Bu çalışmanın amacı, yerel demokrasi ve katılıma ilişkin öngörüleri ve potansiyelleri belirlemek ve bu doğrultuda sivil toplum kuruluşları (STK) olgusunu incelemektir. Yapılacak incelemede çıkış noktası, yerel demokrasinin yaşama geçmesinde bir araç olarak, STK'ların kentsel katılım oluşturulması sürecinde olumlu rol üstlendiği doğrultusundadır. Yerel yönetimlerin yapısal değişim geçirdikleri bilinen bir gerçektir. Bu değişimlerin başında, kentteki tüm grupları aktör ve paydaş gören yerel katılım kavramı gelmektedir. Kentsel mekânlarda etkili karar alma konumunda olan genelde yerel yönetimler, özelde belediyeler, doğrudan demokrasi avantajlarının ve katılımın sergilenebileceği yönetimlerdir. Gerçekleştirilen yerel mevzuat düzenlemeleri ile yerel yönetimlerde sorunların çözümü ve hizmet sunumunda, çok ortaklı ve çok aktörlü yönetişim anlayışı hedeflenmekte, STK katılımı beklenmektedir. ; The aim of this study is to identify predictions and potentials about local democracy and participation and to examine the phenomenon of civil society organizations (CSOs) in this direction. Starting point of the investigation is the positive role of CSOs in the creation of urban participation as tools for the practice of local democracy. It is a known fact that local governments have experienced structural changes. At the head of these changes comes the concept of local participation that considers all groups as actors and partners in the city. Local governments in general, municipalities in particular, which are in the position of making effective decisions is urban space are the administrations that advantages of direct democracy and participation can be exposed. Multi-partner and multi-actor government approach is aimed in problem solving and service presentations at local governments owing to the arrangements on the local legislations, the participation of CSOs is expected.
Siyasal sistemler ve rejimler tartışması, Platon'dan Rawls'a kadar sürmüştür. Bu süreçte ideal devlet düzeni arayışlarında, meşruiyetini halk iradesine dayandıran demokrasi modeli tek geçerli sistem olarak modernitenin bir göstergesi şeklinde kabul edilmiştir. Siyasal iktidarın kuvvetler arasındaki dağılımı veya sınırlandırılması anayasalarda düzenlenmiştir. Demokratik ülkelerde Parlamenter Sistem, Başkanlık Sistemi ve Yarı Başkanlık Sistemi olmak üzere üç temel hükümet sistemi bulunmaktadır. Parlamentonun varlığı demokrasi için bir garanti olmadığı için demokrasi, parlamenter sistem olmaksızın da var olabileceği gibi; parlamenter sistem de demokrasi olmaksızın var olabilir. Dolayısıyla hükümet biçimi ile demokrasi veya hukuk devleti arasında doğrudan bir ilişki veya orantı bulunmamaktadır. Bu çalışmada iyimser bir perspektiften bu iddia savunulmaya çalışılmıştır. Bu çalışmanın amacı, Türkiye'de sürekli tartışılan başkanlık sisteminin gerekliliği ve uygulanabilirliğini sorgulamak ve sisteme yöneltilen bazı eleştirilerin ve çekincelerin daha iyi anlaşılmasını sağlamaktır. Bu bağlamda literatür taraması yapılarak başkanlık sisteminin avantajları ekseninde, gerek parlamenter sistemin dezavantajları gerekse başkanlık sisteminin olumlu yönleri karşılaştırmalı olarak ele alınmıştır. Çalışmada ayrıca çeşitli yazarların görüşlerine yer verilmiş ve hükümet sistemlerinin kavramsal boyutta analizi yapılarak tarihsel süreç içerisinde ülke örnekleri ile kıyaslama yapılmıştır. Çalışma üç bölümden oluşmaktadır. İlk bölümde öncelikle başkanlık sisteminin gerekliliği üzerinde durulmuştur. İkinci bölümde başkanlık sisteminin ülkemizde uygulanabilirliği detaylı olarak ele alınmıştır. Üçüncü bölümde ise sisteme karşı yöneltilen eleştiri ve çekincelere yer verilmiştir. ; Political systems and regimes discussion lasted from Plato to Rawls. In this discussion process, the democracy model which is universally the only valid regime of all systems basing its legitimacy upon the people's will has been recognized as an indication of modernity in search of the ideal state order. The distribution or limiting of the power of government among the political powers is regulated by the constitutions of the countries. In democratic countries, there are three basic systems of government including parliamentary system, presidential system and semi-presidential system. Democracy can exist without parliamentary system and parliamentary system, in contrast, can exist without democracy just because the existence of Parliament does not guarantee democracy. Therefore, there is no direct relationship or proportion between the system of government and democracy or the state of law. This paper aims to defend these claims from an optimistic perspective. The main purpose of this study is to question the necessity and applicability of the presidential system which has been continually discussed in Turkey and provide a better understanding of the criticisms of the presidential system and some reservations about it. In this context, in the framework of the advantages of the presidential system, both the disadvantages of the parliamentary system and the positive aspects of the presidential system have been examined by making a literature review as well as making a comparison with the other countries historically and systems of government. Moreover, this paper also contains about the views of the various authors by making an analysis in the conceptual dimension. This work consists of three parts: the first section primarily focuses on the necessity of the presidential system. In the second part, the applicability of the presidential system in our country is considered in detail. The criticisms of the presidential system and some reservations against it are given in the third part.
