The Common Agricultural Policy (CAP) reform, decided by the European Council in June 2003, modifies the way Community authorities support agriculture. In France, the implementation of the single payment (in substitution of a part of the compensatory payments allocated historically on the basis of the production factors) constitutes a significant break, in particular in the bovine sector (milk, beef and veal). The aim of the paper is to evaluate the consequences of this CAP reform on the evolution (2003-2007) of the direct subsidies (and of the single payment) for different categories of French bovine farms. The simulation, carried on the basis of individual data of the Farm Accountancy Data Network (FADN, 2003), takes into account assumptions of labour productivity increase and two options of decoupling: partial (according to the method applied in France) and total (as Community legislation allows it). Starting from the simulated state, the possibilities offered to the Member States to redistribute the direct supports are discussed. La réforme de la Politique Agricole Commune (PAC), décidée par le Conseil européen en juin 2003, modifie le mode d'intervention des pouvoirs publics au sein de l'agriculture européenne. En France, la mise en œuvre d'un paiement unique découplé en substitution d'une partie des paiements compensatoires alloués historiquement sur la base des facteurs de production constitue une rupture importante, notamment dans le secteur bovin (lait et viande bovine). L'objectif de cet article est de mesurer les conséquences de cette réforme de la PAC sur l'évolution, à l'horizon de 2007, des aides directes et du paiement unique dans différentes catégories d'exploitations laitières et bovins-viande françaises. La simulation, qui est conduite sur la base des données individuelles du Réseau d'Information Comptable Agricole (RICA) de l'exercice 2003, prend en compte des hypothèses de gains de productivité et traite de deux options de découplage : partiel (au sens des modalités retenues en France) et total (comme la réglementation communautaire le permet). Sur la base de la situation projetée, une discussion est ensuite engagée sur les possibilités offertes aux Etats membres quant à une éventuelle redistribution des soutiens directs. RELEVER LA France DANS LES APRÈS-GUERRES : RECONSTRUCTION OU RÉAMÉNAGEMENT ? Is there a direct link between war and architecture ? Is the first at the origin of a renewal of the second, or is conservatism a constant in this area ? We propose to study the case of France in the 20 th century through legislation and certain concrete achievements, in order to judge the true nature of reconstruction in the postwar periods.

This thesis analyses the invocability of International Agreements before the European Court of Justice and the French"Conseil d'État". A convergence of the Case-Law of these Courts exists on this matter. On one hand, the constitutionalconditions for incorporation of Treaty rules are similar, owing to the common monist orientation of EU and FrenchLegal Orders. On the other hand, Direct Effect – ie the ability of a rule to grant substantive Right – is the main filter ofthe invocability of Agreements before the Courts of Paris and Luxembourg. The recognition of Direct Effect isdecided by a judge's choice. And it appears that the methods of interpretation used by the French "Conseil d'État",combining exegesis and teleology, are coming close to those advocated by the ECJ. In the Judicial Review, theconnection between invocability and Direct Effect can however be criticized, because the claimant doesn't call for theapplication of one of his individual Rights, but for the legality control of a norm on the ground of another norm. TheECJ and the French "Conseil d'État" have indeed given some limited effect to the non-directly effective rules ofInternational Agreements, for example by interpreting domestic law in conformity with this kind of Rules. Howeverthe impossibility to contest the violation of these Rules breaches certainly the Rule of Law. The search for balance in the contract for the carriage of goods by road, envisaged in terms of execution and non-performance of the essential service of the carrier, the movement of the goods, has allowed thanks to a mixture of both interpretative and analytic, to compare the different rules governing the matter in the OHADA space in France and internationally, in fine to highlight the differences between our different sources, and to highlight the vitality of road transport and its role of catalyst in the development of the countries of the OHADA space and the cohesion of the populations. Indeed, while the AUCTMR was largely inspired by the European CMR, the fact remains that it corrects its weaknesses. There are differences in particular : the time of action, the calculation of compensation, the nature of the fault of the valet, the direct action of the valet. The originality of OHADA law lies mainly in its management of conflicts of laws and jurisdictions, since uniform acts are directly applicable in the Member States. In this quest for balance, issues of delivery in a conventional of reasonable time in a context of securities (road and violence) may arise. In fine, the material and financial benefits that characterize the contract of carriage being balanced, it follows that the complete equality of contractual relations remains utopian. Nevertheless, the OHADA law, propelled by French law and especially the European CMR, seeking to establish