of local election. In the 5th local election by popular vote, centralization of local politics which many scholars have mentioned so far was intensified. Central parties have to come off regarding local elections as proxy war and skirmish of the central general election. Second, parties should develop policies. The 5th local election was only for free meals policy issue all over Korea. Most of parties manage to cope with electoral situation related to free meals issue rather than policy development of local level. Free meals policy was considered as the only matter like direct presidential election system issue in 1987 although there are other urgent matters except free meals policy in education policy field. Also the ruling party politicians denounced free meals policy as populism, otherwise the opposition party politicians condemn selective welfare policy for vulnerable groups as discrimination of the poor. These cases are backward behaviors which aim at short-term election victory. All politicians must be more mature. Third, welfare policy need to be carried out depending on each local government's financial conditions. As mentioned earlier, even advanced countries implement various school meals policy on a case by case basis. Also local governments and local assemblies should cooperate each other for establishing desirable local autonomy culture not depending on the unilateral power. ; Master

학위논문 (석사) -- 서울대학교 대학원 : 사회과학대학 지리학과, 2020. 8. 신혜란. ; 본 연구는 정책이동(policy mobility)의 관점에서 서울로 7017의 조성 과정을 분석하였다. 특히 본 연구는 정책이 이동하는 과정에 있어서 도시 정치가 어떠한 방식으로 개입하게 되는지를 집중적으로 살펴보았다. 정책이동은 도시 연구 분야에서 주요 연구 주제로 떠오르고 있다. 전 세계 도시 간 협력과 교류가 활발해짐에 따라 정책의 이동 - 선진 정책의 벤치마킹 및 수입과 모방, 정책 관련 국제 컨퍼런스 발표 및 수상 등 - 은 활발하게 진행되고 있고, 이러한 현상은 도시정책의 추진 및 의사결정에 있어서도 직접적인 영향을 미치고 있다. 한편 기존 정책이동 관련 연구들은 정책이 이동되는 과정자체에 초점을 맞추어 도시들 간의 지역적 맥락이나 정치구조의 차이가 정책의 적용과 변용 등에 어떠한 영향을 미치는지를 주로 살펴보았다. 이에 반해 정책 이동 현상이 넓은 범위의 도시정치와 거버넌스에 어떠한 영향을 미치는지를 활발하게 연구되지는 못하였다. 본 연구는 이러한 부분에 있어서 기여하고자 서울로 7017이 조성되는 과정에서 나타났던 벤치마킹이나 정책 홍보 등의 정책이동 과정이 서울시 도시정책에 어떠한 영향을 미쳤는지를 분석하였다.연구의 결과는 다음과 같다. 첫째, 서울로 7017 조성과정에서 나타난 정책의 이동 – 뉴욕 하이라인의 벤치마킹 또한 서울로 7017 정책의 홍보와 선전 - 은 서울시가 도시정책을 정당화하는 주요한 방법으로서 활용되었다. 서울로 7017은 별다른 공론화 과정 없이 박원순 시장의 정치적 추진력을 통해 급하게 추진되었기 때문에 서울시는 사업에 대한 정당성을 보여주는 것이 필요했다. 이에 서울시는 이미 진행되었던 뉴욕 하이라인의 성공을 통해서 사업의 필요성과 당위성을 보여주었다. 또한 서울시는 사업의 가치와 성공을 국내와 해외로 홍보하는 과정을 통해서, 서울로 7017 대한 성공적인 이미지를 스스로 다듬어갔다. 이처럼 서울로 7017이 조성되는 과정에서 나타났던 벤치마킹과 정책 홍보는 서울시가 도시 정책을 정당화하기 위한 목적에서 진행되었다. 둘째, 서울로 7017의 조성에 있어서 서울시는 하이라인을 벤치마킹 하였지만, 이는 서울시의 정책적 목표와 필요에 따라 선별적으로 이루어졌다. 또한 이처럼 정책적 필요에 맞추어 벤치마킹과 모방이 진행되는 과정에서, 처음 모방하고자 하였던 하이라인의 운영방식과 내용은 큰 폭으로 변용되었다. 일례로 하이라인의 디자인은 유사한 형태로 모방되었지만, 시민참여를 대표하였던 하이라인의 운영방식은 보수적인 서울시의 행정 구조에 맞추는 과정에서 큰 폭으로 변용되었다. 또한 이와 같은 모방과 변용의 과정에서 서울시의 정책, 행정구조, 공간은 빠르게 변화되었다. 본 연구는 전세계적으로 활발하게 진행되고 있는 정책이동 현상이 도시를 어떻게 변화시키고 있는지를 서울로 7017의 실증사레를 통해서 확인하였다. 한편 본 연구는 정책이동을 통해서 이루어지고 있는 다양한 변화들을, 다소 개괄적인 범위에서 살펴보았다는 점에서 한계를 갖기도 한다. 