TÜRKİYE'NİN AVRUPA BİRLİĞİ'NE ÜYELİK SÜRECİNİN GÜMRÜK BİRLİĞİ BAĞLAMINDA DEĞERLENDİRİLMESİTarih boyunca çeşitli nedenlerle karşı karşıya gelen Türk ve Avrupalı devletler, birbirleriyle uzun yıllar süren sosyal ve ekonomik ilişkiler içerisinde bulunmuşlardır. Günümüzde bu sürecin temsilcisi olan Türkiye, farklı dine ve kültüre mensup olmasına rağmen Batının muassır medeniyetine ulaşmayı bir hedef olarak belirlemiştir. Nitekim Avrupalı devletlerin bir araya gelerek oluşturduğu Avrupa Birliği'nin bir parçası olmak için çaba göstermektedir. Bu amaçla 1959 yılında Avrupa Ekonomik Topluluğu'na Ortaklık başvurusu yapmış, 1963 yılında Ankara Antlaşması ile bu ilişkiyi resmileşmiştir. Bu durum Türkiye'nin iç ve dış politikasını değiştiren bir sürecin de başlangıcı olmuştur. Bu Antlaşma ile hazırlık, geçiş ve nihai aşamalar belirlenmiştir. Türkiye, tam üyeliğe giden yolun başlangıcı kabul edilen Gümrük Birliğine nihai aşamada dahil olmuştur. Türkiye'nin Avrupa Birliği süreci Gümrük Birliği bağlamında başlamıştır. Gümrük Birliğine üye olması ile birlikte Türkiye'nin dünya ticaretinde ve Birlik üyesi ülkelerle yaptığı ticarette önemli oranda artışlar meydana gelmiştir. Bu da Türkiye'nin ekonomisine olumlu yansımış ve Makroekonomik göstergelerinde pozitif etki oluşturmuştur. Ankara Antlaşması'nın nihai aşamasıyla birlikte AB Gümrük Birliği üyesi olan Türkiye, bu kapsamda birçok yasal ve kurumsal değişiklikler de gerçekleştirmiştir. Ayrıca mevzuata uyum çerçevesinde yaptığı değişikliklerle, AB üyeliği için şart koşulan birçok kriteri de yerine getirmiştir. Bu bağlamda gerek öncesi değişikler olsun ve gerekse dahil olduktan sonraki değişikler olsun; Gümrük Birliğinin Türkiye'nin Avrupa Birliği üyelik sürecine önemli katkılar sağladığı görülmektedir. Bununla birlikte, nihai amacı tam üyelik olan süreçte, geçen uzun süreye rağmen üyeliğin kısa vadede mümkün görünmemesi, Gümrük Birliğinin güncellenmesi gerekliliğini de ortaya çıkarmaktadır. Güncellenen Gümrük Birliğinin, Türkiye'nin Avrupa Birliği üyelik sürecinde sosyoekonomik kalkınmaya doğrudan ve dolaylı etkileri olacağı yapılan çalışmalarla ortaya çıkmaktadır. Güncelleme olması durumunda aynı zamanda 2005 yılında başlanan müzakere fasıllarının yerine getirilmesinde de önemli katkılar sağlayacağı görülmektedir. Bu bağlamda Gümrük Birliğinin ticari, mevzuata uyum ve güncellemeyle birlikte müzakerelerin yerine getirilmesinde ve tam üyelik sürecinde büyük etkileri olması ve katkılar sağlaması beklenmektedir. --- THE EVALUATION OF TURKEY'S EUROPEAN UNION MEMBERSHIP PROCESS IN THE CONTEXT OF THE CUSTOM UNIONTurkey and European countries have been engaged in social and economic relations for long years despite various challenges throughout history. Although Turkey homes various religions and cultures, it sets as a goal to reach West's modern civilization. And it has been exerting efforts to become part of European Union, founded by European states. For this purpose, Turkey applied for membership of the European Economic Community (EEC) in 1959, followed by Ankara Agreement in 1963 that put an official aspect into relations. This development has become beginning of an adventure that fully changed Turkey's domestic and foreign policies. With Ankara Agreement, preparation, transition and final stages were ascertained. In final stage of Ankara Agreement, Turkey was included in Customs Union with European Union (EU), a move considered to be starting path to full membership. Through this membership, Turkey achieved significant jumps in trade with European Union members and the world, which was positively reflected in its economy and brought positive impact on macroeconomic indications. Also, it actualized many legal and corporate changes. Through amendments in line with harmonization of legislations, Turkey implemented many criteria put forward for EU membership. In this regard, it is seen that Customs Union made key contributions into Turkey's EU accession. Also, the fact that Turkey's membership does not appear to be possible in the short term, despite the long period that is the ultimate objective of full EU membership, also reveals the necessity of modernizing the Customs Union. According to some studies, an modernized Customs Union will have direct and indirect impacts on socio-economic development during Turkey's EU accession. At the same time, this modernization is expected to make important contributions into fulfilling the negotiation chapters that started in 2005. In this study, through compliance with the commercial legislation and the modernization, the Customs Union is expected to have great impacts on and to contribute into implementation of negotiations and full membership.
