La tesi di dottorato di Bruno Brancati concerne il ruolo delle corti nella crisi economica europea, con particolare attenzione alle decisioni relative ai diritti sociali. La tesi principale della ricerca è che, in questo particolare momento, il diritto pubblico europeo richiede un'espansione del ruolo delle corti. Infatti, l'autorità del diritto in Europa è in crisi, perché i confini tra i poteri nazionali e sovranazionali sono incerti. Questo contesto richiede un'espansione della "cultura della giustificazione". "Cultura dell'autorità" e "cultura della giustificazione" sono entrambe necessarie. La prima si concentra sull'autorizzazione ad agire dei vari attori. La seconda si concentra sulle ragioni sostanziali delle decisioni. Quando l' "autorità" è in crisi, l'espansione della "cultura della giustificazione" diventa molto importante, ed anche il ruolo delle corti. La "giurisdizionalizzazione" della crisi economica è un fatto, come dimostrano decisioni quali quella sull'ESM e il Fiscal Compact del Tribunale costituzionale tedesco (settembre 2012) o la decisione n. 187 del 2013 del Tribunale costituzionale portoghese, vertente su alcune misure di austerità. Il primo capitolo della ricerca spiega la tesi principale e la struttura del lavoro. Nel secondo capitolo è illustrata la prospettiva dei "conflitti d'autorità". Il costituzionalismo democratico nazionale e il diritto sovranazionale condividono un orizzonte ideale, ma nella storia della loro relazione è possibile distinguere due fasi: quella della "divergenza" e quella della "convergenza". Il diritto nazionale e quello sovranazionale si sovrappongono, e questa sovrapposizione innesca conflitti, perché essi sono diventati simili, ma non identici. Casi come Viking e Laval sono emblema di un importante conflitto tra queste due sfere. Nel terzo capitolo si può vedere che il livello nazionale e quello sovranazionale si intrecciano nella governance economica e finanziaria. Lo spazio per le valutazioni discrezionali in quest'area incrementa le incertezze dei confini tra i due livelli. Nel quarto capitolo, viene presentato il ruolo del rinvio pregiudiziale alla Corte di Giustizia dell'Unione europea nella prospettiva dei "conflitti d'autorità" e viene considerato il caso OMT. Poi, il capitolo si concentra sui rapporti tra diritto nazionale e diritto sovranazionale nelle "giurisprudenze costituzionali della crisi" portoghese e italiana. Nel quinto capitolo sono stati presentati alcuni argomenti classici, usati contro la giurisdizionalizzazione dei diritti sociali: legittimazione democratica, policentricità, expertise, flessibilità. Le relazioni tra il giudice ed il legislatore in quest'area sono spesso problematiche ed il controllo di proporzionalità può essere molto utile da questo punto di vista. Esso può rispettare la sfera legislativa, ma può anche essere molto pervasivo. Nel sesto capitolo, sono considerati alcuni modi di fare uso del controllo di proporzionalità nella giurisprudenza costituzionale della crisi italiana e portoghese. Le due Corti costituzionali si sono confrontate con la questione dell'equa distribuzione dei sacrifici, ma non sono state sempre persuasive. In altre decisioni, la mancata ricezione di adeguate giustificazioni del sacrificio di un diritto ha giocato un ruolo importante. Allocando l' "onere della giustificazione" sul legislatore, il giudice riconosce i suoi deficit, ma svolge anche un controllo molto efficace. Il settimo capitolo si concentra sulla limitazione degli effetti delle decisioni di incostituzionalità. Questa tecnica è molto utile, a causa della policentricità dei casi riguardanti l'allocazione delle risorse. Sia la Corte costituzionale italiana che il Tribunale costituzionale portoghese sono stati criticati per l'uso di questa tecnica. Inoltre, la giurisprudenza della crisi fornisce un'altra indicazione: il giudice può essere molto efficace se le sue decisioni sono pronunciate subito dopo l'adozione della misura. L'ottavo capitolo contiene le conclusioni del lavoro. La crisi mette alla prova le costituzioni, e le costituzioni appaiono "minimalizzate". Esse riescono a limitare la durezza della politica di austerità, ma non possono stravolgerla. Esse potrebbero perfino legittimarla, addomesticandola. Nella giurisprudenza della crisi, le corti corrono il rischio di perdere la propria legittimazione. La proporzionalità è una tecnica che può enfatizzare la discrezionalità del giudice. L'allocazione di un onere di giustificazione sul legislatore può limitarla, senza eliminarla. La limitazione degli effetti temporali della decisione comporta il rischio di politicizzazione del giudice, ma questa tecnica è molto utile in tempo di crisi, perché consente al giudice di adottare un' "etica della responsabilità". Tuttavia, l'adozione di una tale etica deve rispettare le regole che disciplinano il processo davanti alla corte costituzionale e deve essere controllata da un rigoroso ragionamento giuridico. Bruno Brancati's Phd thesis concerns the role of courts in the European economic crisis, with particular attention paid to decisions related to social rights. The main claim of the research is that, in this particular moment, European public law requires an expansion of the role of courts. In fact, the authority of law in Europe is in crisis, because the boundaries between national and supranational powers are uncertain. This context requires an expansion of the "culture of justification". "Culture of authority" and "culture of justification" are both necessary. The first one focuses on the authorization to act of the various actors. The second one focuses on the substantive reasons in support of the decisions to be taken. When the "authority" is in crisis, the expansion of the "culture of justification" becomes very important, and the role of the courts too. The "judicialization" of the economic crisis is a fact. Decisions such as the one about ESM and Fiscal Compact of the German Constitutional Court (September 2012) or decision n. 187/2013 of the Portuguese Constitutional Court, about austerity measures, demonstrate that. The first chapter of the research explains the main claim and the structure of the work. In the second chapter the perspective of the "conflicts of authority" is illustrated. National democratic constitutionalism and supranational law share an ideal horizon, but in the history of their relationship it is possible to distinguish two phases: a phase of "divergence" and a phase of "convergence". The national law and the supranational one overlap, and this overlapping triggers conflicts, because they have become similar, but not identical. Cases such as Viking and Laval are emblematic of an important conflict between these two spheres. In the third chapter one can see that the national level and the supranational one interweave in the economic and financial governance. The space for discretionary evaluations in this area increases the uncertainties of the boundaries between the two levels. In the fourth chapter, the role of the preliminary ruling question sent to CJEU is presented in the perspective of the "conflicts of authority" and the OMT case is considered. Then, this chapter focuses on the relationships between national law and supranational one in the Portuguese and Italian "crisis constitutional case law". In the fifth chapter, some classical arguments, used against the judicialization of social rights, are presented: democratic legitimacy, polycentricity, expertise, flexibility. The relationships between the judge and the legislature in this area are often problematic and proportionality review can be very useful in this respect. It can respect the legislative sphere, but can also be very pervasive. In the sixth chapter, some ways of making use of proportionality review in the Portuguese and Italian crisis constitutional case law are considered. The two Constitutional Courts have faced the issue of the fair distribution of sacrifices, but they have not always been persuasive. In other decisions the failure to receive adequate justification of a sacrifice of a right played an important role. By allocating the "burden of justification" to the legislature,, the judge recognizes its deficits, but also plays a very effective control. The seventh chapter focuses on the limitation of the effects of the decisions of unconstitutionality. This technique is very useful, because of the polycentricity of the cases regarding the allocation of resources. Both the Portuguese and the Italian Constitutional Courts have been criticized because of the use of this technique. Then, the crisis case law provides another insight: the judge can be very effective if its decisions are delivered soon after the adoption of the measure. The eighth chapter contains the conclusions of the work. The crisis represents a test for constitutions, and constitutions appear "minimized". They manage to limit the hardness of the austerity policy, but they cannot upset it. They could even legitimize it, by taming it. In the crisis case law, the courts run the risk of losing their legitimacy. Proportionality is a technique that can emphasize the discretion of the judge. The allocation of the burden of justification to the legislature can limit it, without eliminating it. The limitation of the temporal effects of the decision involves the risk of politicization of the judge, but this technique is very helpful in times of crisis, because it allows the judge to adopt an "ethics of responsibility". Yet, the adoption of such an ethics must respect the rules that regulate the trial before the constitutional court and must be controlled by a rigorous legal reasoning.

International audience ; The essay aims to analyze the phenomenon of corporate social responsibility, which originated in the United States in the fifties but became a reality widespread in recent decades, from a philosophical-economic point of view and as the Socratic question "how to live ? ", Reproposed by the Nobel Prize winner for economics Amartya Sen, as well as his reflections on the ethical origins of the economy, lead us to reflect on new ways through which the company influences social values. From crowdfunding to the experiences of free-form enterprises, where time and space are decentralized. The phenomenon is interesting from an economic point of view: in fact, new forms of competitiveness are sought in the knowledge that the ultimate goal of the company remains profit, but also and above all ethical and social where new ways of doing business are changing society , while society itself requires innovative models in the way of doing business in its liquid and globalized variability. The need to find new measures of quality of life is also linked to these reflections. In 2008, a commission set up by the then President Nicolas Sarkozy and composed of some Nobel prizes including Amartya Sen, Jean Paul Fitoussi and Joseph Stigltiz, despite not having had a large following, began studying alternative measures to GDP that took into account happiness and of the welfare of the population. The order of economic indices so far known is therefore to be confronted with the disorder of a society that is reorganizing according to renewed models and desperately seeking new certainty, in the economic and political fields; starting from the crisis of homo oeconomicus, of overcoming the mere rationality about human choices in the economic field, if the request of society is that of a greater attention to ethics, to the responsibility in the consumption of resources and in respect of human rights, the governments that in the future will have the objective of guiding the economy and, in turn, not being guided, will have to take it into account and identify new answers to these questions, in order to put the economy back to the full service of man. ; Il saggio mira ad analizzare il fenomeno della responsabilità sociale d'impresa, che ha avuto origine negli Stati Uniti negli anni Cinquanta ma divenuta una realtà diffusa negli ultimi decenni, da un punto di vista filosofico-economico e come la domanda socratica «come bisogna vivere?», riproposta dal premio Nobel per l'economia Amartya Sen, nonché le sue riflessioni sulle origini etiche dell'economia, ci inducano a riflettere su nuove modalità attraverso cui l'impresa influenza i valori sociali. Dal crowdfunding alle esperienze della free-form enterprises, in cui il tempo e lo spazio sono decentrati. A queste riflessioni si collega anche la necessità di trovare nuove misure della qualità della vita. Nel 2008, una Commissione istituita dall'allora Presidente Nicolas Sarkozy e composta da alcuni premi Nobel tra cui Amartya Sen, Jean Paul Fitoussi e Joseph Stigltiz, malgrado non abbia avuto grande seguito, iniziò a studiare misure alternative al PIL che tenessero conto della felicità e del benessere della popolazione. L'ordine degli indici economici fino ad ora conosciuti si trova quindi a doversi confrontare con il disordine di una società che si sta riorganizzando secondo modelli rinnovati e che cerca disperatamente nuove certezze, in campo economico e politico; a partire dalla crisi dell'homo oeconomicus, del superamento della mera razionalità circa le scelte umane in ambito economico, se la richiesta della società è quella di una maggiore attenzione all'etica, alla responsabilità nel consumo delle risorse e nel rispetto dei diritti umani, i governi che in futuro avranno come obiettivo quello di guidare l'economia e, non esserne a loro volta guidati, dovranno tenerne conto e individuare nuove risposte a queste domande, al fine di porre di nuovo l'economia al pieno servizio dell'uomo.
