Próleg i epíleg també en castellà ; The thesis "The form of living in modern Belgian architecture" is a travel through the most industrialized cities of Belgium. lts main objective is to investigate the history of the social habitat in this country, with the aim to reveal the essence of the Belgian modernity and its compromise with the architecture and town planning. Through an excursus on the social housing development, from the nineteenth century to the garden-city,the investigation proposes an historical reconstruction of the modern social housing with a particular emphasis on the importance, growth and tate of neighbourhoods with high-density population. In fact, the hypothesis of this work is that the collective housing has been the innovative element in the experience of a new method of urban planning, and thus a generator cell of Belgian modernity. The research bases itself on the analysis of two projects of workers-city, Grand Hornu and Bois du Luc, built in the nineteenth century using architectural quotations and allusions to try to shape a new reality: the monad life-work. From this time onwards, the social architecture in Belgium was the protagonist of a major evolution concerning the birth of metropolis. Starting from the late nineteenth century, Belgian hygienists gathered the attention around the problem of living in an healthy city, and the need to offer to the workers, most of whom were employed in the many coal mines of the country, a dignified housing. At this time, the garden-city was becoming the most diffused spatial conformation supporting the belief that living in a natural environment could have restored the purity subtracted from the poisons of the devourer city. The new garden-city acted as an organism to encourage the construction of new housing and to propose solutions that consecrated the desire to give to the city a modern future, which could have been an example to export . Without doubts, the rising of architectural and urban theories urged the Belgian society to take care of the issues concerning new lifestyles and therefore experiment novel models of community with the aim to renew the society itself. In the early twentieth century, the enthusiasm of young architects animated Victor Bourgeois (1897-1962) , Huib Hoste (1881-1957), Louis Van der Swaelmen (1883-1929) and Anto ine Pompe (1873-1980) to be active in the debate forwarded by the CIAM, which resulted in the division into two main architectural trends pursuing either the line or the organic form. Later on, the debate on social housing became the cradle for chimeric suggestions, like the one presented in the thirties by the architect Juliaan Schillemans (1906-1943) ,who designed an ideal "world-city ", for thirty-five millions inhabitants, with the aim to redefine the style lifestyle of a society without boundaries. More pragmatically, in the 50s, architects groups like EGAU (Etudes en groupe d'architecture et d'urbanisme), formed by Charles Carlier (1916-1993), Hyacinthe Lhoest (1913 to 1983) and Jules Mozin (1914- 1995) and the Groupe L'Equerre (1935) raised, through a fervent political activism, a reflection on the topic of housing and how to redesign new spaces. In particular, L'Equerre collaborated with the Flemish architect Renaat Braem (1910-2001) who considered architecture as the art to reorganize the human, environment and an instrument to free the society from the hierarchies inherited from the past. On the other side, the works of Groupe EGAU and the architect Willy Van Der Meeren (1923-2002) distinguished themselves in the same current for a strenuous research in the low cost housing field and for the housing solutions presented in the competition organized by CECA (European Coal and Steel Community). ; La Tesi, intitolata La forma del/'abitare nell'architettura moderna belga, e un viaggio, attraverso le citta piu industrializzate del Belgio, che si propone, come obiettivo principale, di fare luce sulla storia dell'habitat sociale in questo paese, per rivelare l'essenza della modernita belga e il suo compromesso con l'architettura e l'urbanistica. Mediante un excursus sullo sviluppo delle abitazioni collettive, dai principi dell'Ottocento alle citta giardino, l'investigazione pretenderebbe di ricostruire la storia degli alloggi sociali moderni e l'importanza dei quartieri ad alta densita abitativa, la loro crescita e il loro destino. lnfatti, l'ipotesi e che e proprio l'abitazione collettiva sia stata !'elemento singolare nell'esperienza di un nuovo metodo di progettazione urbana, come cellula generatrice della modernita belga. Lo studio prende spunto dall'interesse per i progetti delle citta operaie di Grand Hornu e Bois du Luc, edificate nel XIX secolo, che sfruttarono citazioni e allusioni architettoniche per cercare di costruire una nuova realta: quella della monade vita-lavoro. Da questo periodo in poi, l'architettura sociale in Belgio fu l'attrice di una evoluzione importante, avente ad oggetto la nascita della metropoli. Dalla fine del XIX secolo, gli igienisti belgi manifestarono il problema della salubrita della citta, e della necessita di poter offrire agli operai, la maggior parte dei quali impiegati nelle numerase miniere di carbone del paese, delle abitazioni degne. lnoltre, in questo periodo, si appoggio con decisione la conformazione spaziale proposta dalle citta giardino, avvallando la convinzione che reintrodursi in un ambiente naturale avrebbe potuto ristabilire la purezza sottratta dai veleni della citta divoratrice. Le nuove citta giardino funsero da organismi che incoraggiavano la costruzione di nuovi alloggi e proponevano soluzioni che consacravano il desiderio di conferire alla citta moderna un avvenire che avrebbe potuto essere un exemplum da esportare. Senza dubbio, le nuove teorie architettoniche e urbanistiche esortarono la societa belga a sollevare nuove questioni sullo stile di vita e a sperimentare nuovi modelli di collettivita, volti al rinnovo della societa. L'entusiasmo dei giovani architetti del primo Novecento animo Víctor Bourgeois (1897-1962), Huib Hoste (1881-1957), Louis Van der Swaelmen (1883-1929), Antoine Pompe (1873-1980) a essere attivi nel dibattito avanzato dai CIAM, e, a dividersi in due correnti architettoniche, perseguendo la linea piuttosto che la forma organica. In seguito, il dibattito sulle abitazioni sociali divenne la cuila per proposte chimeriche, come quella presentata, negli anni trenta, dall'architetto Juliaan Schillemans (1906-1943), il quale disegno un'ideale "citta mondiale", pensata per ben trentacinque milioni di abitanti, con lo scopo di ridefinire il modus vivendi di una societa senza confini. In maniera piu pragmatica, negli anni '50, si consolidarono gruppi di architetti come gli EGAU (Etudes en groupe d'architecture et d'urbanisme), formato da Charles Carlier (1916-1993), Hyacinthe Lhoest (1913- 1983) e Jules Mozin (1914-1995), e l'Equerre (1935) che imposero, attraverso un fervente attivismo político, una riflessione sul tema dell'alloggio e si adoperarono nel ridisegnare nuovi spazi. Con l'Equerre collaboro l'architetto fiammingo Renaat Braem (1910-2001) che considerava l'architettura come l'arte della riorganizzazione del medio umano e un mezzo per liberare la societa dalle gerarchie ereditate nel passato. La presente Tesi di Dottorato sara spunto futuro di comprensione di come il moderno modello di gestione dello spazio si sia evoluto in epoca odierna. Il microcosmo delle colonie di carbone connotava un interno artificiale che l'investigazione aspira a intendere, decifrando tutta la complessita di un progetto d'architettura nelle sue fasi di ideazione, costruzione e rilettura, e ponderando gli intrecci tra storia, paesaggio, aree periferiche con gli ancestrali vincoli tra architettura, citta, habitat. ; La Tesis, "La forma dell'abitare nell'architettura moderna belga", es un viaje, a través de las ciudades más industrializadas de Bélgica, que se propone, como objetivo principal de estudio de analizar la singular historia del hábitat social de este país para revelar la esencia de la modernidad belga y su compromiso con la arquitectura y el urbanismo. Gracias a un excursus sobre el desarrollo de las viviendas colectivas, desde los principios del siglo XIX, hasta las ciudades jardín, se pretende, reconstruir la historia de la vivienda social moderna y la importancia de los barrios con alta densidad residencial, sus crecimientos y su desarrollo. La hipótesis plantea cómo la vivienda colectiva constituye el elemento singular en la experiencia de un nuevo método de proyectación urbana, como célula generadora de la modernidad belga. La investigación surge del interés por los proyectos de las ciudades obreras del Grand Hornu y de Bois du Luc, edificadas en el XIX siglo, que utilizaron símbolos e alusiones arquitectónicas para construir una nueva realidad: la mónada vida-trabajo. A partir de este momento en adelante, la arquitectura social en Bélgica fue el centro de una importante evolución sobre el nacimiento de la metrópoli. Asimismo, desde el final del siglo XIX, los higienistas belgas habían planteado el problema de la salubridad de la ciudad y la necesidad de poder ofrecer unas viviendas dignas a la clase trabajadora mayoritariamente, empleados en las numerosas minas de carbón del país. En este período, se consolida la configuración espacial propuesta por las ciudades jardín, que pretende reestablecer la relación con el entorno natural y recuperar la salubridad afectada por los contaminantes de la ciudad industrial. Las nuevas ciudades jardín promovieron la construcción de nuevos alojamientos y además ofrecieron soluciones que confirmaban el deseo de otorgar a la ciudad moderna un futuro que hubiese podido ser un modelo a exportar. Sin duda, las nuevas teorías arquitectónicas y urbanas sugirieron la voluntad de impulsar a la sociedad belga a experimentar nuevos modelos colectivos. Este intenso deseo de reformar el estilo de vida, constituye un importante aspecto para analizar, en el curso de la tesis, las cuestiones planteadas por los utopistas y sus experiencias comunitarias. El entusiasmo de los jóvenes arquitectos del siglo XX, Víctor Bourgeois (1897-1962}, Huib Hoste (1881-1957), Louis Van der Swaelmen (1883-1929) ó Antaine Pompe (1873-1980), suscitó su participación en el debate de los CIAM y los impulsa a dividirse en dos tendencias arquitectónicas, persiguiendo la línea antes que la forma orgánica. Posteriormente, estos ensayos iniciales serán la base para la mayoría de las propuestas visionarias como la realizada por el arquitecto de los años treinta Julian Schillemans (1906-1943), que concibe una utópica "ciudad mundial" concebida para treinta y cinco millones de habitantes con el fin de redefinir el modus vivendi de una sociedad sin fronteras. De una manera más pragmática, en los años 50, la consolidación de grupos de arquitectos como los EGAU, (Etudes en groupe de architecture et de urbanisme), formado por Charles Carlier (1916-1993), Hyacinthe Lhoest (1913-1983) y Jules Mozin (1914- 1995) y l'Equerre (1935) planteó, a través de un ferviente activismo político, una reflexión sobre el tema del alojamiento y se afanó en rediseñar nuevos modelos. L'obiettivo della tesi è analizzare in profondità un tema complesso come la povertà. Il fenomeno è in costante crescita, distribuito in modo sempre più eterogeneo nel territorio, con più categorie di persone a rischio esclusione ed isolamento sociale. Nel testo si propongono numerose definizioni di povertà, trattandosi di un termine polisemico e pertanto complicato e riduttivo da racchiudere in una definizione univoca o del tutto esente da giudizi di valore. L'elaborato ne evidenzia le molteplici dimensioni - sociale, economica, relazionale, sanitaria, alimentare, educativa e culturale - che lo caratterizzano, le cause che lo determinano e le conseguenze che può scaturire. Tuttavia, risulta complicato individuarle con precisione in quanto possono presentarsi congiuntamente e variano in base allo spazio e al tempo, per cui impossibili da generalizzare. Si analizza anche il concetto di esclusione sociale, valutato in rapporto a quello di povertà. I due fenomeni solo apparentemente sono sinonimi perché in realtà non coincidono esattamente: il primo costituisce solo una delle dimensioni, seppur ampia e complessa, del secondo. L'emergere di nuovi bisogni complessi, che hanno colpito sia il singolo individuo che il gruppo e la collettività, ha richiesto un cambiamento operativo a livello istituzionale, dove si incentiva una programmazione integrata socio-sanitaria e si applica un approccio manageriale alle pubbliche amministrazioni; a livello gestionale, in cui si punta a promuovere un metodo di lavoro multidisciplinare e l'utilizzo della co-progettazione come strumento innovativo in campo sociale; a livello professionale, con l'assistente sociale che non è un semplice erogatore di servizi e prestazioni, ma ricopre più ruoli nel corso del processo di aiuto, valuta globalmente la situazione, promuove la risorse della persona e della comunità e favorisce la costruzione di una rete sociale territoriale. Inoltre, vi è la necessità di innovare e rendere più efficienti ed esigibili i servizi e gli interventi assistenziali e cambiare la prospettiva professionale di aiuto. Si passa da un processo di carattere residuale e prevalentemente riparatorio alla costruzione condivisa di interventi personalizzati che promuovono altresì l'autonomia e l'empowerment dell'utente e ne rafforzano la capacità di problem solving e le relazioni sociali. La parte centrale del lavoro, è dedicata al ruolo del Servizio Sociale nel contrasto alla povertà, che ha assunto nel tempo maggiore protagonismo in fase programmatoria ed è stato investito di più funzioni in campo operativo. Il servizio sociale professionale sta progressivamente acquistando una duplice funzione – promozionale e preventiva. Si passa dal lavoro sull'utente al lavoro con l'utente, con il soggetto che non è più passivo all'interno del progetto di aiuto personalizzato, bensì ne diventa parte attiva, superando una logica meramente assistenziale. La nascita di "nuove povertà", spesso derivanti da cause diverse e plurime, ha ampliato le categorie di persone a rischio povertà, che le politiche sociali e il sistema di welfare non riescono a ridurre. Si descrivono i soggetti più vulnerabili e le tipologie di bisogni che possono manifestarsi nel corso della vita della persona, riprendendo la classificazione piramidale di Maslow. Si valorizzano la modalità di lavoro multidisciplinare, le reti sociali e lo strumento della co-progettazione. La partecipazione di più professionisti e/o volontari consente di integrare competenze, punti di vista e risorse per poter rispondere in modo più efficiente e mirato alle esigenze del cittadino o della comunità. Le reti sociali rappresentano una elemento importante per la definizione di un progetto di aiuto in quanto consentono di mettere in campo le risorse informali esistenti, integrarle con i servizi territoriali e valorizzare/rafforzare i legami sociali per contrastare il disagio, ridurre le fragilità e prevenire l'emergere di una nuova situazione di difficoltà. La co-progettazione è uno strumento che promuove una partnership formale tra pubblica amministrazione, terzo settore e società civile, finalizzata alla realizzazione di interventi sociali integrati e innovativi. Si affronta il tema della lotta alla povertà e all'esclusione sociale dal punto di vista politico, che negli ultimi anni ha assunto un ruolo centrale all'interno delle agende nazionali, portando all'attuazione di diverse politiche sociali per contrastarne e prevenirne la diffusione. Uno sguardo più generale è stato rivolto al panorama europeo, esaminando le principali strategie di intervento e di programmazione sociale, per poi concentrarsi sul caso italiano, descrivendo il sistema di welfare nazionale e locale e le politiche di inclusione sociale, sempre più orientate al duplice obiettivo di sostegno economico e autodeterminazione del beneficiario. Un'importante attenzione è dedicata al contesto territoriale quale luogo più vicino al cittadino e ambito di riferimento per l'analisi di bisogni, risorse, potenzialità e criticità. La sfida attuale è quella di promuovere una comunità in grado di "autocurarsi" e di creare una rete assistenziale socio-sanitaria per potenziare e rendere più efficace il pacchetto dei servizi offerti e disincentivare l'istituzionalizzazione della persona. La seconda parte del testo si riporta l'esempio di quanto è stato attuato in una realtà territoriale per il contrasto alla povertà e all'esclusione sociale. Si analizza quindi la strategia adottata nel Comune di Capannori, quale ente capofila della Piana di Lucca e una delle zone distretto professionalmente più avanzate, in cui è stato co-costruito un tavolo tecnico, potenziata l'equipe multidisciplinare ed incentivata la co-progettazione con il Terzo settore, promuovendo la nascita di un nuovo modello operativo. Si descrivono brevemente alcuni progetti realizzati nel territorio, relativi all'inclusione sociale e lavorativa, al supporto educativo e familiare e all'emergenza abitativa, evidenziando la presa in carico multidisciplinare e la collaborazione tra enti pubblici e del privato sociale. Nel capitolo conclusivo, viene descritta l'evoluzione della povertà dopo la crisi economica del 2008 da un punto di vista maggiormente statistico, anche qui rivolgendo un duplice sguardo al contesto europeo ed italiano. La parte finale è dedicata ad una lettura della situazione in relazione all'impatto generato dalla pandemia Covid-19, che ha avuto forti ripercussioni sia sulla salute dei cittadini che sul mercato del lavoro e sull'economia mondiale, facendo registrare un aumento esponenziale del numero di persone e famiglie a rischio povertà e la crescita della forbice della disuguaglianza. The goal of the thesis is to analyze in depth a complex issue such as poverty. The phenomenon is constantly growing, distributed in an increasingly heterogeneous way in the territory, with more categories of people at risk of social exclusion and isolation. Numerous definitions of poverty are proposed in the text, since it is a polysemic term and therefore complicated and reductive to be enclosed in a single definition or completely free from value judgments. The paper highlights the multiple dimensions - social, economic, relational, health, food, educational and cultural - that characterize it, the causes that determine it and the consequences that can arise. However, it is difficult to identify them precisely as they can occur jointly and vary according to space and time, making them impossible to generalize. The concept of social exclusion is also analyzed, evaluated in relation to that of poverty. The two phenomena are only apparently synonymous because in reality they do not exactly coincide: the first constitutes only one of the dimensions, albeit large and complex, of the second. The emergence of new complex needs, which have affected both the individual and the group and the community, has required an operational change at an institutional level, where integrated social and health planning is encouraged and a managerial approach is applied to public administrations; at the management level, which aims to promote a multidisciplinary working method and the use of co-design as an innovative tool in the social field; at a professional level, with the social worker who is not a simple provider of services and benefits, but covers several roles during the help process, evaluates the situation globally, promotes the resources of the person and the community and favors the construction of a territorial social network. Furthermore, there is a need to innovate and make welfare services and interventions more efficient and payable and change the professional perspective of help. We move from a residual and mainly restorative process to the shared construction of personalized interventions that also promote the autonomy and empowerment of the user and strengthen their problem-solving skills and social relationships. The central part of the work is dedicated to the role of the Social Service in combating poverty, which over time has taken on greater prominence in the planning phase and has been invested with more functions in the operational field. The professional social service is gradually acquiring a dual function - promotional and preventive. We move from working on the user to working with the user, with the subject who is no longer passive within the personalized aid project, but becomes an active part of it, overcoming a merely welfare logic. The birth of "new poverties", often deriving from different and multiple causes, has widened the categories of people at risk of poverty, which social policies and the welfare system cannot reduce. The most vulnerable subjects and the types of needs that may arise during the person's life are described, taking up Maslow's pyramid classification. The multidisciplinary working method, social networks and the tool of co-planning are enhanced. The participation of several professionals and / or volunteers makes it possible to integrate skills, points of view and resources in order to respond more efficiently and targeted to the needs of citizens or the community. Social networks represent an important element for the definition of an aid project as they make it possible to deploy existing informal resources, integrate them with local services and enhance / strengthen social ties to combat hardship, reduce fragility and prevent emergence of a new difficult situation. Co-planning is a tool that promotes a formal partnership between public administration, third sector and civil society, aimed at the realization of integrated and innovative social interventions. It deals with the issue of the fight against poverty and social exclusion from a political point of view, which in recent years has assumed a central role within national agendas, leading to the implementation of various social policies to combat and prevent its spread. A more general look was turned to the European panorama, examining the main intervention strategies and social planning, and then focusing on the Italian case, describing the national and local welfare system and the social inclusion policies, increasingly oriented to the dual objective. of economic support and self-determination of the beneficiary. Important attention is paid to the territorial context as a place closest to the citizen and a reference area for the analysis of needs, resources, potential and critical issues. The current challenge is to promote a community capable of "self-healing" and to create a social and health care network to enhance and make the package of services offered more effective and discourage the institutionalization of the person. The second part of the text gives an example of what has been implemented in a territorial reality for the fight against poverty and social exclusion. The strategy adopted in the Municipality of Capannori is then analyzed, as the leading body of the Piana di Lucca and one of the most professionally advanced district areas, in which a technical table has been co-built, the multidisciplinary team strengthened and co-planning with the third sector, promoting the birth of a new operating model. Some projects carried out in the area are briefly described, relating to social and work inclusion, educational and family support and housing emergency, highlighting the multidisciplinary management and collaboration between public and private social entities. In the concluding chapter, the evolution of poverty after the 2008 economic crisis is described from a more statistical point of view, again with a double look at the European and Italian context. The final part is dedicated to a reading of the situation in relation to the impact generated by the Covid-19 pandemic, which has had strong repercussions both on the health of citizens and on the labor market and on the world economy, recording an exponential increase in the number of people and families at risk of poverty and the growth of the inequality gap.
La tesi è stata intitolata "Change the System From Within". La participatory democracy e le riforme istituzionali negli Stati Uniti degli anni Sessanta e si compone di cinque capitoli. Nel primo capitolo si riprende l'idea di participatory democracy emersa in seno alla New Left e ai movimenti sociali dei lunghi anni Sessanta. In questo contesto il concetto di participatory democracy assunse due principali accezioni: da una parte rappresentava la rivendicazione politica di un maggior coinvolgimento attivo della cittadinanza nelle politiche - locali, statali e federali - frutto della crisi di legittimità che la democrazia americana stava attraversando in quegli anni; dall'altra, il concetto venne adottato come principio organizzativo all'interno dei gruppi stessi di attivisti, con la funzione di prefigurare quelle riforme politico-istituzionali cui gli stessi militanti aspiravano. Dalla stessa temperie di contestazione sorse del resto anche la critica che alcuni studiosi mossero alla teoria liberale pluralista e alla sua esemplificazione nella coeva democrazia americana. Nel primo capitolo si mostra proprio come da quelle rielaborazioni critiche degli anni Sessanta emerse anche il primo modello di participatory democracy in seno alla teoria politica, sviluppato pienamente negli anni Settanta e Ottanta da Carole Pateman, Crawford B. Macpherson e Benjamin Barber. Questa parte del lavoro di tesi si propone quindi di accostare alle pratiche partecipative introdotte dai movimenti anche la ricostruzione dello sviluppo graduale di una teoria politica della participatory democracy. Tale riflessione è completata da un'analisi storica di ampio raggio, necessaria a meglio contestualizzare il fenomeno e ad includere le nuove richieste democratiche nell'ambito di una tradizione democratico-rappresentativa già dotata di istituti partecipativi di democrazia diretta. Chiarito il quadro storico-politico degli anni Sessanta, il secondo capitolo analizza la ricezione dell'idea di participatory democracy nelle politiche federali. A questo proposito si illustra come il principio di citizen participation fosse stato recepito già con la War on Poverty promossa da Lindon B. Johnson alla metà degli anni Sessanta e fu mantenuto, con esiti istituzionali differenti, almeno fino alla fine della presidenza Carter. Si dimostra inoltre che, malgrado il dettato legislativo federale fosse spesso approssimativo sulle modalità operative, quel principio ebbe in realtà un notevole impatto sulle relazioni intergovernative. Tale principio favorì ad esempio l'intraprendenza di molti amministratori locali nel promuovere il decentramento amministrativo e politico su base di quartiere. Nel terzo capitolo l'analisi affronta le principali trasformazioni in senso partecipativo avvenute nei sistemi di governo statali e locali negli anni Settanta, mettendole in relazione anche alle dinamiche intergovernative di più lungo periodo. Il capitolo è strutturato in modo tale da evidenziare il tendenziale recupero e rafforzamento di istituti già esistenti, come l'initiative, i public hearing e gli school district come strumenti di rivendicazione del community control in alcune città di grandi dimensioni. Mentre il secondo e terzo capitolo tendono a osservare le riforme istituzionali degli anni Settanta in senso partecipativo in seno al governo federale, statale e locale, i due successivi capitoli mirano ad osservare l'impatto della participatory democracy nel confronto tra attivismo militante e pratiche amministrative tradizionali degli anni Settanta. Il quarto capitolo è infatti dedicato all'ingresso della nuova generazione di politici progressisti nelle amministrazioni locali e statali fra la fine degli anni Sessanta e la prima metà degli anni Settanta. Per analizzarlo si è deciso di analizzare come principale caso di studio la Conference on Alternative State and Local Policy (CASLP), una organizzazione e forum nazionale che mirava proprio ad unire alle istanze dei progressisti una expertise di governo. Nell'ambito della CASLP, la cosiddetta Coalizione progressista di Berkeley, CA, fornì un caso esemplare di strategia di confronto con le istituzioni locali e per questo il capitolo le dedica una attenta disanima. La pluriennale esperienza di azione collettiva dei progressisti di Berkeley nell'arena istituzionale è infatti rilevante sia per l'innovazione nella strategia istituzionale, sia per attestare una evoluzione dell'idea di participatory democracy nel tempo. Il quinto capitolo ricostruisce ed analizza la carriera politica di Tom Hayden negli anni in cui passò dall'attivismo alla politica istituzionale, con la campagna elettorale per diventare Senatore della California in Congresso (1975-1976) e la successiva Campaign for Economic Democracy (1976-1982), confermando la spiccata propensione del leader all'innovazione istituzionale in senso partecipativo. In particolare, nella campagna elettorale per il Senato del Congresso del 1976 Hayden riuscì a implementare forme di decision-making partecipato in seno allo staff. Nella gestione del personale cercò inoltre di favorire l'empowerment di volontari e cittadini senza perdere di vista i requisiti essenziali per la sopravvivenza della campagna: fundraising e propaganda. In linea con la sua battaglia contro le distorsioni economiche del big business, scelse di non accettare fondi da corporation e banche e riuscì nell'intento di essere sostenuto per gran parte da small donors. Hayden dunque introdusse pratiche di participatory democracy in seno alla campagna elettorale e continuò a rivendicare la sua fiducia nella forza dei movimenti grass-roots. L'analisi storica, ad ogni modo, evidenzia anche le criticità che derivavano dall'uso di pratiche partecipative nella governance della campagna elettorale. Atttraverso l'analisi teorica e politico-istituzionale della democrazia partecipativa americana fra gli anni Sessanta e Settanta su vari livelli istituzionali (federale, statale e locale), questo progetto di ricerca tenta quindi di colmare un vuoto storiografico e, al tempo stesso intende contribuire alla definizione storico-istituzionale della participatory democracy in seno alla democrazia rappresentativa degli Stati Uniti. Infine, la presente ricerca mira a inserirsi nel dibattito pubblico contemporaneo sulla participatory democracy, offrendo una visione storico-istituzionale importante per meglio comprendere il fenomeno e che, finora, non ha ricevuto l'attenzione che meriterebbe. ; Chapter 1 retrieves the idea of participatory democracy stemmed from the Long 1960s New Left and the following social movements. Indeed, the concept of participatory democracy mainly acquired two slightly different shapes in that historical framework. From one hand, it meant the broad political call for common citizens' greater involvement in the policy-making - at the local, state and federal level. That request was in fact a reply to the ongoing crisis of the American democracy, in terms of political legitimacy and social representation of minorities and poor people. In the other hand, participatory democracy represented the organizing principle adopted by most of the grass-roots groups of that period, with a clear prefigurative function. Indeed, making the activist groups' inner decision-making participatory was a way for the collectives to anticipate the institutional changes they aspired to. In the meantime, because of the same disaffection against the raising social and political inequalities, some political science scholars elaborated a critique to the pluralist version of the liberal democracy - then the most praised one, as well as credited as it was embodied in the American democracy. Those 1960s critiques were eventually used to conceive the first political theory of participatory democracy in the 1970s and 1980s, as Chapter 1 shows. The participatory democracy's canon was in fact mostly developed by Carole Pateman, Crawford B. Macpherson and Benjamin Barber. Beside the intellectual history of participatory democracy from 1960s to 1980s, Chapter 1 allows to contextualize ideas and practices of common citizens' participation into the wider history of the American Political Development. According to that, chapter 1 also provides a detailed analysis of the participatory political institutions that were traditionally part of the United States representative democracy. Chapter 2 verifies whether the 1960s idea of participatory democracy actually affected the federal public policies of the late 1960s and 1970s. Indeed the principle of "citizen participation" was introduced in some of the War on Poverty legislations, promoted by Lyndon B. Johnson since the mid-1960s. Although the heterogeneous institutional effects, that principle was maintained in some grant-in-aid projects until the end of the Carter administration, through the Nixon and Ford administrations. Therefore, the political meanings assumed by the idea of "citizen participation" and its institutional consequences from 1964 to 1980 are carefully analyzed in chapter 2. Moreover, chapter 2 shows that the principle of citizen participation had such a strong impact on the intergovernmental relations. It thus brought forward, for instance, the local public officers' entrepreneurship towards the local devolution, shifting the administrative and political power base from the center to the neighborhood. Chapter 3 deals with the 1970s main institutional reforms aimed at introducing the common citizens' participation in the government decision-making at the state and local levels. Those reforms are deeply related to some long-lasting intergovernmental dynamics and this relationship is also argued. The same chapter's lay-out is vowed to underline the 1970s general trend of retrieval and enhancing of traditional institutions, such as the initiative (direct democracy), the public hearings and the school districts. The school board was indeed reevaluated and reshaped as a means of community control in the biggest cities. As chapters 2 and 3 aim at exploring the implementation of participatory reforms in the federal, state and local level of government, chapters 4 and 5 aim at inquiring the participatory democracy's impact on the 1970s boundary of polity - the space where activism meets political institutions. Chapter 4 inquires the new generations of progressive politicians entering the local and state administrations from the late 1960s to the mid-1970s. To frame that national phenomenon, the historical analysis use the Conference of Alternative States and Local Policies (CASLP) as a case study. CASLP was indeed a national organization born in 1975 to give voice to the progressive public officers around the country and allowed them sharing their government experiences for a more effective institutional impact. Inside CASLP, the progressive coalition of Berkeley, CA (called Berkeley Citizens' Action, BCA) was especially spotted for its exemplary strategy to confront local political institutions. The 1970s BCA's political actions are thus specifically analyzed. In fact, the institutional approach of the Berkeley progressive coalition resulted to be innovative in terms of strategy as well as successful in introducing new forms of participatory democracy into the local government, assessing the 1970s evolution of the participatory democracy political theory and practices. Chapter 5 retraces the political career of the former New Left leader Tom Hayden during the years of turning from activism to institutional politics. Especially, the analysis focuses on the 1975-1976 U.S. Senate Campaign and the following Campaign for Economic Democracy (CED), a coalition project and organization led by Hayden with the goal of mobilizing activists and public officers around the issues of economic justice, environmental and economic public policies (1976-1982). That period - just before Hayden was elected representative at the California Legislature in 1982 - is thus analyzed as a testing ground to verify his long-lasting commitment towards participatory democracy. The historical and political analysis, based on original archival findings, confirms Hayden's inclination for institutional innovation in the participatory realm. In particular, during the 1975-1976 electoral campaign for the U.S. Senate in California Hayden introduced participatory forms of decision-making involving staff people, volunteers and supporting grass-roots groups. Moreover, that campaign's staff and people management was conceived in order to directly empower citizens and volunteers, without losing track of the campaigning basic requirements (e. g. fundraising and propaganda). As he stood against big business and economic inequalities, he chose to reject fundings from corporations and banks. Therefore his electoral campaign was mostly sustained by small donors. Hayden successfully made the campaigning more open, accountable and participatory and kept on sponsoring his trust in community organizing and grass-roots social movements even in his following political endeavour, CED. Eventually, the investigation casts lights on the strengths, as well as the critical issues, produced by the Hayden's participatory governance of campaigning. By the means of analysing the intellectual history and the institutional implementation of participatory democracy during late 1960s-1970s United States, this research project firstly aims at making up the lack of historiography about the topic. In the second stance, grounding the institutional and political history of participatory democracy in the United States representative democracy - where the concept was born - this research project intends to provide a first genealogy of the participatory democracy's institutional implementation. In this sense, the research projects wants also to contribute to the contemporary debate on the participatory democracy. It is indeed a compelling and popular issue in many worldwide political arenas, but it is still rarely defined by its historical and institutional terms.
