The case of migrant construction workers from Bosnia and Herzegovina and Serbia working in Slovenia, fired in the name of the financial crisis, undoubtedly calls attention to the existence of systemic discrimination which is based on nationality.
Diskriminacija kao česta pojava na ovim prostorima jedan je od najozbiljnijih problema sa kojima se susreću pripadnici i pripadnice marginalizovanih grupa. Netolerantnost društva u kome živimo dodatno otežava proces borbe protiv nje. Sistemska rešenja državnih institucija po pitanju koncepta antidiskriminacije, godinama nisu postojala. Veliko zalaganje pojedinih nevladinih organizacija kao i usmerenost ka evropskim integracijama, doprineli su da tokom nekoliko poslednjih godina, pomalo stidljivo i diskretno koncept antidiskriminacije počne da se ugrađuje i u ciljeve i strategiju naše države. Inkluzivni pokret u svetu nastaje sredinom prošlog veka ključna ideja formulisana je još 1948. godine u Univerzalnoj dekleraciji o ljudskim pravima a zatim 1989 u Konvenciji o pravima deteta. Kasnije se ovaj okvir razrađuje u drugim dokumentima Ujedinjenih nacija i nizu drugih međunarodnih dokumenata, u kojima su formulisane strateske smernice i standardna pravila izjednačavanja položaja marginalizovanih i isključenih grupa, posebno u pogledu ostvarivanja prava na obrazovanje. ; Discrimination, which can frequently be seen in this region, is one of the most austere problems being faced by the members of both genders of marginalized groups. The intolerance of the society we live in additionally procrats the process of fighting against it. Systematic solutions from state institutions related to the concept of anti-discrimination have not existed for years. Great efforts from certain nongovernmental organizations as well as their focus on European integrations have contributed in the last couple of years to shy and discreet embedding of antidiscrimination concept into the goals and strategies of our country. The inclusive movement in the world originated in 1950s while the key idea was formulated as early as 1948 in the Universal Human Rights Declaration and then in 1989 in the Convention on Children's Rights. The Republic of Serbia has introduced special circumstances for the determination of sentence for hate crime in the Criminal Code amended in December 2012. If a criminal offence is committed through hate based on race or religion, national or ethnic affiliation, sex, sexual orientation or gender identity of another, the court shall consider any aggravating factors except when it is not stipulated as a feature of the criminal offence. However, the State still neglects to consider mitigating factors. Moreover, it does not pay sufficient attention to eliminating verbal expressions of hatred and discrimination that often precede crimes motivated by hate. The paper discusses the possibility of improving education and coordinated activities of the State, particularly of courts, prosecutors, police and local self-governments, to combat hate speech and hate crimes. The aim of the paper is to present mechanisms of improving institutional capacities to prevent these phenomena that have been implemented within the project "Implementation of Anti-Discrimination Policies in Serbia" financed by the European Union. The paper concludes that central to the success of this process are the education of state actors, and the development of a value system based on equality and acceptance of diversity.