International audience ; A chi appartiene il mio corpo? Sono padrone della mia vita e del mio destino? E se questo corpo è mio, posso decidere di farne commercio? Sono libero di cambiare sesso o di scegliere la morte? I torti arrecati a sé stessi e che non causano danno ad altri sono torti necessariamente immorali? Tali questioni attraversano la filosofia politica e morale e la loro risposta determina la relazione che l'individuo ha con sé stesso e con la sua intimità. Il movimento femminista, sostenuto dai progressi tecnologici in materia di contraccezione, ha permesso di portare sulla scena pubblica la questione della disponibilità di sé e del proprio corpo. Si tratta, tuttavia, di una problematica che non è nuova: essa costituisce uno dei fondamenti del rapporto con il potere inteso come facoltà di vita e di morte nell'Ancien Régime o in quanto governo permanente del vivente in epoca moderna, come messo in luce da Michel Foucault. Se i progressi tecnologici che permettono di oggettivare il corpo hanno rinnovato il dibattito bioetico, le sue origini sono tuttavia più antiche. I Romani organizzavano la vita politica a partire dalla summa divisio tra alieni iuris et sui iuris, divisione che separa la comunità degli uomini liberi e padroni di sé dagli altri: donne, stranieri, bambini, schiavi, ecc. i quali sono necessariamente sotto tutela. Più tardi, la tradizione cristiana generalizzerà questo dispositivo tutelare in funzione di altri criteri morali, in funzione dei quali il corpo non appartiene più al cristiano. Esso è il tempio di Dio, come insegna San Paolo: "Il corpo non è per l'impurità è per il Signore e il Signore è per il corpo" (Corinzi I, 6.13). ; A qui appartient mon corps ? Suis-je maître de ma vie et de ma destinée ? Et si ce corps est le mien, puis-je décider de le commercialiser ? Suis-je libre de changer de sexe ou de choisir ma mort? In agreement with the title of this article, the essay is divided into two basic parts: one which is historical and the other philosophical. In the first part, the author examines at the beginning the classical latin etyma of the term uiolentia (uis, uiolare, uiolator, etc . . ). After that comes the acclaration of the philosophical concept of «violence» in Aristotle and Saint Thomas, and in continuation an indication of the application of the same concept to the field of ethics, and finally to the juridical field within classical roman law. In another sphere of considerations -ethical and political- the author points out the opinions of some characters which Plato introduces in his dialogues Gorgias and The Republic, due aboye all to the resonance which these works hace had in the history of the Western World until the present time. The subject of bloody violence, which is inherent to the action of the tyrannicide, is treated here briefly with references to the works of Cicero, John of Salisbury, Saint Thomas, Marsilius of Padua, Coluccio Salutati, Juan de Mariana, etc. Phenomena of midieval history suchaas the Crusades and the trials of the Inquisition could not be silenced in this case because both phenomena legitimized morally the use of violence directed towards infidels and heretics. The historical excursus on the topic of the legitimacy of violence in the hands of those who govern passes in successive orden, through Machiavelli, to the political literature on the areasson of state», jusnaturalism, etc . To be underlined is the fact that since the end of the Eighteenth Century -and in an even much more important way in the realm of hegelian Idealism- the concept of violence has undergone a process of amplification as much within the field of Philosophy as within the experimental sciences: Darwin, Malthus and Hegel form the framework. This concept, which in Hegel's dialectic transformed itself into the dynamic principie of the antithesis, and which, therefore, affirmed the structure of the metaphysical movement of history, was passed on as a legacy to the successive hegelian trend, which was in itself so complex and so full of ramifications. The figure of Marx stands out in these pages not so much for his ties with the hegelian left, and with Feuerbach in particular, but rather because of one of the basic concepts of historical materialism -the struggle of the classes- which Marx underlined in his Communist Manifesto as the motivating force of history. The author then considers on the one hand the relationships which exist between the different european nationalisms of the last Century and the ones actually existing today, and, on the other, the Marxist ideology; he analyzes in passing the profound influence exercised by the Aufk/arung of the Eighteenth Century upon the deChristianization of man wrapped up first in his rationalism, and, later on, as a compensation, in new forms of religion and the cult of the world. From here on several names appear: Lenin, Stalin, Sorel, Mussolini, Hitler, etc., men who were very different one from the other and even opposed with regard to their respective political philosophies , but who set the pace for violence of a revolutionary and counter-revolutionary nature during short years or lasting decades. After a few more considerations, the first part of this essay ends with the author underlining the interest which experimental psychology and psycho-analysis have dedicated to the study of human aggressiveness and its mechanisms. In the second part of this work the author tries to establish gUidelines for the study of the relationships between the multiple phenomena of individual and collective violence in the present, and the mass civilization of our time. In the first place, the author makes a series of admonitions with relation to the words used: «violence-, .mass civilization- instead of «tnass society-, «civilization- instead ot «culture-, etc. He also recommends the need for not classifying en masse as a result of a reactionary mentality, the discontent which the intellectual contemplation of the present times produces in the observer, because if our state of animation could be termed as nothing else but «reactionary», then the same could be said to define a great part of the best literature of this Century, as well as the figurative arts of this modem age. The expression «mentality of violence- is applied in the historical context of cultural regression, from Friedrich Nietzsche to our day. After this, the author makes a summary description of the mental coordinates of massified man, as well as of certain particular features of the actual «organization- of culture, which is increasingly impregnated by political and economical ideas, in agreement with the fundamental methodology of historical materialism. The nucleus of these considerations is made up of a philosophical definition of the actual conditions of culture in Europe. This definition rests upon the conviction that the ideology of Marxism-Leninism, although it may by in a stage of partial historical modification, directs not only the political evolution of important sectors of , occidental society, but also that it has known how to model. thanks again to the coming-together of circunstances, the forma mentis of the contemporary intellectual. In the final part of the essay, the author dedicates special emphasis on the influence of Marxism upon wide sectors of modem Catholicism. He then adds several wamings in order to avoid , on the part of the reader, interpretations which might be inopportune or false.
This work addresses a theme back in the limelight both in the lexicon and in the community feeling: administrative transparency. "Glass House", as he said Filippo Turati in 1908 about manner how all public bodies should be; or "House with tinted windows", as Aldo Sandulli denounced in an article in 2007, a bitter commentary on the reforms introduced by legislator regarding the right of access? I have tried to figure out what was the legislative policy that has been lead in relation to these two extremes. Moreover, if it is true, as taught by the doctrine, by Arena on, that the absolute transparency is a myth unattainable as well as not advisable - because there may be interest that, in fact, may require confidentiality to protect their best, even temporarily – however, the relationship between transparency and secret can not be identified just by finding in the first one the rule and in the second one a limited exception. From this study it was found that the administrative transparency, as category broader than advertising, which relates to a relationship between "genus" and "species", is mainly an aspect of the administration, an aspiration of public authorities, which is incompatible with the attempt to compress into a single legal institution. The administrative transparency has its murky origins in the insights of two giants lived in the eighteenth century: Rousseau who was convinced of the absolute need for visibility of the acts of public bodies, and especially Kant who, in a strong opposition to the absolute rulers and their dominant "arcana imperii", go beyond the mere political value in order to assign it a moral significance, by using the famous maxim "All actions relating to the right of other men, whose maximum penalty is not susceptible to advertising, are unjust". From philosophy through history, and reaching out the right, this work came across the "arcana burocratici". In fact, investigating since the pre-Unification of Italy, I took both the persistent immanence of the secret and its mutation: born first as synonymous with professional secret, as a consequence of the fiduciary relationship that develops between administrators and administered; however, with the emergence of modern States and of bureaucratic administration, it assumes the guise of a specialized knowledge of the public employee, and this marks the landing to "arcana burocratici". However, this indomitable strength of the administrative secret must be reckoned, especially since 1948, with the new values introduced by the Constitutional Charter which, even if it never explicitly mentions the transparency, contemplates it again and again as a result of the elasticity of its principles: from the democratic one to the manifestation of thought one, or to the political rights or the association and assembly rights, and to advertising right, not to mention the crucial relationship with the principle of impartiality, which all require to resize the strength of administrative secret. This work then gave importance to transparency in ordinary legislation, especially in the Law 241 of 1990, with particular attention to the comparative perspective of the influences arising from the American FOIA, with its model of free access of public documents without subjective filters, in order to detect the distance, since the first hour, between the law project designed by the Subcommittee Nigro and the legislator, regarding the right of access to administrative documents, long time considered as the teaching tool that can perform two functions: to protect individual situations and check public action in a democratic sense. Do not think so the legislator who, since the beginning, relegates it to the mere operation of self-interest and diminish its democratic value, introducing a filter to its use by all citizens that, not only will never fail, but indeed, in subsequent reforming steps, especially in the law n. 15 of 2005, will be accentuated. But these legislative policies, going in the direction opposite to the constitutional requirements, forcing me to investigate other sources, in particular the Digital Administration Code of 2005 and the operation "Trasparenza" launched by the Minister Brunetta in 2009, in order to assess how the system recovers constitutional consistency. And so, on the basis of the emergence since the early 90's of the new standard of communication and maximizing the standard of publicity, this work has noticed that the Italian system was marked by an inexorable passing of the torch of transparency instruments, from the right of access to documents, never too loved by the legislator in terms of transparency, to the on-line publication of information on institutional websites of public bodies. It emerged, based on the new possibilities offered by ICT, a model of transparency as a synonym of potential total accessibility. We move from access to documents to any information accessibility, both the one concerning the activities carried out by institutions, both the one relating to employees. Information that is potentially infinite in number, favoured by the slow passage of the Italian administration to digitization. It is "the triumph of transparency?" Not really: the identified risks are many. From the possible information overload, to the risk of its quality: the accumulation does not guarantee the reliability or fact, nor its significance and hence no guarantee on increasing transparency. Legal issues, such as the adversarial relationship with privacy, that are carried by the counterparties, and technological issues; think of the digital divide still suffered from many Italian citizens who have no access to broadband internet. Finally, in the background, the great fundamental question: why the legislator has staked everything on transparency, as a synonym for release of information on the entities in the network, and cut out of the game the right of access? In the opinion of the writer, when you think in terms of high aspirations, who aspire to ethics and, ultimately, to virtuous behaviours, it would be better to proceed by accumulation and never by exclusion.