2009/2010 ; Lo scopo di questa ricerca di dottorato è l'analisi geopolitica di una regione transfrontaliera dell'Asia centrale: la valle del Fergana. Tre anni di ricerca sul campo: l'analisi delle frontiere di questa regione attualmente divisa politicamente tra Uzbekistan, Tagikistan e Kirghizistan, la cartografia analitica, le osservazioni, le interviste alla popolazione e agli esperti, la ricerca nelle biblioteche della regione, nella capitale dell'Uzbekistan, Tashkent (presso l'Istituto Francese di Studi sull'Asia centrale – IFEAC) e la ricerca svolta in Francia principalmente presso l'Istituto Francese di Geopolitica (IFG) e la Biblioteca Nazionale di Francia (BNF), sono gli strumenti che hanno permesso lo studio di questo territorio. Il principale obiettivo del lavoro è l'analisi delle rivalità di potere della valle del Fergana. Grazie alla sua fertilità e alla sua importante posizione strategica all'interno del contesto geopolitico centrasiatico, il bacino del Fergana è stato e continua tuttora ad essere una posta in gioco ambita da differenti attori territoriali. La rivalità di potere tra i diversi attori si gioca soprattutto sullo scenario transfrontaliero della regione. Il secondo scopo di questa ricerca è la presentazione e la valutazione di un particolare attore territoriale della valle, il Regionalismo culturale. La parte introduttiva della ricerca si concentrerà su una presentazione del contesto centrasiatico e sulle peculiarità derivanti dalle sue frontiere. In seguito verrà introdotta la "posta in gioco" Fergana con le sue risorse fisiche ed economiche al fine di legittimare l'importanza del territorio. Infine l'introduzione si concluderà con la teoria geopolitica: il perché della scelta della scuola di geopolitica del geografo francese Yves Lacoste per questa ricerca e una prima analisi dello spazio Fergana come regione divisa tra confine e frontiera. Il lavoro è strutturato in due grandi parti. La prima, più teorica, è relativa all'analisi dei tre attori territoriali. Le rappresentazioni dei differenti attori che verranno presentate, non seguiranno un ordine cronologico, ma un ordine concettuale: eventi simultanei verranno dunque analizzati non nello stesso momento, perché relativi a rappresentazioni differenti del territorio Fergana. Il primo capitolo è consacrato all'attore Nazione. Con questa espressione si intende non solo l'attore Stato-Nazione in sé, o meglio gli Stati-Nazione (Uzbekistan, Tagikistan e Kirghizistan), ma anche la Nazione come idea, come politica nazionalistica applicata ad un territorio. La valle del Fergana è diventata una regione transfrontaliera da quando, negli anni '20, fu divisa tra i tre Stati, allora all'interno della Unione delle Repubbliche Socialiste Sovietiche (URSS). Negli anni '90, in seguito alla caduta dell'URSS, il Fergana divenne una regione divisa da frontiere non più interne ma internazionali. Questo capitolo ha come scopo l'analisi di tutte le rappresentazioni dell'attore Nazione per quanto riguarda il contesto Fergana, dalla sua nascita (anni '20) fino all'indipendenza delle Repubbliche (anni '90). Sicuramente la rappresentazione più importante da analizzare è quella della creazione delle sue frontiere. L'attore Nazione è senza dubbio l'attore geopolitico più importante anche perché quello più legittimato in questo contesto territoriale. Il capitolo approfondirà anche le relazioni tra i differenti Stati-Nazione che rappresentano allo stesso tempo: un unico attore (contro la Religione e il Regionalismo culturale) e tre attori differenti quando competono tra loro per il territorio Fergana. Il secondo attore è la Religione. La valle del Fergana è una delle aree centrasiatiche più credenti e praticanti e la religione islamica ha sempre avuto un ruolo importante nella gestione della società ferganiana. Verrà proposta un'analisi di tutte le rappresentazioni della religione nel Fergana: il sufismo autoctono con un'analisi sulla geografia sacra dei luoghi ferganiani importanti per questa corrente dell'Islam; l'Islam tradizionale del periodo sovietico, divenuto un'arma legale utilizzata da Mosca per combattere l'ortodossia religiosa sufi del Fergana; il fondamentalismo wahabbita degli ultimi anni importato dall'Afghanistan, dal Pakistan, dall'Arabia Saudita, come conseguenza dell'invasione sovietica dell'Afghanistan del 1979 e dunque in seguito all'incontro tra i musulmani sovietici e i mujaheddin afgani. In seguito verrà analizzato come le differenti varianti dell'attore Religione si sono opposte, negli anni, all'attore Nazione per il controllo del potere e delle risorse del territorio Fergana. Un fenomeno particolarmente analizzato sarà la politicizzazione dell'attore Religione e come questa politicizzazione ha portato l'attore in questione ad essere l'elemento protagonista di numerosi eventi nel Fergana. Il terzo attore è il Regionalismo culturale. Con questa espressione si fa riferimento all'identità geo-culturale di questo insieme regionale che persiste nonostante le pressioni nazionalistiche e religiose. La valle del Fergana è sempre stata un insieme geografico, politico, sociale, malgrado negli ultimi secoli la sua popolazione si è sempre distinta per il suo alto livello di multietnicità e di disomogeneità linguistica. Questo però, non ha impedito un'amalgamazione sociale di tale popolazione che ha sempre considerato la multietnicità come la normalità e ha sempre attribuito ad ogni "etnia" un ruolo sociale integrato all'interno del sistema Fergana. Popolazioni di lingua e cultura persiana e sedentaria e popolazioni di lingua e cultura turca, sedentaria o nomade hanno sempre condiviso, ognuna con il proprio ruolo sociale, una vita comunitaria all'interno della regione e questa è sicuramente la caratteristica principale del Regionalismo culturale del Fergana. Questo equilibrio cambiò con la perdita di sovranità politica della regione, con l'istituzione dei nazionalismi e la conseguente spartizione della regione tra tre dei cinque nuovi Stati nazionali dell'Asia centrale sovietica. In questo capitolo verranno analizzate le principali rappresentazioni nel tempo dell'attore Regionalismo culturale e come esso si sia opposto agli altri attori territoriali, soprattutto all'attore Nazione. La seconda parte di questo lavoro è stata dedicata all'impatto che gli attori territoriali hanno oggi nella valle del Fergana, soprattutto nelle sue aree di frontiera. Questa parte è il risultato delle interviste e delle osservazioni sul campo effettuate in Asia centrale e in particolare nel Fergana nelle spedizioni del 2007, 2009 e del 2010. Nel primo capitolo verrà analizzata la frontiera di questa regione dal punto di vista teorico, in particolar modo con l'analisi del Fergana come" prima o ultima linea di difesa". Nel secondo capitolo, all'interno di un contesto di base: la differenza tra la frontiera all'epoca sovietica e all'epoca dell'indipendenza, ci sarà un approfondimento della definizione di frontiera centrasiatica, l'esame della burocrazia di frontiera, del posto di blocco e dei documenti del soggetto transfrontaliero. Saranno trattate, inoltre, le tematiche relative alle relazioni commerciali transfrontaliere, come i "tre" Fergana riescono ancora ad interagire malgrado la crescente rigidità delle frontiere e verranno studiate le relazioni sociali transfrontaliere sempre all'interno del panorama ferganiano di oggi. In questo contesto, verranno considerate le interviste svolte nel Fergana, le opinioni riguardo le difficoltà di passaggio e di comunicazione nella valle ed analizzeremo la presenza dei tre attori geopolitici che tuttora giocano un ruolo fondamentale nelle relazioni e nei conflitti di frontiera. Il terzo capitolo sarà dedicato ai centri urbani del Fergana; la loro storia, il rapporto dei ferganiani con le città e soprattutto le rappresentazioni interne ed esterne che i centri urbani hanno assunto all'interno di una regione oggi del tutto transfrontaliera. Il quarto capitolo si concentrerà sulle evoluzioni demografiche della popolazione: il Fergana, che durante gli anni zaristi e sovietici era terra di immigrazione, con l'indipendenza e dunque con la concretizzazione delle frontiere, si ritrova terra di emigrazione. Il quinto capitolo sarà dedicato al Fergana delle infrastrutture: come la strada ferrata e la rete stradale influiscono e sono influenzate dalle mutazioni frontaliere di questa regione. Il sesto capitolo riprenderà degli interrogativi teorici posti all'inizio del lavoro, con un analisi conclusiva sull'odierno "Fergana delle frontiere". La conclusione di questa ricerca, in realtà, è una vero e proprio capitolo di analisi, dove si farà il punto della situazione e si constaterà la persistenza dell'attore Regionalismo culturale, la sua evoluzione e il suo rapporto attuale con gli altri attori geopolitici. Un punto di arrivo fondamentale della ricerca è il fatto che la regione Fergana è cambiata, sotto differenti punti di vista e la popolazione ferganiana ha nuovi punti di riferimento culturali, politici e sociali. Differenti forme politiche e nuove strutture culturali hanno portato la popolazione del Fergana, nel tempo, a mutare la propria immagine e la propria identità: "russa, musulmana, ferganiana", in seguito "sovietica, uzbeca (o tagica o kirghiza), atea, ferganiana" e infine "uzbeca (o tagica o kirghiza), laica, ferganiana". Il territorio, le sue frontiere e la società che lo abita sono cambiati, ma vedremo che, nonostante i forti ostacoli posti dall'attore Nazione, il Regionalismo culturale riuscirà a sopravvivere, adattandosi alle nuove tendenze e ai nuovi modi di interpretare il Fergana. Come ultimo studio sul territorio, faremo degli esempi riguardanti gli eventi più recenti concernenti il Fergana (massacro di Andijan nel 2005, scontri ad Osh nel giugno 2010) ed analizzeremo questi fenomeni alla luce delle rivalità di potere geopolitiche che ancora persistono nella regione. ; Cette thèse de Doctorat propose une analyse géopolitique d'une région transfrontalière de l'Asie centrale, la vallée du Ferghana, aujourd'hui divisée entre les Républiques d'Ouzbékistan, du Tadjikistan et du Kirghizistan. Des séjours sur le terrain répartis sur trois ans ont constitué la base de la recherche, au travers de l'analyse des frontières, de la cartographie analytique, d'entretiens qualitatifs avec experts et habitants, et de recherches bibliographiques dans le Ferghana ainsi que dans la capitale ouzbèke Tachkent – notamment près l'Institut Français d'Etudes sur l'Asie Centrale (IFEAC). Ces périodes de terrain ont été complétées par un séjour de recherche en France, articulé principalement autour d'un approfondissement théorique à l'Institut Français de Géopolitique (IFG) de l'Université Paris VIII-Vincennes et de recherches bibliographiques à la Bibliothèque Nationale de France. L'objet de ce travail est donc l'analyse des rivalités de pouvoir entre les acteurs territoriaux sur l'enjeu territorial de la vallée du Ferghana, bassin fertile à la position stratégique dans le contexte géopolitique centrasiatique élargi. Si le Ferghana a toujours constitué un enjeu disputé par différents acteurs territoriaux, les rivalités des acteurs actuels jouent aujourd'hui surtout au niveau frontalier et transfrontalier. Ce faisant, cette thèse introduit un nouvel acteur dans le schéma d'analyse géopolitique classique: le Régionalisme culturel. Le Régionalisme culturel en tant qu'acteur territorial y fait donc l'objet d'une présentation approfondie ainsi que d'une évaluation de son importance passée et actuelle. Concentrée d'abord sur le contexte centrasiatique et les particularités qui découlent de ses frontières, l'introduction présente ensuite « l'enjeu » Ferghana et ses ressources physiques et économiques, qui expliquent l'importance de ce territoire. Elle se poursuit sur un rapide point théorique sur la géopolitique et la justification du choix de l'école de pensée géopolitique de Yves Lacoste comme cadre théorique de cette recherche, avant de s'achever sur une première analyse de l'espace Ferghana à l'aune des catégories de frontières et de confins. La thèse est structurée en deux grandes parties. La première, à dominante théorique, analyse à tour de rôle les trois acteurs territoriaux qui rivalisent pour le pouvoir sur le Ferghana: il s'agit de la Nation, de la Religion, et du Régionalisme culturel. La présentation des acteurs, de leurs différentes incarnations et de leurs représentations respectives du territoire ferghanien sont ainsi abordés selon un ordre conceptuel ; des évènements s'étant produits simultanément ne sont ainsi pas analysés chronologiquement mais séparément, en tant qu'ils se rapportent aux acteurs évoqués. Le premier chapitre est consacré à l'acteur Nation. Par cette expression nous entendons non seulement l'entité effective Etat-Nation et ses trois incarnations (Ouzbékistan, Tadjikistan, Kirghizistan), mais aussi la Nation comme idéologie qui agit sur le territoire au travers de politiques nationalistes. La force de légitimation de l'acteur Nation n'est pas étrangère à l'accroissement de son importance sur ce territoire, qui l'a sans aucun doute mené au sommet de la hiérarchie des acteurs géopolitiques dans cette région. Ce chapitre analyse les représentations du Ferghana définies et mises en oeuvres par l'acteur Nation depuis son apparition dans les années 1920. La vallée du Ferghana est en effet devenue une région transfrontalière à cette époque, avec son intégration à l'Union des Républiques Socialistes Soviétiques (URSS) et sa partition entre trois des cinq Républiques Socialistes Soviétiques nouvellement créées en Asie Centrale. Dans les années 1990, avec la chute de l'URSS et l'indépendance des trois Républiques, les frontières qui divisaient le Ferghana ne sont plus simplement internes, mais deviennent bel et bien internationales. Parmi les représentations majeures qui font l'objet d'une étude dans ce chapitre, une attention particulière est portée aux frontières nationales, leur création et leur évolution. Le chapitre s'intéresse également aux relations entre les différents Etats-Nations, qui constituent un acteur unique lorsqu'ils rivalisent contre les autres acteurs territoriaux – la Religion et le Régionalisme culturel – mais aussi trois acteurs différenciés lorsqu'ils se disputent le territoire Ferghana entre eux. Le deuxième chapitre est consacré au deuxième acteur territorial, la Religion. La vallée du Ferghana est l'une des régions d'Asie centrale les plus croyantes et pratiquantes, et la religion islamique y a toujours eu un rôle important dans la gestion de la société. Ce chapitre propose d'abord une analyse des représentations de la religion dans le Ferghana : le soufisme autochtone et la "géographie sacrée" des hauts lieux de ce courant de l'Islam dans le Ferghana ; l'Islam traditionnel de la période soviétique, devenu une arme légale utilisée par Moscou pour combattre l'orthodoxie soufie du Ferghana ; le fondamentalisme wahabbite récemment apparu, importé d'Afghanistan, du Pakistan et d'Arabie Saoudite à la suite de l'invasion de l'Afghanistan par les Soviétiques en 1979 et de la rencontre qui s'en est ensuivie entre les musulmans soviétiques et les moudjahiddines afghans. Ensuite est examinée la manière dont les différentes variantes de l'acteur Religion se sont opposées, au cours des années, à l'acteur Nation pour le contrôle du pouvoir et des ressources du territoire Ferghana. Nous y voyons comment la rivalité géopolitique entre deux acteurs varie du tout au tout selon que l'on parle de l'acteur Nation au cours de la période Soviétique ou bien au cours de l'ère ayant succédé à l'indépendance. Une attention particulière est portée au phénomène de politisation de l'acteur Religion et à la manière dont cette politisation a amené la Religion à assumer un rôle de protagoniste dans de nombreux évènements du Ferghana. Le troisième acteur est le Régionalisme culturel. Avec cette expression nous faisons référence à l'identité géo-culturelle de cet ensemble régional, qui persiste malgré les pressions nationalistes et religieuses. Car aussi loin que remonte son existence en tant que lieu, la vallée du Ferghana a toujours constitué un ensemble géographique, politique et social à part entière. Bien que sa population se soit distinguée au cours des derniers siècles par une grande multiethnicité et hétérogénéité linguistique, cela n'a pas empêché un amalgame sociétal de cette population qui a toujours considéré la multiethnicité comme normale, et toujours a attribué à chaque « ethnie » un rôle social déterminé au sein du système Ferghana. Qu'elles soient de langue et de culture persane et sédentaire, de langue et de culture turque et sédentaire, ou bien de langue et de culture turque et nomade, ces populations ont toujours partagé, chacune dans son propre rôle social, une vie communautaire au sein de la région, et ce phénomène est la caractéristique principale de ce que nous appelons le Régionalisme culturel du Ferghana. Cependant, cet équilibre change avec la perte de souveraineté politique de la région, l'avènement du nationalisme sous l'action de l'URSS, et la partition de l'espace entre trois Etats nations de l'Asie centrale soviétique. Ce chapitre analyse ainsi les principales représentations de l'acteur Régionalisme culturel au cours du temps, et comment il s'est opposé aux autres acteurs territoriaux, en particulier à l'acteur Nation. La seconde partie de ce travail est dédiée aux manifestations actuelles des acteurs territoriaux dans la vallée du Ferghana, plus spécialement dans ses zones de frontière. Cette partie est le résultat des entretiens et des observations de terrain réalisés en Asie centrale et dans le Ferghana au cours de séjours en 2007, 2009 et 2010. Le premier chapitre analyse la frontière de cette région du point de vue théorique, à la lumière notamment des catégories géostratégiques de "première ligne de défense" ou "dernière ligne de défense". Dans le contexte d'une modification de la frontière entre l'époque soviétique et celle de l'indépendance, le deuxième chapitre approfondit la définition de frontière centrasiatique, au travers principalement de l'analyse de la bureaucratie de frontière, des postes de contrôle et des documents requis pour le passage de la frontière. Les thématiques liées aux relations commerciales transfrontalières y sont examinées : comment les "trois" Ferghana parviennent encore à interagir malgré la rigidité croissante des frontières, quelles relations sociales transfrontalières subsistent au sein du Ferghana d'aujourd'hui. Les entretiens qualitatifs réalisés dans le Ferghana jouent un rôle majeur pour recenser les difficultés de passage et de communication dans la vallée et déceler, dans les descriptions et jugements recueillis, la présence des trois acteurs géopolitiques qui toujours jouent un rôle fondamental dans les relations et conflits de frontière. Le troisième chapitre est dédié aux centres urbains du Ferghana : leur histoire, le rapport que les Ferghaniens entretiennent avec eux, et surtout les représentations internes et externes que les centres urbains assument au sein d'une région désormais tout à fait transfrontalière. Le quatrième chapitre se concentre sur les évolutions démographiques de la population. Jusque là terre d'immigration tout au long des années tsaristes et soviétiques, le Ferghana est devenu une terre d'émigration avec l'indépendance et la concrétisation des frontières. Le cinquième chapitre s'intéresse au Ferghana des infrastructures, notamment les réseaux ferré et routier, et leur rapport d'influence réciproque mutations frontalières de cette région. Le sixième chapitre reprend les interrogations théoriques posées dans l'introduction et développe une analyse conclusive sur le Ferghana des frontières aujourd'hui. La conclusion de cette recherche dresse le bilan actuel du Ferghana et des rapports entre les différents acteurs géopolitiques, et observe la persistance de l'acteur Régionalisme culturel. Force est de constater l'existence de changements dans la région Ferghana à différents points de vue. La population ferghanienne dispose de nouveaux cadres de référence culturels, politiques et sociaux qui ont pris une importance majeure. Des nouvelles formes politiques et de structures culturelles ont eu un impact sur son image d'elle-même, sur son identité: "russe, musulmane,ferghanienne", puis "soviétique, ouzbèke (ou tadjike ou kirghiz), athée, ferghanienne", et enfin "ouzbèke (ou tadjike ou kirghiz), laïque, ferghanienne". Cependant, bien que le territoire, ses frontières et la société qui l'habite aient changé, et malgré les obstacles forts posés par l'acteur Nation, que Régionalisme culturel a réussi à survivre, en s'adaptant aux nouvelles tendances et aux nouveaux modes d'interprétation du Ferghana. La conclusion s'achève sur les évènements les plus récents du Ferghana; massacre d'Andijan en 2005 et affrontements à Osh en juin 2010, qui sont analysés à la lumière des rivalités de pouvoir géopolitique qui persistent encore dans la région. ; This PhD dissertation proposes a geopolitical analysis of a centrasiatic transborder region, the Ferghana Valley, which is today divided between the Republics of Uzbekistan, Tajikistan and Kyrgyzstan. A basis of the research, field trips spread over the past three years enabled the development of instruments such as border analysis, analytical cartography, qualitative interviews with experts and inhabitants, and bibliographical research in the Ferghana as well as the Uzbek capital city Tashkent – noticeably at the French Institute for Central Asian Studies (IFEAC). As a complement to the field trips in Central Asia, a research period in France permitted both a consolidation in geopolitical theory at the French Institute of Geopolitics (IFG) of the University of Paris 8-Vincennes, and additional bibliographical research at the French National Library (BNF). The topic of the research is hence the analysis of power rivalries between "territorial actors" over the "territorial stake" of the Fergana Valley, a fertile basin of strategical location within the larger geopolitical context of Central Asia. Always a stake disputed by various territorial actors over time, the Fergana Valley now experiences power rivalries from contemporaneous territorial actors first and foremost on the border and transborder levels. By doing so, the dissertation introduces a new actor in the classical geopolitical pattern of analysis: the cultural regionalism. The dissertation hence offers a detailed presentation of the cultural regionalism as well as an evaluation of its past and current importance. First focusing on the centrasiatic context and the peculiarities which stem from its borders, the introduction presents the "stake" Fergana and its economic and physical resources which explain its importance as a territory. A rapid summary of the theory of geopolitics follows, with the justification of the choice of the French Lacostian school as the theoretical frame of this work. The introduction closes on a first analysis of the Fergana as a space of border or frontier. The thesis is structured in two main parts. The first, more theoretical, analyses each of the three territorial actors which aim for power over the Fergana: the Nation, the Religion, and the Cultural Regionalism. The presentation of the actors, of their respective embodiments and of their manifestations within the ferganian territory is organised according to a conceptual rationale; events that occurred simultaneously are thus not considered following a chronological order, but separately, according to their respective relations with the actors evoked. The first chapter focuses on the actor Nation. By this word we understand not only the effective entity of the Nation-State, and its three embodiments (Uzbekistan, Tajikistan, Kyrgyzstan), but also the Nation as an ideology which acts upon the territory through nationalistic policies. The force of legitimation of the actor Nation did certainly not have a neutral role in the rise of this actor in the Ferganian landscape, a process which led the Nation to the top of the geopolitical actors' hierarchy in the region. This chapter also analyses the representations of the Fergana which are defined and implemented by the actor Nation since its birth in the 1920s. In fact, the Fergana valley first became a transborder region only in these years, through its integration to the Union of the Socialist Soviet Republics (USSR) and its partition between three of the five newly created Socialist Soviet Republics in Central Asia. In the 1990s, following the fall of the USSR and the independence of the three Republics, the borders which divided the Ferghana stopped being only internal, but became real and proper international borders. Among the main representations that this study looks at, a particular attention is devoted to the study of the national borders , their creation and their evolution. The chapter also looks at the relations between the different Nation-States, which form a unique actor when they rival against the other territorial actors – the Religion and the Cultural Regionalism –, but three well different ones when they rival among themselves. The second chapter concentrates upon the second territorial actor, the Religion. The Fergana valley is one of the most pious and practicing region of Central Asia, and the Islamic religion always played a major role in the society's administration and organization. The chapter proposes first an analysis of the religion's representations in the Fergana: the autochthonous sufism and its sacred geography within the Fergana valley ; the traditional Islam of the soviet times, which became a legal weapon used by Moscow to fight the sufi orthodoxy in the Fergana ; the recently appeared wahabbite fundamentalism, imported from Afghanistan, Pakistan and Saudi Arabia following the Soviet invasion of Afghanistan in 1979 and the encounter it induced between the soviet muslims and the afghan mujaheddins. It is then examined how the different variations of the actor opposed themselves to the actor Nation, over the years, for the control over the power and the resources of the Fergana. We look at how the geopolitical rivalries vary dramatically from the soviet era to that of the independence. A special attention is devoted to the phenomenon of politization of the actor Religion and the way this led the Religion to endorse a role of protagonist in many of the Fergana's events. The third actor is the Cultural Regionalism. It is hereby referred to the geo-cultural identity of this regional entity, which persists in spite of nationalistic and religious pressures. In fact, as long as the Fergana has existed as a place, it has always constituted a geographical, political and social whole. Although its population has been characterized during the past centuries by high levels of multiethnicity and linguistic heterogeneity, this did not prevent the societal amalgamation of populations which always held multiethnicity as normality, and always attributed to each "group" a specific social role within the system Fergana. Be they of language and culture persian and sedentary, turk and sedentary or turk and nomadic, these populations always shared, each in its own social role, a common life within the region. This very phenomenon is the main characteristic of what we call the Cultural Regionalism of the Fergana. However, this equilibrium changes with the loss of political sovereignty of the region and the rise of nationalism under the soviet sovereignty. This chapter analyzes the main representation of the actor Cultural Regionalism over time, and how it took stand against the other territorial actors, especially the Nation. The second part of the dissertation as dedicated to the current manifestations of the territorial actors in the Fergana valley, particularly in its border zones. This part results from the interviews and field observation undertaken in Central Asia and the Fergana in 2007, 2009 and 2010. The first chapter analyzes the border of this region from a theoretical point of view, especially in the light of the geostrategical categories of "first line of defence" or "last line of defence". In the context of a transformation of the border from the soviet era to that of the independence, the second chapter explores the definition of the centrasiatic border, mainly through the analysis of border bureaucracy, control posts and documents required to cross the border. The chapter looks at themes connected to the commercial transborder relations : how the "three" Fergana still manage to interact despite growing border rigidity, which social relationships subsist today. The qualitative interviews led in the Fergana are a major source in this process of reviewing the difficulties of passage and communication within the valley, and of tracking the actual presence of the three geopolitical actors which play a major role in the border relations and conflicts. The third chapter focuses on the Ferganian urban centres: their history, the relations that the Ferganians have with them, et above all the internal and external representations of these centres in a now fully transborder region. The fourth chapter concentrates on the demographical evolutions of the Ferganian population. Up until then a land of immigration, the Fergana became a land of emigration following the independence and the materialization of the borders. The fifth chapter deals with the Ferganian infrastructures, especially the rail and road networks, and their relationship of reciprocal influence with the mutation of the borders in the region. The sixth chapter builds on the theoretical interrogations evoked in the introduction of the dissertation and develops a conclusive analysis of the Fergana of the borders nowadays. The conclusion of this research depicts the current Fergana, the relations between the different geopolitical actors and underscores the persistence of the actor Cultural Regionalism. It establishes the existence of tremendous changes in the region Fergana from various viewpoints: the Ferganian population has new frames of cultural, political and social reference whose importance increased dramatically ; new political forms and cultural structures influenced its self-image, its very identity: "russian, muslim, ferganian", then "soviet, uzbek (or tajik or kyrgyz), atheist, ferganian", finally "uzbek (or tajik or kyrgyz), secular, ferganian". However, although the territory, its borders and inhabitants changed, and despite the strong obstacles set by the actor Nation, the cultural regionalism succeeded in maintaining itself, by adapting to the new tendencies and ways of interpretation of the Fergana. The conclusion ends with the most recent events of the Fergana, the Andjian massacre in 2005 and the Osh clash in 2010, which are both analysed in the light of the geopolitical power rivalries which persist in the region. ; XXIII Ciclo