Pek çok ülkeyi kökten etkileyecek bir dönüşüm yaratan neoliberalizmin kuruluşunda, hükümetler devlet güç ve imkanlarından etkin bir biçimde yararlanmışlardır. Diğer deyişle neoliberalizm, gerekli toplumsal ve ekonomik ilişkilerin kuruluşunda devlete kimi yeni işlevler yüklemiştir. Devletin bu yeni işlevlerinin kamu yönetiminde de etkileri söz konusudr. Dönüşüm süreci, Türkiye'de neoliberal politikaların başlangıcı olarak ele alınabilecek olan 24 Ocak Kararları başlamıştır. Neoliberalleşme sürecinde Türkiye'de de hükümetler devlet güç ve imkânları etkin bir biçimde kullanmışlardır. Bu süreçte kamu yönetimi neoliberalizmin inşasına uygun hale getirilerek Başbakanlık odağında yeniden teşkilatlandırılmıştır. Çalışma, neoliberalleşme sürecini yönetmek üzere merkezileştirilmiş bir idari yapının oluşumunu analiz etme amacını gütmektedir. Bu analizde kamu yönetiminin temel bilgi kaynakları olarak mevzuattan, kamu yönetimi literatüründen ve Türk siyasal hayatına dair kaynaklardan yararlanılmıştır. Çalışmanın ilk bölümünde merkezileşme sürecini siyasal bir bağlamda ele alan yazın üzerinde durulacaktır. İkinci bölümde neoliberalizm, devletin neoliberalizmin inşasındaki rolü ve Türk kamu yönetimi arasındaki ilişki incelenecektir. Son bölümde ise Türkiye'de gerçekleşen başbakanlık odaklı merkezileşme sürecini mümkün kılan araçlara yoğunlaşılacaktır. Kanun hükmünde kararnameler, bütçe dışı fonlar, ekonomi yönetiminin merkezileşmesi ve bürokrat tipolojisinin dönüşümü başlıklarıyla merkezileşmenin araçları analiz edilecektir. ; The governments establishing the neo-liberal social regimes, which caused a radical change that influenced most of the countries, widely wielded from the state power. Neo-liberalism, in other words, imposed new functions on the states in order to construct required social and economic relations. The new functions of the state also influenced the public administration. A transformation process began with the decisions of the Cabinet published on 25th January 1980 which can also be considered as the starting point of the implementation of neoliberal policies in Turkey. During the neo-liberalization process, similar to many other examples, the governments actively used the state power. In this process, in order to establish the neoliberalism, the administrative apparatus was adjusted, re-organized and centralized in the organization of Prime Ministry. This study aims to analyze the shaping of the centralized administration to direct the neo-liberalization process in Turkey. In this respect, the study made use of the main sources in the field of public administration which are legislation and regulations, the administration literature, as well as the field of Turkish political history. The first part gives a brief of the literature that analyzing the centralization process within a political frame and contributes to defining the administrative and political centralization within this context. The second part deals with the relations between neoliberalism, the role of the state power in establishing the neoliberal relations, and public administration. The last part focuses on the main means of the centralization process that the Prime Ministry was in the focal point. It analyzes the centralization mechanisms, namely, legislative decrees, extra-budgetary funds, the centralization of the decision-making process for economic policies, and transformation of bureaucrat typologies, in the neo-liberalization process.
