This article aims to evaluate the institutional design of the political delegation that shapes The Brazilian Development Bank's (BNDES) financial activities. It employs a normative framework of administrative law, concerning the types of political delegation, and studies two of them: legality and discretion. Legal governance is a type of arrangement in which policy objectives are delegated by the Congress, while discretionary public governance policy objectives are defined in the Executive branch of government. Both types have different comparative advantages in governing policies. Whereas legality favors predictability and publicity, discretion enables flexibility and less political involvement. The main claim is that, due to Brazil's institutional environment, discretionary governance has proven advantageous. BNDES has been kept from the games of political and parliamentary clientele and it has suitable operational flexibility to act in times of economic crisis. However, this configuration also has costs, including financial agenda opacity and social accountability deficits. ; El objetivo de este artículo es evaluar el diseño institucional de la relación de delegación política establecida en las operaciones del BNDES. Para ello, se utiliza el derecho administrativo (como marco referencial) en relación a las formas de delegación política, y se abordan dos tipos de gobernanza: legal y discrecional. La gobernanza legal es un tipo de organización en la que los objetivos de política pública son delegados por el Congreso, mientras que en la gobernanza discrecional tales objetivos son definidos por el Ejecutivo. Los dos tipos presentan diferentes ventajas comparativas para guiar las políticas públicas. Mientras que la legalidad favorece la previsibilidad y la publicidad, la discrecionalidad implica mayor flexibilidad y menor participación política. El argumento central es que, por cuenta del entorno institucional brasileño, la gobernanza discrecional ha resultado ser ventajosa. El BNDES se ha protegido de los juegos clientelares político-parlamentarios, y ha garantizado flexibilidad operativa para actuar en tiempos de crisis económica. Por otra parte esta configuración también implica costos, tales como la relativa opacidad (una agenda financiera poco transparente) y un limitado control social. ; O objetivo do artigo é avaliar o desenho institucional da relação de delegação política estabelecida na atuação do BNDES. Para isso, utiliza o referencial normativo do direito administrativo, respeitante às formas de delegação política, e trabalha com dois tipos de governança dessa delegação: a legal e a discricionária. A governança legal representa um tipo de arranjo em que os objetivos de política são delegados pelo Congresso, ao passo que na governança discricionária os objetivos públicos são definidos no âmbito do Executivo. Ambos os tipos têm diferentes vantagens comparativas para governar políticas públicas. Enquanto a legalidade favorece a previsibilidade e a publicidade, a discricionariedade enseja maior flexibilidade e menor envolvimento parlamentar. O argumento desenvolvido é o de que, em razão do ambiente institucional brasileiro, a governança discricionária tem se mostrado vantajosa. O BNDES tem sido preservado dos jogos de clientela político-parlamentar e tem garantido uma flexibilidade operacional para atuar em momentos de crise econômica. The purpose of the article is to provide a theoretical basis for the application of judicial proceedings (judicializacao) in the foreign policy. The starting point is the classical conceptions of Locke & Montesquieu which conferred a great deal of discretion to the Executive for managing foreign relations, what was gradually counterbalanced by the Legislative & the Judiciary. Approaching the Brazilian literature on the expansion of judicial power to the politics & subsequent misrepresentations, the author tries to apply the concept to the foreign policy & analyses five cases of the Inter-American Court of Human Rights. The examination of the inserted nsumwinu (singular - Kasumwinu), in the lyrics of popular songs in the Democratic Republic of the Congo (DRC), reveals hidden roles that are both musical and linguistic. Musically, the compositional technique of the melodic contour is derived from the observation of the semantic level of the language represented by the sequential pattern of tones on words that compose the kasumwinu. A complexidade das relações sociais impõe o reconhecimento da impossibilidade de previsão de todas as situações fáticas passíveis de descrição na hipótese normativa "in abstracto". Nesse sentido, o legislador passou a empregar uma série de técnicas legislativas que, visto providas de substancial grau de indeterminabilidade, têm o poder de aumentar consideravelmente o alcance da norma jurídica. A tendência acima descrita tem especial repercussão nas relações jurídicas que envolvam o Estado. Nesses casos, atribui-se ao administrador público uma maior amplitude para a aplicação do direito (visto que não mais se faz por automática subsunção). No entanto, na mesma medida em que se dá a ampliação da atribuição de aplicar o direito ao caso concreto, exige-se uma maior responsabilidade ao atingimento da finalidade estabelecida na norma aplicada. Nesse quadro, é de se reconhecer que haverá casos aos quais a aplicação desse expediente utilizado pelo legislador não apresentará uma única resposta justa e razoável pelo direito. O resultado disso é a aproximação da atividade estatal, no caso, à competência discricionária. É necessário, todavia, que se identifiquem os limites que o Direito impõe à atividade