Dottorato di ricerca in Economia e territorio ; Il cambiamento tecnologico comporta una "rimodellatura" e, a volte, un vero e proprio rovesciamento dell'ordine esistente all'interno delle organizzazioni produttive. La conoscenza generata dall'innovazione tecnologica, per essere "assorbita", necessita di un corredo di pratiche organizzative adeguate: per tale ragione è sempre più stretto il processo co-evolutivo tra sviluppo tecnologico e cambiamento organizzativo. Il coordinamento e la gestione delle sinergie e dei feedbacks tra diversi aspetti dell'attività innovativa diventa una specifica linea d'azione strategica per le imprese al fine di ottenere performances economiche superiori. La stretta complementarità tra investimenti in beni tangibili (nuove tecnologie) e intangibili (struttura organizzativa), da cui scaturisce una maggiore crescita della produttività, è il fulcro del nuovo approccio a queste tematiche. L'ipotesi di complementarità nei processi innovativi assume particolare rilievo con l'avvento delle tecnologie ICT, con la loro natura generalista o aspecifica (general purpose technology), il loro carattere ampiamente pervasivo, e l'esigenza connessa di una prestazione a più alto contenuto cognitivo e relazionale (Breshnahan et al. 2002, Brynjolfsson et al., 2000, Brynjolfsson et al., 2002, Bugamelli e Pagano 2004). La penetrazione di queste tecnologie nel tessuto produttivo favorisce lo sviluppo di diversi input complementari e comporta diverse ondate di innovazioni "secondarie" che creano nuovi prodotti e nuovi processi, dando luogo a periodi più o meno prolungati di aggiustamento strutturale che coinvolgono la riorganizzazione aziendale e l'implementazione delle pratiche del lavoro ad alta performance o High Performance Workplace Practices (Breshanan e Trajtenberg 1995). Quest'ultime si esplicitano in una serie di azioni che hanno nell'empowerment delle risorse umane l'elemento centrale, e che si concretizzano nella riduzione dei livelli gerarchici, nell'assunzione generalizzata di responsabilità, nel coinvolgimento dei lavoratori, nello svolgimento di ruoli attivi, nel lavoro in team, nella polivalenza e nella policompetenza, nei sistemi di valutazione della performance e dei suggerimenti dal basso, e infine nelle buone relazioni industriali. La concettualizzazione dell'organizzazione come un insieme di elementi profondamente eterogenei ma complementari risale a Milgrom e Roberts (1990 e 1995) che, dapprima, ne forniscono una definizione basata sulle proprietà di supermodularità della funzione di redditività dell'impresa, e poi modellano il raggruppamento delle pratiche risultanti dalla complementarità tra innovazioni tecnologiche e cambiamenti organizzativi. Implicita nella definizione di complementarità è l'idea che fare di più in una certa attività non impedisce di fare di più in un'altra, contrariamente alla teoria tradizionale dell'impresa in cui l'ipotesi di rendimenti di scala decrescenti può porre dei vincoli alla possibilità di incremento simultaneo delle variabili di scelta dell'impresa. Le analisi empiriche hanno messo in rilievo come frequentemente innovazioni tecnologiche ed organizzative siano adottate congiuntamente e come entrambe influiscano sulle performances delle imprese (Black e Lynch 2000, Bresnahan, Brynjolfsson e Hitt 2002, Brynjolfsson, Lindbeck e Snower 1996, Malone et al. 1994, Pini 2006, Pini et al. 2010). Nel nostro paese gli studi empirici sulle complementarità tra sfere innovative sono ancora pochi. I principali lavori di natura econometrica realizzati, sulla base di limitati campioni di imprese a livello provinciale, sono attribuibili a Cristini et al. (2003 e 2008), Leoni (2008), Mazzanti et al. (2006), Piva et al. (2005), Pini et al. (2010). Un aspetto poco indagato, anche nei lavori citati, è quello dell'interazione tra tecnologie ICT, cambiamenti organizzativi e pratiche lavorative ad alta performance sulla produttività del lavoro, che è proprio l'argomento specifico che ci siamo proposti di indagare. Preliminarmente abbiamo ricostruito il dibattito teorico ed empirico sul ruolo di driver al fine dell'ottenimento di performances superiori delle tecnologie ICT, dei cambiamenti organizzativi e delle nuove pratiche del lavoro, singolarmente presi. In una seconda fase abbiamo verificato l'esistenza di legami virtuosi tra le tre attività innovative e la produttività del lavoro mettendo in evidenza le complementarità tra le sfere innovative. Per questo abbiamo effettuato un'analisi empirica utilizzando due fonti principali: IX e X indagine sulle imprese manifatturiere del Mediocredito Centrale (ora Capitalia) e la Community Innovation Survey (Cis-4) dell'Istat. Questi ultimi dati sono integrati con quelli di bilancio delle imprese società di capitali attive dal 2001 al 2008, con i caratteri strutturali del Registro delle imprese (Asia), con i dati del commercio estero (Coe), e dell'occupazione (Oros). Seguendo il productivity approach, abbiamo ricercato i legami di complementarità eseguendo, con il software STATA 10, una serie di regressioni multivariate, utilizzando funzioni di produzione aggiustate con le strategie innovative e le loro interazioni. I modelli, stimati con la tecnica dell'Ordinary Least Square (OLS), sono differenti a seconda della tipologia di dati disponibili: con i dati Mediocredito si è stimata una funzione di produzione di tipo Cobb-Douglas, per i dati Cis-4 un stimato un modello a effetti fissi tramite una funzione di produzione di tipo Translog. Se il ricorso alla funzione Cobb-Douglas è ricorrente nella letteratura internazionale, soprattutto per stimare gli effetti delle singole strategie innovative sulla produttività del lavoro (Black e Lynch 2001, 2004, Breshnan et al. 2002, Gera e Gu 2004), l'utilizzo di una funzione Translog, è scelta assolutamente non ricorrente in letteratura per quanto riguarda l'oggetto di analisi. A tal riguardo ci si è ispirati al lavoro di Amess (2003), nel quale vengono valutati gli effetti del management buyouts sull'efficienza di lungo termine delle imprese manifatturiere della Gran Bretagna. Inoltre abbiamo testato la presenza di complementarità attraverso l'analisi delle differenze in termini di performance, suddividendo le imprese in base a diverse combinazioni nell'utilizzo delle strategie innovative. Un aspetto da rilevare è che, le nostre analisi realizzate sul panel integrato Cis-4 utilizzano un campione particolarmente numeroso e rappresentativo della realtà industriale italiana, un fatto, come detto, non frequente negli studi sull'argomento condotti nel nostro Paese. I risultati ottenuti dall'analisi di entrambi i campioni sono in linea con i principali studi empirici italiani (Cristini et al. 2003 e 2008, Mazzanti et al. 2006, Pini 2006, Pini et al. 2010), convalidando ampiamente l'ipotesi di un impatto positivo delle tre strategie innovative sull'aumento delle performances produttive delle imprese, anche se implementate singolarmente in azienda. Per quanto riguarda la verifica di un legame di complementarità tra le tre aree innovative emerge, chiaramente un effetto additivo sul valore aggiunto attraverso l'analisi dei differenziali e seguendo l'approccio sulla supermodularità di Milgrom e Roberts (1990, 1995). L'aspetto più rilevante dei risultati ottenuti è costituito dal fatto che alcune variabili diventano particolarmente significative quando le imprese le adottano simultaneamente: ciò vale in particolare per la formazione e la partnership in R&D. L'attività di formazione è associata positivamente alla presenza di tecnologie ICT e all'innovazione organizzativa, intesa come instaurazione di partnership per la R&D. Inoltre dall'analisi sui dati Mediocredito emerge, in conformità alla teoria skill biased technical change, una propensione a domandare lavoratori in possesso di qualifiche più elevate da parte delle imprese che hanno implementato in maniera significativa cambiamenti tecnologico-organizzativi (Berman, Bound e Griliches1994, Breshnan et al. 2002, Draca, Sadun e Van Reenen 2006). ; Technological development results in a "reshaping" and, sometimes, a complete change within existing productive structures. The knowledge brought about by technological innovations, to be incorporated need a wealth of suitable structural procedures: for this reason the evolution between the technological development and the structural change is getting narrower. The coordination and management of the sinergies and feedbacks among the different aspects of the innovative activity becomes a line of strategic action within the companies to obtain superior economic performances. The strict complementarity between investments in tangible goods (new technologies) and intangibles ones ( organization structure), which brings about a better productivity growth, is the pivot of the new approach to these thematics. The complementarity hypothesis in the innovative processes is particularly important with the advent of the ICT technologies, with their general purpose technology, their widely pervesive characters and the associated requirements of a knowledge at a higher contexct. (Breshnahan et al. 2002, Brynjolfsson et al., 2000, Brynjolfsson et al., 2002, Bugamelli e Pagano 2004). The penetration of these technologies in the productive frame favours the development of the different complementary inputs and allows several flows of "secondary" innovations, which creates new products and processes, bringing more or less long sructural adjustments which include the business reorganization and to carry out work documentation at high performance or High Performance Workplace Practices (Breshanan e Trajtenberg 1995). The latter can be explained in a series of actions which have in the human resources empowerment its central element (unit) and which are reliased with the reduction of the hierarchical levels of employment at general responsibility level, bringing in the employees in active running roles, in working as a team with many duties and competence, in the methods of valuing performance and suggesions from below and lastly in good industial relations. The notion of the organisation as a collection of elements extremely different, but complementary, goes back to Milgrom and Roberts (1990 e 1995) who, at first, gave a definition based on the properties of modular dimensions of the firm income capacity and then they (the set of elements) put together the resulting documentation due to the complementarity between technological innovations and structural changes. Implicit to the complementariety definition, is the idea that to do more in a certain activity does not exclude to do more in another one; this is to the contrary to the firm traditional theory where the hypothesis of decreasing range efficiency can limit the possible simultaneous increase of the firm variable choices. The empiric analysis have put in evidence that often technological and structural innovetions are taken together and that both influence the firms performances (Black e Lynch 2000, Bresnahan, Brynjolfsson e Hitt 2002, Brynjolfsson, Lindbeck e Snower 1996, Malone et al. 1994, Pini 2006, Pini et al. 2010). In our country the empiric studies on the complementarity within the innovative fields are still few. The major econometric works realised, based on limited samples at provincial level are ascribed to Cristini et al. (2003 e 2008), Leoni (2008), Mazzanti et al. (2006), Piva et al. (2005), Pini et al. (2010). The integration within the ICT technologies, stuctural changes, work habits at high performance on work productivity are aspects investigated insufficiently even on the studies already mentioned. This is the specific subject we propose to examine. At first we have reconstructed the theoric and empiric argument on the driver role aiming to obtain performances better than the the ICT technologies, stuctural developments, work habits, each taken individually. In a second phase we have verified the existence of virtual bonds between the innovative activities and labour productivity putting in evidence the complementariety within the innovative areas. For this reason we carried out an empiric analysis using two main sources: IX and X investigation on manufactury firms of Mediocredito Centrale (now Capitalia) and the Community Innovation Survey (Cis-4) by Istat. These last data are put together with the ones of active plc (public limited companies) balances from 2001 to 2008 with structural characteristics according to Companies Register (Asia), foreign trade data (Coe) and employment (Oros). By following the productivity approach we searched complementarity bonds, achieved with software STATA 10, a range of changeble regressions, using production activities related to innovative strategies and their interactions. The samples, based on the Ordinary Least Square (OLS) technique, are different according to the type of data: available with Mediocredito data, we valued a production function of the Cobb-Douglas type; for the Cis-4 was valued a sample at fixed results using a production function of Tanslog type. If going back to the Cobb-Douglas function appears again in the international literature, especially to value the consequences of single innovative strategies on labour productivity (Black e Lynch 2001, 2004, Breshnan et al. 2002, Gera e Gu 2004), the use of a Translog funtion, is chosen absolutely, without going back to literature when referring to the object of the analysis. From this point of view, we were influenced by Amess' (2003) work, where were valued the results of the management buyouts on the long term efficiency of manifacturing industies in Great Britain. Besides we tested the presence of complementarity by using the analysis of the differences based on performance, by dividing the firms according to their different utilization of innovative strategies. An aspect to take into consideration is that, our analysis carried out on the integrated Cis-4 panel utilise a rather special and large sample which represents the Italian industrial reality, a fact, as already mentioned, not common in the studies undertaken in our Country on this subject. The results obtained from the analysis of both samples are in line with the principal Italian empiric studies (Cristini et al. 2003 e 2008, Mazzanti et al. 2006, Pini 2006, Pini et al. 2010), widely confirming the hipothesys of a positive impact within the three innovative strategies on the companies increase of the producteve performances, even if singularly employed by the business. As regards the examination of a complementarity connection within the three innovative areas, emerges clearly an additive effect on its added value using the analysis of the differentials and approching the super modularity of Milgrom e Roberts (1990, 1995). The most important aspect of these results is that some variables become particularly significative when the firms use them simultaneously: this is particularly valid at educational level and partnership in R&D. The activity at educational level is positively associated to ICT technologies and structural innovetions, understood as the setting up of partnership for R&D. In addition from the analysis of Mediocredito data emerges, according to the skill biased technical change theory, a tendency by the companies, which have made significant techinical-structural changes to look for employees with higher qualification levels (Berman, Bound e Griliches1994, Breshnan et al. 2002, Draca, Sadun e Van Reenen 2006).
Tese de Doutoramento em Urbanismo com a especialização em Urbanismo apresentada na Faculdade de Arquitetura da Universidade de Lisboa para obtenção do grau de Doutor. ; Premissa Em Arquitectura, o desenvolvimento, a confirmação ou a negação de alguns paradigmas culturais e teóricos deve ser antecedido pelo mesmo processo em relação ao mais básico e prioritário dos objetos em questão, ou seja, o veículo das mesmas conjeturas, o produto de estes três anos de formação de terceiro ciclo: a tese de doutoramento. Esta é precisamente uma pesquisa, uma investigação de carácter experimental, original e inédita, confrontada meticulosamente com capacidades e técnicas capazes de controlar o seu processo. Não constitui uma prática de deificação de verdade dogmática, não tem validade universal, não revela a soma absoluta do saber. Pelo contrário, quer gostemos quer não, a investigação, como atividade, é de natureza duplamente parcial: epistemológica e temporal. Por sua vez, derivado de visões anteriores e baseado em inúmeros estudos, é um segmento do saber com uma certa legitimidade, transmissível entre pensadores e operadores da comunidade científica. Ao mesmo tempo, não tem validade cronológica ilimitada e não constitui uma meta invejada, mas sim um ponto de partida para futuras pesquisas académicas, próprias e de outrem, para um avanço disciplinar contínuo. É também importante precisar que o objeto de estudo não é produto de um capricho, e a investigação que dele resulta não constitui um exercício ocioso. Persiste, no entanto, a convicção de que é necessário que sejamos comedidos, mantendo-nos o mais possível dentro do nosso campo disciplinar específico, agora cada vez mais adulterado por desvios e fascinações sócio-antropológicas, com as condições da contemporaneidade na esfera de um realismo saudável. Objeto da pesquisa O objeto desta pesquisa é, portanto, aquela paisagem moderna dos segmentos costeiros do sul da Europa feita de geografia e de objets trouves, formas e materiais comuns, arquiteturas ainda "não acreditadas", resultantes de práticas não muito claras – traços de cidades informais litorais, produtos de auto-construção, ilegalidades, e ambiguidade normativa – que têm normalmente origem, necessidade, sentido e uso autónomos, relativamente a eventuais leituras formais e convencionais, mas que podem interessar bastante a quem se ocupa do território contemporâneo antrópico. Quer se queira quer não, estes manufatos, pela presença cénica por vezes tão imponente e violenta, outras vezes insignificante e camuflada, representam uma quota consistente da paisagem contemporânea e das ocasiões profissionais de nós arquitetos, cada vez mais forçados a manipular, com o olhar e com as nossas obras, a transformar e a corrigir este tipo de situações complexas, em vez de enriquecer os nossos territórios com nova edificação. Só os edifícios abusivos em Itália chegam aos 17%, enquanto que a percentagem aumenta entre os 30% e os 40% se considerarmos as construções que persistem ao longo da costa; a vizinha Grécia evidencia práticas semelhantes; se considerarmos também os edifícios autorizados do ponto de vista normativo, mas nunca 'dirigidos' a quem os observa, é óbvio que falamos pelo menos de metade daquilo que há anos temos constantemente debaixo dos olhos. Um fenómeno de quantidades e dimensões tais que é legítimo, por um lado, reconhecer que o atual sistema positivista normativo é, resumidamente, bastante ineficaz, e, por outro, falar de situações inadiáveis, e não de dissertação teorética gratuita. Talvez tenhamos realmente passado um ponto sem retorno. É possível conjeturar a demolição de quilómetros e quilómetros de construção ao longo da costa? Como reutilizar e armazenar os milhares de restos de metros cúbicos de materiais de construção civil não recicláveis? É economicamente sustentável? É dialeticamente correto? É culturalmente sincrónico? Cada empreendimento demiúrgico, adequado a reimplantar uma hipotética idade de ouro ou o sublimado "ponto zero" do estado natural das coisas, arrisca a parecer mais arrogante e insensato – mesmo que não seja considerado assim pelo senso comum – que uma humilde e realista tentativa de reconhecer certas formas que adornam o território honestamente rejeitado na consciência da autonomia disciplinar e dos limites – dentro dos quais a nossa investigação pode definir-se, de um certo modo, como científica – das nossas competências de estudiosos de arquitetura, que não se confundem com as nossas aspirações vagas de cidadãos e utentes sociais. Trata-se, na verdade, de abandonar por um momento os impulsos políticos e sociológicos e a prática da "reportagem da degradação" – muito em voga hoje – para se limitar, e não se trata de limites, pelo contrário, a investigar, na qualidade de arquiteto, a forma, e compreender até que ponto, objetos e linguagem, não considerados áulicos e sem acreditação, possam constituir, pelo contrário, materiais de construção de interesse. Exatamente como outros, não só no campo arquitetónico, têm repetidamente tentado, ao longo da história, uma cultura nova de partilha. O significado de acreditação A tese de doutoramento entende, portanto, propor uma leitura da paisagem contemporânea, olhando a dinâmica da acreditação como o principal instrumento de reavaliação de alguns objetos e segmentos costeiros da nossa área geográfico-cultural, a fim de enfrentar mais adequadamente a complexidade da gestão de território. A pesquisa explora, portanto, algumas técnicas compositivas para a acreditação, ou seja, contextualiza o objeto, ou o conjunto de objetos, em novos e variados possíveis sistemas de relações funcionais da construção da paisagem, do espaço coletivo, da forma e da contemporaneidade. A acreditação de um objeto está ligada a características intrínsecas e extrínsecas ao mesmo. Esta reside seguramente em atributos formais – forma, dimensões, escala, relação com a paisagem, materiais utilizados – mas sobretudo, amaldiçoando um estéril e perigoso elenco numérico das qualidades a registar, evitando a redução da arquitetura a sistemas meramente quantitativos, em características extrínsecas ao próprio objeto. Em primeiro lugar, a capacidade de criação – aliás, compositiva - que descreve o objeto a ser acreditado, a partir da operação de lançar um olhar sobre este, que é já projeto, transformando-o e tornando evidente com a produção de uma forma (seja ela uma fotografia, uma colagem, um desenho, um poema, uma composição musical) esta transformação. Uma transformação que consiste sobretudo na ativação de novas relações entre o objeto e outros elementos e layers do território, sejam estes materiais ou imateriais. Método e resultados esperados A acumulação de fragmentos da contemporaneidade sobre a forma de um ábaco de elementos de um vocabulário possível, a abstração das formas que adornam a nossa geografia, o confronto sistemático entre "objetos encontrados", esquecimento de hoje, e casos do passado pelos quais existe uma clara e universal atribuição de qualidade, o desnivelamento de um diálogo organizado entre elementos de pontuação, geneticamente heterogéneos, de diversas frentes costeiras, pode constituir um exercício saudável de observação para poder superar o paradigma do pitoresco e da lente da retórica, principais limites da pesquisa de onde é sempre difícil libertar-se. Desta forma, os investigadores, estudiosos, e administradores que colocarem as lentes dadas por esta pesquisa, e através das quais observarem a paisagem, poderão dialogar, debater e criar avanços disciplinares significativos no sentido de compreender as formas do território, concentrando-se nos mecanismos de reconhecimento e acreditação dos elementos que contribuem para a definição da paisagem contemporânea. A utilidade da dissertação é modernizar e atualizar o paradigma em vez de forçar a realidade a uma evolução improvável de "regresso ao futuro", para constituir uma base disciplinar, seja para elaborar cenários possíveis, seja para estruturar sistemas de avaliação de propostas de criação, seja para uma articulação normativa territorial de nova geração para áreas distintas. ; ABSTRACT: Premises Before proceeding with the widening, confirming or retracting of a few cultural and theoretical archetypes in the field of architecture, it may come useful to do the same with the most basic and overriding of the subject matters under examination: that is the vehicle of the conjectures themselves, the result of a third level three year education program: the PhD thesis. Indeed, it is a research, an investigation carrying an experimental flair; original and unreleased, tackled thoroughly by means of skills and techniques able to control its process. It does not intend to be the deification of dogmatic truths, it is not valid all-round nor reveals the absolute summa of knowledge. On the contrary, whether liked or not, the research activity has a two natured incompleteness: of epistemological and temporal nature. In turn, it derives from previous points of view and is based on upstream studies. It is a section of knowledge having a certain validity domain, transmissible and interchangeable among thinkers and operators belonging to the scientific community. Moreover, and at the same time, it has no limits in its chronological validity and it is not the seeking for a target: rather, a starting point inspiring confidence for future academic researches – both of the writer and reader's – for an incessant disciplinary progress. It is also useful to point out that the subject matter of this study is not the result of a whim; the investigation that it prompted, not an idle exercise. Instead, it was the persisting need urging one to measure oneself – trying one's best to remain as much as possible within his specific educational field (now, more than ever, diluted by the many social-anthropological bewitching) – with a healthy realism at the core of the being contemporary. Object of research Therefore, the object of this research is the contemporary landscape of the coastal segments in Southern Europe, made of geography and objets trouvés, ordinary shapes and materials, unacknowledged architectures, often a result of not very straightforward practices – sections of informal coastal towns, products of self building, unauthorized development and regulation ambiguity – which normally are autonomous in their origin, needs, sense and use in respect to a conventional formal reading, but rising great interest in those who are involved in the field of contemporary anthropized environments. Whether we like it or not, these products (human crafts showing, at times, a brutal and imposing stage presence and at times an insignificant or minor and muffled one) represent a considerable part of contemporary landscapes and of professional chances for us architects, being ever more forced to manipulate, transform and correct, both with our gaze and action, the complexity of these set outs, rather than enriching our territories with new volumes. Abusive buildings in Italy cover over 17% of the gross, while the percentage increases reaching 30-40% if considering buildings along coastal areas. Nearby Greece shows similar routine. If, on the other then, one wishes to broaden the dissertation also to those buildings authorized under the regulation point of view, yet upsetting those who observe them, it is obvious that they cover at least half of what we have constantly observed for years. A phenomenon in terms of quantity according to which it is licit on one hand to recognize that the present positivistic regulatory framework is, basically, most useless, and on the other to speak of a compulsory situation, and not of an uncalled for theoretical disquisition. Perhaps we have truly reached the point of no return. Is it at all possible to hypothesize the demolition of whole stretches of buildings along the coastal areas? How to manage the clearing out and hoarding of further billions of square meters of non-recyclable rubble? Is it financially sustainable? Is it dialectically correct? Culturally synchronic? Any demiurgical activity undertaken in order to re-establish an hypothetical golden age or exalted "zero point" of the natural state of things could appear more presumptuous and senseless – although never considered as such by a very popular common sense – than a humble and realistic attempt to give value to certain shapes studding the territory, describing it honestly being aware of the freedom settled by the discipline and boundaries – within which our research may be defined almost nearer a scientific one – of our expertise as academics in architecture, which must not be confused with our aspirations as dwellers or social users. Indeed, it is all about leaving aside for a moment political or sociological drives and the now very popular "environmental degradation reports", to limit oneself – and that is no limit – to investigate as architects, as we are, the shape, understand to which extent objects and languages that are not accredited nor considered noble can instead represent building material tickling a certain interest. Exactly like others, who have experienced, over and over again and not only in the architectural field, the new culture of sharing. The Sense of acknowledging Therefore, the aim of this PhD thesis is to suggest a reading of contemporary landscape, using the dynamics of the acknowledging as a fundamental means to reassess some objects and coastal segments of our cultural and geographical area, with the final objective of tackling more appropriately the complexity of the managing this territory requires. This research investigates some compositional techniques for the accrediting (that is, the putting at stake) of the object itself - or of the objects if a plurality – in new and many possible ways functional to the setting of the landscape, of the collective space, of the shapes of contemporaneity. The inclination of an object to be accredited is connected to its intrinsic and express characteristics. For sure it may be found in its formal qualities – shape, dimension, scale, relation with the landscape, employed materials – but, above all, preventing a sterile and dangerous numerical list of its qualities (an appalling tendency afflicting our time is to reduce architecture to systems measuring mere quantities, in characteristics extrinsic to the object itself. First of all the ability to design – rather, of composition – of who is describing the object to be accredited; starting from the first gaze, which is already designing, transforming it and making that transformation evident by giving it a shape (whether with a photograph, a collage, a drawing, a poem or musical composition). A transformation mainly consisting in activating new relationships between the object and other elements and layers of the territory, both material and intangible. Method and expected results Exercising gathering fragments of contemporaneity, in the form of an abacus of elements composing a possible vocabulary, the abstraction of the forms that stud our geographies, the systematic comparing of disregarded "found objects" of the present and cases of the past for which there exists an established and universal awarding of quality; the unveiling of an orderly dialogue between punctuation elements - genetically heterogeneous – of the different coastal fronts, may represent a healthy training to observation in order to overcome the paradigm of picturesque and the lens of rhetoric; main limits to research, from the domination of which it is always hard to set free of. In this way researcher, academics and managers who will be seeing the landscape through the glasses of this research may converse, discuss and produce significant guideline improvements towards the understanding of the territory, focusing on the mechanisms of acknowledgement and accreditation of the elements concurring to the definition of the contemporary landscape. To update and modernize the paradigm instead of forcing reality in an unconvincing evolution recalling a "return to the future" could represent the disciplinary grounds for developing possible landscapes, for structuring evaluation models for creative proposals, and for the issuing of a new generation of territory laws and regulation dedicated to distinctive areas. ; N/A