Predmet ove disertacije je teorijska analiza regulatornog, komunikološkog, tehnološkog i socio-kulturnog okvira u kome nastaje i širi se "govor mržnje", kao i analiza sadržaja i analiza efekata govora mržnje u internet komunikaciji u Srbiji. Cilj disertacije bio je da preciznije definiše sadržaj govora mržnje i kontekst u kome on nastaje, da u odnosu na kulturološke specifičnosti Srbije preciznije utvrdi granicu između mere u kojoj je neophodno omogućiti nesmetanu slobodu izražavanja i ograničiti širenje govora mržnje. Osnovna hipoteza u ovom radu bila je da je koncept govora mržnje višeznačan i da njegovo razumevanje zavisi od geografskog, kulturnog i uopšte socijalnog konteksta u kome se on manifestuje. Govor mržnje na internetu negativno utiče na javnu komunikaciju te samim tim i na proces formiranja javne sfere. Budući da tako ometa kvalitetnu raspravu o problemima od društvenog značaja, govor mržnje otežava donošenje demokratskih odluka i na direktan način urušava demokratske vrednosti u društvu. U istraživanju je sprovedena komparativna analiza evropskih i nacionalnih pravnih akata u oblasti govora mržnje i slobode izražavanja, dat je kritički pregled ključnih međunarodnih naučnih studija i istraživanja govora mržnje na internetu, kao i institucionalna analiza postojećih mehanizama za suzbijanje govora mržnje. Pored toga sprovedena je analiza odabranih aktera i analiza sadržaja internet stranica na kojima je plasiran govor mržnje prema određenim manjinskim grupama u Srbiji. U istraživanju je identifikovan, opisana i problematizovan fenomen govora mržnje na internetu u kontekstu javne komunikacije u Srbiji. U definisanju samog pojma govora mržnje, kroz komparativnu analizu različitih izvora, uočeno je da njegovo identfikovanje zavisi od toga šta se u određenom društvenom, političkom i kulturnom konetkst smatra za osnovni problem koji želi da se reši ovakvim definicijama. Posebno je istaknuta razlika u shvatanju govora mržnje u različitim pravnim tradicijama u svetu. Pored toga, u široj 4 javnosti kao i u različitoj stručnoj literaturi često nije dovoljno dobro definisana jasna granica govora mržnje u odnosu na uvrede, klevete, negaciju nekih istorijskih događaja ili opravdavanje zločina, vređanje simbola, kritiku javnih ličnosti, različitih političkih stavova i religija. Nedovoljno jasna granica između dozvoljenog i potencijalno zabranjenog izražavanja dovodi do nesporazuma i neefikasne borbe protiv govora mržnje koji bi potencijalno mogao da izazove ozbiljne negativne posledice. Oštra kritika nekog pojedinca ili neke grupe veoma lako može biti protumačena kao govor mržnje, a takav pristup zapravo zatvara prostor za diskusiju o nekom problemu i na direktan način sputava slobodu izražavanja, te ugrožava deliberativan proces u demokratskom društvu. ; The topic of this dissertation is the theoretical analysis of the regulatory, communication, technological and socio-cultural framework in which the "hate speech" is being developed, as well as analysis of the content and analysis of the effects of hate speech in online communication in Serbia. The aim of the dissertation was to more precisely define the content of hate speech and the context in which it arises, and in relation to the cultural specifics of Serbia, more precisely determines the boundary between the measure in which it is necessary to provide unhindered freedom of expression and limit the spread of hate speech. The main hypothesis in this work was that the concept of hate speech is multidimensional and that its understanding depends on the geographical, cultural and general social context in which it manifests itself. Hate speech online has a negative impact on public communication and, consequently, on the process of forming a public sphere. Since it hinders the quality debate on the problems of social coercion, hate speech makes it difficult to make democratic decisions and directly undermines the stability of democratic values in society. The study has conducted a comparative and normative analysis of European and national legal acts in the field of hate speech and freedom of expression, as well as other international scientific studies and research in order to better understand the problem of hate speech online, as well as institutional analysis of existing mechanisms for combating hate speech. In addition, an analysis of selected actors of hate speech was conducted through an analysis of the content of the websites where hate speech was addressed to certain minority groups in Serbia. The research described the phenomenon of hate speech online as a complex phenomenon needed to be analysed from several angles to show more clearly all the problems and all the challenges of its precise definition. In defining the notion of hate speech itself, through a 8 comparative analysis of various sources, it is noted that it depends on what is considered to be a basic problem which particular country wants to solve with such definitions. There is a particular difference in understanding of the hate speech in various international legal traditions. In general public, as in various professional literatures, the definition of hate speech is often not clear enough in relation to insults, defamation, denial of some historical events or justification of crimes, insulting symbols, and criticism of public figures, political affiliations and religions. The insufficiently clear boundary between permitted and potentially prohibited expression leads to misunderstandings and ineffective fight against hate speech that could potentially cause serious negative consequences. A sharp critique of an individual or of a group can easily be interpreted as hate speech, and such an approach actually closes the space for discussion and directly suppresses freedom of expression and endangers the deliberative process in a democratic society.