발전된 후속 연구를 통해서 정책이동이 도시의 변화에 갖는 의미를 더욱 면밀하게 검토하고 구체적인 정책적 시사점이 제시할 수 있기를 기대한다. ; This study analyzes the development process of Seoullo 7017 through the theoretical lens of policy mobility. In the past few decades, transfers, diffusion, and movement of urban policies across national borders have increased rapidly. Accordingly, researches on policy mobility have developed in the fields of geography and urban studies. These studies have critically investigated the processes of adaptation, assemblage, and mutation of a certain policy, but have little focused on how the ordinary urban policymaking and the urban area has changed in the process of policy movement. In this regard, this study explores how the mobilization of certain policy has changed and reconstructed the urban policy and planning system. Especially, this research has focused on the interaction of local decision-making and policy mutation processes. The results of the study are as follows. First, the mobilization of policy that appeared in Seoullo 7017 including benchmarking and policy promotion was strategically used by the Seoul city government. The main purpose of these mobilizations was to legitimize the city's urban policy. Seoullo 7017, which was a mayor's landmark project, has proceeded rapidly without the civic consensus process. In this regard, the New York High Line's success was used as a tool to represent the legitimacy of the Seoullo 7017 project. Also, the branding and promotion of Seoullo 7017, which received great attention from the city government, was used as a self-curation tool to make the success story of Seoul's urban policy. Second, the mobilization and adaptation of the High Line were proceeded selectively according to specific political goals of the Seoul city government. Seoullo 7017 benchmarked both the design and governance of the High Line. Lots of critics pointed out that the design should be differentiated, as the regional context of Seoul and New York was different, However, the design was similarly imitated into Seoullo 7017 because of the symbolic image of the High Line's design itself. Also, the management style which emphasized citizen participation and governance were also imitated, but it ends with instrumental form due to bureaucratic political structure. As such, adaptation, mobilization, and mutation has been carried out in accordance with the process of legitimizing local policy and political authority. The importance of this research is that it investigates the consequences and implications of mobile urban policies through an empirical case at various points. However, it also has its limitations as this study looks into various aspects of mobile policies on a superficial level. 학위논문 (석사)-- 서울대학교 대학원 : 법학과, 2012. 2. 권영준. ; 담보제도는 여신금융거래와 밀접한 관계를 가지고 있어서 담보제도의 안정적인 작동은 여신금융거래의 활성화에 기여할 수 있다. 그런데 최근 들어 새롭고 복잡한 금융기법이 등장하고 있는데도 불구하고 대표적으로 이용되고 있는 담보물권의 일종인 저당권은 여신금융거래를 둘러싼 사회적 요구를 충분히 수용하지 못하고 있다. 특히 대규모의 자금이 투입되는 건설사업 등 각종 부동산개발사업을 추진하는 과정에서 이용되고 있는 프로젝트 파이낸싱(Project Financing, 이른바 PF 대출)이라는 금융기법은 막대한 대출금 규모에 비례하는 보다 안전한 담보가 필요하게 되었고, 이와 관련하여 부동산담보신탁은 새로운 담보방법으로 주목받기 시작하였다. 원래 신탁은 영국에서 발달한 제도이고, 현행 우리나라의 부동산담보제도는 대륙법계에서 발전된 제도이기 때문에 신탁을 통한 담보방법의 폭넓은 활용은 용이하지 않았다. 우리나라에서 신탁을 통한 담보방법인 부동산담보신탁의 활용이 관심받기 시작한 것은 불과 20년도 채 되지 않았다. 물론 부동산담보신탁이 완벽한 담보적 기능을 가지고 있는 것은 아니지만, 현행 법체계에서 담보력을 유지하기 위한 강력한 수단이라고 평가받고 있다. 그 이유 중의 하나는 신탁의 도산격리 효과 때문이다. 이것은 위탁자나 수탁자의 파산절차 또는 회생절차에 구속되지 않고 신탁부동산을 독립적으로 취급할 수 있으므로, 채권자인 수익자는 위탁자나 수탁자의 채권자로부터의 간섭 없이 신탁부동산에 대한 권리를 행사할 수 있음을 의미한다. 이러한 도산격리 효과는 신탁제도의 고유한 효과이므로, 부동산담보신탁에서도 동일하게 인정된다. 특히 위탁자에 대한 회생절차가 개시된 경우 수익자로 지정된 채권자는 경우에 따라 위탁자에 대해 가지는 회생채권은 실권될 수 있어도 수탁자에 대해 가지는 수익권은 실권되지 않는다. 이러한 점은 부동산담보신탁을 활성화시키는 강력한 유인이라고 볼 수 있다. 한편 그동안 우리나라에서는 부동산담보신탁에 대하여 신탁의 형식을 빌린 담보제도로 구성하려는 견해가 많았으나. 엄밀히 말하면 부동산담보신탁은 담보제도로 볼 수 없다. 부동산담보신탁에 대하여 형식은 '신탁'이지만 실질은'담보'라는 주장은 물권적 기능을 하는 권리들을 물권법정주의라는 틀에 맞추어 설명하다 보니 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 일종의 비전형담보권으로 보려고 했던 것이다. 