The article proposes a semiotic reflection on the 'conditions of enunciation' of graffiti in order to understand the essential features of the relation between this expressive form and the concept of power. Daniel 5, the Biblical passage that narrates the episode of Belshazzar's feast, is adopted as a point of departure for the construction of a textual series, which explores a philological tradition as well. Jewish interpretations, Christian exegeses, Christian iconography, and intertextual transpositions, all related to this biblical passage, are analyzed so as to determine the ways in which different socio-cultural contexts, in different periods, interpret and express the relation between political power, its injustice, and the role of 'God's writing on the wall' in redressing it.
On the path of an ancient exegetical tradition, the Roman Catholic Church interprets the Great War as God's punishment for modern world's apostasy. Beginning from the refusal by Gioventù italica – the periodical of the Italian Catholic Youth Society – to accept this interpretation, this article focuses firstly on the resistances to the theology of punishment in 20th century Italy and France. Furthermore, the analysis shifts to the modern apologists of the theology of punishment (Benedict xv, La Civiltà Cattolica, Études), pointing out in particular the compromises they are forced to make in order to adapt their discourse to the modern «feelings». ; Siguiendo una antigua tradición exegética, la Iglesia Católica interpreta la Gran Guerra como el castigo de Dios por la apostasía del mundo moderno. Empezando por el rechazo de esta interpretación por parte de Gioventù itálica –la revista de la Società della Gioventù Cattolica italiana–, el artículo se centra primero en las resistencias a la teología del castigo en Italia y Francia en el siglo xx. Luego el análisis se dirige a los defensores modernos de la teología del castigo (Benedicto xv, La Civiltà Cattolica, Études), destacando particularmente los compromisos que están forzados a hacer para adaptar su discurso a los «sentimientos » modernos.
This essay proposes an interpretation of the Christian theological discourse developed in Thomas Hobbes's Leviathan in order to show: 1) its theoretical-systematic value in the definition of the political form, that is, of the conceptual articulation that sustains the sovereignty device; 2) its complementarity to the performative trait of the Hobbesian anthropological discourse, that is, to the determination of the profile of a specific form of life, adapted to the sovereign order because capable of reproducing industriously within it and which is, at the same time, the primary product of that order. This interpretation shows that the Christian Commonwealth is the complete realization of the Hobbes's anthropological-political project.
This volume of Comunicazioni dell'Istituto Papirologico «G. Vitelli» is the twelfth of the series since 1995, and is divided into three sections: 1. Editions and rieditions of texts; 2. Critical notes; 3. Chronique de Lexicographie Papyrologique de la vie matérielle. The texts of the first section belong mostly to the collection of the «Vitelli» Institute, but there are also two documents from the Egyptian Museum in Cairo and a fragment from the State Archive of Florence. The four contributions of the second section deal with topics of literary papyrology (exegesis to the classics) and documentary (reading revisions and linguistic notes). The third section, an absolute novelty, introduces the first results of an international research project concerning the lexicon of material culture documented in the papyri from the Hellenistic to the Arab era.
The paper considers the prefatory texts of about fifty exegetical works of the period from Ambrosius Autpertus to Paschasius Radbertus. They usually reflect on the role of the exegete in the Christian societas, on the divine inspiration that guides him and on the relationship with the patristic sources. From these themes emerges a strong awareness of the commentators: exegesis continues in history the divine revelation, the preaching of Christ and the apostles, the voice of the Fathers, and proposes itself as a guide for rulers. Another theme often touched upon is the material transmission of commentaries, with important information on how they were composed and transmitted: their diffusion was entrusted to the copies that the recipients themselves would make from the exemplar sent by the author and not to a mass reproduction. These texts were not disseminated as common reference tools, but intended for dialogue among a political-cultural élite (as confirmed by the existence of a number of "minor" commentaries that substantiated the practice of teaching and reading the Bible).