Demokratik yönetim sisteminde, kuvvetler ayrılığı teorisi gereği, yönetim yetkilen yasama, yürütme ve yargı arasında paylaştırılmaktadır. Ancak parlamenter yönetim sisteminde yürütme yasamadan çıktığından yasamaya karşı sorumlu konumdadır ve bu nedenle yasama ve yargı organları tarafından denetlenmektedir. Fiili uygulamada ise yasama yürütmeyi denetlemede yetersiz kalmaktadır. Çünkü yürütmenin başı olan başbakan, mecliste çoğunluğu oluşturan parti veya partilerin lideri konumundadır. Dolayısıyla Montesquieu'nün kuvvetler ayrılığı ilkesinde öngörülen denetim, sadece meclisteki muhalefet partisi veya partileri tarafından yerine getirilebilmektedir. Muhalefetin mecliste azınlıkta olması, meclis denetimini zayıflatmaktadır. Çalışma bu nedenle muhalefete önem atfederek muhalefetin tanımını, sistem içinde oynadığı rolü ve muhalefetçe oluşturulan Gölge Kabine 'nin önemini analiz etmektedir. Çalışma, parlamenter yönetim sisteminde, hükümetin denetlenebilmesi için muhalefetin Gölge Kabine oluşturarak düzenli ve sürekli muhalefet etmesini önermektedir. Çalışma bu kapsamda muhalefetin tanımını, muhalefet etme yöntemlerini ve kapsamlı bir muhalefet örgütlenmesini irdelemektedir. Etkin denetim için muhalefetin "rekabetçi ve işbirliğine dayanan"politikalar uygulaması gerekmektedir. Muhalefetin "rekabetçi ve işbirliğine dayanan " politikalarla iktidara ciddi bir alternatif olduğunu ispatlaması gerekmektedir. Bu kapsamda, muhalefet bir taraftan hükümeti yapıcı politikalarla uyararak iktidar partisine oy vermiş seçmenlerin beğenisi alınmalı, diğer taraftan toplumsal sorunlara alternatif çözümler üreterek iktidara hazır olduğunu gösterilmelidir. ; The Power in the Parliamentary System of Government, which is a type of democratic system of government, is divided between legislation, execution and jurisdiction. Since execution is formed out of legislation in the Parliamentary System of Government, it is liable to the legislation and as a result it is checked by legislative and juridical institutions. But, in application, it can be set forth that the legislation is not competent enough to check the execution. One of the indications of incompetence is the fact that the Prime Minister is selected by the party or parties which have the majority of members in the parliament. Consequently, the mission of inspection which Montesquieu put forward in the principle of division of powers can only be fulfilled by the opposition party or parties in the parliament. But, since the opposition constitutes only the minority of the parliament, the legislative inspection gets weaker. This study analyzes the definition of the opposition by attributing emphasis on it, the role that it plays in the Parliamentary System of Government, the importance of the Shadow Cabinet in the context of opposing and methods that can be applied for inspection of the execution. The opposition should be formed as Shadow Cabinet in the Parliamentary System of Government in order that the execution can be inspected effectively. For this reason, this study explicates the definition of the opposition, the methods of opposing, and a comprehensive opposition organization. In addition, it is pointed out thai the opposition can inspect the Power and the ruling party through the Shadow Cabinet. After the parliamentary elections and the lines of parties in the parliament become clear, as a requirement of Parliamentary System of Government, while the ruling party or parties are forced to work with the Power, the opposition party or parties form the opposition front against the Power, the ruling party or parties in the parliament and their applications. The opposition party should form the Shadow Cabinet in order to inspect and obserye the cabinet more effectively. The inspection and control of the Power by the opposition in the democratic system of government is of great importance in