Alberto Manzi is a key figure in the panorama of the development of Italian language and culture. The analysis of his biography and his writing highlights the humanism that characterizes all his literary works and his pedagogical thinking. A fil rouge that underlies his life and professional experiences, an urgency of renewal that results in a concrete commitment against injustice and ignorance, in the expression of a new paideia, in politically engaged writing.He wrote many novels (Grogh storia di un castoro, Collodi award, translated in 20 languages; Orzowei, honored at the Andersen award translated in 32 languages), tales, articles, informative writings; he developed TV and radio programs for children, parents and teachers. Narrator, teacher, journalist, teachers trainer, ranging from natural sciences to poetry, he could practically embody a figure of the "Renaissance".He is still remembered as 'Maestro degli italiani' for the 10-year TV program Non è mai troppo tardi which received the UN award for its important contribution in the fight against illiteracy in the Sixties.Afterwards he taught for years to the Natives in South America, helping them in their fight for their rights. That inspired him to write the trilogy: La luna nelle baracche, El Loco, E venne il sabato. In these works, the narration becomes a song of denunciation and an act of love: the urgency to give voice to a people, to humanity.In the first part of this work, after having highlighted the links between the biography of the author and his humanist vision, and show the status quo of criticism of the author, the reception of Manzi's work was treated from a theoretical point of view. Then the question of timeliness of Manzi's novels has been approached, in relation to the general problem of reading at school. A summary of the interdisciplinary project that I carried out in a network of schools, in order to verify the reception of Manzi nowadays, completes this part.In the second part of this work, several novels and informative writings compose the corpus which has been analysed in specific chapters. From this analysis, the recurrent elements of Manzi's poetry have been extrapolated and elaborated in a separate chapter.The third part of this research include theoretical reflection on translating and adapting, on the role of the adult as intermediary in the selection and reading of novels, on the lisibilité, and also a comparative analysis of some French versions of Manzi's novels. From this work of analysis and that on fortune, we also suggest a new translation more faithful to the style and integrity of the original texts, in view of a possible and desirable new edition of Manzi's novels.From this analysis emerges the figure of a writer who perfectly harmonizes imagination and ethics-politically engagement: this allows the author to create stories very well appreciated by the readers who are at the same time stimulated to reflect on the theme of the story. Manzi surprises, motivates to read, educates, through the magic sphere of art and fantasy. His novels are harmoniously well built between the pedagogical aim and the aesthetic result, so they resist the test of time and encourage us to confirm the thesis of the inclusion of his works among the great classics. ; Alberto Manzi est un acteur clé de la vie culturelle italienne du second vingtième siècle. L'analyse de sa biographie et de son œuvre met en lumière l'humanisme qui caractérise son travail de pédagogue et d'écrivain. Cet humanisme représente le fil rouge qui sous-tend sa vie et ses expériences professionnelles animées par une exigence de renouvellement culturel qui se traduit par un engagement constant contre toutes les formes d'injustice, dans la construction d'une nouvelle paideia.Manzi a conçu de nombreux programmes de télévision et de radio pour différents publics. Il est surtout resté dans les mémoires comme le «Maestro degli italiani» pour l'émission télévisée « Non è mai troppo tardi» [Il n'est jamais trop tard] diffusée dans les années Soixante et couronnée par le prix de l'ONU pour son importante contribution à la lutte contre l'illettrisme. Professeur, formateur, mais aussi écrivain prolifique, abordant tous les genres, de la vulgarisation scientifique à la poésie, en passant par le conte et le roman, il rappelle par son encyclopédisme, plus encore que les grands pédagogues du XIX e siècle, une figure du siècle des Lumière. Il a écrit de nombreux romans (Grogh, storia di un castoro, prix Collodi, traduit en vingt langues; Orzowei, récompensé par le prix Andersen, traduit en trente-deux langues).Il a ensuite enseigné pendant des années aux nativos d'Amérique du Sud, les aidants dans leur lutte pour faire reconnaître leurs droits. Cette expérience lui a inspiré sa trilogie: La luna nelle baracche, El loco, E venne il sabato (inédits en France). Dans ces œuvres, la narration devient un cri de dénonciation et un acte d'amour, répondant à l'urgence de donner une voix aux opprimés.La première partie de ce travail, souligne les liens entre la biographie de Manzi et sa vision humaniste de la société. Nous rendons ensuite compte de l'état de la critique autour de ses œuvres et de la réception et de la fortune de ses travaux en Italie et à l'étranger. Nous nous interrogeons sur le rôle de l'adulte en tant que médiateur et prescripteur dans le choix et la lecture des romans pour la jeunesse.Puis nous abordons la question de l'actualité de son œuvre, en relation avec le problème général de la lecture en milieu scolaire. Enfin, un résumé du projet interdisciplinaire que nous avons réalisé dans un réseau d'établissements scolaires, dans le but de mettre à l'épreuve et d'interroger l'actualité de l'œuvre de notre auteur, complète cette partie.Plusieurs romans et œuvres de vulgarisation qui composent notre corpus sont analysés dans des chapitres spécifiques qui constituent la deuxième partie de notre thèse. Cette analyse nous a permis d'identifier certains éléments récurrents de la poétique de Manzi qui illustrent son profond humanisme.La troisième partie de cette recherche est consacrée à l'étude de la traduction et de l'adaptation de certains ouvrages de Manzi. Une analyse comparative des versions français et italienne de ses romans nous amène à penser qu'une nouvelle traduction plus fidèle au style et à l'esprit des textes originaux s'impose.De cette analyse émerge la figure d'un écrivain qui allie l'imagination à l'engagement, créant des récits qui emportent le lecteur tout en le poussant à réfléchir sur des thématiques cruciales.Manzi surprend, suscite l'envie de lire, éduque, grâce à la magie de son art. Ses romans résistent à l'épreuve du temps et s'inscrivent dans la lignée des grands classiques.