L'architettura è un gesto. Ludwig Wittgenstein architetto [Architecture is a Gesture: Ludwig Wittgenstein, architect] Daniele Pisani. Quodlibet Studio, 2011 (261 pp., € 28) With great earnestness, Daniele Pisani tells the story of the Kundmanngasse house, designed by Paul Engelmann and Ludwig Wittgenstein, and built by Wittgenstein in the period from 1926 to 1928. Pisani quietly puts together all the pieces necessary for understanding the house and its role in the evolution of Wittgenstein's thought. He accurately describes the philosopher's biography as well as that of his sisters who were involved in the project (Margaret, but also Hermine), providing us with information about the Wittgenstein family and the political and cultural situation in Vienna at the time. He reconstructs the era's architectural debate in which the story of the house is (reluctantly) placed. The quiet tone and the accuracy of the story help eliminate the many legends that have accumulated over time about the house. The Kundmanngasse house is in fact a favourite subject for architects' philosophical dilettantism (second to this is only the exegesis, "Building, Dwelling, Thinking" by Martin Heidegger) as well as for philosphers' architectural dilettantism (think of the crazy interpretations that see in the house a petrified philosophy, a logic transformed into a house—hausgewordene Logik ).
In Leviathan Hobbes confronts with the Bible devoting no less than half part of his work to religious and theological matter. In the parts three and four of Leviathan we can find eighteen voluminous chapters devoted to the discussion of various elements of the Christian faith such as prophecy, revelation, miracles and salvation. In doing so Hobbes deals with a lot of passages from the Old and New Testament. In my thesis I consider the reasons, the method, and the role of Hobbes's account on the Bible to show how the biblical interpretation and the political theory of Hobbes are strictly related. In the first part, I consider how the historical and intellectual reasons that lead Hobbes into a so closer study of the Bible are innumerable and varied. I considered how the dilemma of choosing between papal and clerical abuse to the monopoly over right interpretation, and between protestant Sola Scripura arising from the individual right to read the bible for oneself, appears a theoretical problem in Leviathan. Hobbes faces this problem confronts with the Bible to show how the Scripture affirms that the Sovereign should control both civil and ecclesiastical power and how one unified and scientific method of reading the Bible could potentially eliminate all religious conflict. In this way Hobbes can reply, as much as political libido dominandi of catholic Church to the religious enthusiasm of puritans. In the second part of the thesis I considered how, in his account of the Bible Hobbes adopts an hermeneutic principles that provide for the use of mere natural reason and strictly excluded Enthusiasm or supernatural inspiration. In the chapter XXXIII of Leviathan Hobbes explains that men should expect an agreement between the truth of reason and God's word and so Christians should not renounce to their senses or experiences nor does their natural reason because they are useful to understand better the word of God. Hobbes cannot deny that, in Scripture, there be many things above reason, but he parenterally affirms that there is nothing contrary to it. Hobbes develops in his biblical exegesis a strong critic against scholasticism. Hobbes's rejection to schoolman is based in fact on his conclusion that their way of philosophizing has contributed to the abuse of the scripture by constructing an abstract and confusing language which is contrary to natural reason and adepts can manipulate the citizens. In the third part I considered how this is true especially for his account on the Hebrew Bible, the first five book of the Bible, known also as Torah, or "the law". While tracing back the history of Jews, in his discussion on the Prophetic kingdom of God, Hobbes ascertains that civil and ecclesiastical powers have always been an exclusive privilege exercised by a one and single person, holder of the supreme authority to interpret the law and the word of God. According to Hobbes is the Mosaic covenant, described in the book of exodus, is the historical example of unified authority: political and religious. As Moses controlled both the civil and the ecclesiastical power so the sovereign is allowed to establish regulations for the conduct of civil life, and he has the power to judge the word of God and impose obligation in God's name, since is God that gives the authority to interpret divine commands to the people invested with sovereignty. In this sense the political exegesis of the Hebrew Bible is something crucial in Hobbes's argumentations.
