The foundation of international organizations has created the need to employ in their offices qualified persons who, with the time passing, were called international civil servants. The legal status of international civil servants, their place in the organization and the role played towards member countries, is the subject of the present work. The origin of international civil servants goes back to the 19th c. administrative unions but it was only the League of Nations which accepted this situation. Its full development took place, however, in the latter part of the 20th c., in the period of the so-called organizational revolution. International law and sometimes also the domestic law of the states define the rules of employing civil servants in the organizations. They formulate both the conditions which the candidate for the civil servant must fulfil and the types of his connections with the organization (Chpt. II). International civil servants enjoy the rights and appropriate duties (Chpts. Ill and IV). Their content and scope is the result of, first of all, the internal regulations of the organization, sometimes enriched by the rules of the law of the host state. The rights and duties of civil servants are accompanied by the privileges and immunities — facilities necessary to perform their duties in the organization (Chpt. V). The activities of civil servants may lead to conflicts with organization authorities. To protect their interests civil servants may make use of either administrative procedure stipulated in the inner law of the organization or submit the existing controversy to the competent judicial agency, i. e. administrative tribunal (Chpt. VI). The work closes with considerations on the independence of international civil servants towards the countries they are citizens of (Chpt. VII). And although the rule of independence of civil servants is confirmed by the statutes of particular organizations, still the activities of some countries are threat for this independence.
This article attempts at analysing the current and drafted legal regulations concerning courtexecutive officers and execution as well as the civil procedure as regards the court executive officers'legal status. Allowance is made for their hybrid position in the system: on the one hand, they performpublic authorities' functions; on the other hand, they conduct activities in a self-employed capacity,based on full business risk related e.g. to the high personnel and material costs.
The article describes the manner in which three Polish theater plays portray functionaries of the communist state. Two of the plays are television productions: Norymberga by Wojciech Tomczyk (2006) and Kontrym by Marek Pruchniewski and Marcin Fischer (2011). The third play, Kochałam Bogdana W., by Paweł Kamza (2006), was produced by the Łaźnia Nowa Theater, Cracow–Nowa Huta—the venue situated in the vicinity of the place where, in 1982, a young man had been shot by a Public Security officer. The negative protagonists of the history of the Polish People's Republic are depicted not as demoniac characters but rather as ordinary individuals driven by their personal and professional ambitions and obediently working for the state whose aim was to keep the society under total control. The actors' interpretations of the parts of the communist functionaries reveal their psychological and intellectual characteristics. Theatrical performances similar to the productions discussed in the paper make it possible for audiences to gain an insight into closed milieus of the communist state services. ; W artykule omówiono zachowania funkcjonariuszy komunistycznego państwa pokazane w trzech sztukach teatralnych. Dwie z nich to spektakle telewizyjne: Norymberga Wojciecha Tomczyka (2006) oraz Kontrym Marka Pruchniewskiego i Marcina Fischera (2011). Trzecie z wybranych do analizy przedstawień, Kochałam Bogdana W., zrealizował Paweł Kamza w nowohuckiej Łaźni Nowej (2006), położonej blisko miejsca śmierci młodego człowieka od kuli kapitana SB w roku 1982. Negatywni bohaterowie historii PRL-u nie wykazują cech demonicznych, lecz są przedstawiani jako ludzie przeciętni, kierujący się ambicjami osobistymi i zawodowymi. Wykonują posłusznie pracę na rzecz państwa, którego celem była pełna kontrola nad społeczeństwem. Aktorska konkretyzacja postaci odsłania psychologiczne i intelektualne cechy funkcjonariuszy. Dzięki przedstawieniom takim, jak omawiane w artykule realizacje, odbiorca uzyskuje wgląd w zamknięte środowisko komunistycznych służb państwowych.
The article discusses the issue of the fulfillment of compulsory military service by officers of the security apparatus. The author analyzes documents issued by both the Ministry of Defense and the Ministry of Public Security and points out that exemption from military service may have encouraged some officers to join the security services in the 1940s.
