Die Frage, ob Privatpersonen unmittelbar an die Europäischen Grundfreiheiten gebunden sind, die Frage also ob diese Bestimmungen unmittelbare Drittwirkung entfalten, wurde in den letzten Jahren intensiv und kontroversiell diskutiert. Der Gerichtshof der Europäischen Union (EuGH) sprach in dieser Hinsicht der Arbeitnehmerfreizügigkeit (Art 45 AEUV), der Niederlassungsfreiheit (Art 49 AEUV) und der Dienstleistungsfreiheit (Art 56 AEUV) unmittelbare Drittwirkung zu. Im Gegensatz dazu lehnte der EuGH die unmittelbare Drittwirkung der Warenverkehrsfreiheit (Art 34 AEUV) ab, ohne diese unterschiedliche Behandlung zu rechtfertigen oder näher zu erläutern.Diese Arbeit will einen Beitrag dazu leisten, den differenzierenden Ansatz des EuGH zu beleuchten und der Frage nachzugehen, welche Rolle das Konzept der unmittelbaren Drittwirkung im Rahmen der Warenverkehrsfreiheit einnimmt, einnehmen kann bzw. soll.In dieser Arbeit wird die Auffassung vertreten, dass auch der Warenverkehrsfreiheit unmittelbare Drittwirkung zuzuerkennen ist. Zum Einen wird dies durch das Erfordernis eines kohärenten Systems der Grundfreiheiten begründet und durch eine Untersuchung des Wesens und der Systematik der Grundfreiheiten und der Judikatur des EuGH zur unmittelbaren Drittwirkung untermauert. Zum Anderen wird die Forderung der Warenverkehrsfreiheit unmittelbare Drittwirkung zuzuerkennen durch eine eingehende Interpretation des einschlägigen Primärrechts gerechtfertigt. Es wird gezeigt, dass das Konzept der unmittelbaren Drittwirkung, wenn dieses in differenzierter und ausgewogener Weise im Bereich der Warenverkehrsfreiheit angewandt wird, eine notwendige und sinnvolle Weiterentwicklung dieser Grundfreiheit darstellt, die es insbesondere ermöglicht auf Entwicklungen wie der Verschiebung von Regelungsbefugnissen vom Staat zu ?Privat? adäquat zu reagieren. ; The question whether and to what extent private actors are directly bound by the provisions on free movement of the EU Treaties, or in other words the topic of horizontal direct effect, has in the last years been subject to intensive and controversial academic debate. The Court of Justice of the European Union (CJEU) has in this regard developed a line of jurisprudence where it has attributed horizontal direct effect to the free movement of workers (Art 45 TFEU), the freedom of establishment (Art 49 TFEU) and the free movement of services (Art 56 TFEU). In sharp contrast, the CJEU has rejected to apply the free movement of goods (Art 34 TFEU) horizontally directly to the conduct of private actors, not explaining the reasons for this different approach. This thesis wants to contribute to understanding the CJEU?s differentiating approach and to answering the question what role horizontal direct effect does play, can play and should play in the free movement of goods. In this thesis it is argued that there are compelling arguments for attributing Art 34 TFEU horizontal direct effect: There is on the one hand the claim for a coherent approach to horizontal direct effect in free movement law, a claim based on an analysis of the nature of the fundamental freedoms and the Court?s case-law on horizontal direct effect, which shows that there are no legal reasons to exclude Art 34 TFEU from its attribution. On the other hand the substantiation of horizontal direct effect of the free movement of goods is derived from EU law, building on and around an effet utile argument as its cornerstone. Die grenzüberschreitende Mobilität der Patienten wirft zahlreiche Rechts- und Wirtschaftsfragen auf. This article deals with the conditions and limitations to the right to reside and of freedom of movement recognized to third country nationals who are family members of an EU citizen. With its decision in the Zambrano case, the Court of Justice of the European Union decided that the status of citizen of the European Union produces its effects, initially limited to cross-border situations, also in purely domestic ones. Children with the citizenship of the European Union who are dependent of a parent with third country nationality would be forced to leave the territory of the European Union in case of refusal of their parent's application for the right of residence. They would thus be deprived of the substance of the rights conferred on them by virtue of their status as citizens of the European Union. The scope of said rights as recognized to a third country national member of the family of a citizen of the European Union depends on the determination of the substance of the rights conferred by the status as citizen of the European Union. The post-Zambrano case-law will be examined in order to determine the extent and limitation thereof.

Cet article analyse les dimensions historiques de la différenciation dans le cadre des discussions interinstitutionnelles pour établir la libre circulation des personnes dans l'UE. Il souligne le rôle du Parlement européen (PE) dans ce domaine, de la création de l'espace Schengen en 1985 jusqu'à 2015, en passant par des moments décisifs de la fin de la guerre froide et de la construction européenne. Tenant compte de l'importance de la différenciation « verticale » pour cette étude de cas, il aborde également les conséquences diachroniques de la centralisation du pouvoir au sein de différents secteurs d'intervention publique interconnectés.

Jan Cremers contributed to a thematic issue of the German journal WSI Mitteilungen. He addressed the question of how the EU framework Directive and other Directives in the field of health and safety at the workplace have fared alongside the internal market.

The present thesis dealing with the free movement of lawyers both with respect to EU law and its implementation in Slovakia consists of two parts, the first part dealing with the recognition of diplomas and professional qualifications and conditions of exercise of the profession of lawyer and the second part concerning the provision of services by and establishment of lawyers. Thanks to the initiatives of the EU legislator, but also of EU courts, migration of lawyers in the internal European market has been largely facilitated, whilst preserving the guarantees of quality of legal services provided by migrating lawyers in the EU. As far as the Slovak rules on the profession of lawyer are concerned, these are largely consistent with the EU legal framework. Nonetheless, certain provisions of Slovak law transposing the EU acquis do not seem to be precisely transposed and consistent with the corresponding EU rules. ; La présente thèse traitant de la libre circulation des avocats tant du point de vue de la réglementation de l'Union que de sa mise en œuvre en Slovaquie comporte deux parties, la première traitant de la reconnaissance des diplômes et des qualifications professionnelles et des modalités d'exercice de la profession d'avocat et la deuxième relative à la prestation de services et à l'établissement des avocats. Grâce aux initiatives du législateur, mais aussi du juge de l'Union, la migration des avocats dans le marché intérieur européen a été largement facilitée, tout en préservant les sauvegardes de qualité des services juridiques prêtés par les avocats migrants dans l'Union européenne. S'agissant de la réglementation slovaque de la profession d'avocat, celle-ci est largement conforme au cadre juridique de l'Union. Néanmoins, certaines dispositions du droit slovaque transposant l'acquis de l'Union ne semblent pas être précisément transposées et conformes à la réglementation de l'Union correspondante.

S'il est acquis que le principe de la portabilité du statut personnel gagne en puissance, à travers différents vecteurs, la question des limites à cette portabilité demeure entière. La contribution avance que l'abus de droit peut constituer une limitation opportune, à préférer à la fraude à la loi.
