This article deals with the conditions and limitations to the right to reside and of freedom of movement recognized to third country nationals who are family members of an EU citizen. With its decision in the Zambrano case, the Court of Justice of the European Union decided that the status of citizen of the European Union produces its effects, initially limited to cross-border situations, also in purely domestic ones. Children with the citizenship of the European Union who are dependent of a parent with third country nationality would be forced to leave the territory of the European Union in case of refusal of their parent's application for the right of residence. They would thus be deprived of the substance of the rights conferred on them by virtue of their status as citizens of the European Union. The scope of said rights as recognized to a third country national member of the family of a citizen of the European Union depends on the determination of the substance of the rights conferred by the status as citizen of the European Union. The post-Zambrano case-law will be examined in order to determine the extent and limitation thereof.

Cet article analyse les dimensions historiques de la différenciation dans le cadre des discussions interinstitutionnelles pour établir la libre circulation des personnes dans l'UE. Il souligne le rôle du Parlement européen (PE) dans ce domaine, de la création de l'espace Schengen en 1985 jusqu'à 2015, en passant par des moments décisifs de la fin de la guerre froide et de la construction européenne. Tenant compte de l'importance de la différenciation « verticale » pour cette étude de cas, il aborde également les conséquences diachroniques de la centralisation du pouvoir au sein de différents secteurs d'intervention publique interconnectés.

The present thesis dealing with the free movement of lawyers both with respect to EU law and its implementation in Slovakia consists of two parts, the first part dealing with the recognition of diplomas and professional qualifications and conditions of exercise of the profession of lawyer and the second part concerning the provision of services by and establishment of lawyers. Thanks to the initiatives of the EU legislator, but also of EU courts, migration of lawyers in the internal European market has been largely facilitated, whilst preserving the guarantees of quality of legal services provided by migrating lawyers in the EU. As far as the Slovak rules on the profession of lawyer are concerned, these are largely consistent with the EU legal framework. Nonetheless, certain provisions of Slovak law transposing the EU acquis do not seem to be precisely transposed and consistent with the corresponding EU rules. ; La présente thèse traitant de la libre circulation des avocats tant du point de vue de la réglementation de l'Union que de sa mise en œuvre en Slovaquie comporte deux parties, la première traitant de la reconnaissance des diplômes et des qualifications professionnelles et des modalités d'exercice de la profession d'avocat et la deuxième relative à la prestation de services et à l'établissement des avocats. Grâce aux initiatives du législateur, mais aussi du juge de l'Union, la migration des avocats dans le marché intérieur européen a été largement facilitée, tout en préservant les sauvegardes de qualité des services juridiques prêtés par les avocats migrants dans l'Union européenne. S'agissant de la réglementation slovaque de la profession d'avocat, celle-ci est largement conforme au cadre juridique de l'Union. Néanmoins, certaines dispositions du droit slovaque transposant l'acquis de l'Union ne semblent pas être précisément transposées et conformes à la réglementation de l'Union correspondante.

Research has tried to refine the legal phenomena of the liberalization of goods and services, known as first generation, in favor of a regional economic integration policy under the influence of globalization, in order to establish the ASEAN Economic Community. However, the question of the existence of substantive rules of law is underestimated in the eyes of international lawyers and it is relevant. In other words, ASEAN is mainly based on soft law, namely ASEAN Way, which has effectively slowed down the implementation of its economic integration policy. In order to overcome these challenges, this thesis opted for an approach of public international law in order to examine the mechanism of formation of conventional as well as non-conventional rules of this in ASEAN. In addition, international economic law is also a methodological choice for this research work on essential technical questions in the process of creating the ASEAN Single Market. As a result, we have discovered that ASEAN substantive law does exist and continues to develop gradually in the proper sense of international law. Moreover, the administrative as well as jurisdictional institutional mechanisms have been observed, their operation of which is implicated in a pragmatic manner for the implementation of these material rules regarding the free movement of goods and services. Despite the fact that these rules of law are criticized both for their effectiveness and efficiency because of their flexible and non-binding nature, sectoral legal harmonization is complete towards the direction of the construction of ASEAN Community Law. The current situation presents the risk of a proliferation of competing pockets of rights in the Great Lakes region and the risk of opening an era of legal rivalry between the legal systems to which CEPGL member countries belong. This situation of legal balkanisation is not such as to promote either the free movement of goods, services and capital or the harmonisation of business law in the Great Lakes Region. To remedy this situation, this article recommends the adoption of harmonised law by OHADA. This will allow member countries to have a harmonised right without abandoning its legal tradition. ; La situation actuelle présente le risque de voir se multiplier dans la région des grands lacs des poches de droits concurrents et celui d'ouvrir une ère de rivalité juridique entre les systèmes juridiques auxquelles appartiennent les pays membres de la CEPGL. Cette situation de balkanisation juridique n'est pas de nature à favoriser ni la libre circulation des marchandises, des services et de capitaux ni l'harmonisation du droit des affaires dans la Région des Grands Lacs. Pour remédier à cette situation, cet article recommande l'adoption du droit harmonisé par l'OHADA. Cette adoption, permettra aux pays membres d'avoir un droit harmonisé sans être amené à renoncer à sa tradition juridique.