Diplomatic representatives and communist functionaries from People's Republic of Poland towards political development in Slovakia in the period of Czechoslovak reform in the years 1968–1969(Summary)Slovakia and the structures of Communist Party of Slovakia (CPS), local branch of statewide Communist Party of Czechoslovakia (CPC), played an important role in the period of attempts to reform the communist political system in Czechoslovakia in the years 1968–1969. The effort to gain an equal position to Slovakia in the common state catalyzed the crisis in the ruling establishment that led to election of Slovak communists' leader Alexander Dubček to the post ofFirst Secretary of CC CPC. Dubček became a symbol of reform movement in the party. In Bratislava he was succeded by Vasil Biľak, one of the main supporters of Warsaw Pact's military intervention in Czechoslovakia. After invasion in the August 1968 the leadership in CPS was taken over by Gustáv Husák, who suppressed the freedoms in Slovakia, and after becoming First Secretary of CC CPC in April 1969 continued the "normalization" in the rest of the country. The situation in Slovakia was observed by the diplomats of People's Republic of Poland and functionaries of Polish United Workers' Party especially from regions bordering with Slovakia, who maintained contacts with Slovak comrades. A lot of attention to Slovak problems was given by Władysław Kruczek, First Secretary of Rzeszów Voivodship party organization, who obtained news about situation in neighbouring country from the communists of Eastern Slovakia. The documents are bringing a lot of detailed information, reveal the backstage of some aspects of Czechoslovak politics. They are reflecting the mood in Slovakia, especially among the party functionaries at different levels, but are presenting ideologically deformed outlook and are written from the standpoint that was inimical to democratic changes, which were described accordingly to official attitude as a work of "reaction" and "zionists". The information sent to Warsaw supported the opinion of PUWP leadership that the Czechoslovak reform must be stopped, because it is dangerous to the monopoly of communist power in the whole Soviet block.

Polska Policja jest uzbrojoną i umundurowaną formacją służącą społeczeństwu. Jej zadania związane są w głównej mierze z zapewnieniem bezpieczeństwa i porządku publicznego. Funkcjonariusze Policji pełniący służbę w strefach przygranicznych realizują także zadania związane z ochroną granicy państwowej. W artykule, na podstawie analizy obowiązujących aktów prawnych, przedstawiono zagadnienia dotyczące ochrony granicy państwowej realizowane przez polską Policję. Szczegółowo omówiono zadania, jakie realizują funkcjonariusze Policji w ramach współpracy ze Strażą Graniczną (dalej jako: SG). Przedstawiono także sposoby przygotowania funkcjonariuszy Policji do pełnienia służby na obszarach przygranicznych. W artykule przytoczono również przykłady współpracy funkcjonariuszy Policji i SG, których efektem było wykrycie i zatrzymanie sprawców przestępstw oraz zabezpieczenie nielegalnego towaru oraz towaru bez wymaganych prawem polskich znaków akcyzy. Celem artykułu było przedstawienie ważnej roli Policji w ochronie granicy państwowej. Przedmiotem rozważań uczyniono zjawisko współpracy polskiej Policji ze SG we wszystkich możliwych obszarach związanych z ochroną granicy państwowej. Na podstawie analizy zgromadzonej literatury przedmiotu w rozważaniach przyjęto hipotezę, że polska Policja pełni istotną rolę w ochronie granicy państwowej.
Podstawowym zadaniem powstałej w 1919 r. Policji Państwowej jako organu wykonawczego władz państwowych i samorządowych była ochrona bezpieczeństwa, spokoju i porządku publicznego. Sytuacja polityczna, jaka wytworzyła się na początku XX w., spowodowała, że funkcjonariusze tej formacji nie tylko zapewniali bezpieczeństwo wewnętrzne, lecz także brali czynny udział w obronie zagrożonej niepodległości. Dzięki ich postawom, m.in. w listopadzie 1918 r. oraz podczas wojny polsko-bolszewickiej, społeczeństwo postrzegało polskich policjantów jako patriotów.

