8e et dernière version ; International audience ; Le présent ouvrage établit une synthèse de plusieurs centaines de documents portant sur les différents traités de libre-échange en cours de négociation, abandonnés ou en vigueur : traités entre l'Union européenne et le Canada, entre l'Union européenne et les États-Unis, entre l'Union européenne et l'Afrique, Accord sur le commerce des services, mais aussi traité nord-américain ALENA, entre autres. La diversité des sigles cache de nombreux points communs : l'élimination des droits de douane, l'harmonisation des normes techniques, des règlements et des lois dans les domaines les plus divers en donnant la priorité aux droits des multinationales sur les droits sociaux ou environnementaux, avec en filigrane la fin programmée des services publics si ces traités entraient en vigueur. Le troisième point commun de ces traités est la volonté d'instaurer une « justice » extraordinaire, privée, pour juger des différends des multinationales envers les États, régression historique essentielle. Nous examinerons ensuite les garanties des droits mises en avant par les traités et notamment par le traité euro-étasunien, avant de faire le point sur les avantages socio-économiques attendus. Leur dernière caractéristique et non la moindre est l'opacité voulue des négociations au regard des citoyens en contraste flagrant avec la part essentielle qu'y prennent les grandes multinationales. Après quelques propositions sémantiques visant à privilégier l'information sur le marketing politique, la conclusion s'attachera à comparer les objectifs annoncés et les objectifs sous-jacents avant de tracer quelques pistes pour permettre aux citoyens de prendre en main leur avenir plutôt que de le laisser aux bons soins des multinationales.

International audience ; Several large treaties are being negotiated or ratified today: between the European Union and the United States or Canada, the Trade in service agreement, three projects between EU and Africa, or the Transpacific agreement. We evaluate the methods of the many socio-economic impact studies of these treaties. Most of them take into account only the direct costs for the companies and not the external costs, social or environmental, which are much higher. The environmental impacts are taken into account only through sustainability impact assessments, whose input data are results of socio-economic impact studies. These impact assessments, in their most serious part, translate the economic impact assessments into impacts on pollutant emissions, consumption of raw materials or waste generation through inventory methods. But an inventory is only the first phase of an impact assessment. These studies try also to assess the impacts on other environment and sustainability aspects, as biodiversity, culture, inequalities, etc. but with a biased strictly economic rationality, without drawing on the variety of disciplines necessary for such exercises. ; Plusieurs traités de grande envergure sont actuellement en cours de négociation ou de ratification : entre l'Union européenne et les États-Unis ou le Canada, l'Accord sur le commerce des services, trois projets de traités entre l'Union européenne et l'Afrique, ou le traité transpacifique. New generation of free trade agreements (CETA, TTIP, agreements with Singapore, China, Vietnam, Japan i.e.) are the expression of the objective of making the European Union a global international actor. The external action of the Union is however dependent on the principle of conferral and the division of competences with its Member States. It results from Opinion 2/15 of the Court of Justice that the EU competence to conclude the free trade agreement with Singapore is not exclusive, as long as provisions concerning non-direct investments and dispute settlement fall under the shared competence of the Union and its Member States. The limits of the Union's external competence and the conclusion of a mixed agreement jeopardise the effectiveness of the Union's external action. However, the objective of an efficient external action allows a novel interpretation of the scope of the Union's competence in the field of common commercial policy, comprising sustainable development provisions, as well as of the conditions of exercise of shared external competences.

With a view to intra-regional trade integration, African countries have decided to create an African Continental Free Trade Area (ACFTA) which should establish the rules and political guidelines necessary to promote intra-regional trade but the success of such political choice is conditioned by the degree of complementarity between the economies of these countries as well as their establishment in a win-win approach. In order to assess the prospects for the creation of the ACFTA and specifically on the Moroccan economy by integrating the specificities and potentials of African countries, the estimation of the potential has, however, shown the existence of a significant global potential for Morocco which can be exploited. To do this, the implementation of the ACFTA should allow the dismantling of tariff and non-tariff barriers under the condition of a great diversification of Moroccan products exported regionally which is necessary. The empirical study by integrating the gravitational model and economic variables for the period 2001-2019 on a sample of 50 African countries has made it possible to detect a potential to be exploited but the experience of failure of the already existing interregional communities presupposes a structural transformation of a commercial order, piloting by better diversity and integration of the production chain reinforced by good infrastructure and logistics, and of a political order by boycotting with historical factors and individualism for the benefit of a goal and a lucrative common identity for all countries. ; En vue d'une intégration commerciale intra régionale, les pays africains ont décidé de créer une zone de libre échange continentale africaine (ZLECA) qui devrait instaurer les règles et les orientations politiques nécessaires pour promouvoir le commerce intra régional, mais le succès d'un tel choix politique est conditionné par le degré de complémentarité entre les économies de ces pays, de même que leur instauration dans une approche gagnant-gagnant. Dans un objectif d'évaluer les perspectives de la création de la ZLECA et spécifiquement sur l'économie marocaine en intégrant les spécificités et les potentialités des pays africains, l'estimation du potentiel a montré toutefois l'existence d'un potentiel global important pour le Maroc qui peut être exploité. Pour ce faire, la mise en œuvre de la ZLECA devrait permettre le démantèlement des barrières tarifaires et non tarifaires sous condition d'une grande diversification des produits marocains exportés régionalement ce qu'est nécessaire. L'étude empirique par l'intégration du modèle gravitationnel et des variables économiques pour la période 2001-2019 sur un échantillon de 50 pays africains a permet de détecter un potentiel à exploiter, mais l'expérience d'échec des communautés interrégionales déjà existantes supposent une transformation structurelle d'ordre commerciale, piloter par une meilleure diversité et intégration de chaine de production renforcée par des bonnes infrastructures et logistique, et d'ordre politique en boycottant avec les facteurs historiques et l'individualisme au profit d'un but et d'une identité commune lucrative à tous les pays.