RIASSUNTO La scelta di realizzare un Centro Benessere è stata presa per: - la necessità di focalizzare l'attenzione sull'individuo in quanto parte di una comunità, cercando di costruire un luogo che faccia emergere la primaria importanza del pensare a sé stessi, non come forma di egoismo o egocentrismo, ma come opportunità di conoscersi per poi imparare di nuovo a conoscere gli altri in un confronto sempre costruttivo. Ritengo sia importante abbattere quel muro che stiamo innalzando con mattoni fatti di tecnologia e schermi, reintegrando gli antichi insegnamenti, affrontati con la sociologia, riassunti nel significato di Agorà (dal greco antico ἀγορά = raccogliere, radunare). Nell'antica Grecia con questo termine si indicava la piazza principale della polis (città), creata con la consapevolezza dell'inestimabile valore che hanno gli spazi aperti e quelli comuni nell'aggregazione di individui di diversa età, ceto e pensiero. - la possibilità di costruire un edificio non per un'unica persona o per un nucleo familiare con abitudini simili, ma per cercare un "linguaggio comune" per poter soddisfare esigenze e personalità differenti. Il problema è quindi quello di trovare un modello unico di "abito-edificio" che possa calzare su misura al singolo e che, allo stesso tempo, possa valorizzarlo e distinguerlo dagli altri. Il sito oggetto di intervento si trova nella frazione di Laura, nel Comune di Crespina Lorenzana, in provincia di Pisa. È stato fatto un confronto con altri Centri limitrofi ed abbiamo selezionato questo capannone esistente poiché ospitava già una palestra e accoglieva il bacino di utenza sia del Comune di pertinenza sia dei Comuni limitrofi. L'analisi effettuata ha preso spunto dalla conoscenza, dal principio άρχή (arché), delle strutture per la cura, il trattamento e l'intrattenimento del corpo e della mente, sia per gli edifici esistenti nella storia che nelle altre culture, per poi approfondire quali siano le esigenze del territorio e, in modo specifico, della popolazione. Un altro approfondimento è stato fatto con la letteratura studiando professionisti come Le Corbusier con i suoi 5 punti assiomatici di una nuova architettura e le proporzioni con il Modulor e come Bruno Zevi con le sue 7 invarianti dell'architettura moderna. L'occasione di scrivere questa tesi si ha sia con la riprogettazione di un fabbricato già esistente che con la costruzione di una struttura ex novo su un lotto di terreno ancora libero. Il nuovo edificio nascerà infatti nel lotto in aderenza a quello in oggetto di modifiche. Con l'unione delle due strutture si è realizzato il Centro Benessere denominato "IO", idea nata dalle rispettive forme planimetriche. Il fabbricato esistente, un capannone industriale, ha infatti linee rettilinee ed il perimetro è stilizzabile in un rettangolo, la "I". La struttura nuova è stata invece plasmata da tutti i vincoli, dalle normative esistenti, anche e soprattutto in campo di risparmio energetico e di sicurezza , il risultato finale è stata una superficie esterna circolare ed una copertura a tronco di cono obliquo rovescio, la "O". Considerando cha la minima superficie disperdente, data dal rapporto S/V, è quella della sfera, si è deciso, per ovvie ragioni economiche e di fruizione degli spazi interni, di realizzare un volume cilindrico. La scelta di una copertura a compluvio è stata perfezionata utilizzando l'asse del tronco di cono obliquo, scelta presa sia per la raccolta delle acque sia per fornire una maggiore superficie con una inclinazione favorevole ai raggi del sole per l'istallazione di pannelli fotovoltaici. Tutto ciò è stato pensato per massimizzare la copertura da fonti rinnovabili di acqua ed energia. Con Questo progetto si è inoltre cercato di realizzare un Centro Benessere "a misura d'uomo". Per iniziare a dimensionare il nuovo costruito e capire i limiti di una ristrutturazione per l'edificio esistente sono state analizzate, in via preliminare, tutte le normative sia il Regolamento Urbanistico, il Piano Strutturale, le Norme Tecniche Attuative per l'U.T.O.E 9 di Pian di Laura, la Legge Regionale Toscana e la Normativa di Prevenzione Incendi. L'edificio da riqualificare appartiene alla tipologia edilizia del capannone industriale, così come le altre strutture nella stessa strada Via Karol Wojtyla. Questo perché tutta l'area è stata realizzata in forza di un Piano Insediativo Produttivo (PIP). Approfondendo l'inquadramento territoriale, con lo studio del PIP e delle leggi edilizie e urbanistiche, sono stati fissati i vincoli preesistenti entro cui lavorare. Per realizzare entrambi i poli ho studiato l'antica evoluzione dell'individuo, sia nel confronto con gli altri, per migliorare sé stessi attraverso lo sport, sia nella cura del proprio IO attraverso la cura benefica dell'acqua, cura nata con la costruzione delle prime terme. La struttura è stata così suddivisa in un Aria Secca, a cui viene dedicato l'edificato esistente caratterizzato da una planimetria rettangolare, attualmente è ad uso palestra (I) e in un'Aria Umida a cui viene destinato il nuovo fabbricato a pianta circolare (O). Una volta individuate le funzioni attraverso gli Ambiti Funzionali Omogenei (AFO) si sono stabiliti gli specifici Ambiti Spaziali Omogenei (ASO) da cui abbiamo delineato percorsi sostanzialmente unici o a senso alternato per garantire una più semplice igienizzazione degli spazi e per evitare assembramenti anche nel rispetto delle odierne restrizioni anti-Covid. Tenendo ben salde le Normative di Sicurezza Antincendio e quelle per la fruibilità per le persone diversamente abili si sono stabiliti percorsi orizzontali tali da garantire vie di esodo facilmente identificabili (frecce verdi su pavimento bianco e porte con vetrate di colore diverso per tutta l'altezza del fabbricato) e con larghezza tale da permettere sempre la rotazione della sedia a rotelle a 360° ed il passaggio di 2 persone. Considerando la possibilità del cambio d'uso, essendo una struttura pubblica, il dimensionamento delle vie di esodo è stato effettuato in funzione del massimo affollamento possibile relativamente all'edificio in oggetto. Per l'accesso alle persone diversamente abili al secondo piano esistente è stato introdotto un ascensore antincendio adatto ed usufruibile da tutti. Tra gli spogliatoi comprensivi di servizi non vi è nessuna differenza, sono infatti tutti attrezzati per i diversamente abili, inoltre nessuno scalino e nessuna rampa creano percorsi distinti. Per la realizzazione delle stanze si è scelto di unire diversi concetti insieme, così da sollecitare l'attenzione e la curiosità degli utenti ma soprattutto per farli sentire "a casa". I nuovi volumi sono una combinazione tra: 7 colori dell'arcobaleno e il nero per un totale di 8 cilindri, oltre al colore bianco che servirà per i percorsi. Vere e proprie stanze che possiamo ritrovare usualmente nella nostra casa: Cucina, Pranzo, Salotto, Camera, Bagno, Soffitta, Cantina e Ripostiglio. 5 sensi del corpo umano - Olfatto, Gusto, Vista, Tatto e Udito - oltre all'idea di "Alto", di "Basso" e di "Centro". Ritenendo importante stimolare la curiosità degli Utenti e al contempo riprodurre quella sensazione che si ha la sera quando si rientra nella propria casa, si è deciso di unire queste 3 idee tra loro. ROSSO - OLFATTO - CUCINA, ARANCIONE - GUSTO - PRANZO, GIALLO - VISTA - SALOTTO, VERDE - TATTO - CAMERA, BLU - UDITO - BAGNO, INDACO - BASSO - CANTINA, VIOLA - ALTO - SOFFITTA, NERO - CENTRO - RIPOSTIGLIO, BIANCO - CORRIDOIO. L'involucro realizzato, sia per le pareti opache che nelle parti vetrate come nella nuova copertura è stato verificato in rispetto delle vigenti normative igro-termo energetiche. Sfruttando la costruzione decentrata del nuovo edificato è stato possibile realizzare piscine e spazi all'aperto per l'uso nelle giornate più calde. Si sono infine ipotizzate delle linee guida ed un linguaggio per determinare le "Invarianti dell'Architettura del Benessere". 1. Studio Preliminare - Territorio, Letteratura e Normativa 2. Energia - Forma Involucro 3. Ambiti Funzionali e Spaziali - Stanze 4. Percorsi Riconoscibili e Distanze Minime - Corridoi 5. Sicurezza Antincendio e Strutturale - Materiali 6. Fruibilità senza distinzioni - Struttura Nuova ad Unico Piano 7. Benessere della Struttura 8. Rapporto Interno ed Esterno – Luce ed Ombra Questo è stato almeno il mio ordine prioritario per progettare questo Centro Benessere. Se per una singola abitazione è necessario raccogliere i vincoli e le preferenze dei committenti che la andranno ad abitare allora l'obiettivo che questa Tesi ha cercato di centrare è stato quello di far sentire a casa propria ogni utente che fa ingresso nel Centro Benessere "IO". Almeno le Strutture Architettoniche dovrebbero farci sentire "Ugualmente Diversi" SUMMARY The choice to make a wellness center was carried out for: - The need to focus attention on the individual as part of a community, trying to build a place that brings out the primary importance of thinking of oneself, not as a form of selfishness or egocentrism, but as an opportunity to get to know each other Learn again to learn about others in an always construction comparison. I believe it is important to break down that wall that we are raising with bricks made of technology and screens, remembering the ancient teachings, addressed with sociology, summarized in the meaning of Agorà (from ancient Greek ἀγορά = collect, gather). In ancient Greece with this term the main square of the polis (city) was indicated, created with the awareness of the anestimable value that have open spaces and those common for the aggregation of individuals of different age, class and thought. - The possibility of building a building not for a single person or a family unit with similar habits, but to look for a "common language" in order to satisfy different needs and personalities. The problem is therefore to find a unique model of "building-building" that can fit into size to the individual and that at the same time, can enhance it and distinguish it from the others. The site under intervention is located in the hamlet of Laura, in the municipality of Crespina Lorenzana, in the province of Pisa. A comparison has been made with other neighboring centers and this existing shed was selected as it already housed a gym and welcomed the catchment area both of the municipality of relevance and neighboring municipalities. The analysis carried out has taken inspiration from the knowledge, from the principle άρχή (arché), the structures for the care, treatment and entertainment of the body and mind, both for the buildings existing in history and in other cultures, and then deepen What are the needs of the territory and, specifically, of the population. Another in-depth study was made with literature studying professionals such as Corbusier with its 5 axiomatic points of a new architecture and proportions with the Modulor and as Bruno Zevi with its 7 invariants of modern architecture. Writing this thesis was the opportunity to be redeemed an existing building that the design of a construction of an ex-novo structure on a lot of land still free. The new building will be born in the lot in adherence to that in the object of changes. With the union of the two structures the wellness center called "IO" was created, an idea born from the respective planimetric forms. The existing building, an industrial warehouse, has in fact straight lines and the perimeter is stiluable in a rectangle, the "I". The new structure was instead shaped by all constraints, existing regulations, also and above all in the field of energy saving and security. The final result was a circular external surface and a trunk cover of oblique reverse cone, the "o". Considering the minimum dispersing area, given by the S / V report, it is that of the sphere, it was decided, for obvious economic reasons and of the use of the interior spaces, to carry out a cylindrical volume. The choice of a complyed cover was perfected using the axis of the oblique cone trunk, choice socket both for the collection of water and to provide a greater surface with a tilt in favor of the sun's rays for the installation of photovoltaic panels. All this was designed to maximize roof from renewable water and energy sources. With this project we also tried to create a wellness center "to a human scale". To start sizing the new built and understanding the limits of a restructuring for the existing building have been analyzed, all the regulations are the urban regulation, the Structural Plan, the technical implementing rules for Utoe 9 by Pian di Laura, the regional Tuscan law and fire prevention legislation. The building to be redeveloped belongs to the building type of the industrial warehouse, as well as the other structures on the same street Via Karol Wojtyla. Considering the possibility of the change of use, being a public structure, the dimensioning of the exodus routes was carried out according to the maximum possible crowding relative to the building in question. For access to people with disabilities at the second existing floor a suitable fire lift was introduced and usable by all. There are no difference between the changing rooms, there are no difference, they are all equipped for the disabled people, moreover no step and no ramp create distinct paths. For the realization of the rooms it was chosen to combine different concepts together, so as to urge the attention of users but above all to make them feel "at home". The new volumes are a combination of: - 7 colors of the rainbow and black for a total of 8 cylinders, in addition to the white color that will serve for the paths. - Real rooms that can usually find in our house: kitchen, lunch, living room, bedroom, bathroom, attic, cellar and storage room. - 5 senses of the human body - smell, taste, sight, touch and hearing - in addition to the idea of "high", of "low" and "center". Retentioning important to stimulate users' curiosity and at the same time reproduce that feeling that you have in the evening when you return to your home, you decided to join these 3 ideas between them. This PhD dissertation proposes a geopolitical analysis of a centrasiatic transborder region, theFerghana Valley, which is today divided between the Republics of Uzbekistan, Tajikistan andKyrgyzstan.A basis of the research, field trips spread over the past three years enabled the development ofinstruments such as border analysis, analytical cartography, qualitative interviews with experts andinhabitants, and bibliographical research in the Ferghana as well as the Uzbek capital city Tashkent– noticeably at the French Institute for Central Asian Studies (IFEAC). As a complement to thefield trips in Central Asia, a research period in France permitted both a consolidation in geopoliticaltheory at the French Institute of Geopolitics (IFG) of the University of Paris 8-Vincennes, andadditional bibliographical research at the French National Library (BNF).The topic of the research is hence the analysis of power rivalries between "territorial actors" overthe "territorial stake" of the Fergana Valley, a fertile basin of strategical location within the largergeopolitical context of Central Asia. Always a stake disputed by various territorial actors over time,the Fergana Valley now experiences power rivalries from contemporaneous territorial actors firstand foremost on the border and transborder levels.By doing so, the dissertation introduces a new actor in the classical geopolitical pattern of analysis:the cultural regionalism. The dissertation hence offers a detailed presentation of the culturalregionalism as well as an evaluation of its past and current importance.First focusing on the centrasiatic context and the peculiarities which stem from its borders, theintroduction presents the "stake" Fergana and its economic and physical resources which explainits importance as a territory. A rapid summary of the theory of geopolitics follows, with thejustification of the choice of the French Lacostian school as the theoretical frame of this work. Theintroduction closes on a first analysis of the Fergana as a space of border or frontier.First partThe thesis is structured in two main parts. The first, more theoretical, analyses each of the threeterritorial actors which aim for power over the Fergana: the Nation, the Religion, and the CulturalRegionalism. The presentation of the actors, of their respective embodiments and of theirmanifestations within the ferganian territory is organised according to a conceptual rationale; eventsthat occurred simultaneously are thus not considered following a chronological order, butseparately, according to their respective relations with the actors evoked.The first chapter focuses on the actor Nation. By this word we understand not only the effectiveentity of the Nation-State, and its three embodiments (Uzbekistan, Tajikistan, Kyrgyzstan), but alsothe Nation as an ideology which acts upon the territory through nationalistic policies. The force oflegitimation of the actor Nation did certainly not have a neutral role in the rise of this actor in theFerganian landscape, a process which led the Nation to the top of the geopolitical actors' hierarchyin the region. This chapter also analyses the representations of the Fergana which are defined andimplemented by the actor Nation since its birth in the 1920s. In fact, the Fergana valley first becamea transborder region only in these years, through its integration to the Union of the Socialist SovietRepublics (USSR) and its partition between three of the five newly created Socialist SovietRepublics in Central Asia. In the 1990s, following the fall of the USSR and the independence of thethree Republics, the borders which divided the Ferghana stopped being only internal, but becamereal and proper international borders. Among the main representations that this study looks at, aparticular attention is devoted to the study of the national borders , their creation and theirevolution. The chapter also looks at the relations between the different Nation-States, which form aunique actor when they rival against the other territorial actors – the Religion and the CulturalRegionalism –, but three well different ones when they rival among themselves.The second chapter concentrates upon the second territorial actor, the Religion. The Fergana valleyis one of the most pious and practicing region of Central Asia, and the Islamic religion alwaysplayed a major role in the society's administration and organization.The chapter proposes first an analysis of the religion's representations in the Fergana: theautochthonous sufism and its sacred geography within the Fergana valley ; the traditional Islam ofthe soviet times, which became a legal weapon used by Moscow to fight the sufi orthodoxy in theFergana ; the recently appeared wahabbite fundamentalism, imported from Afghanistan, Pakistanand Saudi Arabia following the Soviet invasion of Afghanistan in 1979 and the encounter it inducedbetween the soviet muslims and the afghan mujaheddins.It is then examined how the different variations of the actor opposed themselves to the actor Nation,over the years, for the control over the power and the resources of the Fergana. We look at how thegeopolitical rivalries vary dramatically from the soviet era to that of the independence. A specialattention is devoted to the phenomenon of politization of the actor Religion and the way this led theReligion to endorse a role of protagonist in many of the Fergana's events.The third actor is the Cultural Regionalism. It is hereby referred to the geo-cultural identity of thisregional entity, which persists in spite of nationalistic and religious pressures. In fact, as long as theFergana has existed as a place, it has always constituted a geographical, political and social whole.Although its population has been characterized during the past centuries by high levels ofmultiethnicity and linguistic heterogeneity, this did not prevent the societal amalgamation ofpopulations which always held multiethnicity as normality, and always attributed to each "group" aspecific social role within the system Fergana.Be they of language and culture persian and sedentary, turk and sedentary or turk and nomadic,these populations always shared, each in its own social role, a common life within the region. Thisvery phenomenon is the main characteristic of what we call the Cultural Regionalism of theFergana.However, this equilibrium changes with the loss of political sovereignty of the region and the rise ofnationalism under the soviet sovereignty. This chapter analyzes the main representation of the actorCultural Regionalism over time, and how it took stand against the other territorial actors, especiallythe Nation.Second partThe second part of the dissertation as dedicated to the current manifestations of the territorial actorsin the Fergana valley, particularly in its border zones. This part results from the interviews and fieldobservation undertaken in Central Asia and the Fergana in 2007, 2009 and 2010.The first chapter analyzes the border of this region from a theoretical point of view, especially in thelight of the geostrategical categories of "first line of defence" or "last line of defence".In the context of a transformation of the border from the soviet era to that of the independence, thesecond chapter explores the definition of the centrasiatic border, mainly through the analysis ofborder bureaucracy, control posts and documents required to cross the border. The chapter looks atthemes connected to the commercial transborder relations : how the "three" Fergana still manage tointeract despite growing border rigidity, which social relationships subsist today. The qualitativeinterviews led in the Fergana are a major source in this process of reviewing the difficulties ofpassage and communication within the valley, and of tracking the actual presence of the threegeopolitical actors which play a major role in the border relations and conflicts.The third chapter focuses on the Ferganian urban centres: their history, the relations that theFerganians have with them, et above all the internal and external representations of these centres ina now fully transborder region.The fourth chapter concentrates on the demographical evolutions of the Ferganian population. Upuntil then a land of immigration, the Fergana became a land of emigration following theindependence and the materialization of the borders.The fifth chapter deals with the Ferganian infrastructures, especially the rail and road networks, andtheir relationship of reciprocal influence with the mutation of the borders in the region.The sixth chapter builds on the theoretical interrogations evoked in the introduction of thedissertation and develops a conclusive analysis of the Fergana of the borders nowadays.ConclusionThe conclusion of this research depicts the current Fergana, the relations between the differentgeopolitical actors and underscores the persistence of the actor Cultural Regionalism.It establishes the existence of tremendous changes in the region Fergana from various viewpoints:the Ferganian population has new frames of cultural, political and social reference whoseimportance increased dramatically ; new political forms and cultural structures influenced its selfimage,its very identity: "russian, muslim, ferganian", then "soviet, uzbek (or tajik or kyrgyz),atheist, ferganian", finally "uzbek (or tajik or kyrgyz), secular, ferganian".However, although the territory, its borders and inhabitants changed, and despite the strongobstacles set by the actor Nation, the cultural regionalism succeeded in maintaining itself, byadapting to the new tendencies and ways of interpretation of the Fergana.The conclusion ends with the most recent events of the Fergana, the Andjian massacre in 2005 andthe Osh clash in 2010, which are both analysed in the light of the geopolitical power rivalries whichpersist in the region. ; IntroductionCette thèse de Doctorat propose une analyse géopolitique d'une région transfrontalière de l'Asiecentrale, la vallée du Ferghana, aujourd'hui divisée entre les Républiques d'Ouzbékistan, duTadjikistan et du Kirghizistan.Des séjours sur le terrain répartis sur trois ans ont constitué la base de la recherche, au travers del'analyse des frontières, de la cartographie analytique, d'entretiens qualitatifs avec experts ethabitants, et de recherches bibliographiques dans le Ferghana ainsi que dans la capitale ouzbèkeTachkent – notamment près l'Institut Français d'Etudes sur l'Asie Centrale (IFEAC). La première, à dominante théorique, analyse à tourde rôle les trois acteurs territoriaux qui rivalisent pour le pouvoir sur le Ferghana: il s'agit de laNation, de la Religion, et du Régionalisme culturel. La présentation des acteurs, de leursdifférentes incarnations et de leurs représentations respectives du territoire ferghanien sont ainsiabordés selon un ordre conceptuel ; des évènements s'étant produits simultanément ne sont ainsipas analysés chronologiquement mais séparément, en tant qu'ils se rapportent aux acteurs évoqués.Le premier chapitre est consacré à l'acteur Nation. Par cette expression nous entendons nonseulement l'entité effective Etat-Nation et ses trois incarnations (Ouzbékistan, Tadjikistan,Kirghizistan), mais aussi la Nation comme idéologie qui agit sur le territoire au travers depolitiques nationalistes. La force de légitimation de l'acteur Nation n'est pas étrangère àl'accroissement de son importance sur ce territoire, qui l'a sans aucun doute mené au sommet de lahiérarchie des acteurs géopolitiques dans cette région. Ce chapitre analyse les représentations duFerghana définies et mises en oeuvres par l'acteur Nation depuis son apparition dans les années1920. La vallée du Ferghana est en effet devenue une région transfrontalière à cette époque, avecson intégration à l'Union des Républiques Socialistes Soviétiques (URSS) et sa partition entre troisdes cinq Républiques Socialistes Soviétiques nouvellement créées en Asie Centrale. Dans lesannées 1990, avec la chute de l'URSS et l'indépendance des trois Républiques, les frontières quidivisaient le Ferghana ne sont plus simplement internes, mais deviennent bel et bieninternationales. Parmi les représentations majeures qui font l'objet d'une étude dans ce chapitre,une attention particulière est portée aux frontières nationales, leur création et leur évolution. Lechapitre s'intéresse également aux relations entre les différents Etats-Nations, qui constituent unacteur unique lorsqu'ils rivalisent contre les autres acteurs territoriaux – la Religion et leRégionalisme culturel – mais aussi trois acteurs différenciés lorsqu'ils se disputent le territoireFerghana entre eux.Le deuxième chapitre est consacré au deuxième acteur territorial, la Religion. La vallée duFerghana est l'une des régions d'Asie centrale les plus croyantes et pratiquantes, et la religionislamique y a toujours eu un rôle important dans la gestion de la société.Ce chapitre propose d'abord une analyse des représentations de la religion dans le Ferghana : lesoufisme autochtone et la "géographie sacrée" des hauts lieux de ce courant de l'Islam dans leFerghana ; l'Islam traditionnel de la période soviétique, devenu une arme légale utilisée parMoscou pour combattre l'orthodoxie soufie du Ferghana ; le fondamentalisme wahabbiterécemment apparu, importé d'Afghanistan, du Pakistan et d'Arabie Saoudite à la suite del'invasion de l'Afghanistan par les Soviétiques en 1979 et de la rencontre qui s'en est ensuivieentre les musulmans soviétiques et les moudjahiddines afghans.Ensuite est examinée la manière dont les différentes variantes de l'acteur Religion se sontopposées, au cours des années, à l'acteur Nation pour le contrôle du pouvoir et des ressources duterritoire Ferghana. Nous y voyons comment la rivalité géopolitique entre deux acteurs varie dutout au tout selon que l'on parle de l'acteur Nation au cours de la période Soviétique ou bien aucours de l'ère ayant succédé à l'indépendance.Une attention particulière est portée au phénomène de politisation de l'acteur Religion et à lamanière dont cette politisation a amené la Religion à assumer un rôle de protagoniste dans denombreux évènements du Ferghana.Le troisième acteur est le Régionalisme culturel. Avec cette expression nous faisons référence àl'identité géo-culturelle de cet ensemble régional, qui persiste malgré les pressions nationalistes etreligieuses. Car aussi loin que remonte son existence en tant que lieu, la vallée du Ferghana atoujours constitué un ensemble géographique, politique et social à part entière. Bien que sapopulation se soit distinguée au cours des derniers siècles par une grande multiethnicité ethétérogénéité linguistique, cela n'a pas empêché un amalgame sociétal de cette population qui atoujours considéré la multiethnicité comme normale, et toujours a attribué à chaque « ethnie » unrôle social déterminé au sein du système Ferghana.Qu'elles soient de langue et de culture persane et sédentaire, de langue et de culture turque etsédentaire, ou bien de langue et de culture turque et nomade, ces populations ont toujours partagé,chacune dans son propre rôle social, une vie communautaire au sein de la région, et ce phénomèneest la caractéristique principale de ce que nous appelons le Régionalisme culturel du Ferghana.Cependant, cet équilibre change avec la perte de souveraineté politique de la région, l'avènementdu nationalisme sous l'action de l'URSS, et la partition de l'espace entre trois Etats nations del'Asie centrale soviétique. Ce chapitre analyse ainsi les principales représentations de l'acteurRégionalisme culturel au cours du temps, et comment il s'est opposé aux autres acteursterritoriaux, en particulier à l'acteur Nation.Seconde partieLa seconde partie de ce travail est dédiée aux manifestations actuelles des acteurs territoriaux dansla vallée du Ferghana, plus spécialement dans ses zones de frontière. Cette partie est le résultat desentretiens et des observations de terrain réalisés en Asie centrale et dans le Ferghana au cours deséjours en 2007, 2009 et 2010.Le premier chapitre analyse la frontière de cette région du point de vue théorique, à la lumièrenotamment des catégories géostratégiques de "première ligne de défense" ou "dernière ligne dedéfense".Dans le contexte d'une modification de la frontière entre l'époque soviétique et celle del'indépendance, le deuxième chapitre approfondit la définition de frontière centrasiatique, autravers principalement de l'analyse de la bureaucratie de frontière, des postes de contrôle et desdocuments requis pour le passage de la frontière. Les thématiques liées aux relations commercialestransfrontalières y sont examinées : comment les "trois" Ferghana parviennent encore à interagirmalgré la rigidité croissante des frontières, quelles relations sociales transfrontalières subsistent ausein du Ferghana d'aujourd'hui. Les entretiens qualitatifs réalisés dans le Ferghana jouent un rôlemajeur pour recenser les difficultés de passage et de communication dans la vallée et déceler, dansles descriptions et jugements recueillis, la présence des trois acteurs géopolitiques qui toujoursjouent un rôle fondamental dans les relations et conflits de frontière.Le troisième chapitre est dédié aux centres urbains du Ferghana : leur histoire, le rapport que lesFerghaniens entretiennent avec eux, et surtout les représentations internes et externes que lescentres urbains assument au sein d'une région désormais tout à fait transfrontalière.Le quatrième chapitre se concentre sur les évolutions démographiques de la population. Jusque làterre d'immigration tout au long des années tsaristes et soviétiques, le Ferghana est devenu uneterre d'émigration avec l'indépendance et la concrétisation des frontières.Le cinquième chapitre s'intéresse au Ferghana des infrastructures, notamment les réseaux ferré etroutier, et leur rapport d'influence réciproque mutations frontalières de cette région.Le sixième chapitre reprend les interrogations théoriques posées dans l'introduction et développeune analyse conclusive sur le Ferghana des frontières aujourd'hui.ConclusionLa conclusion de cette recherche dresse le bilan actuel du Ferghana et des rapports entre lesdifférents acteurs géopolitiques, et observe la persistance de l'acteur Régionalisme culturel.Force est de constater l'existence de changements dans la région Ferghana à différents points devue. La population ferghanienne dispose de nouveaux cadres de référence culturels, politiques etsociaux qui ont pris une importance majeure. Des nouvelles formes politiques et de structuresculturelles ont eu un impact sur son image d'elle-même, sur son identité: "russe, musulmane,ferghanienne", puis "soviétique, ouzbèke (ou tadjike ou kirghiz), athée, ferghanienne", et enfin"ouzbèke (ou tadjike ou kirghiz), laïque, ferghanienne".Cependant, bien que le territoire, ses frontières et la société qui l'habite aient changé, et malgré lesobstacles forts posés par l'acteur Nation, que Régionalisme culturel a réussi à survivre, ens'adaptant aux nouvelles tendances et aux nouveaux modes d'interprétation du Ferghana.La conclusion s'achève sur les évènements les plus récents du Ferghana; massacre d'Andijan en2005 et affrontements à Osh en juin 2010, qui sont analysés à la lumière des rivalités de pouvoirgéopolitique qui persistent encore dans la région.