Dottorato di ricerca in Memoria e materia delle opere d'arte attraverso i processi di produzione, storicizzazione, conservazione, musealizzazione ; Il lavoro di ricerca, condotto in un intreccio serrato tra teoria e prassi che si è voluto evidenziare fin dalla scelta del titolo, si rivolge al complesso ed ampio fenomeno della Public art nell'intento di precisarne i contorni all'interno del più ampio orizzonte dell'arte contemporanea degli ultimi due decenni, di cui costituisce uno dei fenomeni maggiormente vitali. Le contemporanee forme artistiche, con l'inclusione di interventi che vedono in essere pratiche che esulano dai tradizionali spazi deputati, si sono fatte contaminazione, abbandonando quel solipsismo che per troppo tempo l'arte si è tenuta addosso. I confini tra spazio pubblico, vita quotidiana e fare artistico sono divenuti sempre più labili, infranti dal superamento dell'idea di arte come 'separazione', con conseguenti cambiamenti in atto che hanno portato l'arte a legarsi sempre di più al concetto di riqualificazione urbana. Essa ha così cercato di riciclare quel "terzo paesaggio"1 fatto di vuoti urbani privi di identità, costituendo supporto e corollario per investitori pubblici e privati o per semplici cittadini, che si sono ritrovati ad operare in periferie e luoghi dismessi, di colpo divenuti occasione storica di trasformazione concreta2. In questa sede è stata quindi lasciata da parte l'arte pubblica nella sua accezione più glamour, di arte da collocare in spazi sviluppati e già profondamente connotati (arte pubblica come dispositivo di carattere estetico) considerandola nella sua valenza sociale, etica, di arte relazionale che viaggia nel sommerso, pratica i territori della residualità, gli interstizi, si muove lungo i limiti, allontanandola da quella dimensione estetica che la riporterebbe nell'ambito dell'urban forniture e del monumento. Partendo da una riflessione su come sia cambiata la città (indefinibile e impraticabile metafora del tempo presente), si constata che la diffusione dell'arte pubblica, con le sue pratiche site specific, sia andata di pari passo con la perdita di senso e di segno del territorio e del palinsesto città. In questo contesto l'arte non solo è processo, ma innesca processi in luoghi altri, irrituali, dai centri storici alla periferia fino agli spazi interstiziali (quelli abbandonati, dimenticati, desolati) e l'artista produce oper-azioni tra estetica ed etica, mentre il pubblico non solo è partecipe, ma perfino coautore di tali processi. Contemporaneamente, con uno sguardo storico, viene ripercorsa l'evoluzione del significato di Public Art dagli anni '70 ad oggi, restituendone tutta la complessità attraverso un'analisi del pensiero critico espresso da autori internazionali di tante e diverse discipline (dalla sociologia, alla geografia, all'urbanistica, all'architettura, alla legislazione) interconnesse a questo particolare fenomeno artistico. Dopo aver colto le dimensioni in cui l'arte pubblica si manifesta, l'indagine si concentra sulla dimensione etico-sociale di rigenerazione urbana della Public Art, sia attraverso una riflessione sul ruolo dell'arte in questo 1 G. Theories and practice, between critical analysis and urban regeneration. European case studies. The research, that mingles both theory and practice, as the title itself underlines, deals with the wide and complex phenomenon of Public art in order to define its boundaries within the wider horizon of contemporary art (of which it is one of the most vital phenomena), during the last two decades. The contemporary forms of art, with actions that go beyond the traditional delegated spaces, have abandoned the solipsism that has characterized art for a long time. The boundaries between public space, daily life and art have become increasingly fragile, overtaking the concept of art as "separation", and creating new stronger connections between art and urban re-qualification. The idea of "third landscape"1, made of empty urban spaces with no identity, has been recycled and became the support for public and private investors to operate in suburbs and dismissed areas that offered a chance for a tangible transformation2. Thus the glamorous connotation of public art (art as an aesthetic device) has been put aside to enhance its social value, its ethic and its capability to move along the boarders and the interstices, far from the concepts of urban furniture and monument. Starting with considerations about the changes in the city (seen as a metaphor of the present), it is observed that the diffusion of public art, with its site-specific practices, has followed the loss of meaning of the territory and the city scene. In this context art is not just process itself, but it activates different processes in diverse and non-ritual places, from the inner city to the suburbs and desolated, abandoned and forgotten areas; the artist produces actions between aesthetics and ethics and the public is not only participating, but even the coauthor of such processes. At the same time, the evolution of Public art meaning is investigated through an historical overview from the Seventies until nowadays, through an analysis of the critical thought expressed by international authors involved in several disciplines (from sociology to geography, architecture, city planning, legislation) connected to this particular art phenomenon. After describing the dimensions in which public art reveals itself, the research focuses on the ethical-social aspects of urban regeneration of public art, both reflecting on the art's role in this context, and through a dense debate between different European case studies (in Italy, Germany, Holland, Sweden, France, England, Spain, Denmark). Analyses about the legislation that governs the commission of public artworks in Italy and Europe have been also carried out, comparing them with American regulations and dispositions; the project ends with significant interviews to artists and experts of the field. 1 G. Tese de doutoramento em Estudos Clássicos, no ramo de Filologia Clássica, apresentada à Faculdade de Letras da Universidade de Coimbra ; The research work is divided into two basic parts: the translation and commentary of some sections of the book Regum et imperatorum apophthegmata by Plutarch. In particular they have been taken into consideration the Dedicatory epistle to Trajan and the sections dealing with Agathocles, Antipater, Aristides, Alcibiades, Iphicrates, Timotheus, Phocion, Teleclus, Lysander and Pelopidas. The translation was prepared on the basis of the Latin translation by Xylander, the Italian ones by Adriani and Pettine, the English one by Babbitt, the Spanish one by Lόpez Salvá and the French one by Fuhrmann. For each anecdote the different interpretative proposals of the translators have been highlighted in the footnotes. The commentary has been developed along two lines, the former intratextual, the latter intertextual. In the first istance, the attention was paid to the study of the words used by the author, which helped to identify the frequency of some fundamental themes of ethical and political thought of Plutarch, such as the need for the governor not to be tormented by lust for wealth, not to be led astray by private interests and friendships in the management of public affairs, to be able to evaluate flexibly critical circumstances that occur from time to time, shaping the policy and operational positions to them and avoiding fruitless and stiffness intransigence. Before the eyes of the reader the author slides the long series of anecdotes, inviting them to consider which are the virtues, but also the vices that led eminent people to prosperity or to ruin. And what emerges consistently from each short story is the importance of reflection and pondering every time you are about to perform an action or reply to a question not without insolence. It is recommended and appropriate learning to tame irrational forces of the soul through the exercise of λόγος; in fact they cannot be eradicated completely. It is because of this constant and gradual exercise of self improvement that energy, which man has, can be harnessed and directed to noble deeds for those who make them and fruitful for those who benefit them. The policy ultimately cannot be separated from ethics; a politician, who is not persistent in improving his mind and free it from all forms of selfishness, will not benefit at all to those who are subjected to his command. In many cases it is possible to find in the text the words which introduce explicitly the above issues, as, for example, φιλοπλουτία, ἀδικία, δίκη, τóλμα, θάρσος, ἀργία; in other cases it can be deduced from the meaning of the anecdote which category of values the author is referring to. The presence of the terms relating to each theme, in the commentary of the individual anecdotes, are then summarized in a synoptic table in order to allow an immediate comparison of the characters and the vices/virtues attributed by the author. Another aspect investigated thoroughly is the author's appeal to rhetorical devices to give the apophthegms incisiveness, especially when the author summarizes episodes which are more extended and articulated in the Lives and other plutarchian books. In the Apophthegmata you can find especially the chiasmus, which the author often uses to contrast the thinking and acting of the character to that of his detractors; the etymological figure and the polyptoton, with which the main theme of the plutarchian reflection is repeatedly drawn inside the anecdote. It was further highlighted that in the collection of apofthegms there are two types of anecdote; there is, in most cases, the presence of apophthegmata placed at the conclusion of a synthetic context, outlined with rapid hints; but it also notes the introduction of a specific episode of war and customs of characters, devoid of judgment in the epigraph, which are also designed to emphasize an ethical feature and behavior of the character in question. The second line, that we proceeded in the research work, was the comparison of each anecdote with versions of the same occurring in other works by Plutarch. The comparison showed that in some cases the versions coincide almost entirely in the vocabulary and meaning, but on many occasions the perspective, from which the story is presented by the author, varies slightly and sometimes considerably. It has been noted in fact that some details of the anecdote are eclipsed or modified by the author based on the context in which they are placed; the same story is then molded according to the theme that the author is dealing with. In general it was found that in Apophthegmata the presentation of the characters tends to be more positive than in other works by Plutarch, operation where the author comes removing from anecdotes details that could negatively connote the character. At the base of the anecdotes they could hypothetically be the so-called ὑπομνήματα, ie raw notes that Plutarch would be recorded in the course of its various readings and which he would use in the composition of his works. It is given adequate account about this problem in a specific chapter of the thesis, which examines the theories proposed in particular by Van der Stockt, Van Meirvenne, Pelling, Städter and Beck on the nature of ὑπομνήματα. According to some of them the content of the clusters, which are groups of ὑπομνήματα, would mainly philosophical in nature, according to others mainly historical. Furthermore on the one hand it is believed that the Apohthegmata constitute a drafting stage intermediate between the hypothetical sketched ὑπομνήματα and anecdotes as are processed in different works by Plutarch. On the other hand however the collectionof apophthegms is considered complete and independent from the drafting of the Lives and Moralia, theory that appeared to me more convincing on the basis of the rhetorical and stylistic analysis that I developed. The anecdotes do not appear to a stage of stylistic poor structuring and the use of a certain category of rhetorical devices and the tendency to obscure incriminating details for the characters seem to respond to a specific purpose of the author. Another chapter is devoted to the presentation of the debate on the problematic attribution of the work to Plutarch. In this chapter we review the opinions expressed in particular by Xylander, Wyttenbach, Benseler, Volkmann, Schmidt, Sass, Weissenberger, Hartman, Babbitt, Ziegler, Flacelière, Fuhrmann and Beck, noting that the most recent studies, particularly those of Beck, the scholars tend to recognize the paternity of the collection of anecdotes. According to him and other scholars the conciseness of anecdotes than the versions, which are read in the other works by Plutarch, would not be valid indication of inauthenticity; instead it would respond to the specific needs required by the type of the literary genre.