The impact of 'glass ceiling' syndrome and party selection on participation of women in parliament and other political institutions are examined in this article. 'Glass ceiling' syndrome, which means invisible, but almost impenetrable border that women face in professional life, keeping them away from positions of influence and progress in career, is the main reason for the small number of women involved in politics. According to the focus of the research, there are three groups of barriers to women's political participation. Most researchers examine the influence of the political system, institutional and legal mechanisms, the question of their transparency and functional improvement. Significantly less frequent approach came from authors who are concentrated on the social and economic barriers, financial conditions and the broader social context. The third group consists of those who are considering the ideological and psychological barriers, patriarchal cultural patterns, traditional gender roles, self-confidence, ambition and women's desire to be involved in politics. Political parties are key actors in the process of discrimination against women, because they do not allow them to be selected in a number of political functions. There are many factors that determine that the issue of gender equality is variously interpreted in political parties. The most present are contextual and ideological factors, referring to a different definition of the status of women on the political agenda, the social climate in terms of gender equality and respect for human rights, the level of social development and political freedom. Then come organizational factors pertaining to the structure of parties, the manner in which the leadership is elected, whether there are internal women's pressure groups and lobbying, and are women leaders are visible on high positions in decision-making process. Finally, there are institutional-legal factors, which include the type of electoral system, the legal and constitutional framework and the prescribed quotas on national and / or party level.

Prema definiciji Interseks zajednice Severne Amerike, pojam interseks koristi se za osobe rođene sa hormonskim, hromozomskim ili anatomskim polnim obrascima koji ne odgovaraju društvenim i medicinskim očekivanjima muških ili ženskih polnih karakteristika. Između 0,05 i 1,7% stanovništva rađa se sa nekim od interseks stanja koji imaju veliki broj oblika. Standardna medicinska procedura postupanja sa interseksualnim licima podrazumeva postupak normalizacije pola, odnosno korektivne genitalne hirurške intervencije i horomonsku terapiju, sa ciljem da definiše polne organe u skladu sa jednim od dva priznata pola i odgovori na opresivne zahteve heteronormativnosti u kojoj je interseksualno telo devijacija od "normalne telesnosti". Rasprave o interseksualnosti posebno su aktualizovane na polju bioetike kroz radove E. Feder i A. Dreger. Uvidom u određeni broj teorijskih i empirijskih radova na temu interseksulanosti u oblasti obrazovanja, zaključujemo da je njihova zastupljenost zanemarljiva. Cilj rada bio je da se, pošavši od konceptualnog okvira kvir studija kao analitičkog modela koji locira i eksploatiše nekoherentnost hromozomskog pola, roda i seksualne želje, formulišu smernice za unapređivanje obrazovnog zakonodavstva i obrazovne prakse kojima se na bolji način reguliše status interseks dece i mladih. Osnovu za teorijsku analizu predstavljali su rezultati studije "Interseks – ka stvaranju intersekcionalne platforme" organizacije Geten LGBTIQA iz 2019. godine čiji se globalni zaključak tiče pravne nevidljivosti interseks lica u Srbiji koju prati patologizujući medicinski diskurs. Na osnovu naše možemo zaključiti da je neophodno unaprediti obrazovne politike i prakse koje prepoznajemo i kao ključne predlažemo: vidljivost interseksualnih lica u obrazovnoj legislaturi počevši od predškolskog obrazovanja, informisanje aktera školskog života o stanju interseksualnosti i njegovim varijacijama, prevencija nasilja i diskriminacije prema interseks