the balance between the reciprocal obligations of the parties, decides to rebalance the contract thanks to the devices of revision, reduction, or simply to withdraw. Le financement des établissements de soins a connu dans le courant de l'année 2007 d'importants changements législatifs. De l'introduction de la tarification à l'activité sur la base des diagnostic-related groups (DRG) à la mise en concurrence directe des hôpitaux, qu'ils appartiennent au secteur public ou au secteur privé, de l'ingérence de la Confédération dans la planification hospitalière (jusque là domaine réservé des Cantons) à la mise au premier plan des critères de qualité dans l'évaluation des établissements hospitaliers, les exemples ne manquent pas pour illustrer le changement conceptuel auquel nous assistons. L'auteur de ces lignes, privilégiant l'approche historique à l'approche normative, s'est demandé quels étaient les prémices de ce changement législatif et s'est confronté aux différents textes qui ont émaillé les débats de ces vingt dernières années, qu'ils émanent du pouvoir exécutif (messages aux chambres fédérales, ordonnances d'application) ou du pouvoir législatif (textes de loi) afin d'en dégager la cohérence politique. Ce mémoire suit donc une ligne strictement chronologique. Il s'inspire des différents travaux parlementaires. A la lecture de ces textes, il apparaît que, pour les parlementaires, la question du financement des hôpitaux n'est qu'une partie, parfois essentielle, parfois accessoire, selon les époques et l'amplitude du champ d'application du document législatif, du financement des soins par l'assurance-maladie. Les grands principes qui régissent l'assurance-maladie s'appliquent donc nécessairement au financement des hôpitaux. Pour cette raison, il est apparu judicieux à l'auteur de ces lignes de ne pas séparer les deux problèmes et de se plonger dans un premier temps dans les débats qui ont eu cours lors de l'adoption de la nouvelle loi sur l'assurance-maladie (LAMaI) en 1994. The definition of the EU as a constitutional legal order is crucial, but still fragmented. For the sake of systematization, it is important to find out a principle to support its development. That is why we made the choice of examining the principle of non discrimination through the analysis of case law, with the object of verifying if this principle is a fundamental part of the EU constitutional identity. In the first part of this work the structure of the discrimination scrutiny in front of the CJEU and of the ECHR is analyzed, enlightening the fact that its structure increasingly recalls that of a constitutional scrutiny. In the second part of this work we will focus on the contribution given by the case law on the fight against different grounds of discrimination to the EU constitutional identity. As there is an increasing number of grounds of discrimination, a choice should be made. That is why the second part of the analysis is devoted into explaining a selection of grounds of discrimination: discrimination on the ground of nationality, age, disability, religion, and sexual orientation. From the analysis of the case law and of secondary legislation is possible to induce that this principle has the potential necessary to support the development of the EU constitutional identity without prevailing on the national constitutional identities. At the same time, the principle could help into shading light in one of the most debated issues of EU law: the tension between the conferred powers and the direct effect of directives. This thesis analyzes the internal and external political, economic and constitutional life of Mongolia since its democratic revolution. This small country mainly relies on its natural resources and willing to develop its cooperation with other countries, which have rich experiences in mining. Analyses on foreign direct investment in Mongolia show the impact of domestic legislation: laws on the exploration and exploitation of natural resources, protection of the environment, and strategic ranking of natural resource sites etc. The thesis attempts to explain Mongolia's current relations with foreign countries and tries to predict the future in light of the commitments to international organizations and bilateral and multilateral agreements. This thesis puts into perspective the concept of "third neighbor" in Mongolia's foreign policy: the search for the support of a third power, which is a virtual neighbor (ie without geographical proximity) sharing the same democratic values. Moreover, it tries to explain in detail, the bilateral relations between Mongolia and France, its privileged "third neighbor". It highlights the human and territorial relations between France and Mongolia that allow for good relations at a higher level irrespective of economic and political problems. The Possibilities of Extending Economie Relations between Bulgaria and France.
Industrial cooperation between France and Bulgaria is a very recent experiment but numerous contacts between the two countries are planned. One of the major difficulties stems from the unfavorable situation created for CEMA countries.
The absence of monetary convertibility in the East also complicates relations between the two groups of countries.
Finally, it is difficult for the West to establish direct contact with socialist firms, their priority being given to cooperation with firms within CEMA.
However legislation is becoming more and more favorable and East-West cooperation is developing.