Dottorato di ricerca in Diritto dei contratti pubblici e privati ; La persistente inefficienza nell'utilizzo delle risorse umane nel settore del lavoro pubblico impone l'attenzione sul come la pubblica amministrazione stia tentando di rispondere alle nuove complesse problematiche poste a livello nazionale, internazionale e globale. In un mercato del lavoro in rapido sviluppo il settore del lavoro pubblico mostra una scarsa dinamicità ed una certa resistenza ad accettare soluzioni innovative. Si parla da molto tempo della necessità di innovare il rapporto di lavoro nel settore pubblico "privatizzato" e la pubblica amministrazione in generale, ma solo da ultimo il lavoro alle dipendenze delle pubbliche amministrazioni ha conosciuto uno stimolo all'uso dei fattori premiali e flessibili grazie all'introduzione della valutazione della performance. Innovare attraverso lo strumento della flessibilità contrattuale nel settore del lavoro pubblico significa raggiungere l'obiettivo dell'efficienza. Per questo bisogna indagare se il problema della mancata efficienza sia di carattere giuridico "contrattuale" o le ragioni vadano indagate anche rispetto ad una complessità progettuale che tenga conto della cultura e dei processi sociali. L'indagine, in questa sede, è finalizzata allo studio dell'adattabilità delle tipologie contrattuali di lavoro flessibile, utilizzabili per l'organizzazione e la gestione del personale nelle pubbliche amministrazioni. L'uso di tali tipologie è divenuto, combinato con la necessità di produttività ed efficienza, fondamentale per la politica di sviluppo delle pubbliche amministrazioni, ma soprattutto indispensabile per l'attuazione delle politiche di contenimento della spesa, (così dette di spending review), per il personale che, in modo particolare a partire dalla fine degli anni novanta, ha raggiunto un livello rilevante. Ciò ha generato una serie di provvedimenti limitativi tendenti a bloccare le nuove assunzioni nel tentativo di raggiungere nello stesso momento un contenimento dei costi ed una riduzione del personale ritenuto, non sempre a ragione, eccedente il fabbisogno, il tutto, ovviamente nel tentativo di incrementare l'efficienza dei servizi erogati. Per tipologie contrattuali flessibili di lavoro si intendono tutte quelle che differiscono dal contratto di lavoro subordinato a tempo pieno ed indeterminato, disciplinato dall'art. 2094 cod. civ. e definito contratto di lavoro standard. Partendo dalle linee guida tracciate dalla legge n. 15 del 4 marzo 2009, di riforma del pubblico impiego, sono state analizzate le misure che disciplinano le modalità attraverso le quali le pubbliche amministrazioni possono avvalersi delle tipologie contrattuali di lavoro flessibile. Per meglio inquadrare l'attuale riforma del lavoro nel settore pubblico privatizzato (in questo studio indicata come Terza Riforma) è necessaria la ricostruzione storica della disciplina normativa del rapporto di lavoro nelle pubbliche amministrazioni, prendendo le mosse in un'ottica efficientistica e passando attraverso l'evoluzione dei modelli contrattuali che l'hanno caratterizzata, partendo dal modello unilaterale e autoritativo fino ad arrivare al modello contrattuale pattizio e paritario. Attraverso questa ricostruzione è possibile individuare i principi fondamentali, quali l'efficienza dell'organizzazione delle pubbliche amministrazioni, l'intangibilità dell'organizzazione e del potere datoriale e la relativa responsabilità dirigenziale, la specialità dell'accesso agli uffici pubblici (anche in attuazione del principio costituzionale di uguaglianza contenuto nell'art. 3 e dell'imposizione della stessa Costituzione all'art. 97, co. 3, del concorso pubblico, salvo i casi di deroga stabiliti dalla legge, quale forma di reclutamento a garanzia dell'imparzialità della pubblica amministrazione), che sono il presupposto essenziale posto alla base del possibile utilizzo per le pubbliche amministrazioni sia dei contratti di lavoro standard sia dei contratti di lavoro flessibile. L'uso dei contratti di lavoro flessibile rappresenta uno strumento idoneo, quando inserito tra i vari strumenti ed obiettivi primari delle pubbliche amministrazioni, a garantire la migliore organizzazione degli uffici se finalizzato a perseguire il buon andamento della pubblica amministrazione, così come previsto dall'art. 97 della Costituzione. Grazie ad un opportuno utilizzo delle risorse umane diviene possibile raggiungere anche l'ulteriore obiettivo, primario per le pubbliche amministrazioni, del controllo delle risorse finanziarie. Una conoscenza approfondita della gestione delle risorse umane (dipendenti con contratto di lavoro standard e non) ed una attenta analisi del contesto di riferimento possono favorire una efficiente razionalizzazione delle risorse, non solo in merito all'organizzazione degli uffici e del lavoro, ma anche sul piano politico, economico e sociale, piani con cui fino ad oggi si è dovuto scontrare il datore di lavoro pubblico nell'uso delle tipologie contrattuali di lavoro flessibile inserite nella gestione del personale e delle risorse delle pubbliche amministrazioni. Non a caso l'art. 36 del decreto legislativo n. 165 del 2001, Testo Unico del Pubblico Impiego, ed in particolare il comma 3, così come da ultimo modificato dall'art. 17, comma 26, del decreto legge n. 78 del 2009, ha evidenziato che un sistema che preveda l'uso delle predette tipologie contrattuali come strumento di gestione per le pubbliche amministrazioni deve essere finalizzato a combattere gli abusi derivanti dal suo uso distorto. L'abuso e l'uso distorto delle tipologie contrattuali flessibili ha dato vita ad un intenso precariato, sanato ciclicamente dalle norme dette di "stabilizzazione" (norme che sono state oggetto di valutazione di legittimità costituzionale). Attraverso una attenta analisi dell'attuale contenuto dell'art. 36 del d.lgs. n. 165 del 2001 è possibile individuare, tenendo a mente la disciplina che regola il rapporto di lavoro nel settore privato, da una parte gli aspetti critici dell'impianto regolativo che consentono di verificare la distanza tracciata tra le discipline che permettono l'uso delle tipologie contrattuali di lavoro flessibile da applicarsi al datore di lavoro privato con quelle riservate al datore di lavoro pubblico, e dall'altra individuare quanto sia ancora presente nel rapporto di lavoro alle dipendenze delle pubbliche amministrazioni del modello unilaterale ed autoritativo che caratterizzava il rapporto di pubblico impiego prima della privatizzazione del rapporto di lavoro. Partendo dalla prima versione contenuta nel decreto legislativo n. 29 del 1993, dei primi due commi del citato art. 36, è possibile individuare il campo di applicazione dei rapporti giuridici derivanti dalla stipulazione dei contratti di lavoro flessibile ivi elencati. Sono così messe in risalto le diversità esistenti tra la disciplina prevista per i rapporti di lavoro alle dipendenze del privato datore di lavoro e la disciplina prevista per il pubblico impiego privatizzato. Grazie alla comparazione tra il contenuto delle norme che disciplinano ciascuna tipologia contrattuale flessibile inclusa nel contenuto dell'art. 36 d.lgs. n. 165/2001 ed il suo valore precettivo è stato possibile verificare la specialità che caratterizza il rapporto di lavoro nelle pubbliche amministrazioni e l'uso delle tipologie contrattuali flessibili. Il rinvio inserito nel secondo comma dell'art. 36 del d.lgs. n. 165/2001 al contenuto dei contratti collettivi nazionali di lavoro, che hanno il compito di disciplinare la materia dei contratti di lavoro a tempo determinato, dei contratti di formazione e lavoro, degli altri rapporti formativi e della somministrazione di lavoro, del lavoro accessorio e dei lavoratori socialmente utili, mette in luce la possibilità per l'autonomia collettiva di regolare ed integrare i singoli schemi contrattuali, realizzando, se così fosse, lo schema del modello contrattuale pattizio, ed evidenziando, in realtà, il limite costituito dall'essere circoscritta alla sola individuazione dei contingenti di personale da utilizzare. Una piccola parte dell'indagine è dedicata al lavoro a tempo parziale ed agli incarichi dirigenziali del personale inquadrato con contratto standard che, seppur inseriti nel contesto del rapporto a tempo indeterminato, sono anch'essi espressione di flessibilità del lavoro nelle pubbliche amministrazioni considerati nell'ottica efficientistica dell'organizzazione amministrativa. Gli incarichi di collaborazione coordinata e continuativa e gli incarichi dirigenziali a tempo determinato conferiti a dipendenti sia interni sia esterni all'amministrazione che pubblica il bando presentano degli aspetti critici che hanno avuto spazio per un breve sviluppo. L'analisi del comma 5, dell'art. 36 del d.lgs. n. 165/2001, ha permesso di sviluppare il tema della violazione delle disposizioni imperative; ipotesi che nel passato ha trovato scarsa applicazione ma oggi, grazie alla recente versione introdotta dalla legge n. 102 del 2009, ribadisce, con più forza, la misura disciplinare che prevede il recupero nei confronti dei responsabili dirigenti inosservanti delle somme erogate dall'Amministrazione per l'impiego di lavoratori assunti con contratti di lavoro flessibile illegittimi. Interessante, considerata l'abrogazione della conciliazione obbligatoria in materia lavoro, anche per gli esigui risultati ottenuti, risulta la possibile applicazione al settore pubblico privatizzato delle forme irrituali di deflazione del contenzioso quali l'arbitrato e la conciliazione alla luce delle recenti innovazioni introdotte con la legge n. 183 del 2010, cd. Collegato Lavoro e dalla disciplina emanata, da ultimo, in materia di mediazione con il D.Lgs. n. 28 del 2010 e il D.M. n. 180 del 2010, così come modificato ed integrato dal D.M. n. 145 del 2011. Ulteriori considerazioni giungono dalla previsione obbligatoria, per tutte le amministrazioni, di redigere ogni anno un rapporto informativo da trasmettere ai nuclei di valutazione nonché alla Presidenza del Consiglio dei Ministri sulle tipologie di lavoro flessibile utilizzate relativamente alla quantità numerica ed alla spesa relativa per tipologia. Tale rapporto informativo è uno strumento avente duplice finalità: la prima è quella di permettere di individuare il dirigente responsabile dell'irregolare utilizzo delle tipologie contrattuali non standard, attraverso la verifica degli atti gestionali posti in essere; la seconda si avvale della possibilità, offerta da una rapida conoscenza del fenomeno, di adottare misure mirate a migliorare sia l'aspetto normativo, sia quello organizzativo che di controllo della gestione delle risorse umane e finanziarie. Aspetti che rilevano la necessità di insediare in maniera efficace la cultura della buona amministrazione della cosa pubblica. Questa linea di condotta rappresenta la migliore politica per realizzare i principi di trasparenza ed imparzialità propri delle pubbliche amministrazioni. Principi idonei ad evitare che l'uso dei contratti di lavoro non standard degenerino in forme di precariato o realizzino una alternativa modalità di accesso ai ruoli professionali delle pubbliche amministrazioni, elusiva, grazie al collaudato ricorso a norme che introducono le procedure di stabilizzazione, dei previsti concorsi pubblici di accesso all'impiego pubblico per contratti di lavoro a tempo indeterminato. Alla luce dei recentissimi interventi normativi e giurisprudenziali, merita una trattazione il "caso" rappresentato dai rapporti di lavoro flessibili utilizzati dal Ministero della Pubblica istruzione, sia per il personale docente sia per il personale amministrativo definito ATA. Prendendo spunto dai testi normativi (legge n. 124 del 1999 e D.P.R. n. 430 del 2000), la ricerca ha evidenziato alcuni aspetti critici rispetto all'applicabilità della direttiva comunitaria in tema di contratti a termine. Nelle conclusioni vengono messi in luce i caratteri del modello contrattuale neo-autoritatio, attualmente utilizzato, nella Terza Riforma, dalle pubbliche amministrazioni. Ulteriori considerazioni finali sono orientate ad indagare gli effetti che la imminente riforma del mercato del lavoro, attualmente in discussione in Parlamento, avrà anche nel settore pubblico "privatizzato" ed in particolar modo quali novità introdurrà rispetto all'uso delle tipologie contrattuali di lavoro flessibile; e quali di queste saranno sviluppate nel tentativo di fornire una soluzione circa l'opportunità che la pubblica amministrazione utilizzi - ancora una volta - uno schema negoziale previsto nel settore privato ma "riadattato" alle esigenze di specialità, insite nel rapporto di lavoro del settore pubblico, comunque insuperabili. ; The persistent inefficiency in human resources management in the public sector draws our attention on how the public administration is currently trying to face the new, complex issues raised on a national, international and global level. In a fast-developing labour market, the public sector is showing a scarce dynamism and a certain resistance to accepting innovative solutions. The discussion about the need to innovate the "privatised" working relationship and the public administration in general has been going on for quite some time; still, only recently performance evaluation has been introduced for "privatised" jobs within public administrations. Contractual flexibility in the public sector is an innovation that typically equals to more efficiency. That is why it seems necessary to us to investigate the reasons behind the lack of efficiency: is it only due to contractual issues or are there more complex causes, linked to cultural and social processes? Our study aims to investigate the adaptability of flexible employment contracts – that could be used to handle the organisation and management of personnel in public administrations – within the neo-authoritative contract model's framework. The use of these types of contracts, together with the need for improved productivity and efficiency, has become fundamental to the development policy of public administrations. It is also essential for the implementation of cost containment policies - the so-called spending review – for the personnel who, starting from the late 1990s, reached high levels in the organization. Control measures have been previously taken: aiming at improving the efficiency of the services provided, by containing costs and reducing personnel – wrongly deemed redundant –, new employments were blocked. By flexible employment contracts we mean all those types of contracts which are different from a full-time, permanent contract of employment, disciplined by the Article 2094 of the Italian civil code and defined as standard employment contract. Starting from the guidelines outlined in law n.15 of 4th March 2009 – which reformed public employment – we analyse the measures which discipline the way public administrations can avail themselves of flexible work contracts. To better understand the third reform of labour in the privatised public sector, it is necessary to examine the historical reconstruction of the normative discipline that regulates the working relationship within the public administrations: starting from the assumption of performance improvement, through the evolution of contract types which characterised it, from the unilateral and authoritative model to the pactional and equal one. Thanks to this reconstruction it is possible to identify the fundamental principles which are the basis of a possible use, by public administrations, of both standard employment contracts and flexible ones. This principles are "the efficiency of public administrations' organizations", "the intangibility of the organization, of the employer's power and its relative managerial responsibility", "the access to public offices" (relating to the application of the constitutional principle of equality, included in art.3, and to the imposition with the art.97 co.3 of the Constitution of public competitive examinations as the hiring method, except for dispensations stated by the law, in order to guarantee the public administration's impartiality). When included among the several instruments and primary objectives of public administrations, the use of flexible employment contracts represents a suitable tool to guarantee an improved organization of the offices, especially if it is aimed at pursuing the overall public administration's good performance (according to art.97 of the Constitution). Thanks to an appropriate management of human resources, it also becomes possible to reach a further target of primary importance for public administrations: the control of financial resources. An in-depth knowledge of human resources management (be them either employed through a standard contract or a flexible one), combined with a detailed analysis of the relevant context could support an efficient rationalisation of resources, not only on an organizational level but also on a political, economical and social one. The latter ones being so far the most complicated to deal with when managers tried to use flexible types of contracts within public administrations. It is not a coincidence that art. 36 of legislative decree n.165 of 2001 (Testo Unico per il Pubblico Impiego) and especially paragraph 3, eventually modified by art. 17 paragraph 6 of legislative decree n.78 of 2009, highlights that a system which foresees the use of the above-mentioned types of contracts as a management instrument for public administrations must be aiming at fighting the abuse deriving from its own distorted use. The abuse and distorted use of flexible employment contracts generated a large number of temporary employees, who are being cyclically helped by the so-called "stabilization norms" (norms which themselves have been under scrutiny for their legal validity). Through a detailed analysis of article 36 of legislative decree n.165 of 2001, and bearing in mind the norms that regulate the working relationship within the private sector, it is possible to pinpoint all the critical aspects of the legislative apparatus, thus verifying the separation between disciplines which allow the application of flexible employment contracts by private employers and public ones. This analysis also shows that the "unilateral and authoritative model", which regulated the working relationship within public administration before its privatisation, is still very much applied in that context. Starting from the first revision of the first two paragraphs of the already mentioned article 36, included in legislative decree n.29 of 1993, we can determine the field of application of legal relationships deriving from the stipulation of flexible employment contracts here listed. All the discrepancies between the discipline that regulates the working relationship with a private employer and the one with a privatised public administration are easily highlighted. By comparing the contents of the norms which regulate every single type of flexible contract, included in article 36 of legislative decree n. 165/2001, and its perceptive value, it is possible to verify the specification that characterizes the working relationship within public administrations and how flexible contracts are there applied. The cross-reference - included in the second paragraph of article 36 of legislative decree n. 165/2001 - to the content of the National collective labour agreements, which regulate temporary contracts, "paid apprenticeships" (contratti di formazione e lavoro), other vocational training and supply contracts (altri rapporti formativi e somministrazione del lavoro), ancillary casual labour (lavoro accessorio) and socially useful workers (lavoratori socialmente utili), highlights the possibility for the "collective autonomy" to regulate and integrate single contractual schemes thus realizing the scheme of the pactional contract model and at the same time emphasizing its limit in indicating only the categories of employees to whom that can be applied. A small part of this analysis is dedicated to part-time jobs and managerial assignments for personnel employed through standard contracts which, although falling under the category of permanent jobs, are nevertheless an expression of a certain labour flexibility within public administration on the basis of improved performance and administrative organization. The analysis of article 36, paragraph 5 of the legislative degree n. 165/2001 develops the topic of violation of imperative provisions: rarely applied in the past, a new revision has been re introduced with law n. 102/2009 and now strongly reasserts the application of disciplinary measures against non compliant managers in order to recover funds used to hire employees through illegal types of flexible contracts. Further considerations come from the mandatory requirement, for all public administrations, to present every year to their relevant evaluation board and to the Presidenza del Consiglio dei Ministri an informative report on all the types of flexible employment contracts applied in relation to the number of personnel and the relevant expenditure per type. This informative report has a double purpose: on one side it allows the board to easily locate the manager responsible for misusing non-standard contract types, by checking the managerial decisions taken; on the other side - and on a more general level - it offers the opportunity to adopt measures aimed at improving the legislative and organizational management of human resources and finances. As if to say, it is essential to effectively promote a culture that encourages a good management of the res publica. This trend represents, in our opinion, the best strategy to fulfill the principles of transparency and impartiality peculiar to public administrations. These principles will help avoiding that the implementation of non-standard employment contracts either degenerates into new forms of temporary employment or creates a new, elusive method to access professional jobs within public administrations thanks to the proven resort to the so-called "stabilization norms" and public competitive examinations for permanent positions. In light of the recent regulatory and jurisprudential interventions, we will separately analyze the case of flexible employment contracts applied by the Ministry of Education both for teachers and administrative personnel (called ATA). Starting from law n.124/1999 and D.P.R. n.430/2000, this section highlights the relationship between school employees and the applicability of the EU directive concerning temporary contracts. In the conclusions, we will describe the main characteristics of the neo-authoritative contract model, now used in public administrations. Further final reflections consider the effects that the imminent reform of the labour market, currently being discussed in Parliament, will produce also in the privatised public sector and especially what innovations will introduce in the flexible contractual typologies, in the attempt to provide a solution about whether or not the public administration should or could once again use a contractual scheme different from the one implemented in the private sector.