tenns of stability of the political regime and even the guarantees the regime to be democratic. While shaping its policies, the opposition should comply with the secular and democratic rules of the game. After all, the constitutional spirit gives the Power and the opposition the mission of representing the public best in the pluralist democratic system of government and enables them to compete with each other within the democratic game rules. For his reason, an effective inspection and check of the Power by the opposition makes the cabinet stick to laws and minimizes the misuses in the administration. "Competitive and cooperative" policies should be applied in the opposing methods. Tlie concept of only "Strict competitive" or "Over compromising cooperative" opposition doesn't bring positive results. Furthermore, the opposition's "Strict competitive" or "Over compromising cooperative" policies are not encouraged by the public. For this reason, the opposition should prove that it is a serious alternative to the Power with its "competitive and cooperative "policies. In this context, the opposition should warn the Power with constructive policies, receive the appreciation of the people who voted for the ruling party and show that it is ready to be Power-by producing alternative solutions to the social problems. The opposition should try to have an image of a party having a high comprising culture by tolerating the suggestions made by the Power or at least by not rejecting them. The opposition should avoid having an intransigent party image. It should include the needs of the majority of voters in the party program and should develop policies in accordance with them. In addition to offering a successful opposition, experienced staff should be brought up. The opposition will only be able to convincingly show that it is ready to undertake execution and it is an alternative to the Power by training such staff For his reason, after the defeat in the election, the party which becomes the opposition should restructure itself with an emergency assembly and should not insist on the leaders who weren't selected by the public. As a result, the intra-party debates will be resolved sooner without harming the party and the party mil set off with its new leaders confidently. The party should be made to reach new masses in the context of restructuring, the policies constructed should be directed to inspect and check the Power and they should focus on winning the forthcoming election. For this reason, the opposition will need a professional team which will make its program and policies effective. This team is called "Shadow Cabinet" in the British Parliamentary System of Government. The missions of the members of the Shadow Cabinet will be equivalent to those of existing cabinet. The ministers of the Shadow Cabinet will check the actions and applications of the ministers of the actual cabinet and have an inspection over them and will criticize them when needed. Accordingly, the number of the members in the Shadow Cabinet is equal to that of actual cabinet. In addition, the members selected for the Shadow Cabinet should be skillful, they should be let to work actively till the end of the opposition period and with the experience they gain, they should be appointed as ministers of an actual cabinet upon a victory in the elections. As a result, the program of the Shadow Cabinet or the opposition party should alternate to the applications of the ruling party and it should convince the social base. The primary missions of the oppositions are shortly checking and inspecting the Power, trying to affect and direct the Power, developing relations with great masses of the society, overcoming deficiencies in the party program through the experiences gained, getting ready for the elections and getting ready to undertake execution in case of crisis.