ÖZET2011 GENEL SEÇİMLERİ SÜRECİNDE YAZILI BASININ SİYASAL İLETİŞİM YÖNÜNDEN İNCELENMESİSiyaset ve iletişim disiplinlerinin kesişim noktasından doğan "siyasal iletişim" kavramı, hayatımızda yalnızca teorik anlamda var olmamaktadır. Öyle ki, etrafımızı çevreleyen neredeyse her kitle iletişim aracı her an siyasal iletişim mesajları taşımakta fakat aynı zamanda bu mesajları farklı anlatım biçimleriyle yansıtmaktadır. Yazılı basın da bu kitle iletişim araçlarının geçmişten bu yana en etkili olanlarından biridir. Bu nedenle, yalnızca seçim dönemlerinde değil, seçim dışı zamanlarda da gazetelerin siyasal iletişim açısından önemli bir rolü vardır.Siyasal iletişim kavramı, 20. Yüzyılın sonlarına doğru popülerlik kazanmış olsa da, Antik Yunan'dan günümüze varlığını sürdürmektedir. Platon'un "Sokrates'in Savunması" ve "Gorgias", Aristoteles'in ise "Retorik" adlı eserlerinde siyasal iletişimden izler bulmak mümkündür. Özellikle retorik (ikna edici dil kullanımı), siyasal iletişim tekniklerinin temel öğelerinden birini oluşturmaktadır. Zaman içinde gelişen siyasal sistemler ve iletişim sistemleri, kavramın etki alanını genişletmiştir. Pazarlama öğelerinin hemen hepsi "siyasal iletişim yönetimi" adı altında birleşip, siyasal reklam, siyasal propaganda ve siyasal pazarlama gibi kollara ayrılmıştır. Özellikle Amerika Birleşik Devletleri'nde iletişim teknolojilerinin gelişmesiyle birlikte siyasal iletişimin önemi artmış; seçim dışındaki dönemlerde de uzun vadeli stratejik planlar yapılmaya başlanmıştır. Bu noktada, kitle iletişim araçlarının toplum üzerinde kısa ve uzun vadede yarattığı etkilere örnek olarak çeşitli kuramlar/modeller üretilmeye başlanmıştır. Siyasal iletişimi de ilgilendiren bu kuramlardan biri Gündem Belirleme Modeli (Agenda Setting)'dir. Bu modele göre, medya yansıttığı gündemle, bizim ne konuşacağımızı değil ama "ne hakkında konuşacağımızı" belirlemektedir. Diğer bir deyişle, bizi yönlendirmektedir. Dolayısıyla medyanın (tez konusu gereği basının) elinde bulundurduğu bu güç, siyasi parti liderleri tarafından bir manipülasyon aracı olarak görülmektedir. Bu durum, basın ve siyaset ilişkisini konunun içine dahil etmektedir. Basın tarihi boyunca, siyaset ve iktidarla ilişkiler hep gündemde olmuştur. Özellikle Türk Basın Tarihi'nde yapılan sansürler, kapatılan dergi ve gazeteler, hapis cezası alan gazeteciler bu ilişkilerin boyutunu gözler önüne sermektedir. Elbette ilişkilerin bu girift (çapraşık) hali almasında ilk gazetelerin devlet eliyle çıkması, sonrasında basında yaşanan holdingleşmeler, hükümetler tarafından verilen teşvikler ve değişen habercilik anlayışının da etkileri olmuştur. Neticede, değişen habercilik anlayışı "haberin metalaşması" sorununu da beraberinde getirmiştir. Bunun yanında, basın-siyaset arasında yaşanan çıkar çatışmaları haber diline yansımış; nesnellik, objektiflik ve dengelilik gibi unsurlar belirgin şekilde göz ardı edilmeye başlanmıştır. Tüm bu nedenlerden ötürü, bu çalışmada 2011 Genel Seçimleri sürecinde partilerin ve liderlerin siyasal iletişim çalışmalarının yazılı basında nasıl sunulduğu ve yansıtıldığı incelenmiştir. 1 Mayıs 2011- 12 Haziran 2011 tarihleri arasında Cumhuriyet, Hürriyet ve Zaman gazetelerinde partilerin seçim çalışmaları ile ilgili yer alan haberler, eleştirel söylem çözümlemesi modeli örnek alınarak analiz edilmiştir. Çalışmanın birinci bölümünde, Siyaset, İletişim ve Siyasal İletişim kavramlarının yanında, Siyasal İletişimin Tarihçesi, Öğeleri ve Türkiye'deki Gelişimi ele alınmıştır. İkinci bölümde, Yazılı Basın ve Siyaset İlişkisi, Siyasal İletişimde Yazılı Basının Yeri , Siyasal İletişim ve Habercilik Etiği incelenmiştir. Üçüncü bölümde, partilerin 2011 Milletvekili Seçimleri sürecinde kullandıkları sloganlar, ilanlar, seçim vaatleri ve tanıtım faaliyetleri irdelenmiştir. Dördüncü bölümde ise, Eleştirel Söylem Çözümlemesi Modeli örnek alınarak seçilen gazetelerin analizleri yapılmıştır. ABSTRACTANALYSIS OF THE PRESS IN TERMS OF POLITICAL COMMUNICATION DURING 2011 GENERAL ELECTIONSPolitical communication, which arises out of the crossroads of politics and communication disciplines, does not exist just theoretically in our lives. Such that, every means of mass communication that surrounds our environment carry political communication messages at any moment by reflecting these messages using different wordings at the same time. Press is one of the most effective means of mass communication from past to present. Because of this reason, not only in the election periods, but also during non-election periods, newspapers have an important role in terms of political communication. Even though political communication started to gain popularity towards the end of the 20th century, it's been in existence since Ancient Greeks. It's possible to find the traces of political communication in Platon's works, "Sokrates's Defence" and "Gorgias" and, Aristoteles's work "Rhetoric". Especially rhetoric (persuasive use of the language) is one of the basic elements of the political communication techniques.In time, the developing political and communication systems has broadened the influence area of the term. Almost all the components of marketing came together under the name of "political communication management" and ramify in to the branches like political advertisement, political propaganda and political marketing. Mainly, by the development of communication technologies in the United States, the importance of political communication has increased and long-term strategical plans (including non-election period) has started. At this point, various theories and models have started to be produced as a sample for the long/short term effects of the means of mass communication on the society. One of these theories which concerns political communication is Agenda Setting. According to this model, the media do not determine "what we are going to talk" but "about what we are going to talk". In other words, it redirects us. Thereby, the power that press has is seen as a mean of manipulation by the political party leaders. This situation directly takes press and politics in to the subject. Throughout the history of the press, politics and power relations were always on the agenda. Especially in the history of Turkish press, the censorship, banned magazines and newspapers, the journalists who were sentenced reveal the size of these relationships. Certainly, the emergence of first newspapers by the hand of state, the incentives provided by the governments, the conglomeration in the press immediately afterwards, and the changing understanding in the journalism all have had an impact on the relationships which reached this perplexed state, too. Eventually, the changing understanding in the journalism has brought the problem of "commoditization in the news", as well. Besides, the conflicts between the press and politics have affected the language of the news; the elements like objectivity and balance in the news have clearly begun to be ignored. Because of all these reasons, how the political communication process of the leaders and parties were presented and reflected during 2011 general elections in Turkey is analyzed. Between May 1 and June 12, the election studies of political parties in the news of the daily national newspapers Cumhuriyet, Hürriyet and Zaman is analyzed by using the model of critical discourse analysis. In the first chapter of this study, the History, Elements and Development of Political Communication in Turkey were discussed, beside the concepts of Politics, Communication and Political Communication. In the second chapter, Relationship between Press and Political Communication, Place of the Press in Political Communication, Political Communication and Journalism Ethics are studied. In the third section, slogans, advertisements, election promises and promotional activities of the parties in the process of 2011 general elections are widely examined. Finally in the fourth chapter, selected newspapers were analyzed through Critical Discourse Analysis Model.
Il lavoro è volto a mettere in luce le problematiche connesse all'attività delle imprese multinazionali e alla sussistenza in capo alle stesse di una responsabilità sociale internazionale (RSI). Nell'attuale panorama economico e politico mondiale, caratterizzato dalla globalizzazione e dalla stretta interdipendenza dei mercati, dalla sempre più frequente internazionalizzazione dei processi produttivi e aziendali e dalla contestuale operatività delle società in più Paesi, dalla accresciuta consapevolezza del consumatore circa il rispetto, nei processi produttivi, di istanze ritenuti fondamentali dalla società civile, come i diritti fondamentali dell'uomo e dei lavoratori o la protezione dell'ambiente, l'impresa multinazionale assume un ruolo fondamentale sia nell'indirizzare i trends economici globali (si pensi al fatto che alcune società hanno profitti superiori al PIL di buona parte degli Stati della comunità internazionale); la configurazione di una responsabilità sociale in capo a tali società vuol dire mescolare la libertà di impresa e il libero mercato con l'etica. La necessità di inserire la questione dell'etica negli affari nasce, dunque, dalla convinzione - sempre più diffusa in ambito internazionale e nazionale - che l'attenzione dell'impresa verso le istanze sociali, ambientali ed etiche delle comunità umane costituisca una condizione imprescindibile per uno sviluppo durevole e sostenibile. In tale prospettiva, dunque, il concetto di responsabilità sociale d'impresa richiama le imprese a considerare attentamente - nella definizione della propria strategia, nell'articolazione delle politiche e nelle procedure gestionali quotidiane - gli interessi diffusi della collettività, nonché l'impatto delle proprie attività, non solo in termini economici, ma anche sociali, ambientali ed etici. La responsabilità sociale rappresenta, quindi, per l'impresa uno strumento utile ed efficace per rispondere alle istanze e alle esigenze della società civile. Con la RSI nasce quindi una teoria di impresa che vede la produzione di beni non solo come strumento di profitto ma anche come occasione di realizzazione del benessere sociale; lo stesso operato dell'impresa inizia ad essere valutato globalmente non solo in rapporto ai risultati economici della stessa ma anche in base alla qualità del prodotto, alla qualità dell'ambiente lavorativo e alle istanze ambientali, seconda i dettami di quella scuola di pensiero del cd. business ethics per cui le imprese sono chiamate a compiere azioni che contribuiscano ad eliminare e prevenire le iniquità sociali e a promuovere lo sviluppo della collettività. Tale necessità è stata anche consequenziale a comportamenti ed abusi messi in atto dalle società transnazionali che hanno arrecato gravi danni alle comunità umane degli Stati ospiti delle attività produttive. Gli abusi commessi dalle imprese, non sempre riconducibili a precise violazioni degli ordinamenti nazionali, sono stati progressivamente interpretati e costruiti come violazioni o mancanze nei confronti di un complesso di principi definiti come appartenenti ad una ampia sfera di responsabilità sociale internazionale dell'impresa, che implica la perdita di reputazione e, quindi, la possibile riduzione delle sue quote sul mercato qualora gli stakeholders più interessati riescano a mobilitare l'opinione pubblica su larga scala. Fin dagli anni '70, diverse organizzazioni internazionali hanno iniziato ad occuparsi della regolamentazione dell'attività delle imprese transnazionali, evidenziando il ruolo che le imprese multinazionali sono chiamate a rivestire nei processi di tutela dei diritti umani e dell'ambiente che emergono nello svolgimento delle loro attività economiche; appare evidente come sia basilare, nel piano dell'opera, definire l'impresa multinazionale, analizzando i diversi strumenti adottati dalle organizzazioni internazionali e i contributi dottrinali in materia, alla luce dei quali sembra potersi dire che il carattere di "multinazionalità" o "transnazionalità" è dato dalla presenza di diverse unità operative, dislocate in più Paesi, che si trovano sotto il controllo (azionario o di gestione) di un'unica società holding; tale distinzione tra unità operative si estende fino al profilo giuridico, in quanto le singole consociate sono autonomi soggetti di