그러나 담보신탁을 통하여 얻게 되는 채권자의 담보취득 효과는 경제적인 측면에서 그러한 것이지 법률적인 측면에서 그러한 것이 아니다. 따라서 부동산담보신탁은 어디까지나 신탁제도의 일종이라고 보아야 하고, 신탁제도 자체의 고유한 법리에 기초한 해석으로써도 부동산담보신탁제도를 충분히 설명할 수 있다고 보아야 한다. 미국에서는 부동산을 담보로 금융을 얻는 방법으로 대륙법계의 저당권이 아니라 'Mortgage'나 'Deed of Trust'를 이용하여 왔다. 이러한 'Mortgage'나 'Deed of Trust'는 담보를 위하여 부동산에 대한 소유권을 이전한다는 점에서는 동일하지만, 전자는 채권자에게 부동산에 대한 소유권을 이전하는 반면에 후자는 수탁자에게 그것을 이전하고 채권자는 수익자로 된다는 점에서 차이가 있다. 캘리포니아 州의 경우 1930년 이후부터'Deed of Trust'와 'Mortgage'를 동일하게 취급하여 'Deed of Trust'의 본질을 매각권이 부여된 'Mortgage'로 보았다. 그러나 이와 같이 'Deed of Trust'와 'Mortgage'에 대한 동일한 취급이 우리나라에서도 수용 가능한 것인지는 재고의 여지가 있다. 왜냐 하면 미국의 도산절차에서는 담보권자의 권리가 감축되지 않으므로 'Deed of Trust'를 매각권이 부여된 'Mortgage'로 취급하더라도 별 문제가 없으나, 우리나라의 경우는 채무자 회생 및 파산에 관한 법률의 회생절차에서 회생담보권자로 취급되면 권리감축의 대상이 되므로 부동산담보신탁을 담보제도로 보게 되면 중대한 문제가 발생할 수 있기 때문이다. 즉 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 비전형담보권으로 보게 될 경우 논리적으로 회생담보권이 되어 수익자 보호에 취약해질 수 있다는 것이다. 최근 우리나라에서는 신탁법의 전면 개정(2011. 7. 25. 법률 제10924호)으로 담보신탁의 법적 근거가 마련되고, 어떤 측면에서는 기존의 담보제도가 가진 한계를 극복-예컨대 수익증권의 발행이 가능하게 됨으로써 수익권의 유통성이 확보됨-할 수 있게 되었다. 이러한 점들은 앞으로 부동산담보신탁의 활용을 높이는 계기가 될 것이다. 한편으로는 담보신탁의 대상이 단순히 부동산에만 한정된 것이 아니기 때문에 동산, 유가증권, 금전채권 등의 신탁재산을 포괄하는 담보신탁의 활용 가능성에 대한 관심과 연구가 증대되어 궁극적으로 안정적이고 편리한 담보신탁의 활용을 통하여 여신금융거래의 활성화에 기여할 수 있도록 하여야 한다. ; The stable working of the security system can make a significant contribution to revitalizing the loan financial transaction because both of them are intimately associated with each other. Although new and complicated financial methods recently appear, a typically-used hypothec does not accept social needs surrounding the loan financial transaction. Especially the financing method which is called Project Financing needs a safer security in the process of promoting all sorts of the Real Estate Development Business prodigious funds are invested in. In this situation the real estate security trust began to make a mark as a new type of security method. A wide use of Trust as a security method was not easy because it is originated from the United Kingdom and the real estate security system in Korea has been developed from the Continental law line. It is less than 20 years that the real estate security trust has been noted as a new type of security method. Although the real estate security trust does not have perfect functioning of security, it is appreciated as a powerful means for keeping the value of security. One of the reasons is due to bankruptcy remoteness effect in Trust. This means that a creditor as the beneficiary can exercise his or her right about the trusted real estate being free from intervention of truster or trustee. As this bankruptcy remoteness effect is a peculiar one of the trust system, it is equally admitted in the real estate security trust. If a rehabilitation procedure is started, a creditor as the beneficiary can lose his or her rehabilitation credit about truster but can not lose the beneficiary right about trustee. This aspect is a contributory cause in reinvigorating the real estate security trust. Some people tended to regard the real estate security trust as the security system so far in Korea. In other words those who make an assertion that it is 'the trust' in form and 'the security system' in essence think of the beneficiary right as a kind of non-typical security right. But strictly speaking, it is not the security system. Because the security acquisition effect in the real estate security trust is