India's 'Representation of the People Act, 1951' (RPA), includes two provisions that restrict certain categories of electoral speech. The first such provision is Section 123 (3) of the RPA which restricts electoral appeals made by political representatives on ethnic or religious grounds while the second is Section 123 (3A) of the RPA which prohibits the promotion of enmity or hatred by political representatives between different classes of citizens. This paper examines the impact of these restrictions on political representation in India and its effects on competing democratic constitutional values. Our examination finds that the restrictions on identity-based appeals fail to optimally balance competing democratic values, and this adversely affects Indian democracy. The paper finally makes a case for redrawing the contours of the restrictions placed by Sections 123 (3) and 123 (3A) on Indian electoral speech so as to best strengthen Indian democracy.

In his 1999 article, Libman v. Quebec (A.G.) and the Administration of the Process of Democracy under the Charter: The Emerging Egalitarian Model, Colin Feasby suggests that the Supreme Court of Canada endorsed an egalitarian approach to democratic participation and the regulation of electoral speech. More specifically, Feasby argues that the Court has adopted a model that draws from the philosophy of John Rawls; in particular, his supposedly egalitarian idea of the fair value of the equal political liberties. In this article, I critically examine this egalitarian thesis in the context of the Court's more recent 2004 decisions in Harper v. Canada (Attorney General). While I agree that the Court has adopted an approach similar to the philosophy of John Rawls, I nevertheless reject the conclusion that this is an egalitarian model of democratic participation. Instead, I argue that both Rawls and the Court may be more clearly understood as endorsing a liberal fair opportunity model of elections. This liberal model rejects the egalitarian ideal that all citizens are to enjoy equality of influence in political decision making. The focus, instead, is on the liberal ideal of procedural fairness, and ensuring that all citizens have an equal opportunity or chance to influence political outcomes.

AbstractThis paper contributes to the study of social change by considering boundary work as a dimension of cultural change. Drawing on the computer‐assisted qualitative analysis of 73 formal speeches made by Donald Trump during the 2016 electoral campaign, we argue that his political rhetoric, which led to his presidential victory, addressed the white working class's concern with their declining position in the national pecking order. He addressed this group's concern by raising their moral status, that is, by (1) emphatically describing them as hard‐working Americans who are victims of globalization; (2) voicing their concerns about 'people above' (professionals, the rich, and politicians); (3) drawing strong moral boundaries toward undocumented immigrants, refugees, and Muslims; (4) presenting African Americans and (legal) Hispanic Americans as workers who also deserve jobs; (5) stressing the role of working‐class men as protectors of women and LGBTQ people. This particular case study of the role of boundary work in political rhetoric provides a novel, distinctively sociological approach for capturing dynamics of social change.

Nicolás Maduro ha sido el ganador de las elecciones presidenciales de mayo de 2018 en Venezuela, un proceso electoral marcado por un bajo nivel de participación y el desconocimiento de los resultados por la oposición y gran parte de la comunidad internacional. Siguiendo el paradigma teórico-metodológico del análisis crítico del discurso, en este artículo se analizan los discursos de Nicolás Maduro durante la campaña electoral, a fin de identificar en ellos sus características y las estrategias de resistencia al discurso dominante que sobre Venezuela se ha configurado en el escenario internacional. Los resultados revelan un enfoque positivo, centrado en la esperanza y en el futuro más que en desprestigiar a sus adversarios políticos, pero sin desvincularse del legado chavista. ; Nicolás Maduro was the winner of the presidential elections in May 2018 in Venezuela, an electoral process marked by a low level of participation and ignorance of the results by the opposition and a large part of the international community. Following the theoretical-methodological paradigm of the critical analysis of discourse, this article analyzes Nicolas Maduro's discourses during the electoral campaign, in order to identify their characteristics and the strategies of resistance to the dominant discourse that has been configured about Venezuela in the international scene. The results reveal a positive approach, focused on hope and the future rather than discrediting its political adversaries, but without disassociating itself from the chavista legacy. ; Nicolás Maduro foi o vencedor das eleições presidenciais de maio de 2018 na Venezuela, um processo eleitoral marcado por um baixo nível de participação e desconhecimento dos resultados da oposição e de grande parte da comunidade internacional. AbstractThe article examines the role of verbal and paraverbal means in conveying critical evaluation, based upon electoralspeeches of German and Ukrainian politicians. The paper contains an overview of the types, forms and functionsof criticism in political discourse. The study highlights the linguistic and, in a narrower context, discursive contrastsdetectable in German and Ukrainian political criticism. Furthermore, the kinetic means of highlighting criticalstatements in the electoral debates under analysis are specified.RésuméThe article represents a discursive study of verbal and paraverbal means of conveying criticalassessment based on electoral speeches of German and Ukrainian politicians. The paper containsan overview of the types, forms and functions of criticism in political discourse. The study highlightsthe linguistic and, in a narrower context, discursive contrasts detectable in German and Ukrainianpolitical criticism. Through the identification experiment, 500 critical discourse fragments were singledout in German and Ukrainian, containing 340 relevant co-speech gestures supporting critical utterancesin the two languages; they were analyzed in terms of the types of co-speech gesture, hand shape, palmorientation, movement direction, and movement trajectory. The study reveals that the Ukrainianpoliticians are more emotional in electoral debates and support their critical assessments with impulsiveco-speech gestures using one or both hands, nods, body movements and pointing the index fingerdirectly at their opponent. At the same time, the German politicians display a calmer paraverbalbehaviour, attaching more importance to the verbal component of the critical assessment. Suchdifferences can be explained by the cultural traditions of political criticism in Germany and Ukraine:they depend on the mental and cultural characteristics of politicians, their motivational guidelinesfor critical rhetoric as well as on the personal rhetorical competence of the speaker, the degreeof eloquence of his/her speech, etc. ; У статті представлено дослідження вербальних і паравербальних засобів критичної оцінкина матеріалі передвиборчих промов німецьких та українських політиків. Описано види, формиі функції критики в політичному дискурсі. This article examines the effects of committee specialization and district characteristics on speech participation by topic and congressional forum. It argues that committee specialization should increase speech participation during legislative debates, while district characteristics should affect the likelihood of speech participation in non-lawmaking forums. To examine these expectations, we analyze over 100,000 speeches delivered in the Chilean Chamber of Deputies between 1990 and 2018. To carry out our topic classification task, we utilize the recently developed state-of-the-art multilingual Transformer model XLM-RoBERTa. Consistent with informational theories, we find that committee specialization is a significant predictor of speech participation in legislative debates. In addition, consistent with theories purporting that legislative speech serves as a vehicle for the electoral connection, we find that district characteristics have a significant effect on speech participation in non-lawmaking forums.