Artykuł prezentuje wyniki badań własnych mających na celu zidentyfikowanie psychospołecznych zagrożeń zawodowych obecnych w izolowanym środowisku pracy, jakim jest zakład karny. Badania dotyczyły funkcjonariuszy działu ochrony, którzy mają najbardziej intensywny kontakt z osadzonymi. Ten dział odpowiedzialny jest za bezpieczeństwo nie tylko osadzonych, ale także pozostałych pracowników jednostki penitencjarnej. To wszystko powoduje, że funkcjonariusze działu ochrony narażeni są na wiele stresorów zawodowych, których często nie można wyeliminować, dlatego pozostaje jedynie niwelowanie skutków ich działania.
The article addresses the notary's systemic position under the first Polish Law on Notaries of 27 October 1933. The analysis of the position of the notary carried out in part one of this article pointed to serious difficulties in the precise defining of this position, both among the scholars in the field and the judicature. To precisely define the systemic position of the notary, part two has provided an analysis of the provisions of the Law on Notaries regarding the professional self-government of notaries, supervision over notaries and their activities, disciplinary liability and compensatory liability of the notary, and the rules of preparation for the profession of notary. The analysis of the Law on Notaries of 1933 presented in the first and second part of this article, leads to the conclusion that the notary's position included in its legal position a combination of features of a public officer and a liberal profession. The legislature, using in Article 1 the term "public functionary", and not "state official", and giving notaries in Article 23 of the Law on Notaries the legal protection enjoyed by state officials, wanted to clearly emphasize the existing differences between them while at the same time underlining their close relationship to the state. The adoption of such a definition made it possible to grant notaries a wide range of powers. At the same time, it provided the basis to establish a professional self-government and entrust its bodies with significant powers in the area of disciplinary jurisdiction. The dualistic approach to the position of the notary was also reflected in the separate rules of training for the profession and in the special rules of notary's liability for damages. The state, by entrusting notaries with activities related to non-contentious judiciary, secured for itself an exclusive influence on the staffing of notary positions and covered the system of notaries by a strict supervision exercised by the Minister of Justice. The discussion presented in the article leads to a conclusion that the legislature approached the position of a notary in the Law on Notaries of 1933 in a special way, creating a combination of official and professional elements, which can be called a public function. In terms of the political and administrative system, regardless of the definition itself, the notary in practice performed the function of a person of public trust. ; Artykuł dotyczy problematyki pozycji ustrojowej notariusza na gruncie pierwszego polskiego Prawa o notariacie z dnia 27 października 1933 r. Dokonana w części pierwszej opracowania analiza pozycji ustrojowej notariusza wykazała istnienie poważnych trudności w precyzyjnym jej określeniu, zarówno wśród przedstawicieli doktryny, jak i judykatury. W celu precyzyjnego określenia pozycji ustrojowej notariusza w części drugiej przeprowadzono analizę postanowień Prawa o notariacie dotyczących samorządu zawodowego notariatu, nadzoru nad notariatem i notariuszami, odpowiedzialności dyscyplinarnej i odszkodowawczej notariusza oraz zasad przygotowania do zawodu notariusza. Przedstawiona w obu częściach artykułu analiza przepisów Prawa o notariacie z 1933 r. prowadzi do wniosku, że stanowisko notariusza zawierało w swoim położeniu prawnym połączenie cech urzędniczych i cech wolnego