diritto sottoposti, relativamente ai profili della regolamentazione e della costituzione, all'ordinamento giuridico dello Stato di nazionalità. Ciò spesso comporta che le società scelgano come sede un Paese sulla base della convenienza che ciascuno di essi offre in relazione al trattamento fiscale, al costo della manodopera e delle materie prime, alla regolamentazione in materia di protezione dell'ambiente. Sembra quindi necessario un tentativo di regolamentazione da parte di organismi sovranazionali, a fronte del numero sempre maggiore di imprese operanti in più mercati (più di 80.000 società con circa 900.000 società sussidiarie), al loro peso economico e occupazionale (si stimano circa 80.000.000 di posti di lavoro) e a seguito di numerosi episodi che hanno coinvolto tali imprese dagli anni '70 ad oggi, come nei casi della Drummond o della Del Monte, accusate di gravi repressioni dei diritti sindacali e sociali dei lavoratori, o della Chevron/Texaco e della Union Carbride, responsabili di disastri ambientali tra cui quello di Bophal, in India, fino al caso, recentissimo, del disastro ambientale causato dalla piattaforma Deepwater Horizon al largo delle coste della Florida e della Louisiana tra il 2010 e il 2011, o i casi di violazioni dei diritti umani e commissione di crimini internazionali (arresti arbitrari, torture, violenze sessuali, trattamenti inumani e degradanti), commesse da società transnazionali operanti nel settore estrattivo e minerario in Africa e nel Sud Est Asiatico, commessi direttamente o a mezzo di milizie assoldate per la protezione degli impianti. L'attività delle Organizzazioni internazionali, a partire dagli anni '70, si è focalizzata sul tema; l'OCSE, l'Organizzazione internazionale del lavoro, la Camera di Commercio internazionale hanno adottato in quegli anni raccomandazioni e dichiarazioni rivolte agli Stati membri e alle imprese per l'adesione a certi principi e diritti già sanciti da altri strumenti convenzionali; le Nazioni Unite, prima attraverso l'attività della Commissione sulle imprese multinazionali e poi della Sottocommissione per la protezione e promozione dei diritti umani, si sono occupate della materia, giungendo alla elaborazione di un Codice di condotta per le imprese multinazionali (mai adottato) e di Norme sulla responsabilità delle imprese multinazionali e altre imprese in relazione ai diritti umani, che si affiancano alla partnership pubblico-privata del Global Compact. Ancora, anche altre organizzazioni internazionali, come l'Organizzazione mondiale della sanità, l'OMC, la Banca mondiale, l'International Standard Organisation, hanno adottato atti che invitano le imprese a svolgere la propria attività produttiva nel pieno rispetto dei diritti fondamentali della persona, delle comunità locali e dell'ambiente, e quindi prendendo in considerazione non solo interessi e diritti dei soci ma di tutti i soggetti a vario titolo coinvolti o toccati dall'attività aziendale. In ultimo, è il lavoro del Rappresentante Speciale del Segretario Generale ONU John Ruggie ad elaborare un quadro normativo (denominato Protect, Respect, Remedy) generale relativo al rapporto tra business e diritti umani. La caratteristica degli strumenti analizzati è la loro natura non vincolante, quindi meramente esortativa e ad applicazione volontaria. Tale situazione si ricollega sostanzialmente a due ragioni: la discussa soggettività internazionale delle imprese multinazionali e le opposte visioni dei Governi in materia (con evidenti difformità di vedute tra Paesi in via di sviluppo e Paesi industrializzati). Riguardo alla soggettività delle imprese multinazionali, ovvero lo status di essere titolari di diritti e obblighi nascenti dal diritto internazionale, la dottrina internazionalistica è fortemente divisa. Secondo un primo orientamento, le IMN non sarebbero soggetti di diritto internazionali in quanto sono solo destinatarie di norme, e quindi "oggetto" del diritto internazionale; sarebbero soggette solo alla giurisdizione dello Stato, e vincolate dal diritto internazionale solamente in virtù del richiamo da parte dell'ordinamento giuridico interno. Dagli anni '60, inizia a farsi largo un diverso filone dottrinale che, partendo dal noto parere della Corte internazionale di giustizia Reparations for Injuries, considera l'impresa quale soggetto di diritto internazionale, in virtù di una serie di diritti e obblighi che le vengono attribuiti dal diritto internazionale, soprattutto in materia di investimenti e di contratti internazionali (tra tutti, il diritto di adire un'istanza arbitrale o giurisdizionale a carattere arbitrale). Inoltre, la costante attenzione per l'attività delle IMN da parte delle Organizzazioni internazionali, potrebbe testimoniare la nascente opinio juris di conferire una, seppur limitata, soggettività internazionale alle imprese. Dall'analisi della prassi internazionale si sono tratte conclusioni provvisorie, in particolare che l'impresa, soprattutto nel settore del diritto economico e degli investimenti, possegga una personalità giuridica internazionale limitata e soprattutto derivata dalla volontà degli Stati, ma soprattutto funzionale, poiché contenuta nei limiti stabiliti dal trattato internazionale (BITs) o del contratto internazionale che stabilisce diritti e obblighi per la stessa. Negli ultimi anni anche l'Unione Europea ha iniziato a promuovere una adesione delle imprese ai valori fondamentali dei diritti dell'uomo, dei lavoratori e dello sviluppo sostenibile. A partire dal Libro Verde del 2001, l'UE ha elaborato progressivamente una strategia europea per la responsabilità sociale di impresa, qualificata come adozione spontanea di prassi volte a contribuire al miglioramento della società e alla qualità dell'ambiente. La strategia dell'UE si caratterizza per avere una dimensione sia interna all'impresa, stabilendo una serie di programmi d'azione e l'adozione di sistemi di gestione dei processi produttivi, sia esterna alla stessa, prevedendo il coinvolgimento di comunità locali, partner commerciali, clienti, fornitori, ONG, autorità statali. A tali fini, l'UE lanciò una serie di iniziative, quali i sistemi EMAS e ECOLABEL di certificazione ecologica e di audit ambientale, il Multistakeholders' forum, per formare un quadro giuridico regolamentare in materia di appalti pubblici e sostenibilità ambientale, di tutela del consumatore, di pubblicità ingannevole, nonché l'adozione di codici di condotta settoriali, ispirato ai principi della RSI. L'attività di regolamentazione della RSI ha ricevuto un contributo dalle stesse imprese multinazionali, nel senso di una autoregolamentazione delle proprie attività, attraverso dei codici di condotta autonomamente adottati dalla singola impresa in funzione delle proprie strategie e valori. Tali codici si distinguono nettamente dalle linee guida adottate dalle Organizzazioni internazionali perché in essi l'impresa si fa creatrice e destinataria di norme, create non perché la necessità provenga dal diritto, ma dall'interesse dell'impresa (che, in molti casi, si caratterizza per essere meramente reputazionale). Tali codici, di chiara natura volontaristica, garantiscono il rispetto degli standard di tutela e di promozione dei principi in esso contenuti, stabilendo il più delle volte un meccanismo di monitoraggio e controllo del rispetto delle norme in esso contenute, meccanismo che può essere a carattere interno (gestito quindi da un ufficio interno all'impresa) o a carattere esterno (gestito, il più delle volte, da una ONG o da un sindacato). Infine, la ricerca si conclude con l'analisi dei principali temi che riguardano la RSI negli ultimi anni, ovvero quelli relativi ai profili di responsabilità delle imprese per violazione dei diritti fondamentali e per danni ambientali (con particolare riguardo alla disciplina statunitense contenuta nell'Alien Torts Statute), con particolare riferimento agli obblighi internazionali che incombono sugli Stati attraverso la ricostruzione della prassi internazionale. Inoltre, ulteriore profilo di studio è quello che si concentra sulla possibile estensione della giurisdizione dei tribunali internazionali per crimini internazionali alle persone giuridiche, con particolare riguardo ai lavori preparatori della Conferenza di Roma che ha portato all'istituzione della Corte Penale Internazionale. In conclusione, oggetto della ricerca è stato la ricostruzione del concetto di RSI, il quale è un prodotto degli ordinamenti nazionali ed in particolare degli ordinamenti giuridici degli Stati industrializzati, identificando un framework giuridico che include strumenti normativi di varia natura e in svariati settori, come quelli che disciplinano le società commerciali; le normative nazionali di prevenzione e repressione della corruzione; le normative del settore finanziario ed in particolare quelle sulle borse valori; le discipline a tutela del lavoro, dell'ambiente e del consumatore. Negli Stati più avanzati dal punto di vista economico e istituzionale la RSI, dunque, non è codificata in uno specifico settore regolamentare ma rappresenta un sistema complesso di normative che regolano i diversi aspetti di quelle attività di impresa; nei PVS, invece, tali normative sono spesso frammentarie o addirittura assenti: questa situazione ha permesso alle IMN di avvantaggiarsi dei vuoti legislativi o delle regole stringenti presenti in questi Paesi. Appare evidente come la comunità internazionale abbia constatato la necessità di regolare l'attività delle imprese multinazionali, per la promozione e la protezione dei propri valori fondamentali e di uno sviluppo in un'ottica di sostenibilità ambientale, nell'intenzione di creare un quadro giuridico internazionale che permetta alle imprese di perseguire le proprie finalità aziendali senza perdere di vista le esigenze collettive (in particolare dei Paesi in cui operano). Per raggiungere tale obiettivo, appare inevitabile un'evoluzione del diritto internazionale vigente, i cui processi di formazione, gestiti sostanzialmente dai Governi, non possono non tenere conto dell'accresciuto ruolo e peso delle IMN e della società civile. ; In today's economic and political world characterized by globalization and interdependence of markets, by an increasingly internationalization of production processes and by business operations of the company conducted simultaneously in several countries, by an increased consumer awareness regarding compliance of production processes to values that are considered essential by civil society, as fundamental human rights and labour and environmental protection, MNEs have a fundamental role in addressing the global economic trends. In this perspective, then, the concept of corporate social responsibility attracts companies to consider carefully - in the definition of its strategy and in the articulation of policies and procedures daily management - the various interests of the community, as well as the impact of its activities, not only in economic terms but also in social, environmental and ethical issues. Social responsibility is, therefore, a useful tool for the enterprise and effective way to respond to the needs and demands of civil society.With the CSR arises, therefore, a theory of business that sees the production of goods not only as a means of profit, but also as an opportunity for the realization of social welfare, as dictated bythe school of thought of thebusiness ethics, which invite companies to take action in orderto eliminate and prevent social inequities and promote community development. This need was also consequential to the abusescommitted by transnational corporations that have caused serious damage to human communities of their host countries. Abuses committed by companies, not always related to specific violations of national laws, have been gradually interpreted and constructed as a violation or misconduct against a set of principles defined as belonging to a broad spectrum of social responsibility international, which implies loss of reputation and, therefore, the possible reduction of its share on the market where the key stakeholders concerned can mobilize public opinion on a large scale. Since the 70s, several international organizations have begun to deal with the regulation of transnational corporations, highlighting the role that multinational corporations