deci i mladima, ohrabrivanje prava interseks dece i mladih na samoodređenje. Ističe se potreba za osmišljavanjem i sprovođenjem kvalitativnih pedagoških istraživanja intreseksualnosti iz dečje perspektive koja mogu destabilizovati normativni diskurs polnosti/telesnosti i depatologizovati interseksualnost. Inkorporiranost zahteva iz dokumenta Promišljanje obrazovanja: ka zajedničkom globalnom dobru (UNESCO, 2015) vidimo kao dobru startnu osnovu za građenje nacrta obrazovne politike koja se temelji na humanističkim nasuprot utilitarističkim vrednostima. ; According to definition of the Intersex Society of North America, the term intersex is used to refer to persons born with hormonal, chromosomal or anatomical gender patterns which do not correspond with social and medical concepts of male or female gender characteristics. Between 0.05% and 1.7% of the population is born with an intersex condition that may take numerous forms. The standard medical procedure for dealing with intersex persons involves the gender normalizing procedure, i.e. corrective genital surgery and hormone therapy whose aim is to define sexual organs according to one of the two recognized genders and respond to oppressive demands of heteronormativity in which intersex body is a deviation from a "normal corporeality". Discussions about intersexuality have been particularly topical in the field of bioethics through the works of E. Feder and A. Dreger. By examining a number of theoretical and empirical papers on intersexuality in the field of education, we conclude that their representation is meagre. The aim of the paper is, starting from the conceptual framework of queer studies as analytical model that locates and exploits the incoherence of chromosomal sex, gender and sexual desire, to formulate guidelines for improvement of education legislation and practice so as to regulate the status of intersex children and young people better. The starting point for theoretical analysis is the result of the 2019 Geten LGBTIQA study: "Intersex – Towards Building an Intersectional Platform" whose global conclusion concerns the legal invisibility of the intersex persons in Serbia, followed by pathologizing medical discourse. Upon our analysis, we can conclude that it is necessary to improve educational policies and practices. The key improvements we propose are the following: visibility of intersex persons in education legislation starting from the pre-school education, informing the participants of school life about the state of intersexuality and its variations, prevention of violence and discrimination against intersex children and youth, encouraging the right of intersex children and young people to self-determination. The need to design and conduct qualitative pedagogic researches of intersexuality from the children's perspective that can destabilize normative discourse of sexuality/corporeality and depatologize intersexuality is emphasized. Inclusion of requirements from the document: Rethinking education: towards a common global good (UNESCO, 2015) is perceived as a good starting point for creating a draft of education policy which is based on humanistic and not utilitarian values. ; Zbornik rezimea / 24. This paper deals with a critical discourse analysis (CDA) of pre-election TV commercials inthe last two campaigns of 2012 and of 2014 in Serbia. The aim of the research is to deconstruct thestrategy of political parties in the field of gender sensitization from a gender perspective based onthe most important activity of parliamentary democracy – the election cycle, using examples ofpaid political advertising – the pre-election TV clip, for which the parties allocated the most resourcesin the campaign of 2012 and of 2014 in Serbia. The aim is also to analyze the personalexperience of female politicians in order to provide a new and different way of analyzing practicesand strategies of the parties in relation to the visibility of female candidate in the mediaduring the election campaign.The basic method is the critical discourse analysis (CDA) complemented by the method ofcomparing the regular election campaign of 2012 and the early elections of 2014, and the methodof life stories of the candidates (oral history). The CDA puts a special emphasis on various forms of discrimination that result from the abuse of power that continues to lead to the emergence ofsocial inequality and injustice (Dijk 2008).There are three levels at which the (in)visibility of women in the political process can be observed:a) the (lack of) presence of women on the candidate lists in the election campaign, andafter the elections, the (decreased) number of women in the parliament; b) (in)visibility of womenin paid media campaigns and c) (in)visibility of women in the language.Practice: a) On the basis of the "principle of affirmative action", women become more presenton the candidate lists and in the parliament as a result of the introduction of quota into the gendersensitive legislation (all SEE countries – Southeast Europe/Western Balkans). b) Women are stillrarely seen in the pre-election TV clip which is the most effective paid advertising, because it is atraditionally male "space", while women are more active in reach-out field work. c) visibility ofwomen in language is achieved, for example, by the use of the Gender-sensitive language Code.(S. Savić).In this paper the focus is on the sub-paragraphs (a) and (b), with (c) being analyzed in a limitedmanner only as part of the pre-election TV clip slogans analysis.A TV clip is comprised of: the slogan and the body of the clip. The slogan is made of aniconic and a linguistic part. In both campaign slogans there were no gender sensitive slogans,except for one in 2014 (URS's campaign for the female Mayor of Belgrade). The body is made ofthe video format and the content. In both campaigns, in 2012 and in 2014 forms of videos werehybrid types that included: documentary footage from the field, speech of the leader speakingdirectly in camera, animation, short fiction form.The analysis confirmed the basic hypothesis: despite the fact that, according to the legal provisionsa female candidate occupied every third position of the candidate lists in both analyzedelection cycles – they are underrepresented in paid political advertising in the media (TV clip).Individual hypotheses are also confirmed.The icons and the contents of the presentation of Serbia in the election cycle in 2012 and in2014 in the election TV clips were masculinized from the standpoint of power in society that isheld by male party leaders. The basic strategy of all parties who had a paid television campaign,in a form of TV clips, in both observed election cycles was the strategy of exclusion from thepolitical space mediated by the media. So we are here talking about a media, and by that, a widersocial invisibility of women in exercising one of the fundamental rights, the right to participationin decision-making and active participation in the elections. ; Cilj rada je da dekonstruiše strategije političkih partija iz rodne perspective u odnosu natelevizijsko predizborno političko plaćeno oglašavanje u kampanjama 2012. i 2014. u Srbiji.Cilj je takođe da se analizira lično iskustvo političarki da bi se na nov i drugačiji način analizirale prakse i strategije partija u odnosu na vidljivost kandidatkinja u vreme predizborne kampanjeu medijima. Metode korišćene u istraživanju su: kritička analiza medijskog diskursa(jedinica analize je tv spot u celini, verbalna, vizuelna i zvučna komponenta), komparativnametoda i životne priče kandidatkinja. Osnovna hipoteza je da bez obzira na to što su, shodnozakonskim odredbama, na kandidatskim listama, u oba analizirana izborna ciklusa, ženezauzimale svako treće mesto – one su podzastupljene u plaćenom političkom medijskom reklamiranju(TV spotu). Osnovni rezultat je da su medijske plaćene kampanje bile maskulinizirane.U fokusu je samo partijski lider. Kandidatkinje su podzastupljene u oba posmatranaperioda. Partije nisu rodno senzibilisane kada je reč o političkom plaćenom oglašavanju uvreme predizborne kampanje.