Il lavoro è volto a mettere in luce le problematiche connesse all'attività delle imprese multinazionali e alla sussistenza in capo alle stesse di una responsabilità sociale internazionale (RSI). Nell'attuale panorama economico e politico mondiale, caratterizzato dalla globalizzazione e dalla stretta interdipendenza dei mercati, dalla sempre più frequente internazionalizzazione dei processi produttivi e aziendali e dalla contestuale operatività delle società in più Paesi, dalla accresciuta consapevolezza del consumatore circa il rispetto, nei processi produttivi, di istanze ritenuti fondamentali dalla società civile, come i diritti fondamentali dell'uomo e dei lavoratori o la protezione dell'ambiente, l'impresa multinazionale assume un ruolo fondamentale sia nell'indirizzare i trends economici globali (si pensi al fatto che alcune società hanno profitti superiori al PIL di buona parte degli Stati della comunità internazionale); la configurazione di una responsabilità sociale in capo a tali società vuol dire mescolare la libertà di impresa e il libero mercato con l'etica. La necessità di inserire la questione dell'etica negli affari nasce, dunque, dalla convinzione - sempre più diffusa in ambito internazionale e nazionale - che l'attenzione dell'impresa verso le istanze sociali, ambientali ed etiche delle comunità umane costituisca una condizione imprescindibile per uno sviluppo durevole e sostenibile. In tale prospettiva, dunque, il concetto di responsabilità sociale d'impresa richiama le imprese a considerare attentamente - nella definizione della propria strategia, nell'articolazione delle politiche e nelle procedure gestionali quotidiane - gli interessi diffusi della collettività, nonché l'impatto delle proprie attività, non solo in termini economici, ma anche sociali, ambientali ed etici. La responsabilità sociale rappresenta, quindi, per l'impresa uno strumento utile ed efficace per rispondere alle istanze e alle esigenze della società civile. Con la RSI nasce quindi una teoria di impresa che vede la produzione di beni non solo come strumento di profitto ma anche come occasione di realizzazione del benessere sociale; lo stesso operato dell'impresa inizia ad essere valutato globalmente non solo in rapporto ai risultati economici della stessa ma anche in base alla qualità del prodotto, alla qualità dell'ambiente lavorativo e alle istanze ambientali, seconda i dettami di quella scuola di pensiero del cd. business ethics per cui le imprese sono chiamate a compiere azioni che contribuiscano ad eliminare e prevenire le iniquità sociali e a promuovere lo sviluppo della collettività. Tale necessità è stata anche consequenziale a comportamenti ed abusi messi in atto dalle società transnazionali che hanno arrecato gravi danni alle comunità umane degli Stati ospiti delle attività produttive. Gli abusi commessi dalle imprese, non sempre riconducibili a precise violazioni degli ordinamenti nazionali, sono stati progressivamente interpretati e costruiti come violazioni o mancanze nei confronti di un complesso di principi definiti come appartenenti ad una ampia sfera di responsabilità sociale internazionale dell'impresa, che implica la perdita di reputazione e, quindi, la possibile riduzione delle sue quote sul mercato qualora gli stakeholders più interessati riescano a mobilitare l'opinione pubblica su larga scala. Fin dagli anni '70, diverse organizzazioni internazionali hanno iniziato ad occuparsi della regolamentazione dell'attività delle imprese transnazionali, evidenziando il ruolo che le imprese multinazionali sono chiamate a rivestire nei processi di tutela dei diritti umani e dell'ambiente che emergono nello svolgimento delle loro attività economiche; appare evidente come sia basilare, nel piano dell'opera, definire l'impresa multinazionale, analizzando i diversi strumenti adottati dalle organizzazioni internazionali e i contributi dottrinali in materia, alla luce dei quali sembra potersi dire che il carattere di "multinazionalità" o "transnazionalità" è dato dalla presenza di diverse unità operative, dislocate in più Paesi, che si trovano sotto il controllo (azionario o di gestione) di un'unica società holding; tale distinzione tra unità operative si estende fino al profilo giuridico, in quanto le singole consociate sono autonomi soggetti di diritto sottoposti, relativamente ai profili della regolamentazione e della costituzione, all'ordinamento giuridico dello Stato di nazionalità. Ciò spesso comporta che le società scelgano come sede un Paese sulla base della convenienza che ciascuno di essi offre in relazione al trattamento fiscale, al costo della manodopera e delle materie prime, alla regolamentazione in materia di protezione dell'ambiente. Sembra quindi necessario un tentativo di regolamentazione da parte di organismi sovranazionali, a fronte del numero sempre maggiore di imprese operanti in più mercati (più di 80.000 società con circa 900.000 società sussidiarie), al loro peso economico e occupazionale (si stimano circa 80.000.000 di posti di lavoro) e a seguito di numerosi episodi che hanno coinvolto tali imprese dagli anni '70 ad oggi, come nei casi della Drummond o della Del Monte, accusate di gravi repressioni dei diritti sindacali e sociali dei lavoratori, o della Chevron/Texaco e della Union Carbride, responsabili di disastri ambientali tra cui quello di Bophal, in India, fino al caso, recentissimo, del disastro ambientale causato dalla piattaforma Deepwater Horizon al largo delle coste della Florida e della Louisiana tra il 2010 e il 2011, o i casi di violazioni dei diritti umani e commissione di crimini internazionali (arresti arbitrari, torture, violenze sessuali, trattamenti inumani e degradanti), commesse da società transnazionali operanti nel settore estrattivo e minerario in Africa e nel Sud Est Asiatico, commessi direttamente o a mezzo di milizie assoldate per la protezione degli impianti. L'attività delle Organizzazioni internazionali, a partire dagli anni '70, si è focalizzata sul tema; l'OCSE, l'Organizzazione internazionale del lavoro, la Camera di Commercio internazionale hanno adottato in quegli anni raccomandazioni e dichiarazioni rivolte agli Stati membri e alle imprese per l'adesione a certi principi e diritti già sanciti da altri strumenti convenzionali; le Nazioni Unite, prima attraverso l'attività della Commissione sulle imprese multinazionali e poi della Sottocommissione per la protezione e promozione dei diritti umani, si sono occupate della materia, giungendo alla elaborazione di un Codice di condotta per le imprese multinazionali (mai adottato) e di Norme sulla responsabilità delle imprese multinazionali e altre imprese in relazione ai diritti umani, che si affiancano alla partnership pubblico-privata del Global Compact. Ancora, anche altre organizzazioni internazionali, come l'Organizzazione mondiale della sanità, l'OMC, la Banca mondiale, l'International Standard Organisation, hanno adottato atti che invitano le imprese a svolgere la propria attività produttiva nel pieno rispetto dei diritti fondamentali della persona, delle comunità locali e dell'ambiente, e quindi prendendo in considerazione non solo interessi e diritti dei soci ma di tutti i soggetti a vario titolo coinvolti o toccati dall'attività aziendale. In ultimo, è il lavoro del Rappresentante Speciale del Segretario Generale ONU John Ruggie ad elaborare un quadro normativo (denominato Protect, Respect, Remedy) generale relativo al rapporto tra business e diritti umani. La caratteristica degli strumenti analizzati è la loro natura non vincolante, quindi meramente esortativa e ad applicazione volontaria. Tale situazione si ricollega sostanzialmente a due ragioni: la discussa soggettività internazionale delle imprese multinazionali e le opposte visioni dei Governi in materia (con evidenti difformità di vedute tra Paesi in via di sviluppo e Paesi industrializzati). Riguardo alla soggettività delle imprese multinazionali, ovvero lo status di essere titolari di diritti e obblighi nascenti dal diritto internazionale, la dottrina internazionalistica è fortemente divisa. Secondo un primo orientamento, le IMN non sarebbero soggetti di diritto internazionali in quanto sono solo destinatarie di norme, e quindi "oggetto" del diritto internazionale; sarebbero soggette solo alla giurisdizione dello Stato, e vincolate dal diritto internazionale solamente in virtù del richiamo da parte dell'ordinamento giuridico interno. Dagli anni '60, inizia a farsi largo un diverso filone dottrinale che, partendo dal noto parere della Corte internazionale di giustizia Reparations for Injuries, considera l'impresa quale soggetto di diritto internazionale, in virtù di una serie di diritti e obblighi che le vengono attribuiti dal diritto internazionale, soprattutto in materia di investimenti e di contratti internazionali (tra tutti, il diritto di adire un'istanza arbitrale o giurisdizionale a carattere arbitrale). Inoltre, la costante attenzione per l'attività delle IMN da parte delle Organizzazioni internazionali, potrebbe testimoniare la nascente opinio juris di conferire una, seppur limitata, soggettività internazionale alle imprese. Dall'analisi della prassi internazionale si sono tratte conclusioni provvisorie, in particolare che l'impresa, soprattutto nel settore del diritto economico e degli investimenti, possegga una personalità giuridica internazionale limitata e soprattutto derivata dalla volontà degli Stati, ma soprattutto funzionale, poiché contenuta nei limiti stabiliti dal trattato internazionale (BITs) o del contratto internazionale che stabilisce diritti e obblighi per la stessa. Negli ultimi anni anche l'Unione Europea ha iniziato a promuovere una adesione delle imprese ai valori fondamentali dei diritti dell'uomo, dei lavoratori e dello sviluppo sostenibile. A partire dal Libro Verde del 2001, l'UE ha elaborato progressivamente una strategia europea per la responsabilità sociale di impresa, qualificata come adozione spontanea di prassi volte a contribuire al miglioramento della società e alla qualità dell'ambiente. La strategia dell'UE si caratterizza per avere una dimensione sia interna all'impresa, stabilendo una serie di programmi d'azione e l'adozione di sistemi di gestione dei processi produttivi, sia esterna alla stessa, prevedendo il coinvolgimento di comunità locali, partner commerciali, clienti, fornitori, ONG, autorità statali. A tali fini, l'UE lanciò una serie di iniziative, quali i sistemi EMAS e ECOLABEL di certificazione ecologica e di audit ambientale, il Multistakeholders' forum, per formare un quadro giuridico regolamentare in materia di appalti pubblici e sostenibilità ambientale, di tutela del consumatore, di pubblicità ingannevole, nonché l'adozione di codici di condotta settoriali, ispirato ai principi della RSI. L'attività di regolamentazione della RSI ha ricevuto un contributo dalle stesse imprese multinazionali, nel senso di una autoregolamentazione delle proprie attività, attraverso dei codici di condotta autonomamente adottati dalla singola impresa in funzione delle proprie strategie e valori. Tali codici si distinguono nettamente dalle linee guida adottate dalle Organizzazioni internazionali perché in essi l'impresa si fa creatrice e destinataria di norme, create non perché la necessità provenga dal diritto, ma dall'interesse dell'impresa (che, in molti casi, si caratterizza per essere meramente reputazionale). Tali codici, di chiara natura volontaristica, garantiscono il rispetto degli standard di tutela e di promozione dei principi in esso contenuti, stabilendo il più delle volte un meccanismo di monitoraggio e controllo del rispetto delle norme in esso contenute, meccanismo che può essere a carattere interno (gestito quindi da un ufficio interno all'impresa) o a carattere esterno (gestito, il più delle volte, da una ONG o da un sindacato). Infine, la ricerca si conclude con l'analisi dei principali temi che riguardano la RSI negli ultimi anni, ovvero quelli relativi ai profili di responsabilità delle imprese per violazione dei diritti fondamentali e per danni ambientali (con particolare riguardo alla disciplina statunitense contenuta nell'Alien Torts Statute), con particolare riferimento agli obblighi internazionali che incombono sugli Stati attraverso la ricostruzione della prassi internazionale. Inoltre, ulteriore profilo di studio è quello che si concentra sulla possibile estensione della giurisdizione dei tribunali internazionali per crimini internazionali alle persone giuridiche, con particolare riguardo ai lavori preparatori della Conferenza di Roma che ha portato all'istituzione della Corte Penale Internazionale. In conclusione, oggetto della ricerca è stato la ricostruzione del concetto di RSI, il quale è un prodotto degli ordinamenti nazionali ed in particolare degli ordinamenti giuridici degli Stati industrializzati, identificando un framework giuridico che include strumenti normativi di varia natura e in svariati settori, come quelli che disciplinano le società commerciali; le normative nazionali di prevenzione e repressione della corruzione; le normative del settore finanziario ed in particolare quelle sulle borse valori; le discipline a tutela del lavoro, dell'ambiente e del consumatore. Negli Stati più avanzati dal punto di vista economico e istituzionale la RSI, dunque, non è codificata in uno specifico settore regolamentare ma rappresenta un sistema complesso di normative che regolano i diversi aspetti di quelle attività di impresa; nei PVS, invece, tali normative sono spesso frammentarie o addirittura assenti: questa situazione ha permesso alle IMN di avvantaggiarsi dei vuoti legislativi o delle regole stringenti presenti in questi Paesi. Appare evidente come la comunità internazionale abbia constatato la necessità di regolare l'attività delle imprese multinazionali, per la promozione e la protezione dei propri valori fondamentali e di uno sviluppo in un'ottica di sostenibilità ambientale, nell'intenzione di creare un quadro giuridico internazionale che permetta alle imprese di perseguire le proprie finalità aziendali senza perdere di vista le esigenze collettive (in particolare dei Paesi in cui operano). Per raggiungere tale obiettivo, appare inevitabile un'evoluzione del diritto internazionale vigente, i cui processi di formazione, gestiti sostanzialmente dai Governi, non possono non tenere conto dell'accresciuto ruolo e peso delle IMN e della società civile. ; In today's economic and political world characterized by globalization and interdependence of markets, by an increasingly internationalization of production processes and by business operations of the company conducted simultaneously in several countries, by an increased consumer awareness regarding compliance of production processes to values that are considered essential by civil society, as fundamental human rights and labour and environmental protection, MNEs have a fundamental role in addressing the global economic trends. In this perspective, then, the concept of corporate social responsibility attracts companies to consider carefully - in the definition of its strategy and in the articulation of policies and procedures daily management - the various interests of the community, as well as the impact of its activities, not only in economic terms but also in social, environmental and ethical issues. Social responsibility is, therefore, a useful tool for the enterprise and effective way to respond to the needs and demands of civil society.With the CSR arises, therefore, a theory of business that sees the production of goods not only as a means of profit, but also as an opportunity for the realization of social welfare, as dictated bythe school of thought of thebusiness ethics, which invite companies to take action in orderto eliminate and prevent social inequities and promote community development. This need was also consequential to the abusescommitted by transnational corporations that have caused serious damage to human communities of their host countries. Abuses committed by companies, not always related to specific violations of national laws, have been gradually interpreted and constructed as a violation or misconduct against a set of principles defined as belonging to a broad spectrum of social responsibility international, which implies loss of reputation and, therefore, the possible reduction of its share on the market where the key stakeholders concerned can mobilize public opinion on a large scale. Since the 70s, several international organizations have begun to deal with the regulation of transnational corporations, highlighting the role that multinational corporations are called to play in the process of protection of human rights and of the environment that emerge in the course of their economic activity. Is fundamental for the work plan, define the multinational enterprise, by analysing the various instruments adopted by international organizations and doctrinal contributions on the subject, the light of which it seems possible to say that the character of "multinationality" or "transnationality" is the presence of various operating units, located in different countries, which are under the control (equity or management) of a single holding company; the distinction between operational units extends to the legal point of view, as the individual subsidiaries are independent legal entities subject, relatively to the profiles of the regulation and constitution, subjected to the legal system of the State of nationality. It often means that companies choose the host country on the basis of convenience that this country provides in relation to the tax treatment, labour costs and raw materials, to the rules on environmental protection. It therefore seems necessary to attempt to regulate multinational enterprises by supranational bodies, in relation to the increasing number of companies operating in multiple markets (more than 80,000 companies with about 900,000 subsidiaries), to their economic and employment (an estimated 80 million job opportunities) and following several incidents involving such companies from the '70s to today, as in the case of Drummond or Del Monte, accused of severe repression of trade union rights and social rights of workers, or Chevron/ Texaco and Union Carbide, responsible for environmental disasters including that of Bhopal, India, to the case of the environmental disaster caused by the Deepwater Horizon rig off the coast of Florida and Louisiana between 2010 and 2011, or cases of human rights violations and commission of international crimes (arbitrary detention, torture, rape, inhumane and degrading treatment) by transnational corporations operating in the mining industry in Africa and South East Asia, made directly or through the militias hired to the protection of plants. The activities of international organizations, from the 70s, focused on the theme, the OECD, the International Labour Organization, the International Chamber of Commerce adopted in those years, recommendations and declarations addressed to the Member States and the companies for adherence to certain principles and rights already provided by other conventional instruments; also the United Nations, first through the work of the Committee on Multinational Enterprises and then through the subcommittee for the protection and promotion of human rights, have dealt with the matter, coming to the elaboration of a Code of Conduct for Multinational Enterprises (never adopted) and rules on the responsibilities of transnational corporations and other business enterprises with regard to human rights, alongside to the public-private partnership of the Global Compact. Still, other international organizations such as the World Health Organization, the WTO, the World Bank, the International Standards Organization (which as a private nature), have taken actions that invite businesses to carry out its production activities in full respect of fundamental human rights, of local communities needs and of the environment, and then taking into account not only the interests and rights of the shareholders but to all those involved in various ways affected the activity or business. Finally, it is the work of the Special Representative of the UN Secretary-General John Ruggie to develop a framework (called Protect, Respect, Remedy) concerning the relationship between business and human rights. The characteristic of the analysed tools is their non-binding nature, then merely hortatory and voluntary application. This situation is linked mainly to two reasons: the disputed international subjectivity of multinational enterprises and the opposing views of Governments on the subject (with obvious differences of views between developing countries and industrialized countries). Regard to the subjectivity of transnational corporations, or the status of being holders of rights and obligations arising from international law, international legal theory is strongly divided. According to one view, MNEs would not be subject to international law as they are only recipients of rules, and then the "object" of international law would be subject only to the jurisdiction of the state, and bound by international law only by virtue of the reference made by the domestic legal system. Since the '60s, a different doctrinal trend began to make his way starting from the known opinion Reparations for Injuries of the International Court of Justice, and then considering the company as a subject of international law, by virtue of a series of rights and duties which are assigned to it by international law, especially in the field of investment and international contracts (among them, the right to appeal an arbitration tribunal or judicial character arbitration). In addition, the constant attention to the activities of MNEs by international organizations, could witness the nascent opiniojuris to give ainternational subjectivity to businesses, albeit limited. An analysis of international practice have taken provisional findings, in particular that the company, especially in the field of economic law and investment, possesses an international limitedlegal personality and mainly derived from the will of the States, but above all functional, as contained in limits established by international treaty (BITs) or international agreement that establishes rights and obligations for the same. In recent years the European Union has begun to promote adhesion of the companies core values of human rights, labour standards and sustainable development. From the Green Paper of 2001, the EU has developed progressively a European strategy for corporate social responsibility, described as spontaneous adoption of practices to contribute to the improvement of society and the quality of the environment. The EU strategy is characterized by having an internal dimension to the company, establishing a series of action programs and the adoption of management systems, processes, and external to it, calling for the involvement of local communities, commercial partners, customers, suppliers, NGOs, state authorities. To this end, the EU launched a series of initiatives, such as EMAS and Ecolabel certification ecological and environmental audit, the multi-stakeholder forum, to form a legal framework to regulate public procurement and environmental sustainability, protection of consumer, misleading advertising, and the adoption of sectorial codes of conduct based on the principles of CSR. The regulatory activities of CSR has received a grant from the multinational enterprises themselves, in the sense of a self-regulation of their activities, through codes of conduct adopted by each company independently according to their own strategies and values. These codes can be clearly distinguished from the guidelines adopted by international organizations because in them the company is the creator and recipient of rules, created not because the need comes from the law, but by the company (which, in many cases, characterized by being merely reputational). These codes, clearly voluntary, ensure compliance with standards for the protection and promotion of the principles contained therein, setting most of the time a mechanism for monitoring and enforcement of the rules it contains, a mechanism that may be internal character (then managed by an office inside the company) or external character (managed, in most cases, an NGO, or a trade union). Finally, the research concludes with an analysis of the main issues concerning CSR in recent years, namely those related to the profiles of corporate responsibility for violation of fundamental rights and environmental damage (especially with regard to U.S. regulations contained in the Alien Tort Statute), with particular reference to international obligations on states through the reconstruction of the international practice. In addition, further study is to profile that focuses on the possible extension of the jurisdiction of international tribunals for crimes under international law to legal persons, with particular reference to the drafting history of the Rome Conference that led to the establishment of the International Criminal Court. In conclusion, the object of the research was the reconstruction of the concept of CSR, which is a product of national law and in particular the legal systems of the industrialized countries, identifying a legal framework that includes legal instruments of various types and in various sectors, such as those governing commercial companies, national regulations for the prevention and combating of corruption; regulations of the financial sector and in particular those on stock exchanges; disciplines to protect labour, the environment and the consumer. In the most advanced in terms of economic and institutional CSR, therefore, is not encoded in a specific sector regulation but it is a complex system of regulations governing various aspects of the business activities, in developing countries, however, these rules are often fragmentary or even absent: this situation has allowed MNCs to take advantage of loopholes in the law or stringent rules present in these countries. It is evident that the international community has identified the need to regulate the activities of multinational enterprises, for the promotion and protection of its fundamental values and development in a sustainable environment, with the intention to create an international legal framework that allows companies to pursue their own business purposes without losing sight of the collective needs (in particular in the countries in which they operate). To achieve this goal, it is inevitable evolution of international law, whose formation processes, managed largely by governments, cannot fail to take into account the increased role and weight of MNEs and civil society. ; Dottorato di ricerca in Persona, impresa e lavoro: dal diritto interno a quello internazionale (XXV ciclo)
L'oggetto di questa tesi è la peculiare comparsa del termine imperator in un numero esiguo, ma comunque significativo di documenti provenienti dal regno di Asturia e León e dalla Britannia del X secolo. Se già di per sé questa sorta di "incongruenza storica" cattura l'attenzione, il fatto che i due fenomeni imperiali siano praticamente contemporanei e si sviluppino in due contesti molto distanti nello spazio, senza un apparente collegamento, evidenzia l'opportunità di uno studio comparativo. Ad una più attenta analisi, non si può fare a meno di notare come, in entrambi gli ambiti, il secolo immediatamente precedente sia stato caratterizzato da un momento particolarmente favorevole per la cultura – el renacimiento asturiano e the alfredian renaissance – reso possibile dall'azione attiva di due monarchi, Alfonso III di Asturia e León (866-910) e Alfred di Wessex (871-899). Nelle corti di questi sovrani vennero redatte delle cronache (le Crónicas Asturianas e la Anglo-Saxon Chronicle) nelle quali si proponeva una chiave di lettura della storia tesa a ricercare una nuova identità per i rispettivi popoli e si sottolineava il ruolo centrale delle rispettive dinastie regnanti. L'obiettivo della tesi è pertanto duplice: da una parte si desidera comprendere in quale modo e in quale senso sia stato utilizzato il termine imperator nella documentazione presa in esame, dall'altra si prova a capire quale peso ebbero le nuove identità etniche, religiose e territoriali, elaborate nelle già citate cronache, all'interno di questi fenomeni imperiali. Per una miglior resa dell'argomentazione si è deciso di dividere la tesi in due blocchi, il primo dedicato alle cronache del IX secolo e il secondo ai documenti in cui compare il titolo imperiale, risalenti al secolo successivo. A sua volta ciascun blocco si divide quindi in due capitoli, all'interno dei quali le tematiche vengono declinate nel caso ispanico e in quello anglosassone. La tesi si apre con la presentazione dei criteri impiegati nella selezione del corpus di "documenti imperiali" (Cap. 1) – nome con cui si definiscono i diplomi al cui interno compare il titolo di imperator – che ammontano ad un totale 38, di cui 20 asturiano-leonesi (privati e pubblici) e 18 anglosassoni (esclusivamente pubblici). A seguire viene fornito il contesto storico (Cap. 2) e lo status quaestionis (Cap. 3). Nel primo capitolo del primo blocco (Cap. 4) vengono trattate le tre cronache prodotte nella corte asturiano-leonese alla fine del IX secolo: conosciute anche come Crónicas Asturianas, sono intitolate rispettivamente Crónica Albeldense, Crónica Profetica e Crónica de Alfonso III. Per rendere il quadro qui esposto il più completo possibile si inizia trattando il patrimonio librario a disposizione degli autori delle cronache. A seguire si delineano i profili delle tre opere, soffermandosi in particolar modo sulla loro paternità e datazione. Si forniscono quindi indicazioni sulla tradizione manoscritta di queste cronache per poi tracciare un percorso tra le fonti. In questa parte si chiariscono concetti come quello di identità (etnica, religiosa e geografica), e si assiste alla comparsa di temi storiografici come quelli della Reconquista e del neogoticismo. Questi elementi costituiscono il punto di partenza per un ragionamento teso a far emergere il background ideologico comune a tutte e tre cronache. Nel corrispettivo capitolo inglese (Cap. 5) si delinea un profilo della produzione letteraria, in particolare storiografica, che ha caratterizzato le ultime due decadi del IX secolo anglosassone. Si inizia inquadrando gli uomini che formarono parte della cosiddetta alfredian reinassance per poi analizzare il ruolo avuto, all'interno di questo momento di rinascita culturale, dalle traduzioni in Old English delle grandi opere storiografiche. Infine, si propone una rilettura dell'unica opera storiografica scritta ex novo – l'Anglo-Saxon Chronicle – dalla quale emerge come fil rouge il concetto di overlordship. Questo è il nome che gli studiosi moderni hanno dato all'autorità che alcuni re anglosassoni poterono esercitare al di sopra degli altri regni dell'isola: si trattava di una supremazia principalmente militare che portava un re, per periodi spesso brevi, ad imporre la propria sovranità – e talvolta dei tributi – a popolazioni diverse dalla propria. Questa idea di sovranità sovrapposta era già presente in Beda e viene recuperata dai cronisti anglosassoni che la ricollegano, in maniera evidente, alla dinastia dei re del Wessex, coniando per quei re che la detennero la parola bretwalda. A conclusione del primo blocco è presente un capitolo di confronto (Cap. 6) che permette di tirare le somme della prima metà della tesi. Si ribadiscono alcuni punti in comune tra i due casi di studio qui definiti "macrocongruenze": sia la Britannia che la Spania erano parte dell'impero romano, ma non di quello carolingio e subirono un'invasione durante l'Alto Medioevo (danesi/norvegesi la prima e islamici la seconda); in entrambi i casi la produzione di cultura scritta durante il IX secolo orbitava attorno alla figura del monarca; le cronache del periodo celebrano la dinastia regnante come elemento cardine della storia "nazionale" e così facendo ne legittimano l'autorità; fra le pagine di queste cronache vengono proposte nuove identità per entrambe le popolazioni. Tuttavia, al di là di queste evidenti somiglianze, si è notato come, all'interno della cronachistica, si sia arrivati a due modi particolari di rappresentare sé stessi, il proprio regno, il proprio popolo e il proprio contesto geografico. Sono queste differenze a suscitare un particolare interesse dal momento che, come è stato chiaro sin dalla sua fase embrionale, in nessun modo lo scopo di questa ricerca è l'omologazione: non si sta cercando di uniformare la storia inglese del IX e X secolo con quella spagnola dello stesso periodo, per quanto esse abbiano sicuramente dei punti in comune. Nel capitolo di confronto si riflette quindi sulle particolari soluzioni autorappresentative soluzioni a cui sono giunti i cronisti asturiani e anglosassoni riguardo a tre punti chiave: il recupero del passato, la concezione territoriale dell'ambiente geografico e la questione identitaria. Non si può infatti trascurare il differente peso che ebbero nei relativi ambiti il ricordo del regno visigoto e quello dell'Eptarchia anglosassone e dunque, rispettivamente, le opere di Isidoro di Siviglia e Beda il Venerabile. Sarebbe inoltre sbagliato non sottolineare le differenze tra le due nuove proposte identitarie: quella inglese su base spiccatamente etnica (Angelcynn) e quella ispanica su base principalmente religiosa (regnum Xristianorum). Non poteva infine mancare un paragrafo dedicato ai differenti rapporti tra i due ambiti studiati e il mondo carolingio contemporaneo. Nel secondo blocco vengono sviscerati i fenomeni imperiali. Il capitolo dedicato all'ambito ispanico (Cap. 7) si apre con una riflessione sulle varie figure di scriptores del regno di León e sul peso avuto dai formulari visigoti nella documentazione altomedievale. Al principio del corrispettivo capitolo inglese (Cap. 8) vengono invece presentati due casi di utilizzo del termine imperiale precedenti il X secolo: quello di sant'Oswald di Northumbria (634-642) nella Vita Sancti Columbae di Adomnano di Iona e quello di Coenwulf di Mercia (796-821) nel documento S153. Seguono due paragrafi dedicati alla documentazione di Edward the Elder (899-924) e Æthelstan (924-939) che mettono in luce un sostanziale sviluppo della titolatura regia, indice di un progressivo ampliamento dell'autorità di questi monarchi. Il centro di entrambi i capitoli del secondo blocco consiste nella dettagliata analisi dei documenti imperiali e nelle riflessioni che da questa scaturiscono. Nel caso spagnolo è possibile affermare con una certa sicurezza che l'uso del titolo imperator ebbe inizio con il figlio, Ordoño II, che lo attribuì al padre per rafforzare la propria posizione di re di León. Tra la morte di Ordoño II (924) e l'ascesa al trono di Ramiro II (931) il titolo cominciò ad essere adoperato anche nella documentazione privata, senza per questo scomparire da quella regia. Non è purtroppo possibile cercare di ricondurre il fenomeno imperiale ispanico alla figura di uno scriptor in particolare – a differenza del caso inglese –; va però fatto presente che alcuni testi risalenti alla seconda metà del secolo differiscono dai documenti di Ordoño II nell'impiego del termine, poiché questo viene usato in riferimento al re vivente, anziché al padre defunto. Il titolo, almeno all'inizio del X secolo, non sembra riflettere un'autorità superiore (per l'appunto imperiale), ma richiama la sua più antica accezione, quella di "generale vittorioso" e costituisce una prerogativa dei sovrani leonesi. Per quanto