right in a economical aspect and is not so in a legal aspect. So the real estate security trust is a kind of trust system and we can understand it with an explanation based on the peculiar principle of trust system. They have used 'Mortgage' or 'Deed of Trust' as a method for financing with a real estate in the United States. This 'Mortgage' or 'Deed of Trust' is similar in transferring the ownership about a real estate for a security, the former transfers it to a creditor but the latter does so to trustee. In California 'Deed of Trust' and 'Mortgage' are treated equally as the essence of 'Deed of Trust' is a kind of 'Mortgage' that has the right of disposal by sale since 1930. However we must reconsider whether this treatment in California can be accepted in Korea. Although 'Deed of Trust' in California is similar to the security trust in Korea, they are not identical. It is natural that 'Deed of Trust' is treated as a kind of 'Mortgage' which has the right of disposal by sale because the security right is not reduced in the law related to rehabilitation or bankruptcy procedure of the United States. However the law in Korea is different from that in the United States. If we regard the real estate security trust as the security system in Korea, the serious problem comes into existence because the rehabilitation security right is reduced according to the insolvency law of Korea. In other words if they think of the beneficiary right as a kind of non-typical security right, it is logically the rehabilitation security right. In result we can not protect the beneficiary. The Trust Law of Korea was fully revised in 25th July, 2011. It has not only brought about the legal basis of the security trust but also made a kind of the institutional device which can get over a boundary of the past security system-issuing a beneficiary certificate and securing a circulation of the beneficiary right. These points will enhance the use of the real estate security trust. Additionally as the object of the security trust is not limited only to a real estate, we must study the chance of using the security trust which include movable properties, securities, bonds to be paid in money and so on. This leads to making good use of the security trust which is stable and convenient, and so will eventually revitalize the loan financial transaction. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 행정학과(행정학전공), 2012. 2. 정광호. ; 사회가 민주화되고 가치가 분화됨에 따라 각종 국책사업을 둘러싼 공공갈등이 심화되고 있다. 단순한 이익갈등뿐만 아니라 가치갈등 또는 복합갈등이 빈번하게 발생하고 있으며, 갈등범위도 전국적으로 확대되고 있다. 본 연구는 국책사업 중에서 '세종시 수정안'을 사례로 선정하여 정책결정 과정을 둘러싼 갈등에 대해 분석하고자 하였다. 특히 세종시 수정안 정책결정을 둘러싼 갈등의 배경과 성격은 무엇이고, 그 갈등을 관리 또는 해결하기 위해 정부에서 선택한 의사결정 방안이 적정하였는지 등을 참여적 의사결정 하의 갈등관리시스템의 틀로 분석하였다. 이를 통해 향후 세종시 수정안 추진과 유사한 대형국책사업 추진에 있어서의 성공적인 갈등관리를 위한 시사점을 도출할 수 있을 것으로 기대하였다. 제1장에서는 연구의 목적과 필요성, 연구의 대상과 범위에 대해서 설명하고 연구에서 사용한 사례연구방법과 자료수집방법에 대해 밝혔다. 제2장에서는 공공갈등의 개념과 유형 등 이론적 논의를 한 후, 참여적 의사결정이론을 소개하였다. 이러한 이론적 배경과 선행연구 등을 바탕으로 연구의 분석틀을 설정하였다. 제3장에서는 세종시 수정안 갈등의 발생배경과 갈등의 성격, 갈등의 쟁점과 이해관계자 분석, 갈등시기별 전개과정 등을 살펴보았다. 제4장에서는 연구의 분석틀에 따라 참여적 의사결정 요인과 정치 환경 요인에 따라 세종시 수정안 사례를 분석하였다. 주요 분석결과를 요약하면 다음과 같다. 우선 참여적 의사결정 요인에 따른 분석결과, 세종시 수정안 사례는 전반적으로 참여적 의사결정 방법에 의한 갈등관리가 미흡하였다고 평가할 수 있다. 첫째, '여론수렴 및 정보제공'이 미흡한 것으로 나타났다. 초기부터 여론수렴 및 정보제공 보다는 정부주도의 일방향적인 의사결정 추진 및 설득에 치중함으로써 갈등관리에 부정적인 영향을 미쳤다고 볼 수 있다. 둘째, '참여적 의사결정 활용' 측면 또한 미흡한 것으로 나타났다. 