This paper aims to re-read Roman-Barbarian ethnicity as a cultural construct not least based on Biblical models viewed and interpreted as founded as well as authoritative instruments of self-definition. The study intends to overturn the traditional historiographical paradigm, according to which ethnicity emerges as a purely "Barbaric" construction in opposition to the Christian-Roman universalism. Starting from such a model, European history was often represented as a conflict between universalistic and nationalistic issues. According to A.'s analysis, the political role of ethnicity in Latin Europe doesn't emerge, at least partially, as a Barbarian "import". Far from representing an antithesis to the Universal Church, ethnicity assumes its politic role through Christianity and, more specifically, on the basis of exegesis as well as of re-adaptation of ethnic self-definitions well attested in Biblical texts. ; Il contributo rilegge l'etnicità romano-barbarica come costruzione culturale fondata in parte sulla rilettura e sulla riappropriazione di modelli biblici intesi come strumenti fondanti e autorevoli. Lo studio tenta di capovolgere il paradigma tradizionale secondo cui l'etnicità sarebbe un portato prettamente "barbarico", in opposizione all'universalismo cristiano-romano. Seguendo questo modello, la storia europea è spesso stata rappresentata come un conflitto tra principi universali e nazionali. Secondo l'A. il ruolo politico dell'etnicità nell'Europa latina non va considerato, almeno in una certa misura, come un'importazione barbarica. Lungi dal rappresentare un'antitesi alla chiesa universale, l'etnicità assume il suo ruolo politico decisivo proprio attraverso il cristianesimo e, più in particolare, attraverso la ripresa e l'adattamento di taluni modelli di auto-definizione etnica presenti nei testi biblici.
In the age of greatest crisis of a state perched on ancient systems of values, that in fact were the prerogative of a narrow political circle no longer able to govern, Cesare appears as the man who reveals the way of no return taken by the Republic, by forcing extreme mechanisms of the system and stalling them with his protomonarchic experiment. Here, through ancient and modern literature and historical sources, one of the most mythologized figures of all times and the exegesis of the birth and construction of this myth is analysed. ; À l'ère de la plus grande crise d'un État perché sur d'anciens systèmes de valeurs qui étaient en fait l'apanage d'un cercle politique étroit qui ne pouvant plus gouverner, Cesare apparaît comme l'homme qui révèle le chemin du non-retour emprunté par la République, en forçant des mécanismes extrêmes du système et en les bloquant avec son expérience protomonarchique. Ici, à travers la littérature ancienne et moderne et les sources historiques, l'on analyse l'une des figures les plus mythologiques de tous les temps et l'exégèse de la naissance et de la construction de ce mythe. ; Nell'epoca di maggiore crisi di uno stato arroccato su antichi sistemi di valori che di fatto erano appannaggio di una stretta cerchia politica non più in grado di governare, Cesare appare come l'uomo che rivela la via di non ritorno imboccata dalla Repubblica, portando a forzatura estrema meccanismi del sistema e mettendoli in stallo con il suo esperimento protomonarchico. Qui viene analizzata attraverso la letteratura e le fonti storiografiche, antiche e moderne, una delle figure più mitizzate di tutti i tempi e l'esegesi della nascita e della costruzione di questo mito.
L'oggetto di questo lavoro è il compito di legittimazione culturale della dittatura franchista sviluppato per i giuristi spagnoli tra 1937 e 1945. Il suo obiettivo é fornire un quadro complessivo utile per la comparazione con il percorso italiano. Si mettono a fuoco cinque questioni: in primo luogo, la rottura nella accumulazione e nello sviluppo del sapere giuridico causata dalla guerra civile e le ulteriori esecuzioni, esili e epurazioni dei professori universitari; poi, la legittimazione con gli argomenti del diritto del coup d'État del 18 luglio 1936. Dopo si esaminano le teorie che davano fondamento alla posizione suprema del dittatore. È anche oggetto d'indagine l'atteggiamento dei giuristi davanti alle grandi leggi del regime, segnato per l'esercizio di una esegesi acritica e senza costruzione. Infine, l'ultimo punto tratta lo studio dei sistemi giuridici del Terzo Reich e dell'Italia fascista che spesso facevano i giuristi spagnoli al fine di ricavare informazioni utili per il processo d'istituzionalizzazione della dittatura franchista. This work will examine the cultural legitimacy given by the Spanish jurists to Franco's dictatorship between 1937 and 1943. I intend to give a general outlook in order to compare the Spanish experience with the Italian jurists. I will discuss five issues: a) The discontinuity in the development and growth of legal knowledge caused by the civil war, the executions, the exile, and the purge of universities' faculty; b) the use of legal arguments to legitimate the military coup of July the 18th of 1936; c) the theories that made the basis of general Franco's caudillaje; d) the exegesis without construction as a means to interpret and expose the dictatorship's laws; e) the focus on Nazi Germany's and fascist Italy's legal systems as models for the institutionalization of the 'new State'.