riguarda il fenomeno imperiale inglese, invece, è possibile individuare un punto di inizio nei famosi alliterative charters, probabilmente redatti da Koenwald di Worcester (928/9- 957), sulla cui paternità si discute lungamente nella tesi. Sembra chiaro che imperator altro non sia che la traduzione latina di quello che gli storici hanno definito overlord. Tramite l'impiego di tale titolo i sovrani anglosassoni hanno voluto rappresentare la loro crescente egemonia sugli altri regni dell'isola, rivendicando così un'autorità più territoriale che etnica. Occorre però far presente che l'uso della terminologia imperiale forma parte di quel più ampio processo di evoluzione della titolatura regia già iniziato con Edward the Elder. Queste riflessioni vengono poi messe in relazione con quelle del primo blocco e sviluppate nelle conclusioni (Cap. 9). Esse vertono su quattro punti fondamentali: l'uso del documento e della lingua latina nei due ambiti; la Britannia e la Spania come universi a sé; il significato di imperator nei due contesti documentari; la concezione territoriale come presupposto teorico e geografico di questo utilizzo. La lettura delle fonti ci permette di affermare che entrambi i contesti rappresentavano per i rispettivi sovrani degli universi idealmente a sé stanti. I sovrani leonesi e anglosassoni ereditarono dai loro predecessori non solo una "missione" politica – di riconquista per i primi e di controllo per i secondi –, ma anche una specifica concezione – diversa per ciascun caso – dell'ambiente geografico in cui si trovavano a operare. La Britannia del re-imperatore anglosassone è la Britannia di Beda, frammentata e divisa, eppure tutto sommato unita. La Spania dei re leonesi è la Spania di Isidoro, unita, omogenea, ma drammaticamente perduta. Tuttavia, per il caso spagnolo e nel periodo qui preso in esame, al titolo non venne mai accostato un riferimento spaziale che rimandasse ad un dominio su tutta la penisola. In quello inglese, invece, tale accostamento ci fu, ma il riferimento geografico alla Britannia non fu un'esclusiva del titolo imperiale. Possiamo quindi dire che, nel caso inglese, il titolo nacque per il bisogno di tradurre in latino un'autorità indiretta ed egemonica (come quella di un rex regum), e perse poi questo significato – e quindi l'uso –, quando la situazione politica del regno si modificò; nel caso spagnolo invece, avvenne un'elaborazione quasi simmetricamente opposta. Il titolo, inizialmente usato nel suo significato più antico di "generale vittorioso" o "signore potente", venne poi reinterpretato quando nell'XI e XII secolo cambiarono gli equilibri politici della penisola. In questo periodo troviamo infatti sovrani come Alfonso VI e Alfonso VII impiegare titolature quali imperator totius Hispaniae. In entrambi i casi, l'imperator venne inteso come sinonimo di rex regum, ma in due momenti diversi: ovvero quando ve ne fu effettivamente bisogno. La tesi è provvista di mappe e della bibliografia, divisa tra fonti e studi. Inoltre si è considerato utile aggiungere in appendice i testi dei documenti imperiali. ; The subject of this thesis is the peculiar presence of the term imperator in a small, but still significant, number of 10th century documents from the reign of Asturia and León and from Britain. The fact that these two "imperial phenomena" coexisted and developed in two very distant contexts, without an apparent connection, makes a comparative study necessary. Also, in both areas the previous century was characterized by a particularly favorable moment for culture - el renacimiento asturiano and the alfredian renaissance - made possible by the action of two monarchs, Alfonso III of Asturia and León (866-910) and Alfred of Wessex (871-899). In these sovereigns' courts, chronicles were drawn up (the Crónicas Asturianas and the Anglo-Saxon Chronicle), proposing an interpretation of history which tend to seek a new identity for the respective peoples, highlighting the central role of the respective ruling dynasties. The aim of the thesis is therefore twofold: on the one hand, to understand in what way and in what sense the term imperator was used in the documentation examined; on the other hand, to estimate what weight the new ethnic, religious and territorial identities had within these imperial phenomena. For a better performance of the argument, it was decided to divide the thesis into two parts, the first dedicated to the chronicles of the 9th century and the second to the documents of the following century in which the imperial title appears. In turn, each part is divided into two chapters focused on Hispanic and Anglo-Saxon cases. The thesis opens with the presentation of the criteria used in the selection of the corpus (Ch. 1), which amounts to a total of 38 imperial documents, of which 20 Asturian-Leonese (private and public) and 18 Anglo-Saxon (exclusively public). The historical context (Ch. 2) and the status quaestionis (Ch. 3) are provided below. The first chapter of the first part (Ch. 4) deals with the three chronicles produced in the Asturian-Leonese court at the end of the 9th century. Also known as Crónicas Asturianas. they are respectively entitled Crónica Albeldense, Crónica Profetica and Crónica de Alfonso III. This chapter starts treating the Asturian library, available to the authors of the chronicles, and follows with the description of each chronicle, focusing on their paternity and dating. It then provides information about the manuscript tradition of each chronicle and it finally ends with an overall reading of the sources. Here, concepts such as identity (ethnic, religious and geographic) are clarified, and we observe the origin of historiographic themes such as those of the Reconquista and neo-Gothicism. These elements constitute the starting point for a reflection aimed at bringing out the ideological background common to all three chronicles. In the corresponding English chapter (Ch. 5) is outlined a profile of the literary production, in particular historiographic, which characterized the last two decades of the 9th century in England. We start by framing the men who formed part in the so-called alfredian reinassance and then analyze the role played in this moment of cultural rebirth by the translations in Old English of the great historiographic works. Finally, we propose a rereading of the only historiographic work written ex novo, the Anglo-Saxon Chronicle, where the concept of overlordship emerges as a common thread. Overlordship is the name that modern scholars have given to the authority that some Anglo-Saxon kings were able to exercise over other kings in the island. It is a predominantly military supremacy which leads a king, for often short periods, to impose his sovereignty - and sometimes tributes - on populations other than his own. This idea of overlapped sovereignty was already present in Beda and is recovered by the Anglo-Saxon chroniclers who relate it, explicity, to the dynasty of the kings of Wessex, coining for those kings who held it the term bretwalda. At the end of the first part there is a comparison chapter (Ch. 6) that draws the conclusions of the first half of the thesis. Some points in common (here called "macrocongruenze") between the two case studies are reiterated: both Britain and Spania formed part of the Roman Empire, but not of the Carolingian Empire and both suffered an invasion during the Early Middle Ages (Danes / Norwegians and Muslims); in both cases the production of written culture, during the 9th century, orbited around the figure of the monarch; the chronicles celebrate the reigning dynasty as the centre of "national" history to legitimize its authority; among the pages of these chronicles new identities are proposed for both populations. However, beyond these obvious similarities, it has been noted that the chronicles adopted two different ways of self-representing themselves, their kingdom, their people and their geographical context. The comparison chapter therefore reflects on three key points: the recovery of the past, the territorial conception of the geographical environment and the identity issue. In fact, we cannot neglect the different importance that the memory of the Visigoth kingdom and of the Anglo-Saxon Heptarchy (and therefore, respectively, the works of Isidore of Seville and the Venerable Bede) had. It would also be wrong not to underline the differences between the two new identity proposals: the English one had a distinctly ethnic base (Angelcynn), while the Hispanic base was mainly religious base (regnum Xristianorum). The last paragraph if finally dedicated to the different relationships between the two areas studied and the contemporary Carolingian world could not be missing. In the second block imperial phenomena are examined. The chapter dedicated to the Hispanic context (Ch. 7) opens with a reflection on the various figures of scriptores of the kingdom of León and on the weight of Visigoth formulae in the early medieval documentation. At the beginning of the corresponding English chapter (Ch. 8) are presented two cases of a use of the imperial term preceding the 10th century: that of Saint Oswald of Northumbria (634-642) in the Adomnan of Hy's Vita Sancti Columbae of and that of Coenwulf of Mercia in the charter S153. These cases are followed by two paragraphs dedicated to Edward the Elder's and Æthelstan's documentation, which highlight a substantial development of the royal title, pointing out an expansion of the authority of these monarchs. The center of both the chapters of the second block consists in the detailed analysis of the imperial documents and in the reflections that arise from it. In the Spanish case, it is possible to affirm with some certainty that the use of the imperator title began with his son, Ordoño II, who attributed it to his father to strengthen his position as king of León. Between the death of Ordoño II (924) and the ascent to the throne of Ramiro II (931), the title also began to be employed into private documentation, without disappearing in the public one. Unfortunately, it is not possible, as it is in the English case, to trace the Hispanic imperial phenomenon back to a particular scriptor. However, it should be noted that some texts dating from the second half of the century differ from the charters of Ordoño II in the use of the term, adopting it in reference to the living king, rather than the deceased father. The title, at least at the beginning of the tenth century, does not seem to reflect a superior (or imperial) authority, but recalls its most ancient meaning, of "victorious general" and constitutes a prerogative of the Leonese sovereigns. As for the English imperial phenomenon, however, it is possible to identify a starting point in the famous alliterative charters, probably drawn up by Koenwald of Worcester (928/9- 957), whose authorship is largely discussed in the thesis. It seems clear that imperator is nothing but the Latin translation of what historians have called overlord. Through the use of this title, the Anglo-Saxon rulers wanted to represent their growing hegemony over the other kingdoms of the island, thus claiming a more territorial than ethnic authority. However, it should be noted that the use of imperial terminology forms part of the broader process of evolution of the royal title that started with Edward the Elder. These reflections are then related to those of the first part and developed in the conclusions (Ch. 9). They focus on four fundamental points: the use of the documentation and the Latin language in the two areas; Britain and Spania as self-contained universes; the meaning of imperator in the two documentary contexts; the territorial conception as a theoretical and geographical assumption of this use. Reading the sources allows us to affirm that both contexts represented universes ideally self-contained for their respective sovereigns. The Leonese and Anglo-Saxon rulers inherited from their predecessors not only a political "mission" - reconquering for the former and control for the latter -, but also a specific conception - different for each case - of the geographical environment in which they found themselves operate. The Britannia of the Anglo-Saxon king-emperor is Bede's Britannia, fragmented and divided, but spiritually united. The Spania of the Leonese kings is Isidoro's Spania, united, homogeneous, but dramatically lost. However, for the Spanish case in the period examined here, the imperial title was never related to a geographical reference; in the English one, the geographical reference to Britannia existed, but was not exclusive to the imperial title. We can therefore say that, in the English case, the title was born out of the need to translate into Latin an indirect and hegemonic authority (like that of a rex regum), and then lost this meaning - and therefore the use - when the political situation of the kingdom changed. In the Spanish case, conversely, an almost symmetrically opposite processing took place. The title, initially used in its oldest meaning as "victorious general" or "powerful lord", was reinterpreted in the 11th and 12th centuries, when the political balance of the peninsula changed. In this period, we find in fact rulers like Alfonso VI and Alfonso VII employing titles such as imperator totius Hispaniae. In both cases, the emperor was intended as a synonym for rex regum, but in two different moments - always when it was more needed. The thesis is equipped with maps and bibliography, divided between sources and studies. Furthermore, it was considered useful to add a final appendix with the texts of the imperial documents. ; El tema de esta tesis es la aparición peculiar del término imperator en un número pequeño, pero significativo, de documentos del siglo X procedentes de los reinos de Asturias y León y de Inglaterra. Si en sí mismo este tipo de "coincidencia histórica" capta la atención, el hecho de que los dos fenómenos imperiales sean prácticamente contemporáneos y se desarrollen en dos contextos muy distantes en el espacio, sin una conexión aparente, pone de manifiesto la necesidad de un estudio comparativo. Tras una ulterior búsqueda, no pasa desapercibido cómo, en ambas áreas, el siglo inmediatamente anterior se caracterizó por ser un momento particularmente favorable para la cultura – el renacimiento asturiano y the alfredian reinassence –, hecho posible por la acción de dos monarcas, Alfonso III de Asturias y León (866-910) y Alfred de Wessex (871-899). En los entornos de estos soberanos, se elaboraron crónicas (las Crónicas Asturianas y la Anglo-Saxon Chronicle) que proponían una lectura de la historia destinada a buscar una nueva identidad para los respectivos pueblos, subrayando el papel central de las respectivas dinastías gobernantes. El objetivo de la tesis es, por lo tanto, doble: por un lado, se quiere entender de qué manera y en qué sentido se utilizó el término imperator en la documentación examinada y, por otro lado, tratamos de comprender qué peso tenían las nuevas identidades étnicas, religiosas y territoriales, dentro de estos fenómenos imperiales. Para una mejor presentación de los argumentos, se decidió dividir la tesis en dos bloques: el primero dedicado a las crónicas del siglo IX y el segundo a los documentos del siglo siguiente en los que aparece el título imperial. A su vez, cada bloque se divide en dos capítulos donde se desarrollan las temáticas en los casos hispanos y anglosajones. La tesis comienza con la presentación de los criterios utilizados para la selección del corpus de "documentos imperiales" (Capítulo 1) – los diplomas donde aparece el título de imperator –, que asciende a un total de treinta y ocho, veinte de los cuales son asturianos-leoneses (privados y públicos) y dieciocho anglosajones (exclusivamente públicos). El contexto histórico (Capítulo 2) y el status quaestionis (Capítulo 3) se proporcionan a continuación. En el primer capítulo del primer bloque (Capítulo 4) se presentan las tres crónicas producidas en la corte asturiano-leonesa a finales del siglo IX. También conocidas como Crónicas Asturianas, estas son la Crónica Albeldense, la Crónica Profética y la Crónica de Alfonso III. Para conseguir una visión lo más completa posible, comenzamos viendo los libros que los autores de las crónicas tenían a su disposición. Estos elementos constituyen el punto de partida para un razonamiento destinado a resaltar el trasfondo ideológico común a las tres crónicas. En el capítulo sucesivo (Capítulo 5) se traza un perfil de la producción literaria, en particular historiográfica, que caracterizó las últimas dos décadas del siglo IX anglosajón. Se comienza enmarcando a los hombres que formaron parte del llamado alfredian reinassance y analizando sucesivamente el papel desempeñado por las traducciones en Old English de las grandes obras historiográficas en este momento de renacimiento cultural. Finalmente, proponemos una nueva lectura de la única obra historiográfica escrita desde cero, la Anglo-Saxon Chronicle, a partir de la cual el concepto de overlordship emerge como un hilo conductor. Este es el nombre que los eruditos modernos le han dado a la autoridad que algunos reyes anglosajones pudieron ejercer sobre los otros reyes de la isla. Es una supremacía predominantemente militar que lleva a un rey – a menudo por períodos cortos – a imponer su soberanía, y a veces tributos, a poblaciones distintas de la suya. Esta idea de soberanía superpuesta ya estaba presente en Beda y es recuperada por los cronistas anglosajones que la relacionan, evidentemente, con la dinastía de los reyes de Wessex, acuñando para aquellos reyes la palabra bretwalda. Al final del primer bloque hay un capítulo de comparación (Capítulo 6) que permite resumir las conclusiones de la primera mitad de la tesis. Se reiteran algunos puntos en común entre los dos estudios del caso: tanto Britannia como Spania formaron parte del Imperio Romano, pero no del Imperio Carolingio y sufrieron una invasión durante la Alta Edad Media (Daneses / Noruegos e islámicos); en ambos casos, la producción de cultura escrita durante el siglo IX orbitaba alrededor de la figura del monarca. Las crónicas resultantes de este período celebran la dinastía reinante como la piedra angular de la historia "nacional" y al hacerlo legitiman su autoridad; entre las páginas de estas crónicas se proponen nuevas identidades para ambas poblaciones. Sin embargo, más allá de estas similitudes obvias, se ha observado que dentro de las crónicas ha habido dos formas particulares de representación de sí mismos, de su reino, de su gente y de su contexto geográfico. Son estas diferencias las que despiertan un interés particular, ya que, como ha quedado claro desde el principio, no hay absolutamente ningún intento de homologar la historia inglesa de los siglos IX y X con la historia española del mismo período, aunque sin duda tienen puntos en común. Por lo tanto, el capítulo de comparación reflexiona sobre las particulares formas de auto-representación proporcionadas por los cronistas asturianos y anglosajones y se centra en tres puntos clave: la recuperación del pasado, la concepción territorial del entorno geográfico y la cuestión relativa a la identidad. De hecho, no podemos descuidar el peso diferente que tuvo el recuerdo del reino visigodo y el de la Heptarquía anglosajona y, por lo tanto, respectivamente, las obras de Isidoro de Sevilla y de Beda la Venerable. También sería un error no subrayar las diferencias entre las dos nuevas propuestas de identidad: la inglesa, con una base claramente étnica (Angelcynn) y la hispana, con una base principalmente religiosa (regnum Xristianorum). Finalmente, no podía faltar un párrafo dedicado a las diferentes relaciones entre las dos áreas estudiadas y el mundo carolingio contemporáneo. En el segundo bloque se examinan los fenómenos imperiales. El capítulo dedicado al contexto hispano (Capítulo 7) comienza con una reflexión sobre las diversas figuras de los scriptores del reino de León y sobre el peso de las fórmulas visigodas en la documentación altomedieval. Al comienzo del capítulo correspondiente en inglés (Capítulo 8) se presentan dos casos de uso del término imperial anterior al siglo X: el de San Oswald de Northumbria (634-642) en la Vita Sancti Columbae de Adomnano de Iona y el de Coenwulf de Mercia (796-821) en el documento S153. Siguen dos párrafos dedicados a la documentación de Edward the Elder (899-924) y Æthelstan (924-939), donde se destaca un desarrollo sustancial del título real que indica una expansión de la autoridad insular de estos monarcas. El centro de ambos capítulos del segundo bloque consiste en el análisis detallado de los documentos imperiales y en las reflexiones que surgen de esto. En el caso español se puede concluir que, aunque hay rastros de un empleo del título imperial en la documentación de Alfonso III, es posible afirmar con cierta certeza que el uso del título imperator comenzó con su hijo, Ordoño II (914-924), quien lo atribuyó a su padre para fortalecer su posición como rey de León. Entre la muerte de Ordoño II (924) y el ascenso al trono de Ramiro II (931), el título también pasó a la documentación privada, sin desaparecer de la pública. Desafortunadamente, no es posible, como en el caso inglés, tratar de rastrear el fenómeno imperial hispano hasta la figura de un escritor en particular. Sin embargo, debe tenerse en cuenta que algunos textos que datan de la segunda mitad del siglo difieren de los documentos de Ordoño II en el uso del término, ya que se emplea en referencia al rey vivo y no al padre fallecido. El título, al menos a principios del siglo X, no parece reflejar una autoridad superior (precisamente imperial), pero recuerda su significado más antiguo, el de "general victorioso" y constituye una prerrogativa de los soberanos leoneses. En cuanto al fenómeno imperial inglés, por otro lado, es posible identificar un punto de partida en los famosos alliterative charters, probablemente producidos por Koenwald de Worcester (928/9- 957), cuya autoría se discute extensamente en la tesis. Parece que imperator no es más que la traducción latina de lo que los historiadores han llamado overlord. Mediante el uso de este título, los gobernantes anglosajones querían representar su creciente hegemonía sobre los otros reinos de la isla, reclamando así una autoridad más territorial que étnica. Sin embargo, debe tenerse en cuenta que el uso de la terminología imperial forma parte de ese proceso más amplio de evolución del título real que ya comenzó con Edward the Elder. En las conclusiones (Capítulo 9) se relacionan estas reflexiones con las del primer bloque desarrollándolas. Se centran en cuatro puntos fundamentales: el papel del documento y del idioma latino en las dos áreas; Britannia y Spania como universos en sí mismos; el significado de imperator en los dos contextos documentales y, por último, la concepción territorial como una premisa teórica y geográfica de este empleo de la terminología imperial. Tras leer las fuentes podemos afirmar que ambos contextos representaban, a los ojos de sus respectivos soberanos, universos dentro del universo. Los gobernantes leoneses y anglosajones heredaron de sus predecesores no solo una "misión" política – de reconquista para los primeros y de control para los segundos – sino también una concepción específica, diferente para cada caso, del entorno geográfico en el que se encontraban. La Britannia del rey-emperador anglosajón es la Britannia de Beda, fragmentada, dividida y, sin embargo, unida. La Spania de los reyes leoneses es la Spania de Isidoro, unida, homogénea, pero dramáticamente perdida. Sin embargo, para el caso español, en el período examinado aquí, nunca se encuentra el título imperial en relación a una referencia territorial que evoque un dominio sobre toda la península. En el inglés, sin embargo, existía este uso, pero la referencia geográfica a Britannia no era exclusiva del título imperial. Por lo tanto, podemos decir que, en el caso inglés, el título nació de la necesidad de traducir al latín una autoridad indirecta y hegemónica (como la de un rex regum), y luego perdió este significado – y su uso – cuando la situación política del reino cambió. En el caso español, sin embargo, tuvo lugar un procesamiento casi simétricamente opuesto. El título, utilizado inicialmente en su significado más antiguo como "general victorioso" o "señor poderoso", fue reinterpretado más tarde cuando el equilibrio político de la península cambió en los siglos XI y XII. En este período encontramos, de hecho, gobernantes como Alfonso VI y Alfonso VII que emplean títulos como imperator totius Hispaniae. En ambos casos, imperator fue concebido como sinónimo de rex regum, pero en dos momentos diferentes; cuando realmente se necesitaba. La tesis está provista de mapas y bibliografía, dividida entre fuentes y estudios. Además, se consideró útil agregar los textos de los documentos imperiales al apéndice.
Dottorato di ricerca in Storia d'Europa: società, politica, istituzioni (XIX - XX secolo) ; La ricerca realizzata ha inteso studiare, in un'ottica di lungo periodo e in una prospettiva complessiva, ciò che ha rappresentato l'esperienza del fascismo in un contesto territoriale periferico e non omogeneo, di cui è espressione quel segmento dell'Umbria meridionale costituito in provincia nel gennaio 1927. Tale area si è rivelata un case study esemplare, in grado di offrire interessanti spunti interpretativi. In effetti, all'unico grande polo industriale della provincia, compreso nel territorio della conca ternana, si contrappone la restante parte del territorio provinciale, comprendente città come Orvieto e Amelia, contrassegnate da consolidate relazioni con le regioni limitrofe, espressione di un'Umbria verde, agricola e mezzadrile, ma anche francescana, terra d'arte, di misticismo, ritenuta dalla pubblicistica di regime "cuore" dell'Italia fascista. A partire da ciò, si è creduto opportuno impostare la ricerca attorno a tre questioni principali, ritenute essenziali per cogliere aspetti e dinamiche della società locale nel ventennio mussoliniano. Per fare questo è stata definita una griglia interpretativa funzionale a verificare il ruolo del Pnf nel quadro del rapporto centro-periferia, continuità-rottura. Si è così puntato a esaminare come il fascismo abbia influito sui processi di formazione e consolidamento dei ceti dirigenti locali, verificandone la capacità di rapportarsi con le vecchie élites, di promuoverne di nuove o, magari, di fare coesistere entrambe. Si è poi cercato di approfondire il ruolo che il partito ha svolto in ambito locale, la sua capacità di inserirsi nelle diverse dinamiche territoriali, di creare e controllare reti clientelari e, soprattutto, di rapportarsi con le due realtà che rimangono fuori dal suo controllo, il grande gruppo polisettoriale rappresentato dalla "Terni" polisettoriale di Bocciardo e la Chiesa locale, il tutto al fine di conseguire i propri obiettivi totalitari. Infine, si è affrontata la questione del consenso. In questo senso, è stato preso in considerazione non soltanto il ruolo della violenza attuata dal fascismo per conquistare il potere e la stessa azione repressiva dispiegatasi negli anni del regime, che si dimostra concreta e reale come è normale in una situazione di dittatura, ma si è provato a fare luce sul dissenso e sulle aree di rassegnazione o di consenso tiepido che sembrano persistere nella società locale. Nel procedere si è poi cercato di coniugare la storia politicoistituzionale con quella sociale e in parte economica, attraverso un costante lavoro di analisi e incrocio delle fonti studiate, scelta ritenuta utile per conseguire gli obiettivi prefissati. Certamente, la riflessione sulle origini, l'affermazione, il consolidamento del fascismo in provincia di Terni, offre sostanziali conferme a quanto una parte della storiografia aveva proposto. Nell'Umbria meridionale il fascismo, nei suoi vertici, sorge e si afferma come punto d'incontro dei ceti dominanti tradizionali. Esso si afferma in quanto strumento della reazione agraria e dei gruppi industriali monopolistici di 2 fronte alla conflittualità contadina e operaia e al dilagare del socialismo. La sconfitta delle élites politiche tradizionali alle elezioni politiche del 1919 e a quelle amministrative del 1920, che seguiva l'effervescenza sociale del biennio rosso; la stipula del patto colonico del 1920 sfavorevole per gli agrari; la stessa esperienza, sebbene breve e contraddittoria, dell'occupazione delle fabbriche, sullo sfondo di una situazione economica difficile, ne determina la reazione, che si concretizza per l'appunto nell'adesione al fascismo. Dapprima nella versione squadrista, capace di sconfiggere sul piano militare gli oppositori, anche grazie al diffuso sostegno degli apparati di sicurezza dello Stato, quindi come blocco elettorale e nuova struttura politica in grado di conquistare il potere, il fascismo si configura come una sorta di union sacrée contro il "bolscevismo", in cui confluiscono conservatorismo agrario ma anche impulsi industrialisti e modernizzatori. Più concretamente, esso viene accorpando tutte quelle correnti politiche, contrapposte tra loro nel primo quindicennio del secolo, che avevano costituito il frastagliato universo giolittiano. In questo senso, come l'analisi dei vertici del Pnf provinciale e degli amministratori locali ha permesso di verificare, sino al 1927 a essere protagonisti sulla scena politica locale sono le forze che tradizionalmente facevano parte del blocco agrario. In primo luogo i proprietari terrieri, molti dei quali appartenenti alla nobiltà, a cui si affiancano esponenti della borghesia delle professioni, le cui proprietà erano cresciute a cavallo tra Ottocento e Novecento, nonché alcuni settori espressione diretta del mondo rurale, come gli agenti di campagna, i fattori, ma anche quei contadini che nei primi anni venti erano riusciti ad accedere alla proprietà della terra. In provincia di Terni quindi, dalla conquista fascista sino all'introduzione della riforma podestarile ma, in gran parte, anche dopo, la presenza ai vertici delle amministrazioni municipali e di quella provinciale di esponenti del notabilato locale, essenzialmente aristocratici, proprietari terrieri, professionisti, si rivela dato costante che permette di accomunare la provincia di Terni a realtà come la Toscana, l'Emilia-Romagna e, anche, a parte dell'Italia meridionale. L'attuazione della riforma podestarile, con le prerogative concesse al prefetto nella nomina dei vertici delle amministrazioni comunali, non sembra variare di molto la situazione, almeno nella prima fase di attuazione della riforma. Come è emerso nei comuni della provincia di Terni, il criterio seguito dai prefetti per l'individuazione dei podestà era connesso con la rilevanza sociale ed economica riconosciuta in una comunità ai candidati alla carica che, senza dubbio, un titolo nobiliare e una professione adeguata erano in grado di assicurare, anche magari a scapito della mancanza di qualche requisito previsto dalla legge istitutiva della riforma podestarile. In questo senso, sembra dunque perpetuarsi un modello burocratico e ottimatizio insieme, grazie al quale il fascismo intendeva presentarsi alle comunità locali con un volto rassicurante, al fine di accattivarsi il favore della popolazione. L'analisi prosopografica dei profili relativi a presidi, consultori provinciali, podestà, membri delle consulte municipali, per il periodo 1926-1943, ha reso possibile definire un quadro che vede sostanzialmente confermata l'analisi fatta in una prospettiva nazionale da Luca Baldissara ormai più di una decina di anni 3 fa1. E' cosi emerso il carattere di classe della rappresentanza politico-amministrativa fascista in questi anni, sebbene con alcune differenze effetto delle specificità socioeconomiche caratterizzanti l'area esaminata. Nello specifico, l'esame condotto sul corpus di 147 amministratori (78 podestà e 69 commissari prefettizi) che si succedono nei Comuni della provincia nell'arco di tempo considerato, ha permesso di tracciare l'identikit di un funzionario con un'età compresa tra i quaranta e i cinquanta anni; in possesso di un titolo di studio elevato (laurea o diploma di scuola superiore); in cui la proprietà della terra riveste un ruolo essenziale, coerentemente al tessuto socio-economico prevalente in provincia, e in cui dal punto di vista della professione esercitata appare predominante la figura del libero professionista (in genere avvocato e notaio). Forte è poi il legame dei podestà con il Pnf, più della metà del campione individuato risulta nel partito dal biennio 1920-1922; al tempo stesso, la maggioranza delle designazioni effettuate dai prefetti avviene in accordo con la federazione provinciale fascista. Sembra quindi delinearsi un quadro d'assieme che nel corso degli anni trenta, in gran parte della provincia, vede la predominanza delle gerarchie notabilari nella gestione del potere locale. Da tale situazione si discosta in parte l'area industriale compresa tra Terni e Narni, in cui come avviene in altri contesti urbani o regionali, attraverso il Pnf si assiste all'ascesa di personalità espressione della media e piccola borghesia urbana, per i quali l'istituto podestarile diventa uno strumento di promozione sociale e di affermazione nella gerarchia del potere locale. L'immagine del governo locale che si profila non è però statica, appare invece dinamica e contrassegnata da una forte conflittualità che, a vari livelli, si dimostra uno dei tratti comuni percepibili sotto l'apparente pacificazione realizzata dal fascismo. La forte instabilità presente nelle amministrazioni comunali della provincia di Terni, attestata dall'elevato numero di commissari prefettizi e di podestà retribuiti che si succedono, è testimonianza non solo delle difficoltà incontrate dai prefetti nella selezione di un ceto dirigente adeguato ma, soprattutto, del tentativo delle élites tradizionali, attraversate da interessi diversi e relazioni clientelari e familiari molteplici, di resistere all'azione omologatrice del regime. Indubbiamente, lo Stato fascista, attraverso la promozione di un modello di podestà fondato su competenza, capacità di agire, allineamento alle direttive dei vertici, in nome della proclamata modernizzazione puntava a ricondurre le periferie sotto il controllo del centro. Ecco allora che la ricerca di una concreta azione di governo delle amministrazioni locali, frequentemente sollecitata dal prefetto, da perseguire, ad esempio, attraverso la realizzazione di opere pubbliche funzionali alla mobilitazione di settori diversi della società, diventava il riferimento attraverso cui misurare l'efficienza e, soprattutto, "l'operosità" degli amministratori locali. L'elevato turnover dei podestà rappresenta pertanto una spia che si presta a misurare significativamente le difficoltà incontrate dal regime nell'affermare la propria azione in periferia. Non di rado tuttavia l'intervento del prefetto sui podestà si rendeva necessario per stroncare le lotte intestine e di fazione che si scatenavano all'interno delle élites locali per la gestione del potere. Le modalità attraverso cui tali scontri si manifestano sembrano esprimere dinamiche del conflitto omogenee a quanto accertato da altri studi 1 Luca Baldissara, Tecnica e politica nell'amministrazione. Esse assumono la forma di lettere, esposti, denunzie anonime, che divengono lo strumento di lotta principale tra le fazioni in una dimensione comunale ma, come è stato accertato in chiave provinciale, anche tra i rappresentanti dei diversi poteri locali, oltre che all'interno degli stessi vertici della federazione fascista ternana. A