zawodu. Prawodawca, używając w art. 1 określenia "funkcjonariusz publiczny", a nie "funkcjonariusz państwowy", oraz nadając notariuszom w art. 23 Prawa o notariacie ochronę prawną przysługującą urzędnikom państwowym, chciał wyraźnie zaakcentować istniejące między nimi różnice, a zarazem podkreślić ich bliski związek z państwem. Przyjęcie takiej definicji umożliwiło przyznanie notariuszom szerokiego zakresu kompetencji. Jednocześnie stworzyło ono podstawy do powołania samorządu zawodowego oraz powierzenia jego organom istotnych uprawnień w zakresie sądownictwa dyscyplinarnego. Dualistyczne ujęcie stanowiska notariusza znalazło odzwierciedlenie również w odrębnych zasadach przygotowania do zawodu oraz w szczególnych zasadach odpowiedzialności odszkodowawczej notariusza. Powierzając notariuszom czynności należące do sądownictwa niespornego, państwo zapewniło sobie wyłączny wpływ na nadawanie posad notariuszom oraz poddało notariat ścisłemu nadzorowi Ministra Sprawiedliwości. Przedstawione w opracowaniu rozważania prowadzą do wniosku, że prawodawca ujął w Prawie o notariacie z 1933 r. stanowisko notariusza w sposób szczególny, stwarzając syntezę pierwiastków urzędniczego i wolno-zawodowego, którą można określić mianem funkcji publicznej. W zakresie ustrojowym, niezależnie od samej definicji, notariusz w praktyce pełnił funkcję osoby zaufania publicznego.
Bezpieczeństwo jest wartością nadrzędną każdego człowieka. Od początku życia staramy się podejmować działania w sposób bezpieczny. Niewątpliwie znaczenie bezpieczeństwa jest dość szerokie i definiowane wielowymiarowo. Jednakże, aby czuć się bezpiecznie, organy do tego powołane muszą stać na straży ustawowych zadań. Ważnym elementem w tej materii jest również sam funkcjonariusz, który powinien zapewnić sobie odpowiednie bezpieczeństwo. Artykuł ukazuje znaczenie odpowiedniego przygotowania policjantów do realizacji zadań służbowych i rolę posiadanych przez funkcjonariuszy środków przymusu bezpośredniego. Wartością dodaną są przedstawione wyniki badań uzyskane w ramach realizowanego zadania badawczego.
Odpowiedzialność konstytucyjna należy do kanonów rozwiązań konstytucyjnych współczesnych państw demokratycznych. Jedną z jej cech pozostaje osobisty i ograniczony podmiotowo charakter. Wśród podmiotów podległych kognicji Trybunału Stanu, zgodnie z regulacją polskiej konstytucji, znajdują się jednakowoż funkcjonariusze państwa, wchodzący w skład kolegialnych organów państwa. Stąd zasadnym jest postawienie sobie pytań o możliwość pociągnięcia ich do zindywidualizowanej w swej formie odpowiedzialności konstytucyjnej za działania podjęte z naruszeniem prawa przez kolektywny organ państwa, którego z mocy prawa integralną część stanowią, i o przedstawienie zapatrywań przedstawicieli doktryny prawa konstytucyjnego na powyższe zagadnienie.

The subject of consideration and analysis in the article is, among others, an assessment of a legislative process related to the creation of the National Revenue Administration, and a subsequent pragmatics relating to its HR and payroll policy. Studies have shown that a reform of the government administration of public levies in the field of the so-called consolidation of the tax administration, customs service and fiscal control has not been adequately prepared. In this respect, the Author identified main shortcomings of that reform, supporting his views with empirical material. ; Przedmiotem rozważań i analiz w artykule jest m.in. ocena procesu legislacyjnego związanego z utworzeniem Krajowej Administracji Skarbowej wraz z następczą pragmatyką kadrowo-płacową w tym obszarze. Przeprowadzone badania wykazały, że reforma rządowej administracji danin publicznoprawnych w zakresie tzw. konsolidacji administracji podatkowej, służby celnej oraz kontroli skarbowej nie została należycie przygotowana. W tym zakresie autor wskazuje główne jej mankamenty, popierając swoje tezy materiałem empirycznym.