관련분야의 학식과 경험이 풍부한 전문가들을 민간위원으로 포함시켜 '세종시 민관합동위원회'를 구성ㆍ운영하였으나, 인적구성에서 찬성의견과 반대의견에 대한 균형을 이루지 못하여 활동결과에 대한 신뢰도를 저하시키는 원인이 되었다. 셋째, '협력규칙의 적용 여부'를 살펴보면, 우선 참여규칙, 분해규칙 적용 측면에서 미흡하였다. 그리고 자원확대규칙 측면에서는 원안보다 큰 경제적 보상이라는 인센티브를 제공하였으나, 이해관계자들에게 정치적 신뢰를 얻지 못함으로써 큰 효과를 발휘하지 못하였다. 마지막으로 '결과의 공개 및 정책에의 반영 여부' 측면에서 볼 때, '세종시 발전방안'을 언론 브리핑 형태로 발표함으로써 결정결과의 공개 자체는 투명하게 이루어졌다고 할 수 있으나, 수정안 마련 과정이나 발표 이후 국민의견수렴 절차를 거치는 과정은 미흡했다고 볼 수 있다. 정치환경 요인에 따른 분석결과는 다음과 같다. 우선, 여당내 대통령의 리더십이 수정안 찬성집단과 반대집단으로 분절된 결과, 정책의제 설정 및 정책결정과정의 추진력이 약화되었다. 둘째, 야당이 타협의 의사 없이 세종시 수정 추진에 무조건 반대하는 방식으로 진행되어 갈등이 증폭되었다. 셋째, 핵심 어젠다 제기의 정치적 타이밍과 관련, 5년 단임제의 특성을 고려할 때 집권 2년이 다 되어 갈 무렵 세종시 수정이라는 어젠다가 공식 제기됨으로써 유리한 타이밍을 놓쳤다고 볼 수 있다. 이와 같이 불리한 환경적 요인들은 참여적 의사결정에 의한 갈등관리에 부정적인 제약요인으로 작용하였다고 볼 수 있다. 제5장에서는 이와 같은 연구결과를 요약하고, 다음과 같은 시사점을 도출하였다. 첫째, 갈등과 갈등 당사자의 특성, 갈등이슈 유형 등에 따라서 갈등관리방식의 선택 또한 달라져야 한다는 것이다. 특히, 극단적인 대립과 갈등이 예상되고 그 파급효과가 매우 큰 세종시 수정안과 같은 사례일수록, 사전에 갈등영향분석 등을 통해 갈등의 요인을 사전예측ㆍ분석하여 관리대책을 마련하고, 정책의제설정 및 정책결정과정에서 참여적 의사결정 수단의 적극적인 활용이 필요하다고 볼 수 있다. 둘째, 정책대상집단과 이해관계자에 대한 사회적 인식(social construction of target populations)에 따라 갈등관리의 구체적인 수단 또한 달라져야 한다는 점을 알 수 있다. 따라서 향후 유사한 갈등사례에 있어서 정부의 갈등관리 전략 마련시 대상집단에 대한 사회적 인식에 대한 관심을 바탕으로 유ㆍ무형의 인센티브를 적절히 활용하는 것이 필요하다고 할 수 있다. 셋째, 참여적 의사결정기법 활용을 위한 구체적인 법적ㆍ제도적 장치 마련이다. 세종시 수정안 사례에서 전반적으로 참여적 의사결정방법의 구체적인 수단 활용이 미흡했던 것은 이러한 방안을 준비하고 실행할 수 있는 제도적 뒷받침이 부족했던 점에서도 그 원인을 찾을 수 있다. ; As society is democratized and the value is divided, public conflict surrounding the various national projects is growing. Value conflicts or compound conflicts, as well as simple interest conflicts occur frequently, and conflict is expanding nationwide scope. This study selected the case of amendment of Sejong city among various national projects as a case study, and tried to analyze conflict over the decision-making process of the case. Especially, this analyzed over the background and characteristic of conflict on the amendment of Sejong city, and appropriateness of the system of conflict management selected by the government in order to manage or solve the conflict through the frame of conflict management system under participative decision-making. This promotion is similar to the amendment during the next three kinds of large national projects in promoting the success of the implications for conflict management was expected to be drawn. Through this study, it is expected to reach to an implication for the successful conflict management on the similar case of the amendment of Sejong city. Chapter 1 explains the purpose, necessity, range and target of the research, and it defines a method of case study as well as the method of collecting data that are used for the case study. Chapter 2 explains the theory of participative decision making after introducing a theoretical review such as concept and kinds of public conflict, and establishes a framework of the study by referencing previous studies. Chapter 3 reviews the background and nature of conflict on the amendment of Sejong city, conflict issues and stakeholders, and development process of conflict. Chapter 4 analyzes the case by the factors of participative decision making and the political-environmental factors through the framework. The summary of main analysis is as follows: First of all, the case of amendment of Sejong city can be evaluated that the conflict management through participative decision making is insufficient, as a result of analysis by the factors of participative decision making. First, the 'collection