are called to play in the process of protection of human rights and of the environment that emerge in the course of their economic activity. Is fundamental for the work plan, define the multinational enterprise, by analysing the various instruments adopted by international organizations and doctrinal contributions on the subject, the light of which it seems possible to say that the character of "multinationality" or "transnationality" is the presence of various operating units, located in different countries, which are under the control (equity or management) of a single holding company; the distinction between operational units extends to the legal point of view, as the individual subsidiaries are independent legal entities subject, relatively to the profiles of the regulation and constitution, subjected to the legal system of the State of nationality. It often means that companies choose the host country on the basis of convenience that this country provides in relation to the tax treatment, labour costs and raw materials, to the rules on environmental protection. It therefore seems necessary to attempt to regulate multinational enterprises by supranational bodies, in relation to the increasing number of companies operating in multiple markets (more than 80,000 companies with about 900,000 subsidiaries), to their economic and employment (an estimated 80 million job opportunities) and following several incidents involving such companies from the '70s to today, as in the case of Drummond or Del Monte, accused of severe repression of trade union rights and social rights of workers, or Chevron/ Texaco and Union Carbide, responsible for environmental disasters including that of Bhopal, India, to the case of the environmental disaster caused by the Deepwater Horizon rig off the coast of Florida and Louisiana between 2010 and 2011, or cases of human rights violations and commission of international crimes (arbitrary detention, torture, rape, inhumane and degrading treatment) by transnational corporations operating in the mining industry in Africa and South East Asia, made directly or through the militias hired to the protection of plants. The activities of international organizations, from the 70s, focused on the theme, the OECD, the International Labour Organization, the International Chamber of Commerce adopted in those years, recommendations and declarations addressed to the Member States and the companies for adherence to certain principles and rights already provided by other conventional instruments; also the United Nations, first through the work of the Committee on Multinational Enterprises and then through the subcommittee for the protection and promotion of human rights, have dealt with the matter, coming to the elaboration of a Code of Conduct for Multinational Enterprises (never adopted) and rules on the responsibilities of transnational corporations and other business enterprises with regard to human rights, alongside to the public-private partnership of the Global Compact. Still, other international organizations such as the World Health Organization, the WTO, the World Bank, the International Standards Organization (which as a private nature), have taken actions that invite businesses to carry out its production activities in full respect of fundamental human rights, of local communities needs and of the environment, and then taking into account not only the interests and rights of the shareholders but to all those involved in various ways affected the activity or business. Finally, it is the work of the Special Representative of the UN Secretary-General John Ruggie to develop a framework (called Protect, Respect, Remedy) concerning the relationship between business and human rights. The characteristic of the analysed tools is their non-binding nature, then merely hortatory and voluntary application. This situation is linked mainly to two reasons: the disputed international subjectivity of multinational enterprises and the opposing views of Governments on the subject (with obvious differences of views between developing countries and industrialized countries). Regard to the subjectivity of transnational corporations, or the status of being holders of rights and obligations arising from international law, international legal theory is strongly divided. According to one view, MNEs would not be subject to international law as they are only recipients of rules, and then the "object" of international law would be subject only to the jurisdiction of the state, and bound by international law only by virtue of the reference made by the domestic legal system. Since the '60s, a different doctrinal trend began to make his way starting from the known opinion Reparations for Injuries of the International Court of Justice, and then considering the company as a subject of international law, by virtue of a series of rights and duties which are assigned to it by international law, especially in the field of investment and international contracts (among them, the right to appeal an arbitration tribunal or judicial character arbitration). In addition, the constant attention to the activities of MNEs by international organizations, could witness the nascent opiniojuris to give ainternational subjectivity to businesses, albeit limited. An analysis of international practice have taken provisional findings, in particular that the company, especially in the field of economic law and investment, possesses an international limitedlegal personality and mainly derived from the will of the States, but above all functional, as contained in limits established by international treaty (BITs) or international agreement that establishes rights and obligations for the same. In recent years the European Union has begun to promote adhesion of the companies core values of human rights, labour standards and sustainable development. From the Green Paper of 2001, the EU has developed progressively a European strategy for corporate social responsibility, described as spontaneous adoption of practices to contribute to the improvement of society and the quality of the environment. The EU strategy is characterized by having an internal dimension to the company, establishing a series of action programs and the adoption of management systems, processes, and external to it, calling for the involvement of local communities, commercial partners, customers, suppliers, NGOs, state authorities. To this end, the EU launched a series of initiatives, such as EMAS and Ecolabel certification ecological and environmental audit, the multi-stakeholder forum, to form a legal framework to regulate public procurement and environmental sustainability, protection of consumer, misleading advertising, and the adoption of sectorial codes of conduct based on the principles of CSR. The regulatory activities of CSR has received a grant from the multinational enterprises themselves, in the sense of a self-regulation of their activities, through codes of conduct adopted by each company independently according to their own strategies and values. These codes can be clearly distinguished from the guidelines adopted by international organizations because in them the company is the creator and recipient of rules, created not because the need comes from the law, but by the company (which, in many cases, characterized by being merely reputational). These codes, clearly voluntary, ensure compliance with standards for the protection and promotion of the principles contained therein, setting most of the time a mechanism for monitoring and enforcement of the rules it contains, a mechanism that may be internal character (then managed by an office inside the company) or external character (managed, in most cases, an NGO, or a trade union). Finally, the research concludes with an analysis of the main issues concerning CSR in recent years, namely those related to the profiles of corporate responsibility for violation of fundamental rights and environmental damage (especially with regard to U.S. regulations contained in the Alien Tort Statute), with particular reference to international obligations on states through the reconstruction of the international practice. In addition, further study is to profile that focuses on the possible extension of the jurisdiction of international tribunals for crimes under international law to legal persons, with particular reference to the drafting history of the Rome Conference that led to the establishment of the International Criminal Court. In conclusion, the object of the research was the reconstruction of the concept of CSR, which is a product of national law and in particular the legal systems of the industrialized countries, identifying a legal framework that includes legal instruments of various types and in various sectors, such as those governing commercial companies, national regulations for the prevention and combating of corruption; regulations of the financial sector and in particular those on stock exchanges; disciplines to protect labour, the environment and the consumer. In the most advanced in terms of economic and institutional CSR, therefore, is not encoded in a specific sector regulation but it is a complex system of regulations governing various aspects of the business activities, in developing countries, however, these rules are often fragmentary or even absent: this situation has allowed MNCs to take advantage of loopholes in the law or stringent rules present in these countries. It is evident that the international community has identified the need to regulate the activities of multinational enterprises, for the promotion and protection of its fundamental values and development in a sustainable environment, with the intention to create an international legal framework that allows companies to pursue their own business purposes without losing sight of the collective needs (in particular in the countries in which they operate). To achieve this goal, it is inevitable evolution of international law, whose formation processes, managed largely by governments, cannot fail to take into account the increased role and weight of MNEs and civil society. ; Dottorato di ricerca in Persona, impresa e lavoro: dal diritto interno a quello internazionale (XXV ciclo)
L'ermeneutica filosofica di Hans-Georg Gadamer – indubbiamente uno dei capisaldi del pensiero novecentesco – rappresenta una filosofia molto composita, sfaccettata e articolata, per così dire formata da una molteplicità di dimensioni diverse che si intrecciano l'una con l'altra. Ciò risulta evidente già da un semplice sguardo alla composizione interna della sua opera principale, Wahrheit und Methode (1960), nella quale si presenta una teoria del comprendere che prende in esame tre differenti dimensioni dell'esperienza umana – arte, storia e linguaggio – ovviamente concepite come fondamentalmente correlate tra loro. Ma questo quadro d'insieme si complica notevolmente non appena si prendano in esame perlomeno alcuni dei numerosi contributi che Gadamer ha scritto e pubblicato prima e dopo il suo opus magnum: contributi che testimoniano l'importante presenza nel suo pensiero di altre tematiche. Di tale complessità, però, non sempre gli interpreti di Gadamer hanno tenuto pienamente conto, visto che una gran parte dei contributi esegetici sul suo pensiero risultano essenzialmente incentrati sul capolavoro del 1960 (ed in particolare sui problemi della legittimazione delle Geisteswissenschaften), dedicando invece minore attenzione agli altri percorsi che egli ha seguito e, in particolare, alla dimensione propriamente etica e politica della sua filosofia ermeneutica. Inoltre, mi sembra che non sempre si sia prestata la giusta attenzione alla fondamentale unitarietà – da non confondere con una presunta "sistematicità", da Gadamer esplicitamente respinta – che a dispetto dell'indubbia molteplicità ed eterogeneità del pensiero gadameriano comunque vige al suo interno. La mia tesi, dunque, è che estetica e scienze umane, filosofia del linguaggio e filosofia morale, dialogo con i Greci e confronto critico col pensiero moderno, considerazioni su problematiche antropologiche e riflessioni sulla nostra attualità sociopolitica e tecnoscientifica, rappresentino le diverse dimensioni di un solo pensiero, le quali in