AB SÜRECİNDE TÜRKİYE TARIMIAvrupa Birliği (AB); siyasi ve ekonomik anlamda uluslararası bir bütünleşmedir. Avrupa'da siyasi ve ekonomik bütünleşme Avrupa Ekonomik Topluluğu'nun (AET) kurulmasıyla başlamıştır. 1951 yılında kurulan Avrupa Kömür ve Çelik Birliği (CECA) bütünleşme yolunda atılmış ikinci adımdır. Ekonomik yönden birleşme fikrine yoğunlaşılması sonucunda 25 Mart 1957 tarihinde Avrupa Atom Enerjisi Topluluğu (EURATOM) kurulmuştur. Bu topluluklar AB'nin temelini oluşturmaktadır. 1 Ocak 1958 tarihinde kurucu altı ülke (Almanya, Fransa, İtalya, Belçika, Hollanda, Lüksemburg) tarafından imzalanarak yürürlüğe giren Roma Anlaşması ile Avrupa Ekonomik Topluluğu bugünkü adıyla Avrupa Birliği kurulmuştur. AB, Avrupa'da yaşanan savaşların tekrardan çıkmasını engellemek, ekonomi alanında yaşanan işsizlik sorunu çözmek, az gelişmiş bölgelerin kalkındırılması ve yaşam standartlarının yükseltilmeyi amaçlamaktadır.Avrupa Birliğinin İç politikalarının temeli, 'Serbest Piyasa Düzeni' oluşturmakla beraber birçok korumaya yönelik önlemler ve birlikte hareket etme prensibine önem verilmektir. Dış Politikaları ise, Topluluğun çıkarlarını temel almaktadır. Dış Politikalar; Ortak Tarım Politikaları, Ortak Ticaret Politikaları, Ortak Sanayi Politikaları ve Ortak Sosyal Politikalardan oluşmaktadır.Haziran 1993 tarihinde düzenlenen Kopenhag Zirvesinde, AB'ne üyelik koşulları belirlenmiştir. Bu koşullar üyelik için başvuran tüm aday ülkelerin yerine getirmesi gereken asgari koşullar olarak nitelendirilmektedir. Bu koşullar, siyasi, ekonomik kriterler ve müktesebat uyumu olmak üzere üç grupta toplanmaktadır.Türkiye AB ilişkileri 31 Temmuz 1959 tarihinde Türkiye'nin AETye ortaklık başvuru ile başlamıştır. Gümrük Birliği ve tam üyeliğe yönelik ilk adımlar 1 Aralık 1964 tarihinde yürürlüğe giren Ankara Antlaşması ile atılmıştır. Türkiye Avrupa Topluluğu (AT) ile 1963 yılında imzaladığı Ankara Anlaşması ve 1970 yılında imzalanan Katma Protokol ile; Topluluğa tam üyeliği amaçlanmakta ve taraflara bazı yükümlülükler getirilmektedir.Bu yükümlülüklerden birisi, Türkiye ile AT arasında emeğin serbest dolaşımı konusudur. Emeğin serbest dolaşımı konusu, Ankara Anlaşması ve Katma Protokol ile 1976-1986 tarihleri arasında aşamalı olarak gerçekleşmesi öngörülmüş olsa da bu durum AT tarafından kabul edilmemiştir. Türkiye AB' ne katılım süreci içerisindeki aday adayı ülke konumundan 1999'da düzenlenen Helsinki Zirvesi ile aday ülke konumuna geçmiştir. Ayrıca AB, bu süreçte Türkiye'nin diğer aday ülkelerle aynı şartlara sahip olacağını belirtmiştir.1923-1950 yılları arasında tarımsal KİT'ler kurulmuştur. Türkiye ekonomisinde 1960'lı yıllardan sonra planlı döneme geçilmiştir. 1960-1970 yılları arasında tarımsal girdi kullanımının teşviki ve sulama alanlarına yönelik yapılan yatırımlarla sağlanan verim artışı sonucunda destekleme alımları yapılmış ve desteklenen ürünlerin sayısı arttırılmıştır. Bu dönemde yaşanan sosyal ve siyasal istikrarsızlık, Kıbrıs Savaşı, petrol krizi ve döviz darboğazından dolayı ekonomide durgunluk yaşanmıştır. Bu gelişmeler sonucunda Hükümet önlemler almaya başlamış, 1978 yılında "istikrar programı "nı açıklamıştır. İstikrar programı içerisinde yer alan ve uygulanan önlemler; KİT açılarlını kapatmak amacıyla KİT ürünlerine zam yapılmış, ithalat zorlaştırılmış ve devalüasyon yapılmıştır. 1979 yılında uygulana yeni bir program ile KİT ürünlerine yönelik zam uygulamasına devam edilmiş, faiz oranları yükseltilmiş ve Türk Lirası yeniden devalüe edilmiştir. Enflasyona engel olunamamasından ve durgunluğun devam etmesinden dolayı 24 Ocak1980 Kararları alınmıştır. 1980 sonrası dönemde 24 Ocak 1980 Kararlarıyla; devletin tarım sektörüne sağladığı destek azalmıştır. Fiyat yoluyla desteklenen ürün sayısı, 1980 yılında 24 iken, 1981 yılında 20'ye, 1985 yılında 18'e,1990 yılında ise 10'a düşmüştür.
