In Germany two radical changes have recently been made in immigration policy. First the free movement of labour was stopped with regard to the EU accession country of Poland, secondly the immigration act was passed. Based on the concrete example of Polish doctors' decisions to immigrate, this paper asks whether these legal developments are in accordance with Germany's needs. The immigration of doctors is identified as a need on the basis of economic studies and a discussion of the extent and development of the shortage of doctors. Consequently the immigration of Polish doctors is (also) desirable. By means of the theory of wage differentials, the incentives are portrayed that lead these doctors to immigrate into Germany for economic reasons. Then the obstacles that prevent people from emigrating are described. The paper looks into which amendments of the law hinder or encourage the decision. It emerges that the majority of the amendments that can encourage migration originate from European initiatives, whilst the amendments in the genuinely German legislation promise a more marginally positive impact.
Die Arbeit untersucht aus der Perspektive der Arbeitsmigration die Niederlassungsrechte der Staatsangehörigen und der Unternehmen aus Mittel- und Osteuropa in der Europäischen Union im Zeitraum 1990-2009. Erörtert werden das relevante EU-Recht und die entsprechenden nationalen Regelungen am Beispiel Deutschland und Bulgarien. Behandelt werden u.a. unterschiedliche Fallkonstellationen, in denen die gewährten Niederlassungsrechte nicht zweckentsprechend genutzt werden. Untersucht werden dabei die rechtlichen Aspekte der unlauteren Nutzung der erwähnten Niederlassungsrechte als eine ungewöhnliche Form der legalen Migration aus Mittel- und Osteuropa. Diese können unter bestimmten Umständen als Mittel eines legalen Zugangs zu sonst gesperrten Arbeitsmärkten der "alten" EU-Mitgliedstaaten dienen oder als Instrumentarium für eine Aufenthaltsverfestigung in Hinsicht auf die Versuche, durch die Niederlassungsrechte einen vorher unrechtmäßigen Aufenthalt in einem EU-Mitgliedstaat zu legalisieren. Die Untersuchung berücksichtigt die relevante Rechtsprechung im Bereich und verläuft komplex auf drei Ebenen - auf Ebene des internationalen Privatrechts Bulgariens, des EU-Rechts und des deutschen alten und neuen Ausländerrechts. ; The dissertation examines the right of establishment of nationals and companies of Central and Eastern Europe (CEE) in the European Union from the perspective of labour migration. It discusses the relevant EU legislation combining the corresponding German and Bulgarian national regulations over the period 1990-2009. The dissertation presents inter alia different constellations, in which the right of establishment is not used according to the spirit and purpose of the law. It analyzes the legal aspects of such unfair practices as a nontypical form of legal migration from Central and Eastern Europe in the European Union. In the years preceding the EU accession 2004/2007 and in the transitional periods after that the labour markets of the "old" EU Member States were subject of restrictive regulations. That fact provoked the CEE nationals under certain circumstances to use the right of establishment improperly - as an instrument for a legal access to the aforementioned labour markets, as a tool for acquiring a permanent residence status in the host country or even as an attempt to legalize an illegal residence. The study takes into account the relevant EU and German case law and runs complex on three levels - on the level of EU law and on the level of the corresponding Bulgarian and German law.

For example, researchers have been able to show that throughout the late 18th and mid-19th centuries, in cities like Paris, Mexico City, New York, and Manchester, surprisingly similar discussions were taking place about the regulation and liberalisation of bread and meat production, and their related distribution systems. The article engages with this international discussion by arguing that these debates represent a kind of "double movement" between regulated and self-regulated markets, as outlined by Karl Polanyi. It then raises the question of how urbanisation and political regulation affected the food supply system of the city of Vienna during the Vormärz period (1815–1847). Abstract Information systems constitute a key feature of the European Composite Administration. In the Food and Feed sector, the European Union has established a Rapid Alert System for Food and Feed (RASFF) obliging the Member States to exchange information on food- and feed-related risks to public health, thus enabling them to take action in case of food safety risks resulting from the free movement of these products within the European Union. Such information systems pose a particular challenge for effective legal protection since undertakings seeking to challenge the information exchange or measures resulting from it because of e. g. incorrect information are confronted with a multitude of actors, legal orders and systems of judicial protection. Against this background, the article explores the RASFF's design and ist functioning, notably the role of the various actors on national and EU level, and analyses the issues of primary and secondary legal protection in case of incorret alert notifications. Moreover, on the basis of these findings, general conclusions for designing EU information systems – relevant also beyond the Food and Feed sector – will be drawn.