Doktorska disertacija nastoji da objasni rezultate višestranačkih parlamentarnih izbora u Srbiji od 1990. godine do prve mirne smene vlasti 2000. godine sa stanovišta informisanosti publike o izbornim opcijama. U njoj je potvrđena generalna hipoteza da su informativni televizijski programi o izborima za Skupštinu Srbije tokom 1990-tih godina onemogućavali slobodnu i poštenu utakmicu izbornih rivala. Umesto da biračima ponude adekvatne informacije kao osnovu za racionalan izbor, oni su sistematski favorizovali jednog izbornog učesnika u odnosu na druge. U radu se utvrđuju glavne medijske strategije uticaja na mišljenje birača na osnovu empirijske analize televizijske prezentacije izbora u periodu 1990-2000. godina. Kvantitativno-kvalitativna analiza sadržaja obuhvata redovne informativne programe i specijalizovane izborne programe proizvedene tokom kampanje za izbore za Skupštinu Srbije 1990, 1992, 1993, 1997. i 2000. godine. Analiza je fokusirana na utvrđivanje centralne strategije medijske prezentacije izbora u svakom pojedinačnom ciklusu, identifikovanje slike društvene i političke realnosti kao konteksta u koji se smeštaju informacije o aktivnostima izbornih učesnika, utvrdjivanje glavne teme-dileme izborne kampanje u odnosu na koju se pozicioniraju izborni učesnici i utvrđivanje televizijskih imidža glavnih izbornih rivala. Analizi medijske slike izbora prethodi razmatranje političkog, pravnog i medijskog konteksta u kome su izbori održani. Analiza je potvrdila radne hipoteze da je izborno izveštavanje državne televizije RTS (RTB) od 1990. do 2000. godine podsticalo biračku podršku za vladajuću stranku – Socijalističku partiju Srbije (SPS) ili njenu koaliciju – sistematskom diskriminacijom njenih izbornih rivala; da su specijalizovani izborni programi državne televizije favorizovali interese vladajuće partije SPS ili njene koalicije u odnosu na interese drugih izbornih učesnika i favorizovali interese izbornih učesnika u odnosu na interese birača; i da je redovno TV izveštavanje o aktuelnim neizbornim događajima omogućavalo da izborne poruke jednog izbornog učesnika budu lakše prihvatljive za birače od poruka njegovih izbornih rivala. Način na koji je izveštavanje o izborima kontekstuirano u specifičnu sliku neizbornih događaja identifikovan je kao ključna dugoročna strategija uticaja na birače, zajedno sa medijskim definisanjem smisla izbora u skladu sa interesima jednog izborno učesnika - poželjnog izbornog pobednika. Doktorska disertacija je potvrdila teorijsku hipotezu da kulturološke studije nude pogodnu teorijsku i analitičku osnovu za istraživanje uloge medija u izbornoj komunikaciji u Srbiji tokom 1990-tih godina. ; The doctoral thesis aims to explain the results of multiparty parliamentary elections in Serbia from 1990 until the first peaceful change in power in 2000 from the standpoint of information about election options available to voters. The thesis confirms a general hypothesis that the information TV programs about elections for the Parliament of Serbia during the 1990-ies prevented a free and fair competition of election rivals. Instead of offering adequate information to voters as a basis for a rational choice, TV programs systematically favored one election participant over others. The thesis identifies the main media strategies of influencing the opinion of voters on the basis of empirical analysis of television presentation of elections in the period 1990-2000. The quantitative-qualitative content analysis is applied to regular news programs and specialized electoral broadcasts produced during campaigns for elections for the Parliament of Serbia in 1990, 1992, 1993, 1997 and 2000. The analysis is focused on identifying the central strategy of the media presentation in each election cycle, the picture of social and political reality as a context for the information on activities of election participants, the main issue of the election campaign and TV images of the main election rivals. The analysis of the media picture of the elections is preceded by a review of political, legal and media context in which the elections took place. The analysis confirmed the working hypothesis that the election coverage of the state television RTS (RTB) from 1990 until 2000 mobilized the voters' support for the ruling party – Socialist Party of Serbia (SPS) or its coalition – by a systematic discrimination of its election rivals; that the specialized programs of the state television favored the interests of the ruling party SPS or its coalition in comparison to interests of other election contestants as well as the interests of election participants over the interests of voters; and that the regular Serbian television news reporting about non-election events made the messages of one election participant more easily acceptable by voters than the messages of other contestants. The way the coverage of election events was placed into a specific picture of non-election events is identified as the key long-term strategy for influencing the voters' decision, together with the media definition of the meaning of the election which was in accord with the interests of one election participant – the preferred election winner. The thesis confirmed a theoretical hypothesis that cultural studies offer a convenient theoretical and analytical basis for studying the role of the media in election communication in Serbia during the 1990's.