administrativa no que concerne à sua aplicação, de forma que a Administração Pública não se utilize indevidamente do ordenamento com o escopo de mascarar arbitrariedade. Legal certainty is an essential value to the Democratic Rule of Law, presenting itself as a relevant principie for limiting powers in the performance of state functíons. lt can be understood in a double perspective, from an objective perspective, that is, it concerns the establíshment of limits to the retroactive effects of state decisions, whether in the administrative sphere or in the judicial sphere, from a subjective perspective, that is, linked to the protection of the perfect legal act, acquired right and res judicata. Still, in a subjective conception it can be understood regarding the protection of trust, that is, with regard to the stabilization of the decision-making process when interpreting and applying rules in the exercise of administrative activity. ln this scenario, indeterminate legal concepts and administrative discretion are highlighted, as techniques for solving the question posed in the specific case, which must observe the duty of consistency when making decisions. Thus, administrative precedents are evidenced as an instrument for amplifying legal certainty. This study, through research and bibliographic review, using the deductive method, aimed to analyze the principie of legitimate expectations, unveiling its effects on administrative activity. Resumo: O controle das políticas públicas, por parte dos tribunais de contas, sempre ensejou muitos debates jurídicos acerca de seus pressupostos e limites, principalmente, em razão de albergar um campo maior para o exercício da discricionariedade administrativa na definição de metas, diretrizes, prioridades e planos de governo para a consecução do interesse público. O exercício dessa importante atividade de controle não é o cerne do problema, considerando que no atual modelo de Estado de Direito não existem mais campos imunes à incidência do direito, o que inclui a própria política, em especial quando se estiver tratando de políticas públicas deficitárias, também chamadas de falhas estruturantes, decorrente do próprio estado de coisas. O mérito das discussões está na efetivação dessas intervenções e ativismos estruturais quando realizados de forma unilateral e antidialógica, sem a realização de um amplo debate democrático, com a utilização de instrumentos de controle consensuais, sob o viés da consequencialidade, oportunizando o alcance de bons resultados práticos e privilegiando o equilíbrio institucional próprio de um governo democrático e com poderes constitucionalmente separados. ; Abstract: The control of public policies by the courts of audit has always given way to countless legal debates regarding their assumptions and limits, mainly in order to encompass a larger field for the exercise of administrative discretion in the definition of goals, guidelines, priorities and government plans to attain the public interest. No presente artigo buscamos analisar a atuação do Ministério Público (MP) na área do direito à educação infantil pela via extrajudicial, por meio do Termo de Ajustamento de Conduta, a partir do estudo do caso do município de Telêmaco Borba (Paraná). Procuramos compreender de que modo a atuação da instituição incide na efetivação do direto à educação infantil nesse município. Entrevistamos os atores envolvidos no processo de firmamento e implementação dos Termos de Ajustamento de Conduta, triangulando tais dados com fontes documentais – referentes ao processo de firmamento dos termos e processos correlatos no âmbito do legislativo – e dados de atendimento na etapa. A partir de tais fontes, buscamos compreender as causas e efeitos do processo de judicialização da educação infantil ocorrido no município, entendida a judicialização como o deslocamento de questões usualmente debatidas pelos poderes eleitos para a esfera do sistema de justiça, incluída a seara extrajudicial. Os resultados apontam para tensionamentos entre poder público e Ministério Público, com interferências entre a discricionariedade da atuação do administrador e a ação da promotoria de justiça. Mais além, percebe-se ampliação da discussão em torno do acesso à etapa, denotando ampliação do entitlement da sociedade local em relação ao seu direito à educação infantil. ; In this article we intend to analyze the extrajudicial performance of the Public Prosecution's Office (PPO) regarding the right to early childhood education (ECE), through the Conduct Adjustment Terms (CATs), using the case of the municipality of Telêmaco Borba (Paraná). We seek to understand the ways in which the institution impacts the enforcement of the right to ECE in this municipality. We interviewed the stakeholedrs, who took part in the signing and implementation of the CATs, and analyze it along with enrollment data and documental sources – regarding the signing process and other related activities in the legislative branch. Using these sources, we try to understand causes and effects of the ECE judicialization process that took place in this town. We understand judicialization as the displacement of issues usually debated by elected officials to the justice system sphere, extrajudicial activities included. The results point to the intensification of disputes between the administration and the PPO, with alleged meddling between the administrative discretion and the activities of the justice prosecution. Moreover, we noticed the broadening of the discussion on the access to ECE, denoting the expansion of the entitlement of local citizens regarding their educational rights.