Die Freirechtsbewegung war eine Strömung in der Rechtswissenschaft zu Beginn des 20. Jahrhunderts, deren Anliegen eine grundlegende Reformierung der Rechtsprechung war. Die Freirechtler lehrten, der Richter habe in Wahrheit ein viel freieres Verhältnis zum Gesetz, als dies die herrschende Auffassung annehme, und drängten auf die offene Anerkennung dieser Erkenntnis. Hermann Kantorowicz wurde durch seine 1906 erschienene Schrift " Der Kampf um die Rechtswissenschaft" zu einem der führenden Repräsentanten der Bewegung. Zeitlebens wurde Kantorowicz von dem Vorwurf verfolgt, er wolle Rechtsfindung contra legem, da er in der Kampfschrift in bestimmten Fällen dem Richter die Befugnis zugesprochen hatte, vom Gesetz abzuweichen. Die Arbeit untersucht, welche Rolle Hermann Kantorowicz in der Freirechtsbewegung spielte und ob es seinem wissenschaftlichen Werk gerecht wird, seinen Namen im Wesentlichen mit der Contra-legem-Problematik in Verbindung zu bringen. Außerdem wird der Frage nachgegangen, ob die Freirechtsbewegung nur eine folgenlose Episode in der Geschichte der Rechtswissenschaft gewesen ist, oder ob es ihr beschieden war, sich bleibende Verdienste zu erwerben
In einem Verfahren, das 2003 beim Finanzamt Linz seinen Anfang genommen hat, hatten sich UFS, VwGH und EuGH mit Fragen zur Unionsrechtskonformität der Entlastung von Beteiligungserträgen von der wirtschaftlichen Doppelbesteuerung im österreichischen Körperschaftsteuersystem zu befassen. Der EuGH stellte in seinem Urteil Haribo und Salinen mehrere schon länger im österreichischen Schrifttum vermutete Unionsrechtswidrigkeiten im Zusammenhang mit der Internationalen Schachtelbeteiligung fest, sowie dem System der Beteiligungsertragsbefreiung von Körperschaften allgemein.Die vorliegende Diplomarbeit beschäftigt sich daher zunächst mit den materiellrechtlichen Rahmenbedingungen dieser Entscheidung: Einerseits dem österreichischen Körperschaftsteuersystem, andererseits demjenigen Teil des Unionsrechts, an dem ersteres zu messen war: der Kapitalverkehrsfreiheit, sowie der jüngeren Judikatur des EuGH zu den direkten Steuern.Anschließend folgt eine Untersuchung des Urteils und dessen Stellung in der Rechtsprechung des EuGH, die sich in den vergangenen Jahren, und insbesondere auch noch im Laufe des Verfahrens, ganz erheblich entwickelt hat. Der EuGH befasste sich mit Fragen zum Verhältnis zwischen Anrechnungs- und Befreiungsmethode zur Beseitigung der wirtschaftlichen Doppelbesteuerung, zur Kapitalverkehrsfreiheit gegenüber Drittstaaten, zur Beschränkungsmöglichkeit der Grundfreiheiten in Form des Abstellens auf Amts- und Vollstreckungshilfeverpflichtung der Ansässigkeitsstaaten, sowie dem Anrechnungsvortrag ausländischer Körperschaftsteuer in Verlustjahren.Zuletzt werden die Auswirkungen auf die österreichische Rechtslage dargestellt, in Bezug auf das Körperschaftsteuergesetz und dessen vom EuGH festgestellte Unionsrechtswidrigkeiten, die der Gesetzgeber nunmehr im Abgabenänderungsgesetz 2011 weitgehend behoben hat, aber auch in Bezug auf die zukünftige Handhabung von Verstößen gegen das Unionsrecht durch nationale Steuernormen durch den Verwaltungsgerichtshof. ; In 2003, proceedings started at the Finanzamt Linz (Tax Office Linz), in which the Unabhängige Finanzsenat Linz (Independent Finance Tribunal Linz), the Verwaltungsgerichtshof (Administrative Supreme Court) and last the European Court of Justice were to decide on questions of the prevention of economic double taxation of dividends received from companies established in other Member States and in non-member States.The ECJ confirmed infringements of European Union law, which had been suspected repeatedly in Austrian literature, concerning the Austrian system of the taxation of international holdings, and the corporate income taxation of dividends in general.The thesis is therefore commencing with an outline on the legal context of the decision. The Austrian 1988 Law on Corporation Tax (Körperschaftsteuergesetz 1988) on one hand, the corresponding European Union law on the other hand: the principle of free movement of capital in particular, as well as the relevant recent case law of the ECJ on direct taxation.Afterwards, the ECJ?s decision is enquired, including its position between the ECJ?s other recent case law, which has been rapidly evolving during the past years, and especially during the proceedings. Health services have long been insulated from the process of European integration. In this article, however, we show that we are witnessing their re-configuration in an emerging EU health-care system. The article uncovers the structuring lines of this system by focusing on three interrelated EU-wide processes influencing the integration of national health-care systems into a larger whole. First, the privatisation of health-care services following the constraints of