qualche modo vengono a convergere verso un unico centro. Un centro "unificante" che, a mio avviso, va individuato in quello che potremmo chiamare il disagio della modernità. In altre parole, mi sembra cioè che tutta la riflessione filosofica di Gadamer, in fondo, scaturisca dalla presa d'atto di una situazione di crisi o disagio nella quale si troverebbero oggi il nostro mondo e la nostra civiltà. Una crisi che, data la sua profondità e complessità, si è per così dire "ramificata" in molteplici direzioni, andando ad investire svariati ambiti dell'esistenza umana. Ambiti che pertanto vengono analizzati e indagati da Gadamer con occhio critico, cercando di far emergere i principali nodi problematici e, alla luce di ciò, di avanzare proposte alternative, rimedi, "correttivi" e possibili soluzioni. A partire da una tale comprensione di fondo, la mia ricerca si articola allora in tre grandi sezioni dedicate rispettivamente alla pars destruens dell'ermeneutica gadameriana (prima e seconda sezione) ed alla sua pars costruens (terza sezione). Nella prima sezione – intitolata Una fenomenologia della modernità: i molteplici sintomi della crisi – dopo aver evidenziato come buona parte della filosofia del Novecento sia stata dominata dall'idea di una crisi in cui verserebbe attualmente la civiltà occidentale, e come anche l'ermeneutica di Gadamer possa essere fatta rientrare in questo discorso filosofico di fondo, cerco di illustrare uno per volta quelli che, agli occhi del filosofo di Verità e metodo, rappresentano i principali sintomi della crisi attuale. Tali sintomi includono: le patologie socioeconomiche del nostro mondo "amministrato" e burocratizzato; l'indiscriminata espansione planetaria dello stile di vita occidentale a danno di altre culture; la crisi dei valori e delle certezze, con la concomitante diffusione di relativismo, scetticismo e nichilismo; la crescente incapacità a relazionarsi in maniera adeguata e significativa all'arte, alla poesia e alla cultura, sempre più degradate a mero entertainment; infine, le problematiche legate alla diffusione di armi di distruzione di massa, alla concreta possibilità di una catastrofe ecologica ed alle inquietanti prospettive dischiuse da alcune recenti scoperte scientifiche (soprattutto nell'ambito della genetica). Una volta delineato il profilo generale che Gadamer fornisce della nostra epoca, nella seconda sezione – intitolata Una diagnosi del disagio della modernità: il dilagare della razionalità strumentale tecnico-scientifica – cerco di mostrare come alla base di tutti questi fenomeni egli scorga fondamentalmente un'unica radice, coincidente peraltro a suo giudizio con l'origine stessa della modernità. Ossia, la nascita della scienza moderna ed il suo intrinseco legame con la tecnica e con una specifica forma di razionalità che Gadamer – facendo evidentemente riferimento a categorie interpretative elaborate da Max Weber, Martin Heidegger e dalla Scuola di Francoforte – definisce anche «razionalità strumentale» o «pensiero calcolante». A partire da una tale visione di fondo, cerco quindi di fornire un'analisi della concezione gadameriana della tecnoscienza, evidenziando al contempo alcuni aspetti, e cioè: primo, come l'ermeneutica filosofica di Gadamer non vada interpretata come una filosofia unilateralmente antiscientifica, bensì piuttosto come una filosofia antiscientista (il che naturalmente è qualcosa di ben diverso); secondo, come la sua ricostruzione della crisi della modernità non sfoci mai in una critica "totalizzante" della ragione, né in una filosofia della storia pessimistico-negativa incentrata sull'idea di un corso ineluttabile degli eventi guidato da una razionalità "irrazionale" e contaminata dalla brama di potere e di dominio; terzo, infine, come la filosofia di Gadamer – a dispetto delle inveterate interpretazioni che sono solite scorgervi un pensiero tradizionalista, autoritario e radicalmente anti-illuminista – non intenda affatto respingere l'illuminismo scientifico moderno tout court, né rinnegarne le più importanti conquiste, ma più semplicemente "correggerne" alcune tendenze e recuperare una nozione più ampia e comprensiva di ragione, in grado di render conto anche di quegli aspetti dell'esperienza umana che, agli occhi di una razionalità "limitata" come quella scientista, non possono che apparire come meri residui di irrazionalità. Dopo aver così esaminato nelle prime due sezioni quella che possiamo definire la pars destruens della filosofia di Gadamer, nella terza ed ultima sezione – intitolata Una terapia per la crisi della modernità: la riscoperta dell'esperienza e del sapere pratico – passo quindi ad esaminare la sua pars costruens, consistente a mio giudizio in un recupero critico di quello che egli chiama «un altro tipo di sapere». Ossia, in un tentativo di riabilitazione di tutte quelle forme pre- ed extra-scientifiche di sapere e di esperienza che Gadamer considera costitutive della «dimensione ermeneutica» dell'esistenza umana. La mia analisi della concezione gadameriana del Verstehen e dell'Erfahrung – in quanto forme di un «sapere pratico (praktisches Wissen)» differente in linea di principio da quello teorico e tecnico – conduce quindi ad un'interpretazione complessiva dell'ermeneutica filosofica come vera e propria filosofia pratica. Cioè, come uno sforzo di chiarificazione filosofica di quel sapere prescientifico, intersoggettivo e "di senso comune" effettivamente vigente nella sfera della nostra Lebenswelt e della nostra esistenza pratica. Ciò, infine, conduce anche inevitabilmente ad un'accentuazione dei risvolti etico-politici dell'ermeneutica di Gadamer. In particolare, cerco di esaminare la concezione gadameriana dell'etica – tenendo conto dei suoi rapporti con le dottrine morali di Platone, Aristotele, Kant e Hegel – e di delineare alla fine un profilo della sua ermeneutica filosofica come filosofia del dialogo, della solidarietà e della libertà. ; The philosophical hermeneutics of Hans-Georg Gadamer – one of the cornerstones in the 20th century philosophy – certainly represents a compound, prismatic and articulated thought, i.e. a philosophy made up of several different dimensions entwined with each other. A simple look at Gadamer's major work Wahrheit und Methode (1960) can already clarify this point, since the book displays a theory of understanding which takes account of three different dimensions of human experience – art, history and language – obviously conceived as mutually related. But this picture gets a lot more complicated if one takes into consideration the many books and articles Gadamer wrote before and after his magnum opus which testify the presence of other interests and topics in his thought. Nevertheless the complexity of Gadamer's philosophical hermeneutics has not always been recognized by his interpreters, who often concentrated only upon Wahrheit und Methode (in particular upon the problems of the Geisteswissenschaften) and gave no attention to other subjects (in particular the ethical and political dimension of his hermeneutical philosophy). Moreover it seems to me that many interpreters didn't pay enough attention to the fundamental unity – which of course doesn't mean "sistematicity" – that reigns in Gadamer's philosophy despite its pluralist and heterogeneous character. My point is that the many dimensions of Gadamer's philosophical hermeneutics – aesthetics and human sciences, language philosophy and moral philosophy, dialogue with the Greeks and critical confrontation with modern thought, reflections upon anthropological problems and observations concerning our actual sociopolitical, scientific and technological condition – actually represent the different sides of one thought centered on what we could define the malaise of modernity. In other words, it seems to me that the whole of Gadamer's philosophy originates from the consciousness raising of the critical situation in which our world finds itself today: a deep crisis which, according to Gadamer, branches out into manifold directions and various dimensions of human life. My interpretation tries then to give an account of both the pars destruens and pars costruens of Gadamer's philosophy, namely of his attempt to investigate and take a hard look at this critical dimensions of human existence in order to let out the point at issue and propose remedies, alternatives and possible solutions. In the first section – entitled Phenomenology of modernity: the various symptoms of the crisis – I explain how a great part of the 20th century philosophy has been concerned with the idea and the feeling of a crisis of our culture and our civilization. In my view Gadamer's hermeneutics too takes part in this global philosophical discourse. I try then to show and illustrate the various symptoms of this crisis analyzed by Gadamer, such as: socioeconomic pathologies of our bureaucratic societies; world-wide growth of the Western way of life to the detriment of other cultures; crisis of our values and beliefs (and consequent spread of relativism, skepticism and nihilism); growing inability to have meaningful relations with art, poetry and culture; finally, problems concerning the proliferation of weapons of mass destruction, the risk of an ecological crisis, and the disturbing, unpredictable consequences of some recent scientific discoveries (above all in the field of genetics). Once outlined Gadamer's critical view of our age, in the second section – entitled Diagnosis of the malaise of modernity: the spread of instrumental and techno-scientific reason – I try to show how, according to Gadamer, a common root lies at the base of the many symptoms of the crisis, namely the birth of modern science and its close, intrinsic relationship with technique and with a specific form of rationality that Gadamer – with reference to the analysis developed by such thinkers as Max Weber, Martin Heidegger and the so-called Frankfurt School – calls «instrumental reason» or «calculating thinking». I try then to give an account of the gadamerian conception of techno-science, meanwhile highlighting some aspects: first, how Gadamer's philosophical hermeneutics should not be interpreted as an antiscientific thought but rather as an antiscientistic thought (which of course is something quite different); second, how Gadamer's reconstruction of the malaise of modernity never ends up in a "totalizing" critique of reason, nor in some sort of negativistic and pessimistic philosophy of history centered on the idea of an inescapable course of the events guided by a polluted, "irrational" rationality; third, how Gadamer – despite all the inveterate interpretations that read his philosophy as a form of authoritarian, traditionalist and antienlightenment thought – never aimed to reject the modern scientific Enlightenment tout court but rather to "correct" some of its tendencies and so to regain a wider and more comprehensive concept of reason. After having analyzed in the first two sections the pars destruens of Gadamer's philosophy, in the third and last section of my work – entitled Therapy of the crisis of modernity: the rediscovery of experience and practical knowledge – I take into consideration the pars costruens of his thought, which according to my interpretation consists of a rediscovery of what he calls «a different kind of knowledge», i.e. of a rehabilitation of the all those forms of pre- and extra-scientific experience that constitute the «hermeneutical dimension» of human life. My analysis of Gadamer's conception of understanding and experience – seen as forms of «practical knowledge» different in principle from theoretical and technical knowledge – leads then to a global interpretation of philosophical hermeneutics as practical philosophy, i.e. as a philosophical elucidation of the prescientific, intersubjective and "of commonsense" reasoning which characterizes our «life-world» and our practical life. But obviously this analysis also implies a special consideration of the ethical and political implications of Gadamer's thought. In particular, I try to examine Gadamer's conception of ethics – taking account of his relation with Plato's, Aristotle's, Kant's and Hegel's moral theories – and finally I sketch an outline of his philosophical hermeneutics as a philosophy of freedom, dialogue and solidarity.