of public opinion and provision of information' was insufficient. From the beginning, the government focused on a one-way decision-making and persuasion rather than collection of public opinion and provision of information, and it negatively influenced on conflict management. Second, the 'use of participative decision-making' was also insufficient. Even though various experts participated in the Sejong city committee, the composition was biased. Therefore it was one of the main cause of declining the reliability of the results. Third, 'participating rule' and 'factoring rule' were not sufficiently utilized. In terms of 'resource expanding rule', the government suggested more incentive of amendment plan than one of original plan, but it was not effective because of distrust of the government. Finally, in terms of announcement of the result and feedback of policy', amendment of Sejong city was openly publicized through giving a briefing. However the process of collecting extensive opinions was insufficient. The result of analysis by means of political-environment factor is as follows: First, the leadership of President was divided into supporting groups and opposition groups. Therefore the momentum of agenda-setting and policy-making was weakened. Second, the opposition party opposed to the amendment of Sejoing city without any condition. Third, the political timing of agenda-setting was not timely. The government missed the advantageous timing because the agenda was proposed during second year of a 5-year term of presidency. These adverse environmental factors negatively effected on conflict management of participative decision making. Chapter 5 summarizes the results of these studies, and the following implications were drawn. First, the method of conflict management should be selected according to the nature of conflict and the conflict parties, conflict type of issue. In particular, when the extreme conflict is anticipated and the result of the policy is wide, the government should pre-establish measures of conflict management through conflict effect analysis, and participative decision making should be actively utilized. Second, the specific means of conflict management should be selected by social construction of target populations. Third, the government should prepare the specific legal and institutional means for the use of participative decision making. ; Master

학위논문 (박사) -- 서울대학교 대학원 : 사범대학 사회교육과(역사전공), 2020. 8. 유용태. ; 본 연구는 청이 불평등조약과 서양 국제법 서적을 통해 주외공관 제도를 수용하는 과정을 분석한 다음, 이것이 주한공관 설립과 한청 근대외교로 이어지는 모습을 고찰하였다. 이 과정에서 전통외교와 근대외교 각각에서 유래한 합리성과 제국성이 작용하는 양상에 유의하였다. 요컨대, 외교학의 용어와 개념은 물론 주외공관의 운영 원리에 착목하여 청의 주한공관을 체계적으로 밝힌 개척적인 연구라 할 수 있다. 청은 아편전쟁으로 체결한 불평등조약에 따라 주외공관 제도를 수용하였다. 이후 열강이 속속 설립한 주청공관은 자국인을 보호하고 외교 협상을 효과적으로 전개하는 한편, 영사재판권·포함외교 등을 통해 자국의 이익을 확보하였다. 한편 이 시기 청에 번역 소개된 󰡔만국공법󰡕 등의 서양 국제법 서적 또한 주외공관의 역할, 권리, 의무 등을 총체적으로 설명하는 한편, 非서구에 대한 영사재판권과 포함외교를 정당화하였다. 이를 통해 청에서는 합리성과 제국성으로 대표되는 주외공관 인식이 형성되었다. 본고가 불평등조약과 서양 국제법 서적에서 公使·領事 등의 번역어가 정착되는 과정을 분석한 결과는 청의 주외공관 인식이 심화되는 과정을 잘 보여준다. 이러한 상황에서 대외 위기가 고조되자, 청 정부 내에서는 상주사절 파견론이 대두하였다. 그 결과, 청은 영국을 시작으로 해외 각국에 공사관을 개설하고, 싱가포르 등 청국인이 많이 거주하는 지역에는 영사관을 설립하기 시작하였다. 청의 주외공관은 현지에서 교섭 사무, 자국민 보호, 정보 수집 등 다양한 업무를 수행하였다. 이는 청이 불평등조약에 따라 설립된 열강의 주청공관을 관찰하고, 서양 국제법 서적을 번역 이해한 결과였다. 이러한 흐름 속에서 1883년 청은 첫 번째 주한공관으로서 주조선상무서를 설립하였다. 그런데 주조선상무서는 분명 근대외교의 산물이었으나 청과 조선은 아직 전통외교를 적용하고 있었다. 따라서 주조선상무서는 전통외교와 근대외교가 착종된 과도적 형태의 주한공관이라 할 수 있다. 