Maastricht economic convergence and the EU accession criteria; second, health-care worker and patient mobility arising from the free movement of workers and services within the European Single Market; and third, new EU laws and country-specific prescriptions on economic governance that the EU has been issuing following the 2008 financial crisis. By using some simple tools of game theory, this contribution examines the impact of Europeanization on the strategic bargaining capacities of the unions in Switzerland. To this end, the bilateral agreement on the free movement of persons -- as an example of Europeanization by international treaty -- is compared to the process of the unbundling of the local loop, an example where Switzerland adopts European law without contractual commitment. In the case of Europeanization by treaty, the unions always have the possibility of resorting to the referendum. Thus, provided that the unions can credibly present themselves as an important veto player in the process, they can either block the ratification or receive side-payments in exchange for their support. In this perspective, Europeanization does not weaken their position compared to a purely national law-making process; depending on the actor constellation, their position may even be strengthened. With regard to "autonomous adaptation," however, the threat of blocking the procedure is only available if the ordinary law-making procedure is chosen. Yet, given that Europeanization leads to delegation of important competencies to executive authorities, possibilities to circumvent these veto points often exist. Comunicacion popular (popular communication) in Chile is the watchword in the evolution of civic discourse in the post-(Augusto) Pinochet era. The concept refers to base media & base communication (at the popular level) that are closely linked to social movements. Comunicacion popular has been an important component in Chilean democracy since the 19th century, & has played a leading role in Chile's successful (with the exception of the 1973-1990 period) democratic government. The historical precedents for the return to a free press following the end of Pinochet's rule are discussed in some detail, as are future prognoses for Chilean media. A. Cohen-Siegel

Wie verlaufen die Migrationsprozesse von Frauen, die seit 1989 aus 13 EU- und Nicht-EU-Ländern Mittelosteuropas in Berlin als Arbeits-, Bildungs- und Heiratsmigrantinnen zuwanderten?Die Studie von Helga Jockenhövel-Schiecke zeigt die hohe Bereitschaft der Migrantinnen, das mitgebrachte kulturelle Bildungskapital sowie ihre Erwerbsorientierung zu erweitern. Beide sind charakteristisch für die Mittelschicht und prägen auch die mütterlichen Erziehungsstrategien. Der Untersuchung liegen biographische Interviews zugrunde, in denen die Frauen ihre Migrationsmotive, gendertypische Bildungs- und Erwerbsprozesse, transnationale Lebensformen und Gefühle ihrer multiplen Zugehörigkeiten beschreiben. Sie spiegeln so die Feminisierung der Zuwanderung aus Mittelosteuropa - auch bei Bildungsmigrantinnen.

Die vorliegende Arbeit beschäftigt sich mit der aufenthalts- sowie sozialrechtlichen Stellung nicht erwerbstätiger Unionsbürger im EU-Ausland. Im ersten Teil der Arbeit soll zunächst geklärt werden, welche Rechtsgrundlage einem nicht erwerbstätigen Unionsbürger ein Freizügigkeitsrecht einräumt bzw. welche Voraussetzungen für das Bestehen eines rechtmäßigen Aufenthalts in einem anderen EU-Mitgliedstaat erfüllt werden müssen. Der zweite Teil der Arbeit widmet sich sodann der Frage, ob ein nicht erwerbstätiger Unionsbürger, der sich in einem anderen EU-Mitgliedstaat aufhält, in diesem auch in den Genuss von Sozialleistungen kommen kann. Im Bezug darauf wurden gerade in den letzten Jahren wesentliche Entscheidungen getroffen, die für mehr Klarheit hinsichtlich der sozialrechtlichen Stellung nicht erwerbstätiger Unionsbürger im EU-Ausland gesorgt haben. Der Fokus des zweiten Teils der Arbeit ist deshalb auf die Analyse der aktuellen Rechtsprechung des Europäischen Gerichtshofs gerichtet. ; The following dissertation concerns the legal status of unemployed European Union (EU) citizens and their right of residence in other EU member states. This also invokes questions regarding their access to social contributions. Initial attention investigates the legal basis of the right of free movement within the EU and further discussion provides insight into the necessities required in order to maintain residence in the host member state. The second part of this dissertation examines the question whether a non-active EU citizen, who already resides in another EU-member state, can claim social contributions in the host member state. Essential decisions have consequentially been taken in the last few years so that the non-active EU citizens social status is better defined.