In this study, we are concerned with the "carteggio interno" of the Fondo Sforzesco, preserved in the State Archive of Milan. This huge documentary deposit can provide the historian both with an unprecedented amount of data and sources of outstanding heuristical potential and with some possible deception, like the lack of information or the complete silence about important events. Starting from a dossier of documents (parts of them enclosed in a digital appendix), we will analize the centrality of the letter. The flexible format of the letter is suitable to express personal feelings, emotions, and also a certain degree of informality and confidence. Writing to the prince, the correspondent is normally inclined to go beyond the rules and to use confidential terms or remember personal acquaintance, in a characteristic mixture between the political sphere and the private and personal dimension. As narrative texts, letters require a careful exegesis and interpretation. Finally, the huge dimensions and the narrative appeal of the "carteggio" may give the wrong impression of a pervasive and powerful State, where the relationship with the prince dominates the political life. ; Nell'ambito della "storia documentaria delle istituzioni" ci si propone di esaminare il carteggio interno del Fondo Sforzesco dell'ASMi e di metterne in luce la ricchezza, le potenzialità per la ricerca e anche qualche possibile insidia interpretativa. A partire da un dossier di documenti, che in parte sono forniti come corredo iconografico al testo, si analizza la centralità della lettera all'interno di questo corpus di carte. La forma epistolare è prima di tutto un medium di comunicazione interpersonale, poco formalizzata e libera nell'espressione: chi scrive al principe segue certe regole e stili, ma può anche utilizzare toni confidenziali e personali, in una commistione tra pubblico e privato particolarmente congeniale alle relazioni politiche dello stato principesco. Le lettere sono costruite come testi narrativi e vanno attentamente interpretate e contestualizzate. Le stesse dimensioni del carteggio, che costituisce una raccolta imponente, condizionano il lettore che è tentato di vedervi un'immagine della pervasività e della potenza dello stato ducale.
Il presente progetto di ricerca propone l'esegesi di alcune sezioni delle Grazie di Ugo Foscolo, secondo l'Edizione Nazionale (1985), a cura di Pagliai-Scotti. È stato fornito il commento delle seguenti sezioni: Prima redazione dell'Inno, Seconda redazione dell'Inno e Appendice alla Seconda redazione dell'Inno, Versi del Rito, Quadernone, Stesure milanesi: Viaggio delle api e frammenti sparsi. Tutte le stesure della Prima redazione dell'Inno e alcuni frammenti delle Stesure milanesi non erano mai stati commentati fino ad ora. Il commento offre una ricostruzione dell'intertesto delle Grazie – le fonti letterarie, erudite e figurative –, e punta alla storicizzazione e alla contestualizzazione della poesia di Foscolo. Attraverso lo studio dei frammenti nella loro evoluzione è possibile intendere come i tre inni, diventati uno soltanto nella redazione del Quadernone, rappresentino la sintesi di tutto il sapere e gli interessi foscoliani (eruditi, scientifici, filosofico-estetici e letterari), e come essi, sin dai primi esiti poetici, siano specchio delle esperienze biografiche dell'autore. Il commento proposto nella tesi ribadisce la complessità della poesia delle Grazie, nelle sue componenti civili e didattiche. Esso avanza nuovi e importanti spunti di indagine, ponendosi come viatico indispensabile per un futuro commento integrale. ; This project is an attempt of commentary of some parts of Ugo Foscolo's Le Grazie, according to the Edizione Nazionale (1985), edited by Paglia-Scotti. The following parts have been annotated: Prima redazione dell'Inno, Seconda redazione dell'Inno e Appendice alla Seconda redazione dell'Inno, Versi del Rito, Quadernone, Stesure milanesi: Viaggio delle api e frammenti sparsi. This is the first commentary of the whole section of Prima redazione dell'Inno and of some drafts of Stesure Milanesi. This commentary aims to show the literary, figurative and erudite sources of Le Grazie, and it contextualises Foscolo's poem. The analysis of the evolution of these drafts proves that the three hymns ¬– which become one in the later draft of Quadernone – represents the synthesis of all Foscolo's knowledge. Since the beginning of the poetic composition, Le Grazie reflect Foscolo's autobiographical experiences. Furthermore the commentary explains the public and political aspects of Le Grazie, and it represents a fundamental basis for the future exegesis of the whole poem.