이것은 청이 진수당의 직함을 총판상무위원이라 하면서도 사실상 총영사의 지위를 부여한 데서도 잘 나타난다. 진수당은 주로 청 상인의 경제적 이익을 확보하는 방향으로 제국성을 표출하였고, 이를 합리성으로 분식하기 위해 전통외교와 근대외교를 선택적으로 활용하였다. 이 시기 한성·인천·부산·원산에 설립된 주조선상무서는 판리조선상무장정을 토대로 운영되면서 진수당의 활동을 뒷받침하였다. 1885년 청은 진수당을 경질하고 그 후임으로 원세개를 임명하였다. 이때 원세개에게는 총리교섭통상사의라는 직함과 총영사 겸 4등공사라는 지위가 부여되었다. 본고는 원세개가 지닌 4등공사의 지위에 주목하여, 이것을 원세개가 상국의 대표로서 조선의 외교를 주지한 법적 근거였음을 밝혔다. 그러나 원세개는 외교뿐 아니라 내정에까지 개입하였고, 이 과정에서 전통외교와 근대외교를 선택적으로 구사하여 제국성을 더욱 강렬히 표출하였는데, 이는 원세개의 독단적인 판단이 아니라 어디까지나 청 정부의 암묵적 동의에 따른 것이었다. 이 시기 원세개가 임기를 마친 후에도 두 차례나 더 유임되었고, 주조선상무서의 규모가 대폭 확장되고 용산상무서가 신설된 것은 원세개의 활동을 뒷받침하는 토대로 작용하였다. 그러던 중 청일전쟁이 일어나며 주조선상무서는 폐쇄되었다. 그러나 청은 1896년 총상동·총영사 당소의를 파견하여 주조선영사서를 개설하였다. 이때 당소의가 비공식 사절을 자처하였던 만큼, 주조선영사서 또한 비공식 기구에 머물렀다. 청이 자국민을 보호하면서도 조선의 수교 요구는 거부하기 위해 일종의 편법을 사용했던 것이다. 청은 마지못해 수교를 결정한 다음에도 4등공사 또는 흠차대신을 파견하려고 하는 등, 여전히 대한제국에 전통외교를 적용하려는 태도를 보였다. 1899년 한청수교가 이루어진 후, 청은 두 번째 주한공관인 주한공사관·영사관을 개설하였다. 이는 결국 청이 대한제국에 근대외교를 전면 적용하게 되었음을 의미하는 것이다. 주한공사 서수붕, 허태신, 증광전은 서양 국제법과 한청통상조약에 근거하여 교섭 사무를 처리해 나갔고, 이 무렵 신설된 外務部가 주외공관 제도의 개편에 나서면서 주한공사관·영사관의 합리성은 한층 보강되었다. 이 시기 청이 제국성을 표출하기 어려워진 상황과 달리 대한제국에서는 열강을 모방한 제국성이 생겨나기 시작하였다. 제1·2차 한일협약 이후에는 청의 주한공사관이 철수하고 주한영사관이 그 공백을 채웠다. 이 시기 한국총영사 마정량은 주한공사에 버금가는 권한을 지녔고, 주한영사관의 규모는 더욱 확장되었다. 본고는 이 시기 청 정부가 주외공관 제도를 개편하면서, 주한영사관의 관제가 개편되고 관원에 대한 대우가 개선된 것에 주목하였다. 이는 대한제국이 국권을 상실해 가는 상황에서도 청의 주한공관이 지닌 합리성이 증진되었음을 의미한다. 그러나 한국총영사 마정량은 각종 현안을 교섭하는 과정에서 합리성을 내세웠지만, 대한제국을 매개로 일본이 표출하는 제국성에 대응하는 과제를 안게 되었다. 그리고 한일병합으로 대한제국이 주권을 상실한 후에도 주한영사관은 주조선영사관으로 명칭을 바꾸어 존속하였으나, 한청관계가 일청관계로 대체되었기에 그 위상은 점차 낮아졌다. 본 연구에서 청말 주한공관을 한청관계의 맥락 위에 놓고 전통외교와 근대외교의 착종 과정에 주목한 것은 선행 연구의 보완과 연구 지평의 확대라는 측면에서 다음과 같은 의미를 지니고 있다. 첫째, 중국외교사의 측면에서, 청의 주한공관은 중앙 정부와 개인 차원의 외교 행위를 상호 관련성 속에서 이해할 수 있도록 하는 발판이 된다. 특히 청의 근대외교는 합리성을 갖추고 있었던 것은 물론 속국에 대해서는 명백히 제국성을 띠었던 만큼, 청의 근대외교가 지닌 후진성이나 反침략성을 강조해 온 선행 연구의 관점은 재고될 필요가 있다. 둘째, 한중관계사의 측면에서, 청의 조선 정책은 전통외교와 근대외교 양쪽 모두에서 유래한 합리성과 제국성이 길항하는 과정에서 그 양상을 달리하였음을 규명하였다. 따라서 청의 조선 정책을 전통적인 속방 체제의 강화 또는 근대적 제국주의 어느 한쪽으로 이해하는 것보다는 양측 모두가 착종한 양상에 주목하는 것이 적절하다. ; This study examined the way in which Qing dynasty had introduced the diplomatic office system through unequal treaties and the Western international law books, and figured out relevance between Qing's diplomatic offices in Korea and Sino-Korean modern diplomacy. In particular, this article paid attention to the manifestation that rationality and empireness of the diplomatic offices appeared and the aspect that the traditional diplomacy and modern diplomacy competed. In premodern times, traditional diplomacy based on tributes and installation was widely practiced in East Asia. But traditional diplomacy shook and modern diplomacy spread after the Opium War. In particular, the diplomatic offices of Western powers were symbol of modern diplomacy. Qing's understanding of the diplomatic office deepened through unequal treaties and Western international law books. The unequal treaty that Qing dynasty signed with the Western powers included clauses related to the diplomatic offices. The Western international law books introduced by Qing also included contents related to the diplomatic offices. In short course, the idea of dispatching resident envoys emerged in the Qing government. In this situation, Qing started to set up legations and consulates abroad. The diplomatic offices of Qing dynasty carried out various tasks, including negotiation affairs, protection of citizens, and gathering information. These