If human rights are "inalienable rights of all members of the human family", as is enshrined in the Universal Declaration of Human Rights, then no government should be allowed to deny people of them. When some governments fail to realize them for the people under their jurisdiction, the international community has a responsibility to step in. This extra-territorial effect of human rights was not included in the original conception of human rights. It is of recent date, and, in practice, limited to interventions to end severe violations of civil and political human rights. For economic, social and cultural human rights, extra-territorial obligations are still contested. In this paper, we elaborate three contentions: first, that the realization of social human rights requires the acceptance of and compliance with extra-territorial obligations; second, that compliance with extra-territorial obligations would help transform the international assistance paradigm from charity into legal obligation; and third, that for global constitutionalism to succeed in improving the fairness of the international legal order requires acceptance of the indivisibility of human rights.

The Maastricht Centre for Human Rights of Maastricht University and the International Commission of Jurists are pleased to announce the adoption of the Maastricht Principles on Extra-Territorial Obligations (ETOs) of States in the area of Economic, Social and Cultural Rights. These international legal principles clarify the human rights obligations of States beyond their own borders. The Principles cover all economic, social and cultural rights, including among others the right to just and favourable conditions of work, social security, an adequate standard of living, food, housing, water, sanitation, health, education and participation in cultural life.

This study addresses the development of public policies within transnational spaces and, in particular, states' attempts to establish or cultivate links with citizens residing abroad. This practice has intensified lately in all regions of the world and carries important implications for the evolutions of the concepts of sovereignty and citizenship, as well as citizens' exercise of their political rights. This work focuses on the case of Argentina in the 2000-2015 period to observe recent attempts to reach out to Argentines abroad. It analyses the evolution of state initiatives and the factors shaping emigrants' responses, with particular emphasis on the exercise of voting rights from afar. The study contributes to unveil the political and institutional dynamics surrounding attempts to govern populations across geographical distances and the redefinition of citizenship beyond borders in one of the least explored cases in the literature. ; Este estudio analiza el desarrollo de políticas públicas a nivel transnacional, en especial aquellas que intentan vincular a los ciudadanos residentes en el extranjero con su país de origen. Se trata no sólo de una práctica que se ha intensificado en América Latina sino en todas las regiones del mundo, con importantes repercusiones para la evolución de los conceptos de soberanía y ciudadanía y el ejercicio, por parte de los individuos, de los derechos asociados con el status de ciudadano. Este trabajo se centra en el caso de Argentina en el período 2000-2015, donde se observan intentos recientes y parciales de aproximación a los argentinos en el exterior. Se analizan aquí cómo evolucionaron las iniciativas estatales y qué factores influyen en la respuesta de los emigrantes, en particular respecto del ejercicio del derecho al voto desde el exterior. Este estudio contribuye así a elucidar la dinámica política e institucional que moldea los intentos de gobernar poblaciones a la distancia y la redefinición de la idea de ciudadanía más allá de las fronteras territoriales en uno de los casos menos estudiados de la literatura académica.

This book explores the causes and consequences of the discursive and legal construction of the Hungarian transborder nation through the institutionalization of non-resident citizenship and voting. Through the in-depth analysis of Hungarian transborder and diaspora politics, this book investigates how the political engagement of non-resident Hungarians impacts inter- and intra-state ethnic relations. In addition, the research also explores how institutional changes and shifting discursive strategies reify and redefine ethnic belonging narratives and the self-perception of Hungarians living outside the country. The research uses a multidisciplinary qualitative methodology which includes institutional (historical, rational choice and sociological) analysis, discourse analysis as well as interpretive methods. Through the inventive application of multiple methodologies, the book goes beyond the mostly institutional/legal analysis dominant in the study of citizenship.-- Provided by publisher