Il lavoro intende rendere il lettore edotto di come, progressivamente, la dottrina sia divenuta consapevole del rilievo dell'intesa tra Stato e confessioni di minoranza. A una prima collocazione di queste nell'ambito dell'extragiuridico (teoria del rilievo solo politico dell'intesa) fa seguito, in correlazione con gli eventi storici del tempo, un tendenziale parallelismo con i concordati con la Chiesa cattolica. Si realizza co¬sì una visione dell'intesa più conforme a uno Stato laico e pluralista, qual è il nostro. L'intesa è esterna o interna all'ordinamento italiano a seconda di come la confessione interessata intenda impostare le proprie relazioni con l'autorità statale, e questo indipendentemente dal carattere originario o derivato dell'ordinamento delle confessioni di minoranza. Accanto a un nucleo di materie comuni fra intese e concordati regolamentate secondo una tecnica di disciplina analoga, si riscontrano materie specialissime che caratterizzano la peculiarità di ciascuna confessione e regolamentate secondo una disciplina sui generis. Lo scritto evidenzia come l'esegesi delle norme costituzionali sul fattore religioso, come delle norme giuridiche in genere, sia condizionata dal dato storico-politico. Il diritto condiziona la storia e la storia condiziona il diritto; da questo l'esigenza che l'interpretazione delle norme sia sempre in consonanza con l'epoca in cui si vive, come dimostra la diversa percezione del rilievo dell'intesa dal 1948 a oggi. The study intende to make the reader aware of how dottrine has progressively become knowledgeable of the importance of the agreement between the State and minority confessione. A first placing of these in the extra-juridical ambit (theory of the political importance only of the agreement) was followed by a tendential parallelism with the con¬cordats drawn up with the Catholic Church, in correlation with the historical events of the time. In this way, a vision emerges of the agreement which is more in conformity with a laical and pluralistic State such as ours. The agreement is external or internal to the Italian organization depending on how the confession in question wishes to define its relationship with government authority, independently from the original or derived character of the rules of the minority sette. Alongside a nucleus of matters common to agreements and concordats, regulated by a technique of analogous discipline, there are very particular matters characterizing the peculiarity of each confession, and regulated by a «sui generis» discipline. The paper outlines how the exegesis of constitutional norms in the religious field, like juridical norms as a whole, is conditioned by historical-political data. Right conditions history and history conditions right; from this springs the need for the interpreta¬tion of norms to always be in consonante with the age in which one lives, as shown by the different perception of the importance of the agreements from 1948 up to today.
Il lavoro muove dalle fasi dello sviluppo dell'Informatica forense in Italia, prosegue attraverso una sistematizzazione della disciplina, per poi passare all'analisi delle questioni tecniche e della rilevanza giuridica costituenti il presupposto di fatto comune alle fattispecie giuridiche oggetto di studio. La ricerca non verte solo su una disamina dei temi di Informatica forense e di quelli interdisciplinari con il diritto penale, processuale informatico e informatico-forense, ma soprattutto, muovendo dalle norme della Convenzione di Budapest e dalla L. 48/2008 di Ratifica, il lavoro affronta le questioni di Informatica forense più ardue e ancora poco esplorate dalla dottrina al fine di isolarli e svilupparli con innovativa originalità. In tale analisi, gli elementi innovativi del lavoro sono molteplici, vari e concernono: • le puntualizzazioni della terminologia giuridica dell'Informatica forense sulle quali il candidato spesso si sofferma dando prova di quanto ancora oggi sia spesso usata impropriamente • il fondamento scientifico-ontologico della definizione di dato digitale, ritenuto chiave di volta dell'intera disciplina; • la natura fisica e giuridica dei dati digitali oggetto di investigazioni e indagini e la loro dimensione materiale-immateriale, che condizionano l'esegesi e la prassi della disciplina; • la natura ripetibile e/o irripetibile degli atti di indagine aventi ad oggetto dati digitali, ritenuta una delle più gravi idiosincrasie sistemiche della disciplina; • la prova documentale digitale ed il rapporto tra documento digitale originale, originario e copia, nell'ambito del processo penale; • la ricaduta di tali argomenti ancora trascurati dalla dottrina processualpenalistica nella più recente giurisprudenza di merito e di legittimità. ; The work moves from the stages of Forensic Informatics development in Italy, continues through a systematization of the discipline, then moves on to the analysis of the technical issues and legal significance constituting the assumption of fact common to the legal topics being investigated. The research not only focuses on an examination of the forensic IT issues and of those interdisciplinary with Criminal Law, Procedural Digital Law and computer forensics, but especially deals with difficult themes of Forensic Informatics and issues little explored by the legal literature in order to isolate and develop them with innovative originality, moving from the rules of the Budapest Convention and Law 48/2008 of its Ratification in Italian acts. In this analysis, the innovative elements of the work are many, varied and relate to: • clarifications of the legal terminology of Forensic Informatics over which the candidate often dwells, demonstrating even today what is often misused; • scientific-ontological definition of the digital data, considered key to the whole Forensic Informatics foundation; • the physical and legal nature of digital data, object of investigations and surveys and their material-immaterial dimension, affecting the exegesis and the practice of the legal doctrines; • repeatable and /or unrepeatable nature of the acts of investigation involving digital data, considered one of the most serious systemic idiosyncrasies of the discipline; • digital documentary evidence and the relationship between the original, primary and copied digital documents, in the criminal process; • consequences of such reasoning, still neglected by Criminal Processual Law, in the most recent jurisprudence of merit and legitimacy.