diplomatic offices were based on the reference of the Western powers' diplomatic offices and Western international law books, therefore they contained both rationality and empireness of modern diplomacy. Paradoxically, rationality and empireness were fully expressed in the East Asian country. Qing's diplomatic offices in Korea can be explained in terms of rationality and empireness, and the change of Qing's diplomatic offices in Korea can be divided into the following two periods. The first phase is the founding period of the Qing's diplomatic offices in Korea. In this period, Qing aimed at making the Chosun her vassal state through the Commercial Affair Office. The General Commissioner of Trade Chen Shu-Tang established several Commercial Affair Office. In fact, the Commissioner of Trade was equal to the consul, and the Commercial Affair Office was equal to the consulate. But Qing avoid the term 'consul', 'consulate' to emphasize the vassal status of Chosun. Yuan Shi-Kai as a successor to Chen Shu-Tang corresponded to diplomatic minister. In this period, Qing and Chosun experimented the modern diplomacy through the diplomatic offices, but the traditional diplomacy was still valid. Qing made a use of modern diplomacy and traditional diplomacy arbitrarily. The second phase is the completing period of the Qing's diplomatic offices in Korea. In 1896, Qing established the consulate in Korea to protect the Chinese and avoid Chosun's call for diplomatic ties. After deciding to establish diplomatic ties, Qing planned to dispatch the fourth minister, and soon changed it to the minister plenipotentiary. This phenomenon symbolically shows the shift from traditional diplomacy to modern diplomacy. In 1899, Qing established a legation and consulates after concluding Sino-Korean treaty of commerce. The ministers of Korea treated the negotiation with Korea on the basis of the Western International law and Sino-Korean treaty of commerce. At that time, Qing established the Department of Foreign Affairs to reform diplomatic institutions. As a result the rationality of modern diplomacy increased, but the empireness of modern diplomacy was difficult to appear. In 1906, Qing decided to withdraw legation of Korea by request of Japan, and the consulate then dealt with task of the legation. Accordingly, consul general of Korea Ma Ting-Liang came close to minister of Korea, and the consulate grew in size. At that time, Qing government reformed the diplomatic office institutions, so consulates of Korea were reformed and diplomat treatment improved. After Japan-Korea Treaty of 1910, Sino-Korean relations ended, but the consulate of Korea still maintained changing its name to consulate of Chosun. In short, the consulate of Korea had developed in a way that enhances the rationality of modern diplomacy, but had to defend against Japanese empireness. This study has the following meanings in terms of supplementation of prior research and expansion of research horizon. First, this article revealed that Qing's empireness before Sino-Japanese War had come from both traditional diplomacy and modern diplomacy. Therefore preceding researches which have judged Qing's Chosun policy traditional or modern need to be reconsidered. Second, this article discovered the rationality from modern diplomacy in proceeding of Sino-Korean relations. Several preceding researches didn't stress on the development of Sino-Korean relations.