partire dal 1927, con la nascita della Provincia e l'insediamento di istituzioni politiche e amministrative nella città capoluogo, anche per il fascismo locale inizia una fase nuova, l'esame della quale ha permesso di meglio comprendere come in questa realtà si viene definendo il rapporto con il centro. La genesi della nuova entità territoriale è frutto di una serie di variabili legate, da un lato, alle esigenze politiche amministrative dello Stato fascista divenuto regime; a cui si sovrappongono le dinamiche conflittuali interne al fascismo regionale, che portano alla pacificazione dello stesso e alla nascita della federazione provinciale del Pnf. Infine, un ruolo determinante lo ha l'affermazione della "Terni" polisettoriale, vero e proprio potere forte nella nuova provincia, in grado di dare vita a un originale sistema di fabbrica a metà strada tra paternalismo assistenziale e truck-system. Con essa il regime dialoga direttamente, baypassando la neonata federazione provinciale del Pnf e, se necessario, intervenendo per normalizzarla, come dimostra esemplarmente la vicenda politica e personale di Elia Rossi Passavanti, primo federale e podestà di Terni. In questo senso, la ricostruzione dei percorsi personali e professionali dei vertici dell'amministrazione statale (prefetti e questori), degli organi politici (federali, vicefederali, segretari amministrativi, componenti del Direttorio della federazione fascista) ed economici (membri del consiglio provinciale dell'economia, di quello delle corporazioni e del principale istituto bancario del capoluogo), è stata preziosa per le riflessioni che permette di realizzare rispetto al ruolo avuto dal Pnf in provincia e, specialmente, alle dinamiche politiche che si innescano nei rapporti che il partito instaura con le altre autorità, a cominciare da quella prefettizia. Proprio con riferimento ai prefetti, si è potuto osservare che sui nove che si succedono in provincia di Terni nel periodo considerato, ben sei provengono dal Pnf. Tale fatto non sottende necessariamente un'automatica collaborazione con la federazione fascista, quanto piuttosto sembra rispondere all'esigenza del centro di superare i contrasti esistenti tra la federazione fascista e la prefettura che, invece, è situazione ricorrente in provincia. Nel contempo, il succedersi di dodici federali alla guida del partito è prova di una significativa instabilità, dato peraltro ulteriormente confermato dalla netta prevalenza di personalità estranee all'ambiente locale, ben nove. Questo fatto non esprime solo una certa debolezza del fascismo locale, incapace di fornire un ceto dirigente adeguato, ma dimostra la stessa evoluzione che subisce la figura del segretario federale, nei termini di una spiccata professionalizzazione inquadrabile nel più generale contesto di crescente burocratizzazione del Pnf funzionale a consolidarne il ruolo di mediazione e di intervento nell'amministrazione dello Stato, che si rivela uno dei tratti tipici del Pnf staraciano. In questo senso, le guerre che si scatenano tra prefetto e federale nel corso degli anni trenta, ad esempio per la questione delle nomine dei podestà, in cui ruolo determinante lo acquista ancora una volta l'arma dell'esposto e della lettera anonima, attestano il tentativo portato avanti dal partito di far sentire il proprio peso al fine se non di sovrapporsi, quanto meno di affiancare lo Stato in periferia. Affiora così quella di5 mensione policratica che si configura come uno degli elementi caratterizzanti la politica in periferia negli anni del regime. Nonostante i contrasti che si scatenano tra i poteri, le lotte intestine all'interno del Pnf, la cronica debolezza dimostrata dai ceti dirigenti, la federazione provinciale fascista nel corso degli anni trenta riesce comunque a essere vitale e in grado di esercitare il proprio ruolo ai fini della fascistizzazione della società locale. D'altra parte, ai vertici del partito se si escludono i federali e i loro più stretti collaboratori, le restanti cariche continuano a essere gestite in larga parte dal medesimo nucleo originario fascista, fatto di appartenenti al ceto agrario e alla borghesia delle professioni provenienti, per la maggior parte, dall'area ternana. Ciò attesta lo scarso ricambio generazionale esistente all'interno della federazione, ma anche il peso politico ed economico ricoperto dal capoluogo rispetto all'intera provincia. Questi dirigenti fanno parte dei diversi Direttori federali che si succedono e, talvolta, ricoprono contemporaneamente, laddove la legislazione lo consente, incarichi in organismi quali il Consiglio provinciale dell'economia o, anche, alla guida della principale banca locale. Ai vertici del partito il peso degli appartenenti a settori della piccola borghesia e del ceto operaio è invece minore. Soltanto con l'approssimarsi del secondo conflitto mondiale, si fanno strada figure espressione del ceto impiegatizio, ma anche tecnici e qualche sindacalista con alle spalle una carriera nell'apparato burocratico della federazione provinciale, i quali assumono incarichi di un certo peso, come quello di segretario amministrativo o di componente del Direttorio. In questo modo sembra prefigurarsi, sebbene in maniera timida e non paragonabile a quanto accade in altre province, l'affermazione «dal basso e dalle periferie [di] una nuova classe dirigente del regime totalitario»2. Nel corso degli anni trenta dunque, sebbene tra molteplici difficoltà di natura anche economica, il Pnf riesce a dare vita in provincia a una struttura organizzativa in grado di penetrare e inquadrare la società locale. Peraltro, l'afflusso costante di contributi concessi da enti pubblici diversi (amministrazioni provinciali, comunali, Consiglio provinciale dell'economia) e soggetti privati (la Società "Terni" in primo luogo, ma anche altre aziende) a un partito alla continua ricerca di risorse, che la documentazione amministrativa della federazione ternana ha permesso di verificare, rappresenta testimonianza esemplare degli sforzi profusi dal regime per rendere il Pnf un volano di sviluppo del peculiare welfare funzionale alla fascistizzazione della società locale. In questa prospettiva, il rapporto con la Società "Terni" si è rivelato una chiave di lettura che non è possibile trascurare se si vuole comprendere la natura dell'esperienza fascista in provincia di Terni. Si è visto che la stessa nascita della nuova Provincia è connessa alla questione del controllo delle acque del sistema Nera-Velino, presupposto essenziale per la creazione dell'impresa polisettoriale; così come la stipula della convenzione tra il Comune di Terni e la società guidata da Bocciardo, sanziona di fatto in maniera prepotente la forza non solo della grande azienda, ma l'affermazione dello stesso "centro" sulla "periferia". Da quel momento e anche dopo l'inserimento della "Terni" nel sistema delle partecipazioni statali attra- 2 Marco Palla, Il partito e le classi dirigenti, in Renato Camurri, Stefano Cavazza, Id. X, nuova serie, dicembre 2010, 3/10, p. 296. 6 verso l'Iri, operazione che garantì allo Stato il controllo pubblico sull'azienda e sul suo assetto produttivo, la grande impresa per il fascismo ma, più in generale, per la stessa società locale diventa emblematicamente una madre-matrigna. Essa viene percepita come un complesso capitalistico che invade la città e, con i suoi vertici, in grado di dialogare con il centro e, anche, direttamente con il duce, si pone rispetto al Pnf locale in una situazione super partes. Non è così casuale che i federali presentino come risultato della loro azione politica i buoni rapporti che riescono a intrattenere con i vertici aziendali, i quali peraltro si dimostrano costantemente impermeabili all'influenza della federazione fascista. D'altra parte, a partire dalla stipula della convenzione del 1927 e per tutto il decennio successivo la "Terni", insieme al partito, appare senza alcun dubbio uno dei pilastri del regime in provincia. Non soltanto sostiene la federazione provinciale con contributi costanti, essenziali per assicurargli la possibilità di svolgere la propria azione sul territorio; ma, più in generale, con tutto il suo peso di grande gruppo polisettoriale sposa in pieno le politiche economiche, sindacali, sociali del regime, garantendo allo stesso le condizioni per affermare «un sistema di aggregazione/costruzione del consenso/controllo sociale e politico che si adegua al modello del regime reazionario di massa»3. In queste dinamiche si inserisce anche, per quanto è stato possibile accertare in relazione alle fonti disponibili, l'atteggiamento tenuto dalla Chiesa cattolica locale nei riguardi del fascismo. L'analisi condotta con riferimento specifico alla diocesi di Terni-Narni e al vescovo Cesare Boccoleri che la guida nel Ventennio fascista, ha permesso di accertare che, come succede in altre diocesi italiane e coerentemente con le scelte fatte dai vertici vaticani, la Chiesa ternana sembra tenere una posizione di sostanziale appoggio al fascismo e di collaborazione con il Pnf. Ciò emerge in maniera evidente in alcuni momenti: ad esempio, in occasione delle campagne promosse dal regime sul terreno economico e sociale, come per la Battaglia del grano e, soprattutto, dopo la stipula del Concordato, o nel corso della guerra d'Etiopia e di Spagna. Al tempo stesso, anche quando si hanno tensioni nei rapporti tra Stato e Chiesa (per effetto della crisi del 1931 sulle prerogative dell'Azione cattolica o in occasione dell'introduzione delle leggi razziali), le conseguenze concrete per la Chiesa locale sono di scarso rilievo e, comunque, tali da non incidere sostanzialmente sulla natura dei rapporti esistenti con la federazione fascista. Anche la Chiesa locale quindi, sebbene con l'obiettivo di preservare e, per quanto possibile, incrementare la presenza cattolica nella società locale, contribuisce nella sostanza a consolidare e, anche, ampliare il consenso al regime. In particolare, essa si dimostra attiva nel favorire, specialmente nelle aree rurali, quell'azione di «modernizzazione politica» di natura reazionaria, conseguenza del tentativo di organizzazione della società italiana secondo criteri gerarchici e accentratori, che il fascismo è impegnato a portare avanti in periferia. Certamente, un ruolo essenziale ai fini della creazione e, soprattutto, del mantenimento del consenso lo esercita anche la costante opera di vigilanza e repressione di ogni forma di dissenso organizzato e di attività politica di opposizione, che si attua in provincia per opera degli apparati di sicurezza dello Stato fascista. Tale azione si rivela particolarmente efficace se negli anni del regime solo i comunisti, essenzial- 3 Renato Covino, L'invenzione di una regione, Quattroemme, Perugia 1995, p. 58. 7 mente nell'area industriale ternana, riescono a mantenere in vita, per quanto a fatica e in misura ridotta, una forma di opposizione organizzata. E tuttavia, il fatto che continuamente le autorità, sebbene nell'ambito del riconoscimento di quanto fatto dalle diverse organizzazioni del partito a favore del ceto operaio, lamentassero l'inadeguato grado di "comprensione fascista", quando non la scarsa fascistizzazione dei lavoratori delle industrie ternane e la loro "pericolosità" politica, sembra essere la conferma implicita di come in provincia, non solo non scompare l'insofferenza e il dissenso, anche politicamente organizzato, ma, più in generale, sotto la camicia nera, a prescindere dalla propaganda e dall'attività delle differenti istituzioni del regime, non vengono meno nemmeno gli interessi molteplici che contrassegnano la società locale e le diverse realtà presenti sul territorio. In ultima analisi, il fascismo locale appare in grado di esercitare un ruolo attivo nel disegno di fascistizzazione della società, coerentemente con l'accelerazione nel processo di creazione dello Stato totalitario di cui è strumento il Pnf staraciano. Il partito si rivela dunque un vero e proprio centro di potere, espressione di un regime autoritario e tendenzialmente totalitario, con cui, inevitabilmente, tutti i cittadini si trovano a confrontarsi per le necessità della vita quotidiana: in altre parole, a dover essere, almeno una volta nella vita, fascisti. ; This research project is an in-depth study, in a comprehensive and long-term perspective, of what Fascism represented at a local level in a peripheral and non-homogeneous context, as in the case of the Southern Umbria areas, established as an administrative province in 1927. This specific geographical district flagged-up all the prerequisites for an exemplary case study, featuring several significant explanatory points. To this unique large provincial administrative industrial hub located within the Terni basin, other districts, part of the same province, remained juxtaposed. Within their respective areas, these districts included towns such as Orvieto and Amelia, which had strong links with the neighbouring communities, representing the rural, agricultural and mezzadrile aspects of Umbria, land of Saint Francis of Assisi, rich in art and religious meanings, which the Fascist Regime came to proclaim officially as the "heart" of Fascist Italy. On the basis of these introductory remarks, the study focuses its scope of research on three main points, all but essential to understand fully the aspects and dynamics of the local society during the Fascist period, also referred to as the ventennio mussoliniano. An interpretative functional grid has been designed with a view to describe the role of the National Fascist Party (Nfp) within the centre-periphery and continuity-innovation relationships with the previous regime. The study seeks to investigate how Fascism exerted its influence on the establishment and process of strengthening of the local ruling ranks, attesting its ability to relate with the old dominant élites, or promote the emerging of new ones or, in addition, facilitate and support the coexistence of both. Furthermore, the research focuses on the role exerted by the Nfp at a local level, its capability to affect the various localised dynamics of power, to create and control networks of affiliates and, above all, to relate with the two main subjects which remained independent from its control, the important industrial group represented by "Terni" of Bocciardo and the local Catholic Church, with an overarching aim to achieve its totalitarian objectives. Finally, the question of popular consent has also been scrutinised. At one level, the study analyses the 2 role of fascist violence deployed to obtain power and the repressive actions carried out under the Regime, which were highly effective, as one might expect under a dictatorship. At another level, it investigates the popular dissent and the grey areas of passive acceptance and weak consent which were common among strata of the local population. Additionally, in a broader perspective, political and institutional historical analysis has been coupled with social and economic investigation, through a systematic scrutiny and cross-examination of the main sources, as a methodological approach needful to the achievement of the final outcomes of the research. Findings on the origins, development, and strengthening of Fascism within the Terni province appear to concur with the conclusions reached by previous historical research. In the Southern areas of Umbria, Fascism, at its highest level, was brought into power and successfully established by the traditional ruling classes. The establishment of Fascism was supported and facilitated by the agrarian reaction and the monopolistic industrial groups threatened by the discontent of the rural and working classes and the rapid advancement of Socialism. The political defeat of the traditional ruling élites at the 1919 general election and the 1920 local elections, which followed the social turmoil of the so-called red biennium; the agreement of the 1920 patto colonico, disadvantageous to landowners; the occupation of factories, though a brief and contradictory experience, against a background of economic difficulty, caused their reaction and prompted their acceptance and support for Fascism. Firstly, Fascism, in the form of Fascist action squads and their capability of defeating its opponents militarily, with the extensive assistance of the State security services, then as an electoral block and political force capable to achieve power, presented itself as a sort of union sacrée against the threat of Bolshevism into which various groups appear to converge: the agrarian conservatism but also industrial and more modern forces. Undoubtedly, Fascism drew together different political forces, which during the first decade of the twentieth-century had been mutually antagonistic, and segments of the complex and divided political establishment of the Giolitti era. The scrutiny of the highest levels of the local Nfp and civil servants has revealed that, at least till 1927, the main political figures belonged to those forces already part of the agrarian block. Firstly, the landowners, many of whom belonged to the local nobility, supported by members of the professional bourgeoisie, whose estates and wealth had augmented during the nineteenth- and twentieth-century, and other sectors which were the direct expression of the rural milieus, such as the rural agents, farmers, but also those peasants whom, during the first two decades of the twentieth-century, had succeeded in becoming landowners themselves. Therefore in the Terni province, from the establishment of the Fascist regime to the introduction of the office of podestà and, for some time even after, 3 the highest offices of the municipal and provincial administration were held by members of the local nobility, primarily aristocrats, landowners and professionals. This is an invariable characteristic which put the Terni province in alignment with similar situations in Tuscany, Emilia Romagna and other areas of Southern Italy. The administrative reform and the establishment of the podestà authority, together with the prerogatives of the prefectures in appointing members of the highest offices within the municipal administrations, did not radically change, at least during the early phases of the reform, established practice. A survey of the municipalities located within the Terni province, shows that the prefects in the selection process to appoint the podestà took greatly into account the candidates' social and economic status of and, without doubt, a honorific title and tenure of highly considered profession were often sufficient criteria for a candidate to be nominated even when lacking some of the prescribed requisites as outlined by the administrative reform. The Fascist regime therefore, in perpetuating a bureaucratic and grandees system, showed an intention to reassure the existing ruling élites and obtain the support of the local population. A prosopographical analysis of the biographical profiles of headmasters, members of the provincial advice bureaus, podestà, members of the municipal advisory councils, during the 1926-1943 period, has made it possible to outline a summary framework which strongly corroborates the analysis carried out at a national level by Luca Baldissarra over a decade ago.1 What has emerged from this analysis is the class-based character of the Fascist political and administrative representation during those years, though presenting various differences linked to the social and economic specificity of the area scrutinised. In more depth, the study carried out on a corpus of 147 civil servants (78 podestà and 69 prefectural officers) employed by the municipalities of the province during the examined period, made it possible to draw up a profile of the typical officer: between forty and fifty years of age; highly educated (having achieved a high-school or university degree); often a landowner, a characteristic consistent with the social and economic structure prevailing throughout the province, and among whom the status of self-employed (generally lawyer or public notary) represented the most frequent professional position held. Relations between the podestà and the Nfp appear to have been particularly close, over half of the sample identified is composed by individuals who had joined the Fascist Party at an early stage, during 1920-1922; additionally, the majority of the appointments made by the prefects were agreed in advance with the Provincial Fascist Federation. The industrial area comprised within the administrative territories of the two municipalities of Terni and Narni, however, appears to contrast with other districts of the province. In this area, as for similar cases in other municipalities or other regional administrations, the Nfp supported the emergence of members of the small and medium local urban bourgeoisie, as the office of podestà became a vehicle of social advancement and an opportunity to climb up the local hierarchy of power. Despite the apparent pacification established forcibly by the Fascist regime, the dynamics of power within the local government remained characterised by extreme unrest and strong conflict at various levels. The sizeable number of prefectural commissioners and remunerated podestà who succeeded in office, often in rapid succession, bears witness to the instability which marred almost all the municipal administrations of Terni province. This is evidence of the obstacles encountered by the prefects during the selection process of a qualified managerial class but, above all, of the resistance put up by the traditional élites of power, motivated by divergent interests and loyalty to various networks of familial and personal relations, to the process of homologation pursued by the Fascist regime. Undoubtedly, the Fascist regime, in implementing a model of podestà based on competence, on the energetic ability to act, on its alignment to official directives, and in order to achieve a modernisation of the administrative system, aimed at placing the local authorities under the prescriptive control of a centralised State. The actual administrative actions implemented by the local administrative offices, frequently under the guidance and pressure of the Prefects, as for example in the case of the accomplishment of public works functional to the civil mobilisation of various segments of the local community, became a measure of their efficiency and, above all, a measurement of how industrious the local administrators should be. The high turn-over of podestà is a clear indication of how difficult it was for the Fascist regime to implement its plans of action in peripheral areas. Additionally, direct intervention by the Prefects was often necessary to put an end to rivalries and internal power struggles which frequently broke out among local élites. These clashes and their manifestations appear to be similar in their dynamics, as pointed out by previous studies, to other cases occurred in different municipalities, provinces and regions. Resorting to anonymous letters, official complaints, accusations, came to represent the instrument to attack and weaken the opposite factions at a local level, within the municipalities, but also within the provincial administration, among the various representatives of the local administration and even the highest offices of the Terni Fascist Federation. From 1927, following the establishment of the 5 Province and the set up of political and administrative authorities in Terni, now seat of local government, a new phase emerged for the local Fascist Party too. The study of this new province has facilitated the understanding of its relations with central authorities. The establishment of this new local administration was the result of various circumstances linked to the political requirements of the Fascist State following the transition to a totalitarian regime. Additionally, the internal conflict dynamics of the regional Fascist Party played an important role. These led to the inner pacification of the Party and the set up of a Nfp Provincial Federation. Finally, the establishment of "Terni" had a pivotal role too. "Società Terni" (also referred to as "La Terni") came to represent the real "strong power" of the province, capable of imposing a factory regimen based partially on paternalistic assistance and partially on a truck-system model. The Fascist regime dealt directly with "Terni", bypassing the newly-established Nfp Provincial Federation and, where necessary, intervened to impose its authority, as the political and personal vicissitudes of Elia Rossi Passavanti, the first Federal secretary and podestà of Terni, exemplified. In this perspective, drawing together personal and professional career paths of the highest officers (prefects and police commissioners), of both political (federals, deputy federals, administrative secretaries, members of the Fascist Federation Federal Bureau) and economic authorities (members of the Provincial Economic Council, members of the Provincial Corporations Council and of the main bank) has represented an invaluable study, conducive to the understanding of the Nfp's role within the province and, in addition, of the political dynamics at play among the Fascist Party and other authorities, such as the prefectures. With specific reference to the prefects, it is worth noticing that of the nine prefects in office in the Terni province during the period under scrutiny, as many as six were Nfp members. This situation, however, did not necessarily imply a spontaneous collaboration between the prefectures and the Fascist Federation, but it would appear to have been a response to the need of overcoming the conflictual antinomy between the two authorities, which was a recurrent event throughout the Terni province. In addition, the succession of twelve Federals as leaders of the Fascist Party bears witness to a pervasive instability, a fact which is also confirmed by the noticeable preference given to individuals, as many as nine, unconnected with the local milieu. This is certainly a clear manifestation of the local Fascist Party's weakness - which appeared unable to express and produce capable managerial ranks - and of the evolution of the Federal Secretary's role, becoming more and more a professional one, in the context of the remarkable bureaucratisation of the Nfp, aimed at strengthening its mediatory and interventional role on the local administration, one of the main characteristics of the Nfp 6 under the leadership of Starace. Within this framework, the contrast between the prefects and the Fascist Federal secretaries during the 1930s, with regard, as a case in point, to the appointments of the podestà, and the crucial utilisation of official complaints and anonymous letters, bears witness to the Party's attempt to impose its decisions or, at least, to influence the administration at a local level. This, in turn, resulted in a situation of polycracy, which was one of the factors denoting local politics during the Fascist regime. During the 1930s, despite deep rooted conflict among the authorities, the internal power struggles within the Nfp and the endemic ineptitudes of the ruling class, the Fascist Provincial Federation was successful in exerting and promoting the fascistisation of the local community. It is manifest that the highest authorities within the National Fascist Party, with the exception of the Federals and their closest advisors, remained the domain of the original Fascist core, composed by members of the rural class and the bourgeoisie originating primarily from the Terni area. This explains the inadequate generational change within the Fascist Federation and, in addition, the political and economic importance of the Terni area in comparison to the entire province. These political figures were part of the various Federal Bureau and, in some cases at the same time, if the law permitted, held additional offices in different institutional bodies, such as the Economic Provincial Council or were in charge of the main local bank. On the contrary, the influence exerted on the high levels of the National Fascist Party by the small bourgeoisie or by members of the working class remained negligible. It was only with the approach of the Second World War that members of the clerical class, but also technicians and a few tradeunionists already employed within the bureaucratic structure of the Provincial Federation, acquired an enhanced importance and gained access to higher office, such as administrative secretaries or members of the Federal Bureau. The Terni area too, though in a more limited way, which bears not comparison with other provinces, saw the rising «from the bottom and the periphery of a new ruling class within the totalitarian regime»2. During the 1930s therefore, despite various difficulties, including economic issues, the Nfp was successful in creating at a provincial level an organisational structure capable of influencing and organising the local community. Additionally, the regular flow of financial contributions bestowed by various public authorities (provincial administrations, municipalities, Provincial Economic Council) and private companies ("La Terni", first of all, but other businesses too) to a political party constantly seeking financial backing, as thoroughly documented by records of the Terni Fascist Federation, bears witness to the outstanding efforts the Regime made to 2 Marco Palla, Il partito e le classi dirigenti, in Renato Camurri, Stefano Cavazza, Id. X, nuova serie, dicembre 2010, 3/10, p. 296. 7 successfully present the Nfp as a conducive mean to the development of this specific welfare model, with a view to promote the fascistisation of the local community. In this perspective, the Nfp's relation with the "Società Terni" is key to understanding the nature of the Fascist Regime and its role within the Terni province. The establishment of a Province was connected to the control of the water-system of the two rivers Nera-Velino, essential to create an industrial hub; similar reasons were behind the agreement stipulated between the Terni municipality and the Bocciardo Company, which came to sanction resolutely the importance of the Company and, additionally, the supremacy of the "centre" over the "periphery". It was from this period and following the inclusion of "Società Terni" within the system of state-controlled industries through the Institute for Industrial Reconstruction, a transaction which secured State control over the Company and its productive branches, that "La Terni" became firmly linked to Fascism and, more in general, to the local community, though in a controversial and ambivalent mutual relation. The Company was perceived as a capitalistic enterprise which took over the city, its directors being able to negotiate with the central Government directly and with the Duce himself, taking a super partes position in relation to the local Nfp. It was not a fortuitous occurrence that the Federal secretaries gauged their political influence against the effectiveness and strength of the relations they were able to maintain with the executive directors of "Società Terni", whom, on their part, appeared to be impenetrable to any influence exerted by the local Fascist Federation. Additionally, following the 1927 agreement and during the ensuing decade, "La Terni", in conjunction with the Fascist Party, appeared to become, without doubt, one of the main pillars of the province. At one level, it supported the Fascist Provincial Federation through a constant flow of financial contributions, vital to bankroll the Federation's activities within the province; but, at a more general level, asserting its influence as a large industrial group, it was capable of shaping the economic, trade-union and social policies of the Fascist regime, creating those conditions to establish «a system of aggregation/disaggregation of the social and political consensus/control conforming to the mass reactionary regime model»3. Within this dynamic interactions, and on the basis of documents available, the local Catholic Church played a significant role in relation to the Fascist Party. With reference to the specific case of the Terni-Narni dioceses and bishop Cesare Boccoleri, the Church's main leader during the Fascist ventennio, this research has showed that, as in the case of other Italian 3 Renato Covino, L'invenzione di una regione, Quattroemme, Perugia 1995, p. 58. 8 dioceses and in alignment with the decisions taken by the Vatican, the Church authorities in Terni supported the Fascist apparatus and adhered to a policy of collaboration with the Nfp. This was particularly manifest on specific occasions: for example during the economic and social campaigns promoted by the Regime, as a case in point the so-called "Battle of the wheat" and, above all, following the 1929 Concordat with the Catholic Church, or during the Ethiopian and Spanish conflicts. At the same time, even when tensions arose and marred the relations between the Fascist regime and the Catholic Church (following the 1931 crisis caused by the limitations imposed on the prerogatives of Azione Cattolica or the adoption of the 1938 racial laws), the consequences for the local Church were negligible and did not appear to affect the on-going relations with the local Fascist Federation. The local Church therefore in pursuing the aim of preserving and, wherever possible, augmenting the Church's influence on the local community, contributed to reinforce and widen consensus for the Fascist regime. More specifically, the Church's actions were particularly effective in encouraging, especially in rural areas, that precise process of "political modernisation", though reactionary at its core, based on organising the entire Italian society on hierarchical and centralising criteria, which Fascism was promoting particularly at a local level. Additionally, and without doubt, the important function to create and, above all, to maintain a high level of consensus was exerted by the pervasive surveillance and repression of any form of dissent and political opposition, enforced within the province by the Fascist security services. A repressive action which was extremely effective and, during the dictatorship, only the Communist Party, despite being hemmed in to the Terni industrial area, was able to maintain, albeit with great difficulty and in a limited way, a form of organised resistance. The fact that the Fascist authorities continuously, though recognising what had been achieved by the Party's multifarious organisations to favour and support the working classes, lamented the feeble "fascistisation" of the Terni industrial workforce and their being "politically dangerous", would appear to confirm implicitly that throughout the province the opposition and political dissent had not completely ceased. More in general, under the "black shirts", despite the propaganda and the activities of various Fascist authorities and institutions, it remained evident that the diversified interests which characterised the local society and the different realities rooted at local level persisted. Ultimately, the local Fascist Party appeared capable of exerting an active role in the "fascistisation" process of society, in alignment with the creation and implementation of a totalitarian state, being the main objective of the National Fascist Party under the leadership of Starace. The Nfp was therefore a real centre of power, expression of an authoritarian 9 regime leaning toward totalitarianism. A regime against which all citizens had to relate for their everyday life needs: that is to say, all citizens had to act, at least outwardly, as fascists.