Questo saggio si propone di indagare il ruolo politico e giuridico degli esegeti nell'Atene tra il V e il IV secolo; dopo una veloce rassegna del dibattito, vivo soprattutto intorno alla metà del secolo scorso, intorno alle origini, al numero e all'identità degli esegeti, esso si concentra soprattutto sulle fonti letterarie disponibili, che permettono di distinguere tra due categorie. Gli esegeti tout court (da identificare con i due gruppi che le testimonianze epigrafiche qualificano come Eupatridi e Pythochrestoi) erano consultati da privati in situazioni particolarmente complicate, e l'applicazione delle leggi di cui essi erano depositari serviva ai loro clienti per dare il corretto impulso a un'eventuale azione processuale. Gli esegeti Eumolpidi, competenti in merito al culto di Eleusi, custodivano antichi e severissimi νόμοι a disciplina della ἀσέβεια commessa in relazione ai Misteri. Le loro pubbliche richieste di applicazione di tali νόμοι, tuttavia, generavano dubbi e controversie, sia perché essi riguardavano una materia regolamentata anche dalle leggi cittadine, sia anche perché – come è stato qui ipotizzato – almeno fino alla metà del IV secolo i confini della loro esegesi non vennero definiti con chiarezza. Sebbene la diversità di competenze mostri l'opportunità di evitare di parlare degli esegeti come categoria unica, l'analisi condotta porta ad alcune conclusioni definitive che possono essere accolte per entrambe le tipologie: innanzitutto, le leggi da loro custodite riguardavano una materia tradizionalmente indicata come "sacred law". In secondo luogo, l'attività che essi svolgevano sulle "leggi" di cui erano depositari – e che non erano pubblici, come lo erano invece i νόμοι cittadini, consultabili da chiunque – non era propriamente di "interpretazione": era, piuttosto (come confermano anche le fonti lessicografiche), di illustrazione e spiegazione del loro contenuto. ; The aim of this essay is to analyze the political and legal role of the Athenian exegetes in the fifth and fourth century B.C. After a review of the scholarly debate about the origins, the number, and the identity of the exegetes, the paper focuses especially on the available literary sources, which make a clear distinction between two categories. First, there were the exegetes tout court (to be identified with the two groups qualified by inscriptions as Eupatrids and Pythochrestoi); they were consulted by private citizens in particularly complicated situations, and the application of their "laws" allowed their clients to give the proper start to a possible legal action. Then, there were the Eumolpid exegetes, whose province was generally the Eleusinian cult and particularly ἀσέβεια committed during the Mysteries. The application of the archaic and severe νόμοι they guarded gave rise to doubts and controversies, both because the same topic was also regulated by the laws of the city, and because – as I suppose in the paper – the limits of their exegesis were clearly defined only in the middle of the fourth century. Given the different provinces of the two groups, it is impossible to talk about the Athenian exegetes as a homogeneous category. Nonetheless, some conclusions can be drawn for both the Eumolpids and the other exegetes. The laws they guarded dealt with a subject generally designated as "sacred law".
